..Title Authorizing the Commissioner of Public Property, on behalf of the City of Philadelphia, to execute an easement agreement that grants to Philadelphia University ("University") an easement to convey storm water from the University's campus across a certain portion of Wissahickon Park and to repair and maintain the University's improvements in a certain easement area in the vicinity of Lincoln Drive, approximately 500 feet northeast of the Henry Avenue Bridge; also authorizing the President of the Fairmount Park Commission and the Executive Director of Fairmount Park to execute an Operations and Maintenance Agreement with the University that sets forth certain requirements for the University to perform improvements in Wissahickon Park and to maintain those improvements; all under certain conditions. ..Body THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. The Commissioner of Public Property, on behalf of the City of Philadelphia ("City"), is authorized to enter into an easement agreement ("Easement") with Philadelphia University ("University") that grants an easement to the University to convey storm water from the University's campus across a certain portion of Wissahickon Park identified in an attachment to the Easement and to repair and maintain the University's improvements in a certain area in the vicinity of Lincoln Drive, approximately 500 feet northeast of the Henry Avenue Bridge, as identified in the Easement. SECTION 2. The President of the Fairmount Park Commission and the Executive Director of Fairmount Park are authorized to execute an Operations and Maintenance Agreement ("O & M Agreement") with the University that sets forth certain requirements for the University to perform improvements in Wissahickon Park and to maintain those improvements. SECTION 3. The Easement, and all the exhibits to the Easement, must be substantially in the form set forth in Exhibit "A" to this Ordinance. The O & M Agreement, and all exhibits to the O & M Agreement, must be substantially in the form set forth in Exhibit "B" to this Ordinance. The City Solicitor is authorized to include in the Easement and in the O & M Agreement, and the exhibits to each of them, such other provisions as the City Solicitor deems necessary and appropriate to protect the interests of the City and to carry out the purposes of this Ordinance. SECTION 4. The Chief Clerk of City Council must keep on file and make available to the public for inspection during regular office hours the exhibits referred to in this Ordinance. ..End
