I work for PGW. And so I am working from home a few days, well, four days a week, as well as we
just need extra space for storage. So the thought process was for me to put a shed back there that
I could kind of work out of and store some things in. The shed that you want to use is a little bit
bigger than what you're supposed to. Is that right? So I think the rules are that you can

we're looking at 212 east price street here currently a vacant lot you can see this red
arrow is highlighting partially behind the van an area that was demolished let me move into some
aerial views here is a locating us with some zoning you see 212 east price street here with
the red dot running street to street fronting on Price Street with a rear frontage on Stafford
Street or RSA 3 zoning. We've got some CMX 2.5 as well as a little bit of RSA 5 across the rear
as well as more RSA 3 and RSA 5 across Stafford, sorry, across Price Street. Here's an aerial
showing the previous structure that did exist on the site when my client purchased it.
Here's a picture of the existing building that was on the site when he built it.
His intention was to rehab this existing building.
And you can see that the rest of this is also the lot.
But it was condemned by the city.
There wasn't too much he could do to restore it.
and as of such he raised it. Here are some current pictures of the site. Again here you can see
kind of the same picture as the cover. You'll notice this is Price Street if you can see where
my little hand is moving. As you move across the site from Price Street through to the rear
there's kind of a significant drop in elevation to a point where the townhome on the rear
It's almost, you know, an entire story down from the first story on Price Street.
And the existing rear includes this masonry wall.
Just a few pictures of context around the site.
I'll kind of bounce back to some of these later, but we've got a significant amount of multifamily around us.
You can see, you know, quite a few of these structures have two mailboxes or three mailboxes, as well as the structure immediately across the street, which includes 12 units as a sort of a men's home.
We posted the site. These pictures are from March 17th.
We posted all three of the posters as requested by the RCA, including the zoning posters as well as the flyer for the meeting.
Here's a copy of the deed.
Here is a revised zoning plan submitted to the hearing.
The application consists of subdividing the lot into two equal sized lots.
equal-sized lots. So to the screen left, we have Price Street. Screen right, we have Stafford
So to the left screen left, we have.
Street. There's a new lot line running directly down the middle, dividing it into two 30-foot
wide lots. This gray area on the plan denotes the occupied area of the zoning plan. Each of these
buildings is a semi-detached four-family house. And to the rear, each of these lots has four
parking spaces. And there's a shared access easement between the two of them to allow
all of the parking spaces to be accessed. A modification we made after meeting with the
RCO includes a one-story porch on the front and a segment of the building set back to match
the frontage of the adjacent building, as well as, you know, they have a porch in front of theirs.
There's a vacant lot is on the other side, so there wasn't anything to match there.
As you can see in this zoning section on Price Street here, our first story is just a few steps
above grade. But as the site drops down Stafford Street, we were able to take advantage of that
change in elevation to have a parking level with some slight retaining walls that allow for a
direct walkout from what is a cellar so that each of our proposed units can occupy one entire story
and the the basement unit is able to have a full access door and full windows at grade at the rear
as well as windows you know full windows above grade before the elevation rises too much
along the side. Now, our refusal, as previously stated, we are in a single family district and
we're proposing four family structures in each of these two lots. And then the parking that we've
proposed sits within the required side yard. So we have a, you know, it would be required to set
those parking spots back eight feet from the sidelines which would make them impractical.
We also have an amended refusal the initial there's no change to the actual refusals but
the description of the original one said that there were only two parking spaces per lot where
there's actually four and here's the original with that slight error. These are our proposed
building plans. I don't mean to interrupt. There's going to be four units on each lot? Correct.
So from floors one through three have an identical plan. We've got this shared porch at the first
story. Each of these units, and this holds true for all four of them, are two bedroom and two
bathroom units. They're a little bit over 1,000 square feet each, and each of them contains a
private deck to the rear um it's it's eight feet by 11 foot seven which gives it a fairly
you know decent private exterior area um there's a slight difference in our basement unit which
is our type b accessible unit it has an entry directly off the parking area which allows for
accessibility without any ramping. The bathrooms end up being slightly different, and the front
bedroom functions with a window well. This is our current rendering of the proposed concept.
We had a bit of revisions to this concept working with the community group. Initially,
we had had a full balcony across the entire back and we were our building was set fully up
to our front setback line without a porch and our stair had shifted back a little bit to allow for
entry from the side closer to the parking the RCO felt strongly that there should be a porch
on the front that this segment should be set back and that the stair the front entry should be the
main entry to the stair and we've we've fulfilled all of those requests to their desire they also
requested that the building take on a more traditional character and bring incorporate
some of the red brick from the neighborhood we've done that as well in our concept renderings
here's a rendering of the side of the building we've provided for trash
here's a rendering of the side of the building we've provided for trash storage and these fenced
storage in these fenced off areas along the side walkway along the front price street
start.
frontage where trash collection will be you can see the single story porch now on the front of
the building and the setback as well as the private balconies to the rear here's a rear elevation
this would essentially be standing in the parking lot looking at the building
uh we had a we've got a summary of the meeting with uh the faith um development community
sorry the faith community development corporation here this is a letter of support
They've included some proviso language, part of which in this, we had a little bit of a difficult time meeting with the group.
We weren't able to get an original meeting scheduled until March.
There were no attendees at the meeting, so we rescheduled for a meeting April 25th, which was just last week.
Again, there were no attendees.
One neighbor did join the meeting.
The other two non-applicant members of the meeting were both representatives of the RCO committee, and I do not believe either of them were actually living within the affected neighbor area.
um one proviso they included was a brick firewall between the two buildings we object to this
proviso as we we do not feel um that the the reverend chester who made that recommendation
um has the necessary expertise for a building code situation like this we believe
The building code provides for adequate protection between the buildings, and it was not something that was agreed by our party during that meeting.
We've got copies of the zoning notices.
The second zoning notice that RCO requested, we provide it according to their proposed method of flyering, which includes these several pages as well as this document.
this is our hand flyering inventory which marks all the addresses which we're able to deliver
the flyers to as well as those which are vacant or otherwise not possible because they're you
know combined lots with a single building or parking lots or other things like that we've
got three pages of these as well as our original RCO meeting notice that went out according to the
zoning board standards. I've got the bulk certified USPS form here.
I did want to jump back to the original aerial image here just to point out some of the other
variances that have been granted in the community. The most on point is 222 East Price Street,
which received a variance for four units in a very similar block to the one or the very similar building, the one we're creating existing, but, you know, same block, same depth.
And that was in 2020. We've got the variance for the 12 units across the street.
We've got some commercial variance. We've got, I think, over here on Utah, we've got nine units.
and over here on written house we've got some six unit variances so we're essentially we're asking
something um in line with what's already been granted in this neighborhood this is a blighted
neighborhood um and we do not believe that the current lot uh supports a large footprint
single family housing we're also there's a financial justification due to the fact that
the existing building had to be demolished at the owner's expense we've got an application for appeal
we've got our product information form included in the packet and then we've also we were unable
able to obtain a tax certification due to some unrelated issues with businesses that are no
longer existing, which have overdue tax filings for years in which they weren't in existence.
you know, overdue tax filings for years in which they weren't in existence,
but we are able to show that the property, the real estate tax has a balance of zero.
But we are able to.
At this time, I'd like to ask Mr. Causey to join the meeting.
So first, let me ask you a question. What's the property next door? How many units are the
property next door? The property next door is a duplex. That's a duplex? Yes. Okay. The property
on the other side is a vacant lot owned by the city. Okay. Thank you. Bring your client on,
please. And one other question. How did you get to eight units? I mean, how did you get to eight?
Explain that to me. Sure. So initially we looked at a by-right subdivision
to see what we could do with single family on the site.
And we were thinking if we could divide it down the middle
and then again, you know, that we had two lots facing Price Street,
two lots facing Stafford Street.
If we could do four units by right, you know, single family homes,
maybe that would work.
But the lot's not big enough to subdivide by right into four.
The most we could subdivide by right was into two.
And once we got looking at multifamily, considering, you know, the demolition, the change from front to back, the desire to put parking for the community, the amount of retaining, you know, the new sort of excavation requirements, it pretty quickly, you know, realized that if we could do one unit per floor, we could, you know, this building would be feasible.

So that is not a question we directly addressed.
Now, there are some new landscaping requirements that have come into effect more recently.
We have a 20 foot rear yard setback and I, you know, we did look at other ways to arrange parking. This gave us a one to one parking. If we remove this eight foot stretch from the parking lot.
um there's a potential that we could fit two or three parking spots um directly behind the
building although I don't know how easy it would be to maneuver in and out of them
as a direct pull-in um you know this was one thing that the RCO did not seem concerned about
i believe they were happy to have the parking and i this will it's essentially a retaining wall
along this side separating it from the adjacent building um and there will be
a slight retaining wall on the other side so we did we entertained a few parking scenarios
this was the one that gave us one-to-one parking and it's a working thing or maybe not for general
with what I believe to be the least amount of disturbance or the least amount of variance.
But with two cars, you could fit that in the rear, though?
Potentially.
Now, we would still have some issues.
So they'll want it would be an eight, you know, be an 18 foot parking spot.
you know it would be an 18 foot parking spot and then we would need to have a I believe that's now
And then we would need to have a.
at a 16 foot aisle so I do think that that aisle would go into the landscaped area I'm not sure
that we could even with two spots that we could get by without a refusal thank you any other

I'm going to share with the Board the documentation previously submitted.
We have submitted the refusal support letter from the UN ACA RCO, photos, plans, tax, and related documentation.
This is an application at the corner of 16th and Master Street.
This is an RM1 zone district.
And what we're asking is to essentially demolish an existing structure to erect a new structure to be used as a six-family dwelling along with two surface parking spaces.
to be used as a six family dwelling along with two surface parking spaces in the back. Now these are
because of the corner property the parking spaces are actually accessed from the side of the
property and not the rear as required. As you can see the parking refusals mostly are triggered due
to the district and the location of the parking port. In addition we're asking for a use refusal
variance for the number of units. We met with the RCO and received their support in this matter.
The RCO of this area realized that, of course, this property, like many in the area,
are surrounded by student housing. In fact, we are also surrounded on both 16th and Master Street
by generally student housing. Across the street on the corner, that's a large 48-unit plus
community center. That is also across the street from this property. Because of that, the larger
units, which would happen if we were to try to go for three units, was something the community
actually had more concerns with than what we are actually proposing. We're proposing to build a new
structure and split the units, in essence, front and back, but they're individually much smaller
units. Each unit would be essentially a one-bedroom unit accessed through a central stairwell.
There is trash management in the rear yard. There's actually trash storage areas that is
built into the plans. Again, it's all accessible from the side of the building, and we're providing
two off-street parking spaces as a way to also help with the parking issue that would normally
come with the additional units. As a result, the community is generally in support of this use.
They actually have no issue with the idea of the units because of the bedroom setups. I'm going to
move to the, I'm sorry, I have to scroll down, but I'm going to move to the actual
plan of the units. I think it's easier to go this way. So as you can see, these are one-bedroom
units that we're proposing, and they're basically smaller units. This avoids one of the biggest
concerns of the community, which is having people come in, occupy a unit, and then hold parties.
Initially, the RCO also had concerns with the roof deck. However, we worked out a CBA with the community, and they understood that the roof deck is a small deck that only applies to the upper floor one bedroom unit.
therefore it's not a openly accessible roof deck that all units can go up to and it alleviates
again the concern of the partying that is one of the biggest issues in the area so with the
trash management the additional parking spaces as well as the minimized decks the community
gave us their support in this particular application because we are also across the
street from a very dense development. And we're surrounded also by student housing. A six unit,
smaller unit design in this area, I believe would be a fitting use and would not negatively impact
the area. The smaller units individually also would generate less concerns with safety,
noise, and general cleanliness and trash. We are working also in addition, as part of the CBA,
we're going to be working on trash cleanup with the community on a regular basis as an owner to
make sure and the owner herself actually grew up in the community so she is familiar with the area
and this is through a lot of discussion with her architect and also her understanding of how
the community would prefer having the smaller units and this is why this particular application
was brought forth in this manner and that is essentially why we're asking the board's favorable
review of these particular variances to point out the two parking spaces in the back are mostly
refused due to the access and the width of the lot being 17 foot rather than 18 foot which is
the normally required depth for a parking space so the two spaces in the back essentially are a
little bit smaller one foot shorter than what is normally required and the handicap accessibility
which was raised as an item is also an issue because if we do try to make it handicap accessible
we would have to make it only one parking space rather than two and getting the two cars off the
street is actually more preferred by the community than having the handicap accessible parking
more preferred by the community than having the handicap accessible parking space, one single space of that nature.
So I'm happy to answer any questions from the board and certainly I can redirect to any part of the presentation if the board would like to see it again.

to being listed for sale, the property was outfitted for six. However, we are no longer
looking for six units. We're looking for five. We're going to consolidate two of the units
so there will be five units instead of six. It's an existing property, as I said.
Now let me get to some of the interior so you can see at least the current condition.
and it's nothing but mechanicals. I have photo evidence of multiple utilities,
both electric and gas. We have two units on the first floor.
We have two units above on the second
and two units on the third. The third floor front is a bi-level unit. Again,

As you can see, there's the multiple electric meters, there's a fire system, there's proof
of posting. We also, as I said, we met with the registered community organization and
we mailed in notification 107 individual households, the notice of not only the RCO meeting,
but today's hearing. According, by the way, I want to take note of page 87 of the Philadelphia
2035 plan from the Planning Commission. Note for the record that according to the plan,
this block is earmarked for medium residential density,
which is 100% consistent with the five-family dwelling in this property.

that our daughters will always be able to live in the community. They're 39 years old and
their whole life we have fought for accessibility, for integration in the community. And I wanted
to make sure that when we're no longer there to advocate for them, that my youngest daughter,
Gabriella and her family will be able to look after the children, oversee and help them and
be supportive. So we sold a house that we had upstate that we'd worked for many years to make
accessible and it was an old fixer-upper and we sold it and with that money we started looking
for a property in philadelphia when we saw the property uh at 706 north 5th street
the first thing that jumped out to me was the fact that the side entrance was totally accessible
for wheelchairs uh uh and and we looked when we looked at the entire ground floor and the property
per se it was the ideal situation for us moving forward the the accessible part we can make in
the back of the building and uh so our daughters can have easy access and in the long term that
they the rental of another other units could give them some financial stability for the long term
when we know longer here
and going forward.

