Good morning, Chairman and committee members. My name is Charles Denny. I'm the assistant chief traffic engineer and I'm here to testify on Bill 010525. The Streets Department has no objections to this bill, but we do recommend a regulation be posted under a trial ordinance. A hearing could be 4 10/2/01 STREETS & SERVICES 010525 held in six months, and area residents and businesses will have an opportunity to comment on this regulation at that time after seeing how the regulation operates. The actual text of the posting will be "No 7 Truck Parking Anytime." We can have the signs posted within three weeks, with Councilwoman Tasco's approval.

Bill No. 010503, an ordinance granting permission to Sunesys Incorporated, its successors 5 10/2/01 STREETS AND SERVICES - 010503, 506 and assigns to construct, maintain and operate, replace and remove a telecommunications system along, over, in, and under the public rights-of-way, City streets, and private property, subject to permission of the property owner, or attached to or within the facilities of other entities holding a grant to other City ordinances, subject to each owner's consent, all under certain terms and conditions.
Okay. Good morning, Chairman and members of the committee. My name is Nancy Sen. I'm an engineering supervisor for the Streets Department and I'm here to testify on Bill No. 17 010503 on behalf of the Streets Department. This bill grants permission to Sunesys to install a new aerial and underground fiber optic systems in the public right-of-way. Two routes are proposed for the project: A northern and western route. Both routes begin at the Telecom Hotel, 1t 401 North Broad Street, and run to the City limits in two directions. These routes will link Sunesys facilities in Delaware County and Montgomery County 6 10/2/01 STREETS AND SERVICES - 010503, 506 with Center City. The routes are primarily aerial on existing PECO or Verizon poles, with a small portion underground in either existing utility facilities or proposed new conduit to be constructed by Sunesys. The department reviewed the proposed route and gave preliminary plan approval verifying that this work will not conflict with proposed street construction. Therefore, the Streets Department has no objection to the passage of this bill.

Thank you. Aerial is obviously the least expensive route for a utility company. Was there an alternative? Could this -- without major excavation, were their facilities available, conduit, that this could have gone underground?
I believe that they had approached PECO, which they have an alliance with, a corporation alliance, about trying to get more conduit to pull through. However, in order to get from Point A down to Point B in Center City, they 7 10/2/01 STREETS AND SERVICES - 010503, 506 weren't able to find continuous conduit, so they would -- they would actually have to do a few blocks and then construct a few blocks. It would be piecemeal like that. So it's a little less disruptive to the communities to, you know, not have that construction, the trench construction going on to use the pole lines.
But if they could in certain blocks put it underground if the facilities were available, wouldn't we want to -- wouldn't we strongly recommend that as much of this go under that's humanly possible?
I believe that until you get into the Center City confines, there's no real law that, you know, we can direct to telecom companies to use underground. Until you --
Have you ever suggested to Council to have a law that would give you -- empower you to say that if facilities are available that we force them underground?
I definitely know that that is a 8 10/2/01 STREETS AND SERVICES - 010503, 506 part of the right-of-way ordinance that's to be introduced this session, that whole concept. So --
Because, you know, it seems as though we're going the other way. There's been for years efforts to put as much of this underground as possible. And once this goes aerial, it will never go underground.
Again, we don't have a tool that we can say when the companies come to us, and we do hope that legislation will definitely address that issue.
I had heard it was coming in between now and Thanksgiving, so I -- we only hope here, also in the Streets Department because it will make managing the companies coming in here, you know, a little bit better.
If there was a delay on this, this new legislation would be applicable to this request?
The problem we're having is that -- I shouldn't say "a problem." It's 9 10/2/01 STREETS AND SERVICES - 010503, 506 a very sensitive issue and it's a very broad issue to deal with. The legislation is being worked on. Every so other than when we think we have it finalized, theres another question that comes up either from the Administration or the Solicitor's Office, with all good intentions. So we're really working through that whole process. We hope to have it introduced in the next four weeks or so. But even at that, if we were to introduce it in the next four weeks, given the likelihood of the -- given the fact that we're coming up along with the holiday season break, we probably wouldn't get to this legislation until sometime in the spring, and I don't know if we want to hold this company responsible to wait that long 'cause we still don't know the outcome of the bill eventually. So I just -- to give you background, we are working on a bill which I intend to introduce in the next two to four weeks, okay? Thank you. Councilman Rizzo, are you through?
That's a fair explanation, but I would hope that this legislation 10 10/2/01 STREETS AND SERVICES - 010503, 506 occurs, but anything that's on the drawing board right now I would hope would be considered or held if it's not an immediate emergency to get this facility in, because in our neighborhoods, there's nothing worse than having all of these aerial facilities if the facilities to put them underground are available.

