Council President Clarke

The Chair recognizes Councilman Oh.

Councilman Oh

Yes. May I be heard on this matter?

Council President Clarke

Absolutely, sir.

Councilman Oh

Thank you very much. Council President, last week I was looking at an article online and something caught my eye at the bottom of Stated Meeting March 9, 2017 3/9/17 - STATED - 2ND READING the page, and it was entitled "Among Porn Scandal Casualties: Four Who Didn't Send a Single E-Mail." It was an article written and published November 23rd of last year, 2016, by Craig McCoy and Angela Couloumbis. Well, I hope I pronounced that wrong -- correctly, but Couloumbis, I think. Anyway, the article states that two years ago, then-Attorney General Kathleen Kane staged one of the most unusual public gatherings in the history of Harrisburg. She summoned reporters to a room to examine pornographic e-mails found on her agency's computers and named eight officials. The impact was swift and nasty. Reputations were tarnished. Five people lost their jobs. Careers were thrown off track. On Tuesday, Kane's successor, Attorney General Bruce Beemer, said Kane had been on the wrong side -- or had been wrong to single out eight, when hundreds of government workers had received Stated Meeting March 9, 2017 3/9/17 - STATED - 2ND READING offensive e-mails, including more than 350 in her agency alone. And as it turned out, her sister, a high-ranking officer in the Attorney General's, had not only received but forwarded and sent these e-mails. After Beemer's remarks, Mark W. Tanner, a lawyer for several of these men, criticized Kane and said that her misinformation was accepted at face value when distributed by Kane and her operatives for political retribution. The follow-up investigation found that there was a core group of 38 former and current officials who were identified as high volume senders who had sent 50 or more troubling e-mails outside the agency. Of the eight named by Kane, none of them were in this high volume group. In particular, three of them, including Patrick Blessington, did not originate or forward a single troubling e-mail. The issue had gained a lot of Stated Meeting March 9, 2017 3/9/17 - STATED - 2ND READING attention. We ended up with what we have. The Attorney General has been prosecuted. Two Supreme Court Justices have stepped down. As the investigation found, 350 members of her office had received, forwarded, sent these e-mails, which were and are troubling. Justice should be fair, and Pat Blessington has been a career public servant, very respected for his work and his fairness, and his reputation as one of three people in this city has been tarnished to an unjust level. I introduced this resolution to recognize his good work. Let me say people have asked me what is my relationship with Patrick Blessington. I don't hang out with him. I hardly see him. I worked with him for about two and a half years, in 1986 and '87 and part of 1988. I know Pat Blessington to be a very decent person, a very quiet person, a methodical, hard-working person who Stated Meeting March 9, 2017 3/9/17 - STATED - 2ND READING spent many weekends, holidays, and late nights working on his cases. I know him to be a person who has spent money out of his pocket to help victims of crime. I know that he put on the Santa Claus suit to go into poor African American neighborhoods to hand out toys. And I know him, above all, to be a person who I respect, because there is a very important principle in the prosecutor's office and, that is, prosecutors should not be persecutors. And so a prosecutor has an ability when the evidence shows that there is not a reasonable cause of action to null prosse the case, even against their supervisors' wishes that they should move forward and prosecute. Patrick Blessington is a person who if the evidence shows that there should not be a prosecution, he will not move forward on a baseless case. For that reason, I do submit this resolution, and I thank you very much. Stated Meeting March 9, 2017 3/9/17 - STATED - 2ND READING

Council President Clarke

Thank you, Councilman. The Chair recognizes Councilwoman Gym.

Councilwoman Gym

Thank you very much, Council President. You know, as all of us who hold higher an elected office, we understand the context and nature of our responsibilities and the role, most importantly, that we play in the very public eye. This scandal involving these communications that were all over the state department involved attorneys and judges and included their female staff, and they were shocking, to say the least. They violated the public trust and they certainly compromise the integrity of those who were either receiving or passing them along. And in the face of those kinds of harassing types of things, men simply cannot remain silent or passive when faced with such e-mails that came through. They have to speak up. Stated Meeting March 9, 2017 3/9/17 - STATED - 2ND READING People have to push back. Otherwise, these behaviors persist, as they persisted in the state as long as they did, and they are being tacitly endorsed by those who stayed silent when those things happen. I would have loved to have seen a resolution for the women who are negatively impacted by the horrible pornography e-mails that went around, and I would have loved to have seen a resolution or a statement from these men who publicly denounced it and what they could have done to combat what essentially became a deeply destructive and hostile work environment. But we didn't, and thus I am unable to support this resolution.

