President Street

Aye. The ayes are 17, the nays are zero. A majority of all members of Council having voted in the affirmative, the bill passes. The next bill for consideration is Bill No. 960823.

Chief Clerk

An Ordinance amending Title 17 of the Philadelphia Code entitled "Contracts and Procurement," by amending Section 17-107 entitled "Contractors: Labor Management Relationship," by revising the Prevailing Wage Ordinance, including extending the prevailing wage requirement to certain service contracts.

President Street

This bill having been read on two different days, the question now is shall the bill pass finally. The Chair recognizes Councilwoman Clark.

Councilwoman Clark

Mr. President, I wish to offer two amendments to Bill No. 960823.

President Street

The clerk will please read the amendments.

Councilwoman Clark

Mr. President, those bills have been distributed to members of CONSIDERATION OF SECOND & FINAL READING CALENDAR Council. And I don't know whether the clerk has it, or not. Here they are, two.

President Street

Does every member of Council have the amendments? The clerk will please read the amendments.

The Clerk

First amendment, proposed amendment, to Bill 960823, Section 1(1)(b), City Work: All building or construction work under a contract with the city for compensation that exceeds $2,000, including repair, alteration and remodeling, done on behalf of the city, under a contract awarded by the city and all other service contracts with the city for compensation that exceeds $200,000 and, bracket, $100,000, underline, $100,000.

President Street

The Chair recognizes Councilwoman Clark.

Councilwoman Clark

I move the adoption of the resolution, sir. (Duly seconded.)

President Street

On the amendment, the Chair recognizes Councilman Mariano.

Councilman Mariano

Mr. Chairman, there has been a little bit of confusion on this CONSIDERATION OF SECOND & FINAL READING CALENDAR amendment. Although I know that Councilwoman Clark's intentions are well here, I think what we need to understand is the scope of this thing. What she is attempting to do here is to amend the part that says, "Service." Okay? And as a former building trades member, the intention of this whole bill was to make sure that people can't do work less than $200,000. We made an agreement with the Administration for 100,000, and her amendment makes it 200,000. And I know her intentions are well, but I would rise against this amendment.

President Street

The Chair recognizes Councilman Kenney.

Councilman Kenney

Thank you, Mr. President. With all due respect to my colleague's and co-sponsor's reading of these amendments, they have been discussed at length with both the city Administration, the Law Department. And, as I understand them, it is moving the threshold from 100,000 to 200,000 dollars CONSIDERATION OF SECOND & FINAL READING CALENDAR on service contracts. The second amendment will define those specific services, including but not limited to those services. And that the issues addressed in this bill dealing with the construction, the construction issues, are left totally untouched. This is solely moving the threshold on service contracts specifically defined from 100,000 to 200,000, and were considered originally to be friendly amendments to this bill.

President Street

Is there anything else? The Chair recognizes Councilwoman Clark.

Councilwoman Clark

Mr. President, by way of clarification, I associate myself with the comments of Councilman Jim Kenney, which is the correct interpretation of what my amendment does. And I would be happy to speak off the record to my colleague, Mr. Mariano, so he understands what we are doing. We simply raise the number from 100,000 to 200,000. It is otherwise unaffected by CONSIDERATION OF SECOND & FINAL READING CALENDAR the rest of the bill.

President Street

The Chair recognizes Councilman Mariano.

Councilman Mariano

On the amendment, again, Councilwoman Clark's contentions are well. I sat here when the Administration spun their well good that they mean for all workers of the city. But what is happening here, service contracts -- I understand the difference between service contracts and construction contracts. Okay? Let's go down to locking systems, repairs, mechanicals, HVAC maintenance, repair elevators, escalators. When a generator blows up in the Municipal Services Building, that is a service contract. Union electricians come and fix the generator. If it is below $200,000, if it is $150,000, it possibly could go to somebody that doesn't pay prevailing wage under this bill, under this amendment. CONSIDERATION OF SECOND & FINAL READING CALENDAR That's why I would rise against the amendment. It is that simple.

President Street

The Chair recognizes Councilwoman Clark.

Councilwoman Clark

Mr. President, Mr. Mariano's objections are duly noted. However, he is correct. What we intend by this resolution is to permit small-business persons to do business with the city, without having their contract eaten up by the time it takes to continually produce reports. We should not hold small mom-and-pop contractors to the same reporting levels that one would hold for General Motors or large corporations. He and I have had this go-around on the record. We can do it again now, or we can incorporate our previous comments as those set forth fully here.

President Street

All those voting aye will be voting in favor of the amendment. All those in favor of the amendment let it be known by saying aye. Those opposed say nay. CONSIDERATION OF SECOND & FINAL READING CALENDAR
