There are pictures of the most recent posting, and the block itself, which you can see is
a mix of two and three-story dwellings.
Here's the proposed plan, members of the board.
What we're seeking to do is have a three-story structure not to exceed 38 feet tall.
At our second story cornice line, what we're doing is trying to match as best as possible the height of the existing structures and have a mansard style that leads up to the third story.
The refusal that we received for the roof deck is this very small part to the rear by the roof deck access pilot house, only to the rear of the property, so we won't have anybody to the front of the property overlooking the street, which is generally what my understanding is this code provision is to prevent.
here's the interior floor plan the basement is essentially a rec room with a half bath
on the ground story we have living and dining with a kitchen to the rear we have stairs going
up to the second story where we have two bedrooms one in the front run to the rear bath in the
middle and we have the owner's suite on the third floor up to the front and then a large
bath to the rear roof deck itself this is the area where we are where we receive the refusal
for not having the extreme property lines have it pardon me this is the area where we have the
refusal for not setting the roof deck back but it's very small area and it's a de minimis infraction
of the code we largely keep within the spirit of the code with respect to the way that we have this
pilot house set up and the roof deck itself set up with respect to the property itself we are
very similar to existing property rear yard sizes we're not seeking
uh very similar to existing property rear yard sizes we're not seeking an overbuild on the
property the house itself is just around 2 000 square feet and with the support of the community
you would ask you vote to support this project members of the board and grant the variances
that we request my client i believe is not present today but i would make all these affirmations as a

Mr. Vernick, can you pick up where we left off in explaining to the board why you believe that this appeal should not be granted
and that it's an overreach in asking as it impacts negatively you as an immediate neighbor?
I was telling the board prior to the continuance that
we're one of the oldest, if not the oldest neighborhood in the city. Our infrastructure
is similarly extremely old. I have two buildings within 50 feet of the Painted Bride. Both
buildings require pressure pumps in the basement in order to get water up to the third and
fourth floor. I'm not a water engineer or a utility person, but I understand that it's
caused by the infrastructure and its age and its deteriorated condition. Likewise, I built a new
house on the 200 block of Vine 12 years ago, and the gas company could not give me enough pressure
to put in a tankless water heater. Whether that has changed since then, I can't tell you. But that
was the story 12 years ago and as far as I know our our guests and its its lines in our street
have not been changed so I put that out because here we have 75 units I'm fairly sure that they're
going to be okay because their connections will be large enough to supply all of their needs
but I question what the effect is on the rest of the neighbors by them taking what they need
for 75 units. The point being that the massing and the size and the number of 75 units
is simply too much for this neighborhood. The other thing I was telling you before we left
off is I need to set the stage for this particular block. And I know the chairman told us that
he drove down it and he looked around personally a month or so ago.
But New Street is one lane of travel. New Street runs to the south of the Painted Bride building.
Bodine Street is a little alley, and that is basically zero lanes of travel. You're lucky
if you get a subcompact down it, let alone a truck, which leaves Vine Street. The 200 block
of Vine Street is a block and a half from the I-95 off-ramp of Callahill Street. And so
when you put 75 units on this block, and I understand that there are 12 parking spaces
within the building because of some kind of zip car loophole that that is in compliance
but that and I'm not even speaking about the people that live in the building and have cars
And I'm not even speaking about the people that live in the building and have cars that are going to be dumped on the neighborhood.
If he's legal with parking, he's legal, period.
But that there's a whole host of other people that will be coming upon this property and will have to access this building from movers at the middle or the end of the month to move in people in the beginning of the month.
And in a 75-foot unit building, I wouldn't be surprised that in the summer months that we don't see four or five trucks pull up at the end of the month and four or five trucks pull up at the beginning of the month.
Actually, Mr. Chairman, it's all speculation.
It is speculation.
I agree.
But it's highly likely that in a 75-unit building that this is what's going to happen.
People have to move in and people have to move out.
Mr. Vernick, wouldn't that be the same case if it was lesser units?
You're going to have people moving in and moving out.
Lesser units or lesser moves in and lesser moves out.
And even more so that the only place for them to do this, because there is no loading dock with an elevator that I see on the plans,
the only place for them to put these trucks is Vine Street.
which effectively will reduce Vine Street to a one-way street.
And let me tell you, in the morning, when the cars are coming off the I-95 ramp
and cutting through the neighborhood, you're going to have gridlock.
And there's no place else for them to put their trucks.
There's no place for the repair people, the plumbers, the electricians,
the people that service this building to put their trucks.
And as I was telling you last time, we all know that contractors put their trucks
as close to the building as possible, very simply because their tools, their equipment,
and their supplies have to be unloaded. So the question is, what happens to our street?
You're going to turn a two-way street into a one-way street, and then you're going to have
gridlock because of it. I now want to speak to this mosaic, which I've lived with for the last
30 years. And as far as I've seen and I've heard, this mosaic is the only reason that has been
advanced for the three requested variances. We all understand, and it's part of the record,
that the Historical Commission has ruled that neither the mosaic nor the building is historic.
And we all understand. That's relevant to the case, Mr. Chairman.
Yeah, Mr. Vernick, with all the respect, we went through this the last time.
you testified and I'm not dismissing that but rather than go over the same stuff any new
material we would appreciate any new comments so the painted bride the painted bride has put forth
testimony that's part of this record that a hundred percent of the northwest facade of the
mosaic is delaminated we're separating from the building Mr. Chairman the painted bride hasn't
testified in this case. Can I address this, Mr. Chairman? Mr. Mattione put in 265 pages of
documents which are all hearsay. If what I'm about to say is hearsay, I ask that his 265 pages be
stricken as hearsay as well. Okay, let's move on. If you can get to the point of your testimony,
that would be helpful so my point is that this mosaic is not in good shape
has been testified to by chairman that there's a condition report i mean
it is what it is he's not test he's not qualified to testify as to the condition of the mosaic
yeah and i again so you know uh i i was actually out there a week and a half ago i have probably
have nothing better to do with my life so i go visit the bride every now and then uh and i'm not
trying to make light of this but i was out there again and i don't know i mean that with the black
shroud that's over it um it's for me at least and you may have better knowledge before the shroud
was put on i could not determine whether there was any significant damage to the to the to the
building itself so again mr chair what i could observe i i didn't see that not saying it isn't
there but i just couldn't mr chair i think what but the witness is trying to communicate is that
mr anastasio thank you i think about my uh the witness is trying to communicate is that the
black the existence of the black shroud in and of itself uh is proof positive that the that the
uh is proof positive that the that the mosaic is in bad shape well that could be and it could
that Mosaic is in bad shape
well that
also be to protect it from being damaged i mean i i again i you know i wasn't there when the shroud
was put on so i don't know what the existing condition was prior to the shroud but it's it's
likely it could have been put up to protect it uh i i have a question and you got to refresh my
memory maybe mr manioni can do this uh mr vernic keeps talking about the 75 units if the buy is a
buy right is 65 feet correct 65 feet correct how many units would it be in that if it was a buy
right project you could have 75 units in a buy right project i mean that's what i'm saying so
the number of units isn't going to change based on the height of the building correct all right
okay well then why aren't we discussing a by right project well because you're gonna this
this application is to exceed the 65 foot height limit which was put in by a councilman who happened
to happen to be me at the time as a way in which to allow the community to be part of a process
because we didn't want some tall buildings in some areas of old city as opposed to others
and that was really the only reason i did the 65 foot it wasn't a magical number it was a number
we thought we can all live with we'd like to live with that number too i know i'm sure you do but
again that was again that was only put in place to allow the community to be part of that process
which we're doing now and that did not mean that it would never be able to exceed 65 feet
basically it was a project by project decision that would be made by the community and or the
zoning board of adjustment if they wanted to exceed that thank you mr chairman mr vernick
anything else to add yeah so let's all briefly please for the sake of time so i asked this board
that if this mosaic is so valuable and worthy of three variances why hasn't it been preserved
repaired or cleaned since it was put up 30 years ago why is it in the condition that it's in
let's just take it for granted that it's not in good shape but this following this argument
this developer is pretty smart guy he submitted an agreement to you which speaks for itself
but if you read that agreement he absolves himself of responsibility for the care preservation repair
and maintenance of this mosaic even though he owns it even though he bought it even though it
is the sole excuse for asking for three variances. That's the part of this whole thing I don't
understand. But let me tell you why. Because he now has to build an 85-foot building within the
perimeter of this thing and somehow brace it and protect it so that it's not further damaged. And
he doesn't want to take that risk. So he has pushed it off onto Magic Gardens via the agreement
which has been submitted to you, and that simply is a flaw in this whole process.
As to this mosaic, if you believe that we're dealing with a Michelangelo and the Sistine
Chapel, that's a one-of-a-kind type of building. There are 220 of these mosaics around this city,
all under the protection of the Magic Gardens and Emily Smith. This is not one of a kind.
They're all different, but they're all similar. And so I say to you, to destroy a neighborhood
because of this mosaic is simply not called for. We have to live here with this thing.
So let me leave you with this thought. Five other construction projects have been approved within 150 feet of the painted bride. Zero have needed or requested a variance, let alone three variances.
So the simple question is this. You either have to choose the law and the zoning code, or you have to follow some other standard. I submit to you, this mosaic is not the standard to follow and create precedent. Thank you.
Mr. Vernick, one quick follow-up question and then we'll let you go.
Are you aware since the last hearing of our efforts collectively in trying to negotiate a settlement with the applicant's attorney?
I am absolutely aware.
Any settlement discussions are just that, settlement discussions.
That's right, and we're not going to get into what we discussed.
I just want to clarify for the record, Mr. Vernick, is that correct?
clarify for the record uh mr vernick is that correct that uh uh you and the other clients
have directed uh your attorneys your your legal counsel to try and come up with a negotiated
settlement is that correct that is correct and i am aware that i don't know gary gary and then
also uh part of that settlement uh part of your direction to your counsel was to do what we could
to preserve some or part of the mosaic is that correct we've been trying to talk since the
beginning of this and we've just been met with the fears thank you very much what the preservation
of the uh mosaic part of that conversation would that have changed any of the variances that are

want to do is have a conversation and we believe one of those options is the preservation of all
or some of that bride's skin and we can and they could still build but we can't even get to a
conversation we're just shut down immediately and I know that's not Michael's fault he's just
doing what his client tells him to do but we'd be willing to save you know we understand the
importance of uh for some people of that of skin of the bride uh we believe there are ways in which
we can preserve part of all or part of that bride skin and still have a development that
makes sense for the developer we can't even have that conversation unfortunately
we love that conversation councilman dom tried to even initiate the conversation
he was shut down well we've been trying to do this for quite some time
mr chairman my client has said and i appreciate council member dom's intervention as well along
with mr anastasia my client has stated um did make changes back when this was first filed
reduce the number of units, reduce the setback at the seventh floor, and cannot find a way to do
any further reduction in building, massing, et cetera, and make it work financially. And that
has been his position. We appreciate that everybody has reached out, and he has in good
faith looked at numerous options and can't find a way to make any of them work other than what he
has presented today. So we understand and appreciate the concerns of the community,
and but that's where we are but still nobody sat at a table and worked this through at all
and that's unfortunate and i think that's what council member dom was hoping that would happen

The city's clear policy regarding public art supports the granting of these variances.
Now, as the board knows, the Pennsylvania Supreme Court in Hertzberg made two important points with regard to dimensional variances.
The first being that the board should be more flexible in considering a dimensional as opposed to a use variance.
But the second was that when considering a dimensional variance request, the Supreme Court directed the Supreme Court, the Supreme Court directed the boards to consider numerous and multiple factors, numerous and multiple.
Those are the exact words that the court used.

position uh on uh on this proposed appeal sure uh franklin bridge north neighbors uh exists because
other parts of the city don't have our community's best interests at heart. Franklin Bridge North
was born out of old cities disinterest in stepping into fight for the neighborhood when the Vine
Street Expressway was planned and built. And here we are again being bullied by those outside of
our neighborhood. Of the over 700 names that were collected in support, almost none of them live in
the neighborhood. They simply don't have to live with the actual, not perceived consequences of
this project. The Magic Garden and the developer, after hitting roadblocks of the historical
Commission of the PA Courts believes that using the financial and political resources they have
to threaten and shame our community. They can get us to kowtow.
We're just presenting a case. I mean, I think it's threatening and shaming. I think it's
incorrect. I don't necessarily think he means during this presentation. Go on, Chandler.

as if they're holding it down to our head,

can have both. But for them to be coming at us with this, you must give us variances or we're
going to demolish your mosaics is a threat for those that believe that the mosaics should be
should be preserved. I believe this is disingenuous behavior both on the part of the
developer and the magic art. The developer wants to create a hardship where none exists and get
permission to build something larger than they would otherwise be permitted to build. In addition
to it being out of scale, it visually clashes with the neighborhood and further sets a bad precedent
for the neighborhood development when so many other parcels are being put forward or putting
forward plans. Allowing this project to go forward will be letting the genie out of the bottle and

Having suffered the indignities of the Vine Street Expressway and I-95 construction, the community must take a stand and oppose those who want to bend, skirt, or exempt themselves from the rules through whatever convenient excuses they can manufacture.
I believe that the Magic Garden is equally disingenuous, and having been
denied historical designation, they are once again attempting to create precedent,
but not with their own property in their own neighborhood, nor any of the other 220
plus such mosaics that exist throughout the city, but with this one. And the Painted
Bride was never the exterior of the building, but the Painted Bride stated as much themselves
in front of the Historic Commission. Objection, Mr. Chairman, the Historical Commission
and there's no bearing on this case.

