property that's currently a vacant lot on the 2500 block of manton street it runs right in
the graceberry neighborhood uh right a couple houses in or lots in rather from the viaduct
that runs along 25th street we received the for purposes of the record the refusal appeal and
project information form are at page one area zoning maps are at two my client's deed is at eight
Zoning notice to our neighbors is at 17.
Proof of mailing is at 24.
The RCO letter is at 25.
Commercial activity license and tax information are in this packet,
but they were sent in separately to the Zoning Board Council.
Photos of the property are 27 and plans are at 38 of this presentation packet.
So going to page one of the presentation packet,
we received the refusal, members of the board,
solely because this property is zoned industrial.
The rest of the lot is zoned commercial,
pardon me, residential multifamily.
But for some reason, at the end of our side,
probably because we run the next to the train tracks,
our lot was zoned industrial.
When we get to the zoning map,
we'll see exactly what I'm talking about.
So my client was proposing to have multifamily dwelling
where there currently is a vacant lot.
That's the only reason that we have the refusal is because of the industrial nature of the zoning.
I'll go through our appeal.
There we go.
So now getting to what has been marked as page two for purposes of my submission, we can see, indicated by my cursor in the center, this blue parcel is our parcel.
You can see exactly here's the 25th Street Viaduct.
We've all had the pleasure of driving under that from time to time, I'm sure, if you found yourself in the neighborhood.
What a mess that is. But you can see we have all industrial that's owned along there.
And as we get to the photographs of the block, you will see that the block itself is not industrial in any way.
It is, in fact, residential. There are new residential construction on the block.
I believe some are multifamily as you approach 26th Street.
And we're only looking to stay within the character of the rest of the block, because this seems like it's an aberration of a prior time in zoning that this would have been industrial.
There's no feasible use for this lot as it is, you know, 17 feet wide, however many feet deep for industrial purposes.
And nobody at our community meeting mentioned that they would like to have any sort of industrial use on the property.
In fact, as the chair noted, there was no explanation given in the letter from the RCO as to why there was opposition, but voiced to us at the community meeting, and my client will be happy to verify this, was that the immediate neighbors didn't appear for the meeting.
Why that is, I don't know.
My client had personally reached out to them.
We did send out the letter ahead of time so they were aware of the meeting.
We had postings that were put up on the property.
I'm not sure if any of the immediate neighbors have shown up.
But that was the only reason that there was any opposition to this at all, because the neighbors didn't show up to the online community meeting.

But that's our parcel.

And I'll just zoom in on that a little bit.
So this is our vacant lot right here.
There is a tree there that's being taken care of shortly by my client to ensure that it doesn't cause any damage to the adjacent properties.
He's been in consultation with an arborist.
Along these empty lots here, my understanding is since this photo has been taken, when we get to the more recent photographs that I have, there is new construction here as well.
And we'll get to that in a moment.
This is just a little bit more zoomed in view of the block itself, taken directly from Google Maps at page four of my presentation packet.

This is looking westbound onto Manton Street from 25th Street.
There is new construction. Actually, it's already occurred in this corner lot here.
This is looking eastbound towards the viaduct that I was discussing earlier.
The subject lot, you can see where this tree is. It's off to the left.
And the houses you can see are generally elevated as you approach 25th Street,
whether that's due to the slope of the street and necessary drainage for the properties,
I'm not entirely sure, but as we approach Mantons, the steps for these houses do get higher.
And there's just another Google view of the property itself. Page eight, this is my client's
deed. This is the notification letter at page 17 that was sent out to all of the neighbors,
including a copy of the refusal page 19 we have a list of all the rcos and neighbors that received
a copy of the letter and there's the proof of mailing at page 24 page 25 as the chair noted
we do have this letter of opposition my recollection was initially it was one in favor to
oppose i'm i'm guessing that after there was additional discussion once we had left the
meeting. They changed the vote to three, no, zero, yes, but I'm not entirely sure why other than
the reasons that were told to us at the meeting, which were to the best of my recollection,
hey, our neighbors didn't show up. What's going on with that?
That's my client's commercial activity license, which we sent over this morning and I received
yesterday. That's a tax clearance for the property as well. Here's a photograph of the
property and the posting. There's the tree that we were discussing earlier. This is the new
construction that I was talking about. That's looking eastbound. I'm doing a 360 degree. This
is a recently converted factory, which I believe is a mix of commercial and residential uses.
this is new multi-family construction closer to the 26th street side of the block as you can see
same thing here and so we're not really seeking anything other than what already has existed
is existing on the block in terms of new construction the only difference between
these properties and the ones that we have is this towards the 26th street side of the block
is zoned residential multifamily, and we are zoned industrial. Otherwise, we wouldn't even
have to have gone through the zoning process. So what we're proposing is three stories with
the mezzanine with the sunken rear yard that's going to be accessed by the first floor unit.
We can go through the floor plans as well. We don't exceed 38 feet. We do have a roof deck
and pilot house. Those all comply with the setback requirements under the code.
so we'll start first with the first story and basement floor plans so there will be two front
doors in order to get to the first unit because this is a proposed three-unit building you would
enter through a door on the right entering through that door gets you into your living room
kitchen area dining room balcony and set us that's down lets you get into an office area
bathroom to the front, laundry across, mechanicals, another bathroom to the rear with a bedroom,
a full sliding door to a rear yard with steps to allow you to get the grade,
and that'll get you to this balcony area. In order to get to the units two and three,
there's going to be another door off to the left of the building.
You would enter into there and go up a set of stairs and go to the next page.
so you come up those stairs hang a right to get into unit two
this is also a one-bedroom unit kitchen to the front dining room living room area
mechanicals bathroom bedroom to the rear with a nice big window big closets
The third story has a mezzanine in addition to the third story as well, so that is going to be a two-bedroom unit with access to the roof deck.

There's a bedroom, laundry, bathroom, living room, dining, and kitchen to the rear.
Then to get upstairs to that mezzanine level, you'd follow this little L-shaped staircase.

otherwise so there's a nice open ceiling area going from the second pardon me third story up
to the mezzanine area but this would otherwise be blocked off for some nice privacy for the
second bedroom area to get up to the roof deck you go up these stairs and here's our roof deck
pilot house again setback from the rear we have our five foot setback as required by code as well
so members of the board i would suggest to you that the reasons that we have presented for
our hardship in this matter namely the fact that this is a 17 foot wide parcel on a residential
block that is zoned industrial which is on a block that is otherwise residential multifamily presents
a hardship for development and what we're proposing would essentially be a by right proposal but for
the fact that we are zoned industrial on this residential multi-family block so my request would
be is that you find that we have presented evidence of hardship that you grant our request for
variances to build this residential multi-family building on a residential multi-family block
i would ask that my client be called so that we could get him to testify and adopt my testimony

I just want to note under separate cover, my office forwarded a memo brief that is going
to be part of the record, and I'm entering that into evidence as well this morning.
In addition to this binder of 6235 Lancaster Avenue, it's a 37-page binder.
The application is for event space. And the examiner, we believe the examiner, Ellen and I, erred in issuing this refusal. So no, I do not stipulate to the accuracy of this document because it's my understanding that based on the information and gleaned with my client, that this is going to be an event space for life events.
baby showers, funeral luncheons, and it's going to be for less than 50 people at any one time
in this commercial space. As a result, I believe this should be a referral and not a refusal
for a special exception because it is within the discretion of L&I to place this category
category outside of the nightclub and private club category, which is, in fact, where it is.
So that's the issue that we're dealing with. So if I said yes to the initial question,

this is the interior of the space my client purchased the property and prior to her purchase
it was occupied as event space uh when she purchased the property she renovated it and
began to operate it again as event space uh for things like baby showers and wedding showers
again luncheons after uh funerals thinking that and being told by the seller that it in fact was
a legal permitted use it was not but she did operate for several months
It was not, but she did operate for several months with not one 3-1-1 call, not one 9-1-1 call, absolutely no incident, and it was a real benefit to the community.
Upon learning through LNI that she could not have this space without a use permit, she closed immediately, contacted my office, and we began the process.
when she made the application pro se i believe there may have been a miscommunication which
uh it ended up with a refusal when in fact uh we believe it was an error and it should have been a
referral as the space will never hold more than 49 people and again she's looking for
temporary variants we have commercial trash pickup lighting and security cameras surrounding
the entire property as you know as i said before lancaster avenue is in fact a commercial
corridor and we believe based on the history of the use and no instances during that time
that this use will not pose any detrimental impact to the community anymore
than a similarly situated facility of this kind here is the proof of mailing that my client did

in an ITE industrial zoning district,
where if we were proceeding under an RM zoning district,
we would be able to build four family dwellings on each parcel.
The request today is that we are asking for three family dwellings on each parcel,

