..Title Authorizing the Commissioner of Public Property and the Director of Commerce, acting on behalf of the City of Philadelphia to enter into a lease agreement with Tinicum Township, Delaware County, for the lease from Tinicum Township of an approximately 21.8 acre parcel of land adjacent to Philadelphia International Airport which is currently intended for use as a safety area at the end of a runway, under certain terms and conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. The City of Philadelphia (the "City") is hereby authorized to lease for public purposes from Tinicum Township, Delaware County, an approximately 21.8 acre parcel of land (the "Premises") owned by and within Tinicum Township and adjacent to Philadelphia International Airport (the "Airport"), which is currently intended for use as a safety zone at the end of an Airport runway, the Premises being more fully set forth on Exhibit "A" attached hereto and made a part hereof with the metes and bounds set forth on such exhibit approximations and not necessarily exact. SECTION 2. The Commissioner of Public Property and the Director of Commerce, or their designee(s), acting on behalf of the City, are hereby authorized to (a) execute and deliver a lease agreement ("Lease") with Tinicum Township for the lease of the Premises for a ten (10) year term with the option to renew the Lease for one additional term of ten (10) years and (b) take any and all further actions as may be necessary or appropriate to accomplish the intent and purpose of this Ordinance. SECTION 3. The Lease shall be substantially in the form set forth in Exhibit "B" attached hereto and made a part hereof, with such changes as the City Solicitor deems necessary or appropriate to protect the interests of the City. SECTION 4. The Commissioner of Public Property and the Director of Commerce, or their designee(s), acting on behalf of the City, are hereby authorized to execute and deliver any and all other documents, agreements or instruments (a) related to the Lease and the satisfaction of the City's obligations thereunder and (b) necessary or appropriate to effectuate the Lease or this Ordinance, all of which shall contain such terms and conditions as the City Solicitor shall deem necessary or appropriate to protect the interests of the City. SECTION 5. The Chief Clerk of City Council shall keep on file all exhibits referenced in this Ordinance and shall make them available for inspection by the public during regular office hours. ..End