Well, as my mom, Mary, alluded to a few minutes ago, making it a five-family dwelling will allow us to access the whole first floor of the building.
And there's a side entrance that leads to an alleyway that I can access very easily with my motorized wheelchair.
And then there's a side entrance to the first floor that only has three steps.
And as most people know, ADA, and when I say ADA, I'm talking about the federal law, the Americans with Disabilities Act, to make buildings accessible, it is very costly.
But because there are only three steps that lead into the first floor of the apartment, that is an easily made accessible accommodation because of the cost.
So being able to access that full first floor, once we're able to use the funds to make that side entrance accessible, will allow me and my twin sister to live independently with our family members and caregivers in the community with the support that we require.

the 27 pieces of exhibits that I now move into evidence, because our proposal is consistent with

Okay. So, good morning, Chairman and members of the Board. Thank you again for hearing
our presentation. This is a request for a special exception for an animal services use
on the second floor of this building, as well as a variance for limited animal boarding
on the second floor. For the record, I will note that a special exception has been granted in the
past for the first floor and the basement for animal services use. So with respect to the
special exception, we are asking for an extension of that same special exception to the second floor
subject to different provisos. With respect to the variants, we are, and I'll go into further
detail on this, we are asking for limited animal wording, which is necessary for the treatment of
the particular species that are going to be seen at this location. So you'll see here, this is the
current location of the veterinary center. My client is a sister clinic to the existing
art museum veterinary center. And the expectation is that the two clinics would work together.
And the expectation is that the two clinics would work together to treat a wide variety of animals that are legally kept as pets in the state, in the Commonwealth of Pennsylvania.
The expectation is that the entrance would remain the same and clients for the second floor would proceed to the upstairs.
I will show a rendering of what the clinic is expected to look like. So from that first floor entrance, folks will, you know, come in through this elevator and proceed to this waiting area.
There will be a special reception just for the clinics of this particular practice.
As far as the layout for the location, and especially with respect to the variance request,
so this clinic is going to focus on the needs of certain types of animals.
The focus is on small mammals, such as gerbils, rabbits, hamsters, on avian species, such as birds, aquatics, reptiles, and amphibians.
These particular species require specialized medical attention, and you'll hear from my client, who is going to be the lead veterinarian at this location, what those special needs are.
One such special need is that because of the unique, you know, bodies and health needs of these particular animals, overnight medical observation is critical to ensure that the treatment provided to these animals is actually to their benefit.
So as you'll see here on the site plan, we are contemplating the creation of a well room, which is where animals of these particular species will be kept overnight for medical observation.
Uh, so to be clear, our request for a variance for boarding is not for, um, any kind of a
pet kennel or, um, or pet hotel.
Uh, it is for extremely limited, uh, medical observation overnight.
Um, for contrast, the first floor, which is, and has been approved for, uh, animal use
and has been a well-loved staple in the community, um, when they treat certain, um, you know,
certain animals, cats and dogs, I think are their primary clientele, those animals must go home
after particular treatment is rendered. And cats and dogs are far more resilient than these
particular types of species that will be seen on the second floor. So that, you know, the risk of
anything going wrong is considerably lower for those types of animals. Here, if a bird, for
for example, receives treatment. Because of the unique makeup and needs of, you know, birds,
for example, medical observation overnight is extremely important to ensure that the bird is
on its way to recovery and that there are no ill, you know, side effects as a result of that,
as a result of a given treatment. So, all overnight stays will be limited to this well
room. As you can see, there are a very limited number of, you know, of spaces for those
particular animals. So, again, the expectation is to limit it just to these specific species
and patients of the clinic. Additionally, being mindful of the fact that to the rear of this
address is a residential area, this well room will be fitted with soundproofing materials and
other noise attenuating materials to ensure that there is no noise that disrupts the other neighbors
in the local vicinity. I will also note that given these particular species,
noise to them is actually quite harmful. So the expectation is that in this well room,
the staff will take necessary steps to ensure that all patients staying there are soothed and quiet
and are relaxed. Again, therefore, further limiting the amount of possible noise that
could disrupt other folks in the neighborhood. I do at this point want to call my client.
I do, at this point, want to call my client, Susan Tyson, who is the lead veterinarian for the premises, as I think she would be able to give some better and more scientific explanations as to the need for this particular variant.

uh susan could you speak more to the particular needs of the species that will need to be
kept overnight for medical observation yes so um i don't know if i'm able to turn my camera on
i don't know if i have the option um so um so my name is susan tyson i'm an exotics veterinarian
I primarily focus on, my goal is primarily focused only on exotic species. So this includes
birds and reptiles. 72% of my clientele right now are rabbits. I do specialize and have a lot
of very complicated cases that are referred to me from local veterinarians. So many of these cases
are, are very sick and debilitated. Um, I have patients and clients with, um, birds that might
be, you know, 60, 70 years old. Um, these patients are very, um, arthritic. They need six to eight
medications, um, given to them by mouth twice a day. So having specialized staff to care for them
and specialized caging to care for these patients is super important. I, I also, I also have a lot
of referrals, like I said, from, from local veterinarians for these cases who may not have
the tools or the equipment to perform specialized surgeries. Many of my avian patients and my rabbit
patients go through, I will perform very complicated surgeries on them. And then following that they
need a quiet space to recover in. Um, and many times transferring them to the client or even to
an emergency center to be monitored, um, can disrupt their recovery and actually, um, we can
lose the patient. So, um, our goal is to, um, maintain these, these patients overnight in a
warm dark environment um where there's minimal handling they can have um any heat support or
other support that they might need um dr tyson oh sorry we dr tyson we do understand exactly
everything you're saying and council council expressed that very well is there any questions

today we have in front of you 712 north american street i've presented 10 exhibits consisting of
41 pages commissioners i'm not going to go through every exhibit just the pertinent ones
here we have the refusal we applied to
Here we have the refusal. We applied to license and inspections to develop this vacant structure into a three-family dwelling.
This structure is a RSA 5. RSA 5 provides for a single family. As a little background, though, I would like to tell you that at least since 1968, this property has never been used as a single family.
It was a commercial business, F. Lotiero and Sons, and they were a chimney and masonry repair business that operated out of 712 North American Street for at least 30, 40 years.
I provided you with the property information sheet, the deed showing that the client is the owner of the building.
I also wanted to provide you with a little history of the property, and I'm just trying to get down to the L&I exhibit.
I just really wanted to show you here. This was an office and a business place for chimney builders since 1968.
By the L&I records, it looks like this business closed somewhere around 2013 or 2014, and this property has been vacant since then.
the property has changed hands on at least three different occasions since then
but it was never developed into any use here is a copy of our plans
let me just go down a little bit for you here it is 712 north american street you can see
this is where the property sits on the block it's a very diverse area there are all kind of uses
here. You can see on the corner is a large loft apartment building with one, two, and three-bedroom
apartments. Right next door is a vacant property, which is a garage of sorts, but it's not being
in use currently. Across the street, you can't really see it, but there's actually a drive-in
a parking structure which is used for a house on the block. Here is just a map that shows you
where North American the property is. It sits between San Mart and Brown Street. Again this
is the property. It has a unique window here. There's an entrance here and there's a little
covered alleyway here which you can kind of walk all the way to the back of the property
right there.

Next door to the property is actually Orthodox Church.
Here are our actual plans for the development of this property.
basically it's pretty simple commissioners we would like to have a three-family dwelling

proposing to develop. You can see it's a pretty large building suitable for the proposed development
that we're requesting today in regard we did meet with the community and this is a northern
liberties and as we all know there are parking issues in the northern liberties but it was
established that in order for us to there's no parking that we can actually make on this lot

So it just really isn't feasible.

again there are many different types of uses their garages there's some single families

There are all different types of uses.
We've got the church.
We've got what we're trying to develop into residential.
We have commercial here, and we have a commercial type of artist there for storage of cars and whatnot.
Directly across the street is a single-family home.
I wanted to give you a picture of. So there are some single families, not many, but it is a mixed
use community here. That's just a picture through the gate of the back of the property.

It is a highly commercial walkable area. Some of these properties have commercial on the bottom
and multi-units on the top in this neighborhood.

which has many, many apartments,
one, two, and three bedroom apartments there.
and commissioners we did notice a meeting with the northern liberties neighborhood association
we did meet with that association on march excuse me april the 3rd it was a very well
attended meeting we had a good discussion and frankly there were really no opposition
to our project. We did send out 133 pieces of mail. There is our proof of mailing. And we did
get a letter of support from the Northern Liberties Neighborhood Association. We did
indicate to them, my client in the organization, in a gentleman's agreement, that they will try
to restore some of the existing facade of the building to maintain some of its characteristics.
Commissioner, and that's my presentation today, and I'm more than willing to answer any questions
that anyone may have. Counsel, there was a reference in the plans of demolition of a
one story section of the building. Is that true? Well, yes. And I'll just go back to the plan very
quickly. I'm just going to go back to the site. Here is was kind of like a makeshift covered
shed that we're going to tear down to give us the backyard on use. The first floor apartment
will have a use. They do have a door here, it's not shown on the plan, where they can come out
into this backyard. But this was just like a covered area in the back that we are going to
uh demolish hillary yeah miss this is hillary this is a change in youth application there's no
no construction or demolition as part of it um so i believe you will need a separate permit
application for the demolition um because they will need to review plans and plans are not

This property is 708 North 43rd Street.
This is my table of contents, along with my presentation package.
And I'll go through all the exhibits, AA through A-10, including the historical zoning records indicating this property has been a six-family dwelling on and off since the 1930s.
And also, I wanted to show the board the remaining zoning records of other properties on the 700 block of North 43rd, which are multifamily.
So our request today is to take this long, vacant lot and restore it to its historical use, which is multifamily.
The refusal, we have four refusals, two for use and two dimensional. Basically, this is an RSA3
zoning district and the refusals indicate that multifamily is not permitted.
And the refusals indicate that multifamily is not permitted. And also there's open space and rear yard refusals that I will address as we move through this presentation.
We do have a unanimous support of West Belmont Civic Association. We met with them on one occasion and they liked our project and they made a recommendation, as you can see in the second letter, their attachment letter, suggesting that we have a trash plan that does not include putting the rubbish in front of the building.
So even with that proviso, they were in favor of our plan.
But nevertheless, my client still revised the plan.
And I want to show you how we address the trash situation at this property.
So this is on the 700 block of North 43rd Street.
And as you can see, the west side of the street is mainly vacant lots.
I was there last week to confirm that.
While this is a dated photograph, it still is an adequate reflection of what's going on in the Manitua section here.
On the other side of the street, there's some single family and some multifamily.
And at the end of the presentation, I'll show you those addresses and go property by property where there are other multifamily, including eight units, six units, four units, and several duplexes.
This is a data photograph showing you what the lot used to look like. Our client acquired the lot, has cleaned it up, and here's proof of our zoning notices that were posted in a timely fashion.
Our plans, if approved today, we do have a proviso, and proviso is because we basically included a covered side yard for the trashy areas that the community group requested.
This is the front elevation. It's a three-story property. We're not looking for a roof deck or any situation like that. We do have window wells in the front and the back of the property for access for the bedrooms.
uh the floor plan and here's the change we made mr chairman if we go over to uh the first floor
plan we have a breezeway leading from the front of the house to the rear yard for access to the
rear yard but more importantly we have carved out of the first floor a trashing utility area
the community group is very concerned about any trash being on the front of the property trash
bins trash enclosures also they were concerned that they didn't want any utility meters on the
front of the property so we went back to the drawing board and carved out a part of the first
floor for trash for the units in the front and we did the same thing for trash and utilities
in the rear of the property we're basically asking for six units again this was an historical use of
the property back in the day and i'll show you those plans as i work through it
This was our old plan. I just wanted to show the board that, in fact, we did make changes
to accommodate what the requests were from the neighborhood group. We now have a breezeway,
as I said before, leading from the front of the house to the back of the house. The front elevation
is all brick in keeping with the typical style in the neighborhood. No metal or wood or vinyl
on the front. This is our tax certificate. The other documents are your pro forma documents that
you would see in a presentation like this. Our lot is a rather large lot for the block.
Here's a deed indicating ownership. And I understand, Mr. Chairman, there are a number of
neighbors and residents on the call who do want to pipe in and chime in on their feeling as to
this development. So here's the zoning records, and I'll blow these up for you, of
surrounding properties in the neighborhood that are multifamily. All of these on the 700 block
of North 43rd, except for one on Aspen Street, which is just right around the corner, and I'll
show that to you. And then on the right-hand side, I put the years when these properties were
permitted. And I have copies of the fronts of each elevation of each of the properties,
as well as the zoning permits. So what I'm trying to show the board and what the community group
recognizes, there's a lot of vacant lots on the block. There hasn't been that much development.
And any of the development that has taken place has been multifamily. In fact, this property at
749 North 43rd is under construction now, and that's six dwelling units. And again, I don't
want to speak for the community group but you know sometimes when you have a situation where
You know, sometimes when you have a situation where there's not a lot of development, you want to try to get more folks and more development spurred on that particular block.

