Members of the board, we're here on 1344 North 5th Street.
This is a vacant lot on a corner that is zoned for CMX1.
uh the the commercial use was really not compatible uh for the surrounding neighborhood
and so we uh proposed um a residential use um initially uh we were proposing four uh dwelling
units in a in a new construction uh but after meeting with the community we made a number of
different uh changes to the design and we'll walk through those but now our proposal is for
three dwelling units at this corner property. So the refusal is two. One of them is
use refusal because multifamily is not allowed when the surrounding residential zoning is an RSA5.
And we now have a dimensional refusal because the community asked us to set the house back from the front street and that impinged two feet into the rear yard.
So we have a seven foot rear yard setback as opposed to the nine foot that's required by the code.
when we met with the community several times we had good meetings and we
which resulted in a unanimous vote of support by nine attendees at the community meeting
and their letter you know reflects the concerns that they had and how
we have addressed all of their concerns we went down from four to three dwelling units
we addressed the concern about living space in the basement, we changed the setback to
uh address the concern about living space in the basement we changed the setback to
harmonize with the setbacks of the houses in the surrounding lots
uh let's do the drawings here so um
is this a good size for for members of the board to to take a look at
yes yes yes it is all right good um so uh
that's a these are two different views um of the um of the the elevation of the of the drawings we
also um i believe have our architect uh available to answer questions if that's uh uh necessary this
So these are the revised plans that we submitted to LNI in the last few months.
So we originally had our setback up to the curb and we've moved it back.
So now we have a dimensional variance of two feet in this open area.
our changes that we made as i said was the front setback we increased it we decreased the dwelling
units we reduced the rear setback we slightly increased the building height but it's still
inside the the limits of the code we added landscaping we made sure that every unit
had access to outside access through various extra doors.
We located the find where the utility trench was going to be and just added some more landscaping.

Good morning, Mr. Board, again, Jeffrey Young here for the representative applicant, DRS
and King Richard Enterprises, LLC, the owner of the property located at 1913 on Wesley
High Avenue.
Here is a copy of our deed to show proof of ownership.
here's a tax clearance i briefly uh mentioned uh we were able to get that tax clearance as
you see it was issued uh today
here is the a copy of the refusal um so we were refused uh for having a proposed use of a child
here is the
care center um on the first floor of the property located at 1913 west lehigh avenue um the current
zoning is rsa5 um so we were refused for that use for not being a residential use um on on the
property. And as you can see here, this is a zoning map of the property. You'll see most of the
properties are this yellow class, which is RSA 5. However, when I get to the pictures, you'll see
that this property does not fit the typical RSA 5 characteristics for properties in this
particular neighborhood. Here are plans for the property. I'll zoom in.
So folks can see a little easier. Essentially, we are proposing to use the basement and first floor as a child care center. And the second floor has two previously approved uses for apartments. So we will just be reconverting the second floor to that apartment use.
uh here so there will be two studios apartments essentially about 500 square feet apiece
here this is a map of the property we'll see we're located on the uh northwest corner of
garnett and sedgley and also across the street is uh lehigh avenue which is a major uh thorough
thorough view in North Philly. Here's pictures of the zoning notifications. We posted up to the
front of the property and also on the side of the property. Here gives you a view looking at
the property. Again, it's situated here on the corner. As you can see, this property has gates
on it. The gates were there when we purchased the property. There are signs on the property. Those
signs are already there when we purchased the property. And as I will dig more into the history
of this particular property to show that it has never been used since 1937 as a residential,
as a 100% residential property. Again, here's another view of the property looking north.
Here is the view of the neighborhood looking west on Lehigh Avenue. As you can see, this is
approximately a half a block west of the property. To the left here in the picture is another
child care center in a property that is zoned RSA 5. So our use is not inconsistent with uses that
are in this particular neighborhood. Again, there's a child care center a half a block down
in an RSA 5 zoned district. Here's a view of the property on the side of our property in the rear
looking south on Garnett Street and again this is a directly across the street from our property
I would want to say southeast of our property there is plenty of parking in this neighborhood
when the parents will be dropping off and picking up their students so there are no houses on this
side of Cesslie Avenue here where folks pull up and will be able to to pick up and do drop-off
again this is across the street from my property is this abandoned uh factory that's been abandoned
pretty much my entire life um and so we're just trying to you know add some life to this corner
um in north philadelphia these pictures here are pictures of a child care center that was actually
already in the facility um this is not current pictures of uh of what we and our design will
look like, but I just wanted to show that this use, I don't know if it was legal or not, but this
use was already there in the center prior to my client's purchasing this property. And, you know,
we had that center, I did not get any complaints from the neighborhood whatsoever. Here is the
notification that I sent out for the community meeting. Proof of mailing.
and here i want to get into a little bit more of the property history um so i'll zoom in um as you
can see uh in 1967 uh this was the first floor was a luncheonette uh with two apartments above
in 1976 it was a variety store with two apartments above
And again, in 1951, it was a two-family unit with a restaurant.
And again, in 1951,
So, again, this property, you know, the history of this property has never been a residential use.
100% residential use, excuse me.
Again, there's another family restaurant and two-family dwelling.
and attaches our, this is our notification letter from the RCO letting us know when our community
meeting was. Again, we had our meeting on Wednesday, December 30th via Zoom, and that
notification was sent out to all RCOs and all neighbors. Here's our letter of support from the
RCO stating, you know, that they support our project. We had our meeting on December 30th,
and we did have some technical issues with via Zoom.
You know, a lot of folks are getting used to this.
However, we were able to have our meeting
and the board of the Allegheny West Civic Association
supported our variance requests.
We also went above and beyond and flyered the block
to have our own meeting, again, with neighbors on the block.
We did have one resident of the block
to participate in this particular meeting as well
and showed her support for our project.

Association RCO and we are one of the one of the five affected RCOs on this for this address you

okay um we sent our letter in which I hope was red and we're asking that there be a second meeting
As Mr. Young reported, only one affected address was at the meeting.
The RCO coordinator did not consult with the five RCOs before making the meeting date of 1230,
which is the eve of New Year's Eve, and the notice was sent out on Christmas Eve 1224, which is unreasonable.
There are, the state says there's 29 daycare centers in the area.
We are saturated with daycare centers.
I understand the youth history that Mr. Young described.
However, even on that block, the state of Pennsylvania,
Commonwealth of Pennsylvania says there's daycare at 1927 Lehigh
and there's one at 1937 Lehigh.
One of them is a new construction that was just built.
And in the immediate area, there's almost 10 daycare centers in, say, like a square of Lehigh, the southern block of Huntington, one block south and one block north, which is Somerset.
But we see no hardship to find other uses that are not duplicated in this area, especially where there are two other daycares on the block and they were not at the meeting.
And so one being a new construction by Deliverance Baptist Church, who is a very good neighbor in terms of land use.
in terms of land use. There's no hardship that has been proven that we need a third daycare center here or this entire building being converted away from residential use.

I'm unsure because of the documents whether this applicant is going to put one apartment above because we were sent drawings with two apartments which may have been what existed there before.
We're saying that this is overuse of the variants.
And also, we don't understand, is a special exception already existing at this address,
or does the daycare center that's being proposed need a new special exception?
And have the same question about the apartment.
So are we talking about two different – are we talking about a multifamily variant
and a special exception in this hearing?
um hopefully you have a question it wasn't clear so i can answer that question
could you please address the issue of the residential unit or unit yes so the residential
units were previously approved we are not um refused for the residential units we are refused
for the proposed daycare use um and to um reference miss uh fernandez comments regarding
other daycare centers in this particular neighborhood, the census, looking at census
data shows that there is a growing amount of children in this neighborhood. So having a
center here that with a capacity of about 30 children will not put any harm, cause any
detrimental harm to any of these other daycare centers in the neighborhood. Most of these centers
have wait lists for quality centers, what we are going to do is provide a quality daycare center
at this location. I don't think that we can put, I guess, a cap on the number of quality
educational institutions that our children in North Philly have. And in regards to the community
meeting aspect of it, it is the coordinating RCO's responsibility to coordinate the community
meeting um i sent our request in to the to the uh planning commission um and you know it's the
coordinator's rco's responsibility to get that information out um now just i want to show here
uh members of the board i have emails from the planning commission uh december 2nd i asked them
to you know send me uh who the coordinating rco is um i got a reply back stating it has not been
assigned as of december 2nd if the project still was not assigned um on december 21st i received
this email telling us it was assigned to Allegheny West Civic Association, and we scrambled to try to
put together a community meeting in time, which was put together, and I was given the information
on December 24th. That same day, I sent out notices to all affected RCOs, mailed notices out to all
affected addresses, and we proceeded to have our community meeting on December 30th. I think that
is something that is not of the doing of us or my client. We followed the procedures and rules
that were placed in front of us to move forward.

and not consulting with RCOs because they sent out emails to selected parties,
most of them not even RCOs, saying they wanted to have a meeting for 1915 Lehigh.
So the RCO, Allegheny West Foundation, they're not following the rules.
does not it doesn't justify the other the other four RCOs being cut out of a meeting to get a
notice. I would suggest, ma'am, that you raise this issue with the Planning Commission and the
RCO. I did that. However, we are still asking for a second meeting, especially where there are two

So it was a lot going on.
And I really wanted to be able to enjoy one part of this holiday amidst the chaos of COVID.
So I really wanted to ask for continuance because we really wanted to make sure that we had a full understanding about what's happening in the community because it is in our footprint.
And we know that some of the community members, we can guarantee you, did not get notification.

Okay, and these are neighboring properties, 1915 is at the corner of 5th and Hoffman,
1917 is one in from the corner of 5th and Hoffman, and I represent Cliff Lasky, he's
also on the call, he's the developer, and we have a real estate expert, Jonathan Torrey
also available to testify. And as you asked the missionary, we did submit the tax clearance
certificate, which I will bring up for both properties. Okay, and we have tax clearance
certificate for both properties. And the refusals are very simple. There are one refusal for
each property. For 1915, it's to have three residential units where one is permitted,
and for 1917, it's to have two residential units where one is permitted. These are residential
for sale condominium units, and again, it's one variance on each property, as I described.
We met with the RCO in November, on November 10th in the rain at an in-person meeting,
and the RCO letter shows support. It was 13 people in support and one person in opposition
for both projects.
Despite this, and despite this vote, the RCO in their letter takes no position.
Despite this,
and despite this,
I will get to that in a minute.
Here is the site plan for 1915.
As I said, it's three units, and we meet all of the dimensional requirements.
It's 38 feet in height.
we have 20 percent open area we have a rear yard that is 11 and a half feet deep for
1915 we meet it's 37 feet in height the rear yard's 14 feet deep and we have 25
open area because it's not a corner property all the requirements are met in terms of dimensional
relief. The floor plans for both units, and the RCO letter, as I said, it shows the support
of 13 people, eight tenants, and five residents.
I don't know why they made a distinction, and the opposition of one person.
Despite that, the final position by the coordinating RCO is they did not reach agreement, but
we had overwhelming support of the people who came to the meeting that night.
The area that this is in, if you start at 5th and Mifflin and work your way south, the
corner property, that's CMX1. That's a commercial use. But every property after that, 1905, 1907, 1909, 1911, and 1913 are all multifamily and they're all three units. And the property across the street on the corner, 1914 South, 5th Street is also a multifamily structure.
so in this area and this is our lot in this area you have numerous multifamily that's the two lots
the one on the corner is 1915 the one one in is 1917 been vacant for a long time
just showing the site and then the surrounding properties this is 1913 that's a three-unit
multifamily structure. The houses on Hoffman Street are single-family, and I think that's
appropriate because it's a small street, wouldn't really support a multifamily use, and as you can
see, there are both old and new structures on Hoffman Street itself. When you look at the
neighboring properties, though, you have 1913, which is a new three-unit structure, and then
When we go and look to the north, you see a row of all multifamily structures, and then you have the quarter commercial unit at 5th and Mifflin, and again, multifamily structures even farther north from there.
So the properties in this area are generally multifamily on 5th Street.
There are many vacant lots in this area.
The vacant lots cause problems such as illegal dumping and crime.
The variance is necessary for the development of these lots, especially in light of the large number of vacant lots in the area.
Each property includes an enclosed trash area in the rear yards for the properties as well.
Again, it fits in with the context.
The properties have been vacant for many years.
We did have the overwhelming support of attendees at the RCO meeting.
The developer will testify that it's not feasible to develop the single-family residences.
And this situation was not created by the applicant.
The variances will allow for the development of these properties in conformity with the surrounding properties.
It's in harmony with the zoning code by creating quality housing, meets the goal of the zoning
code to revitalize vacant properties.
It benefits surrounding properties by developing properties.
It benefits the surrounding commercial units by bringing density to the area and helping
out the stores such as the Stewart Fifth and Mifflin.
The area will benefit by removing these vacant properties and the trash and the dumping and other problems that have happened on these vacant properties in the neighborhood.
And they will not alter the character.
It's 100% residential, surrounded by 100% residential.
And the variances are the minimum necessary.
And the variances are the minimum necessary.
And again, these properties do comply with all.
And again, these properties do comply with all of the requirements in terms of height and bulk and open area and things like that.
So with that, I did want to call on briefly Jonathan Torrey, our real estate expert, if he could be unmuted.

