Thank you,5 Mr. Chairman. Thank you, Councilman6 Greenlee. Chris Vogler, V-O-G-L-E-R,7 from the Philadelphia Parking Authority.8 Good afternoon. My name is9 Chris Vogler. I'm the manager of red10 light photo enforcement for the11 Philadelphia Parking Authority. We would12 like to thank Chairman DiCicco and the13 members of the Committee for allowing me14 to testify today. And also as an aside,15 Councilman DiCicco, I think this will16 probably most likely be the last time17 that I will testify before you as18 Chairman of Streets and Services, and I19 just wanted to thank you for your20 consideration through not just my21 position at PPA but before long ago and22 far away when I was a Council staff23 member. I'd also like to3 thank Councilman O'Neill for introducing4 this legislation. I'm testifying in5 favor of Bills 110308 and 110309, which6 would add two additional intersections to7 the red light camera program in the City.8 These intersections will be Grant Avenue9 at Academy Road and Bustleton at Byberry10 Road.11 I would like to commend Council12 for its past excellent and, most times,13 unanimous support for the program. Since14 the first cameras were activated at Grant15 Avenue and Roosevelt Boulevard February16 23rd, 2005, the program has been17 successful in its main goals - decreasing18 red light running, accidents, injuries19 and fatalities. There are now 90 cameras20 at intersections, and with the21 addition of these intersections and those22 that were recently approved by Council,23 the citywide total will be 111 cameras at24 intersections after installation of25 9 11/29/11 - STREETS - BILL 110308, ETC.1 all the approved cameras are completed.2 And also additionally, Chairman3 DiCicco, Councilman Greenlee, Island4 Avenue at Lindbergh Boulevard, which was5 approved by Council and signed by the6 Mayor approximately four months ago,7 construction is being completed and8 depending on weather conditions, the9 60-day warning period at that10 intersection will start either at the end11 of this week or the beginning of next12 week. And also Grant -- I'm sorry; Broad13 Street at Vine Street, the 60-day warning14 period will end Thursday at midnight, so15 starting this Friday, December 2nd,16 violations will start to be issued at17 that intersection.18 The intersections of Grant19 Avenue and Academy Road and Bustleton20 Avenue and Byberry Road are both large21 and busy intersections with a heavy22 traffic volume of vehicles and23 pedestrians. Additionally, both24 intersections are along commercial25 10 11/29/11 - STREETS - BILL 110308, ETC.1 corridors and consequently both2 intersections currently have a very high3 rate of vehicles disregarding the red4 signal. It is not an exaggeration to say5 that you sometimes put your life in your6 hands navigating this area.7 As I've stated in previous8 testimony before the Committee, I believe9 that red light cameras will change the10 behavior of motorists at both11 intersections as they have in other parts12 of the City to make walking and driving13 in this area a safer experience. The14 establishment of red light cameras at15 these intersections will continue to16 enhance and extend this program to other17 dangerous intersections in the City.18 Finally, I ask that the19 Committee give Bills 110308 and 110309 a20 favorable recommendation and request that21 the rules be suspended to allow first22 reading at the next Council session.23 Thank you again for the24 opportunity to testify before the25 11 11/29/11 - STREETS - BILL 110308, ETC.1 Committee this afternoon and I'd be happy2 to answer any questions that you may3 have.4 COUNCILMAN DiCICCO: Thank you.5 Mr. Denny.6

I am here to offer testimony on13 Bill No. 110308.14 This bill authorizes the15 installation of a red light enforcement16 system at the intersection of Grant and17 Academy. The Streets Department supports18 this bill. I5 have found you to be dedicated to your6 constituents, smart and of high7 integrity. And I want to thank you for8 your work and support for the Streets9 Department. You have certainly shown10 leadership relative to the issues that11 impact us. You have tried to challenge12 us to be innovative, and we've13 appreciated that. You've challenged us14 in terms of how we have done our15 business. In all ways you have done it16 in a respectful manner. And your17 leadership with regard to trying to get18 our city clean, we didn't accomplish all19 that we wanted to accomplish there and we20 have much to go, but we thank you for21 being on the forefront of that. My name18 is Michelle Brisbon and I'm a Staff19 Engineer with the Department of Streets.20 I'm here to offer testimony on Bill No.21 110840.22 This bill authorizes Margaret23 Vann, owner of Rainbow Learning Center,24 to construct, own and maintain a fence25 29 11/29/11 - STREETS - BILL 110308, ETC.1 within the public right-of-way as2 indicated in Bill No. 110840.3 The Streets Department cannot4 support passage of this legislation. The5 description of this encroachment is not6 accurate and it doesn't reflect the7 actual width of the right-of-way at this8 location. The applicant can submit an9 updated drawing that reflects the actual10 right-of-way widths to the Streets11 Department for review and approval in12 accordance with Section 11-604(4) of The13 Philadelphia Code.14 Thank you for your time. Well, the one19 that this bill is referring to, I'm not20 sure if it's existing. We haven't seen21 any plans for this location, and I wasn't22 aware of it until it was introduced. But23 to my knowledge, there are a number out24 there illegally. They basically go to25 37 11/29/11 - STREETS - BILL 110308, ETC.1 L&I and get electrical permits. They2 don't come to the Streets Department at3 all.4

I'm not sure.8 Typically the utility companies are the9 ones that actually place a pole within10 the right-of-way and we have to stamp11 off -- we have to approve the pole12 permit. But as far as these, not to my13 knowledge.14

The15 reason I ask that is maybe -- and I have16 no idea on individual, this one or any17 other individual, but it could be people18 think they got an electrical permit from19 L&I, they're legit, unless they're told20 differently. Well, I believe22 with this particular applicant, they23 contacted PECO, and PECO told them they24 had to get permission from the Streets25 40 11/29/11 - STREETS - BILL 110308, ETC.1 Department, and we then -- I explained to2 him that we don't allow private poles3 within the right-of-way for electrical4 purposes. So I guess they proceeded to5 have an ordinance introduced for their6 approval.7 COUNCILMAN DiCICCO: I think8 it's going to be a job for the next9 committee to figure out, because there10 are numerous situations all over the11 City, and not faulting anyone or any12 department. There's got to be some13 meeting of the minds, if you will, to14 figure this out, because newsstands, you15 name it, everything out there is some16 sort of a wire hanging, and got to make17 it somewhat more uniform. The electrician16 in question that I used did get an L&I17 permit. I was originally told by PECO,18 by the grid designer in that area, that19 all that was required was the proper20 permits that I received from the City in21 order to obtain the electrical service.22 So the proper permits were pulled from23 L&I, upon which when I went for24 installation of that service, they told25 42 11/29/11 - STREETS - BILL 110308, ETC.1 me that I would need something from the2 City, an ordinance in fact, to have the3 electric given to me. However, like4 Ms. Brisbon, who has spoken before, has5 said, numerous other people within 30 to6 40 feet of where I proposed have that7 service and --8

And they9 probably just did it or, again, maybe10 didn't realize. Maybe they weren't told.11 I don't know.12

Mr. Krawitz

The grid designer13 who I spoke to did change over the summer14 and I was told by the previous one who I15 had spoke to originally that the permits16 from L&I and from the City were all that17 was required by PECO at that time to hook18 up the service. So you can see how it's19 a major competitive advantage when20 they've done it illegally. And I'm21 operating illegally now.22

Councilman Greenlee

Sure. I23 got you. And it seems like -- again, not24 to put blame here, but it seems like L&I25 43 11/29/11 - STREETS - BILL 110308, ETC.1 maybe should -- if you apply for2 something, it's clear what you have to3 do. There may be some communication4 saying, here's the next step you have to5 take before you or anybody else starts6 work. It just seems fair.7

The inspection25 44 11/29/11 - STREETS - BILL 110308, ETC.1 process is done by a third party, who has2 already come in and inspected the way the3 electrical wires have been hooked up.4

So have the5 wires been put in a metal sleeve down the6 side of the pole into the outlet or is it7 the wire itself that is going into the8 pole without being in a metal sleeve?9

Mr. Krawitz

No. It's10 encased. But no wires have been hooked11 up yet. Before I can do so, you need to12 approve the ordinance. So everything is13 protected and safely done on my14 particular pole. I can't speak for15 anybody else.16