As the chairman knows, in RM1, parking would not be required,
but here, in deference to the community's wishes,

It happened to be October 17th.
So there weren't a lot of people at the meeting, but they did vote in support of the meeting.
On October 17th, there was a Phillies game, a Flyers game, and a soccer game.
So that's why we went around the neighborhood and tried to get as many signatures as we could on a petition supporting the project, and that is in my packet, too.
Next is an aerial photograph.
This is looking south, and you can see where it says 2706 Federal Street.
There are two parcels there, 2706 and 2708.
You can see to the right, there's garages, actually four roll-top gates with curb cuts.
The only industrial that I'm familiar with on this block, Mr. Chairman, is an ironworks.
It's a gentleman who does, actually, he signed the petition.
He does ornamental iron for residential single-family and commercial, like railings, grab bars, and things like that.
the remainder of the block on the right-hand side has either been approved for multifamily
has either been approved for multifamily or is multifamily.
or is multifamily and when i get to the end of the
And when I get to the end of the presentation,
I have an aerial photograph with the multifamily demarcated
so that the panel can see exactly what is multifamily on the block,
what is vacant, and what is single-family.
The next group of photographs just show the vacant lot, again, looking southbound.
And then there's a few photographs looking eastbound
to show you the curb cuts that are existing already on Federal Street,
and you can see the roll-top gates in front of some of the garages on the block.
Then the larger photograph depicts Manton Street,
which is, as I said, the lot runs all the way from Federal to Manton.
It's 100 feet deep, and you can see that there are curb cuts on Manton Street.
There's no parking on Manton Street,
So we're providing two parking spots for each project.
The remaining photographs are photographs of the posting of the notices to the community about the hearing.
Next, we'll move on to the plans.
The first plan is the zoning plan, which shows a tire brick front.
The community group wants to see brick as much as possible.
um also there's a pilot house at the top there's a rooftop deck
then we can move on to the floor plans again these are three units mr chairman uh the basement
the first floor uh is one unit uh the first floor and second floor is the second unit and the third
second and third floor is a third unit now i brushed over this not not because i'm trying to
not bring it to your attention, but the first floor and basement is one unit in the sense that
the rear of the first floor is a bedroom for the basement. And so then the first floor and the
second floor, the rear bedroom on the second floor belongs to the first floor. And then the
second and third floor are their own units. And then there's a rooftop deck. We're going to have
Trash storage in the rear yards of both properties with containers
so that the tenants can come down and place their trash there on a regular basis.
Beyond the floor plans and the zoning plan,
we do have streets approval for both parking on both Federal Street as well as Manton Street.
The rest of the documents, we have an application for appeal.
We have the project information form.
We have the tax balance for a real estate printout indicating zero balance.
And then, Margie, if you can move down to the zoning district map, the colored map,
and you can see that the entire federal street of both sides of the block are I2 industrial.
Next is the deed indicating ownership by the Tardiglini family.
Then we have our notices to all the neighbors.
We mailed out 164 pieces of mail to the surrounding neighborhood.
And then the photograph I do want to spend some time on is the aerial photograph where I've marked in red the multifamily properties already on the block.
If you start from right to left, at the corner is a bar.
It's a 1201 bar.
It's been there for decades, at least 50 years.
moving right to left next is a 24 unit apartment building which was approved around two to three
years ago to the left of that is an approval for two dwellings that they're in the making
i was able to obtain that approval from the board about two years ago to the left of the two unit
dwelling is a four unit approved dwelling unit again that construction has not started and then
And as you move further left, you can see there's garages.
The first garage is where Mr. Breen has his ornamental iron business.
And then the other garage is storage, actually storage for my clients who operate a marble and granite business for well over 50 years at 25th and Ellsworth.
And then you can see the blank space, 270608 Federal Street.
That's where our proposed project is to be located.
And then in the foreground of the photograph, there's a six-unit apartment building.
Even though there is facing on Grace Ferry Avenue, that address is Federal Street.
And then to the left of that is another three-unit apartment building on the block.
And the following documents are the support for what I just related to the board.
These are the zoning records that reflect 2736 is 24 units.
That reflects 2736 is 24 units, 2731 is the next entry, that's the six-family dwelling, 2728, that's a four-family dwelling, 2721, that is a three-family dwelling, and 2732 is a two-family dwelling.
So in conclusion, Mr. Chairman, this is a block.
While it is zoned I-2, we try to design the building pursuant to RM1 regulations
because there are multifamily on the block, and it's trending multifamily as we move forward.
If we were in RM1 zoning district, we'd be able to build four units per lot by right with no parking.
we're seeking three units with parking on both 2706 and 2708 and again I ask that my presentation
for 2706 is duplicative of 2708 and I guess I can address that if the chairman is going to call
as a separate item. With that, I would ask the panel to consider this
application. We're not impacting anyone's latent error. We're in conformance with what the community
group wants. We're in conformance with the block and we are in harmony generally with the code.

This proposal is for legalization of an Airbnb.
So first of all, we'll review the notice of refusal, then a letter of support from the East Point Breeze Neighbors Association.
In addition to getting support of the association, as well as the individuals who appeared at the community meeting, we also canvassed the neighborhood where my client obtained a decent amount of signatures that were attached to a petition, as well as letters of support.
I believe the immediate neighbor, 1601 Allen Street, also signed one of those petitions or letters.
Having an Airbnb is not uncommon in this neighborhood.
So we did a review of nearby visitor accommodation listings, and we provided a map to show that,
as well as the VRBO listing for the property to show, like, you know, the ward, what the property is all about.
Mr. Itescu is a responsible Airbnb operator. He has quiet hours from 10 p.m. to 6 a.m. He fines his occupants if there's unnecessary noise or rule violations.
He has agreed to put remote sound monitors in the property in case there's issues with noise.
And he has security cameras surrounding the exterior and the shared hallway of the property as well.
And he provides his contact information on the property itself.
And people in the neighborhood know who he is.
After looking at the listing, we'll review the maps of the area.
photographs of the property as well as uh you know from an exterior point of view as well as
an interior point of view or a simple plan like floor plan of the property um our rco meeting
notice um our application for appeal our deeds of property showing that mr detescue is the owner of
the property and a certificate of tax clearance showing that he owes no real estate taxes uh with
regards to this property at the conclusion of my presentation i would ask that mr detescue virtually

Petition, you can see where we are in the neighborhood. We're on Hannon Street between 16th and 17th, between Ellsworth and Federal, but where we are, the property to the right of us signed a letter, or I believe maybe the petition in support of this matter.
and then here's a copy of our petition copy of some of the letters and actually the letter was
signed by james uh gerald welch uh at 1601 added street but we have many addresses close by of
people who signed uh this petition and or uh letters of support and then it's not uncommon to
have visitor accommodations uh nearby and you know we just wanted to show the board that
uh there's a map of properties within a three or four block radius uh so what we're offering
is not out of character to what would be expected in this part of the neighborhood we're not that
far off of from broad street uh so some people don't want to like you know have accommodations
um in center city um and some people you know have family visiting who live in the neighborhood
And this is a good way for them to have some overflow family stay, especially, you know, even if you think about in this holiday season.
And then this is the listing. We want to show you the fact that Mr. Teskew has a 4.9 rating, 111 reviews. He takes great care of his property. And, you know, he really does screen the tenants well.

