Good morning, everyone. I note that the hour has come and that a quorum of this Council is present. Councilmembers will please take their seats, visitors will retire to the seats outside the rails. To give our invocation this morning, the Chair welcomes Rabbi Yael Levy of Mishkan Shalom Synagogue. She is here today as Councilman Cohen's guest. Guests and members will please rise.
I look to the mountains, I look deep into my heart; from where does my help come? My help comes from God, maker of heaven and earth; my help comes from knowing God in the heaven, seeing God in the mysteries of life and death; and my help comes from knowing God in the earth, recognizing God in the simple everyday acts of being alive. The psalmists teach that we are each servants of the holy one, and our call is simple and mysterious: We are here for the sake of each other, we are here to share our blessings and our GREETING/INVOCATION gifts, we are here to use our strength for good. The psalmists declare, God will not allow your foot to falter, your guardian will never sleep. The holy one will protect you from every evil. God will guard your soul. We are each eyes of God, we are each the hands of God. Our feet must not falter, we must not go to sleep. The heavens and the earth cry out. We must answer with our saving help. We look to the mountains; from where does our help come? Our help comes from knowing that in each moment, God comes through us into the world. May our hearts be turned towards compassion, may our actions speak of justice. May God guard our going out and coming back in, now and forever. Amen.

I'd like to invite Kathleen, Mr. Herb Matthews, Chris's dad. As a matter of fact, President Verna and guests, Mr. Matthews was a longtime
Recognizing Philadelphia's Chris Matthews as an author and host of the successful talk show "Hard Ball" and for 30 years, a significant achievement in the journalism profession and his contributions to the political arena: Whereas, Chris Matthews grew up in the Somerton section of Philadelphia with four brothers who taught him to eat fast if he wanted seconds, and to talk even faster and louder if he wanted to be heard. Some of us relate to that, don't we? Chris Matthews has served as a congressional aide and White House speech writer. He is the author of two bestselling books: Hard Ball and the book Kennedy and Nixon: The Rivalry That Shaped the Post-War America, and is currently host of MSNBC's talk show "Hard Ball," one of the highest-rated programs on the network.

And we're not eating. Chris Matthews' contribution to journalism and politics has been described in these words: He has raised the level of national dialogue. No, no, no. That was a quote. Resolved by the Council -- and I'm going to ask Councilman Brian O'Neill to please join me. I want Councilman O'Neill to join me here at the podium. And it's resolved by the Council of the City of Philadelphia that it hereby recognizes Philadelphia's Chris Matthews as an author and host of successful talk show "Hard Ball" and for 30 years a significant achievement in the journalism profession and his contributions to the political arena. Resolved further that an engrossed copy VISITOR RECOGNITION/PRESENTATIONS of this resolution be presented to Chris Matthews as evidence of the sincere sentiments of this legislative body. Certification that this is a true and correct copy of the original resolution adopted by the City Council of the City of Philadelphia on the 5th day of April, 2001. Now I know why your ratings are so high. We have a couple significant presentations that we would like to make today, and I'd like to call Commissioner John Timoney and Fire Commissioner Harold Hairston to the podium. (Commissioners Timoney and Hairston come forward.)
Commissioner Timoney, would you step forward, please. COMMISSIONER TIMONEY: Good to be back. Good to be back anywhere. Yeah, I've been watching Chris Matthews VISITOR RECOGNITION/PRESENTATIONS since started on "Hard Ball," and I thought it was great that somebody that spoke as fast as I did could make it in television. The only problem I thought he had was this very strange accent. But now that I'm here in Philadelphia over three years, it's amazing, he's lost his accent. (Laughter.) COMMISSIONER TIMONEY: Myself and Mayor Street, during the convention, we had the privilege twice of doing Mr. Matthews' show. And he shared with me at that time that when he was going up as a kid in Philadelphia, the only thing he wanted to be was the Philadelphia Police Commissioner. And so while we're not in the business of making dreams come true, we have the next best thing: We would like to make you an honorary Police Commissioner. (Commissioner Timoney hands badge to Chris Matthews.) (Applause.)

