Good afternoon, everyone. This is the Committee of the Whole. I would ask Mr. McPherson to please read the title of Bill No. 010372.
Bill No. 010372, an ordinance amending Chapter 19-3200 of the Philadelphia Code, entitled "Keystone Opportunity Zone," by extending the time period for exemptions, abatements, or credits from certain taxes, under certain terms and conditions.
Good afternoon. Please identify yourself for the record and proceed with your testimony.
Good afternoon, Madam President and members of the committee. My name is James Cuorato and I'm the City representative and Director of Commerce for the City of Philadelphia. With me is Vince Dougherty, who is the manager for our Keystone Opportunity Zone. I am here this afternoon on behalf of the Administration to testify in support of Bill No. 4 6/12/01 - WHOLE - BILL 010372 010372. This bill would authorize the extension of the time period for of the original Keystone 4 Opportunity Zones. The authorization is contingent 5 on the Commonwealth of Pennsylvania's approval. 6 At the recent Keystone Opportunity 7 Expansion Zone hearing before this committee, I 8 stated that the same legislation that created KOEZs 9 also allow the City to extend all, some, or none of 10 its existing KOZ sub zones for three years so that 11 they would expire concurrent with the KOEZs; that 12 is, December 31, 2013. The essential provision of the legislation is that extensions must be on a sub zone level and cannot be further broken down on a property-by-property basis. Given that provision, the Commerce Department evaluated each sub zone based on the development to date, the potential for future development, existing impediments to development, and overall cost of extension. The result of our evaluation is before you in this legislation. We are recommending that all sub zones be extended except for PIDC's Industrial Parks (East) Sub Zone and the Upper Delaware River Sub Zone. The foregone revenue resulting from this 5 6/12/01 - WHOLE - BILL 010372 extension is estimated to be $2 million per year. The reason for excluding PIDC's Industrial Parks (East) Sub Zone is that this KOEZ sub zone has been the most successful of the sub zones and, therefore, does not need the additional years to promote development. Furthermore, the annual cost to the City in foregone taxes is projected to exceed $4 million for this sub zone. The Upper Delaware River Sub Zone was removed for consideration because the City is undertaking a major reuse study of the Upper Delaware River. To extend the time in this sub zone while its future is being studded did not seem appropriate. In the ten remaining sub zones, there has been very limited development. In many of these areas, the properties that were included in the KOEZ are challenged sites. Many sites have environmental problems, other sites need to be demolished, others are abandoned and need to be processed for sheriff's sale. While all of this work is being done, KOEZ tax benefits are diminishing. A perfect example of this problem is the former Stanley Blacker Building at 19th and 6 6/12/01 - WHOLE - BILL 010372 Allegheny Avenue. The Commerce Department has been working with Councilwoman Miller's office, Allegheny West Foundation and the Hunting Park Germantown Business Association for over a year to prepare a five-acre KOZ parcel for a new business to locate. Because of the demolition and environmental remediation that is required, we cannot offer this property for sale until early next year. Construction of a new facility would take a year, resulting in the business getting less than eight years of KOEZ benefits. Since there is very limited demand by businesses considering some of these troubled sites, the three extra years of KOZ benefits can be critical to attracting new business investment. In addition, it should be noted that our KOEZ benefit is leveraged by an equal or greater State benefit. It is our opinion that by extending the ten sub zones, we will have greater success in attracting new businesses to the City and thereby putting many old, abandoned, or otherwise challenged sites back to productive use. We believe that the additional wage tax that will be generated by these new or expanding operations will more than offset the 7 6/12/01 - WHOLE - BILL 010372 foregone revenue. It is for these reasons that we ask for favorable consideration of this extension.
I should point out that the deadline for advising the State that we will extend the KOEZs is June 30, 2001, and an ordinance of City Council is required. Unfortunately, this public hearing did not get scheduled until today, and the best that we can hope for at this point is approval by this committee in first reading. We would also respectfully request Council's consideration of a resolution this Thursday which would indicate Council's intent to approve this extension. We will then work with State officials to determine if these actions are sufficient for approval of our request or, I might add, Madam President, to see if we can seek an amendment to the State legislation that would give us the additional time that we need. This concludes my prepared testimony. I want to thank you for this opportunity to testify on this bill and I would be glad to answer any questions that you may have.

Hi. My name is Michael Moore, Executive Director of the Germantown Special Services District.
Thank you. REV. SIMMONS: Reverend Leroi Simmons, the Executive Director of the Central Germantown Council.
I understand you wanted to testify? REV. SIMMONS: We're just honored to be here to be a part of the Special Services District that has made such a difference in the Germantown area. I don't know if you knew about it prior to the Special Services District, but there was a considerable amount of trash and crime, and we listened to the neighborhood and the businesses in the neighborhood, and they said if we could make it clean and safe, Germantown had a opportunity to turn around. And we have seen a renaissance in central Germantown now in part because of the work that's being done by the Special Services District. I'm honored to be a part of the board.