please sure i'm the civil engineer for the project i'm a professional engineer licensed
in Pennsylvania and a principal with dynamic engineering. I have over 15 years of land
development experience. Okay and you've prepared the site plan and conducted the surveys and
addressed the heritage tree issue in this matter and I guess the plan that I'm showing on the
screen here is that accurate? Correct. Could you describe the property for me? Yes so the overall
property is located between Caroline Road and Norcom Road. It has Walton Run that runs from
the northern to the southern portion that essentially transects the middle of the site.
In general, there is a significant portion of the site that is located within floodplain limits
and wetlands and associated wetland buffers. There's a steep slope in the western portion
of the site that grades up to an upland area where essentially the development is proposed here
the entire site is wooded the area the upland portion of the site has a significant amount
of historic fill debris tires material that's been brought in you know in prior years so just
something worth noting that it's not undisturbed um you know area even though there are trees there
you know today um it's an area of disturbance so this proposal is for um an approximate 70,000
square foot building it's got a truck court with 16 loading spaces where only four spaces are
required. It has 71 passenger vehicle parking spaces and bicycle parking as well. Okay, Kate,
and to focus on a few things, it's limited in the area where it can be developed, but what do you
estimate the undevelopable area to be? So of the total 12.5 acre lot, the developable portion is
approximately 5.2 acres which is about 42 percent of the overall lot. And that
area is near the front near Caroline Road is that correct? Correct the western
portion of the site. Okay and in that area where is where we removed or would we
remove a lot of trees and is where the three heritage trees are located? Correct
Correct. So within that area, it is wooded. And we can get into the details of what's there in a little bit. But the heritage trees are located within 75 feet. The heritage trees that we're seeking special exception for are located within 75 feet of the Caroline Road right of way.
so within that area it is wooded and
okay and um what how will you address the tree issue with removal and uh replacement
so there is um a tree replacement strategy here um understanding that removal of trees
and incorporating the development we're not able to replace the trees on site
we've proceeded with the fee in lieu um with the fee in lieu strategy so all of the trees
that are being removed including the heritage trees that are part of this application are all
proposed to be mitigated through the fee and loo process and you know through that the applicant
will be contributing close to 160 000 for tree replacement in the city and the important part
of this is that the building couldn't be developed on another portion of the property but only in the
area where the heritage trees are located is that fair to say correct okay and um on the screen i
have what the standards are for obtaining a special exception for heritage tree removal
so the applicant replaces the removed heritage trees in accordance with the tree replacement plan
and we've addressed that by how so we've calculated um all of the existing trees on
site and the density and we've calculated the amount of of trees that that are going to be
removed and then we've applied the fee in lieu to calculate the total amount of contribution
that the applicants required to provide for the application okay um that's all i have for
miss weiss if there's any questions um we did meet with the normandy civic association as
mentioned, we have a letter of support. I would conclude and say that, you know, we believe we've
met the criteria for the board to grant this special exception. We see no average impact by
removing the three trees. The site conditions actually create a hardship in that we're unable
to develop on areas other than where the heritage trees are. But we have alternative remedial
measures that we described that would mitigate any impact from the removal of this these three trees
as well as add even additional landscaping as you saw on the plans that are substantial and robust

We also did extensive canvassing of the neighborhood, so we have a petition which are signed by
many of the occupied properties on the 4,600 and 4,700 blocks of North Penn Street.
um after that you'll see the certificate of variance uh so this property uh was a six unit
apartment building at one point um you also then will see the for our analysis of the 4700 block
of north penn street so we reviewed the public record um and even though this is an rsa5 property
and even though the other properties on this block are also rsa5 it it really screams as this should
be like an rm1 use um and you'll see like all the multi-family structures of public record on the
4700 block of north penn street so what we're proposing is not out of character in the
neighborhood and then you'll review we will review together the lower northeast district
plan philadelphia 2035 where the city planning commission is actually recommending that the
that this property's zoning classification changed to R1.
So there's good reason why we're asking also
for multifamily use here.
The City Planning Commission also agrees with us
in that respect, aspirationally.
We'll then review maps of the area,
photographs of the property, our plans and drawings,
our RCO meeting, our application for appeal,
which shows that Frankfort Capital 3 Limited Partnership
you know filed this or we filed this appeal on their behalf along with the deed to the property
which shows their ownership in the property certificate of tax clearance showing that they
you know that they are in good standing with the state of Philadelphia as it
pertains to real estate taxes and then at the conclusion of my presentation I would ask that

name only because it has an extensive history of multi-family use um and the neighbor the

units here so we met with the community um at a in a well-attended meeting i don't think there
are a lot of nearby neighbors and i guess that was one of the concerns that's why we we circulated
this petition uh to show that there's extensive support from members of this community but the
three board members of the coordinating rco all vote in favor of this project
and then because of that support the district council matter member also issued a letter
of non-opposition and in our petition um we garnered the support of the property to
left and right of us so some of the you know occupants who would be most affected by this
increased use all on this block um are in support of this prop this this proposed increased use
and then these this is the petition that was signed by them letters of support signed by some of them
and then certificate of variance which shows at one point um and this is like i guess old
And then Certificate of Variance, which shows
school way of saying things but this premises was one times used as one housekeeping unit
and five non-housekeeping units um six units so don't know how like how they differentiated
between a housekeeping unit and non-housekeeping unit but um there were six units in this property
at one point and then we really did canvas a neighborhood um again even though this is
rsa5 classification i've never seen something like this where everything's multi-family there
and then we reviewed the 2035 plan and according to 2535 plan
they're recommending to change this part of town into rmwatt as well
and then maps area so we're the sliver of rsa5 there's a little rsa3 here but really everything
here is multifamily um we are bordering cmx2 rm1 there's a little bit of icmx up here uh so
this this yellow is an anomaly based on what we saw and just based on the use and based on what
2035 plan is is recommending and then this is just from a google maps perspective where we are
so we are between arid and uh folk rod as well as griscom and leaper
and then photographs of properties a really nice property i you know my client's very excited
to you know fix it up inside and you know freshen it up outside but it has great bones and it's
rather large structure and the lot itself is rather large as well which can easily accommodate
the five units that we're requesting proof of posting from today's hearing as well is included
in our presentation packet then north penn street to the right of the property north
penn street to the left of the property our architectural plans and drawings there's no
basement living or use down here um you walk into a common vestibule area unit a is here walk down
the hallway unit b is here uh you go up a flight of step there's unit c unit d and then third floor
is unit e um again no roof deck no no basement living actually everyone has access to basement
so i would suspect that garbage would be stored down there um our rco meeting notice we had a
well-attended meeting on november 9th at 5 p.m this is proof of email of that notice a few weeks
before the meeting so we sent it to the all rcos including the coordinating rco the district
council member and such but we also mailed it out to 102 addresses a few weeks before the

regards 10700 Knights Road is in Northeast Philadelphia. It's a standalone building
adjacent to an annex to Jefferson's Jefferson Frankfort Hospital, which I'm showing on the

located off of Knights Road. November of 2022, we appeared here in front of the board for use
variance to use a portion of this existing building as a medical use. And I say a portion
because this portion over here, which you can't really read from here, but it's the settlement
music school in a portion of this building. The application in this RSA 4 residential zoning
district was for physical therapy, occupational therapy use, which is a group medical use,
termed as an outpatient vestibular therapy use. And that was granted. So this application
is for a signed package. This is for you across the street.
The initial application was for four signs, two flat wall, this number two here, a door
sign, and another flat wall sign here at the entrance, as well as one freestanding sign
that will be placed at the entrance off of Knights Road.
And the cut sign package was coordinated with the existing settlement school
sign, as I mentioned. So the first sign, this Jefferson sign here, was the standard Jefferson
sign, health sign, with a logo of 52 square feet. The smaller sign, as I mentioned, near the entrance
was 13.2 square feet. The door sign and the monument sign measuring here seven feet wide by
11 feet in height with a total height of 13 feet for a total of 91 square feet.
We did meet with the RCO, the West Tarsdale Morrell Park Civic Association.
And as a result of that, we reduced this sign by two-thirds to a much smaller sign having 34 square feet.
And we've also agreed to remove this sign number three, which I guess is somewhat redundant in this case.