The property is3 under construction. It's a three and a4 half million dollar state-of-the-art car5 wash and lube facility. It will have a6 vegetative roof. The washing water will7 be filtered and recirculated. It is --8 everything is state-of-the-art about it.9 There is an existing10 35-foot-high aluminum flagpole within the11 right-of-way, although research revealed12 that that was erected without an13 ordinance. So we're seeking to -- the14 ordinance seeks to allow the relocation15 of that flagpole and also within the16 right-of-way.17 The first tab shows some18 pictures depicted. In the first two19 you'll see the existing aluminum flagpole20 right by the porta-potty and extends up21 35 feet. And then the third picture is a22 view looking across Ridge Avenue where23 you see the new construction of the CVS24 and Wawa, a several million dollar25 51 11/29/11 - STREETS - BILL 110308, ETC.1 development that completed last year.2 The second tab is the site3 plan, the survey, and I depicted the area4 in yellow. Ridge Avenue is 80 feet. The5 public right-of-way is 80 feet. The6 improved area is 52 feet. And from the7 outside edge of the sidewalk to the end8 of the public right-of-way is 14 feet on9 each side of Ridge Avenue.10 There are no utilities in this11 area. In fact, you'll see existing12 condition when this was prepared13 identified this as a grass area. You can14 see the small square, which will show the15 existing flagpole back in, I think this16 was, 2009 when this was prepared. So17 that is very material, that no public18 utilities will be disturbed in preparing19 the conduit for the proposed flagpole.20 The third tab shows the21 installation detail. Again, the box22 shows the location of the existing23 flagpole, and you'll see a little bit24 below that the proposed location for the25 52 11/29/11 - STREETS - BILL 110308, ETC.1 sign and the relocated flagpole. Again,2 all within that portion of the3 right-of-way that has no utilities below4 it.5 The sign -- no portion of the6 sign face itself will encroach over the7 sidewalk. It's shown on here as going up8 to the sidewalk. Actually, it will be9 about a foot short of the sidewalk.10 The fourth tab shows some11 details, some renderings of the finished12 facade, and the second page shows the13 actual sign face and pylon sign base.14 And also very material, the15 last tab shows existing signage in this16 block, all of them located within the17 public right-of-way. The first one is18 actually over the sidewalk. The second19 one is planted within this 14 feet of20 unimproved area in the right-of-way, and21 then the third picture showing Midas, the22 Auto Zone and the Ridge Diner. All of23 those are planted within that 14-foot24 right-of-way.25 53 11/29/11 - STREETS - BILL 110308, ETC.1 And then on the other side of2 the subject site, and the last picture is3 Roxborough Animal Hospital, and, again,4 you notice that that is planted within5 this right-of-way.6 For the record, I've measured7 it. The Midas sign is 11 feet from the8 curbline and, therefore, three feet9 within the right-of-way. And the Auto10 Zone sign is nine feet from the sidewalk11 and six feet -- or five feet from the12 edge of the -- outside edge of the13 right-of-way. All the other signs are14 even that much closer. So this condition15 is pretty standard in this block on Ridge16 Avenue.17 COUNCILMAN DiCICCO: Thank you.18 Anyone else testifying?19

It was a10 flagpole that was there, and the flagpole11 was there, well, 25 years that I know of.12

So for the13 past 25 years at least, that sign has14 been there, along with maybe a half dozen15 or dozen other signs that have migrated16 to that position?17

Mr. Williams

Right. These18 signs on that block are all within this19 same 14 feet of unimproved area that is20 within the right-of-way.21

Now, does22 your facility also incorporate the area23 that we're doing the streetscape on Ridge24 Avenue? Will you be the beneficiary that25 55 11/29/11 - STREETS - BILL 110308, ETC.1 far up?2

Mr. Williams

I don't believe3 so. This will be north of Roxborough4 High School.5

Thank you.12 Do you happen, just out of13 curiosity, do you happen to know if --14 for the Streets Department, is the15 objection to this that it is a permanent16 easement or that there's an easement at17 all? I thought I heard you say that the18 policy was permanent easements.19

Ms. Brisbon

Yes. The Streets20 Department doesn't approve permanent21 commercial advertising. None of the22 signs that are on Ridge Avenue were23 approved by the Streets Department.24 They're all illegal. And the flagpole25 56 11/29/11 - STREETS - BILL 110308, ETC.1 was a sign -- I mean, wasn't a sign. It2 was a flagpole.3

Councilman Green

So really4 what you're telling us is that they5 should ask for forgiveness and not6 permission? Doing the right thing on7 Ridge Avenue is not going to be rewarded8 by the City of Philadelphia.9

Ms. Brisbon

I mean, at this10 point, we don't have a policy or some11 type of mechanism to review and approve12 placement of signage. That's something13 that's typically done on a property, and14 L&I will regulate it. I mean, we don't15 review what's posted on the signs, how16 high they are, because it's not something17 that the Streets Department typically18 approves.19

Councilman Green

So this is20 another disconnect between L&I and21 Streets.22

Ms. Brisbon

And L&I is saying23 it's in the right-of-way, we don't have24 anything to do with it. But we typically25 57 11/29/11 - STREETS - BILL 110308, ETC.1 don't approve advertising within the2 right-of-way.3

Councilman Green

But you4 mention permanent easement, and it sounds5 to me like your objection is that this is6 a permanent easement.7

Ms. Brisbon

Well, yeah.8 They're putting footings seven foot9 underground. So this is -- I mean, it's10 a massive structure.11

Into the12 right-of-way.13

So the sign15 that I see that is essentially the front16 of the building is really not a sign,17 it's the front of the building in the18 right-of-way, is that right, on Tab 4?19

Mr. Williams

Behind Tab 4,20 the second page will show the proposed21 sign. This was reviewed and approved by22 the Ridge Park Civic Association. Their23 only concern was that there not be24 digital letters and that the letters be25 58 11/29/11 - STREETS - BILL 110308, ETC.1 plastic.2

Councilman Green

But I guess3 my question for the Streets Department4 is, is the reason we don't approve this5 in the permanent right-of-way or create a6 permanent easement so that we have the7 necessary land in case the street has to8 be widened?9

Ms. Brisbon

Well, no. Our10 purpose is the advertising, using the11 public right-of-way for advertising for12 commercial business.13

Councilman Green

So there's14 no need for the land for the Streets15 Department to create additional lanes on16 Ridge Avenue or other things like that?17

No, not to my18 knowledge.19

This22 legislation, along with legislation that23 is going to be considered tomorrow by the24 Rules Committee, will lead to what we25 63 11/29/11 - STREETS - BILL 110308, ETC.1 believe will be a transformational2 project for Chestnut Hill and the3 district.4 Given the recent exodus of5 national and regional tenants, credit6 tenants, from Chestnut Hill and from the7 corridor itself, we think that there's a8 real demonstrated need for a mixed-use9 project with a significant national10 credit tenant. Bowman Properties has11 recently signed a lease with the Fresh12 Market, which is one of the hottest13 specialty grocery stores in the country.14 This will be the first Fresh Market in a15 northeast city. In fact, this is a real16 coo for Chestnut Hill and a real coo for17 the City of Philadelphia. The site has18 beat out many sites in the region,19 including the Main Line. The Fresh20 Market is a type of a high-quality credit21 tenant that we believe will attract other22 credit tenants back to Germantown Avenue.23 Additionally, this is a $3024 million project, no public subsidy25 64 11/29/11 - STREETS - BILL 110308, ETC.1 whatsoever, 90 permanent jobs. Our2 presentations to the Chestnut Hill3 Community Association began in earnest in4 April, continued through the summer, and5 we believe that we will be having a final6 meeting with the Chestnut Hill Community7 Association on December 12th prior to8 final passage, to the extent this9 Committee votes to move the legislation10 through today.11 With me today is Debra Ferraro.12 She is the Chief Traffic Engineer for13 Pennoni, and she's the Traffic Engineer14 for the project. Good afternoon,21 members of the Streets and Services22 Committee. 3 Under my direction, Pennoni4 Associates prepared a traffic impact5 study for the proposed development at6 8200 Germantown Avenue, consisting of a7 Fresh Market grocery store, business8 district retail and residential9 condominiums and townhomes. The10 transportation impact study included11 review and recommendations for site12 access and internal circulation. 17 We've attached a figure titled18 Study Area. It's included in the packet19 and also shown on the board to my left,20 which shows the roadway network -- the21 location of the site along Germantown22 Avenue, which is classified as a23 community arterial roadway, and the local24 roadway network surrounding the site. 6 Based on the results of the7 transportation impact study that were8 documented in the report, it is9 recommended that the first block of West10 Hartwell Lane be reversed from one way11 westbound to one way eastbound in the12 direction towards Germantown Avenue. All13 traffic is recommended to exit the 820014 Germantown Avenue site to Hartwell Lane15 and be directed to Germantown Avenue16 rather than Shawnee Street and Roanoke17 Street. 5 On the exhibit, the parking6 changes are illustrated and shown for a7 net loss of one parking space on the8 block of Hartwell Lane. 16 Those volumes are about double, almost 8017 vehicles per hour on average, during the18 peak hours on a Saturday. With the19 proposed directional change, these20 traffic volumes will be redistributed21 primarily to the roadways of Willow Grove22 Avenue and Highland Avenue. 3 Pennoni Associates and the4 project team met with the Streets5 Department in the early phases of the6 project to review the site circulation7 plan and Hartwell Lane modifications. As8 Charlie Denny testified, the final9 traffic impact study was submitted to the10 Streets Department for review. The study11 was also submitted to the Chestnut Hill12 Community Association and distributed to13 interested parties during July of this14 year. The results were presented at the15 Traffic Transportation and Planning16 Committee of the Chestnut Hill Community17 Association where the public and18 stakeholders had the opportunity to19 answer questions. )12 COUNCILMAN DiCICCO: Good13 afternoon. 16

