last name is byer b-y-e-r right do you swear or affirm to tell the truth the whole truth and
nothing but the truth i do our vice chair has a few questions for you i'm sorry i hate to interrupt
carol mr byer please turn on your video at this time how do you turn the video on hit your camera
look at the bottom of the screen beside the microphone you see a camera got it there we go
thank you sir thank you very much hi mr byer have you emailed the exhibit packet with the
required documents consisting of proof of ownership proof of tax compliance a copy of
the refusal or referral photos and or plans of the property five days in advance of this hearing
and have you met with the RCO
and do you have a letter?
Yes, I do.
Okay, you may proceed and share your screen
which is already up.
Thank you.
Yes, my wife and I are looking to add a deck
to the rear of the house.
As most of the people in the neighborhood
that have decks have broken out the back wall
to have access to the deck.
We just installed recently
energy efficient doors on in the entire house there's three of them living room dining room
living room kitchen and basement um we would like to use the rear door out off the kitchen
that would go out to a small walkway i think it's three and a half feet wide um out to the deck
um that's number one and number two on the uh refusal is uh actually a mistake the uh l and i
i have a letter or an email copy of an email from them from the uh l and i saying that it was a
mistake so i can i have i have that on this i can bring that up on the screen also um that's
pretty much it um we we really don't want to put another hole in the back of the wall
excuse me sir do you have pictures i'm sorry you have pictures yes yes i have pictures
one he shows the pictures and if you have like drawings what you're going to do too
or is this already done did you already do it all right we'll start with number
there's the letter of from the homeowner association
there's a picture of the house our house
um we want to come out that the middle door there's one in the front one in the middle
and one in the basement we want to come out the middle door out to the deck behind the house
um we already have plans
there's the plans there's one page
the first the first one says alley it's uh that's the driveway that's that's existing
the second one is the i think it's the
that's the one with the deck that's the first floor
uh excuse me the deck has not been built no it has not no thank you
um so we want to excuse me it's a deck has not been built why can't you build it according to
the code well we again we don't want to knock a hole in the back wall and since we've already
had energy efficient doors put in uh and it would be convenient just to go out the door and out the
side and down a walkway to the deck.
I don't get the relationship with the energy efficient doors.
This is Margaret Breyer. We're interested in doing this because
Wait a minute, wait a minute, wait a minute, wait a minute, wait, wait, wait, wait, wait.
So if your wife wants to testify, I just have to swear right now.
Okay. So why don't you just state your name,
and spell it for the court stenographer
and I'll swear again.
Margaret Byer, M-A-R-G-A-R-E-T
capital B-Y-E-R.
Right.
Right. Do you swear for him to tell the truth, the whole truth, nothing but the truth?
Do you swear for him to tell the truth,
the whole truth,
nothing but the truth?
Proceed.
We don't want to break through the wall because we have a huge window that's actually we'd have to take out at great expense and then make a bigger hole in the wall.
So we're trying to eliminate doing that by just going out the back door, making a small walkway and go onto the patio.
The back window that we have put in our house previously is five feet by five feet, and what we're doing is overlooking Pennypack Park, our home backs into Pennypack Park, and we would like to be able to enjoy the park that we have access to.
all right if i excuse me if i understand correctly
decks are not allowed inside yards so you'll be using your side yard
technically if you look at the picture of the house the side yard it's it's just a walkway
we want and you see where the steps are we want to come out the back door have a small walkway
over the steps that are already there
on to the deck above the
garage and the back door.
So we're not
technically I know what you're saying
but there is no real
backyard. We just want to
expand
over the steps.
Excuse me.
But that back door is your exit.
We have another exit.
If you look further down
there's another exit.
but you should but you should have two exits i didn't know our architects felt that this was
appropriate so yeah but you have an exit in the front too right okay okay so so let let me ask
you one question um hillary do we need an updated tax balance document too
no that's no that's that's fine i just checked that because one had been
okay good it's fine thank you all right so what what you're saying is you want to build out that
back door with a walkway that'll take you to the deck and the real reason you're doing it like that
is because you don't want to take that new window out that you put in okay all right questions from
the board nodded off no no mr chairman questions or comments from the virtual audience
i see no hands mr chair planning commission uh ron benton our city planning
uh the property is indicated for residential use on the city plan given the physical
circumstances of the site and surrounding neighborhood context we recommend the
request of variance for granted. Thank you. MI 2021-003-344-1217 Stanwood Street. I vote yes.
