um regarding this case and i wanted to put on record so that she could understand the process
if you're called witness uh testifying was allowed you did not have your hand up to be called on
we move forward so i just wanted to make sure it's on the record that the case was heard and
the board made a decision on the case if you wish you can actually appeal the case to the court of
comment please please if you're unhappy with the decision made by the board thank you so much
cheer for your indulgence and if i could i just have one other matter
we continued the case and i see that fontanelle philagine is here and mr richardson is he going
um fontanelle you would have to reach out to the council person's office as well as the rco
they spoke today that they're trying endlessly to reach out to you and the next hearing for this
case is a must be heard so if you wish you can contact me um or either the zoning board email
for any other information again i thank you chair um i also i did email you the exhibit packet for
this case um we're waiting on okay seems like we up okay good yes so can you guys see it now
yes okay so um my name again for the record is patrick myers on property 7332 north 20th street
philadelphia pa 19138 um i am the owner i'm currently still the owner and i'm seeking a
variant to convert my single family into a duplex. So the first unit will be in the basement
apartment, which is currently a one-bedroom, one-bath, kitchen, bathroom, and the utility
room, and also a laundry room. Could you share those photographs or drawings with us, please?
Yes, I will. So the second slide now is the, okay, so let me go to this now. So this is a
drawing this is a proposed plan could you make could you make that a little bit yeah that's it
yes so this is currently the basement plan now so where the bedroom is currently in the back
which is the rear of the property is where the one bedroom is the closet off the bedroom um that's
where the garage was and now it's a bedroom the entrance to this um to this apartment unit is in
the rear of the house, which is right here is the back door. You come into the apartment. To the
right is the laundry room. This common is the living room area. The utility room is also here.
Coming down is the kitchen. And then off right in the front of the property is the bathroom. And
then there's a storage area right off the bathroom. The first floor now, which is the
the apartment for the the unit the kitchen the living room is going to be an open concept
stairs and this is the entry the front door entry to the property and
stairs and this is the entry the front door entry to the property and on the second floor are the
bedrooms so there's three bedrooms two bathrooms so there's a bathroom bedroom in the back closet
middle bedroom a common bathroom and then there's a massive bedroom in the front with also its own
bathroom and then off where these stairs is here there's a laundry laundry area
So if you had a property, this is currently the front of the house, make it smaller so
you can see, oh, and then this is the rear of the property.
So here is the entry to the basement apartment here, as you can see, and that's the deck
that was also proposed.
We also had the text-
And that was proposed, that's already been built, correct?
That's correct, yes, that is correct.
Because I currently live at the property.
So this is my unit where I currently live.
That's the entry door to where I currently stay.
and that is the deed that you guys had requested.
2017, April of, April, 24 date of April, 2017.
Patrick Myers, as we see here.
And tax clearance, no tax, no tax owed.
and this is a refusal letter.
And here is the, for the RCO meeting.
So the concern with the,
they had gave a refusal for the property.
And when I spoke with Isabella to clarify
why there was a refusal, she had stated
because she thought there was only one entry
to the property um let's see on the um there was um no entry so basically i had um explained to her
and let her know that there was two entry one entry for mine currently which is in the back
and then there was one in the front so i clarified that and i asked her if she could have done
another rca meeting where um i could have got an acceptance but she said that i would basically have
to um plead my key um case to you guys so just um clarify that with you guys so the position of the
rco was still in opposition yes it was in opposition because there wasn't clarity um she
but after after you made that clear they are still opposed um i asked for she said um i couldn't get
a second meeting so she it wasn't opposing but they said once they given um decision um that
was just a final decision they couldn't like go and change the decision that's what she had told
me okay all right um questions from the board uh yes how many meters is in the building currently
there are two meters so there's one meter for my basement and then there's a second meter for the
um the other unit and also two guest meters what about heating units
um there's one which i supply the heat so there's hvac that runs on throughout the house
and it's connected to my gas meter which i pay the gas for that so there's one heater meter
one heater one heater that controls the house yes thank you
any other questions from the board no
no anyone else would like to testify in this case if so please raise your hand
mr chair i see a hillary emerson emerson i will allow her to speak right now yep
good evening hillary please identify yourself for the record and i'll swear you in
good morning mr chair members of the board hillary emerson on behalf of councilwoman
sherelle parker where the firm to tell the truth the whole truth nothing but the truth i do
We're in the firm to tell the truth, the whole truth, nothing but the truth.
Thank you.
Mr. Chair, the Councilwoman is opposed to the proposed conversion of the single family home into a duplex.
This property is a row house in the middle of a block.
We feel that having a basement unit with an exit into the common driveway where there's purely parking and other obstructions would be a safety hazard and would also add congestion.
We also wish to note for the record that this property was already converted or at least partially converted without permits.
stop work order was issued in February to the owner for the work that he did. And the owner
himself is a contractor. So that was rather frustrating to the community because they felt
that he should have known that he needed permits in order to convert the basement.
Finally, we feel that there is no hardship as the property was clearly purchased as a single
family dwelling um and that a duplex um would be an overuse of the property um and as finally i do
want to note as um which previously stated the community um is in opposition to this request
thank you thank you very much anyone else would like to testify in this case if so please raise
your hand hello yes
anyone else who wishes to testify please raise your hand
can i say something on behalf of what she just said i think we we got all your information okay
all right mr chair i do not see any more hands okay thank you planning commission
mr chairman and members of the board the property is designated for single
family and the comprehensive plan and a zone for that use. There are no unique physical
circumstances or conditions particular to the property. For the reasons
staff opposes the granting of this variance. Thank you very much.