And when other developments come before the community group down the road after the multifamily are constructed, they may be in a position to say, you know what, we don't want any more multifamily.
We have a lot of people on the block as a result of what they've done in the past, and so there's a stopgap that could be used in future applications before the board.
But for the board today, we're asking for six dwelling units, and we're going to continue to press forward and show you the reasons why we think that really makes a lot of sense.
So this is a refusal from 1939, indicating that this is a six-family dwelling, and it was granted.
And here's the zoning permit indicating that it is a six-family, two apartments on each floor, and it was a one-family vacant dwelling back in the day.
And from the historical records, I've been able to determine that this property was demolished sometime between 96 and 2004.
I can't pinpoint that because there's no demolition permit in the file.
This is from 1951. Again, six apartments, six units.
And this is the Certificate of Legality of Use from 1961, again, indicating six family units right here.
Again, some redundancy, but just to show the board the historical use.
And now here is what's going on currently.
On the 700 block on North 43rd Street, this is an existing three-story property, brick front, with eight dwelling units.
This is a photograph of the front elevation and attached to zoning permit, indicating this property was permitted in 2018 for eight families.
Next is a property adjacent to the property I just showed you at 749. This was approved for a six-family dwelling unit in 2022. So it's just under construction right now. Those photographs, Mr. Chairman, were taken by me just last week.
next is on aspen street which is from the aerial photograph i'll show you it's just
right around the corner this is a four dwelling unit which was approved in 2019
and here's the zoning permit that's attached to it
and on the set again this is all in the 700 block on north 43rd
these this is a property with four dwelling units you can see that there's four mailboxes
on the side wall there on the front elevation. And then here's a rental license, including
the reference to four units, and it is an active license.
Then again, on the 700 block of North 43rd, it's 729 and 727. These are multi-family again,
three dwellings in 727, three dwellings in 729. And here's the use permit indicating
that this was permitted in 2012.
So there is multifamily on the block
that is from the early 2010 area up until today.
And then here's one at 753 North 43rd Street,
again on the 700 block, multifamily, three dwelling units.
And this permit was issued in 2011.
So, again, just to give you the context, we have eight family, six family, four family, three family, three family, many vacant lots on the west side of the block, although there is a garden right here, as well as on the east side of the block.
And this is the one on Aspen Street right around the corner.
So I just want to bring this to conclusion and just make a couple of comments, Mr. Chairman.
And as I said, there are members of the community who want to weigh in.
So we basically have a block that is really kind of starving for development.
I think the community group recognizes that, and that was recognized in their overwhelming vote, even before we made changes to the front of the property.
We do have an enclosed side alley, which will deal with the issue of side yard requirements here.
It is enclosed, but it still provides a breezeway to get to the rear and to provide for fire access and also for means of ingress and egress.
We also are in a position where we're offering a number of two-bedroom units, which, again, I believe the community wanted because, again, it's going to bring people on the block, feet on the feet, walking the streets, more neighbors.

We also are going to have lighting on the outside as well as security cameras.
I will have my client adopt my testimony, Mr. Chairman,
but just wanted to give some legal basis for why the board should hopefully favorably look upon this application.
historically this has been a multifamily property six units for over 30 years recently
in the 90s it was four units so it's always been multifamily we're not altering the essential
character of the neighborhood there's more vacant lots on this block than residences
and a proportion of the residences are already multifamily so we're not out of character we're
We're not altering anyone's or any property owner's light and air requirements.
We're not impacting any development on the block.
We're in harmony with the code and certainly in harmony with what the community desires by their overwhelming vote.

According to Council, the zoning archives had two units each floor.
and you have three floors so I assume the basement was utilities only so I recommend that the
basement has no bedroom space. Yeah Mr. Holliman on the plans I can go back and say you have egress wells
at both the front and the rear which is required by code for anyone in the basement to certainly
exit the property. And also the access to the property is in the middle of the building. I
guess I can go back to plans, which also provides for a means of egress out of the property. And
when someone would come up from the basement, if there's ever an issue, you're able not only to
exit toward the front of the building, but also to the back of the building. Let me get that up.
Here's that floor plan right here, Mr. Holloman, where if anyone was in the basement and needed to
get out they have access through the window wells and also through the middle of the property rather
than running to the front of the property they're able to exit in the middle of the property and get
out to the rear yard or the front yard but i appreciate your comment i appreciate your

A lot of the buildings in the area haven't been really taking as much consideration into that.
And I think for this property in particular, to have a set up plan and to be implementing it, you know, from jump is a wonderful thing.

Thank you. Just as a parenthetical, Mr. Chair, I did in fact just receive and forwarded to
attorney Emerson and the RCO ZBA email account, a revision on the interior layout.
I also have it available here to pull up after my exhibit packet. In the event that this is
approved, I do believe that that would be one page revised plan. This is for an addition on
an existing property right now. It's a large one-story property that was automobile use in
the past for parking and for parts and for shopping, but it's vacant. And what we'd like
to do is do a sit-down restaurant on the first floor and then put a two-story addition on top
so that we can have three units on the second floor and three family dwelling on the third
floor for a total of six units altogether. The property is zoned CMX two. And because
of the square footage requirements, we do need a variance for two for the additional
two units, six, whereas four is allowed as a matter of right. The way we're able to actually
get six is because of the second variance that is sought. There's 100% lot coverage already
with the old warehouse. So that's how we're able to get ample size units that go beyond the four.
It's because, you know, whereas, you know, we propose 100% lot coverage versus the required
the required 80% lot coverage.
80% lot coverage, and that's only because we're legalizing the pre-existing.
And that's only because we're legalizing
the preexisting use and the rear yard
shall be larger than what we propose.
And again, it is 100% lot coverage.
So I'll show you some plans that we have.
This is the property in question.
As you can see, it's a pretty large property
right on the corner.
we have the first floor would be the restaurant. The second floor would be the three units.
The third floor would be the three units. The revised plans have a trash room right here in
the hallway that will house trash receptacles for all three units on the second floor and
identical trash room right here with again enough space for three additional trash receptacles for

which this already is was a pre-existing uh conform uh you know within the code we would
get those six units as a matter of right? So they all understood that. And we also gave
the neighbors some other businesses that they could look into that are also owned and operated
by my client and his family. Again, they've been in the food business for decades.

The Barber's Hall is the last remaining establishment around that way of African-American ownership.
this particular first of all this was not posted until may 1st 2023 mr adams is outside of that
property every day at his business establishment he said it appeared on may 1st 2023 second of all
list the owner of the robert hassan mr hassan has sold the property to some temple something llc
temple apartments llc or whatever that's the proper owner so i don't know why mr hassan is
still on the application third of all the use is a the property is a light industrial facility it
was a auto parts and auto mechanic shop for many many years it's been vacant for over 10 years
it still has um underground gas tanks in that facility so there's some industrial issues and
some some environmental issues that are not being addressed uh they've never been addressed
Mr. Anastasio kind of presents it as, oh, it's just another thing, but it's not.
That is in the middle of Temple University, and that is on the corner of a very busy intersection.
It doesn't seem to be enough tension in application to all of the needs that will be required to operate a business at that property.

10 foot wide door as if that's going to sustain a restaurant and a bunch of
properties on the second and third floor so the layout to me is just not in order but most
importantly it was not properly advertised mr adams has no notice of any meetings or anything
and he's right next door to the facility and he's been there there's no communication with him in
writing or orally at all so there's there's no way in my estimation that you can proceed
with this application it hasn't been properly posted hasn't been properly noticed and it will
be objected to legally so i mean if it proceeds it's going to be litigation so i think that they
need to consider that okay thank you char for calling it mr bergman i just want to uh i took
notes and i uh appreciate the feedback i want to make sure that we're all on the same page because
it may sound like uh we're not uh the property was posted a second time uh at the end of april
it was posted 22 days prior to today's hearing and then of course it came down and then it was

Back in 1955, right here, October 11th, the zoning board granted, and it was physically turned into, this is a corner property,
a commercial space and a one-family dwelling. About 20 years after this legal use,
the commercial space was turned into a second family dwelling. So this property has never been
since 1955 a single-family home, as the underlying zoning classification now shows.
It's never been that. So it's always been two units. It was for 15 or 20 years, again, a plumbing and heating HVAC shop with a one-family dwelling, one on one side, Porter, the one on the other entrance, Mildred.
And then at some point, 20 years later, the Porter Street side was turned into a residential unit.
So fast forward today, Mary Liberati is now in her approaching 80 years old.
She would like to legalize this pursuant to to having it sell it so that she can live the final hour, you know, final years of her life being independent and self-sufficient, which was the plan all along when her husband purchased the property.
So this is the layout of the property here.
You come in here and then there's this is Porter Street.
and you have a living room, a kitchen, and two bedrooms.

so that she doesn't outlive her money, which unfortunately has happened to a lot of folks,
they would have to deny it. And as this board knows, that's really not
a basis for any kind of proper urban planning. But such as it is, here are the photos.

In addition to the owners of the property, Ana Lam and Alec Ma, who should be on the virtual Zoom
today we also have our architect alex dollar with fusa designs here if there's any specific
questions related to the design itself mr chairman members of the board the incomplete history of
this property is ultimately what brings us before the board today to reapprove the long-standing use
of this property as three dwelling units i will walk you through the background and then i can
quite efficiently sum up the clear hardship as it relates to the use of this property.
As you note, we did receive a letter of support from the Hawthorne Empowerment Coalition,
which is in our exhibit packet at tab 15, and we did also include petitions of support
and letters of support from near neighbors on this block. Alec and Anna purchased this property in
December of 2022 and immediately hired an architect to start working on plans for the
renovation of the aging structure. Alex's elderly parents live in the Hawthorne community and are in
need of a new place to live. It was his intent in purchasing this property to have his parents move

Now, in working with the architect and myself, we quickly realized the permitting discrepancy that requires remediation.
This request relates to 1130 Carpenter Street in the city's Hawthorne neighborhood.
As you can see on the zoning map up on your screen at Exhibit 7, the property sits on Carpenter Street between South 11th Street and South 12th Street.
The property is zoned RSA 5.
I'll bring up some photos at Exhibit 16.
I have some more zoomed in photographs as well.
You can see this is an existing three-story brick structure.
And as I will explain, this property currently contains three, arguably four, separate living
spaces. Briefly, if you refer to some of the interior photos that I've included in your packet,
let me zoom in a little bit on this, you will note an unfinished cellar, which will remain
in relatively unfinished condition, and three clear apartments. Unit one is highlighted in red,
first floor, kitchen. Unit two is highlighted in blue, and unit three is highlighted in green.
Oddly, there is also a separate space identified as unit four. Floor plans reflecting the existing
condition is shown up on the screen now at tab five, and this is where you can see this really
strange, what is separately identified as unit four, although we can't imagine how it was ever
used this way. The permit history for the property is shown at tab nine. And what you will note is
that the property, since at least 1987, has contained three apartments, which was granted
by variance. As I learned when I applied for an updated use permit to confirm the longstanding
in use as three family. The examiner responded to me, and you'll see her response here up on the
screen, noting that a permit was apparently never picked up back in the 80s when the variance was
granted. Now, given that the structure was ultimately converted to three apartments,
I suspect there probably was a permit at some point that has just evaded identification or
has been misfiled. Alec and Anna are proposing a comprehensive renovation of the property to
update and modernize the three units. Proposed floor plans are now shown on the screen at tab
six. The seller will be used for washer dryer space for units two and three, as well as storage.
Unit one, which is the unit that's being designed for Alec's parents, will be a one-bedroom unit of
600 square feet. Unit two and three are two-bedroom units of between 610 and 650 square feet. Each of
the unit will have a ventilated trash room, and community trash will be stored in the rear yard
for pickup. Now, of course, regarding the refusal, because the property is zoned RSA 5,
the application was refused for the multifamily use. However, as the board has seen from the
evidence we presented today, the three dwelling units have existed since at least the 1980s
and would be considered legally non-conforming given their continuous use for the last 40 plus
years. This request is simply seeking to modernize and renovate the long-standing units for the same
three total units. The hardship here is quite simple. It would be a considerable hardship to
return this structure to a single-family use, given its long-standing multifamily history.
Furthermore, the zoning code would not require such a conversion for a long-standing non-conforming
use. If the board is interested, I do have several cases referenced to confirm it would be unreasonable
and by no means the least minimum variance to ask a property owner to convert a structure back to
single-family use after a long history of multifamily use. It also goes without saying
that this is not a self-imposed hardship, as my client just recently purchased this property
and is undertaking this process to ensure the property has all of the up-to-date permits in
place. The proposal is further consistent with the area, which includes a mix of single-family
and multi-family uses. You will see permits for other multi-family uses on just this block at
Exhibit 11, and I did include a summary map, which you'll see up on the screen, showing two, three,
and even five unit dwellings on this same block. Accordingly, we submit this proposal
five unit dwellings on this same block accordingly we submit this proposal will not increase
congestion harm neighboring properties or impair light and air a full analysis is provided in the
memo of law i've submitted to the board at exhibit 12. with respect to the community hawthorne
empowerment coalition's letter of support is in the packet in addition to signatures and letters
of support from your neighbors.