This is a quiet residential neighborhood
with the legacy of historic industrial buildings
and neat row homes,
not massive new built apartment blocks
like Northern Liberties.
As a renter in this neighborhood,
I believe that adding more apartment units
to our neighborhood will not lower my rent
and will likely have the opposite effect.
As existing properties are forced to compete
with new buildings and new amenities,
property managers will likely be forced
to go up market offering new amenities at higher rates speculation speculation this is this is the
impact that i see this is the impact that that i believe could happen additionally as existing
lots are developed and more residences without dedicated parking or creative the cost of leasing
a parking space in the neighborhood is also likely to go up and townhouses again it's all speculation
speculation that's his opinion he's going to impact his community one at a time please
thank you this hearing is going to get shut down if we don't start having some cooperation from
everyone please if if the developer can point out the fact that there's ample parking in the
neighborhood and use that as an argument to support their design then i can point out the
flow on that argument. I believe that townhouses with dedicated parking, which was the original
plan, simply would not impact the neighborhood and existing residents in the same negative ways.
And frankly, I was shocked to see the original plans developed for the townhouses on the property.
The original plan seemingly incorporated mosaics as architectural access. Given the choice between
the two proposals, the overwhelming apartment building or the tasteful townhouses, I believe
the townhouses are very handsome and would not only better conform to the neighborhood, not
require any voting variances, nor set a bad president, they actually preserve the legacy of
the mosaics themselves. Something we are told is impossible without the variances in the grossly
out of place building. Yet this is not what the developer wants anyone to believe. It's simply
the variances or else. Franklin Bridge North neighbors understood this threat when they voted
and they voted to oppose it all the same. And I want to stress that. We understood what the vote
meant, and that is the vote we took. And here we must stand on principle and not bend to these
threats. It's a convenient excuse for the developers to say that the community and the
city want to preserve this mosaic and that that is causing the hardship. And that's simply not
the case. A small group of well-funded, well-coordinated interests want to preserve this
to further their personal, professional, and political interests. If the comment section on
Inga Safran's opinion piece from January 15th of 2021 about this development are any indication
or general public's attitude, the majority either don't care in the newspaper. That's not part of
the record and it's not relevant to the case. Saying that the majority of people don't care
about the mosaic or outright feels not worth preserving. Perhaps you have a sensitivity and
a politeness toward a living artist that is constraining people's honest opinions
if they're less than glowing. The comment section on a news article don't value sensitivity and

Yes, so my brother and I own 253 North 3rd Street, which directly faces this proposed development across Bodine Street.
Our property is landlocked and only receives light from the front and the rear.
if this variances if these variances are granted we would be almost totally stripped of light
in the rear because the property could be a mere six eight feet from our rear windows
this would be a burden as a near neighbor there are jail cells that have more light than what we
will have. In addition, we have been meeting with the neighbors and while we oppose the variances
because while we like the mural, we believe there is a way to preserve the mural and still
give the developer enough of what they want, but they won't talk to us and we feel shut out.
we have been portrayed as uh nimbies not in my backyard people and nothing could be further
from the truth our neighborhood association i have personally seen them bringing coffee
to the homeless encampments in the middle of the winter and they clean up and they clean and they
clean up please don't interrupt and they clean up even though the trash is not our trash
like these are good people who care deeply about this community miss broderson with all due respect
no i don't think anyone is of the opinion that you and the rest of your neighbors don't care
about your community if you didn't we wouldn't be having this conversation so we can stipulate that
you are neighbors who are not nimbys or not bananas build anything nothing anywhere near

the developer on this particular project? Yes, I have been. Okay. And at the final meeting between
the parties, was it your understanding that the developer was going to remove any units using
visitor accommodation? Did they communicate that to you? In fact, I was the one who asked him that
question myself. And yes, he acknowledged that yes, that they would remove the short-term rentals.
And just for the record, if I can be permitted to explain my angst over this, I have lived in
this community with my late husband over 30 years. The advent of short-term rentals has become a real
sore spot in our community. Many of them are regulated well, others are not. And so whenever
we see more short-term rentals being added to a building or a private property, obviously we are
greatly concerned regarding the late night parties around my neighborhood, around my corner. There was
a shootout over drugs because of a short-term rental. So I respectfully asked the board to
understand our my personal angst over this uh additional 10 units which shimmy at the january
7th hearing absolutely promised us would be removed and now they're back in again and this
rest miss rest just to walk that back a little bit uh even though these these uh visitor
accommodation units are permitted as a matter of right you were very grateful and happy that he
agreed to remove them from the plan. Is that correct? Absolutely. And I express that gratitude
at that meeting. Okay, great. And then is it your understanding that despite his assurance,
now those visitor accommodation units are now back in the plan. Is that correct?
Yes, that is correct. Okay. And what does that, how does that sit with you with respect to his
credibility? Well, obviously I'm concerned because if he pulled them out, gave us his word,
they were out and then put them back in, then my concern is, and again, I am not a judgment of
anyone's characteristics. That's not my place. But on the surface, I am concerned that if this
was a back and forth, there might be other issues that we as a community want to negotiate and then
are sort of conveniently put to the side. That's my perception.
And Alice, despite that, would you be ready, willing and able to sit down at a negotiated settlement table again with this developer to try and come to an amicable solution where a development can happen?
Some variances may be granted, but a portion or all of the skin of the bride could, in fact, be preserved. Is that correct?
Absolutely. And I just for the record, I appreciate the bride. My late husband and I were proud of this mosaic, visited many artistic venues there. Yes, I would love to see part of it preserved as a variance. Yes, we will be willing to negotiate. Absolutely.
And it's your understanding that all attempts at negotiation have been met with just no. Is that correct?
Yes, I am the vice president of our RCO. I also sit on our zoning committee and our efforts, our attempts have been met with negative results.
And were you aware that council member at large, Alan Dahm, recently reached out in order to help the parties negotiate a settlement? Is that correct?

I just want to say that Mr. Zakin did say that he would remove the visitor accommodations if the objection to the project was removed.
The objection to the project was not removed, so he did not remove the visitor accommodation.
It was done as part of, hey, I'll give you this if you give me that.
And when he said that he would do that, and then there was a response of, well, it doesn't matter.
We're still going to oppose you.
He said, then I will not remove the visitor accommodation because there's no give back from the community.
And that was the context that it occurred in, and that's how it happened.
So attack Mr. Deacon's credibility, I think, is improper, given the context of the matter.
And I do, I understand Mr. Anastasia was not there at the meeting, so I was, and I know what was said, and I put that on the record because, you know, I do have that advantage over Mr. Anastasia, because he just wasn't there.
So that's how it occurred, and that's what happened, and that's why the visitor accommodation were not removed, because there was nothing to be gained by removing him.
There was no removal of the objection by the community to the project.
And the witness has testified that, again, they're ready, willing and able to sit down and try and come to an amicable solution.
With that, Mr. Chairman, I have no other witnesses on my list.
I'm going to hold off on a closing argument until everybody else puts their witnesses on and then my close will follow Mr. Mattione's.

Thank you. As I indicated earlier, I represent Isaiah Zagar, the artist who created the skin of the bride. And I'm going to address only one single issue, and that's a legal issue. And that is whether as a matter of law, the public policy of the city of Philadelphia should be considered in this matter.
I mentioned that the Hertzberg case, which is the leading case from the Pennsylvania Supreme Court on dimensional variances, required us to be more flexible with regard to dimensional variances.
But it also said that the zoning board should consider multiple and numerous factors.
And those, as I said, were the exact words of the court.
And I then asked, is a municipality's public policy one of those factors that should be considered?
and I suggested the answer is yes. In the Hertzberg case itself, the zoning board in
Pittsburgh granted that dimensional variance, recognizing the project would advance Pittsburgh's
public policy of rehabilitating blighted neighborhoods. Philadelphia has demonstrated
in many ways that supporting public art is a major objective of the city. What's the evidence of that?
Every year, the city gives about $2 million to the Mural Arts Program, the leading agency for
the creation of public art. Other examples the Philadelphia redevelopment authority mandates
that developers dedicate a full one percent of total construction cost to the commissioning
of public art. The city itself in the percent for art ordinance provides that all construction
projects on city-owned or city-related land must include site-specific public art in an amount up
to 1% of the total budget. And finally, another clear statement is one this board deals with all
the time. The zoning code offers height and floor area bonuses to developers who agree to commission
public art. So far, those incentives have been offered only in areas of the city where the city
wants to encourage even more public art than already exists. And look at the actual language
of the code. In section 101, the code provides that one of the purposes of zoning is to preserve
and enhance the public realm, excuse me, including the streetscape and pedestrian environment.
And then in 14702, the code explains that the bonus for public art is intended to expand and
enrich the public's experience and enjoyment of buildings and public space. So in conclusion,
in addition to the compelling testimony that I heard earlier and the persuasive legal argument
that Mr. Mattione is making on behalf of the applicant, I suggest that the city's unquestioned
policy in support of public art certainly is one of those multiple and numerous factors that the
Supreme Court tells you to consider. And in this case, the city's absolutely clear policy
would certainly be advanced, wherever Mr. Zakin, by his highly praised design,
and the Magic Gardens, by its commitment to protect the mosaic in perpetuity, will

have a different perspective um on this project and a different proposal uh about what they would
like to see as well um so give me one moment I don't mean to interrupt but Mr. Chair I thought
you were asking me if I had any questions for Mr. Moss not whether or not I was ready to proceed with
my presentation I apologize I wasn't clear so you uh Jennifer we're going to go back to Mr.

Thank you, Mr. Chairman. As you know, I represent Franklin Bridge LP, which is the owner of the two
properties immediately to the eastern side of the proposed building. They are 226-228. These
are properties that were built in 1770. They have been recognized by the City of Philadelphia as
being historically significant, the highest designation of historic properties that the
city bestows. They are a Flemish brick design, which is unique in the city and unique in
the old city neighborhood in which these properties are located. I have submitted to the board
letters from engineers at Keys and Hood, three letters that are dated June 9, 2021, in which
the opinion of the well-respected engineers is that the construction of an 85-foot building
with an additional 15-foot elevator tower to the side of my client's properties creates risk of
physical harm to my client's historically significant property. Those dangers are the
increased snow load, which would cause the risk of potential partial or complete collapse,
of my client's roots, the creation of a wind funnel over the roofs of my client's properties,
which could induce pressures which were never anticipated by builders of those properties
back in the 18th century, and the risk of earth pressures on the foundations of 228 Vine Street,
which most likely have narrow footings consistent with the type of construction which was
prevalent in the 18th century. Mr. Moss talked about the city's policies regarding
preservation of art or the promotion of art, and I would imagine that everyone here would
equally recognize the city's policies with regard to the preservation of historic buildings,
let alone historically significant buildings.
So the risk to my clients' buildings
are something that I ask the board
to consider with great seriousness.
In addition, I have a witness here, Diane Tucker,
who is the principal of Franklin Bridge LP.
She's also a longtime resident of this spot.
She's lived in the 300 block of Vine Street
for in excess of 35 years.
Her late husband, Dick Tucker,
developed much of the residential properties
that are situated on the 200 block of Vine Street, including 59 apartment units that are
approximately directly across the street from the building in question, none of which required
variances. So if Mrs. Tucker is present, I would ask that she be admitted and allowed to testify.

I've lived in there for 75 years.
40. I moved in 1979. What property do you live in? I live in 221 Vine Street. I am Diane Tucker. I
live and have lived at 221-226 Vine Street since 1979. I am a next door neighbor. I also own 226-228
Vine Street. These two properties are, as my lawyer said, historically significant. They are
Flemish bond construction with historic storefronts and numerous on the fourth third floor.
It is estimated that these two buildings were constructed within perhaps a couple of years
after the signing of the Declaration of Independence. Both buildings have been meticulously restored
according to historic standards and with the help of the Philadelphia Historic Commission.
This proposed construction of an 85-foot building with perhaps another 15 feet of pilot house
and a code-required elevator overrun structure, including a deck on the roof, pose a very serious
and severe threat to my building, so much so that I have hired historic structural engineers
to help me preserve these two building treasures for the future generations. But it is the opinion
of these engineers that the project will put my property at risk of structural collapse. It is
opinion of the historic structural engineers and it is my opinion that their choice in this matter
is between this new building or the preservation or destruction of my two adjacent buildings
built at the time of the declaration of independence my husband bought this dick
tucker this property in the 1980s because of his love of history um and and that was
William Penn said that William Penn's Philadelphia came up to the south side of Vine Street and the
north side was Northern Liberties. So I want to keep it that way. And I would appreciate if you
really consider this as opposed to what could happen. Okay. Thank you very much for listening.

It's Michael Maddion. Yes, I just want to object to the letters that Mr. Yampolsky referred to
because they are hearsay and the statements by Ms. Tucker with preference to the opinions
in those letters. They are hearsay and I want my objection noted on the record.

um let's see here okay so um i'm here representing uh maxim and ivana spillcheck who are the owners
of 259 and 261 north third street they own one building as individuals and one building through
their llc just to be clear the blue dot is 259 and um the building right in front of it is 261
So these are some of the most impacted neighbors for this development, as they will be about
about eight feet away from the new 85 foot tall structure if it's approved. They are right across
eight feet away from the new 85-foot-tall structure if it's approved.
Bodine Street here and so the effects of the lack of open space and the additional square footage
will have a significant negative effect on the light and air access to these properties
And that lack of light and air access to these properties is going to have a significant negative impact on the economics of these buildings and on their ability to use their property as intended.
So first, there is, Ivana actually lives in this property, so there is the obvious effect of her quality of life issues by a lack of light and air.
But more significantly, these are multi-use properties.
They're mixed-use properties with commercial uses on the first floor and residential rental units above those properties.
Some of these units have only access to light and air through the rear of the property on Bodine Street,
and others have significant portions of their light and air access through the rear of the
property. We went through some numbers and my clients who are experienced developers, property
owners, do believe that there would be about a 15% reduction in their overall rent rolls once the
light and air is blocked to their properties. And while that might not seem to be all that
significant of a number for these properties, it's about $35,000 a year in reduced rent.
and that's not including any sort of increased turnover or increased vacancy because of the
lack of desire of these units. So while the developer is talking about his economic concerns,
we need to also consider the economic concerns of what those variances will have on the near
neighbors. That's speculation, I believe. I agree, Mr. Chairman. Michael Mattione.
Naomi. There's no foundation for those. I can have my neighbors, I can have my clients later
talk about the fact that they have looked at similar properties to try to do this analysis
of what similar units without light and air access in the area charge versus what their
properties charge. But in any case, there is going to be a reduction in light and air access
that comes from these variance requests. And I know that there was a shadow study done.
I just want to show these are first the photos that really show you how close this 85 foot
structure is going to be to these properties. Like it's incredibly close where it's so these
that's why this impact on light and air is even more significant for these properties that are
across Bodine Street than on Vine or some of the other streets. So I know the shadow study was done.
I know that was introduced into evidence and the shadow study supposedly shows that there's not
going to be a significant impact on light and air access to these properties. However,
the shadow studies aren't really showing apples to apples. If you look on the proposed project,
there is an open space above the existing structure of about 20% and that's on the Bodine side.
But when we go to the by right project, we now have an open space on the other side. So there's
no looking at what if they did a similar project, but at the right open space at 25% open space at
lower um height to um the impact of that light in air so i just wanted to point that out and also
shadow studies mr chairman it's michael madion i just want to point out the biroy project does
have 25 open space just has a different location and there's nothing wrong with us having it in a
different location and it does show the impact of a 65 foot height building which has basically the
same impact that the 85 foot height building has. And that was testified to by Mr. Zakin at the
last hearing. So that's exactly what I'm trying to point out is that we're looking at a project
that's not in all cases similar other than the variances. There's other changes here. And when
we're talking about whether or not we can reach, I'm going to have my clients present what they
propose that they would like to see here. That's significant when we're looking at that. So I just
wanted to point out those differences i'm not arguing that you're not allowed to make those
differences i'm just pointing them out um and shadow studies have nothing to do with air access
um if i think most of us live and work in the city um or at least have been in philadelphia
and know for a fact that when you walk between two tall buildings in a narrow alleyway
it's hot, it's stale, there's no air access. So I know that I have no studies to show this,
it's hot it's stale there's no air access so i know that i have no

