Bill No. 071007, an ordinance 20 authorizing the Water Commissioner, on behalf of the City, to enter into an agreement with the owners of 4641 East Roosevelt Boulevard for the grant of a right-of-way to the City for drainage and sewer purposes through the property along 3 11/29/07 - STREETS - BILL 070987, ETC. the Tacony Creek from approximately 550 feet east of Whitaker Avenue to approximately 750 feet west of the former "I" Street, under certain terms and conditions. McCLOSKEY: Good afternoon, Mr. Chairman and members of the Committee. My name is Paul McCloskey. I'm representing the Water Department. In regard to this bill, the Water Commissioner, on behalf of the Water Department, entered into -- 5 11/29/07 - STREETS - BILL 070987, ETC. COUNCILMAN DiCICCO: I would ask again, not to interrupt, if the folks that are leaving -- excuse me. The folks who are leaving, we're having a hearing. I know they're happy, and that's okay, but hold it down. Thank you. Mr. McCloskey. MR. McCLOSKEY: It's quite understandable. In regard to this bill 12 introduced by Councilman Clarke by request on November the 15th, the following testimony will be given by the Water Department. The Commonwealth of Pennsylvania has made the City the caretakers of the estuaries located within the City. The Tacony Creek is a major drainage estuary of lower Northeast Philadelphia. It begins in Montgomery County, transverses the City and eventually discharges into the Delaware River. The section of the creek just 6 11/29/07 - STREETS - BILL 070987, ETC. east of Whitaker Avenue to the former "I" Street near Ramona Avenue is severely eroded. This erosion is undermining an interceptor sewer at the creek. This has caused the sewer to become damaged from time to time, resulting in the creek to either -- the sewer either polluting the creek by the sewage flow or the creek's flow entering into the sewer, surcharging it and causing unnecessary treatment of the creek's flow at the City's sewerage treatment plant in Bridesburg. The remedial measures to correct the situation are to reduce the velocity of the flow and restore the eroded banks of the creek. The area of the erosion is just north of Juniata Park and is located in the extreme rear of Friends Hospital at 4651 Roosevelt Boulevard. In order to allow the City to restore the creek, the Scattergood Foundation, which owns and operates Friends Hospital, has agreed to grant a 7 11/29/07 - STREETS - BILL 070987, ETC. permanent right-of-way for drainage and sewer purposes to the City for the use of over nine acres of land for restoration and maintenance purposes only. During construction of the project, the Scattergood Foundation will grant temporary use of an additional eight acres of land for temporary construction purposes. This bill authorizes the Water Commissioner to enter into an agreement, on behalf of the City, to accept the grant of the permanent right-of-way from the Scattergood Foundation and their successors. The agreement also provides language that the City may place the right-of-way on the City Plan at a future date. The restoration of the creek is planned to be constructed using environmental engineering techniques with vegetation, plantings and river rocks to create a natural environment for the 8 11/29/07 - STREETS - BILL 070987, ETC. basis of a wetland. In order to share this natural beauty with the surrounding communities, it is the intent of the Scattergood Foundation to use the City's creek project as an anchor for a wetland park to be opened to the public. In an effort to aid the Foundation, the design of the project will leave the construction roads in place as a start to their wetland project. We recommend that this bill be favorably reported out of Committee and given the near ending of the Administration term, that the rules of City Council be suspended for a first reading. Good afternoon, Chairman and members of the Committee. My name is William Mautz and I'm a Construction Engineer with the Streets Department. I am here to offer the following testimony for Bill No. 070991. This bill authorizes Evangelismos of Theotokos Greek Orthodox Church to construct, operate and maintain an existing raised platform entrance which consists of two exterior stairs, a handicapped entrance ramp and a raised platform landing providing ingress and egress from the church located on the eastern part of Bustleton Avenue. The encroachment is approximately 49 feet in length, 8 feet 2 inches in height and encroaches 10 feet 2 inches onto the east public sidewalk of Bustleton Avenue, leaving approximately 9 feet 10 inches of clear, unobstructed footway. 11 11/29/07 - STREETS - BILL 070987, ETC. The Streets Department has reviewed the as-built plans. As the encroachment does not adversely affect the public right-of-way, the Streets Department recommends passage of this bill. In legalizing a project, just to put it in English for a moment, it's already been built. Now we're just trying to make it right.
You discussed the review of the plan. My concern is, when we do this process, do we miss a step? Do we actually know that this platform and ramp has been built according to the standard that it should be? In other words, are we confident that this is a sound structure that's not going to collapse, that it's built to code when we do this legalization 12 11/29/07 - STREETS - BILL 070987, ETC. process?