So I'm here to present 1637 Nardine Street.
This is in the Graduate Hospital section of Philadelphia.
It's a pretty straightforward case.
I know that there is opposition from the Center City Residence Association.
I would say this, that I believe it's their policy to deny this type of use of a short-term
accommodation such as a merit of A&B. I don't think it really has much to do with the merits
of the case, and we'll review that throughout my presentation. So first, we'll review the
So first, we'll review the table of contents. It's the notice of refusal, correspondence from the Center City Residence Association, a petition that we circulated to nearby neighbors, and a letter of support from nearby neighbors.
Table of Contents is the Notice of Refusal, Correspondence,
uh nearby airbnb listings so it's not uncommon to have airbnb listings um um available uh nearby
and i actually said graduate hospital i mistakenly said stated that that's it's more of center city
we are we're north of uh south street um then a little bit about this listing in particular
in this property i have in the airbnb listing about this place so we'll learn a little bit about
it um and about the amenities which is the next exhibit also we'll review uh the reviews my client
has received um they have received 4.97 uh stars for you know their accommodations maps of the
area photographs of the property our interior drawings um are just basic floor plans uh proof
of our meeting with the group by way of a rco meeting notice and mail in that notice our
application for appeal, our deed to the property, showing that Jeffrey and Faith Whelan are the
owners of the property and our certificate of tax credits. At the conclusion of my presentation,
I'll ask Mr. Whelan to virtually raise his hand, be sworn in, and to adopt my testimony as his own.
So this is a notice of refusal. This is an RSA 5 property, and we're being denied merely because
we're trying to do short-term accommodations, essentially accommodations less than 30 days.
And as the board knows, the rules have changed recently with regards to these short accommodations,
where previously this use was allowed as a right. And a few years ago, City Council passed an
ordinance requiring special governmental approval for these use. I would argue that the use that
we're seeking uh is a non-conforming use my clients purchased this property before the change
in the ordinance and just a little bit of background and why these are special circumstances
my clients currently live out of town they have a family their their parents live in uh in
philadelphia they would like and they're elderly and they'd like to visit the parents you know with
their family on a consistent basis. So they purchased this property in February of 2020
for a significant amount, $530,000, expecting to be able to use this property for their own purposes
six to eight weeks out of the year. In order to make this work and be viable, they also plan to
have short-term accommodations for this property. So it's not like an investment property where,
okay, they can rent this out long-term if this doesn't happen. It would defeat the purpose of
why they purchased this property for $530,000. And you'll see how well maintained they keep
this property through the pictures and that significant expense. But instead of having
hotel accommodations themselves, six to eight weeks out of the year, which would be cost
prohibitive to them they thought that this would be a sound uh path forward and again unfortunately
the law changed after they purchased the property it's not like they purchased the property hoping
to do visitor accommodation and seeking special governmental approval through this board
the law at the time of purchase allowed them to have this use thus this is a non-conforming
property and we're asking the board to merely legalize that non-conforming use
So we do have correspondence from the Center City Residents Association.
Of particular note, the Center City Residents Association, first of all, gave us a fair forum, listed to our presentation, but they don't take votes of the community.
They have an executive board that merely hears the merits of the case, and then they decide amongst themselves as an executive board the position that the Center City Residents Association takes.
Again, unfortunately, they have made a policy decision to deny any Airbnb use of this type.
So again, they have not heard the actual merits of our case, and we would ask that the board
actually consider those merits, especially given the fact that my client spent a significant
amount of money on a piece of real estate in the city of Philadelphia prior to a change
in law, and they're not looking to create a situation where they're taking an RSA by
property and increased density. They're not taking a situation where they have a property that's RSA 5
that did not allow visitor accommodations at the time of purchase. It's a change in law. It's an
unfortunate change in the law. If this board feels so inclined, I would ask that the board grant it

Again, you'll see from the reviews, my client is a stellar landlord for short-term accommodations.
And you can see from the pictures that they take this rather seriously.
So they did circulate a petition around.
You know, again, you can see that 610 Rodman Street, which is close by, 620 Naudain, 641 Naudain, 1640 Naudain, and 1702 Rodman, all signed the petition.
And then separately, you know, again, nearby, we had 408 South 19th Street sign a letter of support.
And then 1702 Rodman Street, two individuals signed a letter of support.
So, again, it's not uncommon to have this type of use in this vicinity of the city.
because we're close to center city again we're just north of south street we're between 16
and 17 street and as you can see we're not even the only airbnb on this block so we're not out
of character what our use is not out of character to what you would expect in this part of town
and then about their place so a couple of things we were talking about how they're reviewed and
you can see this is a 4.97, 122 reviews. We took that screenshot, I believe a few months ago. So
there may be additional reviews as well. Just like they're highly rated as a landlord for
short-term accommodations, they take it very seriously because this is their living arrangement
for up to two months out of the year on average. They actually only accept occupants who are rated
as well by Airbnb. Not many people know that, but the occupants themselves can be rated by
the landlords of Airbnb facilities. And they only take people who have the high ratings just like
them. In addition, they take you very serious about the fact that they want to make sure that
they're a responsible property owner. So in their listing for Airbnb, they have quiet hours from 10
p.m. to 7 a.m. on week, weekly days and 11 a.m. to 8 a.m. on weekends. And they actually have a
fine policy of $500 if there's any violations of any noise or rules, excuse me, any rule violations
regarding noise or other rule violations. They also have, they put into their property a noise
meter where it's an app where if it reaches above a certain decimal level, they get notified. And
And then, obviously, the first time they tell their tenant, hey, you're above those parameters, which we allow, if you exceed those parameters again, you will face that fine.
And then there are amenities.
Again, this is, you know, again, a beautiful place, and you'll see it.
But it's really meant for families.
You can see one of the amenities is a crib, a pack and play, children, books, and toys, children's dinnerware, and board games.
they're not looking to have you know parties there for for their their tenants and you know
they're very careful about who they select as their tenants and then their reviews again 4.97
uh out of 122 reviews so again they're well regarded as as an as a landlord and you know
given their the petition that they circulated you know and the people that are in support of it
and clean people on that block,
we would ask the board to grant a variance
with way of a proviso of a temporary variance.
And then maps of the area.
Again, this is an RSA-5 property.
We're actually surrounded, as you can see,
by RM1 use, CMX2 use, and CMX1 use.
Again, we're not trying to increase the density of the property.
We're merely looking to use it as a single-family dwelling
just on a short-term basis
rather than the long-term basis.
And then again, this is a Google Maps perspective as well.
And then photographs of the property.
It's a beautiful property.
If you look at it, you know, right here is a two-story structure,
the proof of mail, proof of posting of our notice for today's hearing.
And then this is Nardane Street to the right of the property,
Nardane Street to the left of the property.
And then the interior photos.
I mean, they really, this is what the property looks like.
The last thing they want to do is become a nuisance to the neighborhood.
And I think that's the stigma that some Airbnbs have where it's going to be party central.
That's the last thing they want.
You know, again, this is where they stay two months out a year.
So they have nice furniture, nice fixtures, you know, nice accommodations.
you know, this is the lesson they want is to have some deplorable tenants in their property.
You know, this is the last thing they want is to have some.
And then this is just their floor plans. Again, just pretty basic, open floor area,
living room, kitchen on the first floor. There is a lower level with, it looks like a full bath
and again, another living arrangement. And then there's two bedrooms and actually three bedrooms,
I'm sorry, on the on the second floor and with one, excuse me, two bedrooms, one in the front, one in the back and then a bathroom.
And then the RCO meeting notice we met on March 20, 2023 at 7 p.m., 142 addresses were notified of that meeting.
The list of the addresses, proof of mailing to those addresses and their application appeals showing that Jeffrey Whelan and Faith Whelan are the owners of the property.
And then also our deed to the property showing that they purchased it for a significant amount, $530,000.
It would be financially devastating for them to have to, especially in this market, either sell the property.
And I don't think they could even rent it for what they paid for based on their monthly mortgage.
And then there's a second tax plan.

I want to take a moment just to correct the record with regard to the legal status of visitor accommodations in residential districts.
The 2020 zoning ordinance didn't change the basic rule prohibiting full-time use of a dwelling unit as a short-term rental.
This type of absentee management where the owner doesn't live in the unit has been illegal since the first short-term rental zoning regulations became effective in roughly 2012.
What's changed since the passage of the 2020 ordinance is that there's now a licensing and enforcement mechanism.
So this seems to come up a lot.
I just wanted to correct that for the sake of the board's knowledge.
In 2019, the zoning map was amended in this area from RM1 to RSA 5 in accord with recommendations from the comprehensive plan.
Bottom line here is that the appellant has not shown evidence of a hardship that prevents them from using the property in accord with the requirements of the zoning code, namely as a dwelling unit.
And so the City Planning Commission recommends that the board deny the variance.

And what we're looking to do here is a two family dwelling, and as you can see, or you will see from our presentation, it's not out of character, and it has the full support of the community in that respect.
So we'll review the notice of refusal, the letter of support from the Mantua Civic Association, the property history, which has a greater density than what we're asking for, maps of the area, photographs of the property, our plans and drawings, our RCO meeting notice, where you'll see proof of mailing of that notice, where we had a well-attended meeting where the community, I believe, voted unanimously in support of our project.
our application for appeal that we filed with the ZBA, our deed to the property, which we'll see,
I believe, Bluestone Real Estate LLC is the only property, and a certificate of tax clearance
showing that the property owner is in good standing with the city with respect to real

is an RSA 5 district. And what we're seeking to do is a duplex. We're not trying to overuse the
property in any way, especially given its past history of having a much greater use.
And that's shown by the fact that we have no dimensional variances as well. So a letter of
support, as you can see, we've received unanimous support from the community at a well-attended
meeting uh property history i looked at atlas according to the property history at one point
this property was a quadplex plus a doctor's office so five units all we're looking to do
i just want to confirm this is two units and then maps of the area um as you can see we're just off
the 40th street we're the first house on reno off of 40th street but there's an ample amount of
multi-family use around there and within the character of this neighborhood. Again, this is
from a Google Maps perspective. There's also ample public transportation around as well.
And then photographs of the property. This is the front of the property. It's currently a vacant lot.
Has been a vacant lot as far back as 2007. And that's as far back as I can find because that's
as far back as Google Earth goes.
So this has been a vacant lot for some time.
I suspect because of the fact of the zoning classification
makes it rather difficult to build,
but we want the opportunity to build this as a duplex
in the neighborhoods in support of that endeavor.
And then here's our orange posters showing proof
that we notified the community of today's hearing.

I would point out this.
This is a porch neighborhood. So we try to incorporate that design with our own project.
And then this is just a site plan. Again, no dimensional variances. I will point out this.
There is an alleyway, which we have access to, which we also said to the community that we're going to improve because we're going to use that alley where residents will be able to store the trash in the rear for both units.
And they would there would be trash removal from the rear through the front of the property.
And then, as you can see here from the renderings, we are recreating the look and feel of this of this neighborhood by way of a porch, brick facade, lentils and a corner slide.

And then simply, you know.
you have two units you have one in the front obviously in the first floor and the lower
level you have another unit on the second and third floors the unit in on the first and first
floor and the lower level will have access to the rear yard as their recreational space

Oh, one thing I would say, and I do object to the refusal in this sense, that there is no reference to the existing
uh that uh there is no reference to the existing off-street parking um at the property so i do
have an objection as to that um if we can uh you know agree provides on we have a record
of the history of this property it's part of our presentation but to recognize that off-street
parking if the board feels so inclined by way of a complies though um we're here to present 1052-54
or Roy Street. And the proposed use is a private club in the existing structure. And as you can
see here, there is existing parking here as well. During this matter, we'll review the notice of
referral. So this is not a variance matter. This is a CMX2 property. And we believe that a special
exception should be granted because this proposed use would have no greater impact of what would
be normally expected of what we're offering compared to what else is allowed under the codes.
We do have correspondence from the Nice Town, Tayoga, and Improvement Team. Again, I would say
this, the people that were in attendance were not nearby neighbors. And we did make significant
community outreach thereafter. We thought that this was a pretty straightforward project given
been that Mr. Moda has owned this property for almost 30 years and has been a productive member
of this community. And then you'll see that from exhibit three, which is our petition and letter
support. I mean, we even have some handwritten letters. So there are two churches nearby,
each of the elders from an elder from each church, specifically on either handwritten or typed,
like their own support they didn't just sign you know what we provide to others a form letter of
support and petition they took it upon themselves to show that they really care about the fact that
Mr. Moda should have this use and they explain why and we'll go through those letters you'll see
the zoning permit that's previous to this property which shows the off-street parking
maps of the area photographs of the property some interior photographs or plans and drawings which
just basic, you know, handwritten by Mr. Moda. Our RCO meeting notice, our deed to the property
showing Mr. Moda, if you own it to the property, and our certificate of tax credits showing that
he is in the payment plan for this property and does tax compliance. So our notice of referral.
So again, this is a CMX2 property, and we're just trying to put a private club here. So Mr. Moda
has owned this property for a significant period of time.
He used to be an automotive repair shop for some time.
And he's been actively a resident of this property
from a business purpose.
And you'll see that we're not really in a residential area.
So the use that we're proposing
is really not gonna have an impact much
on any portion of this community.
And a few years ago,
he decided to start this jeep club because of his love of cars so they're you know people who are
usually over the age of 40 years old and i would say that's the membership uh he doesn't charge for
membership but just for their love of jeeps and you know they just you know pile around at the
club and then they drive their jeeps around you know philadelphia not causing any noise or any
issues. Their hours of operation are 6 p.m. to 12 a.m. Thursday through Saturday and 10 a.m.
through 6 p.m. on Sunday. In addition to that, he also has a softball team that he also has a
membership, you know, through his friends. And those are the two activities that he wants there.
And, you know, he wants to do it legally. So that's why he hired us to do that private club.
So the correspondence from the RCO, again, it wasn't a well-attended meeting.
There were only four people that voted, three in opposition and one in support.
And in the letter, it actually says, we encourage Mr. Moda to meet with his near neighbors and constituents to formulate a strategy for outreach and community engagement and to formalize plans and public recognition documentation for his many service activities, including cleanups and whatever.
So that's what we did.
We decided that we're going to show not just the group, but the board of this.
Now, I will say this, that Mr. Moda is a limited English proficiency, so it's always difficult
for him to talk during presentation.
We try to handle that as much as possible.
And also, his members also have limited English proficiency, and that's why they didn't feel
his members also have limited English proficiency, and that's why they didn't feel comfortable
comfortable.
going to the community meeting, the virtual community meeting. So, but as you can see here,
we obtained either a petition or letters to support of all, basically, people who are nearby
who would most directly be affected by this property. And then here's our petition, which
shows those nearby neighbors. And then this is a letter from one of the elder statesmen. He is
one of the pastors, and it says to whom it may concern, my name is Charlotte Jefferson. I'm a
member of the Cosmopolitan Mission Service Baptist Church, which is located just down the street.
The Jeep Club is on the same block as my church. The Jeep Club causes no issues with sound or
appearance for our church their areas kept clean by basically carlos and they're always extending
ways to help the church out you know and and to have others help the church out and this person's
there two or three times a week and this person's verifying that you know that our property is
always kept clean front and back and the jeep club is never overly loud um and they were asking
for support but this is a handwritten note from someone in the community and this is someone else
uh you know uh basically recommending carlos moto this is a great club i personally see how
they care and protect our neighborhood beyond uh the expectation they also help clean they
surround the areas they are well-educated people making that difference and so mr mo and obviously
here are a forum uh like petitions as well but two people took it upon themselves to handwrite
or type something that's specific to Mr. Moda and to them.
And as you can see here, and this is-

