my name is frank de chico i'm the chair of the zoning board of adjustment i'll be participating
in today's hearing along with our board secretary confessor plaza and board members mr thomas
Holloman and Mr. James Snell. Board Administrator Tanya Sunken and Board
Attorney Sharon Saleta are also in attendance. For those of you who haven't
participated in one of our virtual meetings,
I'll go through some of the basics of what you can expect.
First, we'll begin this morning's session by reading a list of cases to be
continued. If you believe any announced cases
being continued in error, we will give you an opportunity to
respond. After reading the continuance list and receiving any feedback, we will
take any additional continuance or and or withdrawal requests. Then once we've
confirmed which hearings are being continued, Confessor Plaz will begin
calling the remaining cases listed for this session. When a case is called, we
ask that attorneys representing applicants or other interested parties
in the matter identify themselves for the record. We will then hear the appellant's presentation
followed by any presentation by attorneys representing other parties. Interested parties
and members of the public not represented by council will then be given an opportunity to
testify. We will finally hear the recommendation of the planning commission. At the hearing's
conclusion we will either vote the matter immediately or hold it for discussion and

I do. Please proceed. Thank you. So good morning. As I said, I'm David Guest with Ballard Spar here on behalf of the Housing Authority and Perryman Shoemaker, their general contractor. Just for the record, I'd like to refer to the exhibit book that we submitted about a week ago to the board, which includes various materials such as the zoning plan.

the refusal, tax clearance certificates, and the like. We have our presentation materials
loaded up here. They're also in the exhibit book. First off, I want to thank Diane Monroe and the
14th Ward Democratic Executive Committee, RCO, for hosting our RCO meeting a few weeks ago.
We received their unanimous support for this proposal, and that support letter is included
as Exhibit 12 in our book.
Council President Clark's office also provided us
with a letter of, excuse me, of non-opposition
that came in yesterday and was emailed
to the board administrator.
I'm gonna give a brief introduction
before turning it over to Mr. Dima and Mr. Ray,
who will describe the project in a little more detail.
And then we will wrap up with a little more discussion
of the nature of the refusals
because it's a little bit complicated,
but as you'll see the actual proposal is not very complicated um so milton if you could please
advance the next slide thank you you might want to zoom in slightly if you can but um to orient
you here um this is a block bounded by master street to the north thompson street to the south
10th street to the east and 11th street to the west it is one existing parcel right now a full
block. What you see in the red area is, Milton, if you could kind of highlight it, just the
footprint of the building, is a 15-story existing low-income housing tower operated by the Philadelphia
Housing Authority. In the blue area, the remainder of the block are also low-income housing units
operated by the Housing Authority that are low-rise, and you can see there are several
buildings there. The reason we're showing this as a red area and a blue area is because the nature
of the proposal here today is to rehabilitate that building in the red. It was constructed
around 1956. It's in need of some upgrades. And so as part of a low-income housing tax credit
financing for the project, we need to subdivide off that parcel for the financing to create a
legally divisible interest in just that parcel to finance that rehabilitation. So that's really the
focus of our presentation which you'll see today and just to confirm the blue
area is not really affected in any way by this proposal those residents are
there they will remain there there are no changes to that part of the parcel
except for the fact of this subdivision occurring so that's just to set the
stage I'm gonna have mr. Dima very briefly go over the project in the
context of the housing authorities overall plans and then mr. ray will run
through some more visuals, and then I'll wrap up, as I said, on the refusals. So with that,
I'd like to turn over to Mr. Dima, who's the Executive Vice President of Planning and Development
at the Housing Authority. Good morning. Again, this is Nick Dima from the Philadelphia Housing
Authority. Just briefly to build all that. Dima, excuse me, Mr. Dima. You're swearing the firm to
tell the truth, the whole truth, and nothing but the truth. I do. Please proceed. Just to build
off of what David has described. The tower is an existing tower. It is part of PHA's
Harrison Plaza conventional public housing site. It contains approximately 267 units,
including the tower. The tower currently has about 112 units. The remaining units are low
rise units that surround the existing tower. One of the initiatives of PHA is to really
address the remaining towers that have not been redeveloped within our portfolio so the plan for
this one is given that we know multi-family really doesn't work in high-rise buildings
and given that this tower is in need of major capital improvements we decided to really renovate
the tower and convert it to senior housing because we feel senior housing works within towers so the
plan will be basically to gut the entire building we will come back with pretty much all one bedrooms
right now as a multi-family tower it includes majority two and three bedroom units
so we will completely rearrange the entire floor plate of every floor we will put in senior
amenities the units will really be meeting today's standards over 900 square feet on average
which for a one-bedroom unit in today's standards is probably considered extremely large.
This is a large undertaking. As David said, it'll be financed using low-income housing tax credits
along with money from the Pennsylvania Housing Finance Agency.
And we'll come back with approximately 116 units, so we'll be able to actually provide four more
more affordable housing units.

And so now I'm going to turn it over to Eric Ray, who's a principal at BLT, the project architect.

for the project as you notice as nick noted in the photos the building is in need of repair both
inside and outside and so this is a full renovation the slide on the screen now is a site plan of the
new conditions moving clockwise from master street we have a new parking lot for the convenience of
residents and access for vans to take residents out from the building to appointments etc as you
move across master we have the existing loading dock being renovated and then
down 10th Street we have a new entry canopy glass and metal canopy new stairs
and walk a fully accessible entrance and then as you move to the south we have a
new outdoor terrace for residents for outdoor socializing some mechanical
equipment that needs to be provided for the new building and then going north
again a small canopy that allows residents access to this new parking area next slide
this is a plan of the ground floor the yellow is the circulation the turquoise or light blue
color represents resident amenities including a tenant council room health screening management
office etc and the two amenities on this floor are a new multi-purpose community room in the
lower right and a new laundry upper left the orange color next slide and the next
few images show how we're completely renovating the building taking it away
from an institutional look to a more high-quality residential book this is
a rendering of the entry and you see some of the tenant service or the
excuse me resident services immediately to the right and then the next image is
a rendering of the new community room set up for in this case some kind of a
viewing but this is a flexible space can be used a number of different ways and
it does include a full-service kitchen as well the next slide is the ground
floor excuse me a typical floor of the building and as Nick noted we have eight
units per floor and mix of primarily one bedroom some one-bedroom deluxe and a
few two bedrooms fully renovated next slide these are plans of the typical
apartments they are large by market standards they also have been designed
to accommodate accessibility requirements for the various governing standards of
this project and on the exterior we're fully renovating and repointing the
brick facades the existing area where you see the multicolored panels is
currently stucco that is really deteriorated so we're providing a new facade here in multi-colored
panels both to warm up the building and give it a little bit of personality and then the last two
slides are renderings of this new development here you see the the new glass and steel canopy
as well as the new multi-colored panels running up the building and then finally a similar view
where you can see that this featured panel of the building occurs on all four sides.
Great. Thank you, Eric. So I'll just wrap up really quickly by going through the refusals to explain
their nature and the hardship here. So we have four refusals. They're really all related to the
fact that we're doing the subdivision as required as part of the tax credit financing. So two of
them relate to yards. There's a side yard and rear yard refusal. In this district, Milton, you can
just leave it on this slide. That's fine. The technical requirement is that the setback has
to be three quarters the height of the structure. So of course, because we have an existing 15-story
structure, that generates a very large setback requirement of 97.5 feet. And obviously, we don't
meet that because it's an existing building built in the 1950s. So that's part of it. And then
there's a floor area ratio refusal which is very similar because we're creating that smaller
subdivided parcel technically we have a larger building on a smaller lot which
subdivided parcel. Technically, we have a larger building on a smaller lot which
exceeds the permitted floor area and finally there's a refusal for surface
parking spaces in a yard area so it's the same situation where we're installing
new accessory surface parking to serve the residents which is technically
within one of the those big technical yard setbacks so that's the nature of
the of the refusals you can see that it's an existing condition and really
it relates to the fact that the financing for this project requires the subdivision. So really
just in conclusion, as you've heard today, denial of the variance would result in an unnecessary
hardship by preventing the rehabilitation of this building using tax credit financing. So it's very
important to be able to perform that subdivision. And because we're simply rehabilitating an existing
building and improving the area surrounding the building, there of course are no adverse
environmental traffic or light and air effects on the surrounding neighborhood because it is
in condition and to the contrary in fact the proposal will improve the existing affordable
housing stock in philadelphia and um will actually help with the parking because we'll be adding
parking so it'll free up uh on-street parking in the area so that uh pretty much concludes
our presentation we'd be happy to to take any questions and thank you thank you any questions

um i don't believe i was asked if i stipulate to the accuracy of the referral because i do not
sorry about that okay no problem um i i do not stipulate to the accuracy of either of these
referrals uh they both say that the request is for a rooming house or a single room residence
the referral should have been issued for group living i will go into that just in a little bit
of detail in the presentation because i want to make sure the board actually understands what we
are requesting so I'll get to that let me share my screen all right so again my name is Meredith
Ferliger of the law firm Dolworth Paxson I am here with a request for two special exceptions
for student residences that are at the edge of Temple's campus. Properties are
Properties are located at 1406 and 1408 Willington Street and are both zoned RM1.

The owner of 1406 Willington Street is Guesk Properties, and I do believe we have a representative
on the call today from Guesk Properties.
I'll call them out a little bit later.
The owner of 1408 Willington is Temple Properties, and that is represented here today by Ricky
Biddle.
Ricky's company, MK Management, manages both of these properties.
Ricky, if you can at this time hit the raise hand button so we can get you sworn in and introduce yourself.
hi uh this is ricky biddle r-i-c-k-e-y-b-i-d-d-l-e with mk management
mr biddle do you swear and affirm to tell the truth the whole truth and nothing but the truth
i do thank you ricky if you can just give the board a two sentence kind of understanding
of uh mk management and and its role um the scale of the properties that you manage in the temple
area sure we uh we manage primarily uh temple student housing and we manage uh just over 300
units uh in and around the temple area um not far from the two subject properties here
Thank you. So to give the board some brief background on these two particular structures,
they were both built within the last five years and were approved as duplex dwellings.
Permit history you have is at tabs 12a and 12b of your exhibit packet that starts on page 62 of the
of the PDF. Now, as the board knows, having seen many of these cases in the past, the zoning code
would only permit six occupants in each of the two units, where the request today is to allow
group living to accommodate the additional three occupants. So in total, there would be nine
residents in each structure instead of six. In each structure, unit A has four residents and unit B
has five residents. For reference, you do have floor plans of each structure in your packets
at Exhibit 5A and 5B, which begins on page 32 of the PDF.
The structures are each just under 2,500 square feet, and they have nine bedrooms and six
bathrooms. Each living unit has a kitchen and a laundry facility, and the structures are,
of course fully sprinklered, having been built just within the last five years. Now with respect
to the applications, we received one referral for each for the proposed group living use. Now the
examiner wrote these referrals for rooming house or single room residences. So if the board will
refer to Exhibit 11, which begins on page 56. I'll bring it up on the screen.
You'll see that Section 14601 of the Code provides a definition of a single room residence.
This is defined as a building containing rooms rented as living quarters without private
bathrooms, such as dormitories or rooming houses. Alternatively, a group living use
provides communal kitchen and dining facilities, such as fraternities or group homes. Now, Ricky,
are these rooms rented independently to your tenants?
No, we rent both units as a unit, not as individual rooms.
Okay. Now, I did dispute the characterization with the zoning examiner for several weeks,
But because both of these categories would require a special exception, the distinction is not critical.
However, I just want the board to understand that the proposed group living use is identical to the many other cases that I have brought before this board previously, which were all issued as group living, not as single room residents.
As is required by Section 3037E.1 through .3 of the Zoning Code, the proposed group living use
does meet the definition of a use permitted by special exception in the RM1 Zoning District.
Furthermore, the proposed use will not cause specific detrimental impacts to the neighborhood
beyond that which might normally be expected from the proposed use. The proposed use has