all right so 2216 north 7th street uh we're proposing a 12-unit uh building on this rm1
property uh it's a rather large lot and um you know we're hoping that the board uh sees
how the community saw in unanimously supporting this project all right so we have a couple of
we will review. First is the original notice of refusal, which is July 12, 2023. We did revise it with authorization of the ZBA, so I have a notice of refusal dated November 14, 2023.
we eliminated one refusal there was a refusal for a side yard we actually decreased another
refusal by by including instead of having a side yard as the open area we had the open area
completely in the rear where we had no rear yard setback previously now we have a five foot rear
yard setback which provides ample space to all of the occupants of the building who all have access
to it. And in our community meeting, there was commentary in the fact that they appreciated
this open space in the rear as well. We did meet with the 37th Ward Executive Committee,
Democratic Executive Committee, and the individuals in the audience as well as members of the
Democratic Organization were fully in support of this project. We also presented to them as well
as to you today letters to support from nearby neighbors the person to left and right of us the
property owners are in support of this project we have a letter of support i believe for 2222
2216 we couldn't get a letter from them but verbally you know they support this project and
mr uh gordeski would you know he's going to testify to that effect by adopting my testimony
property, or my representation right now. There's also what we're offering is not out of character to the neighborhood. This is an RM1 property. But there's similar the refusals that we're seeking for the amount of units, the occupied area, even the setback are all common to this, to this part of town. Similar situations where this board has granted
to this part of town. Similar situations where this board has granted those variances in the
past and we'll review that. Maps of the area, we're not that far from, you'll see that this
is an RM1 section of town. There is a lot of vacant land here, which is hurting the commercial
corridor in Germantown, which is a block and a half away. We're hoping that this density will
encourage other people to build in this neighborhood, but in addition to help support
that commercial border which is very important in the neighborhood as well then we'll see photographs
of the property in the surrounding area our plans and drawings or our rco meeting notice showing
proof that we um we sent that out uh to the community uh and proof of mailing of that notice
our application for appeal showing that we filed um our zoning appeal on behalf of these three
entities as well as deeds for these three entities for each of these properties are our certificate
of or certificates of tax clearance uh for these three properties and again at the conclusion my
presentation i would ask that dimitri virtually raise his hand he'll be sworn in i'll ask him a
few questions so he can adopt my testimony um so first things first is though notice the refusal
again we're not taking rsa5 property and trying to convert it into into multi-family use this is
an rm1 property um we think by combining these three properties together it makes it more
efficient rather than having you know either triplexes or quadplexes on these on each of
these properties which you know you'll then see basement use you'll see uh roof decks you'll just
see a funky floor plan not everyone's gonna have access to maybe the exterior the rear of the
property maybe not have trash rooms by combining these three properties together we're making
it very efficient and we think that having 12 units makes it a good use of these properties
there's a diversity of housing each floor will have a studio apartment a one-bedroom apartment
and a two-bedroom apartment equally important is that each of these this building will be
handicap friendly you'll see that there is built on grades so that was really important to
neighborhood too as you know there's an elderly portion of this neighborhood that can't find
housing and having a studio or one bedroom or even a two bedroom is helpful for these members
of the community but we originally had four refusals three of them remain after the change
in drawings and we would ask um you know again if the board you know uh supports this project and
you know, grants it. I don't know what the proper protocol is, but we just want to make sure that
the right refusal is reflected, you know, in the notice of decision. I don't know if you do that
by proviso and just reflect the date of the new notice refusal. But the old notice refusal is this
one. And, you know, we had a rear yard, excuse me, a side yard with refusal. And the other ones
for amount of units, occupied area, and rear yard depth, where we, again, originally we had zero
rear yard depth. We changed our plans. Instead of, you know, we expanded the building outward,
we set it back further in the rear. So with the board's approval, now we only have three refusals.
So we got rid of one. We still have the 12 units, where, again, it's not uncommon. This board has
granted such variances in the past the occupied area we still have you know 235 square feet of
open area in the rear which is more than enough for a beautiful common rear yard for the unit
occupants and then the rear yard depth we went from zero rear yard depth to five
to five feet of rear yard depth again closer into conformance of the code
and then again we we had a well-attended meeting not only are they in non-opposition they're in
actual support unanimous support of this project so they were they were very happy with the design
and the thoughtfulness of the project and then again you know we also reach out to the community
as a whole we have a letter of support from from the next door neighbor um next door property owner
verbally we have support from the one to left of us at 2214 and there's not a lot of development
around there's a lot of vacant lots um but we did reach out to many of the neighbors on north
franklin street which is to the rear bus where you know again maybe they're most directly impacted
by the by the lack of the conforming rear yard setback but even they are in these people on
north franklin street are in support of this project and then these are just the properties
and this is the 122 22 7th street
And then we use 2215 North 15th Street as a North, excuse me, North 7th Street as a guide.
and then we use 2250
Similarly, they proposed to combine three lots, put 12 dwelling units on there, and this board actually supported that as well in 2020 under calendar number MI-2020-001832.
So the amount of density created with this property is similar to the density that we're requesting to be created for our property.
And then maps of the area. Again, we're not in an RSA 5 district. Germantown Avenue is right here.
Tons of RM1, CMX2, a little purple here.
but this part of town for whatever reason hasn't been able to get going and we're hoping that this
this use along with some of the other newer buildings are going to help revitalize that
commercial corridor and again the individuals that would be most directly impacted by some
of the dimensional variances for rear yard setback and an open area are the ones who are in support
of our project too and then photographs of the property this is the front of the property
this is the hearing notice poster showing that we posted um in due course uh for today's hearing
this is 20 this is uh north 7th street to the right of the property uh north 7th street to
the left of the property then our plans and drawings that you can see we built on grade
um you know we're not you know seeking any height variance we're you know we're doing a flat brick
facade which i think was very important to the community we have you know a nice little cornice
that defines the property and most importantly and we have a huge backyard i mean it's slender
but it's huge where we can see we can put a lot of outdoor seating that's in common with the
neighbors no basement living each of the units are going to have its own storage locker which
again was important to the community because when you're dealing with studios or even one bedrooms
you're like where are you going to store your stuff and so my clients try to be as thoughtful
as possible and responsible as possible by not having basement living but but above that is to
have adequate storage for each of the units as well and then as you can see here everyone comes
in through this front door there's you come to the right and each floor is the same you have the
first unit is a studio there's a common hallway this is unit number two which is one bedroom one
bath and unit number three is a two bedroom two and a half bath instead of going down that common
hallway to the right, you keep going in the back, where everyone has access to a rear yard,
where, again, everyone's going to have access to outdoor space. Equally important is each of the
floors are going to have its own ventilated trash storage facility. So again, we're responsibly
storing trash. Given the amount of units, we're already going to be required to do commercial
trash pickup. But rather than doing what you see a lot of the duplex-triplex method,
where it's tough to, you know, where the trash is going to be stored. A lot of times we try to
store it in the units. We try to be responsible here and store the trash in a common hallway
where it will be disposed of by the client's property manager. And then again, it's the same
thing for all the other floors, the same floor plan. And then our RCO meeting notice, we had a
well-attended meeting November 21st at 6 p.m. We also emailed that notice several weeks before
the community meeting so the members of the leaders of the community knew of the existence
of that of that community meeting 131 addresses of you know for within that 250 square foot radius
of the property were mailed notice of that community meeting uh here are the addresses
proof of mailing to those addresses our application for appeal that we followed on behalf of these
corporate entities our original notice of refusal that we got updated and then our project
information form are in you know we have three deeds to the property one for each property that's
going to be consolidated and then our certificates of tax clearance uh with that being said i would

We feel the applicant has failed to demonstrate a hardship
and this proposal represents an overdevelopment

Furthermore, the affordable housing provisions proposed
are unenforceable by the city.
Accordingly, the Planning Commission strongly recommends

All right. So, again, we're allowed seven units as of right. So it's not more than we're not and we're asking for 12 and we're not doubling that. I didn't mention anything about affordability, although it does make it more affordable to have more units.
But again, in terms of the density that we're requesting, this board did approve a similar type of variance request for 12 units at 2248 North 7th Street, in addition to the 12 units that were approved at 2215 North 7th Street.
And then in terms of the occupied area, at 2120 North 7th Street, this board similarly granted a dimensional variance request.
And there's a number of properties nearby and a couple blocks over on Darien Street where they did the same.
and then for the rear yard depth this board granted a similar request for a deviant deviation
from you from the rear yard depth requirement nine feet at 2121 north 8th street and again the number
of these properties nearby and north darien street as well the property owners to the left and right
of us would be most directly impacted by the dimensional variances actually support our
project including a lot of the neighbors on north franklin street that are behind us who would be

located here in the front of the property to further show evidence of the fact that this has

six of the units this photo right here is where the seventh meter was for the common area but