I just want to let you know that I'm going to ask that this bill be tabled. Lots of the area, the geographic area that you're talking about is in my Councilmatic District, and I need to meet with them to gain more information.

Okay. Nancy and Councilwoman Miller, I think you might want to hear this. As the chair of the Streets and Services Committee, I assume that's the reason why these types of bills get sent to my office for introduction. And I guess, you know, there's always a learning experience in this job. What I would appreciate in the future, if it's not already being done, is that a copy of that ordinance be submitted to the District Councilperson in whose district such 12 10/2/01 STREETS AND SERVICES - 010503, 506 a bill would take effect.
In the absence that I forget to do that or something. The normal chain is that the Streets and Services chair gets these bills. So we could avoid any delay in the future, I think that's the appropriate thing to do. So between your office and my office, we should make certain that the District Councilperson gets a copy.
Yeah, we'll follow up. We usually tell the company to make sure they touch base, but that's not a fail-safe system so --
Yeah, and I think that they probably mean well but they're going to go through the process. And I guess that's the way things have been done around here for a very long time, and it doesn't mean that we can't change some of the habits we've had and improve it, at least the communication between our offices
Okay. The only thing I will mention, and it's sort of related to a bill that we're going to here testimony on, to the other Sunesys bill, that's actually done. They're 13 10/2/01 STREETS AND SERVICES - 010503, 506 contractors for the School District and they're trying to wire, you know, in a network several high schools in the -- you know, within Philadelphia. And that's -- the lines that they're putting in for a portion of this bill we're talking about now are going to serve as like the arteries. And then the lines that they're putting in for the other bill might be, you know, the capillaries that go out to the schools. So I just bring that up because I know they're under -- they're doing that project for the school system under a grant, and in order to get monies, they're supposed to construct it by this fiscal year. So, again, I wish there were someone here from Sunesys to bring those points up.
Okay. So what we'll do, Nancy, again, without trying to create any hardship for the companies, since we're going to have another hearing in about two weeks, I'm going to hold Bill No. 010503.