The properties are both located at the edge of Temple's campus just south of the Leopold Center
and are located within walking distance of several public transit spots.
The existing occupants generally travel primarily via foot or via bicycle.
Continuation of these uses has not and will not cause overcrowding.
As mentioned, these buildings are each about 2,500 square feet and have one bedroom per proposed
residence, so a total of nine bedrooms, and six bathrooms. Each of the bedrooms varies between
104 square feet to about 158 square feet. As you'll see in your packet at tab 12C,
which is starting on page 65. This block of Willington Street is made up of many other
similar uses such as two, three, and four family dwellings. In fact, directly across the street
at 1400 North 16th Street is a 48 unit apartment complex. So this is a uniquely dense area even
compared to some of the other cases that I've brought before the board in the past.
Furthermore, both of these lots have a history of high-density uses.
Exhibit 12A shows that 1406 Willington was historically a four-family dwelling,
which may have accommodated up to 12 occupants.
Exhibit 12B shows that 1408 Willington was historically a three-unit,
which would have permitted the nine occupants requested today.
Furthermore, given the lot sizes of these two properties, three units would actually
be permitted on each. If the board refers to exhibit 11, which begins at page 53, I've
brought it up on the screen, you'll see the breakdown. So the requested number of occupants
here is actually permitted based on the lot sizes. We're only here because the nine occupants
are in two living units instead of three. So we do assert that the proposed and existing density
is well in line with the history of the lots, the permissible number of units under the zoning code,
and the character of the neighborhood, and will therefore not cause any overcrowding.
These uses will not impair light and air to adjacent properties as no physical changes are
proposed. The structures are three-story attached buildings that are uniform to the surrounding
properties. The uses will not burden any public facilities as the uses are existing and the
facilities are capable of supporting continued use. The uses will not impair adjacent properties
which all have similar or much higher densities than that proposed. The proposed use will not
endanger public health or safety nor is it inconsistent with the comprehensive plan.
This area is zoned RM1 and is specifically contemplated for multifamily residential use,
particularly the nine occupants that are requested.
The proposed use is in keeping with the impacts that are normally expected from the proposed
use and is specifically contemplated as an allowed use in the RM1 zoning district.
Now Ricky, can you just briefly give the board an understanding of both the sanitation
measures that are employed for these two structures, as well as just generally your
company-wide sanitation. And you are muted, so you'll have to go ahead. Sure. Thanks, Meredith.
We design these two particular buildings have trash corrals under the front stoop that allow for
trash bags or trash cans to be placed under them. And any buildings that we take on or design,
we design with specific trash areas to be stored off street we additionally have a we have a full
time employee with a street sweeper that goes up and down our streets to clean the fronts of any
blocks that we manage including under the trash corrals and in and around the front of the property
thank you um excuse me this is sharon seleta i had one question it's ferlinger if the board
should approve this do you believe there should be language clarifying that it is a group living
facility i i believe so uh group living would be a more would be a more general category so i think
it would be wise if the board is so inclined to approve these um that it that it should be
understood that it's the the more broad category and not the specific
single room residence so something stating perhaps proviso

That would be fine. Thank you. Now before I conclude, I need to address an issue the board
is likely to raise. Each of these structures does have bedrooms in the cellar level. However,
for several reasons, I'm going to implore the board not to issue its common proviso.
let me explain first of all if the board refers to me yeah did you bring up a floor plan yeah sure
all right so for this is 1406 willington um i will i'll highlight what i'm about to explain
for you, and then I'll go to 1408. So first of all, if the board refers to Exhibit 12A,
you'll see zoning history for the properties. When the structures were originally built,
the zoning application specifically did list these bedrooms in the cellar level.
So they were not only approved through zoning, but then of course they went through the building
permit process and were specifically approved with these bedrooms. So if you'll see, there is
the front bedroom and here's the egress for that. There is bedroom here that has an egress here
and then there is the bedroom here that actually has a sliding glass door that provides access
into the rear. Same thing for 1408 which is just reversed. So front bedroom here
with egress there, middle bedroom here with egress into the rear, and again the
rear bedroom with the sliding glass door. So of course each of these bedrooms has
light air and proper means of egress and does comply in full with the building
code having just been built within the last couple years. Now, most importantly, and this is
going to be somewhat unorthodox, if the board refers to exhibits 8A and 8B, which start at
page 40 in the PDF, and I'll bring them up, you'll see the results of two prior cases this board has
heard within the last year year and a half for 8a this was 1838 north 16th street now the board
denied this one specifically because of the bedrooms in the basement this was actually one that
was a walkout basement and the board did deny that one on appeal the court reversed it
and you'll see the court decision there that was just issued uh december of 2019.
Now, even more telling to this issue is the next one, which is 1700 West Norris Street
at Exhibit 8B.
Now, in that case, the board granted the special exception.
However, the board did issue the proviso for no bedrooms in the basement.
I specifically appealed that proviso in that case, and the court reversed it.
I would, of course, be happy to share with the board the legal reasoning for the court's reversal of the proviso, which would, of course, apply equally in the cases that you're hearing today.
But generally speaking, it did turn on the board's authority under the zoning code.
But more importantly to these cases, it centered on the uniqueness of a request for a special exception.
and the fact that when we're asking for a special exception, that request would apply to the
structure as a whole and wouldn't be broken down individually for different parts of the structure.
So we are imploring the board today to grant the request for a special exception without proviso,
both due to L&I's explicit approval of these structures as they exist today, as well as the
court precedent that this counsel has established and presented to the board.
We're imploring you not to make these two owners go through the
time and expense of an appeal given the likely result that the
court has seen here today. So we do therefore assert that we've met the
requirements of Section 3037E.1 through .3 of the Code concerning
entitlement to a special exception and we therefore asked the board grant our application.
With respect to the community, it feels like a lifetime ago but we did meet with Matt Polistic
along with representatives from several other area groups including community land trust.

Occupy's entire site. We are proposing
to demolish it.

We are proposing the first 30 feet of the lot depth to be occupied by commercial element
as the commercial element will carry down to the cellar area.
The rear of the building will serve as residential entrance and also two parking spaces that
are accessory to the single family that is proposed on um first floor rear first floor
also seller rear second third and fourth floor um this single family will also have an access to
roof deck via stair tower and elevator floor plans as you can see in here first floor 30
first 30 feet will be occupied by commercial space. They will have access to the elevator
to access the cellar, residential entry, two-car garage, rear yard in the back. There's also
an egress light and air easement for the next door neighbor. They will be able to exit
under our proposed deck. Second, third, and fourth floor single-family. This unit
will provide four bedrooms, four and a half bathrooms total, will be about 4,500
square feet, generous rooms, generous kitchen, lots of natural light, access to
roof deck and the rail is set back on both sides.
The design is in line with the next door neighbor
currently to the east side. The commercial element is addressed with
lots of natural light and also additional
lighting on both sides of the building. The one item I wanted to point out, the
The sidewalk on South Marshall Street is very narrow.
Our client has agreed to widen the sidewalk by one foot by recessing the first floor,
as you can see in here, and cantilevering the second, third, and fourth floor.
The streets department had signed off on the proposed parking, and one item that I would
like to mention is that in CMX2, if the downstairs is used as an educational facility, the parking
would be something that would be actually expected of our client to provide. That is
something I would like the board to take into consideration. We had met with the community
group. They did not oppose to the proposal. They appreciated the fact that the upstairs
was proposed to be only a single family rather than duplex which would be allowed
by ride and that the parking was also something that was considered since that
area has tremendous parking problem. This is view of Marshall Street, this is the
residential entrance, two-car garage and also the deck in the back. Does the board

i want to um uh just uh show the board the uh the letters of non-opposition if they don't have them
already i believe we have those okay yes we did we did meet with bellavista they uh again they

We revised a plan to provide the commercial space on the first floor and make it a single-family dwelling.
And I would just point out that the general concept here is that it would be a work-at-home type business, very professional.
They could occupy the first floor and reside in the residence above.
so there is you know currently access is in the design to get from the first floor commercial
space to the residence so attached that as an exhibit is the Bella Vista letter of non-opposition

So before the board today is an application for the demolition of an existing single-family home
and the construction of seven dwelling units on this RSA 5 property
that has a land area of almost 8,000 square feet.
The property, as you'll see shortly,
is a flag-shaped lot with much of the area
in the interior of the block.
The property cannot be subdivided
as only the stick of the flag adjacent to Thompson Street
has direct access to a legally open street.
To account for this, we're proposing a carriage house home
with two dwelling units fronting on Thompson Street
under which a gated drive will pass
that leads to a large interior courtyard.
Rachel, excuse me again, would you be able to share?
Let me just pull this down.
So, just going to show you Atlas really quick.
So this is the lot, as you can see.
It's about an 8,000 square foot RSA 5 lot in the middle of the block between East Berks
and east thompson street in the fishtown neighborhood of the city again it's a sort of
a giant flagship lot and it has an existing two-story structure and the rest of the lot is
vacant as the board may know they recently approved i guess two years ago what is called
the montgomery five which sits back here or on east montgomery which i will can bring up the
plans for that. This is kind of a similar flagship lot. This is the Montgomery Avenue one right here
where five homes were built, I believe. Again, our property has a little bit more difficult
dimensions in that our width is about 33 feet. Their width was only about 12 feet. And we're
almost 8,000 square foot lot in this area. So as far as our plans are concerned, and I can have
Agata go through sort of in more detail. We are proposing this carriage house to front on East
Thompson Street. As you can see, the width of this lot is 33 feet, so more than double what a
typical 15 foot wide or even 16 foot wide is in this area. So we're proposing a carriage house
with two units. And as discussed with the community, there is an existing curb cut here,
but we decided to also, with the curb cut, provide for a gated entry to help with some of the
concerns around lighting and security as there's a school nearby and pedestrian traffic. This is
sort of what the rear of the site looks like with the five single-family homes. Our refusal that was
generated was for multifamily. However, these are all single-family homes except for this carriage
house that's going to be two-family. The rest, again, are single-family homes, pretty generous
in size, as I'll have a guy to go through. This is the rear of the property. Originally, we had
submitted for 40 feet in height to help with the parking considerations and also sort of making
the interior living space more up to modern standards. As we looked at sort of putting a
pilot house and parapets on each of them which would have taken us well over the 38 feet however
as you'll see from the proviso plans that we submitted to Sharon we have reduced the height
to 38 feet on these rear homes so that you know to kind of comply with the request of the community
and again we had thought to reduce it to keep it at 40 feet but again happy to compromise in that
way so that the height of everything is kind of in compliance with RSA 5
standards. This is Sharon. I wondered if the board should approve this would you
prefer to have it done as revised plans or simply as a proviso saying maximum
height 38 feet? I do believe we submitted the revised plans. You did and those are
fine I just I'm asking if you have a preference one way or the other. I don't
i'm asking if you have a preference one way or the other i don't have a preference whatever's
have a preference, whatever's easier.
easier for you guys if it's easier to do it as a proviso that would be fine and we would plan
to submit updated plans to l and i anyways whatever's easier on your end is fine okay
thank you yep um additionally as you can see some of the materials that we are using and sort of
as you can see the architect uh nicely incorporated a uh sort of a fence barrier
so that there was a little bit more safety and privacy and so that there was a little bit of a
nicer aesthetic separating the rear yards of these properties from sort of the back single
family homes. As you may be familiar with this site, there is an atlas. We sort of don't have
an illegally open street to um bring in sort of any traffic or egress or um any other means besides
east thompson street for parking considerations wilt street um isn't a legally open street um
and so we can't utilize that as street frontage so everything was sort of designed having east
thompson street um be the frontage of this property um agada do you want to go into more
detail on the floor plans um and then i can kind of go into the
the community considerations and take any questions from the board
what god are you there yes i'm yes can you hear me yeah i'm going to stop
sharing my screen so that you can share yours for the floor plans
it's what we're getting she's getting ready the the height of the carriage
house that would be maximum 38 feet as well correct the community didn't have an issue with
the carriage house that was actually their favorite part of this project was the carriage
house i think it kind of kept in character with the uniqueness of the neighborhood but um it was
mostly the the rear homes that presented more of the concern because of density because of the
lumped in with some of the concerns that they had with the Montgomery 5 now
that that project's under construction. So although, you know, we tried to
explain that we already, you know, initially we went in with six homes in
the back which had been reduced before we even got to the community in order to
try and provide a less dense site. However, any reduction from this point
with the rear homes would just result in larger homes that would be even more out of character
on this lot so five was kind of the middle ground um and it was kind of it's kind of hard to uh be
have an issue with density on the rear which is single family when you're okay with a duplex in
the front so we were just trying to to balance that out and height was one of the the other
more easily adjustable um you know features of the sites that that was sort of that in addition
to the fence, sort of the gate in the front, as well as issues with trash, which we plan
to have private commercial trash for this site.
What are the, what's the square footage of the rear five houses?