but I'm just asking the board to use your own experience to know what that's like.
That condition, this is frankly true, that condition would exist even if you went only to 65 feet.
However, when buildings are taller, there is less access. And we're actually not complaining
about the height of the building. So I'm going to get to that point because my clients actually
have no problems with the general concept of this project. However, they're looking to create a
little extra space between their building and the proposed building, even if it's at 85 feet. So I
would like to call Max, Maxim, who is going to walk through what he's put together and what our
proposal is that we haven't been able to truly discuss with the developer um only very briefly
um but it was shut down so max can you uh unmute yourself i believe i'm unmuted can you guys hear

own these properties, but can you tell us a little bit more about your educational and professional
background? Sure. Structural engineer, master's in structural engineering, civil engineering,
did multiple developments, worked in an architectural firm in the past, worked on large
civil projects, do have experience in this type of development. Okay, great. I just wanted to make
sure that the board recognizes that you have a little bit more technical background than just
the average neighbor. And so you're not opposed to this development in general, but your biggest
concern is that it will impact your light and air and the impact that will have on your property and
your tenants and your ability to rent those units, correct? That is correct. All right, so I want you,
I know you use kind of your technical background and expertise in development and engineering,
and you have put together what you propose as a compromise that will allow the 85 feet,
allowed the developer in your opinion to preserve the mural and have an economic benefit from the
development while giving you and your properties um the light and air access that you need correct
that is correct all right so so this is the proposed development right here that we're seeing
um it's over height um over occupied area over floor ratio yeah um so go ahead and just walk
me through if this is the screen you want or you want me to move to the next screen yeah exactly
okay so this is what they're proposing an eight foot separation and with the facade um he has
some texturing to facade it might even stick out a foot or two into the street uh the alleyway is
only eight feet it's very narrow uh it'll be as you can tell here it's going to be dark it's going
to be really um air is going to get suffocated um in this area and also uh be able to get access
for fire trucks might be an issue too what we're proposing is is i understand needs the height to
save the mural we're just looking to get us a setback if you scroll down to the next slide
we're proposing so it's a negotiation we we're asking for eight feet um uh for brief discussion
with shimmy i just want to be clear that that eight feet is only above the second floor so
above the existing floors correct yes above the existing uh painted broads another existing
campaign-ified facade stays where it is. We're just asking for additional floors only on the
side of Bodine Street at recess. And then we looked at a negotiation of how much, and these
are defected areas. So this is his floor plan. We're just asking, you know, we're asking for
eight. Shimmy proposed less. We just want to come to some agreement. We could come to an agreement
very easily. Every little bit helps. And this would help the developer get what he needs to
be economically viable and this would help bodine street i'm not speaking for a neighborhood but

if there was an additional setback here that provided you and your properties more light
and air access, you would be in support of the other variances, correct? I would be in support

be some um negotiations for this and we would like the board to consider that and have the developer

long-time resident of 259 North 3rd Street. Okay great and I'm just going to ask you real quickly
again what I asked Max is that if there was some sort of an agreement for a setback of eight feet
or maybe a compromise setback on your on the portion of the development closest to your
building you would be in support of the other variances correct? Yes that's correct. Great and
i think you might have a prepared statement you wanted to read briefly um i do um so if i may go
ahead okay okay so um i guess just to reiterate what my brother did mention my brother and i
we both own 259 and 261 north third street we're a long-time residents and our properties
and our near neighbors of this project as the rear of our properties are eight feet from the
proposed development. As a near neighbor, I oppose the variances. Our property is landlocked and can
only access light and air from the front and rear of our properties. An 85-foot structure that is
straight up on the property line next to us with 100% lot coverage will tower over the rear of my
property and will substantially and adversely impact the health and economics of my property
by blocking adequate light and air and it would also impact me personally and my quality of life
as boating street provides 50 of the light to my apartment um so if the zba should decide to
reject our request to deny the developer their variances and decide to grant them we are merely
asking the developer for a reasonable adjustment to the variances to build an acceptable property
that conforms to existing zoning regulations. We understand the desire to preserve the mosaic.
However, the developer is using this mosaic to gain many concessions that would be otherwise
denied. If the contractor needs the massing height and number of units to save the mosaic,
then all boating street neighbors would need as a minimum would be a setback for some relief.
we are asking that the zba require the developer to create an eight foot setback in the elevation
above the current painted by structure again we are only asking for a eight foot setback on floors
three to four in exchange for their variance the mosaic can be saved with slight modifications to
the current building design and without over building to paraphrase the artistic executive
director of the painted bride the artistic value of the skin of the bride is not comparable to the
the artistic value of the skin of the bride is not comparable to the value of the livability
value of the livability of
of our neighborhoods light and air are the most basic reasons for zoning thank you great and um
i can't believe uh i can't remember if it was you or max so whoever um spoke to me about this who
had done the comps on apartments i would just like you to briefly um establish how you came up with
what you thought a 15 reduction would um why that would occur uh uh can the board hear me
yes uh this is maxim spielchow uh so old city has a lot of apartments a lot of them in alleyways
existing warehouses uh we've had tenants move into us from units that face brick walls and they took
our unit because you know we had light we don't understand a new building would be no matter what
gets built does block light and air but once you get to a certain height it makes it more and more
darker and and um um less airflow uh so we based our comps based on we looked around looked at
units that were not as you know not as sunny and and based their values on that great and you own
many rental units so you're experienced in pricing um rental units yes we do not many but we own
quite a few great that's um i just wanted to put that on the record it's uh michael lady i just
want to object to that testimony i think it's speculation we don't know what the properties
are we don't know if they're comfortable i think it's just speculation what might yeah i normally
would agree mike but uh they do own properties and they are familiar with real estate and the
needs of uh tenants so i'll over you know you're truly comparable properties well
they didn't give any list or anything. I'm sure they were provided. I'm just trying to keep this
quick and simple to not drag this out as much as possible. I'm just going to summarize again,
my client's biggest concern are light and air access to this property. And the proposal is
having a large structure with 100% lot coverage, which is going to be very, very close and block
light and air access they're asking for just a setback from uh from the property line uh their
proposal is eight feet they are willing to negotiate and compromise on this um and if that
was granted if we could reach an acceptable compromise they would be in support of the project
one last thing it does not have a hundred percent lot coverage if it's the third fourth
fifth six seven floors there is the cut out they know it so to say it's a hundred percent
law coverage is incorrect sure i think we i think we established that at the last hearing it's it's
20 open over um and 25 is required uh so we could you know look at what a setback would
comp would look at at that extra five percent too mr marionni uh the testimony was just given by
uh splizak i'm probably mispronouncing that i apologize has that been given to uh you you
under your client? Are you aware of that? Yes, my client has spoken to Ms. Bozillo's clients. I
think they said that, and they did have discussions, and they talked about possible
compromises, but when I spoke to my client, he said that he could not, he could not, he gave them
a proposal. They rejected his proposal, and he rejected their proposal, so they did have
discussions about it, Mr. Chairman. I just wanted to make sure on the record that that's established.
thank you uh jennifer any more uh any other witnesses for you um i do not believe so
all right i just want to make an announcement it is now about 11 15 approximately we have
numerous other cases uh i would ask that the attorneys and if you have your witnesses to
please try to be as brief as possible not because the board doesn't care to hear what you have to
say or is not doesn't think it's important but at the rate we're going i suspect this this hearing
may have to be continued again because we're required to take a break for the employees
uh who from the zone employees from or part of the zoning process will need a break at a certain

the theme that came through loud and clear from the earlier testimony
was that there was no communication with some of the neighbors and that holds true for
was that there was no communication with some of the neighbors, and that holds true for the individual who is the largest property owner adjacent or close to the building, and that's Mr. Reinhold.
He owns the Chocolate Works, which would be impacted by any of the developments, but when you heard the last witness say, well, just do this, it would also have an impact on the Chocolate Works.

I am a real estate developer, owner, manager, primarily of multifamily apartment buildings.
And do you have multifamily apartment buildings in the city of Philadelphia?
Yes, we have five buildings in the city of Philadelphia.
Consisting of approximately how many units?
Just about 800 units.
And one of the units that you own is the Chocolate Works, is that correct?
One of the properties is the Chocolate Works, correct.
Where is that located and specifically where in relation to the application on Vine Street?
So the building's legal address is 231 47 North 3rd Street. It is located directly to the south across New Street from the rear of the Painted Bride.
And approximately how wide is New Street?
New Street is a 20-foot wide street. It has parking for one part of it, and then one lane, one way, I guess, west to east.
And how many units are at the Chocolate Works?
It's 135.
And how many of those units will face north?
North. So the north-facing units, there are 27 north-facing units, and north-facing units
obviously look onto the Painted Bride site. And do they also look at various spots,
both east and west, from those apartments? No, they do not. All right. And since you learned
of this proposal for Lyon Street, has the developer or any representative of the developer
reached out to you and had any discussions with you? No. And we appeared at the last listing of
the zoning hearing. And since that time, I presume there's not been any outreach. Is that correct?
That's correct. So there's been no communication between you and the developer, but have you had
communications with the RCO? I spoke with the RCO in I guess it was late January but I haven't
really had much communication at all since then. So please describe for the chair and the board
members the impact that you believe this proposal as it is proposed now not various and sundry
alterations or amendments to it what the impact of the proposed building would be on the chocolate
works yeah i i'd like to do that may i share my screen so that i can show this yes may i okay
just give them a minute okay
and while you're doing that i'll take just that moment to say there was an argument earlier mr
chair about the public policy and i understand that but the public policy is also that the
the impact of any zoning on the community is paramount,
not the impact on potential public art.

can you see it now no it's saying yep there we go you're up okay um it's just it's just a lot
easier for me and I can be briefer chairman to Chico I think if I can if I can show this
um so this is the north elevation of the chocolate works property and so this is looking from
um the painted bride uh to the north and looking to this elevation this is the north side
of the property and you can see the heights here um there are the the chocolate works property is
actually four or five properties that were put together, the former home of the Wilbur Chocolate
Factory back in 1985. So you can see that there's, it looks like two distinct buildings here.
The front part is about 91 feet to the parapet, and the rear portion, the majority of the north
elevation is about 80 feet to the parapet. What I'd like to do is just show you what the impact
will be on this north elevation on these apartments and these windows and views and light
and air based on the as right development and then with variances.
So this is the property, the proposed development as I know it from the presentations that have been
made by the developer.
You can see there's a line that shows you the 65 feet height.
And then you can see that it's higher than that,
which represents the elevator and the pilot house
and the stairwell.
And so this is the as by right development
with setbacks, which is required, as you all know, CMX3.
And then the next slide is the proposed with the requested variances, no setbacks, additional height, and from the prior testimony, we heard that to the power pit, I mean, it's about 88 feet.
and then, of course, the pilot house, elevator, and others, you will see that this property will
be up to about 100 feet at its highest elevation. Now, what I'm showing you now is by right in the
green and with the variances and the impact that it has on the Chocolate Works on the northern
elevation. As I've already said, there's 27 apartments on this side of the building.
They'll all be impacted in some way by this, but 11 of these apartments will be negatively impacted
if the variances are granted and the larger structure is built. And I would just like to say
just a couple of things about the proposed development. We've already heard testimony
about the second floor and the second floor if you look you can see here where these notches are
the second floor are the proposed keyed rooms or what I will call transient rooms
with balconies and that balcony looks directly was on the south side of the of this project but
looks directly over to the north side of my building so what we have is our transient keyed
rooms with balconies. You've already heard testimony about, about, you know, Airbnb and
party rooms. They tend to be party rooms and there's 10 of them. That'll certainly have a
significant negative impact to the residents on the other side of, of, of new street, which by
the way, the, the, the, the distance between these two buildings is no more, or is, is, is,
it's about 40 feet um so so i would excuse me for interrupting i was going to ask that question so
that the south side of the proposed building yes will be facing the north side of the chocolate
works correct and what is the distance between those two buildings at that so new street's 20
feet the existing sidewalk and i don't know this as a fact uh chairman de chico but i'm assuming
a 10 foot sidewalk will stay there there's a 10 foot sidewalk on the chocolate work side so a total
40 feet that's the distance so so the
that's the distance so so the the first thing about the design is this second floor with balcony
um for transient rooms and quite frankly they're they're they're party rooms um especially on
weekends and and and they they are a nuisance people have already testified to that um the
second thing about the project is that on the seventh floor there are balconies
But on the roof, there are planned two roof decks, two large roof decks, as well as, as you would expect, the HVAC systems, which look like to be heat pumps, so heat pump farms.
There is nothing in the design that, you know, mitigates the noise or sound that will definitely come from roof decks and from the HVAC systems.
I guess I can't see it. But that has a significant impact. And the decks are enormous, which is, I guess, great for residents. But unless, you know, we understand what they're going to do regarding buffering noise and hours of operation, there will be certainly a significant nuisance to residents living, you know, 40 feet from the property.
I want to object that there's no, that they're going to be a nuisance.
I got to object to that. That's speculation.
Stipulation. Sustained.
Well, I will only say in my opinion of operating buildings with roof decks,
that we really need to control the hours.
And quite frankly, I haven't seen a building yet that has the size of the,
basically the entire roof, except for the,
the need for the HVAC systems and the pilot has our roof deck. So it's significant,
it's substantial, and I do believe that they have the potential to be noisy.
So that's my opinion anyway. So that's the issue. Do you believe that the proposed development
it would have, as you've described, a negative economic impact on the chocolate works based
on your experience as a residential landlord and residential property owner, department
property owner here in the city of Philadelphia.
And if so, what that impact would be.
So the impact, if you look at these outlines, you can see, look, by right, what you see
and green is what can be built. What I'll talk to is the negative impact from the additional height,
the balconies, the decks, things of that nature. And the additional height and mass of this
property will affect 11 units. And what it'll do is it'll cause increased turnover.
there'll be darker units and I understand the shadow study but it's not just shadow that impacts
light it's it's it's it's the indirect light that that that that has an impact on a building
some people spoke to that earlier so it impacts about 11 of the apartments and quite frankly
just going higher and wider impacts all views from all of the 27 on that side so the significant
it's a significant impact and would have a significant economic impact on on the property
on our ability to rent the units and most likely the rent that we would receive
from those units that are impacted. Thank you. Mr. Reinholder, is there anything else you wish
to advise the board of? Yeah, I, you know, look, I, I, I understand what, you know, what can be
done by right. What I, what I, what I just don't understand is a couple of things. There was never
any outreach by this developer, yet we are the one of the nearest neighbors and probably have
the largest building that's impacted, directly impacted by this development. And it has just
been no outreach. And I don't see anything from the design that has been included in this project
to help mitigate the obvious issues here and potential issues for the neighborhood. I just
see that there's just been really a total lack of communication. And I've heard that from the
other testimony starting in April. And it's highly unusual, in my opinion, as a real estate
as a real estate developer and in my opinion as someone who's been in front of this board
developer and, in my opinion, as someone who's been in front of this board.
and been and have worked and has worked collaboratively with rcos highly unusual
i have nothing further mr chair thank you uh if we could take down that screen mr
reinhold that would be helpful okay thank you for your testimony uh i'm looking are there