Okay, these are the plans for 1917.
And as you can see, you have two bi-level units. In the lower level, you have the living area
and the kitchen, and you have two bedrooms and two bathrooms on the first floor. And then
you have a bi-level unit above that. These units are about 1230 square feet each.
You have, above that, you have, again, on the lower level of the bi-level unit,
you have the living and kitchen area and two bedrooms and two bathrooms, laundry area.
In the rear yard, you have a trash area.
And this unit does have a rooftop deck.
And that's for 1917, the two-unit structure that is one block, one house in from the corner at 5th and Hoffman.
And then for 1915, you have a three-unit structure where you have, again, in the lower level, you have a living room and a kitchen and two bedrooms.
That unit is about 1,230 square feet.
Maybe it's about 1,300 square feet, I'm sorry, because it's a little larger lot.

or not would be affected by Mr. Lansky's agenda.
And the one person that was there was the one

and I'm the block captain for this area, was allowed to even participate in the last hearing

Great. Yeah, so I just wanted to take an opportunity. I am fully in support of the multifamily units that Mr. Lasky has planned here. As a resident of the community, I think it benefits us, you know, on several different levels. So I'd like to take an opportunity to address a few things.
First, and this is something that I wanted to speak to as I kind of thought of it as listening to the previous two testimonies, you know, in regards to parking.
I live here in the neighborhood, and I got to say, parking is really not that bad.
Nine out of ten times, I park in the spot in front of my house.
I'm using a car four, five times a week, so I think that that's pretty good.
And then on the off chance that I'm not able to park directly in front of my house or on my block, I'm parking within a one block radius of my home.
Before I lived here on Dudley Street, I also lived at 9th and McKean for a while.
So a little bit further away from where the proposed listing is, but still within the neighborhood.
And that same, you know, that same experience applies there.
Parking, you know, has never been a true issue for my wife and I here at.
you know, has never been a true issue for my wife and I here at in the neighborhood. So I just kind
of wanted to take, you know, the opportunity to address that. And I also think, you know, parking
somewhat to be expected, if you are having challenges with it, this is city living. And I
know, you know, it's, you know, an inconvenience when, you know, parking can become a hassle if it
does. But that is, I kind of think a little bit of the shtick of, you know, all of the other
conveniences of living in the city. So again, wanted to take an opportunity to address that
from a parking standpoint. You know, and also I think a possible solution there or something to
help alleviate it, you know, if I know my block specifically is not permitted with Philadelphia
Parking Authority, but certainly residents do have the opportunity to petition and create that
permit parking for a specific block should the residents of a block, you know, have a majority
petitioned to create that. And that could greatly reduce the amount of transient parking in the
area, which should help alleviate some of that congestion or issues, you know, if other residents
of the neighborhood are experiencing issues with that. So again, that kind of addresses my thoughts
around parking there. Also wanted to take an opportunity to address just the nature of vacant
lots in the neighborhood. I think that this is something whether you are for or against, you know,
Mr. Lasky's plans here, vacant lots are attracting crime in the neighborhood. I witnessed,
you know, on several occasions, you know, drug use in vacant lots, an extreme collection of trash
and, and not just, you know, paper items or, you know, like normal garbage items. We're talking
about TVs, mattresses, you know, other large, you know, kind of appliance nature things. It's just
a real eyesore in the neighborhood. And any sort of development on these vacant lots is going to
help to, I believe, reduce, you know, the crime activity that is happening in these vacant lots
because, I mean, they're easy to kind of submerge yourself and kind of remove yourself from, you
know, kind of the public view of people walking by. Also should help to just clean the neighborhood
up, you know, which I think is something I think all Philadelphia residents would be interested in
it's just getting cleaner neighborhoods. You know, and with that, you know, these are for sale
condo units, they are not, they're not rentals. So to me, that translates into long term permanent
residents in the neighborhood that are going to care about their community, more than maybe,
you know, a rental property might or, you know, just gets more people involved in planning for
a better tomorrow within our community. So all on board, you know, with that, you know, and as
they become for sale, you know, I'm not sure how they stand with the tax abatement. But that's
certainly something that piques, you know, my interest as well, you know, in a long term,
you know, view, this city needs more residents that are going to become permanent residents that
are not, you know, not renting their homeowners, they have an investment in the city. And I know
with an abatement um the tax uh you know base kind of stays low um you know until some of those
start to phase out um but when we look out on a longer term horizon um as these tax abatements are
expiring um the city will generate more tax base which should help um you know address some of the
issues with our streets um with some you know maybe trash collection issues and you know some
other things happening that i'm sure are a great concern for all of us um you know in the community
so um you know again that's on more of a long-term horizon um but trying to to keep some of that view
as well, because I think that that helps us all keep our intention, you know, a little bit more
pure, you know, when you think about what is really, you know, what is really good for this
area. Also, Mr. Matt, you know, you know, kind of mentioned this, and I would like to echo that as
well. The density that multifamily units create in this city, you know, extremely important as
we think about supporting the local small businesses in our vibrant community, you know,
tons of local family owned. Mr. Faber, I, I apologize for interrupting you. I appreciate

there's drug use in them transit people walk through all the time I see them disappear into
the vacant lots who knows what they're doing I've heard of people going into vacant lots then they
go to the house next door and break in through the backyard it's just it's a mess so the more
this neighborhood can move forward progress bring new people in that's what makes a neighborhood
great right you want different kinds of people um and uh that's just better for everyone so i don't
really see any harm to a long-term vacant lot being developed it's condos so it's going to be
people who are invested in the neighborhood um it's going to reduce crime uh in that immediate
area. And to the point of parking, I totally agree with what the gentleman before said.
My view is you live in a city. I mean, if you're so concerned about parking, you know, there's a
great state called Delaware where you can park wherever you want with no trouble. So, you know,
move out of the city if it's that big of a concern. I don't get it. It's South Philadelphia.
It's not about parking. It's not the place to live if that's all you care about. So I just
wanted to add you know it was most understood i've lived here 75 years so i'm very familiar with that

um um yeah i don't know what else we we could tell them in terms of um you know this would be
a he specifically said this would be a a condominium for sale unit building as they as
they requested not that that's a zoning issue because it's not but um yeah and he explained
and everybody there who came out that night supported the uh the application so
So they didn't really, they just took no position.
They didn't oppose it.
They just took no position with respect to it, despite the overwhelming people.
They did make a point of eight of the people happened to be renters and not owners,
but I don't know that you can make a distinction between somebody who rents
and somebody who owns.
I don't think that's a proper distinction to make either.
So, again, there is no, they had some concern about developers developing multifamily structures in the community, but they did not come out and say they opposed it either.

It's currently a vacant lot.
It is between two existing structures and the proposal is for to construct a new two
unit structure on the lot. Our only refusal was for use as the board is well aware, you are not
allowed to have a two-family household living in RSA 5. This was our application for appeal.
As it's important to note, again, this property was remapped in 2019 in December. Before that,
it had been RM1, which would have permitted multifamily by right. There is other multifamily
nearby. 5037 Florence is a three-family, which was recently renovated. 900 South 51st Street
is a new construction multifamily. Also on this block on 52nd and Florence, 1000 South 52nd Street
and 1004 South 52nd Street are also multifamily, in addition to 1016, 1028, 1032 South 52nd Street.
So as such, and given the direct relationship to the commercial corridors, 51st and 52nd Street,
we proposed two units. We met with the community on, I think it was November 17. Here's the tax
on, I think it was November 17. Here's the tax clearance. There's a balance and we actually
clear.
had it paid as you can see. So we are in good standing tax wise. Here's our deed. Again,
this is the site here. There's RM1 in the corner and CMX2. So we do believe that the
area can support the extra density. And here's photos of the lot. Obviously, this is an infill
development site. Given sort of also the depth of the lot and the size of these buildings, a
brand new new construction single-family home would sort of be out of character and sort of
out of the price point that's currently available in this area. There's not a whole ton of new
construction, so this will add additional more affordable units to the neighborhood. We met
with the RCO, which was the 51st War Democratic Executive Committee on November 17th. There was
no major objections at the meeting. It was actually a really productive meeting. However,
unfortunately, we were unable to get them to issue us any sort of a letter one way or the other.
Mr. Benjamin did apologize for that, but I wasn't able to obtain anything from him yesterday or the
day before when we spoke. We sent out 137 pieces of mail. And again, we're looking to just do
two units on the site. I want to pull up the plans for the board as well. Again,
ground up new construction, two units to provide more affordable housing. We'll be setting back
the third story given this is a two-story block and the only refusal we have is for use. No
dimensional variances are requested. I don't really have anything else for the board. I do
have the owner on the line if I could just have him swear or sign in and adopt my testimony and

My name is Meredith Ferliger with Dilworth Paxson. I am here today on behalf of SAM Development LLC,
the owner of the property that is represented here today by Adam Perlman. Now the request,
oh let me share my screen of course.
Okay the request before the board today concerns a recently constructed building at 3965 Lancaster
Avenue in West Philadelphia that I do have up on the screen. Although the request today is a common
one, we do come to you today without the support of the community, the councilwoman, and I also
the councilwoman, and I also suspect without the support of planning. So to that end, we do need
suspect without the support of planning. So to that.
to provide some detail to this request, which I hope the board will see represents a true and
considerable hardship to my client's property. Now, the board should have an exhibit packet
with 20 exhibits that I'll refer to throughout the presentation. I'll start first with some
background and then I'll ask my client and their representatives to assist with the rest of the
presentation. Now, as the board can see in the plans that I've provided at tabs four and five,
four being the site plan, five being the building elevations, as well as the permit history at tab
12, this building recently completed by right construction as a 10-unit residential dwelling
building with a large, nearly 2,000 square foot ground floor commercial space.
Meredith? Yeah. I hate to cut you off. Is there any way that you can make your picture a little
larger? Yeah, sure. I mean, let me switch to the next view. Is this a little better? That's better.
Thank you. Okay. If you refer to the aerials that I've brought up on the screen here at tab 8,
you'll see that this building sits at the busy convergence of Lancaster Avenue, North 40th Street,
Haverford Avenue and Mount Vernon Street. If you refer now to the zoning map that
I'll bring up on the screen as well, the property is zoned CMX2 and is
surrounded by other properties either zoned CMX2 or RM1. Now the initial
zoning permit for the development was issued in October of 2018, over two years
ago at this point. We're coming before the board today to request a variance to
permit SAM to convert the ground floor commercial space into four one-bedroom residential units,
each roughly 500 square foot or so, give or take. These units would be similarly appointed to the
recently constructed units, which I'll just briefly show you here. And this is tab 12 here,
so just so you get an understanding. Obviously these are brand new units that were just built.
Now, with respect to the application, we did receive two refusals.
Because the property is zoned CMX 2, the ground floor commercial use is required.
We also received a refusal for the proposed increase in the number of units.
Now, we do submit to a considerable hardship here that we'd like to take you through.
In addition to some other factors, the timeline is critical to establishing our hardship.