Yes, they, not including the cellar and the garage, they're about 2,300 square foot homes
with cellar and garage, they're about 3,100.

A couple items that I would like to emphasize on the homes at rear since the carriage house,
I will just briefly scan through since that was not so much of a board's concern,
is that the fourth floor is set back and also the pilot houses were eliminated from the proposal
as well as the parapet walls were also removed to diminish the impact on the adjacent homes.
Proposing the common driveway right in the middle pushed the buildings away from the homes that
they're directly facing Thompson Street to allow as much light and air and obstruct their view as
much as as little as possible. The homes they are backing into Will Street which as you can see
they're only they're not affecting anybody's light and air since these are
party walls on both of these properties right now this is an open area but shall
of these properties. Right now this is an open area but shall anybody erect a garage or
anybody erect
subdivide a lot if Will Street ever becomes a legally open street, we again will not be taking
away any light and air from that particular phase so we felt that that proposal was very responsible.
Layouts of single-family homes starting on the first floor, one-car garage with
den in the rear. This is access to Wilts Street, also ingress and egress. Shall anybody be
approaching it from that portion? Cellar, we're only proposing den, small bathroom. There's
also egress that leads directly into the public right away from the cellar. Second floor,
open floor plan with access to small deck. Third floor, two bedrooms, laundry room, small
office area, fourth floor, generous master suite with access to a roof deck that is not enclosed
with pilot house. This exhibit presents... Can you just zoom in a little bit?
It might be a little hard for the board to see. The exhibit that presents the condo building,
And again, our client would like for these units to be condos.
They are not apartments, so they're high-quality units.
Common Drive, they upgrade generous lobby entrance with stairway leading to the upstairs.
This unit will provide space for one car.
Upper floors, they're exactly the same.
layouts, generous kitchen, dining area, living area, three bedrooms. Each have
access to their own bathroom. Again, laundry room, very generous. They're high
quality units. This is our client we've been working together for many years and
his product is of superior quality.
Massing models, just zoom in a little bit. I'm sorry? Zoom in a little bit. I just
want to make sure it's, yeah. Thompson Street, Wilts Street, they are
rotated for multiple views, so I'll walk you through each view, but you can see
how far these five units are set back and and we really try to be respectful to what we are
proposing in the context that we are proposing it within. Thompson Street view from the other side,
this is the common driveway. This view shows Wilts Street and the rear of our buildings
with the access to roof decks. It's also the same view and here you can see where
how the building tapers back to allow more light and air and also I wanted to
point out that we are located to north of these properties so we are truly not
taking any of their light during today. We're basically north of them.
um i'm not sure if you would like us to go through the materials that they're selected
they're high quality materials bricks i don't think i don't think that'll be necessary yeah
um and also there is an alleyway um that is wrapping around the existing homes on thompson
street um our client will be proposing nice decorative fence with additional lighting to
make the alley a little bit more secure and more attractive and also defensing with living wall
elements will provide security from any of the headlights that might be affecting the
residents of the homes on Thompson Street. Do me a favor would you go back to the previous
exhibit the one that shows in yellow? Yes. Yeah all right right here as an example
uh looking at uh upper right the five houses uh going left to right of the going left to right
of the five houses there's a looks like a large building right here yeah what is that um so right
now this is a one story for most part with two story section in the back it's a warehouse that
most likely you will be seeing soon or you might have already seen they are
also looking for a variance to propose an office complex and I believe there is
actually proposed a further addition on this entire space with parking in the
front that is something that is going through variance at this time but that
but that is not for me to be disclosing their properties okay but you will be seeing that
is not for me to be disclosing their properties but you will be seeing that building
building it it appears to be a warehouse that's why i asked yes yes it is and if you would like
i have um actually an exhibit with photographs they'll give you a little bit more insight

your screen so that i can share mine thank you you're welcome okay so i just want to bring up
the rco letter we met with the fishtown neighbors association we had two meetings with them a
preliminary meeting and then the full community meeting. Here's sort of their
concerns that were listed. The number of units being proposed in the RSA 5 lot,
they understood that the shape and size of the lot was a hardship. They did
mention that if we were able to subdivide it that we'd only be able to
get five units. However, that would just leave just the five homes in the back
with nothing in the front meeting the street level. A lot of their concerns
were around safety. So not having eyes on the street or something that directly is adjacent
to the existing structures, I don't believe would provide a more safe environment. So that's why we
kind of provided the carriage house in addition to the five homes. Again, we did look at reducing
the density, but we had already cut it down from six homes in the back to five. So again, given the
size of those homes already at 3,100 square feet with the basement included, we would have really
large sort of unsizable homes for that neighborhood um again if we were to do this completely by right
we would have one giant home on an 8 000 square foot lot again the other concern was the additional
height again as you can see we've reduced the height to 38 feet so that should eliminate that
concern um again the there was a concern about uh parking and the common driveway again there's an
existing curb cut that's been there it's been a there's been a drive aisle a lot of times you get
concerns about parking and so we were trying to provide a way to have parking and also have some
safety features with the gate in front which was something that we actually added on after the
first RCO meeting and we've discussed with them that we would be happy to you know have additional
conversations to make sure that it's a safe and secure environment the developer has no intention
of providing homes that are unsafe to anybody. Again, we don't have a refusal for parking,
but we are maximizing parking. I believe we have six spots. Is that right, Agata, six spots?
Yeah, okay. So again, a lot of the other concerns were about how was a traffic,
how was a fire truck going to get in Wilt Street?
that wasn't really anything that at the time we could address we just understood that as it exists
now there's no been no issues with any of the properties that are on will street having access
to or having fire trucks have access to them and again providing sort of this drive aisle
will make it so that the homes in the rear even more accessible than they would be without a drive
aisle as you can see they were concerned about some emergency scenarios again the front building
was really appreciated by the community and I feel like we have done a pretty
good job of addressing any of the other concerns although they did issue us a
letter in opposition I do believe that this is a project that makes sense given
the other projects that have been approved again the Montgomery 5 on the
back smaller lot smaller flagship and and sort of ours provides a little bit
more um density however um again it's me it's mainly because of the size and the shape of the
lot so um that's sort of our presentation happy to take any questions that the board has and i'm sure
there's um there may be other comments as well want to answer your client if they adopt your

okay so um the community had came out for this zoom meeting um there was a lot of them and
everyone opposed this project because of it's too dense for the size of this lot we understand it's
a flag lot you can only build one house but the community asked for just one house on this lot
they voted no in addition there's a similar lot that is located in at 303 south 51st street in
West Philly that just had a denial of a permit for fire apparatus access. That lot is the same
as this lot that's being proposed in front of you all, this flag lot in Fishtown. There was a fire
last week on Little Welch Street, which is referred as the pig alley in Fishtown, that's
behind this project. The firefighters were unable to access that car fighter. They had to go through
people's alleyways to be able to and use a jump hose to put out the fire luckily that fire did
not spread to the new construction that's happening on the other flag lot the new construction on the
other flag lot was also appealed by the community twice in 2018 but eventually it was approved by
you all at the zba and the construction on that flag lot has been a menace to the neighbors
the construction vehicles have been unable to access it whatsoever so i am asking the zba
today to stand with the fishtown neighborhood association and vote absolutely no for this
request no exceptions thank you very much no exceptions meaning nothing more than one single
family home exactly that's what the neighborhood wants what else wish to testify in this case

speak um i just want to second some of venice's comments we had a neighborhood um zoning committee
meeting that attracted over 80 people all of whom were aligned in opposition of this project
I live in the house directly next to the alley that's adjacent to 627.
There is no 625 on our block with my husband and two-year-old son, and I'm gravely concerned
regarding putting in a driveway for seven cars four feet away from our home that bisects
sidewalk where droves of kids of all ages walk to the Adair School which is
on Thompson just a block and a half away. We are also as you know across the
street from a middle school and high school Penn Treaty. The block is well
The block is well trafficked by children at all times. There's some disruption, as you may have seen in the photo that was shared by the property development team because of the collapse of the two single family homes that were further down the block.

And I believe that you're going to see a proposal for a zoning change for 631.
And we're very concerned about the proposed shift of this block from single family to
multi-family, multi-unit, and potentially CMX2.
Keeping to the topic today regarding 627, I think that aside from the potential danger
of having seven cars or more in and out of that driveway in the middle of the sidewalk.
Actually, I'm sorry, to say one more thing on that topic, that the development team stated that
there's a curb cut in an existing driveway on 627. While there is a curb cut, it was not legal.
The previous occupant of 25 years used to park his car there and take it out about once a week
And as neighbors, we respected the use of that fake driveway, but that's very different from
seven cars coming in and out every day. I think that although people were generally in favor of
having a home built up to the street front in the front of the proposal that fronts onto Thompson
Street, there is a lot of concern regarding the five units in a backyard in the middle of the
city block the comparison to the Montgomery 5 had to do with the fact
that the Montgomery 5 actually allows I think 50 feet between the back of the
houses on Montgomery and that project whereas this one I believe only allows
about 30 feet so that is a consideration regarding air and I'm unsure why we need
to build seven homes on a lot that zoned for one home many of which would be in
the middle of a city block it just doesn't seem to make sense and it would
affect our day-to-day and the safety of children walking to school so thank you
for hearing my concerns on on behalf of an attendee of the neighborhood zoning
committee meeting I would ask that you oppose this project

uh thank you good morning um i'm a neighbor on this block i'm very familiar with the project
and a couple things i would just like to mention i'd like to reiterate what was already said about
the fna rco meeting um very well attended and almost unanimous opposition to the project
really didn't hear much from anybody that that really found uh you know there wasn't much support
for it there was a lot of for a lot of various reasons um i have my own personal reasons which
i'll go through in a second um briefly i just also would like to point out we've collected
uh 27 signatures from local neighbors that are in opposition that's been submitted to the board
as well excuse me excuse me this is sharon soletta i just wanted to say that we did receive the
petition uh with 25 signatures and two digital signatures however we didn't receive it until
nine minutes before these hearings started and it therefore was not
provided to the Board in advance. And I've never seen it either. I was not
provided with any of those signatures as well. Okay, we can provide a copy of that
for you. Regardless, there's clearly a lot of opposition from immediate
neighbors to this project. So the three specific reasons I'll go
through briefly. So multifamily is not permitted in a single-family district. I
I understand that the concept is townhouses, but essentially it's a four-story multifamily building.
That's what's being proposed.
It creates a lot of awkward situations here.
You're going to have walls with essentially no windows right on a property line.
That's unfortunate.
I don't think that's really how RSA 5 was intended to be used.
As far as the height, we appreciate going from 40 feet to 38 feet.
40 feet to 38 feet but again um even at 38 feet and then with the roof deck on top of that
But again, even at 38 feet and then with the roof deck on.
that's just very much out of scale with what's here on the block there are three-story houses
that actually step down in the back so they have a two-story section and then a one-story section
and with this driveway that's getting created right there um the fronts of these the fronts
of these new homes will actually be um about 25 30 feet away from the backs of the existing homes
We think that's not an appropriate setback.
Typically, it should be closer to 50 feet.
If these four-story homes were built on a typical 50-wide city street, that would be one thing.
But to sort of shoehorn them in the back right up against somebody's rear yard is a little unusual, and it creates an awkward condition.
And then the last thing, the really concerning issue for everybody, is the curb cut and the traffic in and out.
So there's Alexander Adair School, which is two blocks up the street, and Penn Treaty Middle School, which is directly across the street.
And, you know, before and after school, this is a major pedestrian thoroughfare.
It's a parade of parents and kids back and forth, and this would be extremely disruptive.
I think seven cars coming in and out would create a lot of extra congestion.
And, you know, I don't think that this is an appropriate proposal for this block.
it's a residential block it's a highly trafficked pedestrian area and I just
would also like to note that I realized this was reviewed as a multi-family
project but I believe that this if this had been reviewed by parking standards
for single-family a refusal would have been issued if this were RSA if this were
a sub subdivision project and this would be required to be shared lots to be
able to provide to provide parking in this way i believe because the zoning department reviewed it
as multi-family they sort of skipped over the parking and that's why a refusal wasn't issued
but i but i believe it should have been um so for those reasons we ask that you please
deny this project chairman am i able to respond yes please okay so um i just want to comment that
um just to the issue with the windows on the property line i mean that's not an rsa 5 or rm1
or cmx or any of those really you're not supposed to put windows on a property line because if
people build attached then you would lose your windows anyway so just to make that distinction
which i'm sure the board is aware of um as far as um the setback typically you get nine foot rear
yards not 30 foot rear yards in rsa5 so we're providing almost three times what we need to
provide if we were able to set it back even further we would have um that would then encroach on
Wilts Street even more. So it was kind of a balance of providing it so that there was enough
of a setback from the existing homes, which again, 30 feet is more than the nine feet you typically
get. I think a 50 foot setback is just not reasonable or even feasible for this site.
Again, but as the architect had mentioned, that was something that was heavily considered for
this project. In addition to the comments about multifamily, the only multifamily that's being
provided is the carriage house in the front that the community actually was supportive of. The rest
of the units are all meant for single family use. None of them are multifamily. As far as the
parking is concerned, I don't want to make questions or any suggestions about how the
examiner reviewed it because I wasn't there when they reviewed it, but I do believe that the way
that we're providing parking obviously didn't generate a refusal. And a lot of times we hear
concerns in the city about not providing parking. So the alternative would be no parking or seven
cars on the street, which I don't know that that would make it safer for any students or schools.
You know, this is a city that we're living in. There's a lot of schools in the middle of a block
in residential neighborhoods. And it's just, again, something that people have deal with in
different ways. We are providing the gate specifically so that there's some type of a
barrier, the in and out. And we were even open to figuring out additional ways with lighting and
stuff of that nature to make sure, again, there's no interest for anyone to harm anybody. But we are
working in the confines of the city. The last thing I wanted to mention is just, again, this
was completely, you know, to put one single family home on 8,000 square feet just is not
reasonable. I know that that's, the community has mentioned that this is RSA 5, and so
you know, that typically when you remap something to RSA 5, you want one home, but I don't think
the code contemplates having one single family home on an 8,000 square foot lot that you know
sometimes we do remappings entire blocks at a time and it doesn't take into consideration for
example that there's a warehouse on this block as well so just wanted to kind of mention those
points and again just kind of clarify as far as some of the other comments that that Kevin