Good afternoon,17 Chairman DiCicco and Committee members.18 My name is John Beckman. I'm a resident19 of Chestnut Hill and I represent the20 Chestnut Hill Community Association's21 committee that has been formed to work22 with the owner of the property to attempt23 to reach an agreement on the final24 development program. Those discussions25 70 11/29/11 - STREETS - BILL 110308, ETC.1 are not complete yet.2 At the moment, the one block3 length of Hartwell Lane is bordered on4 one side by an unused property owned by5 the developer, Bowman Properties, and6 fewer than ten single detached houses on7 the other side. It's a one-lane street,8 as you see by the exhibit, and it9 functions quite well at the moment.10 Should the developer's program11 of residential and commercial be approved12 in the two bills that will come up at the13 Rules Committee tomorrow, 110762 and14 110763, the situation will change15 dramatically. The negotiating committee16 and the Association, by extension, are in17 support of the reversal of this block of18 Hartwell Lane should that happen. There19 is a sequencing issue, which was referred20 to earlier, which is that because of the21 low traffic volumes and somewhat22 discontinuous street network in the area,23 the street is functioning well now. Ron5 Patterson, 1835 Market Street.6 I guess I should address it7 since my name was mentioned in the bill.8 I represent the owner of the properties9 that surround the left and the right of10 Markle Street, which is on the City Plan.11 It's an entire City block, that12 particular property, surrounded by four13 streets, and Markle Street on paper would14 cut through that square block. Although15 this is the last piece, it was the first16 piece we actually looked at and meeting17 with Councilman Jones to see if this was18 possible. It was vetted with the19 neighbors in the community, and no one20 there wants that street open, because21 it's mainly grassy area. Good afternoon.3 This is an Administration ordinance4 requested by the Department of Streets.5 The purpose of this ordinance6 is to authorize the striking from the7 City Plan and vacating the southerly 408 feet, 5 inch wide portion of Race Street9 from Christopher Columbus Boulevard to10 Water Street and the placing upon the11 City Plan of a right-of-way for various12 utility purposes within the lines of the13 portion of Race Street being stricken.14 The Department of Streets has15 determined that the portion of Race16 Street proposed to be stricken is not17 needed for transportation purposes. At18 the time of construction of the Delaware19 Expressway, the main travel lanes of Race20 Street were shifted northwardly, and this21 portion of Old Race Street fell into22 disuse. I'm an5 attorney for the Latham Hotel, which is6 the proponent of this ordinance.7 Before we begin with our8 testimony, I wish to wish good fortune in9 your future endeavors and as a citizen of10 your district all these years appreciate11 and thank you for your service.12 COUNCILMAN DiCICCO: Thank you,13 Your Honor, when you were on the bench14 for the service to the citizens of this15 City as well. So there is life after16 whatever we were doing, right?17

Yes. There is life18 after public service.19 COUNCILMAN DiCICCO: Thank you.20

This particular21 ordinance seeks the permission of the22 City of a hotel that meet certain23 description to designate and pay for a24 space to park a courtesy vehicle during25 98 11/29/11 - STREETS - BILL 110308, ETC.1 the daytime business hours of the hotel,2 which would be from 7:00 in the morning3 to 11:00 at night, for purposes of4 providing courtesy transportation to the5 hotel guests. I have with me, who will6 give testimony, Tom Varley. Mr. Varley7 is the Executive Vice-President of Ocean8 Properties, which owns the Latham Hotel.9 Ocean Properties is a hotel chain that10 owns at least 125 properties, from11 Montreal down to Key West, Florida.12 I would like to make one13 comment about what I know might be some14 opposition to this bill, that the15 ordinance was crafted to apply to hotels16 that don't have their own off-street17 valet areas, but are situated such that18 the entire frontage of the hotel is19 either a valet and/or a loading zone.20 There is no parking permitted in front of21 these hotels, and the hotels that --22 we've submitted prior a letter from the23 Palomar, the new Palomar, and also from24 the Radisson, formerly known as the25 99 11/29/11 - STREETS - BILL 110308, ETC.1 Warwick, which would be similarly2 benefited if this bill were enacted.3 Again, this is not free parking4 for the hotel. It's not a free space.5 The hotel wishes -- there will be a fee6 for this and that the hotels that are7 similarly situated would have the option8 to designate a space after paying a fee9 and getting the permit. But we assure10 you that the program itself would not11 create any traffic hazard or traffic12 problems on the street.13 With that, I would like to turn14 the microphone over to Mr. Varley for his15 statement.16

Mr. Varley

Good afternoon.17 Thank you for taking the time this18 afternoon. As Judge pointed out, I'm19 with Ocean Properties. We've owned the20 Latham Hotel for about 16 years. We're21 just completing a $12 million renovation22 of the property. We did a complete23 renovation from the top floor all the way24 down, and we're just finishing up a $325 100 11/29/11 - STREETS - BILL 110308, ETC.1 million investment into the restaurant2 and public space. So we've just recently3 invested about $15 million into the4 Latham.5 We're also changing the brand6 of the Latham. As some of you may be7 aware, the Latham had deteriorated over8 the last few years, and we are9 re-branding it as a Preferred Hotel, and10 the Preferred Hotel chain is a line with11 properties such as the Peninsula in New12 York and Beverly Hills. It's a very13 high-end boutique classification of a14 property, and we're hoping to achieve15 average rates exceeding $300 or so, which16 certainly helps the base, and it's17 important to the Hotel Association18 particularly with the new Convention19 Center to have smaller, high-end boutique20 hotels to cater to the higher-end21 customer and to provide this level of22 service that they expect at the other23 Preferred hotels. They've done similar24 courtesy car arrangements, for example,25 101 11/29/11 - STREETS - BILL 110308, ETC.1 at the XV Beacon in Boston and properties2 in Dallas and Houston, which is sort of3 part of the service of this level type of4 property.5 So we're very -- we've really6 enjoyed being in Philadelphia. We7 believe the hotel, it's a very -- the8 hotel business in Philadelphia is very9 good, the tourism business. We're big10 believers in Philadelphia, obviously, and11 we really believe that this amenity will12 help the overall -- not only help the13 Latham, it certainly helps the Hotel14 Association as they go out and try to15 appeal to some of these groups in the16 Convention Center and things like that.17 COUNCILMAN DiCICCO: Thank you.18 Mr. Pollock, are you speaking19 or are you just --20

Yeah. But since5 I had started this the last time we were6 here. One of the things that we just7 want, from a technical point of view, if8 the Council and this community is9 inclined to suspend the rules, we would10 appreciate a suspension of the rules.11 COUNCILMAN DiCICCO: Thank you.12

