Good morning, everyone. For the benefit for those who are in here, and the majority are here on the Wal-Mart issue Bill No. 030740, what I am about to begin to do now has nothing to do with that bill. This is a Committee on Streets and Services. I do appreciate you being here. I do want you to know it has nothing to do with that bill that the majority of you are here for. This is a continued hearing the Committee on Streets and Services. We have a quorum, Councilwoman Donna Reed Miller, Councilman Rizzo, Councilman Clarke and myself Councilman DiCicco. We're now in the public hearing of the Committee and streets and services. The Clerk will read the title of the first bill. And Councilman Ortiz has just arrived as well.

Bill No. 030731, an ordinance authorizing the revision of lines and grades on a portion of City Plan No. 152 by striking from the City plan and vacating Regent Street from 67th Street to 66th Street 4 12/11/03 - STREETS - BILL 030731 and by placing on the City Plan a certain right-of-way for drainage purposes, water main purposes and public utility purposes, all under certain terms and conditions.

Good morning, Mr. Chairman and Members of the Committee. My name is Paul Lonie, Survey Bureau Manager of the Department of Streets, and the Department would offer the following testimony on Bill 11 No. 030731: This is an Administration ordinance 13 recommended by the Streets Department to facilitate children safety between a school and a recreation center, and the Streets Department recommends the favorable action on this bill.

Good morning, Mr. Chairman and Members of the Streets and Services Committee. My name is Martin Soffer, City Planning, and I'm here today to testify on behalf of the City Planning Commission. The proposed ordinance authorizes the striking from the City plan and the vacating of an unneeded minor street located 5 12/11/03 - STREETS - BILL 030732 in the Paschall section of Southwest Philadelphia. The purpose of this ordinance is to create a safer and more pedestrian-friendly connection between the public school and the recreation area on either side of the street. The Planning Commission's staff will recommend approval of this action at its meeting on December 9, 2003. Therefore, the Planning Commission recommends that Bill No. 12 030731 be approved. Thank you.

Again, my name is Paul Lonie, Survey Bureau Manager, and the Department of Streets would like to offer the following testimony on Bill No. 030733: This is a private interest ordinance 20 recommended by Westram Development Corporation to place these streets on the City plan to facilitate a development of major proportion in South Philadelphia. The Streets Department is in favor of this development and recommends this bill 8 12/11/03 - STREETS - BILL 030733 for favorable action..

Good morning, Mr. Chairman and Members of the Streets and Services Committee. Again, my name is Martin Soffer, City planner. And I'm here today to testify on behalf of the City Planning Commission. The proposed ordinance authorizes the placing on the City Plan certain minor streets located in the Packer Park West section of South Philadelphia. The purpose of this ordinance is to provide legal street frontage for the subdivision of 230 new dwellings on a 27-acre parcel of land. This action is consistent with the subdivision plot approved by the Planning Commission at its meeting on September 19, 2002. Therefore, the Planning Commission recommends that Bill No. 030733 be approved. Thank you.

The purpose of this bill is to extend the time frame for compliance to the bill passed on November 13, 2002. The Streets Department is in favor of this bill and recommend it for favorable action.

My name is Mark Washington, I am the District Traffic Engineer for the Northeast section of the City. I'm here today to offer testimony on Bill 030735, a bill establishing a "No 10 Truck Parking" regulation on Friendship Street from Dorcas street to Algon Avenue, both sides. The Streets Department has no 14 objection to this bill. We can post under a trial ordinance, we can have the signs posted within three weeks.

Bill No. 030737, an ordinance to authorize the Water Commissioner on behalf of the City to enter into an agreement with the owner of the property at 5400 City Line Avenue for the grant of right-of-way to the City for drainage and sewer purposes extending in a southeasterly, southerly and southwesterly direction from an existing right-of-way approximately 59 feet southeasterly of City Line Avenue and approximately 283 feet southwesterly of 54 street, under certain terms and conditions.