Yeah, so I respect the idea that we don't want to go down the redundant path and continue to repeat ourselves.
But I just did want to reiterate and add just one or two additional items.
you know, with all due respect to Ms. Pritzker and Ms. Reister, they're being less than forthcoming
about the community concerns, which is evident through the testimony of my fellow neighbors.
This project was overwhelmingly and vehemently opposed by the community. You know, just again,
we have significant and ample concerns about the safety, about access to emergency services,
as evidenced the other day by this fire that occurred out back here. But in addition to all
that you know one additional issue is is that we're we're presupposing that the occupants of
this particular property are only going to be having one car um so yes granted there's only
six parking there's only six spots in the the property itself but uh it's it's very likely that
the single families will have multiple cars and and thus the overflow will get pushed out onto
the street um in addition to that you know i know right now we're in particular times with covid so
there's kids aren't in school but when it comes back the uh the adjoining block there with the
school they make everybody move their cars during the day which further amplifies the surrounding
parking situation um so i think that in addition to everything else that's been said um there's
there's likely to be an increased burden on the parking um and again we do have significant
concerns about the ingress and egress right in front of a school um and just for the record
I did want to state and clarify that that is definitely not a warehouse next door.
That's a private garage that was used as part of a private residence for years.
Not to divert, but yes, recently it was proposed as commercial, which the community, again, overwhelmingly and vehemently denied.
The idea is that we want to keep the character and nature of this community and this black single family without this sort of, I don't want to use it for ridiculous, but this overwhelming density issue.
So I just want to emphasize to the board about, I just want to say that the community strongly opposes this.
And I would respectfully ask that you guys vote no against this proposal.

I took some notes while the presentation was being made,
and I just had some things that I thought I would bring up that maybe others haven't.
I'm new to this process.
I'm new, actually, to the block.
I lived previously around the corner and moved in just after the Montgomery 5 project, I guess, was approved and had heard how bad that was for the neighborhood and how much, despite everyone's objection to that, it was able to proceed somehow.
And I found that to be kind of surprising and was a little bit of a wake-up call for me about how the process.

your opposition for this project please oh sure yeah i'll just go through my go through my notes
here um so there was there was a i'm not sure if these are legally valid reasons or not i'm just
going to say what my objections are um montgomery 5 approval was used as um a precedent for why this
should be approved. I'm not sure that that's a very in-touch case because everyone opposed
Montgomery 5. I would also say with respect to light and air, I think it's also quite out of
touch to say that five 38-foot buildings in someone's backyard are not going to remove
light and air from the surrounding buildings. I mean, that's preposterous. The Montgomery 5
buildings have dramatically impacted the feel of that area already and then to put five more
buildings back there I think there's really no argument that that won't impact light and air
quality in that area. I've also not heard the concept of outdoor green space mentioned at all.
I do not know what the legal requirements for that are but the fact that we're not mentioning
that in this is surprising to me it was mentioned that if we wanted smaller houses or larger houses
rather or if we wanted fewer houses that they would just have to be larger I'm not sure what
logic that's based on but who says you have to cover every square foot of the lot with buildings
that doesn't make sense to me um i think uh yeah so as far as just the green space just
quality of life is the other thing that i think is is important here you have everyone around this
um proposal objecting to it for a variety of reasons and i guess i don't understand
whether that's um a valid reason to uh deny this project or not but it seems fairly obvious to me
that um this would not be a project that's supported by anyone around it um i know that
for example the builder of the montgomery five declined to work on this project because of the
uh uh community uh proposal to project that's that's immaterial at the moment so you could
summarize it appreciate it yeah no that's that's all i have to say thank you thank you for your
time everyone i just want to adjust justin's comments about the green space we did discuss
that at the community meeting um i know that maybe ally could um discuss that in more detail but we
we talked about doing sort of uh the drive aisle space uh in the rear with the parking where you
can have it where there's grass that comes through it it's very hard to accommodate the
sort of back and forth concern of parking no parking parking no parking um and then wanting
green space so for us uh and the green space is really not going to be visible correct correct
Yeah, but we thought at least if we could do sort of the type of dry vial and space that you can have grass come through it,
that at least it wouldn't be sort of asphalt or tall.
It's more pervious at that point.

And then just lastly, to kind of address, there was a mischaracterization about it being four stories.
We've already kind of agreed to knock it down to three stories to the 38 feet.

And the reasons are for multiple reasons that have probably already have been stated.
Number one, there's an actual misrepresentation of the house next door as commercial.
It absolutely is not and never was commercial.
What happened in the early 1980s was the person that lived there requested a variance for his personal vehicles.
That's it.
It was never a commercial trucking warehouse.
else. The other reasons have already been stated, I believe. So fire and emergency access, which has
already been revealed. The fire trucks could not get down there when a car was on fire last week.
I have video of that as well. Traffic going in and out of there. And they mentioned in the community
meeting that there would be commercial trash pickup. That is something we absolutely do not
want next to our house and the community voted rezoning for a purpose and the community is
overwhelmingly against development behind these houses so i just want to state opposition along

okay planning commission mr chairman and members of the board this property is indicated for
single-family use in the city's comprehensive plan we believe that the applicant has not
provided an adequate hardship argument for the property we believe this proposal represents

back of the site accordingly we recommend that the requested variants not be granted thank you
uh before i case my vote i'm just i think the project the way it was presented really looks
like an interesting project i don't know what someone does with a lot that size and when
miss pritchett you pointed that out earlier i do understand some of the concerns many of the
concerns raised by the community in terms of public safety I don't know if
there hadn't been any discussion about any revisions I understand it wants it
to remain single-family although they're supporting a multifamily which is the
one that fronts Thompson Street I don't want to be all over the place on this
one I mean before I vote I didn't know I don't know if there's anything other
that was discussed at the community meeting about then lowering the density the number of units
uh even if that occurred i assume there's still going to be opposition to the curb cut
so if you're going to have parking on the new development you're obviously going to
need the curb cut to get back there i've seen projects in in my district this district i
represent especially in society hill that have homes that are in the rear of the front properties
without parking then that puts more pressure on the on-street parking issue so it's it's a mixed
bag and i'm i'm gonna call for a vote uh but i just didn't know if there was any window of
opportunity on behalf of the developer to maybe go back and have a conversation with the community
um i think that your honor may i say something oh yeah i wanted to just quickly i gotta give um
give Allie and Robert a chance to address the drainage concerns because that was something that
they uh yeah I I think that that necessarily but obviously we addressed because they're going to
build houses with cellars and you can't have flow I mean so something will something would have to
be done with the elevation and that would be taken care of through the building permits issues
issues yes Mr. Chair just want to make sure that was clear sorry God I didn't mean to cut you off
no no no it's okay if i can make um if i can make a um a suggestion of how
the accessibility to the site could be handled um i would like to share the screen real quick
uh since and please let me know if you can see um my screen yes okay um since average fire truck
is about 11 feet in height. We had proposed a building that is approximately 36 and a half feet
for the carriage house, which is still basically a foot and a half below the allowable height.
We would like to propose to diminish the height of the ceiling to nine feet and raise the
roof slightly still to be within the allowable height to provide access for

With me, I have Kim Washington, the Executive Director of Frankfurt CDC, and also Kurt Raymond,
the architect. We're here to request variance approval for alteration and renovation of an
existing fire damage uh structure into a mixed-use structure with commercial space
on the first floor um and cellar and four residential affordable housing units on the
second and third floor so i'm going to just scroll to the zoning map here we go so the
Here we go. So, as I said, the property is 4665 Paw Street. It's currently zoned as CMX2,
As I said, the property is 4665 Paws 3.
commercial mix use 2. The property is situated on Paw Street between
Frankfort Avenue to the north and Meadow Street to the south.
Here are some photos of the existing condition of the property. As I said,
uh it's currently vacant a fire damage three-story mixed-use property see if i can try to make this
bigger for you and that's a a photo of the front of the property a photo here's a photo looking
down from frankfort avenue you can see the exterior and the bracing
here's a photo looking up from meadow uh street um the property is currently sandwiched between
the current uh offices for the frankfurt cdc and another vacant mixed-use building um that will
also be renovated um for affordable housing by the cdc but currently we're only here for
4665 but will be that likely for 4663 as well it was just a closer shot of the
exterior of the buildings I'm talking about now the proposed development that
we're referring to was part of Frankfurt CDC's reimagining Margaret Orthodox
initiative the RMO initiative the focus of this initiative is to reimagine
reclaim, and rediscover. More detailed, it means the reimagined sort of arm of this is to engage
the community, to plan community-centered revitalization of Frankfurt, and the reclaim
is to transform abandoned and vacant properties into usable spaces that benefit the Frankfurt
community. And lastly, the rediscover is to encourage residents to explore what Frankfurt
has to offer. So, as I stated, I'm going to scroll.
Our desire is to maintain the current footprint and height of the building.
we don't anticipate any um we're not increasing the height or changing the footprint whatsoever
um we're designing this as close to the cmx two set standard as we can uh be to meet the intent
and purpose of the code but to provide as much affordable housing density as we can
um the renovation we're going to continue to maintain the first floor as a commercial uh
slash retail space and the upper two floors will be residential the let me
zoom that in so it's better here you can see a floor plan of the proposed
renovation we have a little over 1,100 square feet of retail space the bedrooms
range between 512 square feet to 576 square feet and under the code as written we're permitted
three units by right and we're here to attempt to get the additional
unit so we can maximize the space for affordable housing resources
We held a community meeting that was organized by Councilwoman Sanchez's office because
Frankfort CDC is actually the coordinating RCO for this property, and to avoid a conflict of
interest, the community meeting was organized by the Councilwoman's office on August 20th.
There were 20 attendees, and there was no opposition to the project.
The refusal that we're here for are one for the four units as opposed to the three units
the density and additional dimensional variances for the occupied area in the
rear yard deck now the required occupied area under the code is written it's 75
percent for the current condition of the property as the current the current size
but the current condition of the property as the current um the current size of the property
uh is 81 now we're not increasing or changing any existing condition this is just the existing
condition of the building that we are renovating within the same goes for the rear death variance
that's required per the code under the zoning district we require nine feet but the current
condition of the property currently has two feet and seven and a half inches again we're not
reducing the rear depth we're making any changes to the square footage or the size of the building
excuse me um we are just renovating within the existing condition um as such uh we believe these
variances are de minimis in nature as as we they were not created by the applicant there as um as
the current condition is, and the only variance that we're requesting that's actually created
by the applicant is the slight increase in density from the three units that are by right
to the four units that we're requesting.
In terms of, in addition to the RCO meetings, the additional support that we received for
this rehabilitation stems from not only the planning commission, but state representatives
jason dawkins in the 179th legislative district and also when you see the letter of non-opposition
from the local councilwoman herself um it is both our position and per the letter we received from
planning commission in support of our applications for this project that this project supports the
2035 district plan because it maintains housing and eliminates vacancy and has a focus on transit
oriented uh projects and developments as it is a stone's throw away from the market frankfurt line
now just so anyone so everyone has a better sense of
what our desired end result is here's a photo of a rendering uh again we're only here for four six
And as you can see, this is our desired result for that entire section of Paw Street at the
end of both the projects that are going to be before you.
We do not anticipate any increased congestion of the public streets or the transportation.
As I said, it is a stone's throw away from the Market-Frankfurt line, and it was previously
utilized as a flower shop with residential housing above it. And we don't anticipate any detrimental
health or safety or welfare impacts to the community. In fact, we believe this is a net
benefit in almost every respect due to the increase of housing and to the eradication of
blight and vacant properties. Now, with me today, I have, as I said, Kimberly Washington,