Council President Clarke

Thank you, Councilwoman. The Chair recognizes Councilman Jones.

Councilman Jones

I agree with my colleague who said men can't be Stated Meeting March 9, 2017 3/9/17 - STATED - 2ND READING silent. I don't think we should reward behavior that you should do anyway. You should not be sexist. You should not persecute through prosecution. You should not do those things. And to say that somehow even if it was just about an individual doing the right thing, that they should be recognized in a Council resolution. This morning I come into my office, my legislative aide is in tears, in tears. Having a good feeling about the Women's Day celebrations and honoring power in women, only to be crushed by having to bring to me a resolution honoring someone allegedly that had dishonored women. Even if they are innocent, you don't need a proclamation to say I'm innocent. Just go about being the enlightened male that you should be. So I want to thank my female colleagues, Councilwoman Reynolds Brown, Cherelle Parker, Jannie Blackwell, Maria Quinones-Sanchez, Cindy Bass, Helen Gym, Stated Meeting March 9, 2017 3/9/17 - STATED - 2ND READING for keeping this body of enlightened men and making sure that as sometimes we can be offensive, we are corrected. As men, we can be knowingly offensive and sometimes as men we can be unknowingly offensive, but enlightened men make the conscious decision to know the difference from right and wrong and act accordingly. There are those who know that they are offensive and say and perform rude acts, like catcalling, like referring to women as honey or baby. And then there are those who do not know they are being offensive because of their unfamiliarity with women's values. That is an evolving thing. But once we know that you're being offensive to any group, we should make a conscious choice to hold ourselves accountable to that knowledge and grow. The evolution of growth of men is driven by the knowledge and awareness obtained from women in their lives. So I will not be supporting Stated Meeting March 9, 2017 3/9/17 - STATED - 2ND READING that resolution. (Applause.)

Council President Clarke

Thank you, Councilman. The Chair recognizes Councilwoman Bass.

Councilwoman Bass

Thank you, Mr. President. Let me start by saying David Oh is my good friend, but I will not be supporting his resolution either. And I did have an opportunity to speak with the Councilman about it. And, you know, we all make decisions. We all have an opportunity to decide where we're going to be on the side of history and whether we're going to be on the right side or the wrong side of history, and I think that this particular person has made his decisions along the way by choosing not to speak out. And it doesn't matter that you did not send an e-mail. It doesn't matter that you were only a recipient. The e-mails were so offensive -- I viewed Stated Meeting March 9, 2017 3/9/17 - STATED - 2ND READING them. They were so beyond just being sexist. They were racist, they were homophobic, and there's just no place for this kind of material to be circulating. You know, no matter what you think of Kathleen Kane, I have to say that if it was not for her and her actions, we would know absolutely nothing about what has been happening in these offices for years. This isn't something that just happened that she stumbled across one or two e-mails. There were hundreds of e-mails that were actually circulated. And so I just wanted to lend my voice to my colleagues that have decided not to support this particular resolution and say that this is not I think something that's appropriate for this body. Thank you, Mr. President.

Council President Clarke

Thank you, Councilwoman. The Chair recognizes Stated Meeting March 9, 2017 3/9/17 - STATED - 2ND READING Councilwoman Reynolds Brown.

Councilwoman Brown

Thank you, Mr. President. It's 2017, and the sad news is that we have to have this type of debate in a legislative body. For those of us who are mothers, we need to underscore. For those of us who are fathers of girls, we need to put what Councilman Jones has said in capital letters. For those of us who care about women being treated in a respectable, honorable mention, everything that has been said needs to have 15,000 exclamation points behind it. It's a sad day when we have to have a debate in a legislative body about the conduct that has been referred to. And so as a mother of a 20-year-old, I will not be supporting this resolution.