issue with the philadelphia zoning code code and i'm hoping that the next city council will deal
with like just cleaning this tightening it up a little bit and i honestly can see where some
communities get concerned when you hit private club or nightclub but this is the best category
we fit into yeah that's why that's why i'm one of your comments yeah
so and here's our registration permit showing that we do have off-street parking and then
here's maps of the area as you can see there is no yellow there's no orange there's a sliver of
of of residences but even there you know those people are not against our project it's not even
the project but you can see like this is like an industrial ish area where irregular shaped lots
um you know the previous use was industrial in a way because it was automotive repair shop
i think this is a good use of the property and then this is just photographs from royce street
from west west moreland uh royce street to the right of the property royce street to the left
of the property, West Westmoreland to the right, West Westmoreland to the left. And then you can
see he keeps it very well lit, right? So he has security cameras throughout. And my understanding
is that there was an incident in the neighborhood and the police were able to use footage he had
from the video to help solve a crime. But he's very ingrained in this community. He keeps his
property very clean and it keeps it safe safe and it activates this block which is really important
for the neighborhood here's our uh proof of posting of for today's hearing interior photos
full table trophies nothing crazy you know this is where they keeps the cars
and then our plans and drawings like just the same thing very basic meeting notice again not
very well attended. Only four people attended

My clients, Patriots Holdings, LLC, purchased the property in June of 2022.
We are here because they are seeking the re-legalization of five residential units and a commercial unit on the first floor.
The property is zoned CMX1.
The refusal prohibits multifamily household living in a lot not adjacent to residential districts.
um this property is a strip of pine street you can see the first level of all of these buildings
are storefronts salons and the like my client is this chelsea frame shop here which has
been in existence in the spot for 20 plus years and um looking at the uh archive you can see
from 1981 was the it looks like most recent but uh approval for a vacant store and
it looks like most recent, but approval for a vacant store and five apartments. So the
property's always had a vacant store on the first floor and apartments above it. It actually was
approved for an antique store at that point. But the point is, it's always been five apartments
and a store on the first floor. Looking at the other properties on the block, we have
1112, which is also five units and a retail unit. We have 1114, which is five units and a retail
unit. We have 1116, which is six units and a retail unit. And that goes up and down the block.
So every single property is three units or more. The ones surrounding it are five units. There's
given a six unit with a storefront. And these are all the same size properties. So my clients
seek to reestablish the use that the previous owner did not keep up. And therefore, after they
purchased it to get their licenses, they had to come back in front of the board and seek the
variance. I'll walk you through the rest of my packet. We have a letter of non-opposition from
From the Washington Square West Civic Association, as was mentioned, the only issue that came up was there is a gate out back that has some kind of a crumbling rear wall, and the RCO asked that my clients on the record, which I'll have them do, attest that they are going to fix that rear wall.

So I'm here to present 1315-17 North Preston Street.
As you'll see, what we're proposing is not out of character for this section in the neighborhood.
I know that this is an RSA-5 property, but this used to be an RM1 property, and then everything that's surrounding us is RSA, excuse me, is multifamily.
So it would be out of character and stick out like a sore thumb if we're required to put a single-family structure here on this rather large lot of 40, almost 4,400 square feet.
So during our presentation, we're going to review the notice of refusal, the correspondence
from the West Paladin Saunders Park RCO, our petition, nearby properties with a multifamily
history, maps of the area, photographs of the property, our plans and drawings, our RCO meeting
notice, our application for appeal that we filed with the ZBA, our detailed property
showing the Preston Berkeley LLCs and owner of the property, and our Certificate of Tax
clearance. At the conclusion of the presentation, I'll ask that Mr. Nadeau virtually raise his hand,
be sworn in, and adopt my testimony as his own. So our notice of refusal. So we have two RSA
properties we're looking to consolidate and make an eight-unit apartment building. Again, what we're
recommending or proposing is not out of character for this part of Philadelphia. So our
correspondents from the community, they are in opposition to this, more so just because of the
general nature of this part of the city. They're not against the project. They would like a single
family structure, but it would be out of character and impossible to sell because as you'll see from
the map, every property on our side of the street is multifamily with the same type of proportions
in terms of dwelling structures.
And what we do offer is this in terms of form of a proviso.
We would like, we originally had,
and I think there was a mistake in here.
They said we had 25 bedrooms for eight units.
That's not correct.
We have 23 bedrooms for eight units.
We would agree to having two bedrooms per unit
for a total of 16 bedrooms.
We would also agree to commercial trash pickup.
as well, and no living in the basement, as you'll see, because we don't have to live in the
basement. Again, this is a responsible use of the property. And you can see from the presentation,
we did have neighbors on Preston Street who are in support of this project.
And then nearby properties. Again, if this was a vacant-like block, I would say, well,
this is RSA 5, you know, so be it. Every single house on our side of North Preston Street is
multifamily in nature. Almost every single property across the street is multifamily in nature.
All the properties on Powhatan are multifamily in nature. This is a multifamily section of
Philadelphia. If we try to put a single family house here, it would not succeed. No one wants
to have a single family house on an island. Again, if we were on a block where there was a mix.
Again, if we were, you know, on a block where there was a mix, I can see, but we're not.
And it would just, it would be, you know, difficult for my clients to actually build something here that someone would want to purchase.
And again, given the size of the lot too, we're talking about almost a 4,400 square foot lot.
Again, yes, we are RSA 5 now, but all of those addresses that were on this side and most of the ones on this side are multifamily.
And then, you know, again, we're in the heart of University City where you would see multifamily.
We're not trying to take a part of town which is non-student housing.
so to speak um you know we're embracing that and i don't think someone who who was going to someone's
going to buy a single family house on that block especially given a lot it's not going to be
economically peaceful to even build it and then photographs of the property as you can see this
is new construction that's multi-family uh that was built uh i believe a few years ago
and then these are this is proof of the orange notice posters being posted for today's hearing
and then this is North
Preston to the right of the property
again almost every single
property of that block is multi-family

property as well and then our plans
and drawings again we try
to keep the traditional brick facade
we have a responsible
floor plan here where there's no basement
living we have a trash room in the
front that's accessible to all units
we can also agree to that as a proviso
Yeah, so it's, you know, we try to really make a pretty building here. That's architecturally interesting. So if you look here, so first of all, in the basement is just building storage, a water room, electric. There's no living in the basement. We would agree to provide some in that respect.
As far as the, as far as like where the trash room is located, it is right here in the front.
So we made it responsibly that every single occupant has access to this trash room, is located in the front.
We'll have commercial trash pickup where it's going to be as least disruptive as possible to the neighborhood.
And then we also have a lobby in the mailroom.
every floor of this four-story structure has a front bedroom and a back bedroom we've changed
our floor plans where originally we had 23 bedrooms here where now we're lowering it to 16
bedrooms each so this is each two-bedroom apartments
so rco meeting notice uh we met on april 13th at 7 p.m 115 addresses were notified of that meeting
uh the addresses that were notified who were mailing to his addresses or application for
appeal showing the preston berkeley llc is the owner of the property they're the ones that filed
the appeal, our notice of refusal, our project information form, our deeds of property showing
that Preston Berkeley LLC is the owner of the property, or both properties, excuse me,
and their certificate of tax clearance. So with that being said, I'm going to share my screen.

just for the record how did you get to eight to eight units how how do i get how did you get to
eight units what you mean like how it's number wise what what drove eight units why not four

matters but i did the calculation i think that you know this was rm1 it would be 9.98 units going
to nine units. And then next door to us, I believe, is a quadplex as well. So we're not overusing the

First, I'd like to thank you for having me this afternoon.
Our issues as the RCO, first of all, there were 31 people who attended the meeting. Out of that 31 people, 12 of them were near neighbors.
All right. And I know Mr. Knockison spoke that he had a signed petition from four neighbors.
I had seen that information and I don't know who they are.
They're not anyone who's active in our organization.
So I just wanted to say that for the record.
Our issue is primarily with this development.
This developer wants to take two lots and combine them.
And we really feel as an RCO that it is just an overuse of the property in terms of density in that area.
It's apparent because there are multifamily units around us that we have allowed variances for multifamily units in this neighborhood.
But we feel strongly that this is just too much density.
Just a half a block away, right on the corner of Bering and Preston, on that block, there is a 44-unit apartment building.
Our community members are constantly dealing with noise, trash, congestion, and therefore, we just do not want to support this development.
The owner, when we had our meetings, there was no opportunity to engage conversations about possibly another type of design that would allow for a lesser density.
And then in closing, I want to say, yes, we have been working diligently in our neighborhood to increase single-family ownership.
We fought hard to change the zoning, support the zoning for the Market Street corridor in order to accommodate these types of large usages.
So because of this and the fact that we really feel strongly this and the overuse of the property, we wanted the RSA 5 zoning honored and kept in place.
Mr. Chairman, I always believe there's always there's an opportunity to try to see if there is some type of compromise.
i hear that there may be um there may not be but like i always say try um i would love the
opportunity with miss andrews again seeing about if if there's a way to decrease density that makes
sense for both parties the one thing i will say is the reason why we combine these properties
is that we understand that when you have we could have done two parplexes but we wanted to not have
any basement use and when you combine properties it becomes more efficient and we want to put a
trash room and those by combining those properties gave us the opportunity to do that it sounds less
scary two quadplexes but we thought the eight units as one building was more efficient but i
would like the opportunity to meet with miss andrews and see if there's an you know all right um hillary
um mr chair we could do you know one of one of we could we could do a resumptive hearing um or we
can um close the record and just hold the vote for a couple weeks for further discussions
it's whatever the the chair would like and i do see we have another hand if we if we close the
vote for just the rco and additional discussions do we want the planning commission to take a
position beforehand um well if there's going to be changes they may want to wait on that although