COMMISSIONER HAIRSTON: And although this won't get you out of any tickets or anything, it will allow you to have the permission of the Fire Department to extinguish any honorary fire going on in. We have an artist and he paints it up and everything. As you can see for, this is for an honorary chief; it has its name on it and has today's date. Now, after watching your show, I got to tell you, you don't need this, but some of your guests do. So you can always share that. But you know, if you put this in the right light, the "honorary" becomes obliterated and it will say "chief." (Commissioner Hairston hands fire helmet to Chris Matthews.)

And I want to ask Brian O'Neill to help me out with this next presentation. Chris, when Mayor Street heard that you were coming here to City Council today, he asked me to present to you this replica of the Liberty VISITOR RECOGNITION/PRESENTATIONS Bell. So if all else fails, you can hide behind this, but I don't think you need it, but John Street, Mayor Street, wanted you to have this Liberty Bell. And I'll let Brian O'Neill represent to you.
Chris, I've represented Somerton now for over 21 years.
And you are the pride of Somerton, St. Christopher's. And my regards also from the Mehan and Kenney families that are also extremely proud of you.
This may not be a big day for everybody here but it's a big day for me. It's great to come back after 30 years and see the same faces again. (Laughter.)
Anyway, thank you. So many changes. Anyway, Mr. Longstreth, thank you, VISITOR RECOGNITION/PRESENTATIONS sir. And thank you, Joan. Hey, everybody's here. And I want to go through my list. My dad here was for 30 years. My dad was the dean of the court reporters here in county court, Common Pleas Court. He was with Judge Canuso, Judge Proper. Who else? And Judge (indiscernible). He was here for 30 years and he told me all the good lawyers and all the DAs that were really smart and the ones that weren't really smart. And he knew the good ones and he always liked Rendell, right, Dad? There were a couple other guys he wasn't too hot on. He liked Street, of course, too. But anyway, so I learned a lot about politics watching my dad dictate, especially Domestic Relations Court, when he voice would go down and he wouldn't speak so loud. Those cases very tricky. Anyway, it's great to come back to Philly. As I said, I can again work on my accent again back here. I know we always add an extra syllable to every word here in Philly. I used to think it was "Huntington Park," but if you look at the sign, it says "Hunting Park," but who looks? And it's "Acme," it's got two syllables, I hear -it's actually three: "Ac-a-me." Anyway, St. VISITOR RECOGNITION/PRESENTATIONS Joe's has at least three syllables in it. I've learned how to speak Philadelphia by leaving Philadelphia 'cause I always thought it was the way we should talk. Anyway, it's really wonderful to be back. I love this city. It's the first city, the first capital, and I always think that Philadelphia gets overpassed too many times. They have commercials on TV that used to drive me crazy that say, "In New York, in Chicago, and Cleveland. . . " They'd even go to Cleveland and skip us. We should have a little more time for Philadelphia. I love this city. It's great to be honored by my hometown. Thank you very much. (Applause.)

It is my pleasure this morning to introduce a visiting group from the David Newman Senior Center that have come to City Council in regards to their studies of civic education over the past year. These 16 individuals are all from the former Soviet Union. The majority of them became citizens just three to five years ago. And I've had a wonderful opportunity to speak with them at their class. And I can tell you that there's no greater patriotic group of Americans than these -- a little older now but -- new and young Americans. And let me tell you, this is what I believe the face of immigration is for our country. I'd ask them all to please stand to be recognized. They're from Councilwoman Krajewski's district. Thank you, Madam Chair. I'd like to ask Councilman Jim Kenney and Councilman Frank Rizzo to come join me in presenting this. And all the high-ranking members of the Sheriff's Office and Judge Anthony DeFino. (Sheriff's Department members come forward.)
This is a resolution honoring Deputy Sheriff George L. Sternberger. Whereas, on March 15, 2001 -- let me VISITOR RECOGNITION/PRESENTATIONS wait for the family to join us. (Family members come forward.)
Got to have the parents here. Whereas, on March 15, 2001, began like most other days for Deputy Sheriff George Sternberger, who, as a deputy since 1987, has seen his share of the anger, sadness, and various other emotions that pervade criminal trials he attends in the performance of his duties; and Whereas. . .
. . . he could not have known that the defendant he was escorting from the courtroom to an anteroom had a homemade knife fashioned out of a bucket handle. He could not have imagined that the defendant would stab him on the left side and chin and grab his pistol from the holster at the same time. And he never could have known that the defendant would actually fire the pistol, despite Deputy Sternberger's amazing courage in jamming his thumb between the hammer and the pistol to prevent it from firing; and Whereas. . . VISITOR RECOGNITION/PRESENTATIONS
. . . once the panic button in the courtroom had been hit and order was restored, Deputy Sheriff Sternberger was treated for his injuries and released from the hospital later that day. And while this courageous Vietnam veteran acknowledges that there were others who helped stop the very dangerous situation, which involved kicking and stabbing and attempted shooting, it was he who literally put himself between the defendant and the rest of the people in that crowded courtroom; and
Whereas, although Deputy Sternberger would probably wish to deny his heroism, we are persuaded that his quick actions, even though he was already badly wounded, saved an untold number of lives. We are grateful to him for his bravery and for the high example of public service he sets. Now, therefore, resolved by the Council of the City of Philadelphia that we hereby honor and commend Deputy Sheriff George Sternberger. We applaud his commitment and pay tribute to his courage. Resolved that an engrossed copy of this VISITOR RECOGNITION/PRESENTATIONS resolution be presented to Deputy Sheriff George Sternberger as evidence of the sincerest respect and deep admiration of this legislative body. Certification that this is a true and correct copy of the original resolution adopted by the City of Philadelphia on the 22nd day of March, 2001, signed by Anna C. Verna, President of City Council, and cosponsored by all members of this City Council. (Applause.)