Council President Clarke

Thank you, Councilwoman. The Chair recognizes Councilman Johnson. Stated Meeting March 9, 2017 3/9/17 - STATED - 2ND READING

Councilman Johnson

Thank you, Council President. Council President, Dr. King once said, In the end, we will remember not the words of our enemies, but the silence of our friends. I will be voting no on this resolution. Thank you, Council President.

Council President Clarke

Thank you, Councilman. The Chair recognizes Councilman Oh.

Councilman Oh

Thank you very much. The actions that were committed by hundreds of government officials was shocking and problematic, including supervisors, high court members, their staffs and others. However, the face of that activity was placed upon a person who did the minimal and may not have done more, we don't know, simply receiving e-mails. And I would say that when I saw the article, I was surprised, because you Stated Meeting March 9, 2017 3/9/17 - STATED - 2ND READING can go through pages of Google and read all kinds of untrue statements about what his conduct was. And this article I appreciate, whether it registers or not with anybody else, that clarifies that his conduct was -- his computer received e-mails and he has been unjustly vilified, in my opinion. And I am pleased at any time to have this opportunity regardless of the outcome to let people know that he is a good person, a good professional, and a good public servant. I will also say for those who are upset, you should have something to be upset about. Don't turn to facts and make it fit the claim. And if you'd like to continue to vilify the person, he is not able to defend himself. Every one of us elected officials have been vilified in one sense or another, but we're public officials and we can defend ourselves. So we'll take the vote. I certainly appreciate everybody's opinion. Stated Meeting March 9, 2017 3/9/17 - STATED - 2ND READING I respect your opinion. This is my opinion and I stand by it. Thank you.

Council President Clarke

Thank you, Councilman. The Chair recognizes Councilman Green.

Councilman Green

Thank you, Council President. I respect Councilman Oh's right to have an opinion. However, I disagree with the resolution and will not be supporting it. I served as both a prosecutor here in the District Attorney's Office and also in the Attorney General's Office, and someone that has that responsibility as a prosecutor to represent the citizens of the jurisdiction where they live to do justice, regardless if that person just received information, and as a member of the Bar, they have a responsibility, from my perspective as a prosecutor, to uphold justice, to report and provide Stated Meeting March 9, 2017 3/9/17 - STATED - 2ND READING information to those, even if they just received information. And from my perspective, when someone decides to take an oath to be a member of the Bar and even more to be a prosecutor, if they receive information that is not right, not forthcoming and that taints not only the office and also taints their role as a prosecutor, regardless if they forwarded information or did not, just by receiving that information they, in my eyes, have a responsibility to make a statement and to inform others about that information and say the wrongdoing that has occurred. So based on that perspective, I will not be supporting this resolution.

Council President Clarke

Thank you, Councilman. The Chair recognizes Councilman Domb.

Councilman Domb

I want to also mention that I'll be voting no, but I also don't think this is productive for Stated Meeting March 9, 2017 3/9/17 - STATED - 2ND READING us as City Councilmembers to go any further in this conversation. So we can either have a vote and just move on and end this discussion.

Council President Clarke

Thank you, Councilman. The Chair recognizes Councilman Oh.

Councilman Oh

Thank you very much. I appreciate everyone's opinions. I appreciate the very high standards that have been enunciated. Apparently not standards that 350 people in the Attorney General's Office were able to hold up. Certainly all of them bear the responsibility as much as any individual and more so. And I do think there is an issue that is important and, that is, that when we as public officials lay blame upon others, it should be fair and even-handed. There is a principle in law and, that is, that if a person commits a similar criminal action, the punishments should be the same. The mercy should be Stated Meeting March 9, 2017 3/9/17 - STATED - 2ND READING the same. And that puts into perspective what the action is or was, and certainly all of that is taken in consideration of all that they have contributed or failed to contribute. So with that, I move for the adoption of the resolution.

Council President Clarke

Thank you. Is there a second? (Duly seconded.)