Mr. Dickson

Thank you,17 Mr. Chairman. We were here previously on18 this issue. The Authority's position19 hasn't changed. We believe it's20 inappropriate to take a portion of the21 public roadway and designate it for the22 exclusive use of either one individual or23 one business. We don't take this curb24 space in front of someone's home and say25 103 11/29/11 - STREETS - BILL 110308, ETC.1 this is reserved exclusively for you2 because you happen to live in that house.3 At the same time, we can't do this -- we4 have never done that in any situation for5 a business as well.6 The other issue in this7 particular situation is, the frontage on8 17th Street in front of the Latham at9 best can accommodate about four vehicles.10 That's if you even encroach as close to11 the corner as you could get. In order12 for this hotel to operate, because there13 is no on-site parking, they're going to14 have to operate valet services there,15 which is going to take two spaces.16 They're going to have to have another17 space for other drop-off and pick-up,18 leaving -- and the last space would have19 to be reserved for this vehicle that20 could not be used by anybody else but21 that space. We believe it's going to22 create congestion, because there'll be23 back-ups using the valet zone and other24 vehicles trying to get in and out of the25 104 11/29/11 - STREETS - BILL 110308, ETC.1 space.2 While we certainly want to3 support the hotel industry, we really4 think that we need to be responsible in5 the way we allocate the public roadway.6 Nothing -- we certainly think that the7 space in front of the hotel can be8 configured in such a way that there will9 be open space for a vehicle to come up10 and pick up people and drop people off.11 Like every other hotel, people would call12 down and say, I need a car to take me13 wherever in such-and-such a time, and the14 car could be brought there to provide the15 service.16 So by not installing the zone17 doesn't mean the service can't be18 provided. It just means that the use,19 the exclusive use, of the public street20 for one vehicle we think is21 inappropriate.22 COUNCILMAN DiCICCO: I23 appreciate that. I'm trying to go back24 to the last hearing we had. Latham25 105 11/29/11 - STREETS - BILL 110308, ETC.1 currently has or has had in the past a2 valet zone, two spaces?3

Mr. Pollock

We have a loading4 zone and a valet zone in front of our5 building along 17th Street.6

Mr. Dickson

He's talking7 about the Latham.8 COUNCILMAN DiCICCO: The9 Latham, to the best of my knowledge, had10 a valet.11

Currently the12 Latham has one valet spot, one valet spot13 and one --14

One passenger15 loading zone.16 COUNCILMAN DiCICCO: So only17 two spaces.18

Right. Which is19 just about all that can be accommodated20 there safely.21

Mr. Pollock

I said as3 Mr. Dickson said, he acknowledges there4 might be four spaces, and now we only5 have two, so that would leave two more6 spaces available. And the other7 experience you're going to have, because8 we've seen it with the hotels in checking9 them out with the hotel in Boston, which10 is, what, the XIX and Teatro in Denver,11 these vehicles go in and out because12 they're taking people to and fro. I13 mean, you might have somebody who puts14 up -- like a law firm could put up their15 expert witnesses at the Latham, and they16 may want to need to get that expert17 witness to a deposition or down to18 federal court right away, and we need to19 have that vehicle right there.20 COUNCILMAN DiCICCO: I kind of21 buy that, but when that vehicle leaves22 and somebody else needs it, it won't be23 there. So I appreciate what you're24 saying, but the car is not going to be25 107 11/29/11 - STREETS - BILL 110308, ETC.1 there forever. I mean, it's got to move2 at some point. So it would be removed,3 come back.4 I've been trying to work with5 the Authority -- everybody is friends up6 here -- to help everybody get to where7 they need to be. There's two spaces now.8 You have the valet and you have the9 loading spot.10

Right.11 COUNCILMAN DiCICCO: And,12 Mr. Dickson, you're saying there would13 not be enough space for --14

Mr. Dickson

I appreciate my15 friend Mr. Pollock's comments. What I16 said was if you take every inch of curb17 space from curb to curb, you might be18 able to fit four cars in there. That's19 clearly illegal.20 COUNCILMAN DiCICCO: That's21 Walnut Street back to --22

But my problem,12 Mr. Chairman, is that in order to have13 the valet work and be able to have a14 taxicab to drop someone off, you're going15 to need room to be able to pull in and16 out of there. It's not like everybody is17 going to be parallel parking at this18 place. It's -- we believe and -- I think19 the Streets Department testified at the20 last hearing that the amount of curb21 space available does not lend itself to22 taking any spaces away from public.23 COUNCILMAN DiCICCO: Could24 we -- and I think I asked this question.25 109 11/29/11 - STREETS - BILL 110308, ETC.1 I know there's something in the regs that2 says a valet, you can't leave a car there3 for any length of time.4

Mr. Cohen

Twenty minutes.5 COUNCILMAN DiCICCO: What is6 the average length of time that you think7 that vehicle that you're looking for the8 reserved space would take? How much time9 do you think it would be there10 permanently? I'm looking if we would11 expand the valet to two valet spots and12 one loading, does that get you close to13 where you need to be without calling it a14 reserved parking spot?15

Mr. Cohen

Well, the fact is16 if that the vehicle would remain in the17 spot more than 20 minutes --18 COUNCILMAN DiCICCO: It's19 subject to being cited.20

Mr. Cohen

That's correct.21 That's why we're here, because we don't22 want to have them cited.23 COUNCILMAN DiCICCO: But if the24 car were in, we'll call it, A, B and C --25 110 11/29/11 - STREETS - BILL 110308, ETC.1 A and B, two valet. The car is in space2 A, valet space A, and it's going to be3 there more than 20 minutes, it was4 moved -- just like people keep feeding5 meters, if we moved it to space B --6

Mr. Cohen

Well, that's an7 alternative.8 COUNCILMAN DiCICCO: Is there a9 way of relaxing some of that enforcement10 regulation in valet zones without doing11 it citywide or is it uniformity would12 have to be --13

Mr. Dickson

Mr. Chairman, we14 can't enforce valet zones one way in15 front of the Latham and another way every16 other institution in the City. I mean,17 people need to know what the rules are18 wherever they may be.19 And the other issue -- I mean,20 at the last hearing, the testimony was21 one of the reasons that this zone was22 important was so that this vehicle could23 be parked there and could be a symbol of24 the status of this hotel.25 111 11/29/11 - STREETS - BILL 110308, ETC.1 COUNCILMAN DiCICCO: I never2 really bought that, because it's going to3 move. The purpose of it being there is4 that if someone needs it to go from Point5 A to Point B, for whatever it is, the6 hotel is shuttling that person, it's7 going to move. So, you know --8

Mr. Cohen

Mr. Varley has a9 statement.10 COUNCILMAN DiCICCO: I just11 want to ask a question of you, sir, and I12 asked it at the last hearing.13 Without this parking14 arrangement -- and correct me if I'm15 wrong -- you would not be able to attain16 the Preferred Hotel status?17

Mr. Varley

Well, it would18 require some negotiation on our part with19 them. It is one of the requirements of20 the brand, and the challenge -- a couple21 of the other challenges, if the car were22 parked in a garage, part of the thing is23 when someone is ready for the car,24 they're ready for it now. I can't wait25 112 11/29/11 - STREETS - BILL 110308, ETC.1 15 minutes for the car to be driven2 around from a parking garage, that that3 defeats the purpose of the service. The4 Latham is only 130 rooms. There rarely5 is any -- that valet spot is constantly6 moved. I don't know what the percentage7 of guests that are even bringing cars8 into Philadelphia, but a good majority of9 them fly in and don't even have cars. So10 it really doesn't create any congestion11 out there. From all the time, 16 years,12 that I've been there, I've never seen it13 backed up there congested, and that's the14 challenge with the distance of parking it15 further away.16 COUNCILMAN DiCICCO: Thank you.17 Councilman Green.18

Obviously I certainly and I'm3 sure my colleagues appreciate the fact4 that you're investing in the City and5 you're spending $15 million here. I'm6 just curious about the hotel in Boston7 you referred to that has car service. Do8 they have a dedicated street parking spot9 for that car service?10

Mr. Varley

I couldn't answer11 that specifically.12

Councilman Green

I think the13 answer is going to be no. And so my view14 is that you can have your Preferred Hotel15 agreement as long as you have a car. The16 car doesn't have to be parked in front of17 the hotel at all times.18 I've used that car service from19 many New York hotels when I stayed in New20 York at various hotels and wanted a car.21 I'd call down and say, I need a car in22 ten minutes, and the car would be there,23 and sometimes, as the Chairman pointed24 out, the car was gone and wouldn't be25 114 11/29/11 - STREETS - BILL 110308, ETC.1 back for 20, because it had to go2 downtown or somewhere else.3 And so I'm not sure I4 understand why the hotel can't just, for5 the same fee it would pay the City,6 negotiate with a nearby lot, and there7 are many, I guess it would be, north of8 the portion of 17th that you need within9 a couple of blocks that would dump you10 onto 17th, so that you would have a spot11 that would allow you to be at the front12 door within a minute or two, and that13 seems to me to be sort of like reasonable14 and given -- I'd like you to comment on15 that.16

Mr. Varley

Well, to the best17 of our research, that isn't available.18

Councilman Green

There's no19 private lot that you can get a spot at?20

Mr. Varley

By the time the21 associate would go from the hotel to go22 get the car to bring it around, it would23 be 15, 20 minutes. It defeats the24 purpose of the service.25 115 11/29/11 - STREETS - BILL 110308, ETC.1