than 40 years and my first job in Philadelphia was at the Pennsylvania Academy of the Fine Arts. I
was 10 years the curator of American art there. That's when I first met Isaiah Zagar. And since
2002, I have been the head of the Department of American Art at the Philadelphia Museum of Art.
So I've watched Isaiah Zagar and his work for decades. And I've given a lot of thought to
Philadelphia and its artistic traditions and its history in the arts. I've also, in other capacities,
served as an arts commissioner and as a historic preservation commissioner. So I think it's
pretty clear what side I'm on here. I'm going to defend the mosaics as an important artwork
and as an important piece of Philadelphia's culture and important to its sense of place.
And I'm not going to repeat really arguments that have been made before. What I'm bringing here is
the longer perspective of an art historian and a museum curator who's been watching Isaiah Zagar.
And I'd like to make this statement just because I think the choices here are not just about the
neighborhood, and I'm full of respect for the neighbors' concerns, but I do think that the
decisions here affect the artist's legacy and the city's heritage. So first about the artist's
legacy, I think we all know or remember now that the Painted Bride was Zagar's first big public
monumental project. He made it over nine years. It's gigantic, and it basically has transformed
what was a really plain vernacular building into something very special, something remarkable and
memorable, truly fabulous. And it is not, to go against the earlier comments, it is not just one
of 220 mosaics that Mr. Zagar has made in the city. It is one of his two most important mosaics
in his career. And so to the comments earlier about the Sistine ceiling, I would say if you
I would say if you had the Sistine ceiling, would you say, well, that's fine. We'll just break up the David because we've already got a good work by Michelangelo. We don't really need his second work. So I'm saying we need both of these. They're both fabulous and important.

Then I would say that it is a signature piece for the artist. It's a landmark, an accomplishment in his career, and it's a signature also for this neighborhood. I think it's a marker of the Bohemian high spirits of the 1990s in this neighborhood, of the success of the Painted Bride in its early days, the revitalization of the Old City.
all of this, I think, is in this particular work of art. And I think because of the rapid
development of this neighborhood, we are at risk of losing this special character, of losing this
history of the neighborhood. And this is a building that especially reminds us of the
spunk of Philadelphia, of the artists who live among us, of the artists who transformed this
neighborhood. And so if we lose these mosaics, I think we're going to lose a major achievement
by an internationally recognized artist in our midst.
I think it would be awful for the city
to allow the destruction of this mural
when an alternate plan exists.
And I would say also, I'm a little skeptical
about the terminology here of development,
negotiation, saving portions of the mural.
I don't think you can save portions of this.
I think it's a total work of art.
and I shudder by the idea that somehow fragments of it would be saved in a new plan.
So I think that we would, I would love to approve, you would approve this creative plan. I think that
has been proposed by the architect, an elegant solution that has been recommended by architectural
critics. I think the variance that protects the murals and maintains the artistic spirit of both
the murals and the legacy of the Painted Bride. Now, as a last note, I would just like to comment
on the continual evocation of the fact that the murals were not protected at the Historic
Preservation Board. I would like everybody to be remembering then that the ruling recognized it was
a tie vote, and the chairman voted in favor of the Painted Bride, that is to not designate the
murals, recognizing the hardship of the painted bride. And that was what changed the vote there.
And many of the commissioners felt that the painted bride would be in stress if they had to
protect the murals. At this moment, the painted bride is on the side of this development. They
are actually not speaking at this hearing because they are supporting this proposal. And so the
situation that occurred during the Historic Preservation Commission, I think, has been
resolved and they are happy now to see a proposal that would both um protect and acknowledge the
historic and um and artistic importance of the murals thank you very much

follow-up question of miss foster this jennifer visit low yes um miss foster i just want to
clarify you are not a resident of the neighborhood correct i am not i'm a resident of fairmount thank

in the neighborhood of Old City. We often think of diversity as people, but diversity is also
place. One of the reasons I moved to and like living in Old City is the diversity of the built
environment. It's not just a sea of residential. You can walk to shopping. You can walk to
restaurants. You can walk to art galleries. Many of those places don't just exist, but also
host events that are interesting and different, and you get to mingle and interact with people
both from your neighborhood and from outside. Just as an example of the corner where I live
at 2nd and Vine. One corner is open because it's the PennDOT right-of-way. On the other three
corners in the last four or five years, one corner has built three large townhouses, one has built
six large townhouses, and the other one was the gas station, which is about to build 11 large
townhouses. That's not
That's not very diverse. And I think that as we lose commercial spaces in the neighborhood and they all become residential, we lose a lot of the character of the neighborhood.

And I would like to see this proposal go forward because it not only adds new residential, but it does so without sacrificing and tearing down the ground floor space that would be preserved at the Painted Bride.

So with that, we'll just summarize quickly why we're here.
So we're here for several dimensional variances involving a property that's been placed on the historic list in Philadelphia, and the property is approximately a 13,919 square foot property zoned RSD3, and it's located at 348 Green Lane.
And as you'll hear from Mr. Bailey, immediately or soon after he purchased the property, the community put it on the historic list.
The property is a large 4,000 plus square foot existing historic structure that was converted prior to Mr. Bailey's ownership into five apartments.
The historic designation, the age of the property, the upkeep and maintenance that he's already placed into the building and that he plans to do with the building, as he'll tell you, has created an unreasonable burden on him and creates a hardship in which he is proposing two houses situated to attach single-family dwellings.
situated to the rear of the property, each with a 2,336 square foot lot and a 2,182 square foot
lot. And with that development of the rear portion of the property, it will leave the existing
structure on a compliant 9,400 square foot lot. And as you'll see, put two houses in the rear of
the property. Henry's worked with the community groups and he'll tell you since 2018 to try to
come up with a solution to the dimensional variance requests and to resolve the hardship
that he faces in owning and maintaining the historic structure to the level that he would
like to to bring it back for uh in the neighborhood so with that i'll put um ask henry bailey to

I do. I'm a general contractor, property manager. I'm very familiar with the neighborhood. I was a resident down the street for some time, and my office was in Manion prior to COVID.
stone door llc purchased 348 green lane in may of 2018 our plan is to maintain and restore the large
old home the home was built in 1872 it's pretty old it's once a single family
residence pretty massive because of its immense size the building was operated
as a five-unit apartment building for decades the building still has many great details but
needs some work to restore and maintain.
We hope to keep the home for years and years to come.
Right after we bought the property,
Central Roxborough Civic Association
nominated 348 Green Lane for historic designation.
Once we found out, we supported it.
We attended a couple of meetings
with the historic commission and the CRCA.
And ultimately the end of 2018,
it was officially designated and accepted.
we purchased the home in fair condition in 2018 for $580,000 and up until now we've made
around $180,000 in improvements already we're seeking to make more improvements to the property
that will restore the exterior of the house and the surrounding landscape when we bought the
property we we did our due diligence but really had no idea what we were in for at the time
we began improvements as soon as we uh immediately after purchase and um to get the vacant units
turned over during the first year we had more vacancies and just tried to systematically go
through and address each problem in each unit during the process of updating the units we
uncovered many deferred maintenance issues a massive leak in the deteriorated chimney for
instance was found to have been going on for years and we had to redo the affected floors
and ceilings on that side of the house, had to rebuild the chimney inside and reintegrate it
with the heating system for all of the units. We also uncovered squirrel infestation, which
was not fun. I've never done that before. We had multiple roof leaks, problems with the electrical
system. Recently, we found out that the underground terracotta drain line that ran
across the front yard was cracked out to the street. We had to run a new iron main drain
underground to the street. So those are a couple of the issues we ran into. Of course,
with a building this size, upkeep and regular maintenance is substantial without surprises,
like I've mentioned. During our ownership, we kept busy inside. The exterior still needs a lot
of attention. Much of the outside woodwork and stonework is failing and needs restoration.
but the exterior work is more costly now to repair due to our historic designation.
I've been in GC for 15 years, and in the past, I've worked with many homeowners in the area
to restore their properties. I'm aware of how restoring a home benefits the neighborhood as a
whole. Meeting with the CRCA over the past three years, they prioritized restoration with me as
well. They made it clear that any subdivision of this property must include a plan for
improving the existing home and grounds, and I agreed to that. We met with this RCO 11 times,
and each time we reacted to their comments, changed the plan. We had several architectural
contracts for this project over the last three years as we abandoned old designs,
scrapped things, and came up with new things. Henry, let me stop you right there.
So right now, the proposal, and it's up on the screen, is for two homes facing DuPont Street, and that's to the rear of the existing property.
And then the home itself faces Green Lane, right?
Correct.
Which is the existing service.
Now, originally, in 2018, when you first proposed what?
And by the way, Derek Spencer has and we can we can show these plans now.
We'll show the plans you originally proposed.
And we're I believe it was we're showing 2019.
And we're, I believe it was, we're showing 2019. Hold on one second. We're showing part of exhibit C, which was a page in the zoning presentation that shows it's a sheet.

This was a large study about an addition, a by-right addition that we did not pursue, not believe it's anything we'd be wanting to do.
And that's an addition to what, Henry?

That was just a study the architect did, and it's, I mean, it speaks for itself.
The four units on the lower left-hand corner was our first presentation to the CRCA.
We got the feedback that they wanted to reduce the density.

I mean, the point of the proposal is that each time, and we can put into the record each time that we met and the RCO confirms it, each time that we met with the RCO, the RCO proposed changes and we reacted to those changes.
And Mr. Bailey and Derek Spencer would testify that at first they wanted, you know, certain units, we wanted units facing Maniunk.
Then we were brought down from four to three, then three to two.
Then in 2020, the RCO asked Mr. Bailey to reorient, you know, toward DuPont Street, which he complied with.
And this in front of you is the proposal that you see now with the dimensional variances.
And that's really all the testimony that I have for Mr. Bailey. I open them up to questions, but I think you get the gist and we can move on, I think, to let me ask, actually, Mr. Bailey, a couple more questions.
So, Mr. Bailey, in the future, to accommodate the restoration that you would like to do to the existing historic structure, you cannot accommodate those improvements just through rent on the existing apartment building, correct?
Correct.
And so you need a reasonable use of the nearly 5,000 square foot area that's currently unused in the rear of the property to enable you to consistently maintain and improve the historic structure currently at 348.

the existing property um update get the failing stone work done fix the cornice work put a um
a traditional historic paint job on the place fix the roof fix the gutters fix the lighting
um it's the inside's getting squared away as you know as we go along but the outside is
it needs it needs i mean this is this is the way it should be and and you and you went so far
as to get uh commitments and quotes from uh from contractors to do this work correct
Correct. And it was $63,000 for painting and carpentry. Yes. It was $24,000 for landscaping.
Yes. And stone facade work, etc. Another $8,000, correct? Stone in the front and side. Yep. And
then you were also going to fix the stone fence around the house, correct? That's part of the
the masonry yes so it's basically over for about another hundred thousand or over a hundred thousand
So it's basically over or about another $100,000 or over $100,000 worth of repairs that you were willing to do to repair and restore the exterior of the structure, correct?
And in your opinion, as a builder and as a property owner, would that increase the value of neighboring properties, do you think?
Just know what my objections is.
how do you think that would affect the value of neighboring properties?
I'm, you know, I've been doing this a while. I'm not, I mean, I'm of course going to benefit from
it, but as if, you know, related properties are in the neighborhood, a benefit from beautification
of other properties. I mean, it's just, that's what you call the fabric of the neighborhood.
And you think that knowing the work that you've done in the neighborhood, that this kind of
restoration do you think that that would bring the building you know into compliance with the
characteristics of the neighborhood i believe so more so than it is now certainly it needs work

purposes? That's correct. I see on the refusal that those five units included a doctor's office
with a doctor residing on premises is that still the case at the property no doctor resides at the
premises was there ever there was never a doctor's office while you own since 2018 right no okay so
this is a five unit building you'd agree that it's in an rsd3 zone which is a single family zone
yes okay um and you told us about the improvements you have done and the improvements you've priced
and intend to do is that your testimony today that that's the hardship that uh you believe
warrants a variance that you're seeking today yes okay uh there's no other hardship at this
property that um you can't comply with rsd actually the building itself is complying with rsd
but for your five units right i mean i don't know if i understand the question

and derek uh after you subdivide um the property uh what is the square footage of the property
that's remaining that the single family home will sit on um the single family or the remaining

And the minimum square footage for RSD 3, where this is located, is what?
I believe it's 5,000 square feet.
So the lot, even after the subdivision, will still comply, correct?
Correct. Yes, I believe everything around the five-unit building will still comply with RSD 3.
Now talk about what's proposed in the rear.
In the rear, we have two single-family homes, kind of in a twin-style arrangement.
Through conversations with the community group early on with what they wanted to see on the site was,
if you take a look at the zoning map, actually a little bit, a few pages before this,
you'll see that the site is surrounded by RSA3 and RSA5 lots.
So we were kind of designing in the spirit of RSA3,
which is matching a lot of the context along Manny Yonk Ave.
You'll see there's a lot of twin-style homes that are set back from the street with green space on all sides.
So that was the original intent going in here was to create semi-detached single-family homes
that kind of fit into that fabric of RSA 3, which is the majority of the surrounding context.
Just known by objection.

of the um characteristic of the neighborhood and the surrounding
zoning since it's irrelevant we are dealing with an rsd plot