Council President Clarke

It's been moved and properly seconded. All those in favor of the resolution say aye.

Councilman O'Neill

Aye.

Council President Clarke

All those opposed? (No.)

Council President Clarke

The resolution fails. Thank you very much. Mr. Decker -

Chief Clerk

There are no Stated Meeting March 9, 2017 Final Passage Calendar, Mr. President.

Council President Clarke

Thank you very much. Are there any speeches on the part of the minority? The Chair recognizes Councilman Oh.

Councilman Oh

Thank you very much. We just debated a resolution. It's probably not the most important thing to Philadelphians. But I would like to say that we did hold a hearing about the City's loss of control over the very important functions of online [sic] parking, which is the Parking Authority. That is not to say that the Parking Authority should not and is not or should not continue to operate online parking. It's a question of whether Harrisburg controls online parking in Philadelphia or whether Philadelphians control online parking -- on-street parking in Philadelphia. Stated Meeting March 9, 2017 matter is unresolved because the Law Department issued a memorandum stating that the City did not have the ability to regain its control. I did dispute that and have provided in 25 slides in layman's terms why the City is able to control the Parking Authority and why it is prohibited under the Pennsylvania Constitution to have the state take the revenues off the streets of Philadelphia and in part send them to other parts of this Commonwealth. At a time when state funding is being reduced and is being threatened to be reduced and where it appears that there's more interest in taking revenues off the streets of Philadelphia and sending them around the county, I think it is important, as was raised by Councilwoman Gym and Councilman Derek Green, that the Parking Authority appear before the Law and Government Committee chaired by Councilman Bill Greenlee. Stated Meeting March 9, 2017 appear, and we have called upon them to make their appearance, as well as the Streets Department. And I have met with the City Solicitor, explained my position, and invited them to respond. I certainly said that if you can show me that I am wrong under the law, I will be the first person to happily tell them I am wrong. By the same token, if you cannot defend your position, I'd like to know from you that we are able to move forward in the City's ability to control and regain control of this important street function. If we were collecting the revenues of the Parking Authority, I'm not sure we would need to do four real estate increases and a cigarette tax and possibly not even have a soda tax. And as we look down at more taxes and more fee increases, I certainly invite the Parking Authority, the Streets Department, and the Law Department to come to the next hearing to present their Stated Meeting March 9, 2017 Thank you.

Council President Clarke

Thank you, Councilman. On behalf of the majority, the Chair recognizes Councilman Johnson.

Councilman Johnson

Thank you, Council President. Earlier this week, myself and Chairman of Public Safety, Councilman Jones, held a hearing on the negative impact of certain fees and fines on families who are poor who have children going through the juvenile justice system. With the support of Councilwoman Helen Gym, Councilman Derek Green, Councilwoman Jannie Blackwell, we were able to outlaw the practice with the Department of Human Services of charging poor families for the cost of juveniles going through the juvenile justice system, and that was a big win and the first step towards making sure that the City of Philadelphia doesn't become Ferguson where we're balancing the budget Stated Meeting March 9, 2017 Philadelphia on the backs of poor families and juveniles going through the system. We want to hold our young people accountable and supporting them when they make bone-headed decisions, but nevertheless, we don't want to penalize them with a lifelong of poor credit or going through the juvenile justice system only for the simple fact that their parents can't pay the fines. Just to give you an example, you had one dad who decided to put his son through the adult juvenile system, let him be charged as an adult, because he couldn't take on the actual fine, the restitution if his son would be charged as a juvenile. And so we thank the Department of Human Services, Commissioner Figueroa, for working in partnership with us but, most importantly, we as a unit in this body held DHS accountable, nevertheless, to take a look at this issue, because I Stated Meeting March 9, 2017 of Pennsylvania, there were some judges who were profiting off of putting young people through the juvenile justice system. And so this is just the first step, and we will continue looking at the process while certainly making sure that our young people get the support necessary that they need as juveniles, but we don't want to penalize them to the point where they can't become productive members. I'm not shy to say as a young man, as a juvenile, I wasn't always on the right path, but I'm a Penn grad, former State Rep, first African American to represent the most powerful district in the City of Philadelphia. So, you know, for me, it's important that we support our young people, hold them accountable, nevertheless make sure we're not overly penalizing poor people who are trying to support young people who are making some poor decisions but, Stated Meeting March 9, 2017 nevertheless, they still want to go on and do great things with their lives. Thank you, Council President.

