Good morning, everyone. This is a continued public hearing of the Rules Committee on Bill No. 010014. Do we have any witnesses to testify? (No response.)

Okay, the Chair then recognizes Councilman O'Neill.

Madam Chair, I'd like to offer the following amendment to Bill No. 12 010014. Under Section 14-203, Section 1, subsection (g), I'd like to offer the following language, additional language. And the language is, following the word "children" in Line 1 of subsection (g), the language would be added: "except that for properties within the 6th and 10th Councilmatic Districts, family day care may only be provided to four or fewer children." And that would be the end of the amendment. The paragraph would be the same at the end of that. And we have copies that were handed in.

Okay. Are there any questions from members of the 3 5/9/01 - RULES - BILL 010014 committee? The Chair recognizes Councilman DiCicco.

Thank you, Madam President. And my question is to Councilman O'Neill. Did the Law Department issue an opinion on this, you know, as a concern that if you exclude a district or districts, would it interfere with the legislation, as it did with the abatement bill? Remember the --

I had this prepared by Mr. Rick Auerbach from our staff, and he was pretty comfortable with it and he knew about the taxation issue involving the uniformity as different than are overlays. This is basically a zoning overlay for this bill.

Councilman Dicicco

Okay.

Councilman O'Neill

And I also forgot to mention that I've worked this out with the sponsor of the legislation on behalf of myself and Councilwoman Krajewski. And we will be supporting the bill as amended wholeheartedly.

It has been moved and seconded that Bill No. 010014 be reported out of committee, as amended, with a favorable recommendation, and that the rules of Council be suspended so as to permit first reading at our next Council session.