Thank you. Now, as I mentioned, the zoning permit for this development was obtained in 2018.
I'm going to take Adam through a description of their efforts of leasing the space over the last couple of years.
Now, Adam, when did you first start attempting to lease the space?
I started talking with commercial realtors almost immediately.
um a couple different organizations uh compass jg caldwell banker delphi um just to to have them
without signing an exclusive listing agreement just have them gauge interest from potential tenants
um and that was back when we purchased the property in february of 2018 okay and
And what were some of the measures that you used early on to attempt at leasing the space
once you did get more into the formal end of starting to lease it?
So we kind of left the space as an open shell, but we designed it for a potential restaurant
tenant we have a three foot by three foot exhaust shaft going from the vacant commercial space up
the vacant commercial space up to the roof. We had PGW stub in a commercial gas line
to the roof we had pgw
for a potential restaurant and we installed all storefront windows and left the space vacant
so that a commercial tenant could have a custom fit out. We offered $250,000
dollars for a commercial fit out to any tenants. And we've just, we haven't seen any interest
in over two years. Okay. And, and did, you've answered a couple of my questions in, in your
testimony. Did any of the prospective tenants where you did have any interest, did any of the
prospective tenants give you a reason that they weren't interested in your space?
No one provided any feedback why they didn't follow through with their interests. We had a
couple different types of tenants. We had office space, daycare, restaurants.
um no nobody said anything about the space or the rents when we asked for business plans or
formal letters of intent nobody ever followed up okay thank you now before i move on with adam
our first hearing before the board was originally scheduled for sometime in september for this case
now as a result of the community meeting and discussions with the council office
we agreed to request a lengthy continuance to allow Adam and his team to tap into additional
community resources that the Councilwoman graciously provided to us in seeking to find
a tenant to rent the space. Now in particular, the Councilwoman's office put Adam in touch with
five area business organizations. These included Lancaster Avenue 21st Century Business Association
CDC, Mount Vernon Manor CDC, the Enterprise Center, West Philadelphia Financial Services
Institution, West Philadelphia Corridor Collaborative. Now, Adam, did you end up
contacting all of these organizations? Yes, I emailed and called every organization
and followed up multiple times.
I did receive a few responses,
but nothing ever actually came to a potential viable tenant.
We heard there was some interest from different restaurants.
We heard a bank might be interested.
We were willing to pursue any commercial tenant.
We just never actually received any interest.
Okay. And did you also try and work with the RCO that had been assigned to us for this, which is also a business-oriented group, People's Emergency Center?
Yes. We spoke with Kevin and James and Dante at the RCO meeting.
I met Dante at the commercial space probably a few days after the RCO meeting where we decided to delay the ZBA hearing for four months.
Dante toured the commercial space with me and the rest of the building.
We discussed potential tenants, and I followed up with Dante a few times.
he he was trying to find tenants he said he had restaurants that might be interested or
different grocers that might be interested a bank that might be interested nothing ever came from
that I emailed and called Kevin and James multiple times Kevin's voicemail wasn't available but I
left James a couple voicemails I was never able to get in touch with Kevin or James okay now the
I did include a record of the fairly extensive email correspondence that Adam referred to
at tab 18 of my packet. And you'll see if you had the ability to review this history that
Adam had continuous follow-up with all of these organizations over the course of the last
four months. Now, Adam, before I move on, I want to make this clear. What was your intent for the
space when the structure was first built and approved? We 100% built this space for a commercial
tenant. It's currently a shell that's roughed in for a commercial bathroom, a commercial space with
floor drains, gas line, the duct shaft going through the building.
the duct shaft going through the building. We designed it with these storefronts to be a
commercial space facing a busy intersection. We really had every intention and every hope of
finding a commercial tenant. But at this point, it's pretty clear that after two plus years,
we we don't have any interest and and there's no sign of any interest that we're going to find a
tenant it'll be difficult to try to convert this into a residential space and it's unfortunate that
there is no commercial interest but at this point we really don't have any other options
than to file for this variance. Thank you. Adam Feinstone if you can get yourself unmuted now.
Meredith, before you go any further, the photo that you have and what we're looking at now,
is that the current condition of that first, that ground floor?
Adam, can you see the screen here? This was a photo from the listing. It shows the shell
condition of the commercial space. The commercial space is cleaned out. The walls are all painted.
it's a vanilla box. The floor is stoned so that we could rough in plumbing so we didn't pour the
slab in here but the the shell is in a standard commercial vanilla box.
Okay so you haven't begun any, and correct me if I'm wrong, any partitions that would
basically reflect what you're requesting. You haven't divided the ground floor
into what would, if you were approved, into the four one-bedroom. Is that correct?
Correct. It's a complete open shell right now. Okay.
We'd love to put them in. And my other question is, what is the size of the one-bedroom units
your your your proposal let me let me bring up we we did put together just a basic schematic floor
plan um so the units would vary from 471 square feet 490 514 508 and mr chairman i am going to
have adam um talk a little bit about where those sizes came from a little bit later in the
presentation okay thank you um adam finestone are you unmuted ready to talk

board, what is your involvement with this particular property? So I've been trying to
lease out the commercial space now for two plus years. I've helped various friends and other
business owners get in to their current spaces. And I've had it listed for sale and reached out
to my whole sphere for really two years trying to find a commercial tenant. Okay, so let's just
back up for a minute so how would how would a space like this typically be marketed what what
would if you were of course retained to lease this space what efforts would you typically use
to go about leasing a space like this um banners which was put up um we listed it on the multiple
listing service um and sent out to every agent in the philadelphia area philadelphia and suburb area
Okay. And when was it first listed on the Multiple Listing Service?
I believe it was almost a year ago.
Okay. And members of the board, I do have a copy of that listing up on the screen right now.
This is reflected at Exhibit 10.
Now, how would you typically set the price of a commercial listing like this?
Sorry, you're breaking up. I'm in the car.
and how how would how would you usually go about setting the listing price of a commercial unit
like this um so we looked at at numerous um commercial spaces that were currently rented
out in the area and pretty much based that on a price per square foot um and what what kind of
amenities and what really the owners would do to this space um for the for the next tenant
and based on that just a couple of the spaces like the um the space right next door with the
i think it's the hot dog place i mean they're paying i it's like i think it's around two
I think it's around $2,000 a month, made like 800 square feet.
thousand dollars a month they have like 800 square feet so this is about two thousand
So this is about 2,000 square feet, plus the fact that the owners were willing to put in a quarter million dollars to a business.
That's where we came up with the $4,000.
So you would say, based on your experience as a realtor renting commercial spaces, that this space was competitively priced?
It was not overpriced for the area?
Yeah, especially the fact that they're willing to put in a quarter million dollars to make it a space.
Most landlords would not be willing to do that.
Now, it would be easy, of course, to argue that SAM's troubles here were somehow related to the COVID-19 pandemic and that they should just be patient.
But the information that we would have would suggest that the challenges here are not solely COVID-related and that there are other extenuating factors unique to this property that do contribute to the hardship that we're here today for.
Adam Feinstone, so is it correct that you also took a look at some other listings in this immediate area before the hearing?
Okay. And over what periods of time did you gather leasing histories for?
I looked at anywhere from three months up to about a year.
Okay. And what geographic area were you looking in?
I just looked within a half a mile of the space. I didn't really want to go further out because then you get into different neighborhoods and everything else and things change dramatically.
Okay. And when you looked at the leasing histories for this area, what did those leasing histories show about the ability to lease a commercial space in this area?
it showed so there was over the last year i believe there i don't have it right in front
of me but i believe there's been like nine spaces like this available five of which were rented
um and there's still another four available um i know did the three-month history show
additional evidence that there is commercial viability in this area honestly not really
um and i've talked on top of that i've talked to a lot of other people with small businesses and
i've brought them through trying to think of other ways trying to maybe even turn it into two
two spaces two commercial properties trying to team up people um and just no one thought it was
viable for what for what they wanted okay and it wasn't necessarily the space it was really just
more of the location. Okay, but again, just getting back to the potential argument that this
is a COVID-related problem, did the histories that you look at, did they show that there have
been commercial spaces that have been leased while the COVID-19 pandemic has been going on?
Yes. Okay. And then one of the arguments that I expect that we might hear a little bit later on
is that, you know, the city has stated goals for this commercial corridor, which we certainly
respect. And I think you've heard, you know, Adam's goal here was to contribute to that.
Adam Finestone, if this space, if the board were to deny this variance and this space had to
remain vacant for the foreseeable future, based on your experience in leasing, what impact do
you expect the vacancy would have on the ability of other commercial owners to rent their space?
I think it would negatively impact that. When you see a vacancy, especially in a new building that
with all those gorgeous storefront windows not being leased, it probably really scares other
developers or anyone else that wants to start a commercial space. You need large commercial spaces
around each other to really kind of feed off each other. And without that, it's not viable
for other businesses to start up. Thank you. So based on this information that we've given you,
we believe we've established that SAM employed continual and diligent measures over the course
of nearly two years to find a viable commercial tenant for this space. You heard that Adam
Perlman state that even as we present to the board today, that his true preference would be
have a commercial tenant in that space. What we have not yet established is some of the reasons
why we submit this property is uniquely situated in a way that contributes to the hardship.
Now if the board refers to tab 19, some photographs here,
some photographs here, you'll see some photographs of the immediately surrounding property.

Although this property does have a Lancaster Avenue address, there's only a very small portion
of the building that actually sits on Lancaster Avenue. So if you look at this photo, you'll see
the hot dog place, you'll see the church right next door. Really, the only portion of this building
that sits on Lancaster Avenue is where this door is. And even at that, it's right at the corner.
Most of the building is oriented along North 40th Street, which you can see has a small pocket park that leads to mostly residential uses, particularly the neighboring apartment complex at 611 North 40th Street that has 17 units.
There's a small vacant commercial space right next to the building on North 40th Street.
Now, if you again look at photos of this major intersection, you'll notice that it's not terribly
conducive to free-flowing pedestrian travel given the extensive street widths and the number of
traffic lights that are here. You should also notice the abundance of residential uses that
do surround this intersection, particularly some of the single-family homes across the street here
and along Lancaster. Now the heavily commercial uses along Lancaster largely commence and continue
along the opposing side of Lancaster Avenue. So should the board grant the requested variances,
the proposed solely multifamily use will harmonize with the character of this neighborhood
and will not create any disruption in the commercial block. Now the feedback that we did
received from the RCO and the council office is that Lancaster Avenue is intended for commercial
development, and we wholeheartedly respect that. However, this property is uniquely situated in
such a way that makes the commercial use here challenging and undesirable. Now, if the board
also refers to the aerial that I have up on the screen here at tab 14, you'll see a historic
aerial of this property that dates back to 2004. I was not able to find any aerials earlier than
this, so we do suspect that this condition likely is earlier than 2004, but this should show you
that until the development was constructed, the property was vacant for at least the last 15
years. I mention this only to show that by the board granting this variance, you're not taking
away from the commercial character of this area. The property did not previously have a commercial
use and the granting of the variance will preserve the status quo that's existed at least for the
last 15 years. Now before we conclude, I'd like to bring Adam Perlman back just for a moment.
Adam, as a result of the continuing vacancy, can you just very briefly tell the board
some of the implications that you've now started to face
as a result of the vacancy?
Our insurance carrier dropped the project
because I guess there's liability
with vacant commercial spaces.
So we were dropped from our insurance policy
and it took me until the sixth insurance carrier
to find someone that would carry a 10 unit over vacant commercial space and paying a significant
premium to have a vacant commercial space. Our commercial lender that provided the commercial
construction loan for the project, they contacted us in early December and said that even though
we've rented out the units up above the vacant commercial space we're not hitting our debt
service coverage ratio and they demanded we pay a couple hundred thousand dollars
before the end of the year so we had to come up with that money and pay down our our loan because
of this vacancy um it's it's it's unfortunate but it's there's nothing we could do except apply for
of variance and hope that we can get residential units in there, four one-bedroom units would rent
out in two days. So Adam, I want to just hit on that point for a minute. So when you decided to
consider converting this, how did you come up with the four one-bedroom units? What factors
led you to that specific breakdown? The high demand for the one-bedroom units, we rented up

