The purpose of this ordinance is to extend the time period to 5 3/21/01 STREETS, SERVICES - BILL 000765 construct a campus plaza and walkway and consolidate nine contiguous parcels. This ordinance is supported by the Department of Streets and is recommended to the committee for favorable recommendation.
Good morning, Chairman and members of the committee. My name is Martin Soffer, from the Planning Commission. The proposed ordinance authorizes the striking from the City Plan and the vacating of two unneeded streets in a University City neighborhood of West Philadelphia. The purpose of this action is to enable the University of the Sciences in Philadelphia to consolidate parcels in order to construct a new academic building, campus parking, and pedestrian and bicycle pathways. Therefore, by action at its meeting of November 18, 1999, the Planning Commission recommends that Bill No. 000765 be approved. Thank you.

The purpose of this ordinance is to permit the consolidation of the University of the Sciences in Philadelphia's campus and to enable the construction of a campus plaza, walkway, and a new academic building. Therefore, by action at its meeting on December 2, 1999, the Planning Commission recommends that Bill 24 No. 000767 be approved.

Good morning, Chairman and 17 members of the committee. My name is a Nancy Sen, 18 and I'm an engineering supervisor with the Streets 19 Department. I am here to testify on Bill No. 20 000769 on behalf of the Department. 21 This bill authorizes CNL Hospitality Corporation, owner of the Courtyard Marriott, to construct and maintain a total of three aluminum flag poles and flood lights on, above, and below the public footway of North Juniper Street, 9 3/21/01 STREETS, SERVICES - BILL 000769 between Commerce and Filbert Streets. The encroachment descriptions are as follows: Three aluminum flag poles, with a maximum approximate height of 45 feet located in the island area within the east footway of North Juniper Street; and three in-ground floodlight fixtures located approximately two feet west of each of the flag poles. All encroachments occupy a raised island area at the entrance of the building previously authorized by ordinance 980203, which was signed by the Mayor on April 24, 1998 and approved under City Plan No. 307. As such, these encroachments do not impede pedestrian traffic. Therefore, the Streets Department has no objection to the passage of the bill.
Bill No. 010067, an ordinance amending Section 9-205 of the Philadelphia Code relating to sidewalk sales by providing for sidewalk sales on the 5000 block of Wissahickon Avenue, on the west side, under certain terms and conditions. And Bill No. 010068, an ordinance 15 amending Section 9-205 of the Philadelphia Code relating to sidewalk sales by providing for sidewalk sales on the 3200 block of Fox Street, on the east side, under certain terms and conditions.

I am Otis Haigler, Legislative and Regulatory Affairs Manager for the Department of Licenses and Inspections. 11 3/21/01 STREETS, SERVICES - BILL 010067, 68 Today, I am here to provide testimony on Bill 010067, which, if enacted, will amend Section 9-205 of the Philadelphia Code to allow sidewalk sales on the west side of the 5000 block of Wissahickon Avenue. With respect to this bill, the Department offers no objections to its enactment. Thank you. I will be happy to answer any questions you may have at this time.
Thank you, Mr. Chairman. And, Mr. Haigler, I appreciate your testimony. Mr. Chairman, this is a situation where, because of a previous bill which prohibited vending in a very large area, we subsequently learned that we inadvertently prohibited vending in an area that we did not want to prohibit vending. So this bill is allowing for the vending. The community groups that requested the previous no-vending ordinance are in accord with allowing the vending to take place in this 12 3/21/01 STREETS, SERVICES - BILL 010067, 68 particular location, and they've expressed their support about this bill, and I've talked to the vendor as well.
Just a matter of curiosity. Is this vending for the property owners, or would it allow for outside vendors to be there?
This is a street-related vendor; it is not related to the businesses adjacent. This is an industrial park area up on Wissahickon Avenue.

But, again, a large no-vending bill was done at a previous point in time. This vendor got caught in a situation, and we subsequently learned that a mistake had been made and so we're trying to correct that situation.

Thank you, Mr. Chairman. I would just like to correct one thing that I said earlier. This is obviously an ordinance that is allowing vending in a particular area. It is not vendor-specific.
But there was agreement in the community that vending would be allowed in a particular space having nothing to do with any particular or specific vendor for an area. Do you want me to withdraw the other?
Mr. Chairman, on two other matters, I introduced Bills 000791 and 000792. Those bills were sent over to me by the Water Department. The Law Department has subsequently determined that there are technical deficiencies in both of those bills. And for that reason, I wish to ask that those bills be withdrawn. New bills will be introduced at a 15 3/21/01 STREETS, SERVICES - BILL 000788 subsequent point in time.

Bill No. 000788, an ordinance authorizing the construction of sewers and appurtenant work in portions of Fulton Street and Clymer Street. (Witness comes forward.)
Good morning, Mr. Chairman and members of the committee. My name is Paul McCloskey and I'm with the Water Department for the City of Philadelphia. Bill No. 000788 authorizes the Water Department to construct a sewer in Fulton Street from 23rd to 24th, and in Clymer Street, from 23rd to Grays Ferry Avenue. The 2300 block of St. Alban Street is a private-garden courtway. Parallel and on either side to St. Alban Street is Clymer Street and Fulton Street, which are both legally open streets on the City Plan. The sewers servicing St. Alban Street are private sewers. 16 3/21/01 STREETS, SERVICES - BILL 000788 They are located in Clymer and in Fulton Street. These sewers are deteriorated and require replacement. In light of the fact that they have public water and have been paying water and sewer bills for 90 years, the residents have petitioned the City for a public sewer. A portion of these bills provided for debt service for capital projects such as new and reconstructed water mains and sewers, and so it's only reasonable that such revenue should be used for their own utilities. Further, the revenues received by the properties exceed construction costs and new facilities. An assessment shall be levied against the owners having frontage in order to absorb a portion of the cost of construction, and the residents shall be required to connect to the new sewer at their cost, in accordance with City code. We recommend that these bills be favorably reported out of committee.

This bill authorizes Mr. William Schluth to construct and maintain a private combination sanitary/storm water sewer main, along with five service connections in the east footway of the 6400 block of Van Dyke Street. The main and laterals are to service the needs of his property, known as 4727 through 4729 Levick Streets and also through 6461 Van Dyke Street. The Streets Department has reviewed the preliminary plans for this private utility and the right-of-way and has no objection to the passage of this bill.