I'll just give you a little background, Councilman. This is actually an ordinance that was already passed for this back in May of '06, Bill 7 No. 060086, and the reason that it's come back is two reasons. Number one, the original ordinance required that they enter into an agreement with one year of the Mayor's signature. The church neglected to do that. Also, upon further review, it was determined that we actually misspelled the name of the church. So it was incorrect to begin with. So that's why they are back again. To answer your question, yes, it falls under the auspices of the Building Code. This legalization was part of other work that was occurring at the church, and as far as Building Code requirements for that structure, that's been already determined.
So any time we get something like this in front of 13 11/29/07 - STREETS - BILL 070987, ETC. this Committee, we can be confident that that part of the review has been conducted in the event there's been an oversight on a permit or something like that, that we're not approving something that may be substandard?

Good afternoon, Chairman and members of the Committee. My name is William Mautz and I'm a Construction Engineer with the Streets Department. I'm here to offer the following testimony for Bill No. 070992. This bill authorizes LaSalle University to construct, own and maintain an overhead pedestrian bridge crossing the 5600 block of East Wister Street connecting the Main Campus with Germantown Hospital. The structure spans the entire right-of-way of East Wister Street, approximately 50 feet, with a minimum vertical clearance of 14 feet 6 inches above the roadway. The center line of the structure is located approximately 15 11/29/07 - STREETS - BILL 070987, ETC. 330 feet north of the north curb line of West Clarkson Street. The structure is approximately feet wide. 5 The Streets Department has 6 reviewed the preliminary plans for this 7 project. I am William Erickson, City Planner for the Development Planning Division of the Philadelphia City Planning Commission. I am here to testify on Bill 070988, which was introduced by Councilmember Blackwell for Council President Verna on November 15, 2007. The ordinance authorizes and 22 11/29/07 - STREETS - BILL 070987, ETC. directs the revision of lines and grades on City Plan No. 17-S by striking from the City Plan and vacating Oakford Street from 30th Street to 31st Street, under certain terms and conditions. The Philadelphia City Planning Commission reviewed and approved this same action as part of Bill No. 030376 on June 17, 2003 to allow for a future commercial development on this site. This action is consistent with the former approval and will allow for the construction of a drugstore and a food market. The Philadelphia International Airport is expanding its parking area in the lay-by lane for the former Overseas Terminal. This action is needed to address the loss of parking due to the Airport runway expansion. The proposal is to reduce Island Avenue by 32 feet from 108 feet wide to 76 feet on the south side by removing a lay-by lane on the block between Penrose Avenue and Escort Avenue. The Philadelphia Planning Commission staff has reviewed this street action and will recommend approval of this action at the next Planning Commission meeting on December 18, 2007, and, therefore, the Planning Commission staff recommends that Bill No. 070989 be approved. I am here to testify on Bill 070997, which was introduced by Councilmember DiCicco on November 15, 2007. An ordinance authorizing and directing the revision of lines and grades on a portion of City Plan No. 97 by striking from the City Plan and vacating Reese Street from Kater to Bainbridge. The purpose of the proposed City Plan change is to control access to a 12 foot wide street used as a pedestrian access, which has several problems, including public urination and 33 11/29/07 - STREETS - BILL 070987, ETC. trash. The party-at-interest has an agreement from the other two affected parties to proceed with the closing and will be responsible for the maintenance. The Philadelphia City Planning Commission reviewed and approved this action at its meeting on September 18, 2007, with the additional condition that the street remain a cross easement and should remain undeveloped space. Therefore, the Planning Commission recommends that Bill No. 070997 be approved with the requirement of the cross easement. If the developer does not wish to deed restrict the parcel, the Planning Commission will give Mr. Daniel Ascher the opportunity to present his development proposal to the Planning Commission at its next meeting. Good afternoon, Chairman DiCicco and members of the Streets and Services Committee. I am William Erickson, City Planner, Development Planning Division of the Philadelphia City Planning Commission. I am here to testify on Bill No. 071004, which was introduced by Councilmember Clarke on November 15, 2007. This ordinance amends Section 2 of an ordinance, Bill No. 050516, approved June 2, 2005, entitled "An ordinance authorizing and directing the revision of lines and grades on a portion of City Plan No. 120 by striking from the City Plan and vacating Harlan Street, Stewart Street and Nassau Street, each from 21st Street to 22nd Street, and by reserving and placing on the City Plan a right-of-way for gas main purposes within the bed of Stewart and Nassau Street being stricken under authority of this ordinance, all under certain terms and conditions." 37 11/29/07 - STREETS - BILL 070987, ETC. The purpose is to allow the Philadelphia Redevelopment Authority to construct 71 affordable rental housing units as part of its Sharswood II development. The Philadelphia City Planning Commission has approved the acquisition and disposition of these parcels to facilitate this redevelopment. Okay. Because I thought I had some development coming that I didn't know about and I would have been extremely pleased if I had 71 new houses coming.