So I am a 30-year resident of the neighborhood and these properties, one used 317 North Preston
used to be a single-family house and 315 used to be a garage. 317, a developer did apply for a
variance a few years ago and got denied. This project would just create so much density on
this block. We really would love to see more single-family homes. And I kind of resent Mr.
Nothamson saying about the single-family homes because I am in a single-family home and there
our single family residents, longtime residents on this block. And we really want to, we were
hoping that the RSA 5 zoning would be preserved on this. You know, I'm invested in the neighborhood.
I keep my property up and I am just opposed to the zoning change. Thank you. Thank you for

um council member gotti's office reached out to me said they would be amenable to a resumption

hearing in this in this particular case so that there's an opportunity to discuss the new plans
with the neighbors for both of them well they didn't know they didn't if this was before
okay this was earlier so it was just about this one that we're discussing right now
41st street alan do you want to do that oh yeah no i actually that was i was going to say that
that we we communicated with uh the coordinating rco in the past 24 hours reducing our unit count
to four something that they requested of us um and they you know i i don't want to speak for them
but that was a positive development well why why why don't we do this why why don't we just hold
this one too well they said that they i well with this one they said all right okay let's let's go
on with it and if they come on we'll bring them on okay yeah my understanding is we want to do
a resumption hearing everyone was in agreement to that okay um so we have a notice of refusal
we have revised plans so we got rid of most of our uh of our of our variance requests went through
those revised plans and that was requested us from us um by the community we have the
correspondence from the west paladin saunders park rco and you'll see that the one thing that
we changed based on that letter was the unit count. We went from six to four. And I think
that's something that is positive, a positive development for them. We have a zoning permit
for this property, which we'll review. And then you'll see that what we're requesting is not out
of character to this part of the neighborhood. Maps of the area, photographs of the property
in the surrounding area. Our original plans and then comparing it to the new plans, which if this
for appeal to a client after a resumption hearing to grant it by way of proviso. RCO meeting notice
application for appeal deed to the property and our certificate of tax clearance. And in the
virtual audience as well is Christian Sanchez. Our notice of refusal. So originally we're proposing
six dwelling units and one off-street accessory spot in the front. We got two refusals for parking,
off-street parking. At the request of the community, we removed that, and you'll see that
in our revised plans. We got a second refusal, or the third refusal, two of them is for parking.
The third one dealt with the amount of units. It's an RSA by property, but six units. We're
agreeing to a maximum of four units. And then our minimum rear yard, five feet required, nine feet,
I was just saying nine feet is required, five feet is proposed.
No one has issue with that.
And then these are revised plans.
We're not only removing the off-street parking at the community's request,
they also wanted us to remove the roof deck.
Even though that's not a variance matter for community relations,
we were, of course, agreeable to that and amenable to that.
And these are revised plans showing no roof deck and no off-street parking.
And then, you know, we met with the West Paladin group, and in there, it actually says three to four units is favorable.
So, and that's what we're providing is four, maximum four units.
That was a development that happened in the past 24 hours when we just got the letter, and we would like to, you know, hear from the group, but the group needs additional time after today's hearing.
um you can see here what we're proposing is not out of character for this property
we found the zoning permit that this property had previously a quadplex use so that's more in line
than the six units that we proposed if it has a history of four units or asking for a history of
four units we're actually not increasing density in that respect and then not out of character for
that part of the neighborhood too you can see the the 400 block of north 41st street
uh has a significant multi-family uh history and then maps of the area uh this is an rsa5 property
maps from a google perspective photographs of the property as you can see it's a very well
maintained vacant lot uh this lot has been vacant for some time uh and we're hoping to activate it
by way of this plotplex uh proof of posting of for today's hearing north 41st street to the
of their property north 41st street to left their property as you can see we're on the trolley line
there's ample public transportation interior photos uh so mr sanchez um you know is a very
experienced developer and contractor and this is the type of work product that he has
uh for his units always try to give examples of that so the board can see um that
for his units i always try to give examples of that so the board can see
and then just our plans and drawings again we have one dimensional uh variance requests regarding
the rear yard uh but you can see that it looks like our rear yard doesn't go
as uh far back as the rear yard that's over there on the side of us
and then our floor plans again those floor plans will change so i figured we'll skip that and we
can go over it later when we have uh more finalized floor plans but what was important to my client
was to do a responsible trash storage and maintenance plan and there's there's actually
a trash room here uh so again we always encourage our clients to responsibly deal with trash because
I know it's an issue in most communities,
and we want to be the solution, not a further problem.
Our RCO meeting notice on April 27th,
we met at 7 p.m., 133 addresses.
We're notified this meeting, listed the addresses,
proof of mailing to those addresses,
our application for appeal showing that
public development LLC is the owner of the property,

Okay. And Ms. Andrews, I know your position. What's your feelings on this case?
First of all, I wanted to let everyone know that this particular property came up for us for a variance back in August, August 30th, 2017.
It was denied by the zoning board at that time. The other thing I wanted to mention was Mr. Nakasom stated that his client takes care of the property and the pictures that he showed you showed, you know, cut grass and lawn.
One of the issues that many of our community members had is because they have been actually maintaining and managing that property for decades.
And I'm talking about long-term tenants who've lived in the area for more than 20 years.
And part of their issue about not wanting to support a multifamily variance for this particular tenant was because of how he did not actively engage in managing his property.
effectively. We had decided to think about allowing a variance for this usage,
but what we had asked him when they originally came, preferably because most of the variances
that we've allowed in the area have been for small apartment units, we were asking for
possibly six units, I'm sorry, possibly three units, because that's normally what is in that
possibly six, I'm sorry, possibly three units, because that's
immediate area. Initially, they refused. They did not want to think about, you know, changing the
density. We talked yesterday, and then they came back and said, fine, well, we want to reduce it
from six to four. But really, what we asked for initially was we were really interested in
possibly supporting the variance for three units. No rooftop deck and no curve cut with parking
in the front of the unit. So I just wanted to put that on the record. I had also asked that we
push back a meeting for a few weeks so I'd have an opportunity to present my community members
with new plans. This one too? This one you want to push back? Yes. Yes. Okay. All right. Thank you

to this uh vacant vacant property i live at 433 north 41st street okay and um and i have to say
over the course of the nine years that i've lived uh next to this vacant lot it has never been
maintained consistently um in fact uh i have a photo i'm happy to screen share with you right
now that i took last night even even to this day the sign uh that mr knockamson um displayed being
um you know uh displayed with the with this the notice for this meeting is completely covered in
four foot tall weeds. So it's a consistent pattern of negligence. And often when neighbors have
made attempts to call popular development, we've never received any phone call back. And I should
state, in addition to this variance being rejected in 2017 by your committee, this property also has
over 40 L&I violations due to its negligent property management. So it's consistently
four to six feet tall weeds and no responsiveness from the owners. Okay. It's hard. So I'll just
conclude by saying it's hard for us to imagine. We understand that they can build a single family
property on the lot and they're entitled to do it, but it's hard for us to imagine them
maintaining um any anything you know that they place on that property because of their persistent
10 years of of uh negligence of the of the empty lot mr tucker thank you for your time and effort

history again not a character to have a multi-family in this part of the neighborhood
and i believe that's why the neighborhood supported this project uh maps of the area
this is an rsa five three by property uh you know maps up from a google map perspective
photographs of the property this is a vacant lot has been a vacant lot for a long period of time
since as far back as a week ago as 2007 before uh proof of you know the posting of this property
for today's hearing melon street to the right of the property melon street to the left of the
property sample photographs again i always like to show photographs of what you know the structure
inside is going to look like um and then our site plan um for this property breakfast side
they you know the community appreciated that uh four units again something that the community
appreciated uh i will uh you know point out the fact that we have a trash room on the first floor
where each of the unit occupants will be able to use.
And there is, you know, commercial trash day as well.
So, again, that's a proviso that we would agree to.

my clients are Jenna Nagler and Steve Nemeroff, who should be on the virtual Zoom today.
Jen and Steve purchased this property just over a year ago to build their new single-family home.
As shown on the refusal, let me zoom out a little bit, you'll note that the address is both listed
as 500 Poplar Street, Parcel A, as well as 880 North 5th Street with the OPA number. We also have
our architect, Alex Duller, with FUSA Designs, in case there's any specific questions related to
the proposed home. As I mentioned, this proposal is for Jenna and Steve's new single-family home.
The case today stems from several differences in interpretation that we had with L&I, and those disputed interpretations ultimately led to two refusals from which we are seeking relief from today.
We did receive a letter of support from Northern Liberties, which is also in your packet at Exhibit 17.
Now, to orient you to this property first, you'll note that this property sits on Poplar Street right at the corner of North 5th Street. You can see it's circled and highlighted here.
The property itself is zoned RSA 5, which is noted on the exhibit map at Exhibit 11.
And just for some additional context, you'll see some photos here at Exhibit 17. This is currently a vacant corner lot that adjoins a row of single family homes on Poplar Street.
You'll also take note in this photo that many of these homes on Poplar Street benefit from a front parking spot driveway condition.
As we move towards the rear again this is just looking further up Poplar. This is across the street. And as we move towards the rear here.
You'll see that this, the rear of this property sits along a cul-de-sac of sorts that provides additional parking for you know some of the immediate neighbors here.
Now, prior to their purchase, this property was one combined lot of over 3,000 square feet.
The prior owner of the property subdivided this corner piece back in 2021, which you'll see on the subdivision plan at Exhibit 5, as well as on the subdivision deed that I included in the packet.
Now, for a reason that currently evades us, the Office of Property Assessment has yet to reflect the subdivision in their system, which is why the refusal was issued under that provisional 500 Poplar Parcel A with reference to the new OPA account number.
Now, following the subdivision, the design team submitted and secured a zoning permit for a new single-family home, which you'll see here at Exhibit 7.
Now, when Jenna and Steve purchased the property following issuance of this permit, they applied for a new zoning permit to reflect one minor change, which is the addition of a rear two-car garage to be accessed from that rear cul-de-sac area.

Now, other than the addition of the parking, there were no other substantive changes to the project that had been previously approved.
There are floor plans in the packet at Exhibit 10, and I will show you just the expected rendering here at Exhibit 9.
Now, regarding the refusals, as I mentioned at the beginning of the presentation, both of these refusals stem from a difference in code interpretation.
These interpretation challenges stem from several extremely unique property conditions that led to the hardships being presented to the board today.
Now, starting first with the refusal for this insufficient front setback, you'll see that this refusal notes a front setback requirement of 20 feet, which is based on the adjacent lot.
This particular refusal is based on code section table 14701-1, note 5.
Now, that section of the code would essentially require that the distance between the front facade and the front lot line be consistent with the adjoining structure.
For most properties, this is a very straightforward provision to apply.
Simply put, the facade should line up with the property next to it with the goal of uniformity.
However, I will refer you back to our zoning plan, where you will see that the property line along this property and up Poplar Street is slanted.
So technically speaking, the front facade of the adjoining structure, which you'll see noted here, is 20 feet from its front lot line.
however to strictly comply with the code that would mean that jenna and steve's home would
also have to set back 20 feet despite this uneven lot line condition now of course the intent of
this code section is to have a uniform facade so setting their home back 20 feet would probably
start at somewhere around here and would have quite an absurd result under the code and would
violate the very intent of this provision now instead to achieve the code intent of providing
a uniform front facade the proposed home is set back eight feet now interestingly this refusal
was not issued when the home was first approved in 2021 the second refusal stems from the proposed
rear parking now the zoning code prohibits accessory parking for single family use unless
it can be accessed by a shared driveway, alley, or rear street. It's a very common code provision
that you likely hear quite often. Now, as you will recall, this property backs up to a unique
cul-de-sac condition off of North 5th Street, which you can see a little bit better here in
this city map. Now, we submit that this cul-de-sac, while not officially on the city plan, is
considered by the city as a dedicated street and therefore does not meet the strict code definition
of an alley or a rear street. The code would define an alley as a common right-of-way
shared by three or more abutting landowners that provide secondary access to lots.
This is certainly shared by three or more landowners. A street, conversely, is defined as
one being confirmed on the city plan, which this is not. As you can see here at Exhibit 12 up on
your screen, this is a printout of the city street map from the city's open map system,
and you'll see that the cul-de-sac area presents somewhat of a quandary as it relates to the street
identification. Now, we did argue to L&I that this parking should be a by-right condition under the
code, and that the ambiguity in defining this rear cul-de-sac area should be weighed in favor
of the landowner. Ellen and I issued the refusal nonetheless. That is why we're seeking relief
today. Now, Jenna and Steve's home is perfectly consistent with the single-family nature of this
area, both in light of the proposed aligned facade and in addition to the rear access parking.
As you saw in many of the photos, the adjoining single-family homes in this area all have parking access from Poplar Street, which was not viable here due to the proximity to the corner, and would also have resulted in a refusal.

and orientation. We further submit these conditions are not true deviations from the
requirements of the code, but instead stem from challenging considerations that are not subject
to strict interpretation under the code. We submit the proposal will not increase congestion,

law submitted at Exhibit 14. And as you noted early on, we did receive a letter of support
from Northern Liberties Neighbors Association, which is in the packet at Exhibit 17. So Jen

We, I think, did a lot of concessions here in terms of this project.
If this was just a conceptually proposed project, this would be pretty straightforward.
Unfortunately, there's a long history with my client's mother, who was the former owner of this property, and some of the neighbors on this block, including the immediate neighbor at 1912 South Mold Street.
So we'll go over that and also go over the technical aspects of this various project.
But again, my client, all my client is looking to do is she bought the property for her mom.
She's looking to move in, renovate the property, move into the property, and to start a family.
And we're doing the least modification possible that you would expect on the Philadelphia zoning code.
So we'll review the notice of refusal. We have revised plans. Originally, we were going to have a roof deck and we're going to have a third story, which was going to be set back legally under the code.
So we'll review the notice of refusal.