I've never2 usually -- well --3

And then you got4 to go back and park it and then five5 minutes later, someone comes, you got --6

Somehow they7 manage to do that in Boston, somehow they8 manage to do that in New York, without9 dedicated parking spots. I've never10 stayed at a hotel where I called a car11 where they had a dedicated parking spot12 unless they had it on their premises.13

Mr. Varley

Well, this is14 certainly dedicated parking spots in15 Boston. What the arrangement they have16 with the city, I have no idea, but these17 are dedicated spots right in front of18 this hotel in downtown Boston.19

Councilman Green

Well, the20 car may be sitting there, just as it21 might in Philadelphia if you had three22 spaces, two valet and one loading.23 You've got to have somebody in it so it24 can move when the Parking Authority comes25 116 11/29/11 - STREETS - BILL 110308, ETC.1 by.2 COUNCILMAN DiCICCO: What's the3 maximum, Mr. Dickson, what is the maximum4 time allowed in a loading zone?5

Mr. Dickson

Passenger loading6 zone is 20 minutes. Regular loading zone7 is 30 minutes.8

Mr. Pollock

Councilman Green,9 I did have a conversation with the10 general manager at the -- it's called the11 XV Beacon Hotel and I also had a12 conversation with a general manager out13 at the Hotel Teatro in Denver. In Boston14 they have a valet license, but they also15 have like a commercial parking vehicle16 license that allows along the lines what17 you're suggesting, that allows you to18 stay in an area for more than 20 minutes19 or something like that. And so that you20 could maybe create something -- I mean,21 we still feel that what we're asking for22 is a legitimate use, and I know at the23 last hearing, Councilman DiCicco, you24 realized that there are certain25 117 11/29/11 - STREETS - BILL 110308, ETC.1 situations where spaces have been carved2 out for a special service down around3 Independence Hall to have their own4 space. So that there has been a5 dedication of public space for a basis.6 But there has been in other7 jurisdictions -- Houston also had it --8 where you could create a license where9 you can allow a vehicle with that license10 to stay in a spot for a little bit longer11 than the 20 minutes that we're talking12 about.13

Councilman Green

We have such14 a license in the City of Philadelphia.15

Mr. Pollock

But I don't think16 it's for this kind of --17

Councilman Green

For a18 commercial --19

Mr. Pollock

-- for this kind20 of a vehicle.21

Well, we22 have such a license for contractors.23

But it seems2 to me that the proper approach here is to3 come up with something within our current4 regulatory or other construct for5 commercial vehicles and not create the6 precedent of creating this possibility in7 the public right-of-way of streets in8 front of any hotel in the City who meet9 certain criteria, because while we're10 sitting here and discussing the Latham11 and whether it can hold three or four12 spots, this bill would apply to any13 similarly situated hotel that meets14 certain criteria, and to me, that's not15 the policy for us to just sit here and16 say maybe we can allow this to happen17 anywhere, without knowing where that is18 in advance, without having Streets and19 the Parking Authority commenting on it as20 that particular spot comes up. I21 personally would like to help you find a22 way to do this with some sort of23 commercial license rather than creating24 this precedent and potentially allowing25 119 11/29/11 - STREETS - BILL 110308, ETC.1 it in places where it would be far worse2 for the street than the Latham would be3 with three spots in front of it. So for4 that reason, hearing what I've heard so5 far, I'm going to vote against this bill6 if you move it.7 COUNCILMAN DiCICCO: We have8 actually -- we've tried to put the great9 minds together to figure that very issue10 out, and I know Councilman Jones has been11 waiting. Do you have a comment on that?12

Mr. Varley

Yeah, just one13 other comment. I think in the beginning14 of -- there is a real distinction between15 hotels and someone like Urban Outfitters16 asking for a parking spot. I mean, the17 hotels, this is for tourism for the City18 of Philadelphia, and to make the19 correlation that every person and every20 resident, every business would want a21 business space, a spot, that really22 doesn't fly. I think the hotels are very23 unique to the cause.24

Councilman Green

But the25 120 11/29/11 - STREETS - BILL 110308, ETC.1 problem is, each hotel, some are on2 streets that are one width wide, some are3 on streets that are two wide, et cetera,4 and we're applying this without knowing5 which hotels will take it up and how it6 will impact the rest of that street. So6 for me, what is the difference between7 when we cater to a restaurant and we give8 valet parking privileges and take away9 spots based on revenues to the City of10 Philadelphia versus what we've done for11 hundreds of businesses, giving them12 public property, inducing them to stay or13 expand in the City of Philadelphia versus14 what we are doing here? Before the Great15 Recession, new bank accounts got free16 toasters. I mean, gee, we're talking17 about one parking spot, and I just don't18 understand why we can do so much for19 Comcast, but not do something for hotels20 that rely on this kind of catering and21 preferential treatment to its hotel22 guests, that we can't do that. I don't23 understand why this is so different.24

I5 understand, but the answer to the6 question from my perspective is that7 we're talking about dedicating a street's8 use for one party. Valet zones have to9 be vacated in 20 minutes. We're talking10 about the potential of finding a way for11 them to use the valet zone in front of12 their hotel for just the purpose that13 we're talking about. They do have a14 valet zone in front of their hotel, just15 like restaurants that we permit all the16 time, and they're paying for that permit,17 and we're talking about expanding that by18 one spot, and I think that it's19 appropriate, as you're suggesting, to be20 accommodating. I don't think -- this21 bill does not help just the Latham. It22 helps any hotel that meet certain23 criteria anywhere in the City, and we24 don't know what the possibility of that25 127 11/29/11 - STREETS - BILL 110308, ETC.1 is. And so for that -- I mean, we could2 make the same argument about every large3 commercial building in the City which are4 worth hundreds of millions of dollars,5 they should have their own parking spot6 because of the investment they're making,7 any new hotel that's being built. I8 mean, it's just the question of9 dedicating the public street for one10 individual's use as a precedent and11 applying that citywide, without knowing12 where or how it will impact us anywhere13 else, doesn't seem to me to make sense as14 a policy for the City going forward. Good morning,19 members of Council. My name is Ronald20 Blount. I'm with the Taxi Workers21 Alliance of Pennsylvania representing22 1,200 of the 5,000 taxi drivers in the23 City. And as many of you guys know, taxi24 drivers are the near poor, working 12 to25 129 11/29/11 - STREETS - BILL 110308, ETC.1 16 hours a day, six to seven days a week.2 And we start each day negative, over $703 to rent our cabs, $50 for fuel and4 maintenance, and then with the help of5 the Parking Authority, hotel6 associations, restaurants, we did a7 hospitality initiative in the taxi8 industry. We started accepting credit9 cards, GPS. The cars are better, the10 drivers are better. We made much11 commitment. Drivers are still making12 less income.13 So what this bill, from our14 perspective, will do will further reduce15 drivers' income. They'll be sitting in16 front of hotels not making nothing.17 Twenty percent of our income come from18 these hotels.19 We can be there in two seconds.20 You need to go to the airport? We can be21 there in two seconds. You need to go to22 the courthouse? We can be there in one23 second. We can do that.24 COUNCILMAN DiCICCO: To that25 130 11/29/11 - STREETS - BILL 110308, ETC.1 point, I want to ask you a question. Who2 would be the driver or who would be3 designated to drive these vehicles?4 Would they be hotel employees?5

Mr. Varley

Yes. It would be6 hotel employees. We would not charge for7 the services, and it would not include8 airport runs. It would be limited to a9 two-mile radius of the hotel.10 COUNCILMAN DiCICCO: I thought11 you testified the last hearing the same12 way.13 I do have one other question, I14 guess comment, about dedicating on-street15 spaces for businesses. We do have taxi16 loading zones, don't we? We have taxi17 loading zones in the City of18 Philadelphia?19

No. What's18 contemplated here -- there are taxi zones19 throughout, particularly Center City,20 where taxis can wait for -- where people21 generally congregate that need taxicab22 service, and the driver stays with the23 vehicle, the next person comes up and24 they leave.25 133 11/29/11 - STREETS - BILL 110308, ETC.1 What is being proposed here is2 a reserved space that can only be used by3 one vehicle owned by the hotel where it's4 situated.5

