2/5/15 - STATED - 2ND READING Thank you. The Chair recognizes Councilwoman Brown.
Thank you, Mr. President. Given the supreme importance of this bill and, more specifically, given the constituency that will be impacted by the intent of the bill, I would like the sponsor to share with us once more on the record for the record the intent and its value. Thank you, Mr. President.
Thank you, Councilwoman. The Chair recognizes Councilman O'Brien.
Thank you, Mr. President, members of Council. The right to counsel is a fundamental procedural safeguard guaranteed under the Bill of Rights to all persons accused of a crime who are unable to afford a lawyer. com) 2/5/15 - STATED - 2ND READING versus Wainwright, the United States Supreme Court recognized the fundamental role that legal representation plays in a fair criminal justice system. In November of 2013, I introduced two pieces of legislation that made changes to the Philadelphia Home Rule Charter. Bill No. 130851 was a ballot question and Resolution 130861 was the accompanying resolution. That Charter amendment was approved by a majority of Philadelphia voters in May of 2014. Before the amendment to the Charter, Section 2-309 of the Charter, titled "Leases and Contracts," stated the Council may by ordinance authorize the leasing of real estate for more than one year and the contracting of personal property to be supplied or for services to be rendered over a period of more than one year. com) 2/5/15 - STATED - 2ND READING length of the contract is for one year or less. This is the approach to government that I agree with. I do not believe that every contract should require City Council approval. However, I do strongly believe that any contract dealing with an individual's constitutional rights or statutory rights is important enough to require Council approval. Furthermore, these contracts are of such importance that an exception to the Charter was not only required, but was in the best interest of the City. The right to counsel is a constitutionally protected right. The contract the Administration issued an RFP for and plans to eventually sign deals directly with this constitutionally protected right. This Charter amendment did not prohibit the Administration from entering into a contract. It just requires a public forum to be able to review the contract and get answers before the contract is signed. com) 2/5/15 - STATED - 2ND READING the passage of this legislation, there was no allowance for public input. The amendment to the Home Rule Charter requires that all contracts for rendering of services for a year or less that involves the expenditures of more than $100,000 for the purpose of providing legal representation and related legal services for the indigent may only be made when permitted by ordinance. This provision applies to the contracts, renewals, and extensions. In order to make the amendment as narrow as possible so as not to open the floodgates of City Council approval for every contract, I did the following: put a monetary threshold of over 100,000; two, specifically state that this amendment only applies to contracts dealing with both legal representation of the indigent. The monetary amount is necessary to make sure that only large contracts are considered. com) 2/5/15 - STATED - 2ND READING attorneys who are currently providing legal representation to the indigent by being court-appointed conflict counsel. However, the monetary amount includes the Philadelphia Defender's Association, Support Center for Child Advocates, and Community Legal Services. Let me emphasize, they do extraordinary work. Because over the years these organizations have been contracting with the City, they are exempt from the review requirements unless Council provides an ordinance to the contrary. Bill No. com) 2/5/15 - STATED - 2ND READING matters requiring the use of conflict counsel. I believe the Defender's Association, the Support Center for Child Advocates, Community Legal Services all provide quality representation to the indigent population of our city.
The intent of this legislation is to ensure adherence to standards for those representing indigent individuals requiring the services of conflict counsel. I believe in an open and transparent process, including Council input, in a public forum. Council has fully supported my previous legislative package on this issue, and I am grateful for that support, and I ask them once again to be with me here today. It's important to recognize the Justice Department has already funded a study. com) 2/5/15 - STATED - 2ND READING here. They stopped, as I give great pause. They are going to do a comprehensive study. The United States Attorney General has recognized this is the most important issue on his desk. We have a chance to get another black eye if we don't do the right thing or we can be celebrated as the one city that got it right, and I ask for Council's approval.
Thank you, Councilman. The Chair recognizes Councilman Oh.
