Good morning. This is the public hearing on the Committee of the Streets and Services. With me today are Councilmembers Cohen, Rizzo, Miller and Darrell Clarke. I'm the Chair, Councilman DiCicco. The Clerk will call the first bill. As is standard in this Committee, we will generally bring the witness for the Parking authority or -- no parking today? Okay.

Bill No. 000016, an ordinance establishing a no parking regulation on both sides of the 4300 block of Belgrade Street from 100, from 100 feet south of Gillingham Street to where Belgrade street dead-ends south of Gillingham Street.

Good morning, Councilman DiCicco, Honorable Members of City Council. My name is Steve Lorenz, I'm with the Streets Department, Traffic Engineering and I will be presenting Bill 23 No. 000016. Councilman DiCicco, with reference to Bill No. 000016 proposing to establish a no parking regulation on both sides of the 4300 block of 4 Bill No. 000017 Belgrade Street from 100 south of Gillingham Street south to the end of the street, the following report is submitted: Belgrade street is feet wide, 5 two-way with parking on both sides. In June of 1998 6 traffic engineering posted on a trial no parking 7 from 6:00 p.m. to 6:00 a.m. on the east and west 8 sides of the 4300 block of Belgrade Street. This 9 was done in response to a request from Councilwoman 10 Krajewski on behalf of her constituents. This 11 regulation has been in event for several months 12 without any complaints, to our knowledge. 13 Therefore, the Streets Department has no objection 14 to this proposed ordinance. 15

I'm hear to introduce Bill No. 000017, which is an ordinance authorizing Catherine Aviles, owner of the properties 256-258 East Allegheny Avenue, Philadelphia, PA, to construct and maintain a two-story building addition onto and over the south footway of Allegheny Avenue adjacent to the property 256 East Allegheny Avenue, all under certain terms and conditions.

Good morning, the Honorable Frank DiCicco, Members of City Council, ladies and gentlemen. My name is Mark Washington Streets Department, Traffic Engineering. I'm the district traffic engineer for the City's 4th Traffic District. Councilman DiCicco, with reference to bill 000018 proposing to establish a no truck parking regulation on the north and south sides of Arrott Street in from Leiper Street to Oakland Street the following report is submitted: Arrott Street is approximately feet wide one-way 19 westbound with parking on the north side only. The 20 Streets Department has no objection to this proposed 21 ordinance. 22

Bill No. 000087, an ordinance amending Section 2 of an Ordinance (Bill 14 No. 970348) approved July 1, 1997, entitled an ordinance authorizing and directing the revision of lines and grades on a portion of City Plan No. 58 of an area bounded by Poplar Street, 12th Street, Parrish Street and Watts Street, by revising the lines and grades of Odgen Street from Watts Street to 13th Street and by striking from the City Plan and vacating Myrtle Street to 12th Street to Watts Street, all under certain terms and conditions, including the dedication to the City of the unopened portions of the widened portions of Odgen Street by extending the period for compliance with the 9 Bill No. 000087 authorization conditions therein.

Good morning, Mr. Chairman, Members of the Committee. My name is Paul Lonie, Survey Bureau Manager of the Department of Streets. The Department of Streets would like to offer the following testimony on Bill No. 000087: This is not an administration ordinance but an ordinance 9 requested by William McDowell, the Philadelphia Redevelopment Authority. The purpose of this ordinance is to extend the expiration date of an ordinance approved July 1, 1997. The purpose of that ordinance was to grant the authority to widen Odgen Street and strike Myrtle Street as part of the West Poplar Phase 2 development. This ordinance is supported by the Department of streets and is recommended to Committee for favorable action.

Bill No. 000026, an ordinance amending Section 14-1607 of the Philadelphia Code, entitled "Special Controls for the Center City Commercial Area" by providing that nothing in that section shall prohibit the maintenance of licensed sidewalk cafes along certain portions of Chestnut Street and Walnut Street and amending Section 9-208 of The Philadelphia Code entitled "Sidewalk Cafes," by requiring the main restaurant to use more than percent of its 18 interior gross floor area for seating and that all 19 food be served on non-disposable containers. 20

Good day, Councilman 23 DiCicco, and Members of the Committee. I am Otis 24 Hagler, Jr., Legislative Regulatory Affairs Manager 25 for the Department of Licences and Inspections. 11 Bill No. 000026 Today I'm here to provide testimony on Bill 000026 amending Sections 14-1607 and 9-208 of the Philadelphia Code to permit sidewalk cafes on Chestnut and Walnut Streets between Broad and 18th Streets. The Department of Licences and Inspections offers no objections to the passage of this bill. The bill as introduced by Councilman Clarke is an extension of a previous administration Bill No. 990726 which was passed by Council on December 16, 1999 and signed by Former Mayor Rendell on December 30, 1999. Bill 000026 if enacted will not impact negatively on the Department's ability to enforce the requirements of the bill. This concludes my testimony, I will be happy to answer any questions at this time. Thank you.

Thank you, Mr. Chair. Mr. Chair, I'd like to offer an amendment to this bill based on recommendations by the Law Department. What we'd like to do is on No. 19 on re-number that to No. 20. On , delete 12 Bill No. 000026 Section 2 in the italics and C.

We want to delete 2 and delete the italics and C. We're going to add Section A to under 5, maintenance of sidewalk cafes. It will read as "Licensee shall maintain the sidewalk cafe in accordance with all City, State, and Federal laws, as well as any rules and regulations which pertain to the use of sidewalk cafe including but not limited to any and all City Code rules and regulations as may be required by the Department of Fire, Police, Health, Streets, Licenses and Inspections." And under new Section B, it says all food served from sidewalk calf and the following locations shall be served on non-disposable containers. And add "And no sidewalk cafes shall be in the following locations unless such cafe is directly abutting the restaurant with more than 22 percent of the interior gross floor area used for 23 seating." 24 That's it, Mr. Chair. 25

Good morning, Mr. Chairman and Members of the Committee. For the City Planning Commission, my name is Thomas Chapman. The Planning Commission has not consider this bill specifically. However, the Planning Commission did consider Bill 9 No. 990726 on December 2, 1999. That bill contained the same provisions that are in Bill No. 000026. The Planning Commission had recommended that the previous bill be approved. There were some -- we became aware of some concerns of area residents. It's my understanding that those concerns have been addressed with the amendments that Councilman Clarke included in 000026, and the Planning Commission's recommendation was that the bill be approved.

Councilman Di Cicco

Just for my clarification, Bill No. 000026 as amended, would that -- that does not alter what was passed on December 2, '99, does it?

Mr. Chapman

No. 23

It's consistent with that.

Mr. Chapman

Yes, it's consistent with 14 Bill No. 000026 that. It merely expands the area.

Councilman Di Cicco

Okay, I just wanted to make sure that we were not having two sets of sidewalk cafe bills basically for the same type of environment which is Center City. I don't want to have any confusion as the east side versus the west side.

Mr. Chapman

Don't want to make things more difficult than they already are.
