..Title Authorizing the Department of Veterans Affairs to construct and maintain a pedestrian bridge over and across University Avenue between Curie Boulevard and Civic Center Boulevard under certain terms and conditions. ..Body WHEREAS, the Department of Veterans Affairs owns or controls land on both sides of University Avenue; and, WHEREAS, the Department of Veterans Affairs desires to connect the Nursing Home Care Unit on the east side of University Avenue to the Medical Center on the west side of University Avenue by way of a pedestrian bridge; and, WHEREAS, the Department of Veterans Affairs has requested permission to construct and maintain a pedestrian bridge over and across University Avenue to connect the Nursing Home Care Unit to the Medical Center; therefore, THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. The Department of Veterans Affairs is hereby authorized to erect and maintain an overhead pedestrian bridge, approximately two hundred sixty (260) feet in length and approximately twelve feet in width, having a minimum clearance of approximately twenty-one feet over University Avenue, located as follows: (a) Centerline of the bridge intersects the easterly house line of University Avenue approximately two hundred eighty-two (282) feet south of Curie Boulevard. (b) Centerline of the bridge intersects the westerly house line of University Avenue approximately two hundred eighty-two (282) feet south of Curie Boulevard. SECTION 2. Before exercising any rights and privileges under this ordinance, the Department of Veterans Affairs shall enter into an agreement, with the appropriate City department or departments in form satisfactory to the City Solicitor to provide that the Department of Veterans Affairs shall, inter alia: (a) Agree that upon one hundred eighty (180) days notice from the City, they shall remove the bridge without cost or expense to the City and shall restore the cartway and footway of University Avenue. (b) Secure all necessary permits, licenses and approvals from all appropriate departments, agencies, boards or commissions of the City as may be required by regulation or law. (c) Assume the costs of all changes and adjustments to, and relocation or abandonment of, City utilities and City structures wherever located as may be necessary by reason of the construction of the bridge and its supports. (d) Give the City and all public utility companies the right of access, ingress and egress for the purpose of inspection, maintenance, alteration, relocation or reconstruction on any of their respective facilities that may lie within the present houselines of University Avenue. SECTION 3. The City Solicitor shall include in the agreement such other terms and provisions as he shall deem necessary to protect the interest of the City. SECTION 4. This Ordinance shall not become effective unless the sum of two hundred dollars ($200), toward costs thereof, is paid into the City Treasury within one hundred twenty (120) days after the date this Ordinance becomes law. ..End