The master plan was amended for St. Joe's University and was approved by City Council in June of this year,
which allows for the residence hall that you see here.
I'm going to show a photo, an aerial photo now of the site.
So we're here today for variance and special exception as it relates to the new residence hall.
This new residence hall is really of vital importance to St. Joe's University mission, which is to move student activity and living accommodations away from the neighborhood and within the campus, and it will also replace to existing dorms that are already across the street.
So this will be a new, state-of-the-art, modern, environmentally sound and sustainable building at this site.
We just want to orient everybody. This is 5800 City Avenue. This is Cardinal Avenue. This is Overbrook Avenue. To the rear of the property is another St. Joseph's University property, and this is City Avenue, as I said.
so the first variance that we're requesting is for the setback so it's important to note that
the spins district in which this property lies does not require a setback or a front yard setback
but because the property abuts adjacent residential districts lni applies the most
restrictive setback which actually is from the rsd3 zoning district which is to the rear of this
property and is the st joseph's university property and that's a 25 foot setback the other
residential district is to the right we're over here by overbrook avenue and that setback is eight
feet the setback most of this building is within the 20 meets the 25 foot setback but l and i has
issued the refusal for these bay windows right here. So the setback from the bay windows to the
property line is 6.9 feet. If you were to go with the setback for the RSA district, which is eight
feet, this is really de minimis and is in keeping with the Villiger Hall and St. Joe's University
campus across the street. This setback is required. Actually, if we don't have the setback,
what happens is if you move the building back it number one encroaches upon the welcome the
wolfington welcome center here and then you have an overcrowding of the land in this area with the
building setback and also and more importantly due to the grading and the physical conditions
of the property back here if we weren't able to have this setback here this room right here really
allows for space to provide accessible slopes for the pedestrian pathways. So not having this space
creates a hardship in that way. The setbacks, as I noted, the property, the building from here to
Overbrook Avenue is over 340 feet. From the back of the building to the property line, which abuts
the other residential property owned by St. Joe's, is more than 280 feet. And it meets the setback
here of course from city avenue because it's over 25 feet i'd like to move on to the next
slide to show you a site section so you can see as i said here's a north site section
here's city avenue here's the side of the proposed residence hall the driveway
here's the property as it slopes to Overbrook Avenue and as I said that distance from this
proposed building to Overbrook Avenue is over 340 feet and here is the proposed building
here's Cardinal Avenue and here's Villager Hall which is also a St. Joseph's University property
and these are very close to one another so it's really makes more sense for this setback to meet
what is happening across the street we understand what setbacks are typically used for so there's a
consistency with the buildings but in this case this building is really a standalone within
acres and acres of property so not to have that setback as i mentioned before would really create
a hardship next we move to the variance for the fencing we're proposing fencing to meet the height
of the existing fencing now we're moving the we have a new entry gate here at the intersection
of cardinal avenue and city avenue and the new fencing meets the existing fencing so they added
to create that whole coordinated and consistent frontage it has to meet the existing
coordinated and consistent frontage. It has to meet the existing fencing. It's eight feet. It
will all be consistent. It doesn't create any danger to the public health, safety, or welfare
in making this the same height. Similarly, and I'll move to the special exception. There's a
special exception required for the removal of heritage trees. Now, in this case, there are
certain heritage trees that are being removed because they are dead, but those heritage trees
that are being removed to allow for the construction of this new residence hall there there are 11
and in replace to replace those 11 heritage trees we are planting about 111 trees throughout this
site and on campus as needed but there will be additional trees planted on this site so it also
so it maintains and actually enhances the on-site landscaping so we don't believe that there's any
detrimental impact to the neighbors with the removal of these 11 trees because the new
plantings of 111 trees actually exceeds the required caliper inches that would be needed.
We're planting about 1,100 caliper inches with the new trees and removing about 1,000,
replacing about 1,000 inches. So we are exceeding that requirement.
uh finally i'd like to move to the renderings which show these are the crests that l and i
is designated as signage these are part of the building fabric these are really reliefs of the
building it's a saint joe's crest it's not illuminated as i said it's really a building
relief there is one here at the intersection of cardinal and city avenue
here's another good view so you can see the setbacks here
and how really consistent it looks coming down cardinal avenue from city avenue
this is the interior of the space and here's the second crest that l and i has designated as a sign
again we don't believe these are signs but if the board does not agree with our position we would
ask for a variance in the alternative with that we would like to state that obviously there's no
specific or detrimental impact with the removal of the heritage trees as it's being replaced
in kind and in excess of what's really required and the grant of the variances really would create
hardship especially with the setback so we believe that this request the special exception

so just quickly um i can't tell what you're viewing can you see a uh an aerial map a map
that has um yeah perfect okay all right so as i stated i'm here on behalf of the owner and the
applicant of 1807 pine street that's where this uh big red blob is fronts on pine street and all
these properties on Pine Street go all the way back to this very narrow alley-like street called
Panama Street. This building right here is the existing frontage. We would note there's no change
to the frontage or to the overall height. We did get a height refusal, but that's only for this
existing height at the frontage of over 50 feet. There is nothing else proposed that is coming
close to the 50-foot height. This is in the rear. This is a better photo. You can see this is along
Panama Street down here. There is a single car garage entrance with a curb cut and a pedestrian
walkway entrance, both with, you know, a one-story addition here. There's another three-story addition
here. This is all
100% lot coverage, and this is proposed to be
demolished in the rear and rebuilt. Essentially, the condition you will
see is the same condition as is right next
to us. This is 1805 Pine Street.
That condition was granted a variance for
the 100% lot coverage and fully built out at the third floor.
This, again, you can see, and I assume it will come up.
The property to the right of this screen is 1809 Pine Street.
That is who is represented by council today.
They are set back.
They have a third three-story building there as well.
Both properties are set back and have windows on the side.
Our property would be, as I said, continuing this iteration from 1805, and we would have a large window well cutout extending much of the distance and leaving light and air for 1809.
So again, you can just see this is the 1805 property that is fully built out. The only
difference is we will have a narrower garage and continue to have a single door for pedestrian
entrance. This is that Panama Street that I was describing. On the left is the rear of the homes
that front on Delancey. On the right is the rear of the homes that front onto Pine Street. So again,
it's sort of an alleyway condition in the rear but as you can see both here go look this is looking
east and then here looking west there is almost an entirely garage-like atmosphere in the rear
with virtually every property being a hundred percent built out and those that are not a hundred
percent built out similar to the next door neighbor are built out almost a hundred percent with two-car
parking in the rear. You can see this condition a few times. So we did go before CCRA twice in fact.
We went for the first time in September and they voted to oppose the project. Their opposition
and they voted to oppose the project. Their opposition was related to basically protecting
the light and air of the current residents at 1809, the next door neighbor, and therefore they
asked us. We had proposed a four-story rear addition, and they requested that we reduce
that to a three-story rear addition, and therefore they agreed to host us again for a second meeting
last night, and they voted not to oppose. So they changed their position upon our submission of
revised plans. We submitted revised plans, one page, and a proviso plan form indicating that
reduction of the rear addition, and those are in the package. So again, just to give you an idea,
This is an aerial view. Here's 1807 Pine. This full existing building and frontage, this is the 50-foot frontage. That's going to remain untouched. That's what's facing on Pine Street.
It's this rear portion that will be demolished, and we are seeking to put eight units in. There
are four units currently. We're seeking to put eight units in, add elevator, and full ADA
accessibility. It's our understanding that this would be the first ADA accessible building
on the entire block. And I should note here that the number of units is wholly contextual.
So there are actually seven units at 1808, 1809, 1814, 1815, 1817, 1819, 1820, and 1826.
and there are nine units at 1801 and 1810.
So there's a similar condition of multi-

So, again here, this is our property in the rear. As you can see, existing three-story addition. This will all be demolished and will become a three-story replacement addition.
we also received so we received a very a refusal for height that height again is the existing
condition of the front of this of our property that's unchanged and we're not going up to that
height with the proposed addition then we received a refusal for 100 lot coverage and
that is an existing condition at the property currently and we are actually reducing that
because we will have 135 square foot light well that will be adjacent to 1809 here,
the individual who's represented by council today.
So we will be maintaining, you can see kind of there's an alleyway-esque atmosphere
in between the two properties.
Obviously, any property can build out to the property line,
but when these two were built, these two rear portions were built,
they were set back in order to afford the opportunity for windows.
So again, this is just more evidence you can see were set back.
This rearmost portion would be built out to our property line, which is the cinder blocks.
The whole portion where you see from about 16, 17 feet from this full height of the front building
all the way out down along here will be the open atmosphere airway.
And then here, I apologize, this aerial view came out a little squiggly,
but this was just to show this is what CCRA wanted.
So we had proposed that this rear addition would be four stories,
which we felt was contextual.
Again, you can see from looking up and down the block,
there are a lot of four-story buildings there.
However, CCRA at its first meeting felt that in order to, you know, kind of look out for this building at 1809 and its interests, even though they were not represented at the September meeting, they asked us to reduce the height proposed for our rear addition, and we did so.
So again, this is the one page of revised plans that you have in front of you.