Bill No. 010505, an ordinance 3 authorizing Irvin Bruskin, owner of the property 2451 South Fifth Street, Philadelphia, Pennsylvania, 19148, to construct and maintain a fence for a Dumpster enclosure on the east footway of South Fifth Street, adjacent to the property, all under certain terms and conditions.
Good morning, Chairman and members of the committee. My name is Nancy Sen, and I'm an engineering supervisor for the Streets Department, and I'm here to testify on Bill No. 13 010505 on behalf of the department. This bill authorizes Irvin Bruskin, owner of the property 2451 South Fifth Street, Philadelphia, PA, 19148, to construct and maintain a fence for a Dumpster enclosure on the east footway of South Fifth Street, near the intersection of Porter Street. The fenced-in area for the Dumpster encroaches approximately four feet into the east footway of Fifth Street, leaving approximately eight feet of unobstructed footway. The fence is to be a Cyclone-type with colored slots and will be approximately four feet high. All of the encroachments leave adequate width 16 10/2/01 STREETS AND SERVICES 010505 and clearance of unobstructed footway. Therefore, the Streets Department has no objection to the passage of the bill.
Thank you. And Nancy, again, this is a bill that's in my district and I'm familiar with the business. Do we have any standards as to the materials that are used for Dumpster enclosures? Or is that basically left on an individual basis?
Yeah, it's pretty much -- what we would look at is not so much the materials, but height and, you know, depending on where it's located, that it's not obstructing, especially at a corner property. But I understand that you had actually encouraged the property owner to think about materials, and we don't have any standards, but it would be great if we could work together to make sure that something like that happens because some of the enclosures look like garbage.
Yeah, I know, very unattractive. In fact, they look worse than the Dumpster when they're done. In my district in particular, I know the 17 10/2/01 STREETS AND SERVICES 010505 issue of Dumpsters has been around a long time, even longer than I've been here. And I notice that when it comes to food establishments in particular, where there's a Dumpster that is necessary for the business, there are some that are very attractive, that look like an extension of the building, and you wouldn't even know it's an enclosure for a Dumpster.
And then there are others that use the typical Cyclone fence and put some of that weed material in it, and although it camouflages the Dumpster, it may not lend to the attractiveness of the aesthetics of the surrounding area. And even more importantly, there's an issue of sanitation. I have a friend who has a restaurant, and he built an enclosure that is a part of the building with two metal doors, and you would not know what's behind those metal doors except that he has his trash cans in there. He doesn't even have a Dumpster. So six nights a week, the trash hauler comes at a certain time after the restaurant closes to remove it. And he actually has hot and cold running water in that area to keep it clean, to 18 10/2/01 STREETS AND SERVICES 010505 keep odors down. And there are other places that have similar type of businesses, restaurant businesses, that do the Cyclone fencing enclosure, and they try to camouflage it, but the grease is running out onto the sidewalk, rodents are coming in and out, and I won't mention the place, but they really try, but there's not much you can do if it's left open and exposed. So I'd like to work with you. Maybe we can figure out something that we could --
Actually, this bill came up, you know, late in the last session, and I would suggest that, you know, work through L&I and perhaps even the Art Commission. I mean, sometimes they don't look at things like that, but if they were brought into the fray, you know, they would certainly -- I mean, they might end up having a large hurdle but there's not much out there other than L&I enforcement that they could add that we in Streets could look at, you know.
Okay. I'd like to work on that, and I know that in some cases, it's just not practical to build an enclosure because the 19 10/2/01 STREETS AND SERVICES 010505 sidewalk doesn't allow that encroachment. In fact, some places don't even have a sidewalk at all, so it may not be a standard that we can apply all over, but maybe we can have a set of standards that on case-by-case basis standards we can apply. I think there's a health issue here as well.
Now, if there's any problems with that, I do know that L&I, you know, has issued violations to see Dumpsters for, you know, some of the other issues -- maybe not the look of it, but if anything streaming out from that enclosure, I mean, maintenance of it.
Yeah, they just put one up about a block from where I live in a neighborhood bar, and there's this huge Dumpster sitting out on the sidewalk. It's -- you know, we don't allow residents to keep trash containers outside except for trash day but, you know, it's kind of like a --
I'm wondering if you could -- I mean, I know you have an alliance of people in the restaurant industry. If you could just get, like, costs to -- you know, from the Cadillac down to the Cyclone fence and get that out to the people who 20 10/2/01 STREETS AND SERVICES 010505 own, you know, restaurant properties.
Because if they see that the cost is not that much, then it might just happen on its own to make, you know, their setting look better and attract more customers.
I think your point, Councilman DiCicco, is a very good one. And recently, I saw a situation where there was a Dumpster fire. And I think that a standard should be established because flammable fencing should be avoided because the actual enclosure became a part of the fire. So when that standard's developed, it will possibly eliminate any wood or flammable materials being used for those enclosures, because the Fire Department pointed out that the fire spread as a result of the enclosure.