Yes, I'd just like to have a few comments, Madam President. Prior to me being elected to City Council, I was president of the board of Central Germantown Council, which is the CDC that pretty much is responsible for development in the business district, the Germantown and Chelten business district. Germantown and Chelten was the largest business district, second only to Center City. And for many years, we saw it decline, and there was a group of people that consistently worked and did a whole lot of things when Mayor Green was in, and we eventually put together a group called Central Germantown Council. And through that council, when I was president, I contacted Mark Levy here in the Center City District 'cause we were interested for many, many years in putting together a Special Services District. That district -- Germantown Special Services District, along with Frankford, were one of 14 6/12/01 - WHOLE - RES. 422-435 the two first districts out in the neighborhood, out in the community. So it's -- of course, it took Center City five years to make a impact, to make a difference, and Germantown is moving along slowly and surely. Certainly small special services districts do not have the multi-million budget that the Center City District has but we're trying and we're doing a lot of different things. And it is time for a new board, and I am glad that Mr. Simmons and Mr. Moore have come down to talk about the board members. I think that most people that have been nominated for the board are good people and we also have a few vacancies, but we've got five business operators that are interested in filling those slots. So I would just say that I strongly support the appointment of these individuals to the board.

Good afternoon. I have copies of my testimony. Would you like me to distribute them?
My name is Connie Winters. I have been a resident of Germantown for years. I 18 a background in city planning, specifically in 19 low-income housing, real estate sales, and building 20 renovation of historic properties. I am here today 21 to testify against the approval of the proposed 22 slate for the board of directors of the Germantown 23 Special Services District. 24 The GSSD has operated in violation of 25 its own enabling legislation and the Municipal 16 6/12/01 - WHOLE - RES. 422-435 Authorities Act of 1945 for nearly the entirety of its existence. Its original board met for a maximum of six months; I have been told this directly by the original board. The enabling legislation provided for a board comprised primarily of property owners and residents of central Germantown. Not only has there not been an active board of directors during the last five years, but the current list of nominees does not meet the requirements for property ownership or residency. I own three properties within the boundaries of the Special Services District and am a past president of the Germantown Business Association. During my tenure as president, I made efforts to coordinate the activities of the two organizations with little success. Although Leroi Simmons held a seat on the board of the business association, the GSSD repeatedly refused to cooperate with the GBA. Cooperation between the two entities is essential for the improvement of the business district. Michael Moore, who has been the executive director of the GSSD since its inception, was the executive director of the GBA prior to the establishment of the GSSD. The funding for his 17 6/12/01 - WHOLE - RES. 422-435 position came through the Commerce Department. This funding was shifted from the GBA to the GSSD. The GBA has existed since that time only through its membership dues. All of the real money which is available to promote the business district and manage cleaning operations is funneled through the GSSD. The budget for the GSSD is supposed to be based on assessments of the properties within the district. These properties are assessed at 10 percent of the property tax. The spirit of the enabling legislation is that the budget would be administered by a board the directors which would be representative of the property owners paying the assessment. The proposed new members for the board do not meet this requirement: Bob Emberger is the director of the Whosoever Gospel Mission, which is a nonprofit; Marilyn Tadlock is an employee of Einstein Health Care Network, which rents space in a commercial development on Wayne Avenue and which is a nonprofit; Larry Simmons works for Representative John Myers; Donna Miller is an elected official; Leroi Simmons is the executive director of the 18 6/12/01 - WHOLE - RES. 422-435 Central Germantown Council, another nonprofit; Steve Vaughn is Chief of Staff for Donna Miller; Sabryia Hadi represents the vendors; Anita Hamilton is the director of the Pickett Family Director at Pickett School, a nonprofit; Steve Kuzmicki works for Greater Germantown Housing Development Corporation, another nonprofit. Twelve names are before you today and nine of them represent nonprofits or elected officials. One of them is an elected official. This runs counter to the spirit of the enabling legislation. There are positions open on the board 15 of directors. At least three-quarters of these should be filled by property owners who are paying the assessments which fund the GSSD. They should play an active role in determining the use of those funds for the betterment of the commercial district. Regular meetings of the board should be held and meetings should be open to the public. Communication with the property owners should be consistent and open. In short, there should be accountability. I have written numerous letters to the 19 6/12/01 - WHOLE - RES. 422-435 executive director, requesting a seat on the board of directors.
I have been told that there was no 4 space available. Clearly, there is space available, since there are only 12 names before you today and there are 15 seats on the board. When I first began making requests for representation on the board, there was no active board involved in decision-making. There has been no yearly accounting for monies spent that have been made available by the taxpayers. There should be a regular yearly accounting. In November of last year, there was a hearing held for the reauthorization of the district. I appeared at that hearing and submitted testimony. My husband and I were the only property owners who did appear at the hearing. Participation would be improved if communication were better. The person who is paid full-time to communicate is not getting the job done. I am submitting, together with this testimony, letters of recommendation for my nomination to the board. I'm asking you today to approve my nomination to the board. If appointed, I will work to see that the GSSD operates according to 20 6/12/01 - WHOLE - RES. 422-435 the spirit and the letter of the law. I am also requesting that do you not approve a slate which is weighted in favor of non-tax paying entities and that at least one seat on the board be allocated to the GBA. Thank you very much.

