I'm going to show you the pre-approved when we were approved.
This is it.
I was originally granted on September 26, 2018.
Can you guys see the page?
We do.
So start showing your photos.
Okay, go back to the plans.
Okay, these are the original plans that was approved.
We made absolutely no changes to the plans.
The plans and everything remained the same from 2008 when it was previously approved.
It's three bedrooms on each floor.
This is what the building looked like before renovations, and that's what it looks like afterwards.
So the structure, everything else pretty much remained the same.
What's in the basement?
The basement is just a basement.
There's no access to the basement for any of the tenants.
There is a bill code door in the back of the property for the basement, which houses the hot water heaters and the sprinkler system.
All right.
Show us your other photos.
This is the inside going up the steps.
So this is what the building looks like now.
This is one of the units, and that's the doorway to two of the bedrooms.
That's the inside of one of the bedrooms.
The back bedrooms pretty much look the same.
And this is just a layout of the kitchen, and everything is in accordance with the building layout.
what floor is that bathroom one that's the that's the second floor okay
this is the rear of the property so that's the backyard that's the only access to the basement
through that bill code door and no one has access to that except the owners and this is just a
sitting area in the back of the place in case somebody want to you know tell them want to have
a cookout or just relax in the backyard or store a bike back there or whatever they want to do
And this was the previous RCO meeting from 2018 when they approved the plans at the RCO meeting.
then. Again, this is the current refusal from June 17th, and this is the RCO, the results
from the RCO meeting, the unanimous decision on October 1st when we met with the RCO, and
this is their approval. This is the posted zoning notice, the photograph of it. It's been
up since October the 1st.
I'm sorry, October the 5th.
And that's pretty much the scope of the property.
You guys, I'm open for any questions you may have.
Questions from the board. What's the plan for
trash? The trash will go.
I'll show you where one second one second right there okay all the trash will be we will have big
trash cans right there behind that gated area where the tenants can put their trash right along
the side of the building right there behind that gated that gated area and all tenants are going
to have access to this gate and this is yes backyard yes yes you go you walk right through
that gate the same way to get to the backyard yes right how many other tenants on that block
are storing their trash at the front of the property how many other tenants yeah um well
right next door right next door those tenants uh have the same access and they store there is
either on the side or in the front you can't necessarily see right there the front of theirs
but they store theirs right over there as well on their side okay other questions
So they're storing theirs in front of the porch. I'm looking at Google. But you're planning that your tenants will be storing their trash beyond the face of your front wall, right?
so there so there's so they're storing theirs in front of the porch i'm looking
Yes. We'll be providing extra large trash cans with the wheels and the lids on them for each unit.
Yes, what I'm trying to get to is, see the picture on the right? Your trash cans will be stored where the gray part of the wall is, not where the fence is, right?
No. Yeah, yes, they'll be right by the wall, absolutely. Along the side, yes.
But not in sort of in front of the house, okay.
No, not.
All right.
Other questions?
Can I see the floor plans again?
sir could you show the floor plans okay okay
that's it that's the second floor it's the first floor
okay can you just
okay can you give me a second all right can we go back all right okay first floor okay and you said
that there's nothing in the basement no nothing in the basement that's where the hot water heaters
are stored sprinkler system plumbing stuff like that but no nothing in the basement nobody has
access to the basement as well.
You said there are three bedrooms?
And how many bathrooms?
There's one, right?
Do I see just one
bathroom?
One bathroom?
Is that
what I'm seeing here?
This is the bathroom area right here.
So there's a shower, toilet, vanity, and entrance.
And there's a window right there.
Is the bathroom layout the same for all three units?
Pretty much, yes, they are.
you know just a general note if you're going to have three bedrooms those are usually going to
be rented by families and oftentimes it's good to have at least one of the bathrooms have a full tub
okay hard to wash the toddler in a shower i understand
okay um and then second floor please
Okay, the second floor.
So you have my pet peeve where you have to go from the bedrooms here in the back and
wander through the living room to get to the bathroom.
so only one of the bedrooms really has access
to the bedroom right next to it
so that's a long walk at 3 o'clock in the morning
just one of my
issues here. Okay, and then let me see the third floor
The third floor you said?
Yeah. Okay, there's the third floor as well
okay thank you any other questions questions from our no questions at this time mr chairman
comments from the virtual audience i see no hands chair planning commission good afternoon liz
fusely on behalf of the philadelphia planning commission the comprehensive plan recommends
no change to the rsa3 residential single-family attached zoning at this location the two-family
household living or three-family household living is a common condition on this block face with
several semi-detached three-story building types a transit stop is within walking distance to this
proposal the use variance if authorized will not alter the central character of the neighborhood
or district in which the property is located the planning commission recommends the board grant
the requested variance for three-family living in an existing structure and for the accessory

Our vice chair has a few questions for you.
Thank you.
Okay. Good afternoon. Have you submitted your documents and exhibits 14 days in advance of this hearing?
I have.
And do you wave the veto of your refusals and stipulate to their accuracy?
I wave. I can't stip. And I'll explain why in a minute.
Okay. All right. Thank you. You can see your screen and begin.
Thank you.
And there is a letter of opposition, I believe.
From the RCO.
And we've submitted signatures as well in support.
I think I'm waiting for
to be made a panelist.
Excuse me.
Vern you're not in the system yet
registered
I should be
I see it
there you go
just doing this
I'm not clear.
There it is.
In progress.
Thank you.
Now I can share my screen.
Here we go.
2808-12 Allman Street is creating a unity of use
with respect to covenant easements and the recorded deeds for two things. First and foremost,
we're trying to legalize a fence that my clients put up in replacement of a very longstanding
existing fence. And the second, it's a side yard to their home. The second is a use
variance for one car accessory parking. The reason why I couldn't stip is because while I agree
that we should be seeking relief for the accessory parking, because there is no rear access or alley,
I don't believe that the fence as it exists should have generated a refusal because since
the last 15 or 20 years, if not more, there had been a fence with the same exact footprint.
It was a solid concrete wall, the photos of which have been submitted to this board.
My clients hired a contractor to tear it down and replace it with something a little bit more
aesthetically pleasing. That's all that was done. Same dimensions. As a result, that old
concrete fence is what we would consider a pre-existing non-conforming structure and
therefore substituting it should not, in my opinion at least, should have not had generated
the refusal. Council, I think your volume is on in your computer. I think you're having
a little feedback. Thank you.
okay and this is the refusal that we move into evidence and there is the
this is the refusal that we move into evidence and there is the
aerial view the property in question
we have the zoning map
the top photo is the long-standing over 20 years uh concrete wall that stood there prior to my
client's purchase of the properties and the bottom photo is what was uh the the wall was
replaced with the replacement structure and there it is again here's interior
the lot itself is undersized under 800 square feet
we could not build on it without some sort of zoning relief
As a result, there is a unique hardship in using it as the code would allow.
Here we go. Here's additional interior photos.
And because there already is legal that this board has approved accessory off-street parking, as this photo shows here,
you'll see the top photo
which I personally brought to this board
and it was approved
and the bottom photo is a front-loading garage
here's the plan
there's streets approval
which i asked the board to also consider
and here's signatures of just about everybody do be fair to go back to the street's approval sure
there's the street's approval do you have any questions about it
turning right show show again the turning radius oh you want oh you want the turning radius okay
there you go
sorry for going too fast
then we have signatures of
support of just about everybody who lives
on Almond Street
as well as Livingston
Somerset
an RCO meeting was held
