And you said that's where they're going to store their trash in the rear yard?
Yes, unless I could do it on a payment like the neighbor did across the street and box it out and put a lock on it.
We don't.
They'll do it on a payment.
can you go back to the plans quickly
and and it's like i keep seeing the same three pictures so it's hard to kind of see
that's the basement this is the first floor okay yeah with two speakers one in the back
one in the front one in the back one entrance to the front one x entrance through the back
they have their own entrance so so so the back unit on the first floor is going to enter through
the backyard yes okay and the unit up front is going to have it's from this door towards the
front gotcha okay and then the bill code door is the one that has dn on it okay then you come in
the stairway and you go upstairs can you go to the second floor sure well all tenants have
access to the entrance
that goes to the second floor?
Will all tenants have
access to the entrance that goes to the second
floor? All tenants? No, just
the people that live on the second and third floor will have
entrances to... What's your mail plan for the
first floor tenants?
There's going to be five separate boxes
on the front.
What are you defining as the front?
Where the first...
The middle doors on Atlantic
street okay but what about like amazon packages because they won't fit in the mailboxes and the
only protective vestibule now is only for three tenants or three units no a lot of people have
the drop-off boxes now in front of the houses i can get one of them for amazon but that also
you got to check with streets you're now encroaching into the right of way
other questions more of a comment i think your third floor bedroom is a little small
and i think it's the designers knew that because they did not show a bed in that
i question how much you have in there you might need to rethink that layout
the store for a bedroom is too small i think not too small it's just doesn't really fit a bed
technically it needs code but when you don't show furniture it's you know but it's it's less than
eight feet wide it's questionable anytime you know you have a plan it doesn't show
i understand it reeks of questionable yes other questions from our attorneys our attorney has
other questions from our attorneys our attorney has something to say yes uh lynn reidel huber
something to say here yes uh lynn right

Now, MI2025-004-380-4378-74 Main Street, Henry Clinton is the attorney.
Good afternoon, Mr. Chairman and members of the board.
Hi, Mr. Clinton.
Could you please state your name and spell it for the stenographer?
My name is Henry Clinton, capital H-E-N-R-Y, Clinton, C-L-I-N-T-O-N.
Right.
Do you swear or affirm to tell the truth, told the truth, nothing but the truth?
Could you identify your client and relationship to the property?
Sure. The client is Brazilian Wax and Spa by Claudia, Pennsylvania Corporation, a rather long name.
But Claudia Risardi is here on the call.
It's C-L-A-U-D-I-A, Risardi, R-Y-S-S-A-R-D-I, along with Analia Williams, A-N-A-L-I-A, Williams, W-I-L-L-I-A-M-S.
Both are on the call.
Okay. And Mr. Clinton, I understand this is going to be here and hold. Am I correct? Correct. Because we're waiting for amended refusal. Yep. Our vice chair has a few questions. Actually, I'm sorry. It's going to be here and resume.
what was i didn't hear what that was said
sorry because of probably the uh you're in resume yes yeah so we're going to hear it
but then it's going to be resumed because of what is he's being submitted okay
good afternoon have you uh submitted your documents and exhibits five days in advance of this hearing
I have.
And do you waive the reading of the refusals and stipulate to the accuracy?
Okay. All right. Thank you. You can show your screen and proceed with your case.
Ms. Graham, I submitted one revision this morning. It's an attachment to the proviso. So that was something I admitted.
Thank you.
We have that. Thank you.
Is that visible, Mr. Chairman?
Again, thanks for hearing this case.
this is a request on behalf of a business that has owned and operated the subject building
4370 to 74 main street for the last six years it's a request to add uh five apartments above
the existing structure part of the structure is designated by the uh commission historical
commission so we had some nuances to to play with uh before we got to this point in fact we were
We were going to have a hearing back in July, and we had to request an amended refusal, and during the interim, the examiner asked us for additional information, so I don't really know when we'll get that amended refusal, but hopefully it'll be soon.
So these are the exhibits, A1 through A10, as well as some past zoning records.
The refusal, pretty clear.
It's in the CMX 2.5 zoning district, a pretty broad zoning district.
We requested six dwelling units.
We have reduced that to five.
So we've eliminated this one refusal.
And the second refusal has to do with the minimum rear yard depth.
You'll see from the photographs that this building has two fronts, one on Main Street
and one on the Schuylkill River, the footpath behind it.
So the building is already 100 percent occupied. We cannot have a rear yard whatsoever.
So we do have overwhelming support by the two RCOs in Manioc, both the Manioc Neighborhood Council as well as the Manioc Development Corporation.
So this is the photograph of the existing building.
So where it says Brazilian Wax, that entire span, which has a white clapboard on the second floor and some detailed open windows on the first floor, that's the designated part.
And 743-74, which is a one-story building currently attached to the main building, but that has not been designated.