maintaining the curb cut and this will be where that pedestrian entryway is.
We have a new elevator going in. Again, we believe will be the first fully accessible ADA
property on the block. And this is that large lightwell. It's actually 20 feet long.
And this is, I should be clear, this is 1809 to the left. So we flipped orientation. So this is
where the alleyway is right now that has sort of setback on both sides. Obviously, we don't have
to set back on our side. Everyone's allowed to, again, build to the property line. But we thought
that it was a better design to set it back there. Again, just so that the board is clear,
we submitted a proviso plan form with a single change to reduce the proposed rear addition from
four stories to three stories. Again, these are the, whatchamacallit, here are the refusals that
I've already walked through. We could use a permitted five units. We are proposing eight
units, and I will use it this time. So five units are permitted by right with no bonuses.
Seven units are permitted by right with bonuses. We are seeking eight units, which we believe is
least minimum variance because we are already proposing very large, roughly 1,000 square foot
plus two-bedroom units. And in order to, you know, if we were to reduce the unit count,
we would be increasing those unit sizes really to difficult rental numbers as is.
I mean, we are proposing, likely to propose a three-unit building unit on the very first floor
fronting on Delancey. That will be, you know, sorry, three-bedroom unit fronting on Delancey,
which will be very large. And I should note that the zoning district is RM1.
So this is multifamily and that's what we're seeking to continue.
Now, I know that there, you know, an issue has already been raised with regard to notice.
So I will unfortunately take the time to walk through this. September 5th, the mailing was
sent out with regard to the CCRA meeting at the end of the month. That meeting was, that letter
was sent out to 130 addresses. This is their certificate of mailing. You can see at line 108
here, it was sent to 1809 Pine Street, the next door neighbor who's represented today.
At all times, this is a screenshot from 1807 Pine in the Atlas site.
At all times, this has represented the variance request and refusals.
And the property has been fully posted in the front.
This is the front of the property and the rear of the property.
this is our property over here. So again, just to go back, CCRA held us, you know, agreed to have a
second meeting if we could meet their conditions. We did so. We believe that we have a hardship here
because while we can, because, and I do recall where I conflated the three and four units,
I apologize, board chair. It is three units. Even if we were to buy right, build out this property, and we could do so fully out to the property line, we would have to make an ADA accessible unit because we'd be going, even at buy right, at four stories, we'd have to have a fully accessible buy right unit.
We're trying to put in an elevator, trying to become an ADA accessible building.
That can only happen with that increased cost.
We're also seeking that one basically additional unit.
We do have a very large old existing building that we're trying to bring up to current standards and will be required to bring up to current building code standards with by and through this change in use.
There is no effect to the public health, safety, or welfare, negative effect that is. We are fully contextual, and that was noted by CCRA at both meetings in unit count.
The, you know, there is no effect to the public health, safety or welfare.
And we will have actually this building will become significantly safer if we are allowed to make this addition and build it out to the current code, both with sprinklers, ADA accessibility and improved fire escape access, which right now, ironically, the fire escape requires anyone leaving to jump into the property at 1809.
9 in order to escape any fire that would be taking place. And lastly, I think, as everyone
can see, there's been, you know, a large change in this neighborhood, which by itself can justify
a hardship. You know, there is along both Pine Street and Delancey, not only on this block,
but on others, a significant increase in density. And, you know, the general context, as I walked
through, most of the properties are seven and nine units. And we are seeking eight with regard to
how those lay out. Again, we believe that there is, you know, we have a fully built condition,
we intend to not exacerbate that fully built condition, but to proceed. And really, the only
reason why we're coming before you with those issues um the dimensional issues are because
we're seeking that variance for the eight units which CCRA had no issues with and that's why they
changed their vote to not oppose um so with that I know I went very quickly I'm happy to answer
any questions that board chair the other members of the board may have otherwise I'll call my

So as to the merits of this case, then I'm going to ask my client, Martin Rosenblum, a few questions to address the board.
So first, can you confirm that you're the managing partner of 1809 Pine Street Association?
Yes, I am.
And that owns 1809 Pine Street?
And your property is immediately adjacent to?
It is.
Okay. And based on your knowledge, what was the actual use of the property, 1807, for the past few years?
Well, it was an absolutely luxurious three-family residence. She ran a business out of it. I suggest if anyone is interested in what it looked like, it's on Zillow, because it was just sold.
and it was in norma took very good care of the interior of the property it is absolutely stunning
and it three units to eight units is quite a jump uh i would like to add that although there
is full lot coverage on the ground floor there is not full lot coverage above the ground floor
It is well set back. And every other building on the block has some gap. Even the building directly behind Mr. Singer, which is built all the way across, is only at the ground floor, which he has.
everyone is set back for the remainder of their addition from the lot line okay other than himself
the rear of my property of the original l of the building which is how these buildings were built
in the 19th century identically matches the l of his building and i might add is perfectly
serviceable as rental units i have a hundred percent occupancy so uh i don't i i don't
understand why it will be the first block building on the block that goes property line to property
line on the rear and i will add that it was said at the meeting the other night that is identical
to 1805, which
by the way is a single family
house, but it is
But it is not identical to 1805 because 1805's rear addition does not go the full width of the property.

So this is on the south side of the alley will be the only building that goes full width.

building so they are radically expanding they are taking down an l which suffices for every other
one of the 20 or 30 buildings and they have made no accommodation to me i had asked for continuance
with the hope we could discuss this um it didn't happen i'm local i was never shown a plan
i was never shown any respect for that matter and i might add sir let's sir let me ask you
question did you go to the meeting last did you go to the meeting last night i certainly did and
i will say that you raise all these issues at that meeting i yes i did and i will also
residents association still i drop the opposition away i'm sorry i told them the occupancy of every
building on the east end of the block okay okay and it is a three family a five family a single
unit a seven family and the building after me is a three family they totally go back to my question
you told all them this last night i did and they still took their opposition away they
they they he told them at the meeting last night who's he uh the lawyer sean okay said that the
fourth floor was removed to accommodate 1805 pine street a single family house because it was
on their deck. Sean has said now at this meeting that it was removed at my behest when I never
saw the drawings. Nothing was removed to accommodate me because I didn't even know
that anything was going on. Okay, so I would like to start to state for the record that I would
expect that what was said at eight at the meeting to ccra is consistent what is said today and it
is not no accommodation was made to me sean whalen said the accommodation was made to accommodate
1805 pine street which is a single family house okay thank you
counsel do you have anything more from your client um yes so in your opinion is there any
hardship here there's tremendous hardship and there's no i'm sorry for me no for the owner
for the owner there's no hardship it was a totally occupied and performing building with
three units in it there are other three unit buildings on the block there is no hardship
okay thank you and are you concerned about negative impacts this development would have
on your property or the other neighboring properties tremendous um i'm not going to
dispute what was said at the meeting last night because that hasn't been entered into the record
here but as i said no l on any building on this block has ever been taken down in its entirety
they have only been added to demolition and i know they explained the meeting but demolition
i am an architect and i am a restoration architect i've lived up the block for 40 years
you cannot they are taking this building down under through a six foot wide alleyway
that we are all all used for access to our parking and they have said this isn't going to be a
problem when we have plumbers working on the street it's a problem and everyone is honking
their horn and by the way i have two rented parking spaces behind my building i don't know
I have two rented parking spaces behind my building.
I don't know how they will exist or how they will get in and out.

So it is going to inconvenience my tenants tremendously if they even stay.
There is a lot, as I said, in the same footprint that he has.
I have seven totally successful units.
There is no reason to demolish.
There is no reason to build up. And as far as the ADA, there are steps in front of the building
into a vestibule and then you go up. I have partial information. There's a narrow on the back
and the floor levels between the front and rear portion of the building differ by almost five
feet. So I'm trying to figure out how an elevator operates to a second floor where half the second
floor is five feet higher than the other. There are too many questions here. I have never seen
a section through their building, which I would like to see. They are putting a deck, which no
one's said much about, on their roof, which is going to overlook the neighbor next door who they
so graciously um uh accommodated with no accommodation to me but there's a roof deck
up there i own several properties in the neighborhood access to the roof particularly
open access by more than one tenant is hideous they go out they walk across the roofs you get
beer cans i have a building on the 1800 block of spruce i have a building on locust i can tell you
about communal decks so we're not going to try it with what we want to do is try to concentrate on
this building here and not multiple buildings around the city so okay on this building he's
putting the deck i'm sorry that's okay all right any more questions council might i add one other
fact sir um you can add a fact i mean tell your council okay um we just have uh one other comment
are you concerned about the trash that could result from eight units and that'd be kept
and we'll go out yeah we haven't seen plans with where the the dumpster is going to go for this
increased um density on this property all right all right thank you um and so based on my client's
testimony and it is clear there's no legal hardship here the applicant is asking for more than they
would need and this would have an adverse impact on the neighborhood mr whale cross-examine uh i
have a closing argument but no no questions for mr rosenberg okay why don't why don't you perceive
your closing argument thank you very much um and not to belabor any points i'll try to move quickly
because i know we are the last on the list um no we have another whole group of people but that's
Coming in, we're already past that next list, so I apologize. I'll be as fast as possible.
You heard that we are seeking eight units with a minimal rear addition. Those eight units will
have wholly internal trash. That was covered at the CCRA hearing and was a big issue for them
at the time. Wade Albert, who represents CCRA, told me yesterday he would be on this hearing
so I don't know if he is or not. I can't see the participants, but I'll let him discuss CCRA's
position. Again, CCRA voted to oppose this project in September. They did so for one reason,
because of the height of the fourth story in the rear. To be very clear, their request for us to
reduce that rear addition from four stories to three stories was solely for the benefit of 1809
Pine Street, Mr. Rosenblum's property. The reason why they did that and why they took that position
was because Mr. Rosenblum nor any of his partners were present at the September meeting and they're
the ones who have the windows facing our property on their own setback. So they took the position
that if we reduce that, that would benefit, even though we're not required to, and we could build
to 100% lot coverage, as could Mr. Rosenblum, if he so desired, that would benefit the property at
1809. We did so and represented to CCRA last night, and they voted not to oppose. As you heard
from Mr. Rosenblum. He was present last night. He found out about this meeting.