Good morning, Mr. Chairman and Members of the Committee. My name is Paul McCloskey for the City of 14 12/11/03 - STREETS - BILL 030737 Philadelphia Water Department. This bill WAS introduced by Councilman Nutter on November 13, 2003, by request. The Water Department submits the following testimony: This bill authorizes the relocation of a portion of existing right-of-way for sewer and drainage purposes at 54th Street and City Line Avenue. The relocation of the right-of-way is to accommodate the expansion and facilities at St. Joe's University. St. Joe's is bearing the cost of relocating the sewer in the existing right-of-way to a new location in order to construct additional classroom facilities. The located section of sewer has been built to City standards and with the intent that the City will assume ownership in accordance with the requirements of the Philadelphia Code. In order to assume ownership, of the facilities this ordinance 22 authorizes the City to accept the right-of-way from St. Joe's. We recommend that the bill be favorably reported out of Committee. We also 15 12/11/03 - STREETS - BILL 030738 request a suspension of the rules in light of impending recess of City Council.

Bill No. 030738, an Ordinance authorizing the Water Commissioner, on behalf of the City, to enter into an agreement with the owners of the properties, 16 12/11/03 - STREETS - BILL 030738 and their successors, of a private street, known as Anthony Lane, located at 8816 Ridge Avenue, for the grant of a right-of-way to the City for water main purposes, under certain terms and conditions.

Good morning. Again my name is Paul McCloskey. I'm representing the City of Philadelphia Water Department. This bill was introduced by Councilman Nutter on November 13, 2003, by request of the Water Department. The Water Department submits the following testimony: This bill authorizes the placement of a right-of-way of variable width primarily in the bed of Anthony Lane, feet 17 wide. Anthony Lane is a private street at 18 8816 Ridge Avenue. The Wissahickon Valley 19 Homeowners Association, Inc., and the owner of 20 Lot 16 of the housing development owns the 21 property that the proposed right-of-way 22 transverses. The development of the single-family houses was built with the water being constructed to City standards at the 17 12/11/03 - STREETS - BILL 030739 developer's expense with the intent that the City would assume ownership in accordance with the requirements of the Philadelphia Code. In order to assume ownership of the facilities, this ordinance authorizes the City to accept the right-of-way from the Homeowners Association and the one lot owner through private property. We recommend that this bill be favorably reported out of Committee. We also request suspension of the Rules in light of the impending recess of City Council.

Bill No. 030739, an ordinance authorizing Thomas Jefferson 18 12/11/03 - STREETS - BILL 030739 University, Suite 2100, 130 South 9th Street, Philadelphia, PA 19107 its successors and assigns to construct, own and maintain an underground pneumatic conduit ductbank connecting three hospital campus buildings in the vicinity of 10th and Walnut Streets, under certain terms and conditions.

Good morning, Chairman and Members of the Committee. My name is William Mautz, and I'm a Construction Engineer with the Streets Department. I'm here to offer the following testimony for Bill No. 14 030739 on behalf of the Streets Department. This bill authorizes Thomas Jefferson University to construct, own and maintain an underground pneumatic ductbank connecting three hospital buildings in the vicinity of 10th and Walnut Streets. The ductbank, consisting of two pneumatic conduits and two spare conduits, will connect hospital Buildings B, L, S, G and Barranger to the Curtis Building. The Streets Department has reviewed the construction plans for this project and 19 12/11/03 - STREETS - BILL 030741 has no objection to the passage of bill.

The Streets Department is in favor of this and recommends it to your Committee for favorable action.

The proposed ordinand authorizes the revision of lines and grades to a street located in the Somerton section of the far Northeast Philadelphia. The purpose of this ordinance is to redesign and create a southbound turning lane at the intersection of Southampton Road and Roosevelt Boulevard. 21 12/11/03 - STREETS - BILL 030784 The City Planning Commission's staff will recommend approval of this action at its next meeting on December 9, 2003. Therefore, the Planning Commission recommends that Bill 6 No. 030741 be approved. Thank you.