Knowing Judge DeFino, I am certain that he would love to say a few words. JUDGE DEFINO: President of City Council, Councilmembers, friends, let me say something. I was the beneficiary of my deputy VISITOR RECOGNITION/PRESENTATIONS sheriff's bravery on that particular day in question. So it goes without saying that I'm greatly indebted to him. And every day that he stands in my courtroom, I can assure you of one thing: I feel safe. And I thank you and I congratulate you and I congratulate the City Council for honoring him. Thank you. I am told that Chief Deputy Janet Pina would like to say a few words. CHIEF DEPUTY PINA: Thank you. On behalf of Sheriff Green, he would like to thank Councilman O'Neill and City Council in recognizing Officer Sternberger for his actions. Officer Sternberger was, in fact, a hero. He did stand in the line of defense of the defendant and the individuals in the courtroom. A real tragedy could have occurred. And he is a shining example of the men and women in the Sheriff's Office and how they put their lives on COMMUNICATIONS the line to protect justice daily. Again congratulations, Officer Sternberger. (Applause.)

To the President and Members of the Council of the City of Philadelphia: I am pleased to advise you that on May 23, 2001, I signed the following bill passed by Council at its session May 10, 2001: Bill No. 010061-A. And I am transmitting herewith for the consideration of your honorable body a proposed ordinance amending Chapter 19-3200 of the Philadelphia Code, entitled "Keystone Opportunity COMMUNICATIONS Zone," by extending the time period for exemptions, abatements or credits from certain taxes, under certain terms and conditions. And an ordinance authorizing the Commissioner of Public Property to execute and delivery to the Philadelphia Authority for Industrial Development without consideration a deed conveying fee simple title to a certain track City-owned land with the buildings and improvements thereon situated at 313, 315, 317, 319, 321, 323 and 325 Race Street. And an ordinance authorizing the revision of lines and grades on a portion of City Plan No.'s 163 and 310 by revising the curb lines and grades of a portion of School House Lane from Henry Avenue to Crescent Street by placing on the City Plan School House Lane from Crescent Street to Ridge Avenue. And an ordinance authorizing the Commissioner of Public Property, on behalf of the City of Philadelphia, to enter into a lease agreement with the Philadelphia Authority for Industrial Development for further sublease to the Urban Cable Works of Philadelphia, a Delaware COMMUNICATIONS limited partnership, to lease a certain parcel of ground located at 5201 Umbria street, under certain terms and conditions. And an ordinance authorizing the Mayor, on behalf of the City, to file an application with the United States Department of Housing and Urban Development for a community development block grant, as required by Section 104 of Title 1 of the Housing and Community Development Act, as amended, including all understandings and assurances contained therein. And an ordinance authorizing the Director of Commerce and the Commissioner of Public Property, on behalf of the City of Philadelphia, to execute and deliver and consenting to the execution by PAID of agreements with the Commonwealth which shall provide that upon the occurrence of certain events described in this ordinance, the Commonwealth shall have the option to purchase for $1 a one-third interest in the respective interest of the City. And I am pleased to transmit herewith two proposed ordinances authorizing execution and delivery of certain amendments to existing COMMUNICATIONS amendments affecting parking operations at the sports complex by the City of Philadelphia and the Philadelphia Authority for Industrial Development and the grant of certain options and restrictive covenants to the Commonwealth of Pennsylvania, each in connection with the expansion of the sports complex and the development of a new ballpark for the Phillies and a new football stadium for the Eagles.