It's originally we were.
But because of just the dynamics of this situation, my client just wants to do the least modification possible under the Philadelphia Zerney Code.
And so if this board feels so inclined to grant this variance, I would ask that they grant it by way of proviso via revised plans.

property our original plans and drawings which included again this third story structure which
was legal the issue was where the pilot house was situated on that third story which generated a
technical height refusal but the height was not an issue but for where the roof deck access
structure was but we're eliminating that with revised plans uh we have our rco meeting notice
or application for appeal our deeds of property our tax planner certificate uh and in the virtual
audience is stephanie farm uh one of the owners of this property uh who's going to uh be introduced
to the board she'll state her name be sworn in and then i'll ask her to adopt my testimony as
her own. And then we also have Chris Johnson, the architect for this project. So this is an RSA5
property. We're not looking to increase density here. Bonnie wants to use it as her principal
residence. Originally, as part of this plan, what she wanted to do on this two-story block was add
a third story setback eight feet and then add a roof deck access structure. Also, there was a rear
addition, and this is the only thing that remains as part of this variance request. There's like a
breezeway on our property of 72 feet in totality. We just want to fill in that breezeway to square
off the back of our property such that we have now a functional floor plan now on this still
two-story structure. So all we're asking for is 144 square feet in totality in the first and second
force. We have a refusal for maximum occupied area where 75% is allowed and 85.71% is proposed.
I'll say this, this property is currently a non-conforming property. If I try to present
the property as is to this board, I would need a variance. So we're just slightly extending that
non-conforming use in terms of maximum occupied area you can ignore the height refusal due to
roof deck where the roof deck access structure is situated because we removed that uh by way
of revised plans by eliminating not only the third story which was legal but also the roof
deck access structure because that was what was asked of us by nearby neighbors um as a concern
who were in opposition um they're still in opposition but i think it has more to do with
personality between the previous owner my client's mother and um and those neighbors but has nothing
you know they can talk about if they're in a virtual audience about that um and then the
third refusal has to do with the minimum rear yard depth where nine feet's required and seven's
proposed again look this is a non-conforming lot right now our rear yard uh depth is currently
seven feet other than in that breezeway area because we're filling in that breezeway area
we're getting a refusal because we're extending that non-conformity.
We're just asking for slight modification of the Philadelphia zoning code
to create a functional floor plan in the rear.
And it's not out of character, as you'll see, from other properties nearby.
Again, if this board does grant this variance,
we would ask by way of proviso with these revised plans
where they removed the third story addition
and then they removed the roof deck.
And then this is ultimately this variance in a nutshell.
Not increasing density.
We have a three and a half feet by 14 feet,
three inch section that is a breezeway.
We're merely looking to fill it in.
You can see from the rear yard depth,
the existing is seven feet.
We're just filling this in,
which is creating that refusory.
and given the lot coverage issues we currently have with this this building structure we're
only asking for a slight modification this is not a big lot this lot the size of this lot is
size a lot is only 686 square feet so we don't have a lot of room for error here we just want
to make a functional plan and we're hoping the board understands the dynamics of this situation

Now, we did meet with the East Point Breeze neighbors.
You know, it was a close vote, you know, four in support, five opposed and one abstained.
I would say this, they acknowledge that my clients did vote in support of their project.
They did, you know, it's acknowledged in there, but it was a close vote of four to five.
uh and i'm trying to see what else is here um they did acknowledge that we made changes
you know in terms of uh of the third story edition and removing that and removing the roof deck
um and then the petition like you know we do have neighbors in support of this project we're not
trying to change the character of this block we're not trying to increase density and you know we
We were trying to put a third story addition as of right, but just adding that roof deck created a refusal.
But because the roof deck created a refusal and we were asked to remove the third story,
we're just asking for that one modification to the Philadelphia zoning code by filling in that breezeway.
And then here's our petition, letter of support.
Again, this is a zoning map where we're not changing the use of the property.
And then Google map of the area.
And then this is just this part of this block. I want to point out that you can see that 1913, 15, 17, 19, Mold Street have like full width on at least the first floor. I'm not 100% sure if they're full width on the second floors.
in 1912 uh you know the person who you know rightfully has issues with you know my client's
mother um and we have no affiliation other than being related um and you know but you know she
has full lot width on the first floor so what we're asking for is something that she already
has we're asking for full lot width on it on uh width on the second floor as well and then
photographs of the property you can see it's a it's a cute two-story structure uh brick facade
uh this is the rear of the property uh of particular notes this is 1908 south mole they
were concerned about the effect it would have on 1908 south mole there's no windows in this
breezeway area so when if we fill this in yes there's a window here but there's no windows here
so we're not taking any person's we're not taking the person's light and air away from their
their side of their building structure and then this is south moll street to the right of the
property south moll street till after the property proof of our posting up for today's hearing
and then these are our plans and drawings as you can see this was the originally the intent
was you know to clean up the front facade have a little bit more modern look to it um and then to
have a third story addition by code eight feet back and to have a roof deck access structure
and you know you see the same building footprint we've run afoul of the rear yard setback as well
as the log coverage issues and then you know these are the four plans again simply that hasn't you
know that you know that hasn't changed on the first and second floors and we'll go over that
And then all we're doing is changing it such that instead of having that third story addition, just cleaning up the front facade and, you know, and again, putting new rear paneling on the rear facade, again, squaring off this property for us.
and then again the only thing that we're trying to do is fill in this three and a half feet by
14 feet three inch section of our breezeway again increasing a non-conformity here
and then the floor plans are pretty basic you know living room dining room kitchen but you see
this is where our kitchen is our kitchen is in the rear and if we didn't have that part of
the breezeway filled in it would it would just make it a not not a functional floor plan uh on
the first floor in the rear and the same thing with the second floor we have a bedroom in the
front a bedroom in the back bathroom washer and dryer if we didn't fill in this breezeway we
wouldn't have a really a very large bedroom to say the least uh and then the basement is just
for storage for my clients again they're not a developer they're just looking to live there
themselves. This is our meeting notice. April 19, 2023, we met with the community, 180 addresses,
notified addresses, proof of mailing to those addresses, our applications were appeal that I
filed on behalf of my clients, the original notice of refusal along with the project information form,
our deeds of property showing that my clients own the property, and our certificate.

Okay. I'll be brief. I represent at least four neighbors who've retained me. One has retained me since January of 2019.
And as Mr. Nockmson alluded to, just to give the panel a little flavor of what this block has dealt with, the Concept Realty, which is a management company owned by her mother, the applicant's mother, and the applicant herself served as a property manager, according to her LinkedIn page, during this whole time.
this property at 1910 South mole street was the subject of a let's just call it a nuisance house
there was illegal karaoke house there was dog fighting there was cases and cases of alcohol
outside with no permit so I've been involved since 2019 in getting the police involved and
getting the commission the councilman involved and then all of a sudden what we learned was that the
the property was then transferred for a dollar to her daughter. Ms. Pham did assist the mother,
assist with getting rid of that tenant eventually, but it took years. And then I will commend Mr.
Notcomson and the applicant. I sent a demand letter back in September, I think when we first
learned about this, that we were going to oppose this. And that's when we've had constructive
conversations with the applicant and Mr. Notcomson to, we thought that the third floor would be way
out of character. They've reduced that back to the second floor. We had a very contentious but
cordial RCO hearing just a few weeks ago. There was a vote. A lot of this came up, but more could
have come up. We're still in opposition of this, but we appreciate that they've been reasonable and
brought back their application. I know that there's a lot of other neighbors who are here today who
may have some more to say, and I'll defer to them, but it's still the position of the Neighborhood
association and the neighbors that I represent that they're in opposition basically because of
the lack of trust and the lack of hardship to this character to this property and most of the
hardship has been brought upon themselves I also want to note for the record it did come up at the
RCO hearing that the property just next door our understanding was it was such a nuisance that
that property the property next door being 1908 was just sold on April 14th so the neighbor who
is most affected to this probably has never even gotten notice of this. And when I say most
affected, it's because the breezeway would reduce the light that comes in from their side, not the
1912 side, but the 1908 side. So the applicant had stated that they would try to reach out to
the new owner. I don't know if anybody has been able to do that. So for those reasons, this is
still a block that is a hostile block. And we're trying to cool the temperature of the block
because of all the opposition
that's happened with this particular property
over the last four years.

But the reason I want to speak very briefly is that one of the other neighbors involved in retaining attorney Adler wrote a letter that she wanted to read today in case it was necessary. And I do not believe she is in the audience right now.
If she is, she would be raising her hand. Her name is Joanne Mellis, and she is at 1911 South
Mole. So I know we don't have a lot of time. So I'll try to just recap what's in the letter
instead of reading the letter. And essentially what she wanted to say, and again, this is her
letter, but it does represent those who retained attorney Adler. So Mr. Chair, just for legal
purposes I would object to her reading the letter and hearsay but I would I would let her read a
letter just for a technical objection okay all right so well I was gonna say we need to have a

So we're looking to put an event planning space here.
And, you know, because of how the Philadelphia Zoning Code is impartially drafted, it's
the philadelphia zoning code is in for in artfully drafted it's this is deemed a private club's
backslash nightclub uh which is not but um that's what it's noted as and you know that's what we're
asking for our variance for um we have a letter of support from the southwest philadelphia district
services that coordinating rco um i believe it was unanimous support we also have support from
the nearby, some nearby property owners. This, you'll see, is a former, looks like a former
office building, which has ample public parking of almost 170 parking spots. So unlike most event
planning spaces where you see in center of city Philadelphia, there's always a discussion.
Where are the cars going when you have an event? Well, we have a lot of 170 car capacity, so I
I think we're in a good spot there.
You'll see the petition.
We made a concerted effort to meet nearby neighbors, and we have support from those neighbors.
Maps of the area, photographs of the property in the surrounding area, sample work.
So Dee Williams, one of the leasees, her family is in the industry, the event planning industry.
And what she wanted was a brick-and-mortar site to do her family's company to do events.
And that's what we're hoping to do here at 5616 Woodland.
And you'll see some sample work product of theirs.

This is an I-2 property.
um but does not have an industrial history at all if anything you look at it i think it was a
most recently a drug rehab facility but has been an office building um and we just want to
repurpose it as an event planning space uh which makes sense because we're on the commercial
border uh because we're in we're in an industrial district the proposed nightclub and private club
use is prohibited. And then, but we had a letter of support. We have unanimous support from not
just the community, but the RCO as well. They were just very happy to have the property activated,
honestly, which has not been the case for a number of years. And then this is an explanation
of their support as well. And then our petition, in addition to meeting with the community
through a RCO meeting, we actually did outreach as well.
Again, it's not a high residential neighborhood,
more on the commercial quarter.
So we tried to get as much support as close by as possible.
And then these are just the signatures of those individuals.

It looks like there is a sprinkling of RSA5

But you can see we're just on the commercial corridor.
You know, we have a bus line here, ample public transportation, but we don't need it.

parking lot is rather large and again our understanding is you can fit approximately
only 170 cars in there and then just our floor plans in general uh you know you see here we have
ample space for events there are a couple offices here for my clients obviously public
restrooms there's some storage for them and then you know just our our community notice we had a
meeting on April 20th at 6 p.m 60 addresses were notified of that meeting these are the addresses
Proof of mailing to those addresses, our application for appeal, our lease of the property showing that it's the lease, you know, technically was supposed to start October 1st, 2022.
It's the lease, you know, technically we're supposed to start October 1st, 2022.
We haven't done anything yet, but it ends eight years from the commencement date.
So eight years from October 1st of 2022, which goes October 1st of 2030.
And this is the whole lease in general.

And then there's a certificate of tax money showing that no taxes are owed on the property.

The thought has not shown that the property cannot visit cannot possibly be used in strict conformity with the zoning code and that the variance is therefore necessary to enable the viable economic use of the property.

I know the board's running late, so I'll be brief.
Our packet includes our appeal at Exhibit 8, our zoning posters.

vacant properties at 534, 536, Titan were posted. Our neighbor notices are at Exhibit 10 where we
met with the Dickens Square Community Group back in February and have a letter of support.
The deed to the subject properties is at Exhibit 11. My client purchased these properties back in
August of 2019. At the time, it was an abandoned house that my client has since torn down so that
he can build his own residence at this property. And our tax clearances are at Exhibit 12,
showing 534 Titan has a zero balance, and the associated lot 536 also has a zero balance.
The letter of support was sent directly to the board and is Exhibit 1 of my packet today.
there were 15 members in attendance at the community meeting and there was no opposition
to our variance request. Exhibit two is the notice of refusal for my client. My client is basically
he owns 534 and 536 Titan. We're seeking to combine the two lots into one new lot
and on it erect his single family home that is dimensionally compliant with a roof deck
but also with two-car off-street parking. Now, the property is zoned RSA 5, and in this zoning
district, the off-street parking is not by right unless it's from a shared alley, driveway, or rear
street, and Titan Street is a legally open street, which is why we're seeking the variance request
today. Exhibit 3 is the zoning map of the property and an aerial map. It's just showing the property
is RSA 5, surrounded by other single-family properties. And the aerial map is just to
orient the board of where we're at in the city. This property is three blocks south of Washington
Avenue, north of Wharton Street, and in between 5th and 6th. As I mentioned, when my client
purchased the property in 2019, it was an abandoned house. And photograph four just shows what the
house looked like when he took possession, with plans to build his own house on the property.
exhibit five are the site photos as you can see the property is now a vacant lot
in the middle of the screen other properties on the block are single family in nature just
like my client seeking page two shows the properties to the east on the south side of
titan street and my client's property is also on the south side of titan street
properties immediately to the east of my client's property is has all street parking for a garage
at 528 Titan. That's the lower second picture on page two. And the rest of the properties on this
block are, again, single family in nature. Going down the block to the east towards Fifth Street
are other single family houses. And then we get to the property at 514 Titan Street, which is the
lower picture on page three that has the same design, similar design of what my client's looking
for, which is a door on the left side of the house and a garage for off-street parking to the right
to the west side. And importantly, going back to these photos, the parking is only on the north
side of the block. All the properties on the south side, there is no street parking. So my
client's proposal will not be taking any parking away from the street for the neighbors, which is
why we have support to bring cars off the street. The properties, looking at page four, are just the
properties on the north side of the block. Again, all single family, or strike that page five, are
all properties on the north side that are single-family, and the property at 529 also has
off-street parking, similar to what my client's requesting. And the rest of the properties are
just single-family houses going to the east of the subject property. Exhibit 6 is a lot
consolidation plan, and I'll zoom in because it's super small to see. These are very small lots on
534 Titan is 13 wide by 40 deep. 536 is 12 feet 7 inches wide by 40 feet deep. So very small lots.
They're 496 and 523 square feet respectively. The consolidated lot will
generate or result in a lot that's 1035 square feet and it will be 25 feet wide by approximately
40 feet deep. On this consolidated lot, my clients, as I mentioned, seeking to erect a
similar property to the other properties on the block that's dimensionally compliant.
Looking at the rendering, it's a 32-foot structure with a roof deck and pilot house,
similar to 514 Titan. The front door is on the left of the house, the garage is on the right,
and the rest of the features, as I mentioned, just dimensionally compliant roof deck
um plenty of rear yard space 10 foot rear yard roof deck um and the
plenty of rear yard space, 10-foot rear yard, roof deck, and the front, there is no parking
on this side of Titan Street, which makes this a good idea to bring cars off the street
at this location. The second page of Exhibit 7 is just the proposed floor plans.
The basement level is for storage, non-living space. The first floor is the entryway and the
two-car off-street parking. Second floor is living room, dining room, and kitchen. And then the
bedrooms are on the third floor. It's three bedrooms, two-bath house with a roof deck. And
again, this is a property that's individually owned by Mr. Hausler, and he's looking to basically move
into this as his primary residence and start a family at this location. With that, members of
the board, I'd submit that the subject property, that there's a hardship and that the variance is
in keeping with the characteristics of this block in that there's no parking on this side of the
street. Other properties have off-street parking on this block of Titan Street. And we will be
able to remove cars from the street, reduce congestion. And as I mentioned, to start the
matter, the neighbors are in full support of this request. And counsel, I understand that
council member is not in opposition to this. We have not heard from the council directly.