So, Derek, so what's proposed are 2,336.9 square feet and 2,182.5 square foot lots in the rear of the property, correct?
Correct.
And how do they compare them to the zoning for an RSA 3 and RSA 5? Do they meet those zoning if they were located in those zoning districts? They would meet that zoning requirement?
Yes, they would.
Great. And so I have up on the screen, I have the proposed landscaping plan, which shows, you know, some of the improvements for the surrounding area. Can you walk us through some of the landscaping and some of the things that are proposed on that plan?
Sure. This plan was not actually presented by us. We did not create this plan. Henry had a landscape designer do this, but I can walk you through some of the concepts here, which are the community wanted to see a good amount of green space around the homes.
The homes were actually originally split with an even side yard on either side of the homes.
Community group members wanted to see the view cones and the view lines from the intersection at DuPont, not to be blocked from the existing building.
So we actually pushed the homes further away from Maniunk Ave, giving a slightly larger side yard for that home at the corner.
But we have landscaping around all sides.
We are proposing to keep as many of the existing trees on the site as possible.
I believe that large tree there kind of in the center of the site is existing.
All new plantings are what you can see down there at the bottom in terms of local native species.
That's great. And so I'm going to show you what's marked in the exhibit packet
as proposed rendering presented to PHC.
is that the rendering that's currently proposed?
Yeah, this is the most current iteration of the rendering.
You know, we worked with Henry and the community group
to pick materials that speak back to the original home.
It was the desire of the community group
to kind of hide a lot of the mass of the building
within a gable roof form.
So it doesn't look expressly like a three-story building
from the front, which is where the roof form came from.
But, you know, as we've, as we're going to be discussing here, the historic nature of this, you know, we are going to have to go through the full historic process for all exterior materials.
And that discussion will still be ongoing even, you know, after the zoning process.
And so in the community group letter, if I can just summarize, they object largely to what I would consider.
object largely to what I would consider architectural or characteristics. And do you
think that those could change even with future discussions with the Historic Commission and
the community after the zoning is granted? Yes, absolutely. It'll have to change as we
go through the historic commission process and so um the community made a uh and the historic
commission have made um different points about roofs and different roof types um did you consider
different roof types as you went through and um are you still considering different roof types
And I'm showing I'm showing. Excuse me, excuse me, for the sake of time.
OK, the historical commission will settle. OK, I appreciate it.
OK, Derek, let's go to the refusals then and and what we're here for today for the zoning commission.
And let's talk about the different refusals that are for these for the new houses that we're proposing.
okay yes um i believe most of the most if not all of the refusals are centered around the
dimensional variances um as an rsd3 which is what we are zoned um semi-detached structures are not
allowed they need to be fully detached and we are proposing a semi semi two semi-detached structures
um and the required setbacks um for front yard and side yard i believe are not met
And what about the refusal for private residents' parking garages? We're going to be providing off-street parking in these houses, correct?
Correct, yes. There are two-car garages for both homes.
Correct. And there's also a refusal for steep slopes. Could you speak about that?
Yeah, there are no expressly steep slope areas on the site. We are proposing a new, essentially a curb cut and a cut through the retaining wall that's at the perimeter of the property. It's a bit of a technicality because technically at a retaining wall, you have 100% slope because it's a complete vertical drop off. So being that we are disturbing an area of slope that is over, I believe, 25%, that's hitting us with that refusal.
Derek, you heard Mr. Wise question, Mr. Bailey, about hardship and Mr. Bailey testified about the economic part of the hardship that he's facing with this property.
But what hardship do you see relative to this property and its current state that justifies a subdivision and the dimensional variances that we're asking for?
um i mean i'm not a property developer or contractor so i'm not sure if i can speak
to the actual hardships that are on the site i think there is an unusually large amount of
open space in the rear here that you know could definitely be utilized and i think this proposal
um you know it matches i think the density and the style of home that is within the area and i
think fits well with the fabric. So you're saying comparatively speaking, this property is unusually
large compared to others in the area? I have to object to the leading question, Mr. Chair.
I think it's an appropriate question because that comes up often that people will say that
the proposal is out of character. I think Mr. Malloy is trying to establish that this is not
an unusual uh not going to be an unusual uh house that's being built in this neighbor i think that's
where he's going mr molloy that is correct uh mr chair that's exactly where i'm going with respect
to the character uh of this lot uh before and after the proposed development
yeah i mean i think it's pretty rare to see a property um in the city limits but with this
much open space on the site. And as I stated earlier, the twin style single family homes
fit with a large number of the contextual buildings on the site. If you go down
Manny Yonk Avenue, it's pretty much exclusively twin style single family homes.
So Derek, a couple of questions from the zoning ordinance. Do you think this is the,
if this variance is authorized, is this the minimum variance that will afford the relief
and represent the least modification possible to the dimensional regulations at issue?
Yes, I do.
Will the grant of this variant substantially increase congestion in public streets or
Will the grant of this variant substantially increase congestion in public streets or increase danger of fire or otherwise endanger public health, safety, or welfare?
No, it won't.
Will the variants substantially or permanently injure the appropriate use of adjacent conforming property or impair adequate supply of lighter air to adjacent conforming property?
I don't think it'll have much of an impact on adjacent properties being that it's set back from all sides.
Will the grant of a variance adversely affect transportation or unduly burdened water store, school park, or other public facilities?
Will it adversely or substantially affect implementation or adoption of a plan for the area where the property is located?
And will it significantly, will it cause any significant environmental damage, pollution, erosion, or siltation, and will not increase the danger of flooding during after construction? And will we take measures to minimize damage? And I think you could just say, there might be yeses and nos there.
There may be yeses and noes, but as part of the building permit process, we will be required to provide an IRSA plan to show erosion and settlement control on the site during construction.
So those things will be handy.

You understand that the lot we're discussing is RSD 3, detached homes?

And the refusal on this application is based on the fact that you're suggesting, you're proposing attached homes in an RSD property, right?

You said that as proposed, this is the minimum variance.
First of all, the hardship you testified about was the size of the property being larger.

Yes, we did look at it with the required setbacks. You'd be left with a seven foot wide home.
But that would be a more minimum variance to propose one house compared with two houses, right?
it would be less yes you also I also think it would be unfeasible you you also well well you
could apply for variances though for a lower density proposal couldn't you of course which
and the uh you stated that adding these homes will not increase uh the traffic or congestion
at this location by definition there will be more people on the plot right um yes there will be more
people on the land. You also testified that the proposed project would not affect any adopted
plan, but your refusal contains a refusal from the specific NCO in Central Roxborough being
the driveway, right? Objection. The driveway was asked for by the community group members. They
did not want any of the added density on the site to affect on-street parking.
Okay. Well, we might hear from them. But you agree. Well, the wall, you mentioned the steep slope being the wall. That wall is also part of the historic designation, right?
That's correct. And in our initial historic meeting, we had conversations with them and talked about that at the next historic meeting, we would need details on how the opening was treated in terms of keeping it consistent with other openings in the wall.

How much of the wall is retained or not retained around the front of these new proposed properties on fronting on DuPont, I believe, right?
Yeah. So, I mean, the, the wall wraps the, the entire perimeter of the site.
We have a 42 inch opening for pedestrian access on the DuPont side.
and if we can zoom in possibly on that um driveway access i believe it's a 12 foot
proposed opening for the cars okay so some of that's going away with this project right

All right. And I will try to keep it brief. I understand everyone wants to, especially staff, want to go to lunch.
So I'll try to keep it as brief as possible.
Again, my name is Alan Ockamson. I'm here to present 5002 North 12th Street, which is a few blocks off of the commercial corridor, as we know it, of North Broad Street, and also half a block off a commercial corridor called Lindley Avenue.
So with me is the property owner, Rita Morgan.
A little background about Rita.
She's a nursing aide, and she is looking to use this property, convert it from an RSA
3 property to make it multifamily three units, one of which of the units she will personally
live in herself.
And I know the board frowns upon this, but she did not start the correct way.
at the time when she purchased the property she like did not know that she had to go through this
whole process and she did not have counsel did she not have an architect she worked with a
contractor who led her afoul where she started the work so the work that's inside there it's
already framed out when she purchased the property too she understood that she didn't
she didn't understand that she needed to go through this whole process so we'll go through
the materials, but you'll see that there are 32 properties on this block, 14 of which are
multifamily. The multifamily that we're proposing is not out of character with the neighborhood.
So you'll see in the table of contents, a detailed property, certificate of tax clearance, notice of refusal, application for appeal, maps of the area, photographs of the property, as well as the surrounding area, plans and drawings, nearby properties with multifamily history, a petition she'd circulated to nearby neighbors.
So you'll see in the table of contents, a detailed property, certificate of tax clearance,
notice of refusal.
And you'll see from the map how close those nearby neighbors are in comparison to where the property is, letters of support she got from nearby neighbors as well, as well as correspondence from the Logan Civic Association.
So, again, Rita Morgan purchased this property in April of 2020.
And, again, when she purchased the property, she was looking to do it as, like, where she can renovate a property, live in it herself, be able to afford to live in it by, you know, having income from the rentals, you know, in that building.
So, she's in good standing with the city of Philadelphia.
Again, this is our RSA3 property.
we're not looking to expand the building structure in any way this is a three-story structure where
she's you know going to be living on on the first floor you know in the lower level you'll see also
pictures that in the lower level in the rear there's a set of steps that go up from a safety
perspective i know the board really cares about that but miss you know miss morgan will be living
the first floor and lower level but she does have the safety built into the property of way
is configured our application for appeal
and then just maps of the area as you can see we are not that far off of broad street
we are this is where lindley is we're near public transportation and then photographs of the
property this is a three-story structure at 5002 north 12th street she's not changing in the
outside physical characteristics. You'll see properties to the right of the property on North
12th, properties to the left on North 12th. You can see her backyard. This was taken some time
ago. You can see the snow, but we were originally here in March when it did snow, and then we had
a postponement. What you'll see here, most importantly, is the set of steps that's leading
out of the lower level so she has direct access uh where she can get out or whomever lives there
can get out uh and you know safely and then here are plans i'm just going to make a little smaller
so i apologize if you can't see uh you walk in you go up there's two doors one will be her unit
where you go into living room bedroom in the kitchen open floor plan and then a lower level
where she'll have like a little family room and a little office down there or some type of
transitional space. You go up a flight of steps. Second floor is two bedrooms, one bath. Third
floor is two bedrooms, one bath. No roof deck, no change in characteristics of the property.
If you look, again, my philosophy in zoning variance practice is if you walk by the property
used as proposed and it doesn't stick out like a sore thumb and fits within the character of a
neighborhood, then that's something that makes sense most times. So again, 32 properties on this
block and 14 of which, and I have some on the 4,900 block, which I haven't counted, but on 14
of the 32, not including ours, are multifamily in nature. We're proposing three units. This is
a property that's almost 2,000 square feet. The lot size is 1974. And as you can see, there are
many, many properties on this block with similar characteristics with, you know, similar uses.
And then here are just some pictures of some nearby multifamily, five, you know, again,
but if you look at the ones here, 5001, 3, 6, 7, 12, 13, 14, 18, 20, 21, 22, 25, 26, 29,
all on North 12th Street are a multifamily in nature. Also, if you go on the, you go on Atlas,
You look at the L&I file, you'll see that this has a three-unit history, two residential, and one tailorshaft back in this past.
So this is not a property that has a significant and sole residential single-family use.
It has been used multifamily in the past.
Here are some pictures.

uh 22 is a triplex 28 is a triplex 29 to triplex 31 to triplex now we did meet like because we had
difficulties like usually it's the other way around but my client's a little elderly so she
was having problems getting on the community meeting via zoom um so there were some issues
um so there were some issues with that and quite honestly the community meeting did not go as we
with that and quite honestly the community meeting did not go
planned we did not expect to have these issues but we then circ and we tried to get a new community
meeting given the fact that my client was unable to participate fully um but we can never that was
one of the reasons why we asked for a continuance was to try to have a second community meeting
unfortunately that was unable to happen because the group did not want to meet so we took it upon
ourselves to reach out to the community ourselves so the petition addresses and the letter of
support so if you look at this we're the green which you can barely see but all these addresses
which surround us and these down here are people who supported us for our project so
and then here's a copy of the petition as well with the signatures
and then the letters of support
And then we did meet with the Logan, you know, Square, Logan, sorry, Civic Association.
It seems from their letter, there was only one nearby, I'm just taking base on their letter, but there was one nearby neighbor who was within the affected area who was present, only one.
There were 15 people there, don't know what the vote count was, it doesn't really state, but their explanation is we oppose, we want to keep the community single family dwellings in the neighborhood.
there are too many multifamily dwellings that exist on this block. I hear you. I get it. I
live in the neighborhood in Philadelphia, just like these individuals do, and they have every
right to state that. It would just be financially devastating for Ms. Morgan. Again, she dumped her
life savings into this already, and she purchased the property not knowing any better. So we really
ask the board for mercy here for Ms. Morgan. She's not a developer client of mine. She's just a
a normal person who wants who bought a property expecting to live in one unit having the other one
to pay for her mortgage so with that being said um again i try to speed it up as much as possible
i have miss morgan on the phone or on zoom so if miss morgan if you can virtually raise your hand

thank you Mr. Chair members of the board Hillary Emerson on behalf of Councilwoman
Sherelle Parker and with staff so the Councilwoman is opposed to the
requested variance for three units at this property. She feels it is an overuse of the
property. The property was purchased as a single-family dwelling, and there has been no
non-economic or non-financial hardship shown for why this cannot remain a single-family dwelling.
um there are um some there are a number of hold on guys there are a number of multi-family
dwellings on the block but the community indicated that they wish to retain um single
family dwellings on the block where they could um and the neighbor the near neighbor who was
present at the meeting was one, was a single family homeowner herself. And I just wanted to
note to them on the list that Mr. Nockamson had provided of single of the multifamily dwellings,
I looked at them. 5012, I didn't see any history that that was a multifamily dwelling or any
license history. For 5018, that was reduced to a single family dwelling in 2018. 5020 and 5021

this matter
this appeal was an accelerated appeal with the first hearing being in January 27th of this year.
Prior to that, there was two community meetings with the East Falls Community Council. At the
initial hearing, the East Falls Community Council did oppose a variance request for multiple
reasons, one of which including some, I guess, miscommunication and confusion regarding the
use on the second level of the proposed structure, which was an accessory dwelling unit above two
parking spaces. Since at that hearing, because of that confusion, and in addition to multiple
dimensional issues that the East Falls Community Council had with the proposed project.
The board allowed us to go back to LNI to obtain a revised refusal and to also make
revisions to the project to the highlighted comments of East Falls Community Council and
to the highlighted comments of East Falls Community Council and some of the community concerns.