Madam Chair, we had hearings -- and the resolution is sponsored by Blondell Reynolds and myself. We had hearings in this Council not too long ago about the spread of HIV and AIDS in the City of Philadelphia. And we understand that we have gotten very comfortable about it, but it has once again been growing, and growing in the areas where we do not at least suspect it: People of color, women of color in INTRODUCTION OF BILLS AND RESOLUTIONS the poor areas of this city. And we're living in a time in which we cannot stand idly by. And the policy that the State is proposing, it is one that generally will deter people from getting the care they need because it will deter people from going ahead and getting tested. The unique identifiers that we ask for in the resolution are being used in other cities and states across the nation. I believe that this is the way we should go. Currently, in Philadelphia, we have over 60 percent of all of the AIDS cases and HIV cases in the State of Pennsylvania. But strangely enough, the money that is received from the CDC that goes to the state for AIDS and HIV prevention and education, we get not a cent of that, we don't get any of that money. And if we have the biggest problem, just like we have the biggest problem in education and we're underfunded, we have the biggest problem in terms of this disease and we do not get the help from the State that we need. But however, now they are proposing policies that would create even greater problems for the City of INTRODUCTION OF BILLS AND RESOLUTIONS Philadelphia. And we say at this time that this cannot happen. So I ask my colleagues to adopt this resolution and really send a message to the State Health Department and to Governor Ridge and the State legislature. We need the money, they should send some money, and they should not impose regulations that really will create greater problems and more difficulties and really spread the disease even -- to an even greater extent than it is now being done. Thank you.

Madam Chair, I made a request earlier in the caucus with regard to my SPEECHES pen. I know that there's been an exhaustive search of the building conducted. I just want to let my colleagues know that it was actually on my desk in my office. And so I apologize for anyone that's been looking around for it. Thank you, Madam President.

I would think the remarks made by Councilman Nutter might have been more appropriate if they were made by me, but it shows that age doesn't add up to everything. (Laughter.)
Madam President, while in between the meetings of the two committees this morning and the Council caucus, an extremely important event took place up in the State of Vermont. Vermont is a beautiful state. It has, for example, no billboards, none whatever, something that Philadelphia could well emulate. But the event did not deal just with billboards; it dealt with all kinds of human rights. It was a political event. It began the first step in a different direction from what SPEECHES we've been seeing over the last few months. It began to stop the downward drift of rights among Americans. It began to create a situation politically in Washington where we have some hope now with the Democrats in control of the US Senate, that there may be some attention paid to the environment, that instead of drilling up in Alaska the oil wells, despoiling the environment, instead of giving away to rich people all of the assets of the government in order not to have any money available for human needs. I think we're going to see something else. And maybe we'll even see Democrats act like Democrats instead of acting like pseudo Republicans. So I just want to note, Madam President, this very, very important event, which will affect everybody's lives in Philadelphia for the better. Thank you, Madam President.

Yes, Madam Chair. Thank you. SPEECHES Just two thank-you's to two of my colleagues. One, last time we were here together, Councilman Longstreth was sitting in one of the chairs on the side because of his current knee problem, and I asked Councilman Mariano, who's not here today, if he would give up his seat, I'd move over. I just want everyone to know what it is, but I really want to thank Councilman Mariano, who's absent. He didn't hesitate. I didn't tell him he was getting put in the will or anything like that. (Laughter.)
And he agreed to it. And the other person I want to thank for all her hard work -- and I know she's still a rookie, but maybe she's not a rookie anymore. Councilwoman Blondell Reynolds Brown really worked her tail off on that bill. (Applause.)
And I think the bill would have passed a long, long time ago had the previous sponsor worked nearly as hard. Thank you. ADJOURNMENT