We have two of those are one bedroom units and those leased out in the first.
two of those are one-bedroom units and those leased out in the first few days they were listed.
We received a lot of inquiries. People were offering to put down deposits for whenever
these would become available and being on the ground floor it's less desirable so these would
become more affordable one-bedroom units which are in very high demand right now two blocks away
at 38th and Lancaster they're they're asking two thousand dollars for one bed I don't think that
if we listed it for anything we wouldn't get more than a thousand dollars for one bed maybe
eight hundred or nine hundred so we would be providing the area with affordable one-bedroom
apartments for tenants. Another thing that was brought up at the RCO meeting was
lack of parking spaces. They want a busy commercial business in there, which would
take up a lot of parking spaces for more people in the area who may or may not have cars
because there's a lot of public transportation available, would not provide that burden on
the community. It wouldn't cause any hardships. Okay, thank you. So just to briefly conclude,
we do submit that these are the least minimum variances. We're not requesting any dimensional
variances. Providing a commercial use here is just simply not viable at this time, given the
lot history, its orientation along North 40th Street, the lack of commercial use on this side
of a large intersection, and most importantly, given the extensive efforts that SAM has made
with both the community and the council office to attempt to locate a viable commercial tenant
here. The additional four units will ensure that these units are within the neighborhood
context and will support additional density necessary to support future commercial viability
of the Lancaster Avenue corridor in accordance with the city's goals. We submit that the units
and lack of commercial space will not increase the local congestion given the extensive public
transit network and the availability of Simone Street parking in this area. The proposal will
not impair light and air or negatively impact surrounding properties nor will it place an undue
burden on public facilities, utilities, or cause any environmental damage. We submit the variance
complies in full with the provisions of section 14303AE of the code as it's further detailed in
my memorandum of law submitted at tab 15. Now to reiterate, SAM sincerely respects the community
and the city's goals for this area and I hope you've heard that today. As you heard, they were
hoping to find a commercial tenant for the space and tried everything that they could with the
assistance of nearly every business-oriented organization in this area. However, they
unfortunately do not have the luxury or the flexibility to leave the space vacant indefinitely.
Accordingly, we're asking the board to recognize the severe hardship and grant the requested
variances today. Adam Perlman, have you heard all of my testimony here today before the board?

The photograph you showed a few minutes ago along 40th Street that showed a commercial property adjacent to the applicants.
It obviously looks like it's closed.

Would you or does anyone could speak to whether that commercial space has been abandoned or if it's been abandoned or is it in use?
Yeah, so this is Adam Perlman. It's 609 North 40th Street. It's owned by Dr. Rizel Gebrahana. He owns a couple commercial properties around Philadelphia. He owns a couple pharmacies.
He purchased this building and turned it into one residential unit over a commercial space.
He was unable to rent the commercial space out to any tenants for about a year.
His wife opened a salon in the commercial space, and they invested a good amount of money into the fit-out.
It was a very nice salon with a good storefront, and they just didn't have enough business,
and eventually they closed, and that was pre-COVID.
uh pre-covid okay thank you you answered both my questions um excuse me

so commercial uh any questions from the board no no no would anyone else like to testify in
this case if so please raise your hand yeah here we have a kevin brown mr brown you can unmute
yourself and speak. Mr. Brown? Yes. Actually, this is James Wright, Director of Community Development
at the People's Emergency Center. Hopped on a little bit later. Mr. Wright, would you please
identify yourself, spell your full name, and provide us with your address? I'm James Wright,
Director of Community Development at the People's Emergency Center. We are contracted by the
commerce department of philadelphia to manage the revitalization effort along lancaster avenue
uh my office address is 325 north 39th street philadelphia pa 19104 we're in the firm to tell
the truth the whole truth nothing but the truth yes please proceed yep so uh noting all the
concerns that Meredith cited. I understand the list of concerns, but we have to put it in the
context of 2020. And then also you have to put it in the context of a growing corridor, which the
city's commerce department and planning department strongly supports. And then when you think about
the revitalization effort occurring for a commercial new construction property of this level
occurring at this time. It's a difficult time period, but to permanently make that ground floor
residential could set a precedent that could create a ripple effect along Lancaster Avenue
in the most densest part of that commercial corridor. The vacancy rate prior to COVID
was a little bit over 10% as compared to the rest of the corridor, which gets up to be about
15 to 20 percent but it's changing and so we've worked um for a number of years to make that effort
uh to to make the revitalization effort stronger and we're in the middle of a planning process
funded by the commerce department to read to to re-strategize the tenanting process
on the 4 000 block the 4100 block and the 4200 block of lancaster avenue so to have this building
go all residential at one of the most prominent intersections on Lancaster Avenue and in West
Philadelphia at this time would be unfortunate and also doesn't really consider the fact that
it's a hard time for all property owners. So that's really the meat of what I wanted to get
on here and just talk about. The challenges that Mr. Pearlman has experienced are felt by other
property owners because of the context of 2020. Great. Do you have any sense of when your
plan will be final? The plan will be final by March of this year. We did most of the conversations
throughout the fall, summer and fall of last year, and the planning group that we're working with
are finalizing the document by March.
We're supposed to submit that to the Commerce Department in April.
Will there be any assistance provided to property owners going forward
as a result of the plan that you guys will be putting into motion?
So in terms of direct assistance,
all the incentive programs come through the Commerce Department,
and Commerce has been realigning their strategies in light of the COVID crisis.
to really help businesses and property owners.
We don't have specific incentives with the planning grant,
only that it really helps to come up with a new strategy for how that will go.
And, you know, just off the end of last year and in the beginning of this year,
especially with the new director of the Commerce Department,
resources are all being aligned, realigned.

my probably my next question was uh i mean it's around the corner uh yeah and i'm looking at a
lot of other vacancies and i will well for the sake of this discussion i'll just contribute most
of those vacancies or assume and maybe i shouldn't assume but i'll assume that most of the vacancies
are result of covet so would even though this is not directly on lancaster this still would be part
of the Commerce Department's effort to put some extra commercial spaces at that intersection?
Yes, so it is at the intersection. And, you know, intersections are pretty tricky in terms of what's
on the corridor and not on the corridor. But that part of 40th Street is considered a part of the
commercial corridor, just like across the street, the old West Philadelphia Title and Trust Building
is considered a part of the corridor as well as Morris Funeral Home is a part of the corridor and
the parcel with the Dr. King mural as seen as a part of the commercial corridor so you know
Mount Vernon Street uh comes right up to 40th and it is really hard to separate that as you're
looking at the map that I don't know what the shape is that block of that between 40th Haverford
in Lancaster as not commercial. Going partway down Haverford is also commercial. The businesses
on the north side of Haverford Avenue, the 39 Spotify Avenue, are commercial.
Tom, I interrupted you. I just want to, I think that's where you were going, but do you have
anything else? Yes. Lancaster Avenue is pretty much abandoned. It's being developed, but it's
abandoned, but you would have to get Lancaster Avenue up to par before going down 40th Street.
Sir, I just want to reiterate, this is not going down 40th Street. This building sits
right at the intersection. It is no more than, it starts at the corner, and it goes no more than,
is it 30 feet past the corner? Not even to the end of Mount Vernon. That's not a full block.
It's totally visible. If you're standing, if you're standing west along Lancaster, as far as
the seafood restaurant, you can see this building. It's very much a part of the commercial corridor,
visibly, physically. It's right there. A very beautiful construction right at the corner of
40th and Lancaster. I understand, because I eat at Texas Wheaton all the time.
I would ask you, what type of businesses could you draw on 40th Street?
You said, could you draw, or did I draw? Do you project?
Well, again, I think it's unfortunate characterization of this property as being
on 40th street is definitely a lancaster avenue property you go to texas luna so you understand
it very well it's on lancaster avenue it's connected to the corridor the types of businesses
that people are looking for and we have to really think about the covid crisis and how
business environments are changing but given the level of construction that has been done you got
to think that this will be um in terms of when a new business comes so whether it be a takeout
restaurant or an office retail business we're getting a lot of feedback somebody's mic is on
and there's a lot of shuffling going on hard to hear Mr. Wright thank you yeah Mr. Wright continue
I'm sorry. Yeah, so it's as the corridor revitalizes, this building sets the precedent
for what we want it to become. As we approach other developers to look at renovating parcels
or building out on vacant lots along the corridor, this is a prototype. And so for it to go
residential on the ground floor will set a bad precedent for the trajectory. And so, and also
it's really hard to deny that this is even the way the building is situated it looks and feels
as if it's a corridor commercial building the facade is entirely open to the commercial corridor
and it faces lancaster avenue more prominently than it does 40th street um this is adam perlman
than it does 40th Street. This is Adam Perlman. Mr. Wright, if I could just interject. I really
do want to see all the best for the Lancaster Corridor, but we're talking two, five, ten,
twenty years. There's nothing concrete. All the potential businesses that could be in this space
have all looked at it. No one's shown any real interest. The intersection for the last three
years as i've been involved in this intersection is four or five churches three parking lots
a funeral home a beer distributor um and then two restaurants the texas we go the street
the other restaurant um quality they they do well but there's so in the in the in the last
five years and in the last five years hold on Mr. Wright just let Mr. Perlman finish and we'll
come right to you thank you contacted by developers who are looking in this area and
looking at this intersection constantly and I don't tell them that I'm facing financial hardships
I don't tell them that my insurance carriers dropped me I don't tell them that my commercial
lender has told me that this is a distressed asset. I tell them I have high hopes for the
intersection and high hopes for the area, but I haven't found a commercial tenant in over two
years. And people want to build across the street where the taxis are parked. People are trying to
build up near 41st and Lancaster and west on Haverford, and they can't do it where there's
a commercial requirement and they call me and i and i tell them i don't have a commercial tenant
because i can't find one but i i think the area is gonna it's on its way up i think university
city's expanding but it might be five years it might be 10 years but after two years i i can't
carry this burden on on this project anymore i don't this is my only project this is my only
commercial project. I've spent the last six years volunteering in Africa and India and the Bronx,
New York, and I am a small business owner and my small business is failing. And converting this to
residential will save my building and it will help the commercial corridor. It will not hurt it. But
a vacant commercial space sitting here with developers constantly calling me and asking
why is it vacant isn't going to help anybody. It doesn't have to set a precedent. It could just be
the start of the commercial corridor, moving past Haverford, up Lancaster.
Mr. Wright, I'm sorry, did you want to respond?
Yes, I appreciate the work that you've done overseas. It's very admirable. Some of that
same kind of work is happening on the ground in West Philadelphia. It has been happening for a
long time with all the different groups, civic associations, community leaders, nonprofit
for employees that are giving up the same kind of blood, sweat, and tears that you have
overseas in this community to ensure that it comes back in the best way. 2020 was a really
difficult year, and I understand what it means to own commercial property and have to manage assets
in a difficult situation. We own the commercial space at 3945, which was, again, vacant in a
similar way for three years just because it is challenging, but we were able to get a business
in there that has managed to maintain through COVID across the street at 3950 is a new bike
shop that is thriving.
The old West Philadelphia Title and Trust, the beer distributor business that you cited
was in the middle of rethinking their strategy for how to work with a new community with
students and young professionals coming in.
That property is sold to a new developer who's interested in transforming it.
Then, of course, 2020 happened.
The Quality Taste restaurant opened up a second storefront, and as you noted, they're doing well with two separate storefronts right at that intersection.
Tiny WPA at 4017, which is also a PST property, is also doing well, just two or three storefronts down.
So it's difficult, and it's a hard environment, but there are businesses that are successful.
And if you think that putting residential on the ground floor does not damage a commercial corridor,
that is counterintuitive to the planning strategy that the city has employed, that the Commerce Department has supported.
And that's just the honest truth of it.
And that's just the honest truth of it.
Let me ask a question, Mr. Wright.
But let me ask a question, Mr. Wright.
I guess it's a question for both Mr. Wright and Ms. Felliger.
Meredith, you mentioned early in your presentation,
the Councilwoman Gautier's office had suggested to your client
to seek some assistance as it relates to potentially getting tenants
with a number of organizations.
And you may have said this, I don't recall.
was Commerce Department one of them? The Commerce Department was one of them. I believe Adam did
reach out to them and similar to the other organizations that he contacted, that nothing
came to fruition. So some of the incentives that the Commerce Department has is for businesses
coming into places like this. And so they have a program called InStore, which would give a
business owner up to $50,000 to do a fit out at that spot. They also have a facade improvement
grant, which because this building faces the corridor, it can apply for multiple addresses,
not just the one on Lancaster Avenue. Commerce considers is a commercial building. And then
there are other, as Meredith said, as you said, there are other institutions like the
Merchants Fund or such which would support a business that chooses to locate here. It
is a challenging year, so businesses are probably making tough decisions on where they can locate,
but when a business comes to this location, there's upwards to about $75,000 that they could
apply for and potentially receive via the Commerce Department. And Mr. Chairman, you know, just to
reiterate, Adam mentioned they offered a prospective tenant $250,000 towards the fit-up space, so,
You know, this was not a situation where a business just simply did not have the resources to pay for a fit out of the space.
I mean, they went above and beyond to try and encourage.
I hear that and I respect that.
I just was curious to what extent the conversation took place between your client and the Commerce Department.
Everybody wants the best thing to happen.
And your client, obviously the city and Commerce Department.
I know they have a new commerce director who has been very, very helpful to try to get these things moving along in the city.

