Good afternoon. Thank you all for your patience. We would like to convene the Finance hearing with regard to Bill 5 030611. Will the Clerk please read the title of the bill?

Bill No. 030611, an Ordinance amending Bill No. 030003 (approved June 5, 2003), entitled "An Ordinance to adopt a Fiscal 2004 Capital Budget," by providing for certain terms and conditions relating to the 2004 Capital Budget.

Thank you very much. If there are no opening statements, we will call on Maxine Griffith. Now, I know you're not Maxine, but certainly we welcome you here to present testimony on behalf of the Administration.

Thank you. Good afternoon, Councilwoman Blackwell and Members of City Council. My name is Gary Jastrzab. I'm the Director of the Strategic Planning and Policy Division at the City Planning Commission. I'm here today for Maxine Griffith, the Executive Director of 4 10/08/03 - FINANCE - BILL 030611 the City Planning Commission and Secretary for Strategic Planning who was called away to another meeting. I appear before you today to offer testimony on Bill 030611, which proposes to amend Bill 030003, the City's Fiscal Year 2004 Capital Budget. Today we propose to amend this measure to add Section 2, entitled "General Provisions." Due to a printing error, the Fiscal Year 2004 Capital Budget Ordinance, Bill 030003, passed by City Council on May 29, 2003, and signed by the Mayor on June 5, 2003, inadvertently omitted Section 14 2, the standard General Provisions included each year in the Capital Budget Ordinance. As with the Operating Budget Ordinance, the General Provisions section of the Capital Budget Ordinance delineates certain conditions under which the Capital Budget is implemented. Specifically, the provisions authorize the Director of Finance and the City Controller to approve capital expenditures in accordance with the purposes approved by the loan authorization and to prohibit spending of any appropriation that is not financed. The General Provisions also allow the 5 10/08/03 - FINANCE - BILL 030611 Director of Finance to make adjustments between approved projects within certain prescribed limits. These provisions further permit the Director of Finance to change a funding source administratively. This flexibility is particularly useful when the City receives unanticipated state or federal grants. With that, I'd be happy to answer any specific questions that Council may have related to the proposed amendment as presented. And if I also may request that Council suspend the Rules so that this bill may be passed as soon as possible.
