Good morning. I note that the hour has come and that a quorum of this Council is present. Council will come to order. Members will take their seats, and visitors will retire to the seats outside the rails. To give our invocation this morning, the Chair welcomes Reverend Dr. Lorina Marshall Blake, Associate Pastor of Vine Memorial Baptist Church. She is here today as the guest of Councilwoman Reynolds Brown. At this time, I would ask all members and guests to please rise. (Members and guests rise.)
Thank you. First I'd like to thank Councilwoman Blondell Reynolds Brown and also President Verna for this opportunity. In the word of God, it states that when we pray -- and today we come to -- it says that prayer is not an indifferent or a small thing. It is a sweet little privilege. It is a great prerogative for our reaching in an effect. Prayer is not a mere episode of the Christian life. Rather, the whole of life is a preparation for and the result of prayer. Let us pray. Dear Gracious and Heavenly Father, we come to you this day, this day that you have made and you've been so gracious to allow us to be in it, with bowed-down heads and humbled hearts and with thanksgiving for what you have done. And, yes, Lord, even in the midst of varying situations, there are still praises on our lips and in our mouth for you, for it is not what we have done, but what you have done. And so, God, we come at this time with our prayer for those who lead us in our City Council and our City God, the prayer is that you may give them wisdom, discernment and courage to make decisions which are morally right according to your word. According to your word, you tell us to acknowledge thee in all thy ways, oh, God. And here in City Council, oh, God, that we would indeed acknowledge thee. Lord, that we pray that you would do great and wonderful things through your people as they serve you. Lord, you talk about first being a servant, oh, God, and as they serve God, that they serve you first, and then in serving you, they serve your people. And, God, as we continue to pray, God, and we pray for this City Council and we pray for this City, Lord, we pray that the needs of all, for food, shelter and work, for justice and dignity, might be met. God, we pray that the diverse people living here may join their efforts of all. Lord, that we would minister to the cities through the hands of your people. Yes, again, through the hands of your servants here in City Council, oh, God. And, Lord, we would ask that you continually remind us of our need for you, not just to impart wisdom in difficult times, but also for our need for a savior at all times. And, finally, God, we pray for the governmental officials and law enforcement that face and fight crime and evil in our city each day. Lord, we ask that you give them strength. Lord, we ask right now, Lord, in your name for peace in the land. And, God, we ask that you help this Council as they lead, as they make decisions, oh, God, that they would lead with courage, they would lead with humility, they would lead with wisdom, mercy and brotherly love. And, God, continue to surprise of how much power we have, both individually and collectively, to make a difference, a difference in the way citizens meet, greet, respect and protect the right of others, a difference in the way government, business and labor can work together for justice and social enrichment, and a difference in our response to the needy as a difference in our appreciation for those who give of themselves. And so again, God, as we thank you for the day and we thank you for that which occurs this year, oh, God, and we thank you for the proceedings that will happen here this day, we would ask that you would strengthen all for their journey of the day and the days to come. And as this we ask in the name of Jesus, let all the people of God say amen. (Amen.)

At this time, the Chair recognizes Councilman O'Neill, who will present a resolution honoring Bernard Brunwasser. Thank you, Madam President. This is a resolution honoring Bernard Brunwasser on his retirement. The Council of the City of Philadelphia is very pleased to recognize and honor Bernard Brunwasser on the following a distinguished career of forty -- yes, that was forty years -- of exemplary service to the citizens of Philadelphia; and Whereas, Bernard Brunwasser was born in Kassel, West Germany, one of two sons born to Chaim and Genia Brunwasser. Bernard has -- Bernie has one brother, Alan Brunwasser. He immigrated to the United States at the age of three in 1951 and was raised in the Strawberry Mansion and Oxford Circle neighborhoods of the City. Bernie attended the Solis-Cohen and Stokely Elementary Schools, Woodrow Wilson Junior High, Northeast High School and Penn State University; Whereas, in 1974, Mr. Brunwasser married the love of his life, Eileen, and they have been married for the past thirty-seven years. They are the proud parents of three children: Karen, Steven and Daniel. For the past thirty-two years, the Brunwassers have the Bustleton section of the City, in the 10th Councilmanic District. That's not in here, but that's why I'm up here. Whereas, while a senior at Penn State University, Bernard was recruited for employment by the City of Philadelphia. He began his City employment as a Management Trainee on November 2nd, 1970, and steadily climbed the ladder from there. On August 16th, 1999, he was promoted to Deputy Water Commissioner and has served with distinction as Water Commissioner since April 24th, 2004; and Whereas, Bernard Brunwasser has served the public with energy, commitment and fidelity. He has accepted numerous prestigious awards on behalf of the Water Department and has universally earned high praise for his efforts and the esteem of both his peers and staff. Therefore, by virtue of this citation and as evidence of the heartfelt of this legislative body, the