I'm Charles Isdell, Director of Aviation for the City of Philadelphia, and pleased to appear before you today to testify in support of Bill No. 080585. This bill will authorize the City of Philadelphia, through its Department of Commerce, Division of Aviation, and Department of Public Property to acquire approximately 12 acres of real property located in the 13 vicinity of Island Avenue, Penrose Avenue 14 and Escort Street within the limits of 15 Philadelphia, Pennsylvania. The property 16 is currently owned by Jerome and Flora 17 Heilweil, husband and wife, and is subject to a Lease Purchase Agreement pursuant to which the property is currently leased to the City of Philadelphia, Division of Aviation. The bill will also authorize removal of a historic and now burdensome deed restriction which limits the use of the property to industrial use. Initially, the Division of Aviation anticipates leasing the property to the Philadelphia Parking Authority, which will develop and operate an economy parking facility on the property. The Airport has a need for additional economy parking spaces because passenger traffic continues to increase, with approximately 32.2 million passengers traveling through the Airport in 2007, a 38.4 percent increase in passengers originating travel at our Airport over the past five years. The existing economy parking lot is at full capacity and closed to potential users at least three times per week. In addition, it is anticipated that the Parking Authority will remit approximately $627,000 per year in parking taxes to the City of Philadelphia's General Fund. Therefore, the City is requesting authorization to acquire the property and that Council extinguish the deed restriction on the use of the property so that the property can be used for any Airport purpose. I'm Senior Underwriting Counsel for the National Commercial Services Division of First American Title, which is located across the street at Two Penn Center. I am pleased to appear before you today also in support of Bill No. 080585. First American was requested to insure title and has been requested to insure title which the City has indicated here desires to purchase from the current owners, Jerome P. Heilweil and his spouse, Flora P. Heilweil. A land record search was conducted in the Department of Records for the City of Philadelphia preliminarily to insuring title. The restriction provides that the premises hereinabove described shall not at any time hereafter forever be used for any purpose other than industrial development or redevelopment, including uses related to or accessory to industrial uses which do not change the essential industrial character of the tract and are appropriate and useful in its industrial development or redevelopment, unless and until the Council of the City of Philadelphia shall by ordinance waive or alter or amend this restriction in whole or in part. Accordingly, any entity which acquires the property from the Heilweils 29c9a960-d969-4b7e-95af-cb6d106eb942 (215) 561-2220 V A R A L L O Incorporated 10/22/08 - PUBLIC PROPERTY - BILL 080585, etc. is subject to this industrial use restriction unless the Council for the City of Philadelphia waives the restriction. Councilman, the payment to the City's Aviation Fund last year was approximately $33.6 million on total gross revenue of about $80 million.

It's the total for the 18,000 spaces that the Parking Authority manages at the Airport. The total revenue is about 80,000 -- 80 million. Excuse me. The profit, the net revenue that comes to the City's Aviation Fund, is approximately 33.6 million.
Let me ask the question in a different way. Is there a formula for the split between the operator and the City in terms of shared revenue? Is there a percentage of the revenue that goes to the Aviation Fund/City and percentage goes to the operator?

It's not really a 16 formula, but the agreement between the 17 City and the Parking Authority describes 18 that the Parking Authority collects the 19 gross revenue. 20

So there's no additional expenses incurred by the Parking Authority?
No replication of services, management or anything like that.
The Aviation Fund and the parking tax directly to the City Fund.

Mr. Isdell, what's the relationship with the Aviation Fund, the Airport, on the expenses that the Parking Authority claims they have in operating the facilities? What audit or what oversight or what is the relationship? Do you just rubber stamp the expenses that the Parking Authority suggests that they have in doing that operation?
No, it's certainly not a rubber stamp. We review the annual budget that the Parking Authority presents to us. That's also subject to review, I think, by the City Controller on an annual basis. And from a federal level, there are periodic audits done by the U.S. Department of Transportation, Inspector General. We are comfortable that the Authority's expenses are properly reported to us, and there is in fact -- there's also a cap on the amount of 29c9a960-d969-4b7e-95af-cb6d106eb942 (215) 561-2220 V A R A L L O Incorporated 10/22/08 - PUBLIC PROPERTY - BILL 080585, etc. administrative costs that can be charged against the Aviation Fund for the management of the Airport's parking facilities. And I think that our relationship is quite businesslike, and we're comfortable that the charges the Authority makes from the gross revenue are appropriate.

You always have these curiosity questions, that in 1997 we let a very valuable piece of land get away from us. Apparently a piece that if somebody had a crystal ball back then would have probably not allowed the PIDC to sell this off to someone else. Do we have any other land similar to this down there that really should be in your custody that's not? In 1997, somebody really should have not allowed Mr. -- whoever his name is here.

My understanding -- and I think I may need one of the lawyers to verify this -- is that the 1997 date was the culmination of a long-term purchase agreement that actually started like back in the 1970s. And that's just the official date of the transfer, but I think someone with a better history can confirm that.
But my point is, is there any other land down there that you have an opportunity to purchase? I remember we had that opportunity to buy that building right next to the Airport, that we wound up losing millions of dollars because we didn't act on it.
Well, we are actively looking at every parcel on our perimeter and beyond currently, and in particular, our Deputy Mayor, Rina Cutler, Deputy Mayor for Transportation, has tasked me with providing her with information on all of the land on the Airport's perimeter to see what might be 29c9a960-d969-4b7e-95af-cb6d106eb942 (215) 561-2220 V A R A L L O Incorporated 10/22/08 - PUBLIC PROPERTY - BILL 080585, etc. available and what we might want to be acquiring for the future, because I think your point is, we are a land-constrained airport. We are certainly being as aggressive as we can be, Councilman, in identifying and acquiring parcels, and hopefully we'll be in front of the Council in the near future with some additional requests such as this one. I'm not aware of anything right now that's out there that is the result of any sort of negligence or inaction on the part of the City, but every one of these parcels, I think, has its own story and its own history.
Did we ever get custody of that building? What was the company that owned it that shut it down?