found out about the September meeting as well, but was president last night's meeting. I don't
believe Ms. Stefkovich was or not, but she can speak for herself. I didn't see all the attendees.
And Mr. Rosenblum raised all of the issues that you just heard today. CCRA still,
in hearing all of those issues, they determined, as this board has, that most of Mr. Rosenblum's
issues are not zoning issues. He has issues of he doesn't like the design. He personally has
seven units, but somehow our requesting more units is inappropriate. We should remain with
three units. I showed you, and the photos are in the package, the rear alley shows numerous
properties that are built out 100% lot line to lot line. You know, that's just a matter of fact.
The, you know, the demolition of the rear is by right. There's no question, you know,
because Mr. Rosenblum is frustrated with or doesn't like the demolition of the rear addition
is of no moment. One of the things last night at the meeting that the CCRA members appreciated and
why there was some questions about, you know, difficulty traversing Panama Street and so forth
was that, again, the owner of this property, Mr. Adam Singer, who testified already,
lives at 1802 Delancey. He's catty-cornered to this property, literally could throw a stone
against it. He drives Panama Street all the time. Therefore, not only is it being a good neighbor
to keep Panama Street open, it's selfish that he needs to and wants to keep Panama Street open.
So, you know, I understand that Mr. Rosenblum has frustrations with something happening in the rear and wants the status quo to remain.
As this board is well aware and has found numerous times, it is not a self-created hardship nor any basis to refuse the granting of a variance because a purchaser buys a property with the intention of doing something different with that property than is currently being done or even that would require a variance.
um also there is no legal requirement in fact uh the as the board voted in another case of my own
um there is no legal requirement for the continual checking of whether a posting remains posted
rather as miss emerson has quite eloquently set forth in numerous findings the legal requirement
under the code is for the applicant to show that they posted the property through substantive
substantive evidence, which we did. And then that burden shifts to the protestant to determine
whether or not and show that it was not posted. You heard no such evidence. It was arguably not
posted for at least all day, Monday, the 27th and a.m. on the 28th. But those are a day and a half
out of the entire posting period. That's not substantive evidence sufficient to carry their
burden and overcome the presumption that we established. So just to summarize,
there is clear hardship both in the change of the neighborhood, the contextual character of
the neighborhood, including the immediately adjacent property. This was held and determined
by CCRA upon a second review of the property
and this is the least minimum
variance as I already set forth and fully in context with everything
else going on on the block and finally this will actually benefit
the public with no detriment. So with that
board chair I appreciate your time and consideration of this matter.

accurate we heard this case uh originally on september 26th and at that time we opposed uh
based on concerns that were raised by uh individuals in the community and by our by our
committee members that the the height of the proposed addition in the rear was out of context
with the character of the neighborhood uh and at that after that i i spoke with mr whalen and
communicated that um if they were to reduce the height then ccri would reconsider um that change
that we requested i and i know there is some conflicting testimony i want to be very clear
about that it was not for the benefit of any particular neighbor it was for the community
generally was not we did not make ask to reduce the height to to to help the 1809 or 1805 or any
other property. It was just, we wanted to bring what we believed, um, the, this property back
into the context of, of the character of the neighborhood. Um, and so, um, we, we got those
revised plans and, and, um, gave, uh, the applicant an opportunity to, um, to, to represent last
night, which they did. Um, and as a result, um, CCRA voted to not oppose. I also want to comment
that this the uh mr rosenblum who um is i you know i totally understand the issues that he has raised
with um his you know his property in particular that he owns with his llc and we have tried i i
myself have tried very hard to um to connect mr rosenblum and mr whalen um and i i've spoken to
them, both of them, several times over the past two days. Mr. Rosenblum first sent me an email
or sent an email to CCRA, I believe, on Monday, which was forwarded to me. I immediately shared
the concerns about the notice postings with Mr. Whalen, and I think that's what got things moving
forward. We always try to be a neutral touchpoint for the neighbors and to facilitate any sort of
communications that would hopefully get everybody to agree on development.
I know that it may appear that that is not the case here, but we were hoping that maybe
there's some sort of agreement could be reached, and it appears that it cannot.
But that being said, having heard the plans twice, CCRA does not oppose.

The problem is, of course, our outreach started in May, and we didn't get any response from any RCO until almost September, or at least August.

there are two refusals both for the same property i want to clarify that one refusal is for four of
the units which we will see on the plans it's unit one through four they're individually asked to be
restaurants under that refusal and the second refusal is for unit five which is actually the
lower level of the building and that is a auto repair business so i'm going to go ahead and
start with unit one through four and then we will go to unit five as a second part of our presentation
so this is an application for use as a restaurant in four different tenant spaces in the building
27 north broad 27 50 north broad street is zoned i1 which it's industrial zoning what this building
is and i'm going to jump to photographs because it's probably clear to look at the photos to
understand what we're talking about here this is a large former industrial structure on the corner
of west somerset and north broad street this entire structure including the back area here
all belongs to the same building.
The building was at one point
some kind of industrial factory.
However, it has been vacant by,
I believe my client's estimate
and neighbor's confirmation
somewhere around 30, 40 years.
It might've been vacant for,
it has not been used in an industrial format
for as long as many people can remember.
At this point,
North Broad Street is becoming
a commercial corridor.
and my client is trying to revitalize this building in phases.
This is the beginning of the revitalization.
He has done some repairs required to first make the building safe
because it was unsafe when he acquired it.
Now he is trying to get commercial spaces put in at the front of the building
facing Broad Street.
These are the five spaces that we're here before the board for.
one two three and four unit one to four that we're looking for small restaurant uses and then
this is the entrance to the lower level where unit five would be for the purpose of auto repair
the plans can better show just how little of the building we're really talking about with unit one
through four i'm going to zoom in a little bit but you can see that this is the portion of the
building this each one of these is one of the units so this is unit one through four they all
have their own separation from the rest of the building which actually runs a substantial amount
deeper into somerset street we're trying to at least start phase one of the revitalization of
this building by starting these units and these units if allowed and completed would be completely
separated by wall and further space from Unit 5, the automotive use, so that they would not
in any way interfere with each other, both from a safety standpoint and also from an environmental
standpoint. The restaurant uses are small restaurants with one tenant already looking to
move into the space that my client has been in negotiation with, and the additional spaces he's
negotiation with other potential tenants so we know that at least one unit immediately would
be occupied and will be started should the board permit the use north broad street at this area
is still in between development it's not quite up and running as a as a lot of commercial uses
nearby are still not really supporting the neighborhoods in the area most of them are
car washes and those kind of auto there are other auto repair shops further down the street but
the restaurants were actually well received as a proposal with the neighborhood and the neighbor
that did show up to the meeting the so these four would be individually numbered as units however
they're all part of the front of the building trash would be stored inside and removed from
Somerset Street as needed. There are no operating hours at this point because some of these are
still currently vacant. However, the corner property would be occupied and would run as a restaurant.