And6 that's because they'll be paying for that7 space, correct?8

Bill No. 110827, an11 ordinance amending Title 12 of The12 Philadelphia Code, entitled "Traffic13 Code," by further providing with respect14 to valet parking permit fees; and by15 authorizing the establishment of hotel16 loading zones and providing for penalties17 for illegally parking in such zones; all18 under certain terms and conditions.19 (Witnesses approached witness20 table.)21 COUNCILMAN DiCICCO: Before you22 gentlemen get started, the same applies23 to the Parking Authority. Their24 interaction between this Committee and25 135 11/29/11 - STREETS - BILL 110308, ETC.1 the Parking Authority, as everyone can2 see, is pretty much constant. So I want3 to thank you for the years of service and4 cooperation. This was one of those areas5 where I think we all would like to see6 something happen, but how do we get there7 is going to be -- it's still a challenge.8 But I want to thank you publicly, Rick9 Dickson, Vince Fenerty and the rest of10 your team over at the Parking Authority.11 Please proceed with your12 testimony.13

Mr. Dickson

I'll be14 mercifully brief. The Parking Authority15 has worked with Councilmember Kenney, the16 Mayor's Office of Transportation and17 Utilities and the Hotel Association to18 craft a solution to a problem that19 appeared with the way curb space in front20 of hotels operates. What I believe this21 ordinance does is take what has been22 practiced for a number of years and23 legalizes it. Many hotels had valet24 zones installed to cover the entire25 136 11/29/11 - STREETS - BILL 110308, ETC.1 length of the front of their space2 because they needed to have access,3 ongoing access, for people coming and4 going to the hotel. The reality was that5 much of that space was not used6 exclusively for valet purposes, but was7 used for other people, people or -- hotel8 guests or people using restaurants or9 other services who needed access to the10 front of the hotel.11 What this ordinance does is12 permits a new hotel loading zone, which13 would enable those people who are patrons14 of the hotel for whatever purpose,15 whether they be guests dropping off16 someone, someone going to a restaurant17 that needs to drop someone off or even a18 vendor who needs to drop off supplies,19 could use that space for those20 hotel-related activities. It enables the21 hotels to reduce the amount of valet22 space that they have, which will save the23 hotels money but, at the same time,24 really recognizes that there are a whole25 137 11/29/11 - STREETS - BILL 110308, ETC.1 host of demands on the curb space at the2 hotel, and we tried to accommodate all of3 those demands with this ordinance.4 The difference between this and5 what was proposed in the other one was6 that only one vehicle could ever use that7 space. This space allows anyone for a8 period of time to use the space.9 Certainly a hotel vehicle could stay10 there. It just could not park there11 indefinitely.12 The difference from this and13 what was proposed is that the other14 ordinance permits the vehicle to stay15 there from, I think, 9:00 a.m. until16 10:00 p.m. This says they can only stay,17 I believe, for a half hour.18 COUNCILMAN DiCICCO: Please19 proceed with your testimony.20

Good afternoon,21 Councilman DiCicco and members of the22 Committee on Streets and Services. My23 name is Andrew Stober. I won't reiterate13 what Rick said, but did want to add just14 two things from our perspective.15 One of the things that this16 bill does, while we address the needs of17 the hotel industry, is that we do18 maintain the full-time valet parking fee19 at $2,500, and this is important for two20 reasons. It provides revenue for the21 enforcement required to maintain properly22 functioning valet operations and also23 causes those requesting valet spaces to24 think carefully about what exactly their25 139 11/29/11 - STREETS - BILL 110308, ETC.1 valet needs are. Every valet space is2 typically a space taken away from the3 availability for public parking, and4 public metered parking in Center City at5 even just 80 percent occupancy returns to6 the City and School District upwards of7 $8,500 a year. So while the fees ensure8 turnover at rates that make sure that9 there's access to on-street parking for10 visitors, reducing the valet rate for11 zones that are used less than half the12 time, as this bill does, is consistent13 with an approach to pricing curb-side14 space in a way that reflects its15 enforcement costs and its public value.16 Happy to answer any questions17 you may have.18 COUNCILMAN DiCICCO: Thank you.19 Mr. Fenerty, do you have20 testimony?21

I'm the6 Executive Director of the Greater7 Philadelphia Hotel Association.8 The main purpose for us on this9 bill -- and I'm just going to read the10 sentence. This bill is necessary for us11 to deflect the thousand percent increase12 in valet curb space fees, which would13 increase some hotels costs from $2,00014 annually to 20,000, or about 50 percent15 of the cost of a housekeeper.16 I'd also like to thank everyone17 sitting at this table and Councilman18 Kenney's office for working closely with19 us on coming up with a solution that20 wasn't perfect for everyone but was21 something everyone can live with.22 COUNCILMAN DiCICCO: Thank you.23 Councilman Green.24

I can answer that.8 It's only for hotel properties that lack9 in off-street passenger loading and10 unloading facility. So it's really to11 address the needs of some historic12 hotels.13

Ritz18 Carlton. Okay. So here's my question:19 The hotel is able to pay for the spaces20 in front of it pursuant to this21 ordinance, whatever the cost is per spot,22 whatever spots are available. Is there23 any reason why they couldn't have -- a24 commercial vehicle owned by a hotel could25 142 11/29/11 - STREETS - BILL 110308, ETC.1 not just be left in front of that hotel2 in one of these spaces if they choose to3 do so? It is in the hotel's interest to4 make sure that traffic flow in front of5 their hotel is appropriate to get guests6 in and out. They're going to act in7 their own rational interest. So why do8 we need a -- when we are doing this, why9 do we need a separate bill creating a10 dedicated spot rather than just adding as11 a permitted use for this space a12 hotel-owned vehicle driven by a hotel13 employee and they can leave it there and14 take up a spot in front or not, if they15 want, depending on the --16

Vince Fenerty,21 the Executive Director of the Parking22 Authority.23 Number one, in front of some of24 these hotels, the space is very limited.25 143 11/29/11 - STREETS - BILL 110308, ETC.1 So to park a hotel vehicle there, which2 would not be a commercial vehicle, it3 would be tagged as a passenger vehicle or4 possibly a limousine according to the5 size of it, it may or may not move.6 Without pointing any fingers at any7 hotels, but there are some in very close8 proximity to City Hall where9 Councilmembers are familiar, don't police10 themself right now. They overuse the11 valet zones. To let a hotel start12 policing itself and the activity of its13 own vehicle in front of there would not14 be in the best public interest, in my15 opinion, Councilman. And I'm open to16 finding whatever type of solution there17 is to this, but to allow a hotel vehicle,18 which would be marked or unmarked, just19 park there all day would not be good. I20 think on a street like 16th, 17th or 8th21 Street, some which have hotels, if you22 start stacking vehicles and using a23 vehicle that just sits there waiting for24 a certain type of clientele, you're25 144 11/29/11 - STREETS - BILL 110308, ETC.1 taking away valuable curb space. You're2 having your valets load from the3 operating lane, the center operating4 lane, and traffic gets backed up. And5 we're just trying to ease the congestion6 in Center City.7

Prior to8 becoming a Councilperson, I have paid9 valets 10 or 20 bucks to leave my car in10 front of the hotel and run around and do11 some shopping. So I'm familiar with what12 you're talking about and nowhere to go to13 do that. So I understand.14 Thank you.15

Good afternoon,12 Chairman DiCicco and members of the13 Committee on Streets and Services. My14 name is Andrew Stober and I serve as15 Chief of Staff in the Mayor's Office of16 Transportation and Utilities. I'm here17 today to share the Administration's18 concerns about this bill.19 We do not support this bill,20 which allows for the creation of special21 purpose parking permits for real estate22 agents and home health professionals.23 This measure will begin a serious and24 inevitable erosion of the City's25 148 11/29/11 - STREETS - BILL 110308, ETC.1 residential permit parking program and2 parking management programs. The3 qualification of real estate agents for4 special parking privilege will establish5 a precedent for all small businessowners6 and employees to be exempt from meter7 parking fees and time limits. An8 exemption for home health professionals9 will establish a precedent for other10 service providers to be exempt from fees11 and time limits. Clergy, teachers,12 tutors, social workers and other helping13 professions have been requesting this for14 many years. These permits will be15 difficult, if not impossible, to enforce16 against when they are used for17 non-business purposes.18 While the goal of supporting19 real estate agents and home health20 professionals is laudable, the list of21 exempted groups will grow and the22 function of residential parking and meter23 parking programs will become untenable.24 Residents will not be able to find25 149 11/29/11 - STREETS - BILL 110308, ETC.1 parking and metered parking spaces will2 not be available to the general public.3 The breakdown in the parking system will4 lead to double parking and the traffic5 jams that inevitably follow.6 The Philadelphia Parking7 Authority currently offers day passes for8 specific residential parking areas to9 meet the needs of non-residents who10 require parking in a permit area for in11 excess of two hours. This system12 protects residents and ensures13 non-residents access to permitted areas14 with a level playing field for all15 non-resident drivers.16 We'll join the Parking17 Authority in recommending that this18 legislation not be passed out of19 Committee, and I'm happy to answer any20 questions you have.21 COUNCILMAN DiCICCO: Mr.22 Dickson.23