No, we did not acquire that property, and I think with good reason. There were a number of reasons why we withdrew. There are times today when we wish we had acquired it, but at the time, considering the purchase price that was being negotiated and the fact that we were just embarking on a long-term master plan to determine where, if any place, we could build additional runways and other facilities, we did not have a clear picture of what, if any, need we would have for that parcel, and I think we were on the verge of spending over $90 million for a piece of property we weren't sure if we needed it or not, and as a result, some months after our decision to withdraw from the sale, it was sold for a much lower price on the open market. So I think that we made a good decision not to pay the price that 29c9a960-d969-4b7e-95af-cb6d106eb942 (215) 561-2220 V A R A L L O Incorporated 10/22/08 - PUBLIC PROPERTY - BILL 080585, etc. had been negotiated. If I had all my dreams, I would like to own that property today, just without even knowing what we might do with it, just to have it land-banked for possible relocation of existing Airport facilities, and I know that Deputy Mayor Cutler agrees with me on that, that we in the future will try to be more aggressive and try to acquire as much property as we can for the long-term view that the Airport needs to grow.

I don't really think that is a potential future use. Most of our garage facilities are kept in proximity to the terminal complex. This is really across the street from the existing economy lot, so I don't think that it would become multi-tier parking at least in the foreseeable future.
Who is going to construct? It's not much construction, I'm assuming, but who is the contractor that's going to develop the parking lot?
Councilman, once the Council approves this and the Mayor -- if the Mayor signs the bill and the proper documentation is done between the Parking Authority's counsel and the Airport counsel and the leases are 29c9a960-d969-4b7e-95af-cb6d106eb942 (215) 561-2220 V A R A L L O Incorporated 10/22/08 - PUBLIC PROPERTY - BILL 080585, etc. signed, the addendums are signed, a development plan for it would be done, and then all the work would be publicly bidded. Bill No. 080636, an ordinance authorizing the Philadelphia Authority for Industrial Development, notwithstanding any contrary requirements of the Philadelphia Industrial and Commercial Development Agreement between the City, the Philadelphia Industrial Development Corporation and PAID, to convey fee simple title to a certain property located in the vicinity of 61st Street and Eastwick Avenue to the Philadelphia Regional Port Authority, for a total consideration of $150,000, under certain terms and conditions. Good afternoon, Chairman Clarke and members of the Committee. My name is Duane Bumb, Senior Deputy Director of Commerce. I am here today to testify on Bill 080636, which 29c9a960-d969-4b7e-95af-cb6d106eb942 (215) 561-2220 V A R A L L O Incorporated 10/22/08 - PUBLIC PROPERTY - BILL 080585, etc. authorizes the Philadelphia Authority for Industrial Development, or PAID, to convey a 15-acre industrial parcel located at 3062 South 61st Street to the Philadelphia Regional Port Authority for $150,000. This property will be used as a truck parking lot by the merchants that will occupy the new Produce Market currently under construction on Essington Avenue. The 61st Street property was originally owned by the Redevelopment Authority and transferred to PAID in the early 1980s. The Redevelopment Authority Board is scheduled to consider the assignment of the Redevelopers Agreement for this site at its upcoming November 13th Board meeting. In August, the PAID Board approved the transaction, subject to City Council approval, and the project was also reviewed and recommended for approval by the City Planning Commission this past month. The sale and redevelopment of 29c9a960-d969-4b7e-95af-cb6d106eb942 (215) 561-2220 V A R A L L O Incorporated 10/22/08 - PUBLIC PROPERTY - BILL 080585, etc. the 61st Street site is a critical component within the new Produce Market development. When the new facility is completed, the Produce Market will support over 1,800 jobs, representing an increase of 375 jobs over the current employment levels at the existing Produce Terminal in the Food Distribution Center. The 61st Street site has poor soil and environmental conditions that have resulted in the developer incurring an additional $850,000 in corrective actions. This site penalty, when added to the other cost escalations experienced by the developer, has resulted in the Commerce Department negotiating a reduction in the sale price of the 61st Street property to $150,000, subject to approval of Council, as required under the terms and conditions of the Commercial and Industrial Revolving Fund, also known as the Land Bank. While this reduction in the land price from the $1.725 million appraisal is significant, 29c9a960-d969-4b7e-95af-cb6d106eb942 (215) 561-2220 V A R A L L O Incorporated 10/22/08 - PUBLIC PROPERTY - BILL 080585, etc. it allows the City to leverage a substantially larger investment in the project by the Commonwealth of Pennsylvania, which is providing more than $150 million in support of the project. Further, the increased activity and employment at the Produce Market will yield additional wage and business tax revenue to the City to more than offset the reduced sale price for the land. I ask that the Committee consider this bill favorably and that the rules of Council be suspended to permit first reading at the next regularly scheduled meeting of Council.
