Good morning, everyone. The Committee on Streets and Services is now in session. In attendance are Councilmembers Mariano, Clarke, Ortiz, Wilson Goode, and myself, the chair, Councilman DiCicco. Also in the chamber today is Councilman Nutter and Councilman James Kenney. Councilman Kenney is visiting today and now he's leaving. The clerk will read the title of the first bill.

Before we begin, we have three bills being held by the respective sponsors: Bill 14 010556, Bill 010574, Bill 010507. The first bill before the committee will be 010091, an ordinance amending Section 9-205 of the Philadelphia Code, entitled "Sidewalk Sales," by prohibiting sidewalk sales within the area bounded by Oregon Avenue, Packer Avenue, Seventh Street and 20th Street and within an area bounded by Oregon Avenue, I-95, Front Street and Seventh Street; all under certain terms and conditions (Witness comes forward.)

Good day, Councilman DiCicco and members of the committee. I am Otis Haigler, Jr, Regulatory Affairs Manager for the Department of Licenses and Inspections. Today I am here to provide testimony on Bill 010091, which, if enacted, will prohibit sidewalk sales within the area bounded by Oregon Avenue, Packer Avenue, Seventh Street and 20th Street within the area bounded by Oregon Avenue I-95, Front Street, and Seventh Street. With respect to this bill, the Department offers no objections and is prepared to enact its provisions should the bill be signed into law. Thank you. Good morning. My name is Charles Denny, and I'm the Assistant Chief Traffic Engineer, and I'm here to testify on Bill 010423. The Streets Department has no objections to this bill but we do recommend that the regulation be posted under a trial ordinance. A hearing will be held in six months and area residents will have opportunities to comment on the regulation at that time after seeing how the regulation operates. We can have the signs posted within three weeks, with Councilman Mariano's approval. Also, the text of the bill needs to be 7 10/30/01 STREETS & SERVICES - BILL 010423 amended to indicate that the east intersection on Nester Street and Welsh Road is the western limit. They are two intersections of Welsh and Nester.

Mr. Denny

Good morning again, Chairman and members of the committee. My name is Charles Denny, the Assistant Chief Traffic Engineer and I'm here to testify on Bill 010499. The Streets Department has objections to this bill. The Pennsylvania vehicle code requires 8 10/30/01 STREETS & SERVICES - BILL 010499 PennDOT to develop regulations governing traffic-control devices. These regulations apply to all public highways, and Pennsylvania and the City Solicitor has ruled that the Streets Department is legally obligated to comply with the vehicle code and PennDOT regulations. PennDOT's Subchapter G of Publication 201 covers restrictions of vehicles by size and weight. This regulation requires that vehicles only be restricted based on engineering or traffic conditions. There is no engineering or traffic condition that will allow us to restrict the three streets mentioned in the above regulation. This complaint is based on paratransit buses which use 51st, Nevada, Dauphin, and 52nd Street to make a U-turn to pick up disabled passengers in the 5100 block of Wynnefield Avenue. This bus makes two to four trips per day to pick up or drop off passengers. We have sent a letter to the company asking them that the bus use a different route. The traffic engineering staff has not been able to observe whether or not the bus is using this route recently. We do not know if this proposed regulation 9 10/30/01 STREETS & SERVICES - BILL 010499 is still necessary. We can, however, post a less restrictive prohibition that prohibits the bus from making this through-the-neighborhood trip without violating the above-mentioned regulation. This involves posting a no-left-turn bus prohibition at the intersection of 51st Street with Nevada and with Dakota Streets. This prohibition does not require an ordinance of Council, nor is it in violation of the State vehicle code. These signs could be posted within three weeks if Councilman Nutter indicates that they are required.

Thank you, Mr. Chairman. Mr. Denny, I appreciate your testimony and I think I would only ask that given the time that we've been working on this, this suggestion that you make today, or the proposed solution, was not offered in any of the previous discussions I had with the various personnel at the Streets Department. I would certainly not want to be a person to potentially violate the State vehicle 10 10/30/01 STREETS & SERVICES - BILL 010499 code, notwithstanding the many problems that it presents to us here in Philadelphia. Let me just ask you a couple questions with regard to your proposal. Are you saying that you would be able to post the appropriate sign, whether it's a left turn or a right turn or any other kind of turn, to cover the various streets that are proposed to be covered by the original intention of the ordinance?

Mr. Denny

We can post two no-left-turn signs at the intersection of 51st with Dakota and at 51st with Nevada.

Councilman Nutter

Okay, what happens with Dauphin?

Mr. Denny

Nevada and Dakota both feed into Dauphin; it forms a Y.

Councilman Nutter

No, I understand that. Then what about anything coming in from the Dauphin Street side off of 52nd Street?

Mr. Denny

The bus in question doesn't use Dauphin Street that way. It turns on 51st Street, turns onto Nevada, then goes up Dauphin to 52nd Street, turns onto 52nd Street, and then turns onto Wynnefield to be in the 5100 block of 11 10/30/01 STREETS & SERVICES - BILL 010499 Wynnefield Avenue.

Councilman Nutter

Okay. And you indicate that you estimate that it will take three weeks to post the signs? Why will it take three weeks?

Mr. Denny

Well, we said we could do it within three weeks. We could possibly do it sooner.

