Good morning, everyone. Sorry for the tardiness. A lot of things going on this morning. We have established our quorum. I'd ask all guests and visitors to please retire behind the rail, and with that, Council shall come to order. To give our invocation this morning, the Chair recognizes the Reverend Rafael Fuentes, I.V.E. of Saint Veronica Church and Saint Hugh of Cluny Community in North Philadelphia. He is here today as the guest of Councilwoman Sanchez. Before the invocation, I would ask for all of us to stand, and then remain standing for the invocation, for a moment of silence for those six individuals that have lost their lives in the very tragic event and in addition to which our prayers go out to a speedy recovery for those that have been injured. It's very unfortunate, but So, folks, I ask for a moment of silence at this time. (Moment of silence.)

I thank Councilwoman Maria Quinones-Sanchez for inviting me to be with you this morning. Greeting to the City Council President Clarke and all the members of the City Council and guests. In the name of the Father and of the Son, of the Holy Spirit. Almighty God, you who are infinite goodness, truth, and mercy, I ask you to restore your abundant blessings upon these men and women and that they may hear your voice and let them be guided by your inspiration in the highest wisdom and knowledge so that the divine light of your spirit may enlighten their minds and move their wills to govern with justice, mercy, and peace, especially in searching the common good and the highest dignity of all men and women they serve. Most merciful and compassionate God, show them the way of forgiveness and kindness so that they may hope for harmony and unity in important decisions that affect all peoples of the City so that everyone may live in a better community with life, love, and peace. Oh, powerful God, we thank you for all the graces and gifts we have received. Let us to be your instruments so that we may be your workers in the building up of the City. Strengthen its moral foundations with trust and accord so that we may discern, fortify, and secure the human rights of all individuals, especially the poor and the weak who are suffering. Finally, God of love, help us to understand that the decision of improving our lives is ours, and that decision is an opportunity for the best. As long as there is life, there is hope to be a good example so that together we may achieve the victory against all that is evil and corrupt so that only peace, happiness, and prosperity may rain in our lives here in our City of Philadelphia and in the entire nation. An ordinance amending Title 12 of The Philadelphia Code, entitled "Traffic Code," by permitting the record owner of an impounded vehicle to transfer ownership of the vehicle to the City, in lieu of incurring additional fees and charges for continued storage, revising penalty provisions and making technical changes.
And a non-privileged resolution approving the redevelopment contract of the Philadelphia Redevelopment Authority for the redevelopment and urban renewal of a portion of the West Philadelphia Redevelopment Area, identified by house number and street address as 4030 Haverford Avenue.
That resolution will be on next week's Final Passage Calendar.

During the other day, the members of the Transportation and Public Utilities Committee listened to testimony regarding the expansion -- the extension of the lease that will set the stage for the expansion of the Philadelphia International Airport, and as a competitive city, all of us understood the importance of the magnitude of such a project and the economic growth and development that will take place based upon moving forward on this project. But recognizing also the consensus was that making sure that the workers receive fair wages, the workplace environment in which they work is conducive to their well-being, as well as other aspects of minority participation on the construction side as well as professional services are just as equally important as the expansion and the growth that will take place as a result of the expansion. remain committed as a committee, as a team. I thank all the members as well as Councilman Goode, who is not on the Committee but engaged and raised some very important and critical questions regarding how the Airport operates with its vendors, as well as the participation from Councilman Kenney for also engaging in questioning how the Airport operates in whole. And I just want to just state for the record that we will continue continuing and working to address such issues as we move forward. Thank you, Mr. President. Good morning, Mr. President and members of Council. Thank you for the opportunity to speak to you. My name is Nadia Hewka and I'm an attorney at Community Legal Services in Philadelphia, which represents City residents from throughout the City. I live in South Philadelphia myself in the 1st District. I'm speaking about Bill 120054, entitled "An ordinance amending Chapter 19-1300 of The Philadelphia Code, entitled 'Real Estate Taxes,' by providing for installment payment agreements and requiring commencement of enforcement action, all under certain terms and conditions." I'm here today to say that many Philadelphians would be more able to pay their delinquent real estate taxes if their criminal records were expunged, removing a barrier to employment. According to Attorney General Holder's Reentry Council, about one in three Americans have criminal history records. The percentage in Philadelphia is probably higher than that. According to the Society of Human Resource Managers, 90 percent of employers do background checking. The result is that many people with criminal records have severe employment barriers that limit their income. The employment barrier that is represented by a criminal record was vividly demonstrated here in Philadelphia a few weeks ago when 3,000 persons with criminal records showed up at a job fair and were turned away because of the record crowds. But some criminal cases can be expunged and, most notably, those include arrests, summary convictions, and perhaps more as the Pennsylvania General Assembly considers a bill to allow some misdemeanor convictions to be expunged. We urge City Council to fund Community Legal Services to handle expungement cases. We believe that an investment of $100,000 would generate $6 million annually in savings and tax revenues for $60 return for $1 invested, as well as improve lives here in Philadelphia. Thank you very much.