dwelling fronting on belgrade street lot b would be for the proposed erection of another single
family dwelling facing miller street resulted in two refusals for a lot size 1441 square feet is
required whereas 1364 is proposed for each lot with a difference of 76 square feet which i would
hope the board would agree is de minimis in nature a2 is the notice of refusal as you can see this
case has been around for quite a long time the refusal was originally issued january 10th of
last year and due to covid and other issues uh it took us this long to get to the board
next would be the application of appeal

this is a copy of the deed uh dated 2014 for the property
photographs as you can see this is the original posting i do have some updated photos of the
reposting properties to the left again single family homes one containing a all street parking

the rear of the property with the the zoning posting this is the rear yard obviously it's
in not such great shape, but that would be taken care of once the new construction is

The first exhibit is the D to the property showing that 1905 Spruce Street Associates
LLC owns the property at 1905 Spruce Street.
After that, I have a Certificate of Tax Compliance showing that the property owner is compliant with their obligations to the City of Philadelphia.
After that, Exhibit 3 is the Notice of Refusal.
As you see, the Notice of Refusal is dated June 15, 2020.
We're in the RM4 zone.
This property has been in front of the Board as recently as last year.
There was a variance granted allowing for professional and office use on the first and second floors of this property.
What we're looking to do today is convert the third and fourth floors of this property as well to business and professional office use.
You'll see the application for appeal that we filed with the Zoning Board of Adjustment, as well as the project information form that we filed.
And you'll see that this is, you know, an RM4 property and everything surrounding it as well as RM4.
You'll see that, you know, even though this is an RM4 district, there are commercial uses sprinkling throughout this part of Philadelphia.

And during that public meeting, we heard three neighbors who all expressed opposition to this project.
And their position was that the applicant's proposed use request for business or professional services would not be in line with the general character of the neighborhood.
So hearing those objections, the CCRA voted to not oppose this application, as described previously, but with a provisor that the business only be operated as a law firm or law office.
And the reason for that is we thought that was a way to address the residents' concerns so that in the event that there is a subsequent business owner who seeks to use the property for a different purpose, that they would have to go through the zoning process and come back to the neighbors again.
and so i discussed that proviso with uh with counsel for the applicant and it is my understanding
that the applicant has no objection to that proviso that was forcible sharon

Number two is we believe it's a slippery slope, that once we start allowing some businesses, others will use that as a reason to follow.
Number three, the building has a one-car garage, but they intend to have a full office full of
lawyers, which will take up the very limited street parking available in the area. And number
four is that the people who have purchased 1905 Spruce Street have shown by their behavior that
they may not be intend to be as neighborly as we would like. The zoning information in the front
is posted several feet, like eight or nine feet high where no one can read it. It is not posted
in the back. And the people in my building received no notification about this zoning meeting or any
zoning changes. So we respectfully request that you reject this zoning variance.

since 1996. It is a residential area. We like it for that reason, and we hope it to remain.
I'm an attorney as well, and I could easily convert mine, I would think, to the same use,
and so on and so on. So despite the proviso, I think it sets the stage for more residents to
turn business. We're at a time particularly when people still need to live somewhere but people
will be working remotely and we therefore don't understand the imperative of destroying more
residential space within the city of Philadelphia. I've witnessed already that there's a lack of good
faith in this presentation. For starters, as Ms. Baker already noted, the poster is at an
unreasonable level to read, an unreadable level. There's no poster in the back. The parking,
whoever is the owner or on his behalf, is already parking on the sidewalk blocking pedestrian access.
The history of the prior owner is that despite the proviso that it remain only two businesses on the first and second floor with owner-occupied space on the third and the fourth, quite frankly, that first and second was used for many other businesses.
now um the proviso is enforceable but i mean we're individuals how much can we fight um
and as i understand the rules uh the fact that this wasn't properly noticed is grounds for
dismissal the applicant has submitted no photos as he's required or as it is required since it's
an LLC, of the posters.
I have photos showing, and they've already been submitted to the address required, showing
that there are no photos in the back, and the one in the front is at an unreasonable
or unreadable level.
The notice that was sent in writing looks like junk mail.
It looks like a class action notification, and it had a date of 8-26.
We only learned of this property being changed, and in particular for a law firm at the Center
and in particular for a law firm at the Center City Residents Association meeting

would love to see a notice there as well.
You're in a time of a pandemic when people aren't on the street generally
or shouldn't be um secondly you've had um the owner act as if he's already gotten this
approval um if you go on the firm's web page his address is listed as 1905 spruce street
i happen to think that this panel this board matters i happen to think that city government
matters um the the property owner has moved in business materials including paper shredders
and document boxes and there's been construction ongoing for months if he's waiting for approval
of this board I don't see it in act or deed and I think coupled with a lack of proper notice that
is in your instructions and grounds for dismissal we respectfully request that this be rejected
as far as the CCRA position historically historically when it was a prior owner
they raised the concern that the use could become inconsistent with a largely residential area and
this is exactly that this sets the stage proviso for law firm or not and I am sorry to see
that Center City residents' interests are set aside so freely.
We've been here through thick and thin.
We want to be here in the city, and we don't need more commercial space
that affects traffic acutely in our back street.

and sort of the occupant of the former McElhaney mansion.
Two years of construction, nonstop trucks, services,

double parking in front of Manning Street,

when they have events and concerts.
Loading and unloading for 1900 Rittenhouse Street,
which backs up, as well as 20 Manning,
non-stop food deliveries and trucks there so it's now become a hodgepodge of just traffic and and
and sort of uses of that if i just happen to google and i i welcome everybody who has a
computer from in front of them to go to google maps and just google the block of you know any
any 1900 whatever manning street and in in the photograph that they're showing is a truck
virtually double parked in front of this house loading and unloading so it's not something that
just i'm randomly making up if you look at google maps right now you can see that they happen to
catch you the one time they're driving about it's a non-stop issue um and it's just the flavor of
the neighborhood and this street particularly especially on manning street we absolutely oppose
this we think this is a it should be rejected not only for the reasons that susan and irene
brought up of not having proper notice and things of that sort but this is not the nature of what's
going on and and to to reiterate what the former folks who used to live in this house they would
have concerts running out of their backyard and we would call the police all the time and you know
you're saying having recourse there is no recourse nobody did anything when anybody double parks and
blocks our garage which is probably 20 to 25 percent of the time we try to get out of our
garage that backs up to manning street invariably someone is blocking the street blocking our garage
and there is no recourse.
We were broken record of calling the police,
calling our state representative,
calling our Congress, we have zero recourse.
So I feel of saying any reprisal of saying,

I think that is just the abuse that has happened

Yeah, there was a lot of commentary. So the first things first, in terms of the community meeting, we did send out the notice well in advance of the community meeting.
And in terms of the addresses, that's our last exhibit, we're told of 82 addresses that are affiliated with this property, and we have proof of mailing and the list of addresses that were sent, the notice of the community meeting.
I would also point out this is an RM4 property.
This is not an RSA 5 property.
The amount of use, whether it's residential or commercial, could be a lot more if we decided to.
But we're actually scaling it down in terms of just having a law firm there.
Right now, Mr. Sewardy's firm has six to seven employees.
So the amount of actual people in the property day in and day out is very light.
The hours of operation for the law firm, typical business hours of 9 to 5, again, very light hours.
In terms of using the law firm or, you know, or the space as a law firm currently, I can't speak to that in terms of Mr. Sewardy.
He's on the line.
But I will point out that the first and second floors are allowed to be used, you know, as professional and office space right now.
So if he is using it, he's not changing that use.
He's asking to expand that use to the third and fourth floors.
I will also point out that Mr. Sciority started his law career across the street at 1900 Spruce Street.
Again, it's not uncommon for a lot of these law firms to have spaces similar to this,
and there is evidence of that, and I believe someone else testified as to that,
that this block is more commercial in nature than most in Center City, Philadelphia, on Spruce Street.
You know, for all those reasons, and including the non-opposition of Center City Residents Association,
and the fact that the owner is going to be working there solely and owner-occupied,
I ask that the boards grant the zoning variance.

Kevin has appeared before this board before. He and his family live in the neighborhood on
master street in fact members of the board last month the board approved a request for variance
relief to build a five-story 25-unit multi-family residential development on the vacant lot next door
to this site across from the jefferson street grounds board members you may recall that i had
mentioned at the time that this location is across the way from Jefferson Street Grounds
where the Philadelphia Athletics at one time had played along with some other very interestingly
historical African-American baseball clubs. So we're pleased that that project is underway
and this subject property is right next door.
Kevin, who is a resident, cares a great deal for this neighborhood,
and his actions over the time have supported his words.
Regrettably, there was some confusion regarding pandemic-related RCO voting procedures,
which fortunately have since been ironed out.
Last Thursday, I submitted an electronic exhibit package with Exhibits 1 through 14
to Ms. Saleta, as well as the Philadelphia City Planning Commission. The exhibit package includes
numerous individual letters of support from very near neighbors at tab 5B, in addition to the
non-opposition of the coordinating RCO, the Brewery Town Sharswood Community Civic Association
at tab 5A. Up on the screen, hopefully you can see it. I know we had some technical difficulties
last week is a photograph of the subject properties. Just to the left is the
development site that was approved last month and these stucco properties
comprise the development site. We also have several near neighbors with us
virtually. Hopefully they're still with us. I know the hearing this afternoon,
hearings have gone long. They are prepared to testify in support of the
project. Here you can see on the screen the subject property is located in the
middle of the 1500 block of North Valley next to the apartment building that
Kevin is building. I'm going to jump forward and hopefully you will be able
to see this to an aerial photograph here of this site. To the left the vacant
grounds is the site that was recently approved for the multifamily
development and to the right are the stucco properties this current
development site. Moving to the site plan, the development site itself is
approximately 6,300 square feet in size. It is zoned RSA 5. It has 72 feet of
frontage along North Bailey Street and very very deep lots at nearly 90 feet
deep, 87 and a half to be exact. As depicted in the zoning map, the property is located on a block
which is largely dominated by the presence across the street of industrial residential mixed use,
you can see that in the purple, and RM1 in the orange zoning. RM1 zoning is immediately adjacent.

it yet. I think it needs to be said that they're presenting that we had some technical difficulties
with our meeting. That was not the case. We had a meeting with about, excuse me, about 49 people
present we took a vote and then after the vote someone went out and solicited
votes from people who were not in the meeting to write in to tell us that they
were in favor of this project when questioned these people admitted because
we had a sign they had to register to attend so we knew who was in the meeting
one of them was not even in the state and I think it just needs to be said that the that they came
in and tried to undermine our process we you know we try to be fair we are fair and respectful to
everyone who presents before us and we are just very frustrated that they would come in and do
something like that mr. chairman members of the board i greatly respect what ms aldridge just said
i'm there there was um um certainly miscommunication that occurred i spoke with
rashida phillips who's ms aldridge's co-chair afterwards i was not involved in this specifically
I thought that Brewery Town Charswood's handling of the matter following that miscommunication
regarding the pandemic issue was appropriate, and I was told none of those votes were counted.
The non-opposition that was submitted does not count any of those votes. I can get into specifics

The first is the deed to the property showing Philadelphia City Properties LLC owns the property.
The second one is the Certificate of Tax Clearance showing that they're in good standing.

and showing that although this is an RSA 5 property,
you'll see from the history of the property
that this block has a history of multifamily use.
I personally have handled seven separate matters
on this block of Seabird Street
with the same refusals in terms of asking for multifamily use,
asking for minimum open area and asking for minimum rear yard depth.
And on each occasion, the board approved and granted the approval of the variance.