Council of the City of Philadelphia is pleased to join with the family, colleagues and many friends of Bernard Brunwasser, Commissioner Brunwasser, in honoring him on his outstanding career and service to the citizens of Philadelphia. We wish him a long retirement filled with good health and the joys of family and friends. Certification, that this is a true and correct copy of the original resolution, adopted by the Council of the City of Philadelphia on the 3rd day of February 2011. The Chair recognizes Commissioner Brunwasser. BRUNWASSER: Thank you, Councilman O'Neill. Thank you, Council President Verna, and thank you all, all Councilpersons in Philadelphia. I've been here for 40 years, all with the Water Department. It's been a wonderful life, a wonderful career. And as you know, I'm a product of the Philadelphia public school system and so are my children. All three of my kids went through the Philadelphia public school system, and all are highly successful and they all have at least Master's degrees. I'm the least educated person in the family now. But anyway, I'm proud to report that the Water Department is exceedingly strong, probably the strongest that it's ever been in its history. It is operationally strong. All of its plants, all three water plants, all three wastewater plants, are winning awards on an annual basis for their operation. Operationally we're very strong, thank goodness, and all of that has been recognized by the three bond rating agencies in New York that have given us the highest ratings we have ever had, the highest bond ratings. So I'm very proud of that. And part of that reason for those high ratings and the good record that we've had is the cooperation of City Council. And I want to especially thank President Verna and, of course, all of you members for supporting us by approving our budgets, by approving our bond ordinances, and we've been able to save tens of millions of dollars over the years by refinancing debt with your help and improving our operations also with your help. So I'm very grateful to City Council. And I just want to say thank you to everybody, especially my staff, some of whom are here today, and the employees of the Philadelphia Water Department, who put it on the line every you. Thank you very much. (Applause.)

Good morning. Thank you, Madam President. It's an honor to present this resolution to one of our outstanding organizations in the City of Philadelphia, The Reinvestment Fund, on its 25th Anniversary. Whereas, The Reinvestment Fund (TRF) was co-founded in 1985 by Jeremy Nowak, Ph.D. as a small community development organization working in Greater Philadelphia and has evolved into a progressive, results-oriented, socially responsible community investment group that has become a national leader in financing neighborhood revitalization; and
Whereas, TRF is both a community development financial institution and a policy institute; in other words, think tank, that works across the Mid-Atlantic region, serving Pennsylvania, New Jersey, Delaware, Maryland and Washington, DC, and is headquartered in Philadelphia and has offices in Baltimore and Washington, DC; and Whereas, TRF's mission is to build wealth and opportunity for through the promotion of socially and environmentally responsible development; and
Whereas, combining expert knowledge with innovation and determination, TRF delivers capital in a manner that transforms lives and rebuilds neighborhoods and works closely with a diverse network of investors and business partners to galvanize private initiative and capital for the public good; and Whereas, since its inception, TRF has provided 1 billion in community investment, and these investments have leveraged $3.4 billion in total development, which have financed more than 2,545 projects and have resulted in 550 businesses, 18,914 housing units, 29,207 charter school slots, 46,235 jobs, 8.4 million square feet of commercial space, and 2.98 million megawatt hours of clean energy, enough to power 330,000 homes for a year; and
Whereas, in addition to capital investment, TRF's policy work helps to achieve its mission by providing analysis of critical issues for the communities in which it serves and, through its work, TRF gathers and manages data that is used to guide its financing and development goals and studies the impact of its investments to determine if they meet the standards set forth in its mission; and Whereas, TRF's dual role as a policy institute and a community development financial institution has led to a number of innovative programs like the Pennsylvania Fresh Food Financing Initiative, which has led to TRF-approved funding for 68 food stores in Pennsylvania, a White House town hall meeting in Philadelphia regarding the future of America's cities and metropolitan areas, a Philadelphia kick-off of First Lady Michelle Obama's initiative for improving access to anti-obesity program, and a proposal by President Obama for $345 million in federal funding for the Healthy Food Initiative; therefore, be it
Before we resolve, I'd just like to add that they have provided an in-depth study on the whole issue of predatory lending and was very helpful to this Council when we took that issue up. So resolved, by the Council of the City of Philadelphia, that we hereby honor The Reinvestment Fund on its 25th Anniversary. Further resolved, that an engrossed copy of this resolution be presented to Jeremy Nowak, Ph.D., Co-Founder and Chief Executive Officer of The Reinvestment Fund, as evidence of the sincere sentiments of this legislative body. This was introduced by Marian Tasco, signed by President Verna and of City Council. We congratulate them on the great work they do. We appreciate them being in Philadelphia and working with local government and neighborhoods to bring about a better quality of life for Philadelphia. Thank you, Jeremy, and thank you -(Applause.)