Councilman Nutter

Okay, all right. Mr. Chairman, based on that testimony as well as the letter from the Streets Commissioner, I would certainly like to be as cooperative as possible while at the same time getting relief for my constituents. This particular bus company has not been particularly cooperative with the constituents out there, and whether they have possibly temporarily ceased this activity because of intense scrutiny by the City or not, I would still like to see the signs posted. Also, there was one error in the bill and I'd at least like to have that error -- it was our mistake, have it corrected so that we have a fully correct bill, even if it is going to sit in committee for some period of time. What I would like to do is have the option 12 10/30/01 STREETS & SERVICES - BILL 010499 to have the signs posted, give the Streets Department that opportunity, leave the bill in committee in the corrected version, and if for some reason this proposed solution does not work out, I still have the option to utilize the full weight of the law with regard to this particular matter. I'm certainly willing to be cooperative and give it a chance, but I'd also like to keep my options as flexible as possible.

Okay. So you want to offer the changes for the record now?

Councilman Nutter

Yes. Mr. Chairman, in Section 1, after the capital letters reading "no through-buses," presently the bill reads, "Dakota Street from 5nd Street." What I would like to do is delete "Dakota," and that should read "Dauphin."

Councilman Dicicco

So noted.

Councilman Nutter

Okay. And if we could have those amendments made and moved at the appropriate time, I'm willing to leave the bill in committee with a commitment from Mr. Denny that in no more than three weeks, and as quickly as possible, the signs will be posted. 13 10/30/01 STREETS & SERVICES - BILL 010499

My name is Nancy Sen and I'm an engineering supervisor with the Streets Department, and I'm here to reiterate my testimony on Bill 010503, which was previously made on October 2nd on behalf of the Streets Department. This bill grants permission to Sunesys to install a new aerial and underground fiber optic system in the public right-of-way. Two routes are 27 10/30/01 STREETS & SERVICES - BILL 010503 proposed for the project, a northern and western route. Both routes begin at the Telecom Hotel at 401 North Broad Street and run to the City limits in two directions. These routes will link Sunesys facilities in Delaware and Montgomery Counties with Center City. The routes are primarily aerial on existing PECO and Verizon poles, with a small portion underground in either other existing utility or a proposed new conduit to be constructed by Sunesys. The Department reviewed the proposed route and gave preliminary plan approval, verifying that this plan will not conflict with proposed street construction. Therefore, the Streets Department has no objection to the passage of the bill.

Again, my name is Nancy Sen. I'm here to testify on behalf of Bill No. 010506 for the Streets Department. This bill grants permission to Sunesys to install new area lines on existing PECO and lease existing PECO conduits based to create a telecommunications backbone between the Board of Education administration buildings and several public high school buildings within the City. Sunesys has been awarded a contract by the School Board to provide a fiber optic network. This project is financed and guided by a federal grant program. Under the terms of the grant money, Sunesys must own the system and lease it out to the school system. Construction must be completed by this calendar year for the School Board to security the grant funding. The Department reviewed the proposed route 30 10/30/01 STREETS & SERVICES - BILL 010503 and gave preliminary plan approval verifying that the work will not conflict with proposed street construction. Therefore, the Streets Department has no objection to the passage of the bill.

Good morning, chairman and members of the committee. Again, my name is Nancy Sen and I'm here to testify on Bill No. 010573 on behalf of the Streets Department. This bill authorizes RCN to install a combination underground aerial fiber optic route within the public right-of-way. RCN's route can be broken down into two pieces, converging at the Telecom Hotel, 1t 401 North Broad. The first route travels northwest from 401 North Broad out to the City limits at Montgomery County, near Ridge Avenue, and then continues on to their home office in Trooper, PA. This route totals approximately 15 miles and is completely aerial within the City 34 10/30/01 STREETS & SERVICES - BILL 010573 limit. Southwest from 401 north Broad out to the City limits. The second route travels southwest from 401 North Broad out to the City limits at Delaware County, near 65th Street. This route totals approximately five miles and is a mix of underground and aerial facilities. Beginning at 401 North Broad Street, the route travels in Level 3 underground facilities to a point near the intersection of 38th and Sansom Street. At this point, the route transitions to aerial facilities running on existing Verizon and PECO poles out to the City limits. The Level 3 portion of the RCN route is authorized under Level 3's proposed bill, 010574, which is being heard before the committee today also. The Streets Department has reviewed the two routes for installation within Philadelphia and given their preliminary approval.

We are seeking to connect from 401 North Broad Street to our Trooper facilities from a long-distance switch at 401 North Broad. And there are just two things I'd add to Ms. Sen's excellent summary. First of all, I've submitted written testimony, which covers in particular detail the streets and the details of our construction. I would add that we do not plan to dig in the City streets and would use existing conduit, which would eliminate our need for added underground construction. This bill authorizes Level 3 to install an underground fiber optic route within the public right-of-way consisting of eight 1-1/4-inch ducts along with manholes and other appurtenances. The request for this ordinance came as a result of Level 3's previous ordinance, No. 990606, which never became law. Note that this route is an offshoot of the metro route constructed under Bill 980336, which was passed previously by Council. It begins at an existing Level 3 manhole on their metro route located on Walnut Street, just west of 24th Street, then continues west out to the City limits near City Line Avenue. The Departments of Streets has reviewed the route for installation within Philadelphia and given their preliminary approval.

My name is Terry Nolen and I'm the producing artistic director of the Arden, located at 40th North Second Street, here to provide a little bit of background on the Arden. Over 82,000 people attended a performance at the Arden this past year, giving us the second highest audience base among the region's nonprofit 40 10/30/01 STREETS & SERVICES - BILL 010607 theaters. Our relocation to Old City six years ago has helped to fuel the economic growth of this neighborhood. Over restaurants have opened since 5 we have moved there. The Arden employs about 250 6 full- or part-time employees each season, for a 7 total personnel budget of $1.4 million. 8 We've spent a considerable amount of time 9 and resources over the six years renovating the 10 building at 49 North Second Street. Currently, we 11 are making building upgrade that improve our 12 visibility and presence in Old City, including the 13 new marquee.
