Can I ask my friend and colleague, Councilman O'Neill, to... He and I started a conversation stated - 6/21/04 before we entered chambers. And I was wondering if he can hold the bill, and maybe we can talk this up a little bit more, and talk with the Health Department and see if we can come up to some agreements on this bill.
Madam President, I thought I had mentioned to you this morning -- but if I didn't make it clear I'd like to now -- I think the Health Commissioner and Health Department are receptive to amendments, particularly those that would geographically help areas that have historically had farm animals, particularly chickens, geese, and ducks, from a culturally historical background. But the Commissioner had said, if contacted by Council members about any geographical amendment, understanding it is our last session, none of this could take effect until September.
And that's what I'm asking, if you can hold it off. Maybe we can work out those details. I'm'a get stated - 6/21/04 you a rooster.
If I can finish. He is... I would ask that -- He is not going to enforce this bill in any area where there's an amendment coming forth over the summer to be introduced in the fall. But there are areas where people, particularly in the Bustleton section -And that's what generated this bill and this legislation, where people can't open their windows and their doors to their house because of the offensive odors. And it was that the Health Department asked me to make the bill broader. But at the same time, they recognize there may be some narrowing, particularly in some areas. And they're not out to over enforce the bill, if there's amendments intended on it. So I would ask, if it doesn't pass today, people will be spending another summer with odors that are just intolerable. And you wouldn't want and I stated - 6/21/04 wouldn't want them to have to do that. But at the same time, this isn't a Health Department that wants to run roughshod over people with a history of using these animals properly. And I think over the summer we can work out amendments. But I would ask you to support the bill in its present form so that people don't have to wait three months to get the kind of relief they need. There's no intention to -
I understand. That I can't do for you because on the other side of this argument is that there are people in different parts of the City that actually take very good care of animals, such as chickens and ducks. And I know of a lady -- a group of people that have this nice little place where they have air conditioning. While they don't have air conditioning inside their home, they had air conditioning out there. And the treatment of their -- of these animals are like pets to them. stated - 6/21/04 And I think that there's, more importantly, there's health concerns and we have to address the health concerns. So, again, I humbly submit that you be able to hold up on that bill that we can tell the Health Department anyone who's stinking up a neighborhood should be reported anyway. So, you can always -- we can always report areas where people are presenting health hazards, and report them anyway, instead of making it law.
Councilman, I can only tell you it was the Health Commissioner in the Health Department that told me in order to effectively enforce the situation in Bustleton, which is your area as well, that they needed this bill. But they are very aware of the kind of situations you're talking about. I had not heard about the air conditioning, but certainly had heard some really good stories about people that are good neighbors with their farm animals. And stated - 6/21/04 there's no intention here to affect that.
My wife won't let me bring a rooster home to raise, but I'll be glad to give you one if you want to raise one.
Thank you. Sorry I can't help you because of the last session.
Thank you. The Chair recognizes Councilman Kenney.
You didn't think I recognized you there, huh? I think you wanted to cast a vote for bills that you were not present.
Thank you, Madam stated - 6/21/04 President. I would like to be voting aye on all bills that I missed while out of the chamber.