We did that subsequent to the board hearing this project. At the time when we went back to L&I,
they reassessed the entire project under this use and then issued a new refusal. We didn't receive
the new refusal until June. We passed it along to East Falls Community Council the same day
and requested a community meeting
so we could present the complete overhaul of the project.
At that time, we were informed
that they don't typically meet during the summer,
which was obviously problematic
because we had an August 3rd hearing.
And so that was sort of the initial issue.
Subsequent to that, we were informed
that they were able to meet um on july 21st unfortunately i had two rco community meetings
that night already and i said requested another date and um they weren't able to accommodate um
well apparently they weren't able to accommodate due to the continuance request um was the response
to that um so because this has been going going this application was in november of 2020 um we
believed um that we made basically every change that we made was in response to a comment that
they made um and we essentially got rid of almost every um refusal um except for two now um we we
that's why we initially opposed the request because again that was our first communication
about meeting since they couldn't meet on the 21st since then i was able to connect with um
the zoning chair, and I informed him that if we can be placed on their August 18th agenda,
that I will inform the board that we would be willing to, if possible, obviously I understand
the scheduling constraints of Ms. Sunk and her team, but I informed him that I would be willing
to not oppose the continuous request if we can maybe do it as a continued resumption sometime
time um after that meeting um i mean that said we're ready to go today but to sort of just
operate in good faith um and frankly we're really excited about about our redesigns um and we you
know we don't want to we're not here to hide it from anyone um but we just wanted to get a meeting
that's you know we didn't want to get continued down to december or anything like that for
something that we were ready to present to the community in june um and so that's where we sort
are today um since the since the rco made that request mr msunkit as tanya if if we were to do
a resumption hearing we hear the case and resume it and uh at which time we were making this
decision based on feedback from the rco what would be the earliest date
rough if you don't have a specific date i mean close

and have the another date scheduled only for reading of the new rco letter into the record
kind of where i was going i wanted to find out from tanya because
um according to mr batill he doesn't want this thing obviously to go to december i'm not saying

I have the cover page of my presentation package on screen now.
Basically, there are 12 sets of exhibits encompassing 36 pages.
I will not go over every exhibit, but I will start and scan down now.
The first exhibit that I will address is the refusal.
As you can see, we applied to legalize an existing nine-unit single-room residence.
I'd like the board to take a look at the refusal specifically.
You'll see that in 1944 that this property was used as a five-family dwelling.
That's almost 77 years ago.
You'll also see that in 1984, this use, which has continued, has been, was approved for a dwelling for nine single room residences.
The nine single room residences.
And I'll continue with my exhibit package now.
The next exhibit is the appeal, which I won't comment on.
Then we have what we call the project information form, which I won't comment.

Then we have the deed.
After the deed, I don't know why, but I wasn't really able to print the tax clearance, but I did print a sheet from the revenue department,
which shows a tax balance due of zero.
Here I have property information
which gives you details about the property.
As you can see, my client purchased this property in 1981
and the property is approximately 3,324 square feet.
the next exhibit is an exhibit that i threw in um commissioners i uh reached out to mr karn
in june i asked him to uh please provide me uh with a letter uh shortly thereafter somehow
my client's property got inspected and were issued several violations. The most damaging,
a fire code violation for the certification of the system. I would submit to you that in all
years previous to 2020, this system was certified. And as soon as that violation was issued,
my client called out the certifying company. They really weren't certifying last year and they came
and here is the current fire certification. We got the violation on 626 and on 7-9.
The examiner came out and looked over the system and certified the system again. I just really
wanted to be known that this place is not a fire hazard and that there aren't, although the examiner
hasn't come out again yet, there are no current fire code violations and those violations were
appealed. Commissioner, I believe this section is most important here. This section is what I call
the zoning archive history. And I'd like you to specifically look at the page that I'm showing
here, which shows that this property was legal for nine non-housekeeping units in 1985. So this
property has been existing as nine non-housekeeping units since that time. Unfortunately,
the person responsible for renewing the license every year failed, and we're all human, and we
have failures at one time or another. I just really also want to show you since 1944, you can
see this stamp here in the back that this property went from three apartments to five
apartments. It's always been, at least with the zoning history, it's always been a multifamily
dwelling. Here is just another L&I document which also shows us a legal five-family dwelling
at one point. That was in 1944. This was just a layout which is consistent with the layout
now since 1944. Here you can see in 1969 the case went to the board for some requested repairs. You
can see it was a single-room residence in 1969. Again also in 1969 you can see at least from here
it looks like it was four apartments then there were two apartments at least on the second floor
two apartments on the third floor. It doesn't really mention the first floor, so I can't tell
you what was on the first floor at that time. I just really want to show you that this property
and this use has always been used in this location here. The last document you can see also
is from, I believe that says 1942. And again, it shows in 1942, it was a rooming house. It has
two housekeeping units there and then it had three housekeeping units which would be a total of five
again here's another lni document which just shows a history for this property of multi-family
specifically in 1985 it was nine housekeeping units
here are commissioners is a statement of occupancy issued by the city of philadelphia back to 1985
so this use was recognized and it was approved at one time here we have commissioners and i'm
going just to flip it for you and i apologize i couldn't get it to scan the other way is what
is the layout of the property and the layout of the property is consistent from when
is the layout of the property. And the layout of the property is consistent from when it was first
being used. Currently, this is the basement. It's not used for any housing or anything.
It's just basically used for storage. We have the first floor here. You have two units on the first
floor. This is a community room here. And then we have a kitchen. On the second floor, we have three
units excuse me three rooming units and on the third floor we have three rooming units if somebody's
on the board doing math there you'll see it's only eight units at one point in time this large room
was two and it was condensed into one a counselor can i ask you how many i can't read it too good
but how many bathrooms there are three bathrooms there's one on each floor so they're common

This is a picture of the structure. It's a pretty big structure, and it has a garage back here.
There are a lot of missing spots on this block. There's not many houses.
There are about two, four, six, and then there's a commercial business at the end of the street.
The second is a picture down the side of the street.
That's Pacific Avenue. As you can see, there are not parking issues,
and there are plenty of places to park for the residents that live in the facility.
And I would submit that most of them don't have cars.
Here's a picture of Pacific Avenue and across the street.
As you can see, it's a block that has some disrepair on it.
It's not kept very well clean.
And across the street, I believe there's only maybe three or four structures on the whole block
And there are a lot of missing houses there that have probably been knocked down.
Down the street is a PHA facility, which houses residents and single-room residences.
And across the street is some commercial business, but not a lot.
And on the end, there's a store.
That's just another look down Pacific Street.
And that's another look down 22nd Street.
Same. And that's the commercial business on the end of the block that I referred to earlier.
Again, that's across the street, shows a vacant lot. There's a lot of missing houses in this area over here.
And as you can see, that's a better picture across the street. There is not a lot of activity going on there.

That was the first letter where we didn't set up the meeting.
And then there was the second letter where we had a meeting on October 1st.

And I must say that the negative votes really came from the board.
Thereafter, I did circulate petitions in the area.
As you can see, there are not a lot of houses on the block.
And I would submit to you at least 12 signatures on this petition are from the block that the houses reside on.
With that, I will submit to you that this property hasn't been used in use as a multifamily for at least 77 years, Commissioner.
This property was legal.
They failed to get a rental license, I don't know how many years ago, and the zoning lapsed.
The property now houses, though, six men.
They're in various states of health.
Some of them get disability, but the owner of the building does provide services.
She has one person who resides in this building who's responsible for the cleaning and just looking in on some of the men.
There are mechanisms to take them in there to their doctor's appointments and help filling out their social service type forms for anything that they may be.
There are mechanisms to take the men there to their.
The ages of these gentlemen that live in the house are from 55 to 68.
Commissioners, in that this property has been legal since at least 1944 for a five-unit multifamily, I'm suggesting that the use currently is much decreased.
commissioners until um june 26 of 2021 there were no outstanding violations on this property
and i will submit to you today that since june 26 my client has cleared these violations
and i have appealed them all and we're just waiting for an inspection
it provides a needed service to this community it provides a home for six individuals who can
pay affordable rent the rents for the rooms there are from 400 to 500 the owner provides services
and help with documents social service programs rides to hospital appointments at the meeting
The neighbors that actually came said the men were a good addition to the community, that they were helpful, they were not disrespectful, and that the property was not a problem in this community.
Commissioners, I did circulate those petitions, and I think a good amount of the neighbors, as they said in the meeting, had no objection to this use.
I like to say this is not a new use. So it's not adding to rooming houses in the community. It's been there since 1944. There are no parking problems. There are no disability density problems. There are no, not that I know of anyway, not that anybody expressed at the meeting.
there were no neighborhood complaints. Everybody thought fondly of the individuals that resided in
the house. And for those reasons, Commissioner, I'm going to ask that you grant this variance and
allow these individuals to remain in the home that they've lived in for many, many years
and not be put out on the street and become homeless and unable to afford a place to live
and a place to reside in these trying times.

variant um pretty much um primarily the reasons that the council office gave uh we also noticed
that after the testimony that this is a special occupant household and that the paperwork to
apply for that should have been completed. Also, it's pretty disturbing how long this house has
been illegal. There's illegal work done. To my knowledge, you cannot install bathrooms.
The question from the board member, Mr. Holloman, gave the result of three bathrooms,
gave the result of three bathrooms and you have to have plumbing permits for that so that means
and you have to have plumbing permits for that. So that means that there's illegal
that there's illegal work done in the home with no permits also coinciding with illegal use
as boarding house and or multi-family at various times over many decades also the rental license
if that is not applied for that means that lots of income for decades has been being collected
from these residents without paying Philadelphia business taxes and any other taxes that would
apply.
So we're opposed for those reasons, along with the reasons that we sent in.
One concern for safety is we don't understand how the house can be fire certified without
having legal zoning and legal occupancy allowed.
We don't really understand that, once again, for decades.

Going to what we sent in in written testimony, we are opposed to the variant because this type of use in our vicinity will represent overuse of the variant.
We're congested with illegal rooming houses, and a few that have been approved.
And we're having a horrific problem with dumping of household waste, mattresses, like every week, how many mattresses can a person buy and throw out?
and from rooming houses as reported by our neighbors and um the um the transfer and the
dumping burden is overwhelming many times we have no idea these are rooming houses we have
no way to find the owners we just don't know how to find them they could be houses that are in a
state or something and it's just a huge problem um you can summarize it okay mattress waste
household waste construction waste also this sort of use is not compliant with our philly 23
philly 2035 plan that we did participate in um for i guess a couple months also
this house can be converted as testified to by the council office um to transient occupancies
we understand now there's like special occupants but that could be converted to transient occupancy
that that point that that point was made by the councilwoman's office uh so if you could summarize
we agree with that and um and that's not um acceptable in the rsa3 district and um if if
the board does approve the use we're asking that we can come back to give um provide those and

and you should have letters from all three.

And so we certainly don't want to have a vote or anything taken before that happens.
And so if I can begin, I'll share my screen.

As was stated, my name is Steve Bertil.
I'm representing the owner and applicant for 3018 Midvale Avenue just to I know we slightly
refresh the board sort of on the procedural history of this matter when we're discussing
the continuance but I just want to touch base on the substantive aspect of it just to bring
everyone up to speed as you may recall this matter is like as I stated for 3018 Midvale
avenue that's situated on Midvale between Stokely and Fox Street. The property itself is
not uncommon to some of these larger parcels. It is actually sort of two distinct
lots, although they're under one tax ID number. So you'll see that this is deeded as a separate
area but it's one under one uh address and under one text id number um so the the the appeal for
this project as the board may recall was um for the legalization of a partially um constructed
rear structure um for uh parking um two parking spaces on the ground level and a our intention
at least, was for an accessory dwelling unit on the second level.
If the board remembers, there was, in fact, let me just show it.
if the board remembers there was in fact let me just show it so uh the board remembers the refusal
initially um the language on the refusal was uh a bit confusing um where it mentioned single
family use but it also mentions um storage um and therefore um there was at the the community
meetings that we had before our first zoning hearing on January of this year, there was some
confusion about that. Now, I should say for the record that the owner himself has maintained
completely throughout this entire process that his intention was to utilize this as a dwelling
unit on the second level, but the refusal didn't reflect that properly and thus the refusals that
were issued initially created some issues. And so the original refusal
here was for accessory parking and then also, excuse me, for the height of this structure,
which had a limit of 15 feet, and for the location of the residence, which was within three feet of
the adjacent property line. At the community meetings, in addition to the refusals, there
were one, problems with the fact that the owner and applicant started constructing the
accessory garage without the proper zoning permit, which obviously was well within the
community's right to have a problem with that. And thus, when the applicant went to
go get building permits and they said they needed zoning and they realized that they had they need
to go get a variance and that's when they started this process. I will maintain that throughout this
process as I stated this started in November actually prior to November, October of last year
although the applicants started this process improperly they have since done everything they
can, including going back to LNI twice to confirm and correct their freezals and to start this
process properly, which I'll show in a second. Just to remind everyone of what we're talking about
here, the project itself is currently in this stage. As you can see, it is basically framed
out, roof sealed for the most part. And this is the stage where it has stopped and where it has
been thus far. In terms of the area context, the rear two-story structures is not something
that's not, that's something that's very common in this area. As I stated at the last hearing,
there are 26 homes in this block cluster, at least 15 have detached structures. And then
basically every two-story detached structure is over 15 feet. And as you'll see,
many of them have exterior stairs, which was an issue initially. Now, in addition to that,
just to be frank, the community hated the design, right? They didn't believe it matched the context
of what was in the community, because we're, as you can see, there's no gables, it's kind of square
in the rectangle. And admittedly, the owner was intentionally trying to do something different.
That didn't go over well, it became, you know, problematic. And we received after our two
community meetings, a letter from the community group that highlighted their issues. One being,
Again, the height being over the 15 feet, that was originally a refusal, which is no longer one, which I'll get to in a second.
And then, but mainly, as you can see by their own highlights, the ones that they highlighted as like their main issues was the box form being out of context and the roof design and the finishing of the property.
In addition to that, there was some one neighbor had an issue with the distance from the property line, which again, that's no longer a refusal either, because frankly, it was an incorrect refusal for reasons we highlighted in the first meeting, but was corrected upon subsequent review in our renderings or our new submissions.
And so, in response to those comments, we went back to the drawing board and redesigned
redesigned the project, resubmitted it to L&I, and obtained the refusal that we obtained in June.

This time, we no longer have any dimensional refusals, but because the use was properly
captured as an accessory dwelling unit and not some sort of storage on the second floor,
we do have a refusal for the two multiple, two uses on one lot. As you can see here by the new
refusal, the multiple uses and the multiple buildings generated these two refusals was
essentially pursuant to the same code designation, but because it's parsed out into two refusals.
As I stated, technically speaking, this is not one lot, but there is no real way to capture the existence of this parcel because it's under one tax parcel.
And therefore, I understand why these refusals are issued.
And so I just wanted to take the board on a journey to kind of where we've gone since then.

Okay, so this was the desired end result of the initial project.