Thank you, Councilmembers. The resolution authorizing the Committee to hold hearings to examine the feasibility of the transferring ownership or operations of Philadelphia Gas Works to a private entity is a bad idea, as Philadelphia Gas Works undergirds Philadelphia's economy, and Philadelphia Gas Works can also have the potential of creating a new economy platform. I'd also like to take the time to mention that Resolutions 130225 and 130227 ought to be tabled until there is some kind of resolution with the Dodd-Frank Act that particulars deal with their bank accounts of its customers. Eleven states, I report to the Council, have filed legal actions against the Dodd-Frank Act. There appears to be a lack of disclosure. There appears to be an indecipherable ordinance to these Dodd-Frank Act that no one can understand. So thank you very much.

Thank you, Councilman. I wanted to arrange it so I can see the light rather than blocking the red light. My name is Monty Wilson. I'm a an attorney with Community Legal Services in Philadelphia and I'm here today in support of Bill 120054-A, the real estate tax installment payment agreement bill that CLS and legal services have worked with Revenue and Council staff on for the last 18 months to set up a formal system of written payment agreements for Philadelphia homeowners to enter into payment plans on their delinquent taxes. I think many of us all know from the recent PlanPhilly article that came out last March that there are 40,000 homeowner-occupied properties in Philadelphia which are tax delinquent. This bill marks a big step forward, an enormous step forward in Philadelphia, towards a process of collecting that revenue for the City, while at the same time allowing these homeowners the opportunity to stay in their homes and make an affordable payment. I'm very optimistic given that the bill has been placed on the Consent Calendar that this bill will pass today. The thing I wanted to touch on base before my time ends is the next steps. I think this is an enormous step forward. I suspect that this bill will become a state and possibly a national model. It is comprehensive and well thought out, and I'd like to thank the Council staffers who worked with us. But the next step will, of course, be implementation, and the Department of Revenue and CLS and the housing counselors who have been asked to help these homeowners will need the resources and the funding to do that, and I would hope Council would consider that this month. The other thing to consider is that currently in Harrisburg, unfortunately I learned last week that there is a new bill that -- delinquent tax real estate sale reform bill, HB 1409, has been introduced, which would essentially preempt the bill that you are voting on today, unfortunately. It would set up a mandatory maximum of 24 months to repay your delinquent taxes and also, I believe, bar the City from forgiving penalties and interest on the amount owed. It's directly contradictory to the work that we've done for the last 18 months, and I would urge Council to take a look at that bill, speak to our state reps and urge the Harrisburg sponsors to amend that bill so that we can move forward with this bill. Having said all that, that's the work for the future. I am extremely grateful to Council for considering this bill. I'm optimistic that it's going to pass, and I want to take a moment to thank all the sponsors who were involved in the bill, particularly the folks that I have worked with from legal services, the folks at Philadelphia VIP, the Senior Law Center, and the Philadelphia Unemployment Project and PLA. I would be remiss if I didn't thank people at the Department of Revenue, Clarena Tolson, particularly Frances Beckley, their Chief Legal Counsel who came to the table and worked with us, meeting with us every two weeks for months to hammer out the bill. And, finally, I would like to thank three staffers without whom I think this bill would have been impossible: Sophie Bryan, former staff for Councilman Green; Jennifer Kates, Councilwoman Sanchez's staffer; and Todd Baylson, without whom I don't think this bill could have happened.