Council President Clarke

Thank you, Councilman. They say south of Market, west of Broad, most powerful Council district. The Chair recognizes Councilman Green.

Councilman Green

Thank you, Council President Clarke. I just want to take a quick moment to salute our colleague Councilwoman Cindy Bass on an achievement that occurred today. I have a strong affinity to the Chew and Belfield community. At a very young age, my maternal grandmother used to babysit me in that community. And so when I was President of East Mount Airy Neighbors and I did the housing and land use and zoning work for EMAN for a long period of time, there was a desire by the community to have a supermarket at Chew and Washington Lane. And we were able to Stated Meeting March 9, 2017 that location. However, the supermarket that was there was acquired by another entity -- I'll keep them nameless -- and closed the supermarket, and it sat idle and vacant for a period of time and it was a lot for the most part. And so that entity had a restrictive covenant in the legislation -- I mean had a deed restriction at that location saying that no other market could come to that location. Reverend Chester Williams, who is head of the Chew and Belfield Neighbors, was very active in organizing people in that community, and our colleague Councilwoman Bass introduced legislation to kind of move the needle and force the issue. And so this morning, there was a grand opening and ribbon cutting for the new Save-A-Lot at Chew and Washington Lane, and I was happy to be there at the grand opening, along with Councilwoman Stated Meeting March 9, 2017 officials from the region. So I just want to take a moment to thank her and for her work and using the power of her office to provide economic development opportunity for that community.

Council President Clarke

Thank you, Councilman. The Chair recognizes Councilman Jones.

Councilman Jones

Thank you, Mr. President. My colleague Kenyatta Johnson and I agree on a great many things. Greatest district in the City is not one of them, but let me focus on where we do. From the time he entered this body, he has been an advocate for juveniles and particularly those -- they call it now opportunity youth that we used to call at-risk youth. And this piece of work this week by way of moving DHS to agree to stop creating debtors Stated Meeting March 9, 2017 prisons, particularly on young people, and making parents have to choose between honoring their kids or moving them on to adulthood to avoid fiscal calamity in a lot of cases was huge. It made the national news, but that's not why Councilman Johnson championed it. But I want to also point out that you had placed a great priority on justice reform. And so those little victories that we are beginning to make are moving the needle in the right direction, Mr. President. So as captain of this ship, I believe sincerely you are moving it in the right direction, and as the respective mates on the ship, we get it, and I hope that we will continue in that direction during the budget so that we can -- and there are a lot of people counting on us. I mean, the courts are hoping that this year we actually pay attention to the recommendations that they've been making for a great number of years to do alternatives to Stated Meeting March 9, 2017 opportunity for all of us to put our money where our mouth is. Councilman Johnson really bent my ear about doing a program similar to ones we've done that kind of get ahead of the curve. So instead of reentry, pre-entry. Make sure we give them some assistance, intervention if you would, before they get in the system. So we will be -- and you've charged us with putting together that agenda, and for which we happily do our work. But we are going to move an agenda during this fiscal year. And, no, Rome wasn't made in a day. We won't undo some of the problems in one fiscal year, but we will plant the seeds that will bear fruit in future fiscal years. And it's the intersecting point where the most conservative members and the most liberal members -- and I didn't just look at you, Councilwoman, but can intersect. Stated Meeting March 9, 2017 save money or save a soul, there's an agenda that we can put together mutually that accomplishes both. So we look forward to this process, Mr. President.

Council President Clarke

Thank you, Councilman. And, again, thank you and Councilman Johnson for your great work on that Criminal Justice Reform Committee, and I do believe that you would see some of the recommendations reflected in the upcoming budget process. The Chair recognizes Councilwoman Bass.

Councilwoman Bass