And again, showing that where we are in Spring Hills, part of Philadelphia,
You can see there is a lot of multifamily use even not that far away on West Thompson

It's a two-story structure.
But you can see from pictures to the left and pictures to the right that, you know, it's not uncommon to have new construction.

we purposefully laid out the plans for the property to account for a trash room inside.
So we have a trash room to account for trash. That was very important to the community.

showing that i think what happens a lot of times when you don't have rental licenses consistent
from the time you have a use permit until you know a change in ownership sometimes there's
loss in translation where L&I will not issue a new zoning permit or issue new rental licenses
with respect to the new owner, and that's where we are with respect to this property.
We're not changing the amount of units. We're not changing the configuration of the property.
And most importantly, we met with the community, and I have hopefully that letter updated. I do.

as I can explain to the board during if I get to do this presentation. We filed an appeal in
October of 2019. It's now, you know, September of 2020. And this is an unfortunate matter in which
the private lending institution that I that I now represent uh has taken over this project from a
developer that they were helping finance this project and who went or and racked up I think
there's over 19 violations um to to move this forward if we hold a continuance this is now
would now be the second continuance um this project is just going to sit it's in deteriorating
um this project is just going to sit it's in deteriorating condition as you can see
condition as you can see um and we
and we can't do much with remediating the site while it's well could you share some of those
photos we don't want yeah please thank you so i can't so this is the um as you can see it was
received October 15, 2019. There was a continuance in February for, I think it was like a June
hearing that got rescheduled. So now here we are in September. Additionally, I have the violations
on the property. As you can see, there is 11 here, most of relating to building stuff and
architectural services and work that was done inappropriately by the stop work order that was
done by the prior owner of the property not our client we can't do one thing to resolve any of
these until the zoning is approved again this is the other violations is another seven here
the community is concerned with the project is that it's not set back to eight feet again
already existing and already wired up and everything like that so we had tried to explain
to them sort of the severity in this there was a lot of complaints at the community meeting about
the unsafeness of the structure um we're hoping to get an engineer out there tomorrow but again
we can't move forward without um without being able to to do something with this property and
get the zoning approved it's just for a setback um do you have any photographs of the property
is that you just yeah so this is what the property looks like it's the front of it
as you can see
this is sort of the state of it is right now nothing's been done since the stop work order
on the property and now additional violations have accrued this month as well
so going back to that february uh 20th i think it was a meeting was held with the rco
no it wasn't that's why i had i had gotten involved right when that happened i told the
clients that they needed to meet with the rco the original so we continued it um they wanted
you know they didn't understand the process because again they picked up for the prior
delinquent owner um and we did hold a community we had two of them with the first it was supposed
to be south philly homes we couldn't get a response from them it was uh redistributed to um
the to pietra gamble and petra gamble and her group um at the point for ucdc we met with them
twice first with their zoning committee and then with the full um community group so you know
again pushing this off with these violations pending on this property and the unsafe condition
of it what was the uh discussion at the two meetings and what was the reason we haven't
moved forward um the discussion was basically this is a block that has on both sides mostly has
two uh story homes there are some that are on the other side of the street have been um have the
setback has been waived and there's some that have the actual setback on them so it's not really out
of character if i would just show you the and we couldn't get they they were not understanding or
they weren't sympathetic to the damage that could be caused if we try and demo it and do a mansard
roof or demo it and do this because of the condition it's in and uh so we they wanted us
to come back again to discuss the same thing again although i don't know that if we were going to
have the same conversation that would result in a in a different sentiment um there was somebody at
the meeting who was kind of uh wanted photos of standing on wanted us to get on the roof and stand
on the property to send pictures of the neighboring roofs we were not able to do those so she didn't
feel like she got the picture she needed um i'm trying to remember what some of the we had said
that we're happy to move this cornice line down here because one of the things that they mentioned
was they really like when the cornice line so we were happy to to do that it just wasn't a very
productive conversation about um ways to move forward they wanted us to furnish them an
engineer's report which again we're happy to do but we weren't going to be able to do that in
three days before this hearing and again if we we don't have guidance on how to move forward as far
as the zoning of this it's it's hard to get an engineer to come out there to give us you know
a step a proposal to move forward hey counselor counselor can i have a question yes sir had a
feeling you were going to go ahead please proceed uh do you have a building permit did you get a
building permit um we don't have we didn't file for a building permit they originally i think
had filed for some permits but they did work outside of the prior owner did work outside of
what the city allowed so that's kind of why we're we're here we can't move forward on a building
we're here we can't move forward on a building permit when the zoning is wrong
permit when the zoning is wrong so he built it with
so he built it without a building permit he got a building permit but he built it different than
i think what he got approved that's my understanding of it and again i now represent
the financial group that had lended on this project that then had to take it over because
he didn't meet his financial obligations the current owner is not responsible correct correct
and i have their construction manager as well here are the vice president of construction here as
well um who they have hired to help remedy this um so he could probably speak better than i could to
what was pulled and what wasn't pulled but it's a new contractor a new everything because again
this wasn't done by the by the current clients if you can see i'm sorry tom you finished you know
is it conceivable if this board were to grant this variance that
l and i or somebody can may come by come come along and not issue a permit or order that that
upper floor that third floor be demolished because it may not be in safe condition
and that's what you're trying to get right you're trying to get an engineer out there is that
correct the goal for us would be to get the the zoning approved so that we could then at least
have a way to move forward and then that way yeah if l and i or the uh engineer comes out and says
that the third floor needs to be adjusted or removed and we're happy to do whatever it is we
just need to move forward you can't move until you get to anything all right yeah because i'm
looking at this and i see a drain spout coming out that shouldn't have been there and we yeah
i don't know what's i don't know where that rain that rain what is coming from i guess what kind
of yeah and i can go into the details of why things look the way they look but again we just
wanted a path to move forward i think you made your point and again no disrespect to miss gamble
I think that we got to get somebody out there to check the structural
integrity of this property. The longer we delay it,
the more problems we're going to have.
And it may conceivably be that the third floor has to come off anyway.
So I respectfully declined to continue this case.

And again, we're willing to make compromises to make it so that
if if we are able to keep the third story that we can change the facade at least for the cornice
line to make it you know not as um obvious that it doesn't mesh with the block that's assuming
that there's no structural the integrity of the third floor is intact that may not be so it may
have to come off and you'll be down to that cornice level anyway correct and we let the community
know that if we were going to make any significant changes that we'd be right back in front of them
anyways so we're not trying to do anything outside of what what's allowed

I have been listening. We had a community meeting and there are residents that are currently
listening who have been on my phone waiting for this hearing. I visited with the neighbors after
this particular hearing. And as Rachel knows, we actually spoke about having a continuance
during our meeting. And when we left that meeting, we thought we were under agreement that we would
continue this um and also councilman johnson's uh aide uh france pierre was also also privy to that
call and we had him dispatch elena to this property because of the damage that was done to
the joining neighbor's property now when they talk about this has to be done we asked the requested
that an engineer be uh present and we asked this last week it's interesting that she mentions that
the engineers automatically, magically getting ready to appear. The reality is we asked for this
information last week. And also when you talk about the downspot, that was also one of our
concerns. And because the property had been sitting for so long and is damaged, we didn't
know how safe it was to proceed. But what we did ask to try to compromise with the developer was
that they would remove the setback because that's what the refusal was for. So we told them that we
would approve it if they removed the setback so that then they can get the
engineer and everyone in to look at the safety and the structure of the building.
They refused to do that. So we tried to compromise based on the things and the
benefits that the community would like. And the reason why we didn't even take a
vote on this project is because they agreed that they would continue this
project. There are neighbors listening now that are indicating that they do not
want this to proceed. We are in agreement that we had a setback removed and then
we want to get an engineer to go and there's a woman who when the first person put in he actually
the beams are in her kitchen wall from that house they stuck old and seen the house up it was i
went there to look at it the next day it is outrageous uh and it is dangerous and i agree
that it needs to be something needs to be done about it but it has to be a process it can't just
be well we're going to do what you say we're going to do and then we have to trust in that
because if i had to trust in that i wouldn't trust in the fact that rachel came in here and actually
presented something totally different than what she just presented to us and i'm outraged about
that but i think can i address that um let me finish rachel hold on hold on everyone hold on
please just just a minute i finished mr little page and then rachel you you can respond and i i
have some questions of my own that i'm going to need some uh expertise uh from sharon and and

the refusal we would like to address the refusal we asked them to remove this setback if they
remove the setback then we can revisit this project after the engineers there thank you
i'm going to get to that that's one of my questions uh but rachel and then so at the
end of the meeting um and i talked to franz from the the councilman's office um as well i had
actually said can we put it to a vote because i had i had gauged from the tone of the meeting that
we weren't going to come to a compromise which was okay we want you to do the engineer's report
and we want you to set it back but we had said to them we we can't just go and set it back we have
to work through the process there was no appreciation for any of the procedural considerations
I was trying to explain we were it was not a friendly toned meeting and Albert was kind
and considerate but there were some other folks who were not willing to listen to actually how
this works from a procedural standpoint so then I said go take a vote because I figure we weren't
getting anywhere and having another continuance for everyone to say the same thing was going to
leave this property sitting in the condition that is which is making nothing better on either side
of this, right? Then Albert said, well, we want to actually have a continuance because I don't feel
like we're getting, we can get to a place where we can find a compromise. So they asked for a
continuance. I did not say anything in writing about I'm going to continue it. I explicitly
remember saying I don't want to continue this and I wanted to vote because we wanted to move this
forward. So I apologize if there was a mischaracterization or a misunderstanding from
where my perspective was but i don't know in in my six years of doing this i would have never
in the situation where you're dealing with ellen i and dangerous violations on a property would
have wanted to continue something for another couple months with no resolve because even if
we got an engineer's report and sent it to the community group there would be there's no
assurance that they would agree i think and there's no assurance that we could still do anything
because ellen i wouldn't let us do anything understood understood i think the one thing
everybody could agree on it's a deplorable unsafe situation and nobody wants to be here
the sidewalk has been inaccessible for almost a year maybe even longer longer the communion said
longer um may i ask a question um i'm sorry i had a question it sounds to me it sounds to me i could
be wrong if going forward if this board approves this variance could we have some provisions in
there that talk about the adjustment to the third floor that it would have to have the
three foot or whatever the setback is required no because that was that was the only ground for
the refusal when you're going to require the setback then you're essentially you're denying
the variance and they can get a buy right permit they don't have to speak with the community at
all for that is that correct rachel correct the only reason you're here is because it was already
built out of character and didn't have a setback and it's already been built and it's already been
sitting um and the demolition without getting approval to see what's going on there first
we don't want to just agree to demo something that may cause more issues this has been sitting
for two years so that that's really the concern counselor yes sir i believe you can get a make
safe permit by engineer and then set it back eight feet but our yeah which would be essentially
having us start over that's not a story no but it's just getting where you are now
right but the our and i understand that our thought was if it's already been built out
it's wired up there's plump there's you know plumbing and let's say from the engineer and
set it back yeah and and and i don't know i don't have any i haven't seen this you have them fine
you can show them any interior yeah we have interior i'm just like that that drain spell
that must be coming from the interior of the building i i don't get where that came from
can we bring kurt on the on as well um tanya because he's he's way more advanced on the
construction side of this and has been involved way longer than I have. I want to get to a place
and I don't know if somebody can help me get to a place that says you guys can go out and do all
your structural engineering inspections and whatever but I want to get to a place
but I want to get to a place that that third floor has to be set back.