We have agreed as part of speaking with the community group and also neighbor feedback that additional lighting would be provided.
That essentially the biggest concern in the area has been safety.
uh the these the building being large covering a large part of street additional lighting would
bring an additional activity would bring greater safety to that corner uh that being said i would
like to move on to the second uh refusal which is the automotive repair that is uh in unit 5
so to better understand unit 5 unit 5 is actually going to take majority of what is the
lower level of the building so this part will be the entrance to unit 5 along with a driveway
to understand scale the vehicle two vehicles can actually go side by side inside the driveway
and then the actual work would be done further down in the building in the back where the lifts
are so there's substantial amount of storage space here for vehicles um this this is a decent
representation of how small vehicle would look within the hallway but um when we were at the
actual meeting the operator of the business that that is trying to open indicated he can actually
get three vehicles side by side as needed within that drive aisle towards where he can have the
cars worked on everything will be deep inside the building and the building actually sinks down so
it is a ramp that you drive into that goes down towards the back of the building which is actually
lower than the area here and that is the area where the automotive repair would take place
there's a complete dividing masonry wall and again additional space an actual open hallway
and staircase and space that separates the automotive use from the restaurants so they
would have no interaction or interference with each other when it comes to the uses so the to
give the board a better idea of how that looks here's the um the hallway i'm going to zoom in
little bit so it's easier to see so this is the driveway this is where cars are tend to be stored
the working areas are actually recessed within here and there's a lot of there are actually a
lot of extra space that can be in addition used for vehicle parking if needed again this is a
starting the business trying to move in they try to start and then they realize that the
The zoning wasn't permitted, so right now everything stopped and is shut down and waiting for this case to move forward.
So we've had the inspector has been down there to look at the tire removal and tire storage.
And because of the amount of space available, the tires can be spread out, therefore not causing the kind of fire hazards a pile of tire being shoved into a small space would cause.
And the inspector, the fire inspector has been in working with the tenant on making sure that is not going to be an issue moving forward.
So we have basically been able to work with the fire inspector and also explain this to neighbors.
and they understand that with the space inside there won't be the typical issue of a lot of cars
gathering out on the sidewalks where other auto shops up and down north broad street have
been found to have done where they leave cars outside so because of all these reasons and
because of the size of the building we received again no opposition from the coordinating rco
or the neighbor regarding the application and our request.
I want to point out that we actually did have two meetings.
So the initial meeting, which was mailed and notified to everyone,
including the various RCOs that are involved,
that meeting, no neighbor actually showed up.
And because of that, the coordinating RCO was not comfortable making a decision
So they asked us as applicants to come back for a second meeting, and they also reached out to the council office, and we coordinated a second meeting where both they, the RCO, and Mike.
and we coordinated a second meeting where both they the rco and my client went and flyer the
neighborhood to try to get more notification and reaction from the immediate neighbors and
neighbors within the area on the list and even with all that effort i think only very few
neighbors actually showed up to the actual meeting the surrounding area does have some residential
properties. However, the aerial photo shows that majority
of the residents are actually across Broad Street, and
within reach of the building, a block radius, there are very few
active use households. So
with that, and with the non-opposition of the RCO,
the coordinating RCO, and the intrinsic hardship that this building
really isn't suitable at this point for heavy industrial
use, we would ask for the board's favorable review of this application
and grant the requested variances. I am happy to

and both um meeting ids um we sent a request for continuance um there was no compliant meeting
even when the applicant attorney spoke he never gave dates of meetings at all also um
And there's eight affected RCOs on this address.
For any address, RCO coordinators are assigned per address, and RCO coordinators are equal to all other RCOs.
There is no hierarchy amongst RCOs.
So he's speaking as if he can just talk to Allegheny West Foundation, who never follows the zoning code and the instructions and the RCO notice.
They never follow the instructions.
And he can just ignore the other seven RCOs who know nothing about this project at all.
All we received was three emails from, I believe it was Linda Trong, a staff member of his, and she said she couldn't get in touch with Allegheny West Foundation for a meeting.
Allegheny West Foundation, against the rules and instructions and the zoning code, they never communicated any scheduling or plans with the other RCOs as required so we could plan a meeting.
We have no meeting summary form. We have no floor plans, no site plans. We have nothing.
In a case like this, some of the RCOs would probably have wanted to make a site visit.
The project information forms that are completed have misinformation and incomplete information.
There's no explanation for traffic to these four restaurants at one location.
traffic to these four restaurants at one location and also there's tires there which people in the
neighborhood are not trying to go back to having a lot of tire businesses. We had no opportunity
to even discuss that or to find out what the applicant is presenting because we have no
information about this project. We're asking that this be continued and that the remaining
seven affected RCOs out of the eight affected RCOs, and 143 addresses. Most of them are houses,
some of them are businesses, that our rights be maintained to have public meetings before the
public hearing about development in our neighborhood. There is a conflict also with
Allegheny West Foundation, who served as coordinator, because they are a developer,
and they're doing favors for other developers, hoping that they can get favors when they need
them and they do this consistently adrian listen adrian listen one minute have you talked to
allegheny west about any of this we knew nothing about any of this i'm trying to explain to you
that we had three emails from linda tron who did write us all so she can write all the rcos we can
also receive notices of public meeting by email she wrote us three times i put that in the um
request for continuous because she did write us three times sorry she wrote allegheny west
foundation but she copied everybody else so that ability is there for her to do that when she's
trying to get a meeting date which she should do then allegheny west foundation has a duty
inside of the rco notice and by section 14-303 e1 to consult with all affected but adrian just
just for the point of information this is not the only time you've told us about allegheny west
they do this repeatedly and we have proof of it so we're talking about it today because um you know
i tried to call some of your rcos but we many times have time to talk on the phone none of them
mentioned this address because we didn't even know that meetings were being planned we're supposed
to be involved in the planning part of the meeting per section 14 303 e1 and they want to ignore this
all the time i have numerous writings where i've informed them um excuse me mr chair and excuse me
miss fernandez um i so i i understand that this is a very frustrating situation for you but the
zoning board does not does not oversee the rcos they are overseen by the planning commission so
you really need to direct your right so so the board is right miss fernandez please let me finish
um so the the board's concern here is one that the meeting occurred and two you know whether
the appropriate zoning standards are met for what is being requested um if you have comments related
to what has been requested by the applicant,
you can certainly give those comments.
But the board can unfortunately not able to assist
with concerns you have about the other RCOs
being included in the process.

So in our packet, we have a petition of appeal, the L&I project form, a deed, tax clearance, the impacted neighbors that were notified,
proof of mailing community letter l and i refusal photographs of the property the zoning notice
the site plan and i will move through to the site plan we notified 37 near neighbors
we had a very lively meeting and you know we appreciated all the comments from the neighbors
as you can see in this photograph the curb cut is pre-existing on this property so i tried to
find some history but obviously there was a pre-existing use of this as some type of parking
because of the curb cut mr jackson did not create this curb cut and he does not intend to widen it
in any way whatsoever which is the agreement that we made with the um rco um he intends to
um if this is approved remove this portion portions of this so that the um property could
be used for the two parking spots that we're asking for um again another view of the existing
curb cut on this property this is a view looking to the left this is a view on stillman street
the entrance actually to the property is on stillman street which is right here this is
jefferson street which is facing the camelot school which is located in the north part of
this picture and this is a view looking down jefferson street um on the other side of the
property here is a view looking directly at 2521 jefferson and you can see that the area where we
proposed to have the parking spots is located here in the rear of the property this is looking
at the zoning notice that's posted another view looking down jefford uh stillman street i'm sorry
and here is the uh site plan which i'll turn around for everyone to see
all right so um this is the corner of the property here on the side is the uh proposed parking with
is the proposed parking with the existing curb cut. We are proposing two accessory parking spaces
the existing curb cut we
here. They would be eight feet by 16 feet each. I would note for the panel that an average car
is approximately 15 by 15 feet by six. So this area can easily accommodate two average cars in
the area. We are asking for these spaces because there is an existing issue of congestion with
parking here on Stillman Street. I want to bring up a Google view. As you can see, this is Stillman
Street. There are a number of curb cuts that already exist on Stillman Street for properties,
whether it's for a garage I want to take you down Stillman Street to an area here where there is
parking that's existing for this property here and again we have a number of curb cuts that
already exist on Stillman Street you can see this is a garage it looks abandoned but here there's
parking that's going in and out on this lot where a curb cut exists we have curb cuts here
on the block. There's another curb cut over here to the left. So there are existing curb cuts
already on the block. So this property, again, we're asking for two spaces to alleviate congestion
in the area and to take two parking spaces off the street. I stated at the meeting that
my son just bought a house about three blocks from here and the parking is horrendous. Whenever I go
visit him I have to park three blocks away to walk to his house because there's no parking
so I can personally attest to how difficult it is finding parking spaces in this area now

i do is there anything that you would like to add there is not thank you from the board

just um one kind of a comment um the i know that streets did did review this um as a 16-foot curb
cut which is being proposed and i know that um from what i understand the applicant has agreed
to not enlarge the curb cut beyond what's what's already there um i would like an opportunity just
to talk with the streets department because the reviews for zoning are very preliminary and my
concern is that when they if they do enough have to do another review before the permit is issued a
more extensive review they may say that the curb cut is not sufficient um for the two cars that
are proposed so i just i want to make sure all of all of the things like the turning radius and
sight lines and whatnot were taken into consideration at the initial review so that
don't put a proviso on that comes back later that you know if the board grants um they put
a proviso on that says that that then contradicts what the street's guidance is does that make sense
miss nichols it makes sense hillary my only um i thought from what i understood from our architect
is that the widest or the narrowest point of this curb cut is 16 feet but i appreciate that you do
that so that we wouldn't have any issues later on yeah because i know that there's different levels
of review at different points in the process so i you know wouldn't want to to place a place a
limit and thank you for the clarification about it looked like on the plans where i saw that it
was 16. i didn't realize that was the narrowest part too yeah that's my understanding i could be
wrong um i'm not an architect but i appreciate that you would want to do that level of scrutiny
because we don't want any issues yeah okay i can i can look into that so we can we can
we can hold this mixture chair once we've uh sorry gone to the first audience