I certainly support the7 activity of real estate agents and home8 health care aides, and we think that9 there are legitimate ways that they can10 find to do their job. Unfortunately11 sometimes paying for parking is the cost12 of doing business.13 There are certainly cases that14 could be made for members of the clergy15 or the person that works in the corner16 grocery store who needs to drive to work17 or, for that matter, members of City18 Council who think that it would be better19 for them if they were not subject to the20 rules that everybody else is. But if we21 keep looking at this as a way to just22 provide free parking for special groups23 of people instead of those -- these are24 people who are being paid to do their25 151 11/29/11 - STREETS - BILL 110308, ETC.1 jobs. If we keep giving them free2 parking, those people who are paying to3 support the businesses that pay the taxes4 and do the other things won't have access5 to those places as well. Good afternoon,6 members of the Committee of Streets and7 Services. 12 The Greater Philadelphia13 Association of Realtors commends the14 authors of this unique revenue-generating15 consumer-friendly bill. 18 The proposed parking permits19 for real estate licensees works in tandem20 with the permits for contractors. 1 Together, generating revenue via transfer2 taxes on the purchase of the lot or3 renovation and once again generating4 transfer taxes on the sale of the5 finished dwelling. 10 In an older historic city such11 as ours, vehicle parking is challenging12 as our streets were not built to provide13 for this need. Most households today14 possess two vehicles, consequently15 complicating and limiting the limited16 parking available even further. In the17 normal course of a business day, hundreds18 of our members are meeting potential19 buyers and sellers in locations where20 parking is just not available. 4 The more time-consuming function of our5 licensees would be attending building6 inspections and hosting open houses for7 our consumers, which can last 90 minutes8 to two hours. We recognize that these9 parking enforcement officials are doing10 their job. 15 The attraction of purchasing16 parking permits by licensees is,17 therefore, apparent. If every licensee18 in Philadelphia totalling 3,863,19 including the 2,000 members of the20 Greater Philadelphia Association of21 Realtors, purchased a permit, it would22 generate revenue to the City in the23 amount of $772,600. 1 be more inclined to do business here,2 counteracting our "it's too difficult or3 too costly to find parking in the City"4 reputation. 7 We've been aware of concerns8 regarding the policing and potential for9 abuse of this privilege. 17 As a reminder, this legislation18 is only a pilot program. Therefore, in19 May of 2013 if City Council is not20 pleased with the results of Bill 110828,21 the members can terminate it. 6 MR. McCANN: Hello, Councilman7 DiCicco, members of staff. Thank you for8 hearing us. 13 MR. McCANN: I'm sorry. I'm14 Mike McCann. 17 I write in support of the18 parking legislation before you to allow19 realtors in the City of Philadelphia to20 purchase place cards, similar to the ones21 allowed for contractors, allowing22 realtors to park for a limited timeframe23 in the City. It's not setting a24 precedent. It is one already set. not asking for it for free. If you take someone out and4 you're an ambassador and you show them5 around the City, you're parking your car6 5, 10, 15 times. You're going in the7 home 10, 15, 20 minutes. You're moving8 your car. It's very difficult getting in9 and out, finding a meter, putting it in10 and all that stuff. And then you come11 back and you get a ticket. And I could12 take a buyer out for three hours and get13 two or three tickets. It's kind of14 discouraging. 17 But more than contractors, we18 bring huge revenue to the City in the19 form of transfer tax, business privilege20 taxes, net profit taxes, property taxes,21 jobs, gross receipts and additional22 spending in the City. We're23 self-employed. We're not paid by the24 hour or we get paid for doing it. 2 Our business is down over 503 percent. Sales are way down. We're4 working 14, 12 hours a day. We're not5 asking for anything for free. 9 We sell the positive aspects of10 Philadelphia, promoting new residents11 daily. No professionals are bigger12 cheerleaders for our city since our very13 survival depends upon it. 4

Good afternoon,8 Councilman Chairman DiCicco. How are9 you? And other Councilmembers. I'm10 Kathy Conway. I'm a realtor with11 Prudential Fox & Roach for the last 2512 years.13 I'd like to just explain what I14 believe a real estate agent in the City15 of Philadelphia is.16 We are professionals. We are17 diplomats. We are ambassadors to our18 great city. We create millions of19 dollars a year in revenue between20 transfer taxes, real estate taxes and21 City wage taxes, as well as the revenue22 from the ripple-down effect of our sales.23 I have many Parking Authority24 nightmare stories that I will spare you,25 160 11/29/11 - STREETS - BILL 110308, ETC.1 but I can tell you that in one year I2 received 72 tickets, all of which I paid,3 and 99 percent of them were just from4 expired meters, just because someone5 needs to have more attention, a buyer6 wants some questions answered. I7 literally got one ticket dropping a8 person off on Walnut Street. While he9 was getting out of my car, they were10 writing me a ticket, which all we're11 asking for is some courtesy and a little12 bit of grace.13 I believe this new legislation14 will definitely generate income to our15 City without raising taxes because of the16 permit costs they will be. This is a17 pilot program and can be rescinded in a18 year.19 I would like to thank20 Councilman Kenney for introducing this21 bill, and please pass this important22 bill.23 Finally, I would like to, even24 though Councilman DiCicco is not here,25 161 11/29/11 - STREETS - BILL 110308, ETC.1 thank him for all of his 16 years of2 service to our great city.3 Thank you.4

Hi. My name is9 Antonio Atacan. I'm a broker with Keller10 Williams. I've been selling real estate11 in Philadelphia 15 years and I want to12 make sure that my point is clear to you,13 you Councilmens.14 It's almost impossible to show15 real estate in Philadelphia and not16 getting a ticket basically, because the17 dynamics are such set that it's18 technically when you're selling a19 property, I mean, you could be spending20 five minutes to two hours. You have no21 way of controlling it. You could be22 parking your car three hours away and not23 be able to leave the property, because24 you cannot leave the property with a25 162 11/29/11 - STREETS - BILL 110308, ETC.1 client technically, because there's a lot2 of liability component. This is not3 something you're looking at and say is a4 privilege. It's more of a necessity.5 And it really brings the morale down.6 And we're trying to promote the City here7 and be dealing with the consumer coming8 from New York to cross country, and9 they're kind of laughing at us in a10 sense. We're saying, look, profit11 parking because they're so efficient,12 they have a TV show about it. We see13 why.14 We just need that balance here.15 I understand that if you don't look for16 our interest, who is going to look for17 our interest? Because we're individual18 entrepreneurs. We don't have a union19 behind us. We don't have a big20 corporation behind us. We're all21 self-employed here. So if you don't look22 for our best interest, nobody is going to23 look for it.24 So I hope that you take this25 163 11/29/11 - STREETS - BILL 110308, ETC.1 into serious consideration. This is not2 something because we feel entitlement to.3 I hope that you understand my point.4

Yes. Good7 afternoon. My name is Jack Barry,8 Greater Philadelphia Association of9 Realtors. I practice in Center City10 Philadelphia, and while my co-workers11 here have explained thoroughly why this12 would be a good idea, I would just like13 to speak briefly about the opposition14 that we face in the Administration and15 from the Parking Authority.16 We're not asking for a free17 ride here. We're willing to pay $200 for18 these permits, just like the contractors19 that currently have them do. The20 Administration and the Parking Authority21 feel that the whole entire parking scheme22 may be threatened by these permits and23 even Parking Wars may even be cancelled24 if we get parking permits for our cars,25 164 11/29/11 - STREETS - BILL 110308, ETC.1 and it's just simply not the case.2 The threat of abuse is very3 clearly -- would be monitored by City4 Council and the Parking Authority as it5 is now for the contractors. This is a6 great revenue stream. Over 3,0007 licensed realtors in the City of8 Philadelphia -- those numbers are from9 November 22nd of this year. This could10 be a great revenue stream without11 taxation. And as the Parking Authority12 states, other groups want to get permits?13 Allow them to, too. There's plenty of14 parking spots out there in certain15 sections of the City. There's very few16 spots, very few places where it's hard to17 park your car. I'm out there all day18 long. You don't have to drive more than19 a block.20 COUNCILMAN DiCICCO: I don't21 think you want to go there. You're22 making an argument against this. If23 there are that many spaces, why would we24 need to have special permits issued?25 165 11/29/11 - STREETS - BILL 110308, ETC.1