Thank you very much, Council President. I'm just going to kind of state what my understanding of this situation is, and certainly anybody can correct it or whatnot. What I understand is that when the City became responsible for paying for conflict counsel, paying for counsel -- that was taken from the court -- the Administration came up with the idea or the plan that it would 2/5/15 - STATED - 2ND READING provide all the money to one law firm. That might have been a good idea. I don't know. But the contrary concern raised was that all the money going to one law firm meant that there would be not enough lawyers to go around, that the quality of services may be poor, that in order for the law firm to make money, it would not want to devote the amount of time. I don't know if that's true or not, but that was an issue raised, and that was raised by some of the conflict counsel who have testified today. The Charter change passed. That's done. And now this ordinance, as I understand it, addresses three exemptions from which I believe Councilman O'Brien is concerned that in spite of the Charter change and to further the desire to get the money to the folks that the Administration wants to and to bypass conflict counsel, they're going to sign a contract, which is then going to provide the service 2/5/15 - STATED - 2ND READING funds to these three organizations as it deals with indigent counsel. I think a separate issue that was raised is that basically this passing of this ordinance would further delay the monies that are due or that these very important organizations want to receive. I would, however, myself point out that expeditious is the issue, and the reason there's a delay is because the Administration has not expeditiously dealt with this contract. It's already a seven-month delay. We are not delaying it. I believe we are constrained to follow the Charter and I believe we have to follow the law that has been passed by the people. And I think what occurs is that even if we pass this law, it still goes to the Mayor. The Mayor has got to sign it. Hopefully this contract that's being signed today will be submitted and the monies will be taken care of or whatever else is done. But that's my understanding of what is happening with 2/5/15 - STATED - 2ND READING this bill. I only say that because it's a little confusing and I thought there was two issues weaved into one bill, but I think there's two separate issues. Thank you.
Thank you, Councilman. We'll read the number again. Mr. Decker, just for the record, we'll read it again, 150001.

Thank you very much, Mr. Decker. And that concludes our Calendar for today. Are there any speeches on the part of the minority? The Chair recognizes Councilman Oh.
Thank you very much, Council President. I'd just like to point out that last month the Supreme Court of the United States denied hearing a case from the 8th Circuit that dealt with the dismissal of a female employee who wanted to pump breast milk at work. I'm proud to say that this Council body and the Mayor signed into law legislation making it gender discrimination in Philadelphia to harass or fire a woman who simply wants to pump breast milk at the workplace and, if possible, provide a reasonable accommodation. The reason I'm bringing it up is because it is not settled in this say to me, Well, why do you need this law, I'll point out that there's only one circuit in the country that has said it is gender discrimination to fire a woman simply for wanting to pump breast milk at the workplace, provided there is a reasonable accommodation. In this case, the lower court, a federal court, said it's not gender discrimination because men sometimes can lactate too. I'm not picking up that duty. I don't think Councilman Johnson is either. But I think it really illustrates that still in this nation we are still struggling with gender discrimination issues of the most practical sense, and I just want to commend this body for ensuring that in Philadelphia we are ensuring that people, men and women, will be promoted based on their merit and that we want to have smart, hard-working, innovative, creative women leaders who are also good mothers, and both of those things help our city.
Thank you, Councilman Oh. I'd like to say, Councilman, thank you for your great work. As a result of that, there has actually been a couple of spaces within the City Council jurisdiction that are in the process of being converted to make space available, private space, for individuals to breastfeed. So thank you for your great work.
You're welcome. The Chair recognizes Councilwoman Blackwell.
Thank you, Mr. President. Through February 27th at the Van Pelt - Dietrich Library Center, there is an exhibit that University of Pennsylvania is hosting called The Great Emancipator and the Great Central Fair. They restored in 1940 one of the original copies of the Emancipation Proclamation and they have that, artifacts, paintings, et cetera, that are on display now. They're willing, if any of my colleagues would like us to make a day of it or take an hour and visit it as a body, they will set up a special day for us, a special morning or afternoon for us to do so. If anyone is interested, if you let my office know or call me or have your staff let my staff know, we'll do that. Otherwise, of course, we're always invited February 27th to visit it ourselves. Thank you very much.
Thank you, Councilwoman. The Chair recognizes Councilman Johnson.
Thank you, Council President. On this upcoming Monday at Hawthorne Cultural Center at 6:30, we will be hosting our Quality of been going throughout the 2nd Councilmanic District where we're bringing City agencies out to the community to allow the residents in the community throughout the 2nd Councilmanic District to address their issues and concerns with agencies such as License and Inspections, Streets Department, District Attorney's Office, Philadelphia Police Department. And so that's going to be on this Monday, Hawthorne Cultural Center at 6:30. I also want to acknowledge the work of my good friend David Oh. Being a new dad and just watching how my wife is a super mom, doing work in the field of politics but also raising our son, those breast milk nursing issues are very real issues, especially when you're balancing child care as well. And so I do want to acknowledge the seriousness of his legislation and the comments that he recently made. Thank you very much.
Thank you, Councilman. That concludes the speeches on -- not quite. The Chair recognizes Councilwoman Blackwell.
