I have an intuition to my lawyer.
Because I went to the justices, the peaceful intelligence, made the first step.
I follow him.
And the son he got, he talked about the studio musician, musician something, instrument.
Now he got another history.
For the abuse of prey, the next month, the attorney department got the poverty for sale.
Right.
Okay, so that's what we're going to have to do.
You're going to have to get your attorney and take the action against the individual.
The attorney department got $300,000.
He won a ticket.
I say, no, I'm not touching it.
Hillary, what do you have something?
No, just give me one second because while I was looking on Atlas, it didn't have the most updated.

He passed away.
The person borrowed the $30,000.
I mean, he passed away a long time ago.
And the lawyer used his son.
Every time they call, keep going.
Every time I have a cold day, they just ask him for the young orphan.
He say, oh, no, the son will be here.
But he let me let you know that he died.
The father died.
you're welcome all right so yeah so i um in accordance with what what the chair recommended
sir if so this was this appears to be have the property has been sold at a sheriff's sale three
years almost three years ago um if there are if you have concerns about what happens then you
do need to speak um with an attorney but the property does appear to be in the ownership of
another entity at this time and that's the entity that is selling the property and one of the things
to the court to the city to the charity department because the lawyer okay they set out the brain
right so listen i'm i'm we're really sorry about your problems but you're going to have to find a
way to handle it with your attorney and we're going to need to move on okay but thank you very

All right, so number 12, Mr. Goldberg again.
M-I-2025-007-397-1921 Poplar Street.
Mr. Goldberg, could you please state your name and spell for the stenographer?
Alex Goldberg, A-L-E-X-G-O-L-D-B-E-R-G.
All right.
Could you identify your client, the relationship to the property?
my clients are jeremy peskin and sarah manning peskin and they should be in the virtual audience
um and we also have a letter of non-opposition from councilmember young and i see also franklin
bill is here too okay um you also the applicant has 12 sign signatures right our vice chair has
a few questions for you. Good afternoon. Have you submitted your documents and exhibits five days in
advance of this hearing? I have. And do you waive the reading of the refusal and stipulate to its
accuracy? I do. Okay. Thank you. You can share your screen and see what your case. Okay. This is an
RSA 5 property that has an existing two, that has existing two family living in it that was
legally done and approved under buy-ride zoning at the time when it became a two-unit dwelling.
My client bought it. The proper licenses were not maintained. The zoning changed to RSA-5,
and now they're here because in order to get a two-unit rental license for their two-unit dwelling,
they obviously need to go through the variance process again.
Here's the notice of refusal, which states, again, this is a two-family dwelling.
And I have sort of a timeline of events that I think will paint a clear picture, but there's
a certain exhibit that I want to get to before explaining that.
Here's a letter from the coordinating RCO.
We had an in-person meeting.
My client, Sarah, was there with me.
They live in Philadelphia.
She works for the University of Pennsylvania.
There was no one opposed to the project.
It looks like 17 in support and two not opposed.
um they sort of felt like you know and i agreed that there was a hardship here and you know it's
been a duplex for over 20 years converting it back to a single family uh would be would be a large
burden here's a petition of neighbors there are several other multi-family properties on that
block 1925 poplar 24 31 26 41 and 27 all of those are because this was a multi-family zone block
So a lot of those multifamily licenses were maintained. This one was not since my clients purchased the property in 2016. They have had tenants since that time. According to Sarah, they've had no more than 15 days of vacancy since 2016, and the majority of their tenants have stayed for over five years.
so they have not had a lot of turnover here.
They were not aware of the fact that they didn't have the proper licensing
until they were advised by a realtor and hired us immediately.
Here's the property history showing the two-family living in 2005
when it was converted that way under multifamily zoning from a vacant structure.
And in 2005, that same year, an individual, the owner by the name of Andrew Storer,
got a two-unit rental license.
you can see in the affidavit sign on your screen that under his ownership he for the entire time
lived there so what andrew decided to do when it was a multi-family zone property was get a single
unit rental license because he didn't need a rental license for himself and at the time
we did not foresee the zoning would change to rm1 so we had the one unit rental license
and then in 2016 my client purchased the property with a one unit rental license and the zoning
changed in 2018 and by that point you couldn't get the two unit rental license back because it had
And by that point, you couldn't get the two-unit rental license back because it had been lapsed for some time.
it had been
So I hope that made sense.
Property was legally converted, had a CO.
The owner-occupied individual chose to get a one-unit rental license, and that caused this issue, unfortunately.
Here's the 1900 block of Poplar.
Those addresses that I mentioned are all two- or three-unit structures.
This is a two-unit building.
We're planning to keep it that way.
Here's the bill in 2018 when it changed from RM1 to RSA 5.
Again, they bought it in 2016 as an RM1 property.
Here's where that parcel was for the existing zoning at the time of the zoning change,
and then after it became RSA 5.
Here's the zoning map.
Google Maps perspective.
here's the photo so this is the front of the property we have a bunch of interior photos as
well there's a parking spot off of west george street which is sort of a rear street with a
bunch of other parking spaces that's the only thing i would point out about the refusal it
doesn't reference that parking space that surface parking spot i looked in the atlas file there's
reference to um the seeking of a of a variance for it in addition to other variances um i don't
see anything beyond that it's been that way for some time i know that the records can be spotted
on atlas we believe it to be a legal parking spot and i would ask if that's reflected in the record
and maybe we have to defer to the streets department for that here's the notice posting
at the front and the back of the property here's the backyard so the first floor unit has access to
this space under the deck and the first floor parking spot the second floor unit has access
to this back deck there it is here's poplar street to the right and the left and then west george
which is a narrow street to the right and the left where you can see parking is not out of character
interior photos so this is unit one these units we're not proposing to do anything different
to them these are listing photos the I believe the second floor unit is occupied and the first
floor unit is vacant the first floor unit is a one bed two bath there is basement use which is
existing you can see a photo of it right here which it looks like a workout room and a home
office there's not a bedroom down there the second floor unit second and third floor unit I should
say is a three bed two and a half bath this is what that looks like
very basic illustrative floor plans you can see the first floor unit is this
green color kitchen living in a bedroom at the back with access to the rear off
of the living room and then in the basement you can see there's a utility room and then that gym
at home office and a bathroom and then on the upper floors you have basically kitchen and living on
the on the second floor and then three bedrooms and two bathrooms on the third floor
the rco meeting we met with united france civil civic association on february 12th
The mailing certificates, the application for appeal, deed to the property showing they purchased it in 2016 from Andrew Storer, and then lastly is the tax clearance certificate.
I know my client's availability for this was depending on how long today ran, because I think they may be at the airport, so let's give them a try.
try to quote yeah jeremy or sarah
could that person please raise their hand there's currently no person with that name in a virtual
audience the goldberg you're an officer of the court we'll take your testimony questions from the

okay good afternoon again um with me here today are Mr. Sanjeev Jain and Mr. David Whipple the
project architect is with us virtually um that we're here today with an application for the
change of use for the multi-family residential 12 dwelling units and an existing structure
it was previously permitted for a machine shop and warehouse most recently it was used
as a church though it has long been vacant. We have a letter in support from the RCO unanimous
support and a letter of non-opposition from Councilman Young. The vacant structure sits
at the corner of North 11th Street and West Kelowna Street across the street from the
Penrose playground and directly abuts the regional rail line, making this a really difficult lot to
redevelop. It's zoned I2, medium industrial, but the block is largely residential with the other
properties being zoned RM1, CMX2, and the Penrose playground is zoned RSA3.
um the i-2 designation is what resulted in the refusal for multi-family use