Yes, Madam President. I would -- we have about four people that are interested in being on the Germantown special services board and the nominations come through that committee, and Miss Winters needs to make sure her name is on the list to be considered for some of the vacancies. But I have one question. Miss Winters, have you ever paid your assessment?
When the board began, I received a letter from Brian Woodson (ph.) congratulating me on being the first person in the 21 6/12/01 - WHOLE - RES. 422-435 assessed district to pay my assessment. In recent years, I have stopped paying my assessment because I feel that the district is being managed illegally. And I've written Councilwoman Miller many letters and called her office and been to see her in person, requesting that I be allowed to sit on this board, so she knows me well and knows that I've been trying to seek representation for quite a while -- both for myself and for the GBA, which has been excluded from the process.
I have no more questions, Madam President, or comments.
I believe the Councilwoman indicated that there are four openings. Has your name been submitted?
I've been submitting my name for two years and I've seen the Councilwoman directly about this and written her correspondence, which I happen to have with me the. The only thing that I gave to you with this testimony is letters of recommendation from other business owners in the district. But I have also approached Councilwoman Miller separately, I've approached Michael Moore separately, I've approached Leroi Simmons 22 6/12/01 - WHOLE - RES. 422-435 separately. The district right now is being run more as a private club than it is as an entity that's accountable to the people that are paying the assessments to fund the district, and it's important for the betterment of the Germantown Business District and for the residential areas around it that it be responsive to the property owners in Germantown. There's so much more that could be done with the funds that are assessed and people would participate in the district if the communication were open and if they were allowed to participate. There's such a legacy at this point of being cut out that people don't even try. I'm just a person that doesn't give up.

My name is Jeffrey A. 23 6/12/01 - WHOLE - RES. 422-435 Smith. I've been a resident continually since 1981, and I was born and raised in Germantown since 1946. Councilwomen and Councilmen, my name is Jeffrey A. Smith, and I've been a resident of Germantown since 1981. I was president of the Germantown Business Association from March 1999 until November 30, 2000. I am testifying here concerning my experience as president during that tame. I am not representing the Germantown Business Association here today with my testimony. During my tenure, I initiated efforts to improve cooperation between the Germantown Business Association, the Central Germantown Council, and the Germantown Special Services District, which had not been good since 1996. After a couple of months of negotiations, a group known as the "pilot group" was formed consisting of representatives of the three organizations, mediated by Tina Lekoff, president of the Pennocks Neighborhood Association. The minutes of our first meeting show that Central Germantown Council is primarily concerned with economic development issues in the central Germantown Business District, Germantown Special Services District is primarily concerned 24 6/12/01 - WHOLE - RES. 422-435 with sanitation and appearance issues, and the Germantown Business Association should be primarily concerned with promoting the business climate in Germantown, resolving issues between businesses, and encouraging people to shop in the central Germantown business district. The Central Germantown Council and Germantown Special Services District receive funding from the Department of Commerce, the Germantown Business Association receives funds only from its members at this time. In spite of the efforts of the pilot group, cooperation between Central Germantown Council, Germantown Special Services District, and GBA has been poor. The special services district proposes activities for Germantown which would be better suited for the Germantown Business Association, namely promotions and special projects, which, I believe, come to about $35,000 a year, but the Germantown Business Association has no voice in planning these activities. The Germantown Business Association has at present, and did not have during my tenure, no official representative on the Special Services District but the Street Vendors Association does. 25 6/12/01 - WHOLE - RES. 422-435 I suggest that the Germantown Special Services District invite the Germantown Business Association to appoint a representative to the Germantown Special Services District board to fill existing vacancies. In addition, I propose that Miss Winters be included on this proposed board. She's demonstrated knowledge of the applicable laws and has the best interest of the commercial district in mind. As a GSSB board member, I am confident that she would ensure the accountability of the Special Services District.