is that visible yes all right uh again mr chairman members of the board good afternoon
uh i'm the attorney for denise and peter pellegrino uh they
I'm the attorney for Denise and Peter Pellegrino.
They have owned this property at the corner of Holyoke and Academy Road since 1998.
Prior to that, their brother owned the property from 1979 to 1998.
So this has been a family-owned property for over 40 years.
This is a table of contents, AA through A10, and I'll walk the board through these documents
and ask that they be admitted into evidence.
The request today is simply for a driveway. When I show you the aerial photographs,
you'll see that every property on Academy Road has a driveway and most of them have garages.
So my client is asking for a driveway and for a garage. So this is the refusal. We're an RSD3
District, which is a detached single family, and there's two refusals. One is, I don't have any
qualm with that, the proposed garage and surface parking are located within the required rear yard
depth of 25 feet. That's a refusal I have a contest with, and I'll explain why when I show
you the aerial photographs. The other refusal about having two principal residents on the lot,
I don't have a qualm with because, like most of the other properties in this neighborhood, they all have garages as well as driveways, and their home is situated on the same lot.
Again, we just met with the RCO on Thursday.
I got the sense that it was going to be fine.
The only issue they had was should the driveway or the garage be pushed back further than the planned show.
So let me just give you some perspective on what's happening here. So this is my client's property. It's a very large property. It's 8,500 square feet. For instance, the property next to it is only 7,500 square feet.
However, this property next door to the right of my client's property, which I'm using with
the cursor, is on Academy Road. This is 29,000 square feet. It's a little bit more than half
an acre. It's a gigantic property. And the house that is situated on this lot is about 125 feet
from the side yard of my client's property. So the issue I have with the refusal is,
this is the front yard of the property. And I'll show you the front door. This is the pathway
leading up to the front door. And so this is the side yard. The way the examiner viewed this
property was he considered this the front yard and then this the rear yard. So if you consider
where my cursor is on Holyoke as the front yard, he would be correct that you need 25 feet
for rear yard but since this is the front yard and i'll show you the rsd code regulations since
this is the front yard this my cursor is between my client's property and the very large property
this is the side yard and in the rsd3 zoning district on a corner property the side yard
you only need to be seven feet away from the property line to be compliant my client's
proposed garage is three feet away from the side yard so it has a real bearing on the board's
consideration in this case and the reason that we have side yard requirements is for a number of
reasons one is for fire and safety you don't want the houses too close even though you can see
in the development itself, the houses are relatively close, but I'm going with a strict
interpretation of the code. So you have a side yard requirement for fire and safety purposes so
that if you have a fire in one structure, it doesn't leap to the home next door. You also
have it for purposes of light and air. And also you don't want overcrowding of the land.
Well, because my client's property happens to be adjacent to a lot that's 29,000 square feet
and the residence upon which that lot is situated is 100 to 125 feet away we really have no issues
with regard to fire safety light air or excuse me or overcrowding of the land because of the
great gap between the two properties the other reason this aerial photograph is significant is
because if you look at academy road uh there's there's parking obviously in front of your house
but every property has a driveway right this there's a driveway here that goes all the way
in the back to this apartment complex it's a very narrow driveway you go in they can turn around
and come out you know the front of the car first but most of the other driveways the the homeowners
The homeowners, like, for instance, this house here on Academy, where my cursor is, there's a driveway and a garage.
like for instance this house here on academy where my
And I've seen it most, frankly, residents on the block have to back out and then go forward on Academy.
And then if you look across the street, there's other driveways.
Again, you have to enter off Academy and you typically would back out.
And some of the driveways are wrapped, excuse me, some of the garages situated on the lots across the street are rather large.
You can see where my cursor is, that this is the house and this is the garage.
The garage is almost equal in size to the house.
The adjacent property, again, there's a very large garage and it's almost as big, if not bigger, than the house.
Our proposed garage is half the size of the existing property.
But again, my point is that every house where my cursor is, there's a driveway with a garage.
Here's a driveway with a garage.
Here's a driveway, no garage.
Here's a driveway, no garage.
And on and on and on.
I don't want to belabor the point.
Basically, what we're asking the board is, can my client be treated like every other house that is on Holyoke Street?
Now, if you look at my client's property, he has a pool and there's a shed, which you can't see, where my cursor is over the L in Holyoke.
My client has removed the pool and has removed the shed that's there.
So now there's ample room for a garage and for a driveway.
So this is the front of my client's property.
This is what I'm saying.
This is the front yard and this is the side yard where this railing is.
And the sidebar requirements, which I'll show you later on in the presentation of a corner lot, is seven feet.
My client does not use this as a driveway now.
You can see it looks like some tire marks.
Basically, he pulled an old trailer onto the lot, and that's where it's situated.
Again, another perspective of just a closer view so you can see the size of some of the garages across the street.
You can see the driveways.
You can see the cars coming in all along Academy, and you also can see it across the street.
Some have double-wide driveways.
Some are just single-wing.
And so these are some photographs as you were approaching my client's property.
My client's property is where the cursor is down where this car that I'm circling.
And I just wanted to give you a perspective on, again, here's a driveway where this homeowner will have to back out on the Academy and drive away.
And in this part of Academy, it's narrower, the parking lane, because it turns and there's a curve.
As it gets down to my client's property, the area between bike lane and the curve is a little bit wider.
So this is my client's property, again, where the cursor is with the white fence.
This is a photograph I took just showing directly across the street.
This is the posting of our notice on my client's property, and directly across the street, you can see there's a driveway with a garage in the rear.
And this is a photograph taken from the side of my client's property where the black metal fence is to the residence on the other side, and we've estimated that to be about 100 to 125 feet away from the side yard.

so this is academy road uh this is the proposed concrete driveway in fact the concrete is is
actually going to go over all to the side of where the end of the garage is uh right now we have
nine feet from where the apron is. And then from the property line to the garage, there's another
20 feet. So there's 29 feet from the edge of the apron all the way to the front of the garage. So
the reason I point that out to the board is when I show you the dimensional requirements in the
RSD3 zoning district, you're supposed to have a front yard of 25 feet. And if you count from where
the apron is to the driveway it would be 29 feet now just in all candor to the to the board
we had a discussion with the community group about whether this distance from the property
line to the garage should be 25 feet and since we don't have their letter i don't really know
should be 25 feet. And since we don't have their letter, I don't really know how they weighed in
how they weighed in on
on that. But I just want to let the board know there was a discussion there. And there was a
suggestion that my client might want to move the garage back five feet. If the letter comes in,
Mr. Chairman, and if the board looks kindly upon this application, if the community group suggests
that we move the garage back five feet, we'll do it. We want to make sure that we're in good
stead with the neighborhood group. They were very kind to us, you know, very cordial. And my clients
lived in the neighborhood, his family's in the neighborhood, his son-in-law's in the neighborhood,
he doesn't want anybody to think that he's trying to, you know, pull a curveball here
with anybody, at least of which are his neighbors and or the community group. So I guess we'll have,
we may have to see what that letter says, Mr. Chairman. The other thing that's important here is
because the concrete is going to be all the way over to the side of the garage,
we're going to have about 40 feet here.
And that's going to allow my client,
the garage bays are right over here, right where the parking spaces are.
But this is going to allow my client to pull in with the front of a vehicle.
And then when he wants to exit,
he's going to be able to do a K turn and come out front first.
Again, I'm not saying the other neighbors, you know,
aren't safe and careful when they back out,
but we're not going to have that situation. The other question that might be, the board might be
asking is why now? Why are you, you've been there, now he's been over there 40 years, why are you
proposing the garage now? And the reason being is my client's gotten rid of the pool when it was
out there, it's already taken down, and the shed that he had here, he's actually moved over here.
So, and it's time basically that, you know, he wants to be able to come in and not be fighting
the weather, having the car covered so he doesn't have to worry about shoveling snow.
He's getting a little bit older and things like that.
So that's really the impetus for this request.
And I just wanted to show you, here's the front elevation of the car, of the garage,
two bays on the left with the door access to the right.
And as I said, there's going to be concrete along the entire front of the garage area.
And then here is the RSAD zoning requirement, which I'll blow up.
So we're in this column. So our SD3 is a single family detached minimum lot width. We have that minimum lot area with 8,500. We have the occupied area. And here's what I was talking about, Mr. Chairman and members of the board was the minimum front setback of 25 feet. We have that to the curb 29. If the community group wants us to move it back five feet, we'll certainly do that.
And then here is the minimum side yard requirements. If you have a corner lot, you're only required to have a side yard dimension of seven feet. And our plans indicate that our side yard is three feet, if I could show it to the board.

second unit. And we have a refusal for occupying 87% of the lot with our proposed plans instead of
the required 75% of the lot. So those are our two refusals. The property directly next door
is the same size lot and was approved for two units by this board in 2018. They actually
are built 10 feet higher than we're seeking to build. We're seeking to build in line with the
other three properties that are in this stretch of block. Property three doors down, 18 is an
approved two-unit property as well. That was approved by this board in 2017, and that's more
in line with what we're seeking to do, which is two one-bedroom units. The property is next to
a lot for a multifamily development. And across the street, like I said, it's a rec center and
no single-family homes. So we went in front of the RCO. We got the support with their provisos.
We actually had to return and amend the plans to take any living out of the basement.
So we did that.
That was their proviso.
They wrote a letter supporting us.
And we believe that in conjunction with the two approvals from 2017 and 2018, that this request is reasonable for two units.

This is an application for the erection of a new structure on a corner property that is in a RM1 zone district.
This property is on the corner of 15th Street and Cabot Street.
As part of our application, we're seeking to use the property as a three-family, multi-family dwelling and one rear access parking space.
It's worth noting that majority of the refusal is, in fact, related back to the parking space.
However, I do want to point out to the board that this particular street, Cabot Street, does not allow parking on the side.
It is a smaller street, so the rear access of the parking to this back of a corner property actually would make more sense on this street.
It doesn't take away any on-street parking, and it does, in fact, provide an off-street parking spot to this particular property.
The property is located in an area that is predominantly multifamily.
In fact, we do have support from the RCO.
We also entered into a community benefits agreement with the RCO relating to what they're requesting as far as having cleanup and other support to the community.
The property is currently a vacant lot.
It has a new constructed project next door, which I believe was constructed when these properties were still zoned CMX2, because it does show that it has a commercial component on the first floor and two units above.
This particular property actually at one time applied for a commercial component as well with two units above, but that never was approved or actually it was withdrawn, so it never went forward.
my clients acquired the lot and now seeks to move forward with a construction which is a three-family
dwelling because of the overlay 425 square foot per unit required we have over a thousand square
foot but we're short of the 1275 overall square foot required for a by right three unit however
the lot is a corner lot it is rather large and the layout of a three-family dwelling
would actually fit the size and use of the area, including some of the property next door.
The other corner properties down at the end also has two units and a commercial component,
but essentially from a density standpoint, very similar to what we are proposing.
We're proposing three units with the bedrooms on the first floor, living room on the
basement area for the first unit and the second unit and third unit both are on the second and
third floor and each is a two-bedroom unit. Trash will be stored in the rear yard.

support. Let me go through the relevance. Well, let me show you the photographs first. That'll be
easiest, I think. Now, the appeal, the project information form. This was the notice, and there
was a meeting with East Parkside. The notices were all sent. This will give the idea to the
panel members. This is a two-story property. It is commercial. It was purchased as a vacant
property that had an old salon on the first floor and one apartment on the second. The plans that
we submitted to be stamped by the board reflect the fact that we're going to maintain the same
use. You can see that Mr. Mizell, as the owner, has put money into the property rehab, the first
floor commercial, and the apartment. This is it here, noting the posting that was done with access
being ADA compliant. The two posters. Next door is a vacant lot. This is to the right.
This is down the street. The properties, this is the vacant lot. And you can see in terms of the
nature of the neighborhood. This was all a commercial store at one point in time. So there
was commercial uses all the way up to $39.64 with some apartments above and so forth. And when Mr.
Mizell purchased it, it was a full-on. And the other properties in the neighborhood are single
family. Here's the plan. Let me see if I can move this over a little bit. Okay. So the plan here is

So I'm not sure what the prior commercial use was on this property, but it either if it was personal services, it was abandoned or it was something else, which is.