I think what he's4 trying to point out is basically you're5 not generating enough revenue in those6 areas. This will be an additional7 revenue. Obviously this is not an issue8 in Center City. We're talking about9 areas that not enough activity, but10 you're not generating enough income for11 the City. That's the point.12 And the second thing is, I13 don't know how intelligent, smart about14 not getting a ticket. You're going to15 get a ticket. I just want to make sure16 that you understand that.17 COUNCILMAN DiCICCO: I have a18 councilmanic placard and I'm City-owned19 car and I get tickets, but when I had a20 City car eight years ago, I was getting21 tickets. They are proficient.22

Okay.11 Now, I guess the trouble I have with this12 bill, quite frankly, is -- and I13 understand, realtors do a great job. I'm14 glad property is selling. I'm glad all15 of that. But in the end, I mean, in all16 fairness, you're salespeople, right?17 That's what you are. Well, there's lots18 of other salespeople in the City,19 insurance, whatnot. I guess I question20 why just real estate. I mean, health21 care professional may be a little22 different argument, but, again, with all23 due respect to your profession, why do24 you think it should be just real estate25 167 11/29/11 - STREETS - BILL 110308, ETC.1 agents in this case?2 MR. McCANN: If I may answer?3

Councilman Greenlee

Sure.4 MR. McCANN: Because you're5 physically taking someone in your car and6 if you want to look at properties in town7 today and I would set up ten properties,8 I have to find ten parking spots to park9 my car. You might like that house. You10 might want to stay in there more than the11 money I put in the meters. And our car12 is our office. We're not sitting in a13 beautiful building like this all day.14 We're in and out of the car, and you're15 probably taking out 30 or 40 appointments16 throughout the week in and out of your17 car, parking, moving. That's not18 counting all the -- you're parking,19 you're going to settlements and all that20 stuff. That's a different issue. Coming21 here today, I paid $18 to park.22

Councilman Greenlee

But you23 would be able to park in those situations24 if you had that placard, right? I mean,25 168 11/29/11 - STREETS - BILL 110308, ETC.1 they're not going to check to see if2 you're carrying somebody around at that3 moment.4 MR. McCANN: You're going to5 park in the spot with the placard because6 you're showing properties.7

Councilman Greenlee

Or8 meeting with somebody to talk about a9 property.10 MR. McCANN: That is correct,11 yes, and going to someone's house.12

Councilman Greenlee

So you're13 involved in sales, which is fine, but so14 is somebody selling insurance.15 MR. McCANN: Okay. What about16 the contractors? Why do the17 contractors --18

Councilman Greenlee

Well, I19 think the difference there is, they're20 providing a direct service at that21 moment. For the most part, they're22 fixing something. They're providing a23 service.24 MR. McCANN: But if they're25 169 11/29/11 - STREETS - BILL 110308, ETC.1 going to be there in that one house, they2 could find a real spot and stay there,3 just like when I come to a settlement, I4 know I'm going to be there for two hours,5 I pay for my parking. But when I'm out6 showing you properties and I'm running7 around, I'm going from spot to spot8 trying to find a spot, dropping people at9 the house, finding a spot, running back10 to the house, and that's what it is. If11 I'm a contractor, I'm going to a site and12 there's a parking lot here, I'm going to13 pay there for the day, unload my stuff14 and go pay there for the day. I don't15 need that placard. But as realtors,16 we're in and out all the time. If I have17 a couple appointments, I'm going to my18 office, I pay for parking. I'm coming19 here, I pay for parking. It's being the20 ambassador.21 A home health care, I would22 totally agree too, they're going in a23 house for an hour or two. And so the24 bottom line is, I probably spend three or25 170 11/29/11 - STREETS - BILL 110308, ETC.1 four hundred dollars a month in parking2 tickets, not counting the money I put in3 the meters and not counting the money4 that I pay to park at my garage or other5 garages that I paid today. It's insane.6 It's off the charts.7

Councilman Greenlee

But I'm8 just wondering, don't a lot of other9 salespeople that have to go back and10 forth to see customers and go to11 customers have the same problem? That's12 my dilemma here.13

Ms. Conway

Councilman14 Greenlee, I do not believe that. I think15 that what sets us apart from a16 salesperson or an insurance person is the17 revenue and what we feel about our city.18 We are your cheerleaders. We are the19 ambassadors. We're the diplomats. And20 honestly, we need that special privilege.21 And just the revenue we bring in sets us22 apart from other tradespeople.23

Councilman Greenlee

Ms. Conway

Not really. Not3 how much we make. How much we make the4 City. I'm not saying what -- we have no5 special privilege. We're saying what6 we --7

It's not a special10 privilege. I think it's deserved, as a11 contractor working in a house deserves12 it.13

I hear14 you. I understand what you're saying.15 It's just I'm a little troubled by -- it16 just seems like singling one type of17 business out, which is really what you're18 doing here, I just -- it bothers me a19 little bit.20

If3 you own a property in Center City, if you4 get in the car with me all day long, look5 at houses, you probably maybe have a6 better understanding what we go through.7 I mean --8

The reality is,11 it's a very dynamic situation. It's not12 static. We're going to get a ton of13 tickets, going to get ton of tickets14 unless you stop it. Bottom line. I15 mean, there's no way I can be smarter16 about this. It's just the way the cards17 are dealt.18

Councilman Greenlee

I hear19 you. I'll be honest with you, I just20 have some trouble with this. It just21 seems like it's singling out one22 business, and I just have a little23 concern about that.24

Ms. Butler

I do believe,25 173 11/29/11 - STREETS - BILL 110308, ETC.1 Councilman Greenlee, it is singling out2 one particular business, but to your3 point, this sales business that we're in4 is a unique product. It is not like any5 other product that any other salesperson6 would be engaged in in the City, so it7 does lend itself more to the contractor8 construct than the insurance salesman,9 who has a list of clients he's going to10 visit in any given day. So in that11 regard, I think it does separate itself12 and would hence generate this interest.13

Most places it's8 two hours. It's three hours in the9 evening. I believe the testimony that I10 heard was that people are in and out in11 20 minutes. There seems to be the12 perception from the testimony that13 somehow this permit would exempt people14 from parking tickets.15

I'm just --16 okay. So the time limit is three hours?17

Does it19 apply to any realtor licensed in the20 State of Pennsylvania?21

I think the21 realtors in this town do provide a22 valuable service. It's value added by23 way of the perception of new people who24 come to the City of Philadelphia and are25 176 11/29/11 - STREETS - BILL 110308, ETC.1 treated and are received by these people.2 But I could make that same argument for3 pastors who visit a home. I could make4 that assertion for the pizza delivery guy5 who adds value at halftime to the6 football game. None of them get those7 special privileges, and I would think8 that this body would be hard-pressed to9 start to segregate out.10 I think the compelling piece11 was that so why should the contractor get12 that kind of privilege. Well, if you're13 hauling equipment up and down, proximity14 matters. There's 20 minutes in14 front of businesses. There's free15 parking around City Hall. There's a lot16 of other special exceptions. And we're17 not looking for special exceptions.18 We're looking for -- we're doing business19 in the City. We do provide a very big20 service. Center City has grown 17,00021 people in the last ten years, and a lot22 of it is our blood and sweat. We're23 asking, hey, can't you recognize what we24 do for the City. You don't ticket the25 178 11/29/11 - STREETS - BILL 110308, ETC.1 UPS guy. They don't ticket a lot of2 people.3

Councilman Green

Yes, they4 do.5 MR. McCANN: Well, they do, but6 they cut them a lot of breaks.7

Councilman Green

No, they8 don't.9 MR. McCANN: I'm telling you,10 we go in a house and we're in there three11 extra minutes --12 COUNCILMAN DiCICCO: UPS are --13 MR. McCANN: But you see those14 type of trucks all over the place. So,15 again, we don't need three hours.16

Mr. Atacan

What I heard from17 earlier hearings, that I know you're very18 focusing on making sure that you're19 creating a win-win situation for, just20 listening to your point on taxicab21 drivers having the privilege to be able22 to park because it supports their23 business. We're not asking anything24 really different than that. Rather than25 179 11/29/11 - STREETS - BILL 110308, ETC.1 telling us simply no, give us something.2 Give us something that shows that you're3 committed to help us. Don't shut us down4 on the first try. That's what we're5 looking for. I think that's fair. And6 plus the (unintelligible).