This was our initial desired result of the initial design and project as it's partially
built. And we had some, initially we were sort of, we pushed back on some of the design
and dimensional changes that the community wanted because it essentially amounted to a tear down
and starting over because of, you know, removing the roof, changing the cornice lines, et cetera,
et cetera, shrinking the windows. For the most part, we had to tear it down. Because we received
so much opposition, well, because we received such specific opposition in light of the support
that we did have, because if you recall, we did have a petition of neighbors that did sign in
support under this design. We understand that the board and the community was not inclined
to accept this. And therefore, we've made the following changes. And so I just want to stay
for the record, to be clear, because I'm sure there are some people from the community on the
call, the community has not seen these redesigns. I've been told by the zoning chair that they have
not seen these redesigns. And in fact, there's been some updates that I think the community
would like that even I don't believe the zoning chair have seen because it's as recent as a couple
days ago. Hence why we wanted to go to the meeting on the 18th. So this was the first
redesign. We completely changed the roof line. We completely changed the, excuse me, the
massing, included the gable roof on the side, changed the box square design, and tried to
switch it to materials that we thought was a little bit more complementary to the existing
sort of two-story structures that are along that driveway, as you can see in the photos
here. And so we really thought this design was something that the community would be
responsive to. When we sent it over to the zoning chair, he did have some apprehension of this would
be enough. We were pretty confident in it, but the more that we talked with the owner and the
applicant, we decided like, you know what, let's see if we can do even more. And so I just want to
take you on the journey of where we started, where we thought we would end up, and we gave to the
zoning chair of EFCC, didn't really get the response we were hoping. And this is, so we
decided to do even a more complete overhaul. And hopefully this new design is something that we
believe the community and the board will be more appreciative of. So here is our latest design
that again the the community has not seen this is what we're going to present on the 18th
and recon completely redesigned the materials completely redesigned
the we're using almost completely brick scallop siding
the we're using almost completely brick scallop siding roof shingles where
let me go to a different view we decreased the windows on the rear of the property that
looks over our yard because that was a comment that we heard that basically we had floor to
ceiling windows all the way across if you would remember so we shrunk it to these sort of french
doors. But in all, again, we're maintaining the exterior staircase because that's necessary for
what we're trying to do. But again, we're using the brick, the dark siding, the slate shingles,
again, to match what's exactly there. Here again, this is a side view here of the, again, brick all
way up, have this little steeple that we thought was designed positive. And here is a rendering
of what we believe is something that is complementary to what's existing there. And it's
something that's frankly a much better design for what we're trying to do here for the parking and
the accessory dwelling unit on the second level. And so again, just to
look at like where we came from,
so where we are, our hope is that the community will see that we've made substantial efforts
to go from this, which includes these sort of, these windows in the rear that covers the
tire to go from that to this. Now, just for the record, this is a complete overhaul. This is
going to be essentially starting from scratch. And so I know there may be some people that just
on principle alone, because Mr. Hardiman started this project without joining me, say he shouldn't
get to, you know, complete it or do anything remotely to what he was trying to do. In essence,
this is starting over. We did this, as you can see, even the roof lines are different on the
interior. And therefore, what we have now, you know, we can't just, we can't just sort of put
this on top of it. And so in light of this redesign, and in light of the refusals that we
have the dimensional refusals that are gone. And it's really just the use refusal of the
accessory dwelling unit, or actually, excuse me, of the second use on a property that's technically
actually two lots is not one. Because of that technicality, our hope is that the community
and the board will see the considerable effort to meet the design requirements of the
the opposition letter that we received which again is changing the box form um changing the
roof line um changing the window style um and changing the exterior finishes as well
um we are still over the 15 feet that we were originally over but again that's not a refusal
because um that's not um applicable to what we're the use and what we're doing here um and then
we're still, the footprint is still where it is. But again, that refusal is also gone because it's
again not really applicable to what we're doing here. And it frankly never was. And so I appreciate
the board's consideration to allow us to at least show you what we've done because I thought that
was the point of this resumption hearing. Understanding that we need to show this to the
community as well, so they can have their, you know, make their comments and express their viewpoints accordingly.

Yes, I would like to make a few comments and, if possible, have some neighbors follow up.
I would just like to point out that the neighbor's preference always was that a completely conforming structure would be located in this rear lot that conformed to zoning.
uh the the the suggested changes to the structure was put out there as an alternative
uh to a first choice uh but really just to kind of try and sum this up um you know there's a
hardship created by the owner through um you know the illegal construction
and the neighbors are very concerned about the erection of a full-size
single-family dwelling in what used to be basically a backyard setting. I would just
like to clarify that there are two structures back there which three structures that are
attached to the alleyway, not 15. Only three structures, one of which is an artist studio,
one of which is a grandfathered apartment that is barely occupied, and that is it.
There are no single family dwellings fully occupied back there, and it would appear from
previous renderings that a fire pit, an exterior screen TV is going to bring in a single family
use that would be very disruptive to the piece of all those backyards there. Basically, I appreciate
the uh the changes to to the project uh surely uh but at 23 feet you're really looking at a
full height full size single family structure uh within 18 inches of someone's um
rear yard there's a rear yard on either side of this um and and these the this is what's
distressing the neighbors and changing the nature of that alleyway back there. So we do want to
have a chance to review this new proposal on the 18th. And, you know, we'll do what we can to
encapsulate neighbors' comments on this. But just let me tell you that the hardship is now transferred
to the neighbors uh they're going to be having to live with a single family dwelling
we don't know who's going to be living in there um they need that chance to uh review this
with with the owner and his attorney that's what and that's what the purpose of your meeting on
the 18th will be and then any feedback uh as a result of that meeting will be presented to the
board on august the 25th because mr chair if i could just stay it's possible there may be some
additional changes that the owner may the applicant may be willing to uh to accept absolutely and
mr chair if i could just stay for the record because i i realized as mr langer was speaking
i neglected to say that this hearing um but i believe it should be part of the record for last
hearing the owner um's intention with this property is for this to be an in-law suite
And as such has proposed at both the community meetings, I don't, I think it might've fell on deaf ears, but proposed that they would agree, they would not oppose any proviso that states that this could own, this cannot be rented, you know, for public rent or anything like that, that this is exclusively for his family's use.
for his not to interrupt you but that is a discussion that you guys will have on the 18th

In our packet of materials, you'll see a deed to the property showing that our client owns the property at 3642 North 21st Street.
certificate of tax clearance showing that my client is in good standing with regards to the
real estate taxes owed on the property. Third exhibit is a notice of refusal. You'll see
why we're here. It's a use refusal, no dimensional refusals. Fourth exhibit is an hour application
for appeal. Fifth exhibit is our maps of the area. Sixth exhibit is a map, excuse me, photographs of
of the property in the surrounding area.
Seventh exhibit are floor plans,
and eighth exhibit is correspondence
from the 13th Democratic Board,
as well as an affidavit from my client indicating
that he will comply with all provisos

So first you'll see that this property
was transferred from Rodney Bell to Prepared Housing LLC. Rodney Bell is the sole member
of Prepared Housing LLC, and that's the current owner of the property.
You'll see that the corporate entity owes no taxes, real estate taxes, with respect to the
property. Then you'll see the notice of refusal. This is an RSA 5 property. Again, all we're trying
to do is make this into a three-unit dwelling no dimensional refusals.
Our application for appeal that we filed with the zoning board of adjustment
along with the project information form and the notice refusal as you can see like from the zoning
map there is a significant portion of the neighborhood especially in that block across
the street that is RM1. Unfortunately, we are not. And then you'll see where we are in the
neighborhood. We are between Pacific and West Erie on 21st Street. Photographs of the property.

Now, we did meet with the 13th Democratic Ward as a coordinating RSEO.
And, you know, one of the reasons why we're here today is because we did ask for a continuance
because we've been working diligently with the 13th Democratic Ward to find a way that it's a win-win
both the community as well as the uh as my client uh this is a rather large property from a square
footage perspective uh so it's really difficult for a lot of these properties to be used as single
family use and uh so we did work with the community if you see in blue this is what was
provided uh you know these are the provisos it says however because originally the community
was against it. And then it stated, or at least the neighbors, it says, however, the directly
affected residents, 13th Democratic Ward, RCO committee and ownership and legal team have
discussed and mentioned issues and agreed upon several provisos that mutually benefit the
community and ownership. Proviso number one, implement and forward a trash debris plan for
twice a while. Alan, pardon me to interrupt. Could you enlarge that? Oh, yeah, sure. Is that better?
that's better thank you all right uh so basically first a trash plan and a debris removal plan
where we're going to have pick up twice a week so one of the concerns in the neighborhood was
they're not against multi-family living like in terms of like increasing the density from a
parking perspective which a lot of people that is their concern they're more concerned about trash
storage or removal. So one of our major concessions was to have twice a week pickup
because that was a great concern in the neighborhood. The second concern in the neighborhood was just
general maintenance of these properties, whether it's snow removal or landscaping. So we'll be
working with the community in terms of making sure that there's proper snow removal and landscaping
throughout its existence. And to indicate specifically that the occupants aren't
responsible for the care of the property, like the tenants, we are as a property owner. And that's
item two. And then thirdly, it's something we actually propose, and I propose for all my clients
who are renting out the units, is to have contact information on the front window. So we don't want
bad tenants, like they don't want bad occupants. It's a lose-lose situation where you have a tenant
that's not behaving themselves. So we're going to agree, and at our assistance, to have the
contact information for either Mr. Bell or whomever is managing the property. Right now,
Mr. Bell is managing the property, but if that changes at any point, we will have the name and
contact information so that if neighbors are having issues with our tenants, we know and
we'll properly deal with that. So those are the three provisos that we agreed upon. I don't know
which ones would be enforceable, but that's for the board to decide. But then I also had my client
sign an affidavit. So there's something in writing in this respect. You know, my client,
you know, Blondie Bell owns Prepared Housing LLC. He owns this property. There's a pending
zoning matter with respect or zoning appeal with respect to this property for proposed three units.
And then I said, if the zoning appeal is granted, the company will perform the following tasks as
it pertains to the operation of the property. And almost verbatim, like what was in the proviso. So
So there's no dispute as to what we're agreeing to.
And most importantly, Mr. Bell signed that as well.
So after that, it's just proof of our mailing
of the community notice.

This is currently a vacant lot.
The property is zoned RSA 5.
It is located on the 3700 block of North 16th Street, where, as you can see from the packet, it's a large vacant lot.
The land area of the property is 2,500 square feet, according to the Office of Property Assessment, and has been vacant since at least 2007, in which it was a multifamily use.
We are proposing, we have one refusal that this application generated.
We are proposing use for multifamily.
We'd originally proposed six multifamily units, given the large size of the lot.
however in meeting with the community and the near neighbors the block captain etc
we have reduced our proposal to a four unit project which we did submit proviso plan forms
and revised plans for that there's no dimensional refusals that we're requesting again just a
There's no dimensional refusals that we're requesting. Again, just a reduction in the originally applied for six units to four units.
Literal enforcement of the RSA 5 zoning on the 3600 block of North 16th Street, as you can see, significantly larger square footage than most single family lots in the neighborhood and throughout the city of Philadelphia.
and also there's a lot of multifamily already on this block that's why we're proposing the
or units that we have today single family use would result in extremely large out of character
single family home out of reach financially for not only this neighborhood but most other
neighborhoods given this is a 2,500 square foot lot additionally expansive RM1 and CMX3 zoning
districts within two blocks of the property headed north and east both permit multifamily use
by right and are similar or smaller in size to this lot. Additionally, according to the city's
2035 comprehensive plan, they are proposing to have large the redevelopment of vacant properties
with uses for multifamily in the area south of Erie Avenue that includes the subject property.
This is on page 74 of the Planning Commission's 2035 Comprehensive Plan, which I believe I did include in my appeal.
Again, this lot is extremely large.
Adjacent to the property, there are uses for multifamily, as I provided specifically, six units, three units, four units, things of that nature.
most of the properties on this block are not permitted or were not legalized for single
family use and have obtained variances, or I guess at one point in the prior history were
zoned for multifamily by right. Again, this is the lease modification of the code as we're only
providing for four units. This will help add a more price conscious price point as for rentals
in the neighborhood or the opportunity for condos if the owner chooses to go that way.
And again, our hardship is that we have a 2,500-square-foot lot at the board as well, where you only need 1,440 square feet in RM1 to get four units, and we're proposing four units in a 2,500-square-foot lot.
We did meet with Charles Karn and the 13th Democratic Ward.
A lot of the opposition, as you can see on the screen, came from the RCO board committee.
um i'm not sure how many of those folks live um nearby or live on the block um i don't do know
that mr karn mentioned his address was on the 3800 block of 19th street which is you know between
three and five blocks away from this property additionally the non-opposition came from was
five um non-opposition those were people that were not made up of this rcos board um and also we have
letter of support from unna which is an affected rco they basically state in their letter that
the intention of the project is to help eliminate vacancy and blight and to provide more affordable
housing units they acknowledge that the 3600 block of north 16th street where this property is
and the neighboring venango street and erie avenue currently consists of both rental households and
single-family dwellings so this would not be out of character and also unna acknowledges the
developer to be a community partner has demonstrated a commitment to revitalization of the community
by employing community members and participating in neighborhood cleanups. We just included some
of the outreach that we did in order to try to get multiple meetings and to make sure that everyone
was informed. We have the proof of mailing. We also have a bunch of letters of support from those who
live on the block, and also nearby 3637 North 16th Street, 3617 North 16th Street, 3619 North
16th Street, 3620 North 16th Street, 3323 North 16th Street. The president of Crystal Ray,
also who has the Crystal Ray School on 17th and West Allegheny, submitted support for this
development as well. And again, and also a pastor in the area as well submitted just
her support. And she has a church on, I think, the 2200 block or 2400 block of North 16th as well.
Additionally, like I said, we've made revisions to the plans in order to provide less density
and to help accommodate some of the neighbors' concerns.
So I just want to sort of stop there.
We're looking again for a hear and hold.
So we want to have an opportunity to meet with Mr. Karn, his RCO,
and members of the community to provide the revised plans
and some additional considerations related to senior housing needs
um related to senior housing needs and um concerns with on-street traffic and so what we just because
and concerns with on-street traffic.
the board had already seen this we wanted to at least uh you know not continue this and drag it
out and we were grateful that we were able to have that accommodated i do want to have if scott
woodruff is here to provide the revised plans um for the project on the record again it's a reduction
from six units to four on a long-standing almost a decade and a half it's been vacant and had prior
uses as multi-family as well. I also want to mention for the board that I think there's seven
or so members in support of the project that wanted to speak they were also on for the prior
meeting that was continued at the request of the board so I don't know I'll leave it to the
chairman and members of the board if you want to hear their testimony today i would appreciate them
being heard they've hung on the line for uh now an hour and 45 minutes um and want to make sure that

a two-bedroom, one-bath unit with large kitchen, den, and living room on the first level
with accessible access. And then on the second level, there's a two-bedroom, two-bath
that's currently there. Again, large living, kitchen in the front with the bedrooms in the
rear and then on the third level uh we have the previous two bed um one bath design with two units
on that third floor
and then just again for reference the was the pre-existing exterior rendering again
wouldn't really change too much again red brick kind of uh the main thing that to match the
existing context uh rachel is there anything else you wanted me to to run through uh no i just want
to show just um just the directly adjacent property so that the board can see that directly
next to it fits in with what's there the your massing is a little
leads to the imagination so just so the board's aware this is what is next to the property
So as you can see, we tried to fit in as best a little bit of an odd mix match on the lot,
but we're really trying to stay with what we're going to be directly adjacent to as well.
It's also worth noting just really quickly that there's about 25,000 square feet of vacancy on this block on actually the corners.
There's city-owned land there.
So I think the reduction in units will be helpful to address any concerns about density,
but there is a significant amount of vacancy as well so just want to note that um i'd like to
bring up my clients if possible unless the board has any questions on the plans before we let scott