this so maybe we actually need to get the structural engineer and get that information
so that we can make a better decision than sort of just guessing on how to do this would that be okay

so they're in the loop with that as well yeah i mean the case will stay open obviously we can't
we're not going to close you have to go out and get a structural engineer i understand that i'm
just saying if we could at least spend the next two weeks getting that information that we could
provide to the community that way at least we can say hey listen we we need to demo this anyways
so let's just withdraw or actually it's in good shape you know here's here's the path least
resistance on this end it's just i'm trying to give us bet more answers than what we have now
that's kind of where i was going yeah yeah i i have rachel i'm sorry question i had rachel was
did L&I ever require us to get a structural engineer or was that brought on by the community
group? So what I was saying to them was I haven't been in touch with L&I besides knowing that we
can't pull any permits. We don't have a we have a stop work order. We don't have a make safe
violation. If we had a make safe violation to Chairman Holloman or Member Holloman's comments,
we would need to get plans and everything. I do believe we should get a structural engineer
either way ellen i most likely will request that um so i don't i don't i think that it's
something we'd have to do anyways what i'm suggesting is that we uh we do that it'll help
appease the um the community's concerns and also will give us better direction and the board better
direction um with this case going forward because the prior the prior owner went ahead and built
something apparently that wasn't even part of the the permitting process they gave him the
to go ahead in the first place so if you see here they went beyond the scope of the permit
days it says here permit work not same as permits so whatever they had submitted um you know to to
lni was not uh what was approved i'm in agreement with that and my point of bringing it up was the
fact that uh when i discussed the structural engineer we're we were never ordered by lni to
get a structural engineer not that i'm not in agreement that we need it but we're being preemptive
the community brought it up we agreed to it we tried to act on that as fast as possible and um
one of the uh board members from the community had brought up that he found that it was slightly
odd that we're getting it done tomorrow we have our meeting today but there was nothing nefarious
in that we acted in best interest and best scope uh i only really accommodate that sir
no disrespect to anybody i only raised the issue about a structural engineer because the
the developer went ahead and did something beyond the scope of what the
permit is. And we don't know if that,
if that third floor edition was done,
it was built according to code. We don't know that. It's possible.
It won't have to be demolished. Right.

and members of the board. My name is Steve Bertil from Claire, B-E-R-T-I-L, from Claire,
Harrison, Harvey, and Brandsburg. I'm here on behalf of the applicant owners and project leads
for 53 to 59 north 52nd street um what you're still under mr batel you're still under oath
i'm sorry you're still under oath from this from earlier okay great thank you um i i'm here on as
i was saying i was here i'm here on behalf of the applicants uh owners and project leads for 53 to
59 north 52nd street um kayib smith guy lauren i also have with me here just in case um there's
any questions regarding design our architects from sky design studio yao chang wang uh
and ying yuan chen um i believe there's also we also have some members of community that want to
testify on to why they support this project. Before I get into, if the board will allow
me, before I get into the specific variance request, I believe that there may have been
some letter requests submitted for continuance, which we are opposed to, and I would like
and I would like the opportunity just to provide a procedural timeline of this matter to outline
the opportunity just to provide a procedural timeline of this matter.
why we would want to ensure that we're going forward today and that we can hopefully obtain
the decision on this matter today. Just a sense of procedural background and context, this matter
is pursuant to a notice of refusal that was issued by L&I back in December of 2019.
We submitted an appeal for accelerated review in January of 2020.
I believe it was January 13th.
At that time, a hearing was scheduled on March 18th, 2020 to appear before the board.
upon receiving the day of the hearing, we were in correspondence with the coordinating RCO.
Unfortunately, we could not reach a time to have a community meeting before that,
so we submitted a request for continuance. At that time, the request was for hopefully 30 to 60 days.
Unfortunately, as we all know, on this call, the pandemic and the city shut down,
and obviously the board shut down made that not to be able uh not possible um as such the next
hearing was scheduled on this matter for july 15th 2020 prior to that we held a rco meeting
on june 10th 2020 with the coordinating rco which uh is achievability for this property
these properties. At that hearing, there were 33 participants. At that time, the highest amount
to date for virtual RCO meetings for me. There were 21 votes counted. 62% of those votes voted
yes in support of this project. 24% voted yes for changes, and 14% voted no. Subsequent to that July,
I'm sorry, subsequent to that June 10th RCO meeting, we were contacted by Councilwoman Gaultier's office in the coordinating RCO, stating that community members were reaching out, stating that they weren't aware of the meeting that was held on June 10th.
At that time, we agreed, I mean, one, to show we're engaging in good faith, but also to make sure that we satisfy all the notice requirements because we understood it was like early in the time of virtual Zoom meetings for RCO meetings.
So at that time, we submitted another request to the ZBA to continue the scheduled July 15th hearing
so that we can hold a second community meeting to make sure the people that felt that they weren't aware
or who weren't aware, not felt, but who weren't aware could attend that meeting.
We submitted a request for a 30-day continuance.
That wasn't able to happen because of the backlog of the cases, obviously, and so therefore the next hearing that was able to be scheduled was today, September 1st.
Before this hearing, we had a second RCO meeting. At this meeting, there were 55 participants surpassing the prior meeting and 37 votes counted.
Of those 37 votes counted, 41% voted yes in support of this project, 27% voted yes with changes, and 27% voted no.
Between the two meetings combined, there were a total of 58 votes counted, 48% of those votes voted yes to this project, 26% voted yes with changes, and 26% voted no.
Subsequent to the second RCO meeting, we were contacted by Councilwoman Garcia's office in the
coordinating RCO stating that they wanted to discuss additional concerns or questions that
they had about the project that was presented. We held a meeting with the RCO leadership that was
organized by the councilwoman's office. At that meeting, the leadership and the attendees of that
meeting requested a community benefits agreement. And at the conclusion of that meeting,
it was agreed that the RCOs would send us proposed items that they want in a community
benefits agreement that we review and let them know if that's something we can or can't do,
depending on items um we receive them uh on august 20th we reviewed them and then we
On August 20th, we reviewed them, and then we responded with our responses of what we can do, what we can agree to, and what we can't agree to.
And then it's my understanding that yesterday afternoon there was letters sent by the RCOs
and possibly maybe someone will be making a comment after my presentation that they
want to continue this matter further to discuss one of the items that we did not agree to.
um i can either at the board's discretion go into um what i think is at issue in terms of why they
want their why some people want to continue with pursuant to the letters um or i can go through
with my normal presentation and then address that at the end if those comments come up
would you uh you can move forward with that move forward with the presentation or do you
Okay. So as I stated, we're here for, and I'm going to share my screen now. Are you
able to see my screen? Okay. As I stated, I'm here on behalf of the owners and project
leads for 53 to 59 North 52nd Street. We are here to request a variance approval for the
relocation of lot lines to create one lot from four existing parcels and for the new
construction of an attached five-story structure for use as a commercial space on the first floor
and cellar and use as a business and professional offices to be utilized as an entrepreneurship hub
on the first to fifth floor. So I'm going to just scroll to give you a sense of the current
condition the property this is the property that i'm speaking speak referring to if you can see
my mouse um it sits on 52nd street between uh arch street to the north and market street to
the south it is currently zoned a cmx2 um commercial mixed use uh and it is currently
for vacant lots. The property is sandwiched in between a vacant structure on the right
of it if you're facing the frontage and a neighborhood corner store or small market
on the corner of Arch and Market Street. Here are just some photos of the existing properties
showing that there are that's currently vacant another photo looking down from
Art Street that's a photo looking up from art I'm sorry looking up from market or
with your back to market I should say this is just a photograph of the
notifications posted on the property for the ZBA hearing for both scheduled ZBA hearings for this
for the hearing we're having today and the previous one that was originally scheduled for July 15.
And now I'll go into the proposed project.
So as I stated, let's zoom out here so you can see that better. As I stated, we're seeking the consolidation of four parcels into one lot to accommodate the proposed structure, but that's actually not why we're before the board. We'll get into the refusals in a second.
The proposed structure, as I said, is a five-story structure with a courtyard for use as commercial space on the first floor in the cellar, and the business and office spaces for use as a co-working entrepreneurship hub on the first through first floor.
So as you can see from here, this is frontage on 52nd Street. Up here would be Arch, and Market would be to the south.
You get a sense of the elevation the property the build the proposed height of the building is
is 55 feet the proposed lot area after the consolidation the lot area will be 7,232 square
55 feet the
proposed lot area
feet and the building footprint would be 5,216 square feet even the courtyard of 1,920 square
feet um excuse me the due to the court we meet the open air requirement for this property but
there are additional um refusals that are related to that that i would get into in a second um just
to give you a sense of the floor plan up here is what the first floor looked like as i said this
is facing 52nd street and the entrance would be this is the commercial space and then this
entrance over here would be to the co-working entrepreneurship hub that we have planned for
this project the the floors from three to five are identical as you can see there's meeting spaces
office spaces, individual cubicles, things of that nature that make collaborative meetings
and collaborative endeavors possible and the spaces to reflect that.
So you get a sense of the rendering.
Let's zoom in again.
Here's a rendering of what's envisioned for the property looking down from Arch Street.
um as you can see it's uh from from 52nd street we are feeling the entire lot um as you know from
the aerial of the building that we do have a considerable amount of open space um that will
be utilized as a courtyard looking up from market street this is just another view of it within the
context of the street. And here's just a view of like a frontage of it on its own.
So in terms of the refusal and the required relief, let me just scroll back up to the notice of
refusal. So the maximum height on the zoning district is 38 feet. We're proposing a 55
foot structure after we consolidate all the lots. I will have the project lead get in
specifics of why this is why this is something that's important for the project in our sort of
vision for the for the project i'll just say now that in terms of a co-working or collaborative
space needs to be big enough to attract users occupants and entrepreneurs to create an energy
needed to thrive we're also envisioning support groups participating and they need that space as
well. The building, in our eyes, needs to be bold and iconic in design, so it shows confidence and
pride into going into the future. We believe that the building size is essential to what we're
trying to accomplish here with this entrepreneurship hub. In addition to the height, we have a refusal
regarding the rear yard. Under the zoning designation, a rear yard of 11 feet, 11.3 feet
is required um technically there's zero square feet or proposed yard we actually have more um
than the required open space for the lot we just wanted to we wanted to design it in uh in the more
of a courtyard for the building that is more amenable to inside outside programming than just
a backyard so as i showed you before a little bit earlier
There's a considerable amount of room space here.
We just elected not to move it back to the property line behind the building, which would just be, I guess, a rectangle building with a backyard.
We wanted to make it a courtyard area that's accessible on multiple points of the building and, as I said, is more amenable inside-outside programming and an amenity for potential entrepreneurs or businesses utilizing this space.
In terms of additional support, we have letters of support from business owners, community members, local nonprofits, and local property neighbors.
In fact, I believe some of those individuals are here to testify and support today.
Per the 2035 plan, the top planning, one of the top, or some of the top planning issues,
Per the 2035 plan, the top planning, one of the top, or some of the top planning issues for the West District is the high vacancy rate of parcels and how that contributes to crime or other problems.
Additionally, they list in the 2035 plan for the West District that commercial corridors are generally underperforming in comparison to the rest of the city.
and essentially this means that residents have to travel further to get anything that they need
or obtain services or quality projects.
Some of the key initiatives in the 2035 plan is encouraging development around transit
and concentrating on strengthening the commercial corridor.
It is our belief that this project hits both of those markers as the 52nd Street Terminal
and train stop on the market uh frankfurt line is literally literally at the top of this block
and also it's we are currently re using the space that's currently vacant and not being utilized for
any uh to the property um so before i go on i would like to call i'm going to have um

And there is a bit of a time crunch in that we've got opportunity zone issues that need to be up and ready by the end of the year,
in addition to the tax abatement and an increase in taxes that are facing us at the end of 2020.