Good afternoon, Andrew. Please identify yourself with the record and I'll swear you in.
Good afternoon. Andrew Goodman, G-O-O-D-M-A-N, representing the Office of Third District
Councilmember Jamie R. Gaudier. We're in a firm to tell the truth, the whole
truth, nothing but the truth. Yes, I do. Thank you, sir. Please proceed.
Thank you. So I'm here today on behalf of Councilmember Gaudier, who strongly opposes
the variants being pursued today and ask that the ZBA deny this application.
We are certainly aware of the justifications that the applicant is making today, and we're
not here to challenge any of those.
I think we can all acknowledge and agree that we as a society have faced significant amounts
of crises this year, and I think it's important to note the incredible amount of duress that
has been placed on our service provider organizations as support or financial relief comes and goes
from various levels of government. These are the same organizations that are tasked with doing the
city's work of helping businesses with much less financial wherewithal, avoid closures and
insolvency. So I want to offer that as some context for the service providers that we made
referrals to as just like all of us, we are rolling with the punches as, you know, as this
public health crisis continues. We would like to assert that not getting a new business to pay
$4,000 a month in rent during a time like this should not be sufficient grounds for granting
a long-term multi-decade decision on one of the oldest commercial corridors in the city's
history. We were not privy to some of the exhibits of the applicant. The listing that
we saw, at least previously, did not explicitly reference the $250,000 that's being referenced
today, though I know it's been spoken to. And just looking quickly at what was shown
on the screen. The only other comparable I could see was a couple blocks away in kind of a denser
higher market section of University City that was offering rent at $1,200 less per month.
So just if we're talking about what going rates are, I think there is a sufficient case to be
made that $4,000 per month would not be that. And then want to iterate again or want to reiterate
And then want to reiterate again or want to reiterate, given the physical orientation of the building, we all know that many of these commercial corridors run on diagonals because of their history as predating the city grid.
There are probably hundreds of these sorts of sites that interact with diagonals and still find a way to be viable, and one directly across the street from this property has already been referenced by previous testimony.
So setting a precedent like this that this represents a physical hardship would be very troublesome, not just to Lancaster Avenue, but many other diagonal corridors across the city.
Lancaster Avenue was here before any of us were, and it will be here long after we are gone.
one. These corridors are crucial spaces for commerce, economic opportunity, and public
activity, and their importance and the importance of these visions and plans overrides the interest
of any single individual in any neighborhood or citywide planning process that relates to
Lancaster Avenue affirms this. We certainly share the application or the applicant's disappointment
in not having a tenant yet, and just like the rest of us, we ask that they weather the storm.
As far as we know, the rest of the building is operational and occupied, so we would dispute that this claim makes the whole building itself somehow unviable.
And given the stressors on the Philadelphia business community right now, we believe that there are very logical, rational, understandable reasons why we can look forward to greener pastures in 2021 once public health restrictions are lifted.
And I would also affirm Mr. Wright's testimony about the growth of the corridor and the horizon that it's on.
The idea that because something has not been successful recently means that it can't be successful for the next 20 years is very alarmist.
And further down that same block, the 3,900 block, we can see new businesses coming online in the last year or two years.
And so we agree that this sets a dangerous precedent, even if that is not the intention
of the applicant or of this board.
We know that in practice, we get in the district variances like, variance requests like these
at least once per year.
So while maybe unintentionally, we know that future applicants will cite what happens this
afternoon as grounds to poke holes in a commercial corridor.
On behalf of the council member, I thank you for your time and ask again that the ZBA denies
this variance request. Thank you again. I respond to the last part of your testimony, Mr. Goodman,
is that people say to us as board often, if you allow this to happen, it's going to set a precedent.
Generally speaking, probably the overwhelming amount of times we hear cases, we look at each
case on an individual basis. And before you go, Meredith, I just want to ask Mr. Wright, I don't
to put the burden on you but you do work in a department that the city relies on do you think
there's any value in a further any further conversations with Mr. Perlman since Mr.
Perlman has testified that he was willing to fit out this first floor a tune of two hundred fifty
thousand dollars is there any opportunity you think for a further conversation uh between your
office, maybe not you necessarily, but your office and Mr. Perlman to see if they're, I'm not sure
a lot of people out there know this. I mean, we understand what Mr. Feinstein did when he put this
out on a multiple listing, but you guys in the Commerce Department, you're on the ground floor
and you know what people are looking for in terms of assistance when it comes to either opening
business their business or continuing to operate their businesses yeah i certainly think there's
value to uh continued conversation especially given uh the additional resources that have
um come in at the tail part of the year the year um also considering the work that the council
member's office is doing around west philadelphia commercial corridors in general uh given the
difficult year. And just in that, because we are reaching some sense of normalcy,
business owners are more likely, entrepreneurs are more likely to seek out storefronts than they
were at the top and in the middle of the year. I don't know if this question's been asked, but
Are there any prospects for commercial?
No, that was Mr. Perlman's testimony.
And that's why, again, I wasn't sure if Mr. Wright and or Mr. Goodman,
I think he testified that they weren't aware of the offer that's being made,
The offer that's being made, the financial offer that's being made by Mr. Perlman, that may change the equation to a potential commercial operator.

I don't know. I'm not saying it will definitely, but that is a significant amount of money to be offered as a startup for any business.
We had this conversation back in September with Mr. Wright.
We said that we would be willing to fund the fit out.
But Mr. Wright is willing to continue this conversation.
And with respect, Mr. Wright, you never answered any of my phone calls.
You never returned any of my voicemails.
You didn't respond to my emails.
And if I could just respond to Mr. Goodman and Councilman Goddard.
I'm sorry, Adam, did you speak to my staff member, Dante Leonard?
On everyone's screen right now, they see the Chosen 300 church is adjacent to my building, 3965 Lancaster.
The councilwoman is in support of residential use of a CMX2 property at the Chosen 300, but she is strongly opposed to the adjacent property, 3965 Lancaster, having residential use on the ground floor.
So those are, it's contradictory statements coming from Councilwoman Gaudier's office to not allow residential use on the ground floor of one property and then strongly support it on the adjacent property.
And Mr. Wright, I did speak with Dante. We met at the property. We walked the property. We probably spent over two hours there together talking about the Lancaster Commercial Corridor, ways that I could assist any project that you guys have on the corridor.
um i received no no responses i received no any leads for any potential commercial tenants
and it's been over two years it predates covid and it will post date covid it's this is not a
covid issue i i can't have a vacant commercial space for another two three years i'll lose my
building if he wants to rent out uh so all right Dante Leonard because Dante is the commercial
corridor that works under me and I know that he has been in communication with you so I just wanted
to refute the charge that you haven't been in contact with PEC maybe not me directly but you
have been in contact with PEC and so gentlemen gentlemen this is this is a new day this is let's
put the things of the past as much as we can behind us. Mr. Chairman, 30 seconds please. I just
again you know specific to the point of the precedence again we have to prove a hardship
unique to this property and I believe that we have gone above and beyond to do that today
And just again, turning back to the map here, if you are on North 40th Street on the east side of North 40th Street and you continue along, you have this property, you have that small one that Adam talked about being a vacant ground floor commercial, and then you instantly hit RM1, a 17-unit apartment building.
So, again, just to refute the notion that this building is intimately contributing to the Lancaster Avenue corridor, again, I can't stress enough that I believe that we have established the unique hardship to this property in a way that will not set any negative precedent if another property is to come to you in the future.

development for at least 30 years, as I know of, and it hasn't gotten much further than it is now.

I'm just want to like I'm suggesting that we give this a few more weeks for the applicant

so our understanding of the application two doors down is that the ground floor at least is still
remaining social services and you know i don't think it's that particular address that is up for
review today but if the applicant here today is interested in a non-profit or social service use
we understand that commercial does not necessarily mean retail so this it is by no means the building
two doors down is by no means being converted into apartments or anything like that not fully
you mean part of part of others i think their proposal is for an overnight facility in the
basement all right well we'll deal with that when we get to it but in any event uh i i know there
are other people who like to speak and generally we allow them but we're an hour and an hour and
15 minutes into this case, we have numerous cases to go. So I'm going to suggest that
Sharon, I don't want to close this. I'm trying to figure out a way which we can allow for at
least 30 days of conversation to go between the Councilwoman's office and the Commerce Department.

know that i heard it but sometimes when people come in front of this board and we're about to

and i don't know if there is in this case but i think i'd like to allow for that to happen

So I don't know how there may have been confusion, but I just wanted to reiterate that our records and the ZBA's records have them all for 2 p.m. today.

yes all right so what you'll see before you is a rendering uh for and let me just make it a little
smaller for uh 100 for 100 102 west of olive street um as this board may remember i was here
in september of 2019 for 100 100 west of olive street we proposed two uh duplexes two two unit
condominiums with off-street parking. We thought it was appropriate under the circumstances
both the community as well as the coordinating RCO at the time, which is the same coordinating
RCO today, felt otherwise. They thought it was more appropriate to put two single families there
with off-street parking. We could not come to an agreement at that point. We had the ZBA hear that
presentation, and that variance request was denied. That's the basis for 100 and 102. The
only difference with respect to the refusals is that we eliminated the use refusal. So this is
something the community wanted us to do in September of 2019, and that's why we're back
here today. As far as a 31 Duval Street, it's more in line with exactly, I mean, it's in line
exactly what they want in terms of single-family use. So we're not asking for use variances,
we're just asking for some dimensional variances. And I'll go over each refusal to show
what the refusals are. Here's our table of contents. Let me just make that a little bit
smaller. So it's my typical exhibit packet of eight exhibits. The first exhibit is the deeds
of the property showing that Oak Spark Ventures is the owner of the property. So they're in the
packet. I don't think I need to worry about that. After that, it's a Certificates of Tax Clearance
showing that Oak Spark Ventures is in good standing with the city with respect to the real
estate taxes do on these properties. After that, it's a notice of refusal. So the first
The first one I'm going to show you is 31 West of All Street.
one I'm going to show you is 31 west of Olive Street. You'll see this is an RSA 3 property.
You'll see this is an RSA 3 property, and you'll see that we're asking for a single-family household living.
A couple things to point out.
This block of West of All is two-story in nature.
We're actually keeping in line with that.
So we're not asking for any height variances.
And we're actually going with the roof lines for the properties on the, I guess, the zero block of West Duval Street.
Another thing to pay attention to, and this kind of goes with our first refusal, because this is an RSA3 property, technically we need parking.
But you'll see that, or you'll see in terms of pictures that we have actually in another packet, that it's not typical to actually have parking on the zero block of west of Wall Street.
And then the second refusal has to do with the side yard, eight feet required, five feet is proposed.
And again, you'll see from pictures that we've presented in this packet, most of the properties on that block either have no side yard or minimal side yard, which would not comply with the code.
So that's 31 Duval Street.
100 West Duval Street has this first refusal, which I believe is an error because this is an RSA 3 property.
And it references additional parking regulations for RSA 5, RM 1, and CMX 2. So I don't believe that that's relevant.
The second refusal has to do with non-accessory parking. It's expressly prohibited in the RSA 3 district.
So you'll see from the pictures that we're going to show that we're using one curb cut off of Cherokee that will go so that our rear yard will have parking back there on 100.
and then there would be an easement
for 102, which is to the right of us.