-- Ira Goldstein, who really has done a lot of work and a lot of studies for us around the issue of predatory lending. We thank you for coming and we wish you well. We wish you another 25 years.
I just want to thank the Council. Philadelphia is a great place to work. It's a great place to invest. I think we've got the future despite the recession. I think the future is in front of us. We have some best, most important institutions, educational and medical facilities in the country. In some instances, of global significance. We also have significant problems, particularly in education, but I think with everybody working together and everybody making the best use of public and private resources, I think our best days are in front of us. Thank you, Madam President. City Council, City of Philadelphia citation welcoming Clifton Davis. The Council of the City of Philadelphia is pleased and proud to extend a most sincere welcome to Clifton Davis upon his visit to Philadelphia or his return to Philadelphia, the City of Brotherly Love and Sisterly Affection. Whereas, Clifton Davis is an actor, singer, composer, producer and minister who has shared his unique gifts with audiences around the world for decades. Clifton is probably best known for his five-year run as Reverend Rueben Gregory on the popular NBC television series "Amen." His earlier series, "That's my Mama," established him as a wildly known actor and television star; and Whereas, Clifton was raised on Long Island and began his career in New York City in the Broadway show "Hello Dolly." For six years he performed five Broadway shows and earned a Best Actor Tony Award nomination, which led him to Hollywood; and Whereas, for two years, Clifton Davis served as Executive Director of Sunoco Welcome America here in Philadelphia, the foundation which presented Philadelphia's Independence Day celebration. Presently he is on tour in the comedy drama "What My Husband Doesn't Know" at the Miriam. In recent years, Clifton has appeared in such films as "Cover," "Any Given Sunday," "Halloweentown High," "Kingdom Come," "Max Keeble's Big Movie," "Soldiers of Change" and "The Climb." He has also been guest star on many shows, some of "Half & Half," "American Dreams," "The Jamie Foxx Show," "Living Single," "The Melba Moore & Clifton Davis Show," "The John Laroquette Show," "The Tonight Show," "Oprah," "The Arsenio Hall Show" and so many more; and Whereas, Clifton Davis received a Grammy nomination for his hit composition "Never Can Say Good-Bye." As a singer and recording artist, his album "Say Amen" was a success. He also hosted and served as presenter on numerous award shows and television specials. He has guest starred in many made-for-TV movies such as "Dream Date," "Little Ladies of the Night" and "Cindy" on Broadway. He appeared in "Hello Dolly," "Jimmy Shine," "The Engagement Baby," "Look to the Lilies" and received again a Tony Award nomination for Best Actor in a Musical in 1972 for the Tony Award-winning musical "Two Gentlemen of Verona"; and
And whereas, in 1994, Clifton returned to the in "Hapgood" and has been seen off Broadway in "How to Steal an Election," "To Be Young, Gifted and Black" and Pulitzer Prize-winning "No Place to Be Somebody," among many other productions. He won a Theatre World Award for his performance in "Do It Again." In 2008, he co-starred in the romantic comedy play "The Greatest Love Story Ever Told"; and Whereas, Clifton holds a BA in Theology from Oakwood University and a Master of Divinity degree from Andrews University. He has also earned a Doctor of Ministry degree from Trinity International University and honorary Doctor of Letters degrees from Lincoln University, Paine College and Edward Waters College; and Whereas, Clifton is a recipient of many numerous awards and citations for his social, civic and spiritual service. He is noted in "Who's Who in America" and has been honored by such organizations as Vision, the UNCF, the NAACP and the American Heart Association. Clifton regularly hosts "Praise the Lord" on the Trinity Broadcasting Network. Therefore, by virtue of this citation, the Council of the City of Philadelphia welcomes back Clifton Davis upon his visit/return to Philadelphia, our City of Brotherly Love and Sisterly Affection. We do hope his time in our city is always pleasant and that he returns home safely with fond memories of our city. We did our best to make this city proud and to show the world what a wonderful city Philadelphia really is. The birth place of our nation is alive and well, and freedom and liberty is alive and well. I cannot thank you enough for this recognition, and we're honored to be here today and we hope we see you all at the Miriam Theatre for a cultural experience you won't forget. Thank you so much. His work is enjoyed worldwide. He remains on the Hollywood fast track, writing and developing a sitcom for Fox, casting the follow-up to his Sony Pictures smash debut "First Sunday" and mounting the national tour of his latest stage production "What My Husband Doesn't Know" that is open here Miriam Theatre; and Whereas, David is a highly sought-after content creator across all media. From writing and producing "Unpredictable," the NBC special award for Academy Award-winner Jamie Foxx, to starring in his own reality series "David E. Talbert's Stage Black" and his best-selling novel collaboration "Love Don't Live Here No More" with hip hop icon Snoop Dogg, David has demonstrated his diverse talent; and