We opposed the plan.
that was presented at that time.
What council failed to state that during the presentation,
it was a six-unit presentation.
We asked, and we've been working with the City Planning
Commission, Ariel, for like the last two years,
working on RSA five single family units.
And we do understand development.
However, we've been working with every developer and every owner in the community from Broad Street to 22nd Street to North and Angle Street, all the way up to Windrum.
We are trying to stay under a certain amount of units.
And that was three.
Just today, I received an email from Ms. Pritchard's office stating they wanted to meet after this.
and that was okay but my thing was there right the community and everybody on that block
wanted three family units that directly affected folks there through some tactics or whatever um
I don't know these letters went around these petitions went around but no one
who signed those petitions were on the zoom meeting that we had now I know we're just
presenting now I did send back an email to Ms. Pritchard's office after the 12-13 email stating
that we will have we can have another meeting September 9th that was our next scheduled RCO
community meeting however that's what we would like to have another meeting and I'm pretty sure
the community is for development on that lot and in and a lot around there however the multi-family
over the four and five and six that were presented at that time, the whole meeting opposed it.
And Mr. Kahn, I don't know if you had missed it. I had said that it was a six unit that we are
reducing to four units and that we were asking for a hearing hold specifically so that we could
accommodate another meeting. And so, yeah, we're all on board with the meeting again and, you know,
providing the revised plans no I didn't I'm sorry Rachel I didn't miss it however when you um
presented um your support you stated someone from a church on a 2,100 block we're actually
on the 3,600 we're on the 3,600 block 30 I think she's at 3,400 block uh I did mention that it just
that she had you know spoken in support and I had stated she wasn't on that block I apologize if
that was what we're just saying we're just saying right we had a lot of people um
I'm trying to get on this afternoon, but those are the ones who live on 16th Street, the north side of Venango Street, which is the 13 Ford RCO area.

um and we're providing you know 1440 gets you four units uh we're at 2500 trying to accommodate
four units so um you know we're trying to to meet and that makes sense for the size of the lot

um his their base is actually their uh ward where their territory actually encompasses erie avenue
lehigh avenue but their actual base is below allegheny uh going down the lehigh avenue
uh i also spoke with uh mr mcconnell of crystal del rey and uh you know i could because we
questioned his providing a letter of support for that and he actually thought that rachel
was a developer and uh but i can get get further clarification from him in writing and he can you
know and i can provide that prior to the next on this case i'm just we know we we know that rachel
but uh you know but he he was confused with that with that fact but i can get like i said i can get
that uh you know clarification uh because he does trust you but you know but he can cannot speak to
the developer, you know, of the project. So Councilwoman is actually going to reserve her
judgment at this point until after this RCO meeting. Let's hear what the community has to say

sure all right thank you all right so i'm here for 430 uh mifflin street uh you'll see my stand
this is going to be a proposed two unit condominium building on a property of a size that if this is
an rm1 property uh would be allowed as of right there are no dimensional variances actually if
you and we'll look at the pictures of the block uh the property to the left of us at 428 mifflin
Street, and the property to the right of us at 430 Mifflin Street are also multifamily structures.
So in my presentation packet, we'll go over the indenture, the deed to the property, which shows
430 Mifflin Street LLC owns the property. And with me, I have Nathan Cohen, the owner's
representative. Exhibit number two is the certificate of tax clearance showing that the
company is in good standing with respect to this property. Exhibit three, we'll go over the
refusal. Again, no dimensional variances. This is an RSA 5 property. We're simply seeking a use
variance. Exhibit 4 is our application for appeal that we filed with the ZBA. Exhibit 5 are maps of
the area. Exhibit 6 are photographs of the property as well as the surrounding area. Exhibit 7 are the
plans and drawings for this property uh exhibit eight is a petition uh that um you know that we
circulated actually before the meeting it's been a while uh we filed this this appeal for some time
ago uh so you know we just want to make sure that the community understood that the people within
close proximally support this project and you'll see a map of a comparison of the people that we
had signed the petition um and provide the letters and compare it to actually the sign-in sheet um
you know unfortunately we didn't you know fortunately we met with the community or members
of the community unfortunately the people that did attend that meeting were not in favor of this
project um i believe that there may have been one person in support and the remainder of them
were not in favor of this project but we did get the sign-in sheet and i wanted to show a comparison
of where the people who signed in were compared to, you know, who we got in terms of writing
or signing a petition in support. So, all right. So again, this is a property that's owned by 430
Mifflin ST LLC, showing clearance in terms of the real estate taxes owed on this property.
Again, this is an RSA 5 property. The only refusal we have is, you know, for use, we're trying to
make this into a two-unit condominium building. Again, philosophy in terms of zoning variance
you know philosophy in terms of zoning variance practice if you walk by the property built as
practice. If you walk by the property,
proposed does this stick out like a sore thumb or is this something that kind of fits within the
fabric of the community as you will see there are other multi-family structures within the facility
of this property and in actuality the two of them that are most pertinent are the property is are
the properties to left and right of us which are both multi-family structures our application for
appeal with the to the zba along with our newest refusal and project information form maps of the
areas of the area so we're between fourth and fifth street and essentially between siegel and
hoffman on mifflin so what i i directed my client to do was like we need to know how the people are
most directly impacted by this project how are they in favor of this project or are they opposed
to this project. So you'll see through the map that we created, after we'll see the photographs
first, you'll see that we obtained signatures and letters to support from those individuals.
So again, here's the front of our property on Mifflin Street, 430 Mifflin Street.
I went on Google Earth, you know, before the hearing. So Google Earth only goes back as far
as 2007. But if you went on Google Earth right now on the internet in 2007, this is essentially
how this property looked so this has been a vacant lot for 15 years and that's part of our
hardship essentially because no one's been able to build this as a single family structure over
the course of 15 years we want to do a responsible use my client is a known entity in this area my
understanding is that maybe a community member or two who are going to who are going to speak on
his behalf but he has developed this area before responsibly and he's looking to have a form of
homeownership as a condominium, two units making it more affordable. Mifflin Street to the right
of the property, Mifflin Street to the left of the property. Again, nearby duplexes, 432 Mifflin
Street, 428 Mifflin Street, 414 Mifflin Street, 406 Mifflin Street. And again, we did confirm
that all these uses are legal. We looked at it. That was actually contention when we talked to
the community at the meeting, they indicated, oh, these uses are not legal. And we actually
confirmed each and every one of them on Eclipse, there are zoning permits for each of these
properties. So these are all legal uses, and that's what we're trying to do. So this is the
type of product that my client would put into the property. He believes in having a good work
product for his units, again, condominium. But this is an example of the type of work that he's
done in the past for other projects, and he would use similar materials and quality of workmanship
as well. Now, our plans and drawings. Again, we have a significant backyard of over 260 square
feet. If we were overusing this property, you would see the fact that we would have dimensional
variances, which we have none. If you don't mind, I'm just going to decrease the size so the board
can see the whole page all at once. And of course, I can increase the page, the size of the page at
at any moment. So again, just to quickly go through the floor plan, you have unit number one,
which is an open living area, bedroom, bathroom. We have a lower level, which has a living room
and a flex area. We see more and more, at least my clients are seeing more and more people are
working from home and they would like to have more of the non-bedroom use because most people
are nowadays working from home, and we anticipate how things are going to change over the course of
time, there's going to be more remote working in Philadelphia and throughout society.
You go up a flight of steps, second floor, unit two. Now, this is meant for someone who is a young
couple, maybe even a young family, three bedrooms, three baths. It's a bi-level, second and third
for us. Each of the units will have trash compactors and they will have ventilated trash
closets. Again, we're trying to keep in line with the look and feel of the neighborhood. That's why
my client is proposing to have a red brick facade. Now, this is the map that we created of
you know the petition and sign in sheets and the uh addresses are for everyone the if you'll see
or we have so many signatures that you can't even see where we are on mifflin street
yeah so here we are on mifflin street right so i indicated my client said who are the people most
I indicated my client said, who are the people most directly affected?
directly affected the people.
The people to the left of you, to the right of you, and behind you.
So, and across the street from you in some cases.
And that's what he did.
He like really dedicated himself to like get as many people to know about this project
and be supportive of this project.
We were actually surprised during the community meeting, you know, the people were against
it, but you see the, all the light blue, that's, that's, those are the people in support.
And we'll have, I'll show you the petitions and letters of support.
The people who, again, I just assumed everyone at the meeting was against it.
I believe there was one person in support of the project, but we have the sign-in sheet.
I took a picture of it.
All the red are the ones who attended the community meeting.
So as you can see, none of them are within close proximity.
And I did do a comparison between their addresses and the addresses within the affected area
that is listed by the Planning Commission.
only one property fell within the affected area not to say they shouldn't have a voice in their
own in like these individuals shouldn't have a voice in their own community but only one was
considered affected by as as noted by the planning commission i'm just going to reduce this so you
can kind of see that as a whole page but you can see we have 417 mifflin 13030406 437 here's one
the fifth uh fifth street but 429 hoffman which is behind us uh 15 415 hoffman 403 hoffman 32 hoffman
424 hoffman 412 hoffman 410 hoffman 406 hoffman 517 527 532 hoffman which is a little further
away uh and 534 hoffman and then we have all these other people um and i think they may coincide
but like we have letters to support
And then here's actually a letter we received from one individual at 426, 433, and 419 Hoffman.
Now, we did meet with coordinating the RCO, and as you can see, they said that affected addresses, one support, nine opposed,
And then they said the RCO board voted for against. Again, I took, I can, you know, take, show you the screen of like, I just took a picture of it, but I did do a comparison. None of these people were affected other than one.
and then they wrote a letter saying uh that it's not justified again this has been a vacant lot
for over almost at least as far back as 15 years because if you go google maps you look at it
put 2007 it's exactly in the same condition as it is today so and then here's proof of our mailer
so i really do think illustratively just all the support that we've received
But most importantly, if you just look at this, these are the support that we have within the close proximity.
Not everyone can make it to, this was, by the way, an in-person meeting.
Some people, you know, I understand some people don't feel comfortable going to in-person meetings.
So, but really the voice of the people who live in close proximity should be weighed more so than the people who attend the community meeting who are not within the affected area.
So with that being said, I would be more than happy to take some questions. But before that, I do have Nathan Cohen, the owner of the corporate entity that owns the property on the line, and I would like him to adopt my testimony.

I just wanted to have everybody understand, since me moving back from the community, I've been around the neighborhood for a while, and I fully support this project going on.
And it really, really, the community and the block really needs this.
And I really just wanted to come on and let you understand that, you know, I'm trying to do better things in the community and around.
And so is Mr. Cohen. And playing with the Philadelphia Eagles, we were really big on community based projects.
And I really think Mr. Cohen is doing a an amazing job for our street.
um all of the other people that didn't um approve of this i've never seen them around the community
and i'm on that street a lot you know i might be uh had and masked up but i'm on that street
and i really really appreciate mr cohen bringing um something to this uh to this block

uh mr chair there is a letter of opposition in the sense of he mimicked the saying that the
community was the community was opposed like the coordinating rco was opposed to it so
his office was opposed to it but with that being said again given the amount of like support that

just sharing my screen can everyone see the exhibits yes great thank you as mentioned i'm
here today on behalf of penny pack associates owner of the property located at 8400 east
Roosevelt Boulevard. We're here today with an application for the adaptive reuse of an existing
building at this location to be used as multifamily with 50 units and the reconfiguration of the
existing parking area to provide one-to-one parking. I have with me today owners representatives
Mr. Peter DePaul and Patrick Callahan and as you can see from our exhibit packet we do have
letters of support from both Councilman Brian O'Neill's office as well as the Ron Hurst Civic
Association. The DePaul Group has operated this location as Harmony Place, an assisted living
facility, since the year 2000. As you can see, it's located directly adjacent to the Roosevelt
Boulevard in what has been created as a land condo. Other uses in this condo include a medical
office building as well as a former acute care center. This proposal is generated by the fact
that Harmony Place has consistently had difficulty getting tenants located in its
existing assisted living facility. There are 72 beds at this location. Currently 19 of them are
operated. So this is a creative way to adaptively reuse this existing building and provide class A
rental option in this neighborhood. As you can see, there are several other multifamily uses in
existence here. These are just a few of those that are nearby, so it would not be out of character
with this location. DePaul Group currently operates 18 different multifamily neighborhoods
throughout the city and surrounding area with 4,400 units under management. These are some of
photos that show the level of finishes that the DePaul group currently builds when they
refinish apartments. And this is what we'll be proposing here. This proposal generates
just the single use refusal. As I mentioned, this is zoned RSA 1 for single family. But again,
it's been operated as an assisted living facility for the last 20 years, and it is located within
that land condo, which lends itself very nicely to being utilized for this purpose.
We met with Ron Hirsch Civic Association on two separate occasions. Through some ongoing dialogue,
we were able to address some of the current concerns they additionally raised, and obviously
they are available today to speak to those comments, but they have been appeased and have
provided a letter of support. We believe this project will not alter the essential character
of the neighborhood, as evidenced by the neighboring similar uses. Again, we are providing
one-to-one parking, which we feel is appropriate here, as well as there is a transit stop here
right on the boulevard, which is directly at the entrance to the land condo. We do not feel that
this will impair or deprive the adjacent uses because, again, we are part of that land condo
with existing commercial uses. And lastly, it will not be detrimental to the public welfare
because again we do have letters of support from both the councilman's office as well as the rco
i would just ask mr de paul to please raise his hand so that he can adopt my testimony