And let me just make this a little smaller
just so I can kind of
venture through so this is this is 31 west of olive street as you can see this is a two-story
structure with a front porch a front porch which matches how you would see the other properties
on that block and we can show pictures brick facade and it's a two-story structure
you'll see from the site plan again we have a front yard and we have the side yard of five feet
This is our refusal. Again, there are pictures, and we can show you the pictures, where there's usually either a minimal or no side yard for most of the properties within the vicinity of this property.
Is that the length of the property?
The what? The side yard? Yes, it does. It does.
And another thing to point out is this is RSA 3, so we're required to have 50% open area.
So if technically we wanted to put a parking spot out front and do a curb cut, which the community has been against in the past, with respect to the middle of the block, that would affect our ability to meet the open area requirement for this property.
So that's that one.
And then you'll see this is 100 and 102, and you'll see here, this is, again, this is a three-story structure with a mansard roof and dormers, and this also has a front porch, as you can see, which kind of matches the feel of the remaining properties with both a mix between a stone facade and wood siding.
and let me just but what you'll see is one of the refusals trying to get up to this thing
is is here so we're we have a curb cut on Cherokee and this is 100 Duval Street and this is 102
Duval Street so what we anticipate is there will be two cars one parked on 100 Duval Street and
the other one parked on 102 Duvall Street. So technically, well, they'll be both parked
on 102. I'm sorry, 100. One is for 100 and one's for 102. And the reason why we're getting
refusal is because the parking spot that's for 102 is technically on 100. So it will
be by way of an easement. Let me see what the other refusals have to do for 100. The
The other refusal is the minimum rear depth because the parking spots are considered occupied area.

Technically, we're only showing nine feet of rear yard depth.
Well, 15 feet is required, but as you can see that these parking spots are both eight and a half feet wide.
We would technically meet the open area from an actual visual standpoint, but this is not considered part of the calculation.
And we have the same issue with the side yard, that we're proposing less than required, eight feet required.
We're proposing three and a half feet, but we're also having some nice landscaping on the side.
Again, these are all issues that the zoning board heard before.
The only issue last time was the fact of the use.
nothing else was in dispute with the community. In terms of 102 west of Wall Street, the two
refusals, the minimum side yard, we're proposing three feet while eight feet is required. And
we're technically, which again, we'll show from pictures that that's not uncommon. And then
technically, because we're not showing parking here, we're getting a refusal saying that we're
not provide providing parking for 102 west of all but we are by way of this parking spot which is
going to be an easement for the benefit of 102 i would like to show you side yard runs the full
length like the other property full length of the property uh yes it does mr chair um and these are
photos of the property so i just want to kind of go back and just get that little
all right so this is 31 west duval again you can see their porches uh you can see these are
two-story structures and you can see our property and you know 31 west duval street we're proposing
a two-story structure with a porch that fits in line with the other properties as you can see
there's no parking on for each of either of these uh to the property to the left or to the right of
us you'll see 100 102 west duval street from west duval street we're in the corner of
of Duval in Cherokee. And you'll see 100 and 102 West Duval from Cherokee. And then you'll see 31
West Duval Street, first block of West Duval to the left of the property, to the right of the
property. And as you can see, there's really no parking off street on West Duval on the first
block of West Duval. And then 100 block of West Duval, 100 and 102 from the left of the property
and to the right of the property.
And then from the 6,300 block of Cherokee,
another perspective for 100 and 102.
And then most importantly,
our refusals really go to the heart of the matter.
You know, it's my philosophy.
If, you know, if you see a building proposed,
actually built,
and it fits within the character of a neighborhood,
from a variance standpoint,
most times that is something that makes sense.
So our variance, really the focus of our variance
is the side yard and as you can see on the on the block of Duval Street or that corner there is no
minimum there's no there's no side no side yards or minimal side yards same thing over there
as well as the 100 block of West Duval as well there are nearby no minimal side yards and just
more examples then the the first block of west of all same thing and then we went through the
architectural plans now we did meet with the west mount airy neighbors association oops
and they provided two separate letters one for 31 west of all
one for 31 west of all and one for 100 and 102 west of all and as you can see from the letter
they indicated for 31 west of all that you know what we're requesting is not out of character
from the neighborhood they mentioned the parking situation that they did not want oops they did not
want to um for us to put a curb cut in front of 31 west of all uh because that would take away
on street parking as far as 100 and 102 west of all same thing the organization stated that
and they referenced that we actually met with the group um at the end of last or 2019 and that we
did propose to have two duplexes um and that their only objection essentially was the duplexes and
that the current configuration of the property, which is the same as we're presenting today,
they have no objection to now the community did object to you know our proposal for 31 100 and 102
they have no objection to. Now the community did object to
west of olive street the the actual community members it was not a well-attended meeting
as you can see from the letters there was an equal amount of people from the community as
there were from the actual executive board of the west mount harry's neighbors and i don't know if
Ralph Pincus or anyone from the coordinating RCO is on here. But ultimately, what we got was
they didn't want anything. They're like, they like open area. They don't want anything built
at 31 west of all. They don't want anything built at 100 west of all. And they don't want anything
built at 102 west of all. There was no zoning related discussions. It was ultimately, we like
open area, don't build anything. So we're not trying to get a use variance. We're merely trying
to get some dimensional variances, and we're trying to get off-street parking on the one spot
where we're taking one curb cut to create two parking spots, which, by the way, last time we
were here, this community was for it. And as far as 31, they asked us not to create a curb cut.
So that's basically what we're trying to do as well. That concludes my presentation.

I do. Please proceed. Okay. With regard to all three properties, the Councilwoman is opposing the granting of the variance based on the fact that the community in all three instances voted against granting these variances.
It was a very raucous type of RCO meeting, but the takeaways from that, you know, that were that they were very much against the roof decks, the side yard issues with regard to, you know, building too close to the adjacent properties, like at 29, between 31 and 29 and 104 and 102.
They were against the parking behind 100 that would accommodate 100 and 102 with the curb cut out onto Cherokee Street because Cherokee is a very busy, busy street.
um so you know they they came out against that that and uh the councilwoman takes in
takes umbrage with the fact that uh the westbound area neighbors uh executive board
voted for it and and is providing a letter of support when the community was uh totally against
it uh 11 members for 100 102 at uh 8 3 and 7 to 7 to uh 7 to 3 or 7 to 4 7 to 4 i have to look at
7 to 3 or 7 to 4, I have to look at the letter.
the at the letter but it was it was
But it was for 31 as well.
All the members of the executive board live in the more affluent areas of Westbound area,
further up towards Mount Pleasant Avenue and up in that area.
This is down in the lower area, and the people that were there,
even though it has been characterized as lowly attended,
you had 11 members there that were voting.
And the Councilwoman is in support of the community and what their desires are, not of the RCO board.

You mentioned, Mr. Richardson, that some of the objection had to do with the side yard and these applications, excuse me, these houses would be too close to adjacent properties?
Right. Where the requirement was for 31 is 8 feet, and they're proposing 5 feet. And specifically with 102, the requirement was 8 feet, and they're proposing only 3 feet. That's only a yard. So, you know, there was a feeling that it was too close, and that's what the Councilwoman also feels as well.
um mr knockinson could you put up a couple of those photos showing adjacent properties and
what their setbacks side yards or look like compared to what you're proposing uh yes i can
um just one sec and actually this is the strongest part of our argument to be honest i mean that's
why we're very frustrated well we were frustrated with the community and i think that even in the
the community group was frustrated with their own community in that respect because this is not the
first time we presented so this is the the 6300 block of cherokee because we intersect between
duval and cherokee and you can see there's no side yard but i'm going to go duval it's it's a it's a
it's a block of attached row houses no side yards correct yeah there's some there's some minimal
I can show you the street views as well, but this is just an example of 127 to 131.
There are none.
And then same here.
It looks like there may be a side yard, but again, if you measure them, this entire block would be nonconforming.
So that's what's the most frustrating part.
When we came here last time, the issue was just the use.
We don't want duplexes.
This is a single-family neighborhood.

And the other issue, I think Mr. Richardson said it had something to do with the third floor decks.
Does 100 and 102 both have decks or no?

there are rear decks coming out of the master bedroom and there was a discussion well people
were concerned about privacy but there's actually the property is owned by a behind us is owned by
a community garden that goes let me just take a look at the uh zoning map and that was a discussion
where we are um this this area right here i think it's like four or five properties that are by
community garden so we're not infringing on anyone's like privacy or light and air uh because
we were doing these these rear yards these rear deaths but not a roof deck and i don't know any
questions from the board no no would anyone else like to testify in this case if so please raise

That would be the house immediately adjacent to this construction, the one as you look at it here.

it's the new house as proposed on the right my house is the one right next to it
and what concerns me about this discussion is
I think some inaccuracy I mean I have not gone out to measure between each of the houses but what
you are not seeing in the photographs that the appellant has produced here
are the spaces between these twins these duplexes so for example
if you go to my house 104 the other twin on the other side is 106 there is a significant amount
of space between 106 and what would be 108 the next house over and that is the pattern that runs
down through that block. Now they are correct that there are some houses where there really
isn't a side yard so it is not consistent. I want to be clear about that but there are many side yard
areas and if you look across the street there are significant side yards between those houses
as well so what you have here is this proposal that really butts up on the corner of the block
and not only does it tower over it with that third floor it really is much closer than is
consistent with many of the yards and consistent with this that you are not seeing all of these
spaces and all of these houses really represented accurately here in these photographs uh in this
yes in this exhibit six oh yeah that is there's you can find some sections of row homes as in that
photograph but what you're not seeing are the photographs of these other properties where there
are much larger spaces and the other thing i do i really want to emphasize of of how you're being
really misled here um well i'm going to object you know yeah i mean i finish you're not going
to object i i can finish he but he can't object all right and everybody has an opportunity to
object all right so i i would appreciate if we stay factual not attack thank you so sustained
uh okay whoever please okay so there's a statement that you know that about the issue with the um
uh the decks pose a privacy issue and i don't have a big problem about those decks but
you know when the developer comes in and says well they look out onto a community garden
That simply isn't correct. And you can look at the street plan and see how there are homes there and the backyards, the space behind the houses then going on up to the block that those balconies do look over.
So I just want to make it clear that I don't think that this presentation is as accurate as it should be in representing what this community looks like.
And it's, to me, one of the striking things about it is the amount of openness that you see here.
So that's really my main point is, as you were asking about the side yard questions, that's my concern is that what really gives this area its character, which makes it very attractive area, is that side yard respect that does exist between many of these properties.
And really, that's all I have.

it's it's a you know that's a rental property and there are i think three at least three windows

you know already exists there on our side so on your side what is the side yard width
that i i can't tell you i think it's probably uh four or five feet at least
at least i didn't i haven't measured it that's just all right you know it's close it's a ballpark

that's not been represented to you guys, you know, with the presentation.
If you go further down the block on Google, you can actually just see what the, you know,
that there are significant side yards going all the way down.

because of the fact that this, you know, is being portrayed as, oh, there's either none or there's that.

property 100 making it 18 feet as opposed to 21 that that 18 feet 21 is the width of the lot not
of the building structure well what size is the structure oh the structure oh the structure for a
hundred is a hundred is 17 feet seven inches and change 18 feet it's 18 feet already all right
and the other one is the other structure at 102 is 16 feet it is 16 feet but but but you have to
look at it this is a regular shaped lot for 100 so some of it is actually more than the the here
so some of it's wider in some spaces than others because of how it curves
that's why at a minimum it's 17 is that the minimum
17 and some change you said actually i'm sorry you know what the actual they're both 16 foot
structure wide structures right here i'm looking at the site plan so 100 and 102 so it's as wide
as a little over four feet and nine and a quarter inches and then i don't know what the and then
it's as small as as three feet and four and a half inches but both structures are both 16 feet wide
okay well that makes that makes a difference okay yeah all right um
i'd like to look at this a little further i'd like to recommend that we hold this

by i-95 the overpass it's also surrounded by similar buildings multi-family dwellings
there's a four-unit building that sits adjacent to this property on either side both on the
Shackamaxon side and the Richmond Street side and across the street directly across the street
there is multi-family on the entire block we did meet with Fishtown neighbors they
asked us to make some revisions to the plans which we incorporated
and as I mentioned the changes to the plans eliminated two of the refusals so that the
The only outstanding refusal is for the multifamily, and we believe that the hardship is supported
by the surrounding multifamily uses.