if you can just uh explain the board uh your background and then what the intent and vision
is for this property and this project thank you so i'm a third generation philadelphia and i
In my adolescence, I lived at 52nd and Chancellor.
I used to commute from 52nd and Market.
I've been a real estate developer for approximately seven years,
and I've worked for myself since 1999.
So I'm fortunate enough to be a serial entrepreneur,
and I'm passionate about black and brown business ownership.
I believe it is the key to fiscal destiny,
and I'm passionate about bringing some of the benefits
the benefits that I've been fortunate enough to create to West Philadelphia and for this project
that I've been fortunate enough to create to West Philadelphia.
the density and the transformative energy we need to create for the entrepreneurship hub that we
envision the height and the size of the building is really important. I believe that if we were
limited to what some naysayers would like us to be beholden to it will be difficult for Guy and I
to achieve what what we would like to do because the numbers just don't work um yeah that that's my
perspective thank you mr land uh members of the board i so i i'd just like to circle back um as
i stated we have made um good faith efforts to um engage with the community members the rcos
those, as I stated before we got into the substance of the variance request, that we
have been in open communication and that there were requests made of certain items, and we
have agreed to some of those items, which include providing quarterly updates to a community
advisory board providing access to the courtyard and meeting rooms for through community programming
having at least two career fairs for the community providing individual capacity building
through what what is called the if lab which is a program that's going to be housed at the
entrepreneurship hub and to make good efforts to maximize the utilization of black subcontractors
and during the construction phase um and lastly we um agreed that um we would have we would not
be opposed to providing a mural on the side of the building where you see i believe i'm still
sharing um where you see here um on the wall facing arch street now there there was a request
for us to reduce the either the building height or set back the fourth and fifth floor to reduce
the massing and those were two requests the dimensional crest that we stated that we could
could not accommodate excuse me due to the reasons that were just explained by Mr. Smith and Mr.
um loren and i believe the letters that were sent to the board were uh requesting the continuance
or something that a continuance i believe it was 30 to 60 days um to address that issue in 30 days
or 60 days our position on that specific issue isn't going to change um because of the vision
of this project. So because we feel like we've made some headway with agreeing to some of
these things that we fall in line with the vision of the project anyway, we're vehemently
opposed to any type of continuance, and we believe that this project fits in line with
the vision of revitalizing the commercial corridor on 52nd Street, and as such, ask
for the board to approve our variance request um thank you now did you say mentioned earlier in
your testimony that there was uh there were one or two whatever i forgot how you phrased it
outstanding issues and is that the issue on the setback or were there other community benefit
issues you mentioned something about community so those were the issues so in the when i read
the letters uh it seems like the massing um was the it's like the size of the building is the
issue that they uh that the members or the community rco leaders want to change or defer
uh discuss further um and so our position is a continuance is not going to solve that problem
because that's the one that's one of the issues where we um couldn't make a concession on um all
of the other issues that I listed earlier, we agree to, but that is the one that we can't agree
to due to the vision and what we want to do with the space. So there are no outstanding issues as
it relates to the community benefits agreement? Oh, I can't. That's my question. Are there still
outstanding issues as it relates to the community benefits agreement not i'm not discussing the height
or massive oh i see we re so we've responded to every uh they sent us a list of items um or
i don't want to mischaracterize what they call them but uh items or key priorities i think was
uh items or key priorities i think was was how it's phrased and we responded to each one so our

and the virtue of the project, right? So we're not against that. However, we are really having
a lot of issues right now with mass incising. Right now, the only outstanding issue in the
community benefits agreement was working with the coordinating organization that has a TCMP grant
and does economic development along the corridor which they refuse to do however i believe in time
you know informally they will work together but that was one thing that was part of the community
benefits agreement that was um that was a rejection we also didn't ask for a mural um
we appreciate that they that they offered that but from our point of view um both from a stakeholder
point of view and an RCO point of view we haven't actually gotten any idea as to why they cannot
step back um any of you know the the um third the fourth and the fifth floor um we've asked for
pricing for how how much the um the of the i the space will be leased for we haven't been able to
get that those numbers we only were able to get very basic numbers on price per square footage
so from our perspective the um the idea that this is a financial hardship to not set back
to be more in line with the character of the community in which they they will be a part of
hasn't actually been met so that's the major issue right now we we are really excited to
continue to work with them. But if it won't move forward without a vote, I think that'll be up to

The variance thought is a substantial one and, if granted, will permanently affect the look and feel of this neighborhood commercial corridor,

Many legitimate concerns about this were raised during community conversation,
and we think the project and the community will benefit from more time to work through how this impact can be mitigated.
Our office can commit to help facilitate this between now and the vote date,

We thank this opportunity, but we want to set the record clear because Brother Steve even made it clear.
Although there were two meetings, the first meeting really don't count because it wasn't done in a proper way.
It wasn't notified to all the proper people.
So that shouldn't even be part of saying we had two votes, two meetings.
and also that to combine yes with concerns they want to just put them in
the yes column column and not in the no column so we're trying to address the
concerns that the community have brought to our attention so that everyone can be
on the right page on this so in at each time has been a high number of yes but
with concerns and those concerns are some in it are in the community agreement a document
this is a uh as as we sent a letter and as a state um from the council person's office that
this will change the whole uh dynamics of 52nd street this large building so if we want if once
we do that and then it will open up to a lot of other um uh ventures that want to do that
so we want to get it right we're not trying to hinder or or even uh um permit them from not
having a good project that we think will benefit the community we just want to be on the right page

Just two statements that I made. First, I just want to clarify the numbers, and I can outline them again, but the numbers that I represented on the record broke down the percentage for yes votes, yes with changes votes, and no votes.
I did not combine yes votes and yes with changes votes.
I've kept those separate.
And in both meetings, the yes votes outweighed the yes with changes votes.
As I stated before, in the first meeting, the yes votes were 62%.
The yes with changes votes were 24%.
And just the straight no votes were 14%.
um in the second meeting the just yes votes were 48 percent and the yes would changes votes were
26 percent and then there were no votes of that one as well that were 26 percent and i just wanted
to highlight that both the issues the issues of mashing were brought up in in both meetings um
they were brought up in both meetings and then they were also discussed at uh they were brought
up in the subsequent meeting that wasn't an RCO meeting, but it was a meeting with like
the RCO heads that was organized by Mr. Goodman and the councilwoman's office. So
massing was a was an item that was discussed all throughout this process at every meeting
and every discussion and then the votes were had with that information. I just wanted to be clear
on that um but i'll allow you to uh mr chairman i'll that's the end of my response but i believe

I just want to read a letter into the record.
Dear Chairperson Chico and board members, I'm requesting the zoning board to hold the
vote for this application for at least four weeks from this hearing date.
for this application for at least four weeks from this hearing date. This project represents the
most significant new construction initiative proposed for the north 52nd street commercial
corridor generations and as such it is in the unique position to permanently change the form
character and public realm of the corridor. What is decided on this project in terms of mass and bulk
will ultimately become a precedent for future development along the corridor for this reason
more time must be given for the developer to work on the concerns raised regarding the proposed
buildings height materiality and relationship to the existing architectural rhythm of the corridor
as a member of philadelphia's former zoning code reform commission some of our core tenants were
to protect neighborhood character promote economic growth and to include new land use trends
in the updated code and as current member of the civic design review committee in philadelphia
i am passion i passionately believe that the form and design control set in the zoning code
help to preserve neighborhood character and make the public realm more hospitable it is clear to me
that this project has the opportunity and potential to effectively address these core
tenets. I am hopeful that the developer will take the additional time requested
to make this a truly spectacular project that can be a best practices model for how to rebuild
and revitalize an aging urban commercial corridor. Finally, as a lifelong resident and small business
owner of this what's philadelphia neighborhood i welcome the positive change that this project
if done right can promote respectably respectfully michael johns thank you thank you very much
thank you mr bertell do you have any comment yes so uh mr johns and mr jordan were on the
excuse me my apologies uh were on the the phone the phone conference that i referred earlier that
took place subsequent to second uh rco meeting as uh representatives of i believe the 44th ward
uh rco um and the request uh we're not unfamiliar with their request for reduction in massing um
And I believe, as I said before, that Mr. Johns also voiced his position on the massing of the building at the second RCO hearing.
His position was heard.
And again, the community voted in support of this project despite his individual concerns.
um so the the notion that this is and that i don't think anyone on this call said this but
i'm just going to say this is this is not a a rush job this is not a a a situation where we
haven't engaged with the community as i've said we've engaged uh this application has been pending
since january um and we proactively reached out initially um even when there wasn't a hearing
scheduled um and then after there was a hearing scheduled we we didn't have any pushback to mr
jordan said the first meeting didn't count but there were over 30 people on that call we did
send out uh their their the physical notices to um over you know every every home in the 250 foot
radius now my i think there might have been an email left off of a uh email that was sent uh
or something of that nature um and as such there was no pushback against holding the second one
once we were aware of that um and then at that second meeting although there was again there was
more robust discussion there was over 20 more people or 22 more people that attended um the
vote still bore out where the majority of the people on the call voted yes not yes with changes
the majority voted yes um and subsequent to that uh we were open to conversation we were originally
hesitant because we didn't understand what the subsequent conference call was about but we ended
up having that call we heard their concerns we asked them to submit or to send us some items
we looked at them and we responded with what we can do and what we can't do um and that was
That was, I believe, on the 20th, and then we, or I wasn't aware that they were going to be requesting the continuance until yesterday afternoon.

So my assumption is because they, some of the representatives, or if not all of them, were not happy with some of the responses, but the response on the massing is not going to change in 30 days.
That's something that's essential to what we believe is an important space for something like this to succeed, partly because Mr. Smith's background, which he didn't get into, so I don't want to testify for him, in other co-working environments, he has experience to know sort of what works and what doesn't and how much space you actually need.
to be frank uh uh members of the board and mr chairman if we didn't think it was important we
wouldn't be here because all the uses we're proposing are allowable by right so we could
you know we could put this type of use in a i guess a 38 foot building but because we don't
think that's going to be successful uh that's not something we're trying to do and we're trying to
make this a successful beacon. I should also state that it was mentioned a few times that
this is something that can change the fabric of 52nd Street. That is the intention. The intention
is to change 52nd Street for the positive in a way that'll benefit it. We believe that going in
a new direction with 52nd Street is essential. It's not something that we can do ourselves,
which is why we want to work with the community groups that are both established and the newer ones with the younger people,
because our vision is to be partnering with entrepreneurs and people who want to sort of build an economy in the 21st century economy, as Mr. Smith would say.
But so, again, while we're sympathetic to the idea of change and the idea of the size of the building, we do believe it's a net positive.
We believe it's in line with the goals and the concerns of the 2035 plan that was developed by the city and other community stakeholders for that area.
and so because of that we're asking that the board support these two dimensional
variance requests that would allow us to put what the overarching and more important issue
is the use of that in the of that building to make it possible okay can i ask you a question
frank can i ask yes please i'm just going to ask okay do you do you think if we
further delay this project it would present a hardship to you to the development of it
i'm sorry can you say that you're i'm sorry you're breaking up quite
if we further delay the project would it cause a delay upon the development of the project
well our position is and we believe this to be fact that um the project would be severely
prejudiced um because as we stated the applicant we filed the application in january the refusal
was issued in december now some of that is to no one's fault obviously some of that is to the um
due to the covid pandemic but it is the reality the reality is that we've been delayed substantially
and therefore um things such as financing things such as um the uh neighborhood opportunity zones
things such as the abatement that were all part of the sort of uh sort of the makeup of the project
the financial wherewithal in the capital stack and things of that nature um all of that's at risk
I mean, it's currently at risk, even if we were able to get the July 15th hearing, but now we're so far down the line that it's putting the project in jeopardy.
And I don't want to speak for a misregard, and Mr. Wren or Mr. Smith can speak to this, but my understanding is that this continues to get delayed as much as it has been that the project may go away, that the livelihood of the project may go away.

Okay. Good afternoon, Mr. Chairman, board members. I'm a resident who lives in the
neighborhood area, but not only am I a resident, I'm also a business owner. My company,
Katika, is a technology startup started right here in my apartment. We're a platform that
helps people find local Black-owned businesses and services. We also create
community events which provide important local dollars to our businesses.
Recently we partnered with the Department of Commerce, the African American
Chamber of Commerce, and the Urban League to host the first-ever curbside
restaurant week back in July. Now today's discussion about the rezoning of the
52nd Street property is important because it allows small startups like
mine to be able to move out of an apartment and into low-cost shared
office space where businesses like myself can continue to grow and hire
locally. Other expensive workspaces like WeWork are downtown and not in small
neighborhoods. This proposed project keeps small businesses like mine in
West Philadelphia. And I want to make it clear that this isn't a redundancy of
any services that are currently offered in our community as previously
suggested in other calls that I've been a part of. In a commercial corridor where
building where this building is proposed yes it will be larger than the small corner store it's
next to or the residential home but that's why it's a commercial corridor. So with that said as
a local resident and a local business owner I'm strongly in favor of the zoning change and ask
the board to consider the approval of the variance requests because further delays will only result
in a continuous loop of getting nothing done. If you want to revitalize the corridor and take action
being bold and having division we can't be afraid because delaying is the same as doing nothing

While we have no objection to the density of the building, we would recommend that the
applicant work at reducing the overall height of the building or amend the plan to include

abatement how that plays into the financing of these types of projects so i'm not one to

tried is usually used to require the applicant to go forward and to allow the board to dismiss
the appeal if the applicant is not ready in this case that that wouldn't apply