Whereas, David, heralded by the Los Angeles Times as "one of the most prolific theatre makers in America," his 12 critically acclaimed productions have broken box office records nationwide to millions of fans, garnering him both the NAACP and New York Literary Award for best playwright for -- envelope, please -"The Fabric of a Man," "Love in the Nick of Time," respectively. Recently, David received the NAACP Trailblazers Award for productions; and Whereas, David E. Talbert, a graduate of Morgan State University, earned his Bachelor's degree in marketing, later attended New York University's acclaimed film program. Therefore, by virtue of this citation, the Council of the City of Philadelphia welcomes David E. Talbert upon his visit to our city, the City of Brotherly Love and Sisterly Affection. We welcome you on your visit, and may your time here be pleasant and your return home safely with fond memories of the City of Philadelphia and my debut acting career. (Applause.)

Fred Fisher, commenting on Bill No. 100128, which establishes standards of conduct regarding the political activities of City officers and employees.
Good morning. I am a resident. I've lived almost my whole life in Philadelphia. I lived in California when I worked on the Apollo Space Craft mission and I lived in Washington, DC when I was an employee of NASA, and I'm basically here to talk about the ethics bill. I just read recently that the Sunshine Law enacted in 1993, which allowed citizens to address elected officials at all public meetings, was accepted by all municipalities in the state, except City Council declined to allow this to happen. It took a lawsuit in front of the Pennsylvania Supreme Court to remedy this, which ruled City Council in violation of the law. Why I'm bringing this up, it doesn't speak well of the ethics of City Council. It since went on from 1993 to 2010. In fact, I'm just going to read what the ruling was by the Supreme Court. The ruling was that all citizens and taxpayers of Philadelphia have been improperly deprived of their legal right to provide comment to their elected officials on, quote, matters of concern at any matter which is or may come before the Council, as specifically provided by the Sunshine Law. So I'm very happy to see that City Council is once more examining their ethics position, because I think it has been a very large failure on this matter in the past. Thank you.
My name is Sandra Stewart. I am a proud resident of Tacony. I am a Philadelphia very overtaxed taxpayer. I'm commenting on the ethics bill as well this morning. I would like to implore -again, I believe this bill is long overdue for ethics, on the issue of ethics for City Council. I would like to implore City Council members to at least start a conversation about term limits. It's long overdue for this Council. Philadelphia is the number one city in the continental United States that has the longest running City Council members of 15 and a half years. I think it's important that -and I'm sure the proud Philadelphia residents agree with me -- that City Council service, although very appreciative of it, should not be a way of life. It should be limited to two term limits, four years each, eight years maximum, and then you should vacate the seat and allow new leadership hopefully. Thank you. I appreciate the time.

Thank you, Madam President. In the State of the Union address, President Barack Obama used a theme called "Winning the Future." He talked about infrastructure repair. He talked about using that to create jobs and save our city economically. This week, Vice-President Biden and Secretary LaHood, who is the Department of Transportation's head, came to Philadelphia to talk about high-speed trains. It is significant because more Philadelphians go to Harrisburg, Washington and New York by train than by plane. So that high-speed train has significance here. We want to take a look at locally SEPTA and the relationship with Public Property and our platforms, els, subways and concourses to look at how we can effectively create and be innovative with our underground and platform. To that end, Councilman Wilson examining those efforts through a hearing where we will be looking at this, looking into it and improving those interactions between Public Property, SEPTA and the City of Philadelphia and, most important, its riders. We want to take the lead of our President to look at what we have to make what is necessary to create a more vibrant city. Thank you, Madam President.