As you can see, the three properties to the south of us, to the top left of the page,
are also zone multifamily, four units and three units.
The property just below that is also four units, so we're abutting two four-unit properties.
And then immediately across the street on the other side of Shack of Maxon is a series of
four-family dwellings as well.

So this is just the ground floor plan, how we engage the sidewalks, corner property,
infilling the curb cuts at the request of the community to add to on-street parking.
All four units would have separate unit entry doors, you can see them highlighted in different

You have two units at the first floor and basement with access to a common rear yard,
and then the yellow and green are entry doors to the upper two units.

two bedrooms and bathrooms at the third floor if you can keep going Don master suites at the fourth
floor with access to pilot houses and roof decks that are set back and conform to all the
dimensional requirements of the district next slide so that just brings you to the exterior
so that just brings you to the exterior elevations as thought had mentioned at the request of the
elevations as Don had mentioned at the request of the community
community group we removed the parking from the rear yard made that accessible to the tenants

and introduced the fence there and we decreased the size of the pilot houses
by sloping them they are set back so they wouldn't be visible from a pedestrian right away
anywhere and then we changed all the facade materials to be

in all material respects. So here I have a packet of exhibits, which includes the deed,
certificate of tax clearance, notice of refusal. I also have certificate statements and rental
licenses, application for appeal, maps, photographs, plans, as well as the letter of support, as I
mentioned earlier. So here I have the deed for both properties, 2011 and 2034 North Woodstock,
showing that it is loaned by Fifth Investments, LLC, the transfer tax certificate,
certificate of tax compliance for 2011 North Woodstock, 2034 North Woodstock,
and the notice of refusal, certificate statements, and rental licenses as well.
So this is a peculiar instance where this property is currently a duplex,
and we're simply looking to legalize it. So for all intents and purposes, when we received all
of our documentation from LNI, it shows that it is a duplex, the rental license as well as
the certification statement shows that it is a duplex. We tried to have this matter solved with
LNI, but in light of COVID and everything else that's happening, it has been difficult. So we
decided that the best way to go about it at this point would be through the variance process. So
the only refusal that we do have is for the fact that it's a duplex which is already what LNI has
deemed it to be and we're just looking to legalize that use and it's the same refusal for
2034 North Woodstock as well. So here I have the certification statement for 2011 North Woodstock
showing that it is the two-family dwelling and I also have and this is from 2016, February 19,
2016 to be exact. I also have 2034 North Woodstock also to family dwelling dated to February 19th,
2016. So dating back to 2018, the rental licenses that were issued by LNI also stated that the
number of units were two. So as you can see here, this is from 2020, 2019, 2018, and 2017,
all for 2011 North Woodstock and then 2034 exact same situation goes back to 2020 2019 2018 and
2017 as well all stating that the number of units is two and this one is also for 2016 for 2034
North Woodstock so I also have the application for appeal this one's for 2011 North Woodstock
our notice of refusal for the two-family use which is already in the property we're simply
trying to legalize it again we've had issues dealing with this through lni so we're seeking
to go through the variance process as the path of least resistance

this is the presentation binder or evidence binder which contains table of contents exhibits aa to
A10, current statement, this project is a large vacant lot, used to be used for automobile
vacant lot. It used to be used for automobile storage and repairs. It's a
storage and repairs.
blend of CMX2 and i2. On the phone with me is the representative of the
applicant, Joseph Gitterman, as well as the architect of record, Rustin Olwer. You
can see the zoning designation is CMX2 and i2. You see the duration of the
somewhat odd-looking lot, you'll see it's about 50-50 split between the two, and that split has
resulted in some refusals. Refusals are dimensional, height 38 feet, as well as we're requesting 39
dwelling units, and in the CMX2 zone, only 25 would be permitted, but as I said, we're in a blended
zoning district area of CMX2 and I2. We did meet with both the 34th Republican Ward and the 34th,
excuse me, 37th Ward, and they looked at the project. In fact, we had two or three meetings,
and this is a letter of support. There's also discussions with the community group
about a community benefits agreement, and that has been resolved, I believe, to the satisfaction
of the community group. This is a summary sheet indicating that the vote was 9-0 in favor of the
project. So here is the site plan, well, aerial view, excuse me, of the plot. This is Dolphin
Street, A Street, and the street that runs on an angle here is Germantown Avenue. So the idea is
to have residential in this area on the larger piece and the little area that's jotting out to
or jotting out to Germantown Avenue. The first floor is going to be commercial because Germantown
Avenue is a commercial corridor and above the commercial unit on the first floor will be
additional apartments. The commercial space is about 1,200 square feet or so.
We do have some changes to the plans that have to do with the facade and the egress wells.
There's actually two pages if the board looks kindly upon this proposal.
We're including some photographs of the lot. You can see it's pretty much an eyesore right now.
There's an abandoned trailer and a number of abandoned automobiles on the lot.
So the project is to have commercial in this area, as well as, excuse me, to have residential in this area, as well as residential in this area above the commercial space.
There is some parking coming off of Dolphin Street and park behind the building.

cut um didn't fit on the page but it's about i think 1900 square feet it's about 20 feet wide
the width of the entire lot. You can go to the next slide. You have your typical
upper floor plans. Mixture of one bed and two bedroom units. Same floor plan at second through

Good afternoon, board. Joe Consul here on six properties, four of which are on the 3900 block of Haverford Avenue. That's 3918-3920-3926 and 3930, one of which is on the 3800 block, one block away, 3836 Haverford Avenue, and one of which is on 813 North 40th Street.
which is just around the corner from the other five properties.
With me somewhere out there in Zoom land is a client representative of the owner, German Yakubov.
He'll speak in a minute.
These six properties are all zoned RM1.
We have four identical refusals for the four properties on Haverford Avenue.
Those are density refusals. We are allotted four units, but are seeking six units. These are all existing rehabs in properties that a client has owned and has been renting out.
uh that's these guys here the 3836 Haverford Avenue is an empty lot it is a new construction
uh the refusals for 3836 is for density and for a side yard refusal and then um
finally we have 813 north 40th street that is also an empty lot and that is new construction
the refusal again for density and also includes an open air open area refusal a rear yard depth
refusal and a height of roof deck refusal I can start with the the various layouts like I said
the four properties on the 3900 block and I'm going to have my client walk through the plans
when I, when I call him are, uh, all six, uh, six units each between four and 500 square feet for
each unit. Um, the, I think it'll make sense for him to walk through the plans. When I get there,
I'll go through the rest of my stuff.
The property at 3836 is seven units, and the property at 813 North 40th is six units.
We met with the Mantua Civic Association on December 21st.
We received the letter of support, support of the civic, and near-unanimous support of the neighbors.
We had 25 neighbors in attendance, and it was 21 to 4 and a 22 to 1 vote.
They chunked together the Haverford properties and the North 40th Street property as a separate letter.
Regarding each refusal, first off, the Haverford blocks that we're building on
is kind of a continuing project and vision of my client.
He's been building on that property.
It was previously populated with empty lot,
boarded up buildings, and other multifamily units.
It's not primarily a single family block, zoned RM1.
There is a 35-unit building on the block,
two 12-unit buildings, seven-unit building,
which was approved by the ZBA two years ago.
My client has been collecting these properties for the last 13 years.
They are utilized now as college rentals, not single-family buildings.
Based on experience and the community feedback, my client saw a need for smaller units, not
larger rentals for college students as they are now.
My client believes this is in line with what the area is looking for, and he believes...
My client believes this is in line with what the area is looking for, and he believes rehabilitation on this block of Haverford will be a boon for the city and will create market and below market rate rentals to people in the area that need housing.
I believe someone spoke earlier today on the two o'clock docket about this area and the direction
it's moving. Additionally, this will allow my client to engage private trash companies to keep
his properties clear of trash. And again, he'll speak to that when I call him in a minute.
um regarding the property specifically of 813 north 40th this is a uh a block that is almost
entirely empty lots there's only one building on the block um the other properties being developed
there coincidentally are actually um being developed by my client uh almost exactly a year
ago we received approvals for the same variances we're seeking today um for the properties located
at 801, 803, 807, 811, and 815 North 41st Street. So my client is doing the exact thing
we're seeking approval of on the rest of the block. These are properties that he has in
the interim acquired on this block to continue his efforts. There's density variances for
all the properties. This density variance is for the community benefit in order to make the
units affordable and below market rate. My client's committing to making a third of the units
affordable across all the properties. He uses all private investments. He doesn't rely on any
government subsidies to buy these. He's been building using the strategy in the neighborhood
for the last 11 years. And the ZBA board, as I said before, approved this specific variance
exactly a year ago, as well as prior to that for the properties located at 800 to 804 North 41st
Street, as well as 825 North 41st Street, 609 North 39th, and 3936 Haverford Avenue.
Okay, so again, it's similar to what we're seeking today. We're not asking for ridiculous
amounts of units. There's already buildings this size on the block as well as much larger building
on the block as I talked about before. We have trash plans in place for each property and when
my client helps walk us through the plans he'll discuss it in more detail but for the properties
on Haverford Avenue each property has both access to the basement but also every floor of the
property has a trash storage breezeway that's measured out to include cans for space for all
the units which will allow tenants to store trash in the open air but on the floor of their own
property not in the basement until trash day and trash day with his private company will be three
times a week. For the remaining properties for 38-36 again we'll explain it when we walk through
the plans but the trash can be kept up kept off the street in a trashy area in the rear of the
property and for 813 north 40th there's a common dumpster area in the back specific to that
property that again will get picked up three times a week 3836 and I'm kind of jumping around
but 3836 has a second variance and that's for side yard whiff this property has
no alley. Because of that, we had no alley in the back. Because of that, we had no means
of egress for someone looking to get out of the back of the property. We made the building
skinnier to create a four-foot wide alley along the side of the building for ingress
and egress. It's not in compliance with the 12-foot side yard that us trying to create
the four-foot created that need for a 12-foot by the code. But the lot itself is only 18
feet wide so 12 foot alley would only leave room for a six foot wide building which is impractical
again there's an additional unit in 3836 and when we walk through the plans we'll show you how all
that shakes out but the property itself is actually going to be built slightly above grade so
a unit in the basement would not be below grade. I'll have my client walk through that
in a minute, too. No sleeping rooms would be underground. There's window wells for
additional natural light, and 3836 would contain a handicap accessible unit.
3836 would contain a handicap accessible unit. A 13 north 40th is identical to the approvals
or to the refusals we got from last March.
This is new construction. There is going to be a hallway leading to the back for trash storage
picked up three times a week as I said. There's an open area variance. This variance flows directly
from the same argument um for the density variance we need the space for these properties
to support the rental rates uh we're going to rent these for uh i don't think we're so far off
of the open air uh or the or the rear yard um the rear yard setback uh the entire entire building
has access to the rear yard contains access to the storage space for each unit um plenty of space for
all the folks who store their trash uh prior to pickup day and that's something that my client
will speak to. He's very sensitive of it as he's been dealing with it in that area for a long time.
The roof deck height refusal here is by virtue of roof decks being strictly mechanical. Because of
that the pilot house is not given any kind of leeway as it would if the roof deck were for
tenants use. So we have a roof deck refusal here even though it would be by right had this been
an accessible roof deck uh and again we'll walk through all the plans in a second we don't believe
this is a controversial series of projects uh we had a large rco turnout last year and an even
larger zoom turnout this year uh for the same kinds of projects on the same blocks and we
believe there'll be a net positive for the neighborhood and part of the revitalization
that the neighborhood actually wants um let me call german if i can so he can talk to us about

it would be helpful yeah so um in summary the i guess i'll talk about it in three different
groups. So the properties on the 3,900 block of Haverford Avenue, they're all six studio
apartments. We've been in the neighborhood for about 13 years. A lot of our rentals are low
income. We accept subsidies. And in order to make these units affordable, we needed the increased
density. We've been doing this for, like I said, about 13 years with the help of the ZBA. We've
gotten many variances on this block as well as the 3,800 block at Howiford Avenue to increase
density to six units. It's pretty straightforward plan. There are two units per floor. We have a
unit in the front and a unit in the back. We also have in the breezeway area there, there are no
windows. So it's a perfect place to take trash off of the Howiford Avenue side. And that's a
challenge has been a challenge for us in previous years when the building was
used as a single-family house. We had a lot of college students live there so
always be trash out front and on trash day even after the city comes by there's
always a lot of trash on the street. So these this new layout allows us to keep
the trash off of the street in an enclosed area and we're still outside so
protects the inside of the building from having a vermin or pests and we've
hired private trash pickup to pick up the trash three times a week like we have in our other
buildings. That's pretty much the the gist of these buildings. There's going to be a roof deck
and the roof deck is only accessible by one of the apartments. It's not a common roof deck for
everybody but it is primarily used for that one apartment and it will be there to access the
mechanical space because a lot of the condensers will be on the roof. So that kind of sums up
the properties on the 3900 block at Habakkuk. Joe, if you want to go to the 40th Street property?

