Thank you. The clerk will read the title of the bill and the bill number.
Bill No. 990219, an ordinance amending Chapter 19-1500 of The Philadelphia Code, entitled "Wage and Net Profits Tax," by changing the filing and payment date of 99 5/11/99 FINANCE COMMITTEE - Bill 990219 the fourth-quarter employee earnings tax return.
Thank you very much. Would you identify yourself for the record and then proceed with your testimony.
My name is Nikki Marx, and I am Deputy Revenue Commissioner for the City of Philadelphia. I am here today to testify in support of Bill No. 990219, which will amend Chapter 19-1500 of The Philadelphia Code entitled "Wage and Net Profits Tax." This change will make the filing and payment of the fourth-quarter return consistent with the filings of the return for the other three quarters of the tax year. This requirement is the filing of the return and payment of tax at the end of the first month following the end of each quarter. So all four quarters will be consistent.
Thank you very much. Are there any questions from members of 100 5/11/99 FINANCE COMMITTEE - Bill 990220 this committee? (No questions.)
The clerk will read the number and title of the next bill.
Bill No. 990220, an ordinance amending Chapter 19-1700 of The Philadelphia Code entitled "Review, Refunds and Compromises," by changing the time limit for filing a petition for refund of monies collected by the Department of Revenue, including but not limited to taxes, water and sewer rents, license fees, and interest and penalties thereon.
Thank you very much. Please proceed with your testimony.
This bill will change the time limit for filing a petition for refund of tax from three years from the date of payment to three years from the date of payment or the due date, whichever is later. This change is consistent with the federal statute and will benefit taxpayers who file before the due date. Neither of these bills will have any fiscal impact, and both will simplify the law. 101 5/11/99 FINANCE COMMITTEE - Bill 990220
Are there any questions from members of the committee on either of the bills? (No questions.)
Thank you very much. We are going to pause a moment so that we can clarify the issue with regard to the suspension of the rules of the first two bills. Is there anyone else here to testify on any of the bills that were read today or any of the bills that were discussed? (No response.)
Thank you very much. So we will ask everyone just to stand by for a minute or two. We are trying to converse with the President and to certainly decide what we need to do on these issues. Thank you. The public hearing will be in recess for ten minutes. - - - 102 5/11/99 FINANCE COMM. - Pub. Meeting
If there are those who are in the chambers or who can hear me, we resolved the matter in less than the ten minutes that we called for suspension and certainly, if those folks can hear me, would you please come back into the chambers, and we can resume our public hearing. Thank you. All right, we will resume our public hearing since there are no questions are there any questions I'll ask one more time? Motorcycles no 12 questions.
Since there are no other questions end, then we will end the public hearing and go into our public meeting. The Chair will request from Councilman Nutter a motion with suspension of the rules on Bill No.'s 990285 and 990286.
Madam Chair, I move that Bill No. 90285 be reported out of committee with favorable recommendation and a further recommendation that the rules of Council be suspended so as to permit first reading at our next session of Council. (Duly seconded.) 103 5/11/99 FINANCE COMM. - Pub. Meeting
All in favor? Opposed? The ayes have it and so it is carried. I will now entertain a motion. We did not hear a request for a suspension on the other bill so I assume they're not required for the Revenue Department.
You're also requesting a suspension for the bills dealing with the Revenue Department 990219 -- we just passed the other bills with the suspension.
Madam Chair, I only did one Gas Works bill. You want the second one?
Madam Chair, I move that Bill No. 990286 be reported out of this committee with a favorable recommendation and a further recommendation that the rules of Council be suspended so as to permit first reading at our next session. (Duly seconded.)
All in favor? 104 5/11/99 FINANCE COMM. - Pub. Meeting Opposed? Thank you. The bill is passed. The Chair recognizes Councilwoman Tasco for a motion on Bill 990219, that it be reported out of committee. I've heard no request for a suspension, so I assume that we don't need one.
Madam Chair, I move that Bill No. 990219 be reported out of committee with a favorable recommendation. (Duly seconded.)
All in favor? Those opposed? The bill passes. Councilwoman Tasco, would you give us a motion that Bill No. 990220 be reported out of committee with a favorable recommendation.