Talk about that one. So this exact building, we actually got a variance for in March from this
Ward right before the pandemic hit. It was three identical buildings, 803, 807, and 811
North 40th, and as well as 815 North 41st Street. These are six one-bedroom buildings.
and as well as 815 north 41st street um these are six one bedroom buildings two i'm sorry yeah six
one bedroom units two of the units of the first four are bi-level there are no sleeping rooms on
the lower level only living room and kitchen both of the bedrooms are on the main level which sits
pretty high up even the lower level it was only like two or three feet below ground um so we we
We actually purchased this property from the Housing Authority this past year or last month, actually.
So we asked for the same variance that we got in March.
We met with the community back in March.
We had an in-person meeting.
We had a unanimous vote of 22 or 22 people to none.
This time around, there was one person opposing out of, again, I think 22 or 23 people on the call.
So we've had great support for these projects as well as the ones at Haverford Avenue.
If you want to switch back to the 3836.
So 3836 is very similar in design to a variance that was granted for our property that we own also at 3936 Haverford Avenue about two years ago.
This is seven units.
We have one unit that's kind of about two feet in the basement area, which is in the front.
Most of the unit, again, is above ground.
And the way the lot is slope, it's kind of like on a steep slope in the back.
So there's about a six-foot difference between the back of the building and the front of the building.
So we decided to make the unit that's in the lower level be in the front of the building
So it's only a couple of feet, maybe like, oh, I think I said two feet above, below ground.
Yeah, there's the grade.
Yeah, so as you can see, the grade is pretty significant.
So we decided to utilize that grade to have an accessible unit that's handicap accessible with a wheelchair.
And we needed to make the building a little bit narrower because there is no alley.
And that's the only property on the block that doesn't have a common alley in the back.
so we had to pretty much allow for somebody in the back units to be able to hop out of a window
in case of a fire and then escape to Haverford Avenue and the only way to do that was to make
the entire building about four foot narrower. The zoning code calls for a 12 foot side yard
which is really impractical on 18 foot lots so it means you know we only have a six foot wide
building so like I said this building is pretty much the same plan that was approved about February
at 2018 for 39, 36. And we've gotten, I think there's only one person that opposed this project
also during the RCA meeting out of 24 or 25 people that were there. I think that's it.

Also, I object to the adding additional apartments
to the five buildings, 39, 18, 20, 24, 26, and 30.
um uh i agree with uh ellen i with not having the not having the ample enough space not only that
the fact that since they have been acquiring property on this block which was back in 2008
uh their first one which being 39 18 they have brought nothing but uh trash on this block a
multitude of trash. We've been down this road two years ago, Chairman, with 3936 when Mr.
Jacopo said that they would actually change and get and provide ample enough trash pickup
for their tenants, which they haven't yet. Also, it brings on a multitude of vehicles.
Again, I can't stress enough with the 32-unit building that was approved for that brought no type of off-street parking has stressed our block to the breaking point.
Now they want to add more. Two years ago, Chairman, I'd like to bring back where you yourself told him that you would give him the approval for 3936 for three two-bedroom units with no living quarters in the basement.
And as of now, there's a seven unit that's built out past the landscape of every property on that block that exists.
And then not only that, they want to also go higher.
Actually, they don't want to go higher.
They've already built it out.
No, they're building it out now.
So all five of these buildings are being rehabbed now to the specs that has been turned down.
So somewhere there's a breakdown here.
I don't know where, but there's a breakdown because they've already building these properties out to these dimensions.
So that's my take on it, the whole thing.
And they definitely also, I like to add, that they definitely didn't get the neighbor's approval because I sat in that Zoom meeting in December, and there were only three people on that block that was in that meeting.
One of which was the recent owner of 3926, who sold their building to them, and a person that lives in 3936.
So they didn't get the approval of the neighbors, none of the neighbors.

was 29 people uh what they do is they stack the deck when they're having these meetings

these properties are indicated for residential multi-family use in the comprehensive plan
We have no objection to a multiple unit proposal on each lot.
However, we believe this proposal represents an overuse of these lots.
And as we usually do, we wanted to note that any affordability mentioned is not guaranteed if the applicant does not have an agreement with the city.
So we oppose granting these variances.
Mr. Consul, where are we on the agreement with the city on affordable?
I believe my client, German, would like to weigh in both on the previous comments by Mr. Black and the affordability bit.

So we've been in the neighborhood for about 11 years.
We've been doing affordable housing way before the city had any option for a buyout or anything.
So that's the reason we've been getting granted variances in the past.
And that's why every time we come back to the community, the community supports us because we house veterans who were homeless the day before they move into our apartments.
We take subsidies from PHA, just like the property we bought from PHA last month.
We have a relationship with them.
It's nothing new.
So that part, you know, we do without making the agreement with the city.
To make that agreement with the city would limit our ability to get funding based on the way that we get funding for these projects.
To address Mr. Black's objections, the majority of the block is owned by us.
So any neighbors that would have been on that call that live in a single family house,
I believe there are only six single family homes that are on the block that are occupied by longtime residents.
Mr. Black being one of them, you know, George and I go back to when we bought the first property on 3918 back in 2008, so I'm very familiar with him.
The neighbor that we just, that he mentioned, Ms. Sneed, 3926 Halford, who we just purchased the property from, you know, I should have asked her to come here as well.
But she supports the project because she knows what we've been doing in the community.
We've been her neighbor for, next door neighbor for a better part of a decade.
We fixed our roof, just like we've done with other neighbors on the block.
We're a good neighbor, and we've aspired to be that.
And that's why we've been on the block for the last, you know, 11, 12, 13 years now, I guess.
Time flies by.
So that's kind of what I would lean back on.
And the affordability, you know, the councilwoman's office isn't opposing this project.
But Haverford Avenue has always been a multifamily, an RM1 zoned corridor.
There are other streets in Mantua where, yeah, the whole array of blocks have been rezoned to single-family use.
Haverford Avenue is not one of those streets.

No, 3936 Harford Avenue in February of 2018 approved seven units, and that's pretty much an identical layout that we're seeking for 3836.
The only difference being 3836 has an alley, it doesn't stand the entire width of the lot, whereas 3936 does.

And just to be clear, the only variance we're seeking for the 3900 block of Haverford Avenue is a use variance.
The entire rest of the building is compliant with the code.

pay $60,000, we can't make the units affordable. Other developers get that form filled out?
Well, they probably pay the $60,000 to buy it out, and they don't make the units affordable.

on north 8th street but with a much bigger development but this one is a single row home

unit this would make it total of three units as the other two would be by right according to the
code in the design it is going to be first floor being a rather large unit with the basement and
then second floor and third floor each is a smaller unit none of these are going to be heavily set
up to be heavily dense these are relatively simple units from a design standpoint we have
again received no objection from the neighbors or the community and we would ask the board for

The property is located on a block of Walnut Street that really is, here's a zoning map over here, it's a RM1 zoning district, but the fact is that that building, as you saw, was a commercial building.
There's been commercial uses there since the building was built. The last use that just vacated was a medical health facility.
It was Health Springs that was there since 2010.
Before that, it was a Rite Aid that was there for many years.
I'm going to put up the zoning plan now.
Here's an indication of the property.
Here's the building, sufficient ample parking in the rear.
So the application, it's an R&1 residential district, as I mentioned.
The application is two things.
One is the use, which we're proposing, is Sherwin-Williams paint store.
So the use is described as the retail sales of building supplies, equipment, paint, wallpaper, and related supplies.
The use was not listed as a use refusal on the refusal,
although that's what my application stated that's what was in my appeal that's what we
put in our notice to the RCOs and the neighbors within 250 feet and that's also what we
presented to Spruce Hill Civic Association it would have delayed the case many months
to have the refusal revised so that's why I would choose to do it this way and I have a proviso
letter that would describe the use if the board would such you know approve this case with
conditions so the use we can explain the signs
as you saw I'll go back to the first picture here
there's a lot of signs there's two large signs on this elevation
One large sign here is existing
and there's a freestanding sign.
So what we're proposing for the signage is the following.
Basically replacing the two signs on the one elevation
with one standard branding sign.
Elevation facing Walnut Street had the same exact sign.
So in all, we're going from three signs, two signs, flat wall, from 308 square feet to a total of 160 square feet, 80 square feet each.

And for the freestanding sign, we're just replacing the existing panels.

And because of the zoning district being residential, you're not allowed practically any signage.
As I mentioned, we did meet with Spruce Hill Civic Association.
The use is not out of character with that block based upon the history of the property, the history of the uses, the surrounding uses, and the configuration of the property.
Also, this use, being a retail paint store, is a less dense type of use than were the prior uses, which were the medical facility.

We're here because we're asking this board to approve our request for variance to convert this matter to a three-family unit building.
It was zoned as a three-unit family in the 1940s.
My client has recently purchased the property, believing, of course, that the house was already zoned as a three-family unit.
However, when he went to get the renter's license, that's when, of course, he found out that it wasn't.
We do have a copy of the plan.
We also have, if I may share my screen.
So first, I'd like to start with a copy of the plans, and we'll slowly go through them.
So this is the basement.
The basement has, when he purchased the property, it was already subdivided with three utilities
for the electricity.
um the second there's nothing in the basement obviously but just the um utility stuff on the
first floor that is a one bedroom apartment and as the panel will see um there's a kitchen
air bathroom stove and a bedroom as well as a family unit on the second floor is a two-bedroom
apartment and as the panel see there's a kitchen bathroom two bedrooms and of course a corridor
going to the third floor that's more of an efficiency as you'll see there's a one bedroom
in the back and there's a family area in the front where there's a bathroom a kitchen and
somewhat of a dining room area now this is the plan that shows each individual floor
what it looks like and that's basically it with regards to the plans i can now if i may share

home is on Malvern Avenue, and this was the entrance to the doctor's office. If I go back
to the first photograph, and you'll see it on the floor plan, the way this home is laid out is
there's an entrance here that takes you up to the first floor, excuse me, to the second floor
apartment, and there's a door on the side that takes you to the first floor apartment, and then
the third door is what I showed you on the side, which entered into the former doctor's office.
here's the the formal entrance and this is what the doctor's office just used to look like
it's been demolished and we've told we show these photographs to the community group
because we told them it would not be commercial it would not be a doctor's office and they would
not have the foot traffic or the car traffic in and out of the driveway like they used to
these are kind of rudimentary plans but they nevertheless do depict the actual layout of the
property this is the front elevation this is the door to the second floor apartment and then there's
a side door that goes into the first floor apartment then here's that side entrance door
this is the proposed layout of the basement there will be one bedroom as i said it was formerly an
office but the intent is to convert it into residential as that's what the rest of the block
is the second floor is again a two-bedroom unit that's already existing and as I said my client
has a license residential license for this for this two-family dwelling and this is the first
floor same layout as on the second floor the zoning map here's the the lot it's it's a very
very huge lot it's I think it's about 6,000 square feet according to the OPA and again it sits
at the end of the row. I just wanted to delve into the archives to show you that the board
that in fact this was a two-family with a doctor's office and it even says here in fine print
doctor to live above. So it looked like it was an owner-occupant use on one floor and with his
office in the basement. Again here's a reference from 1988 to what the former use of this property
was. The rest of the documents are my standard documents, tax certification, application for
appeal, the deed indicating that Mr. Foster, who's on the line, is the current owner of the property
and it's his application that we're seeking to prosecute. There's our notice letters and our
certificate of mailing. So again, it's a pretty straightforward proposal, which is to swap out a
commercial use in the basement to a residential. We have the support of the community group
and some of the neighbors on the block. So I'm going to ask if Mr. Foster can be unmuted and
