Good afternoon. This is the Committee on Rules. This is a continued hearing, and I would ask Mr. McPherson to please read the title of the bills before us. MR. McPHERSON: Bill No. 8 070006, an ordinance amending Section 9 14-1605 of The Philadelphia Code, entitled "Regulated Uses," by adding "Licensed Gaming Facilities" as a regulated use, all under certain terms and conditions. Bill No. 070008, an ordinance 15 amending Chapter 14-400 of The Philadelphia Code, entitled "Commercial Entertainment District," by deleting the provision authorizing the City Planning Commission to approve temporary facilities. Bill No. 070009, an ordinance 22 to amend the Philadelphia Zoning Maps by changing the zoning designations of certain areas of land located within an area bounded by Reed Street, Tasker 3/22/07 - RULES - BILL 070009 Street, Christopher Columbus Boulevard and the Delaware River. Bill No. 070010, an ordinance 5 amending Chapter 14-400 of The Philadelphia Code, entitled "Commercial Entertainment Districts," by prohibiting Districts within one mile of one another; providing additional restrictions for gross floor area, open area, and waterfront setback requirements. Bill No. 070011, an ordinance 13 amending Section 14-1600 of The Philadelphia Code, entitled "Miscellaneous," by adding a new Section, entitled "Prohibition on Licensed Gaming Facilities." Bill No. 070012, an ordinance 19 amending Chapter 14-400 of The Philadelphia Code, entitled "Commercial Entertainment District," by providing that no ordinance designating a Commercial Entertainment District may be enacted unless a Neighborhood Improvement District has first been created. 4 3/22/07 - RULES - BILL 070009 Bill No. 070013, an ordinance 3 amending Section 14-1605 of The Philadelphia Code, entitled "Regulated Uses," by prohibiting regulated uses within 1,000 feet of any Commercial Entertainment District and adding "Payday Lenders" as a regulated use, all under certain terms and conditions.

Thank you. The City Solicitor circulated a letter regarding Bill No. 070009 on March the 14th, 2007 to all Councilmembers. I have been asked by the City Solicitor to make that letter a part of the record, so I am giving a copy of it to the stenographer so a copy could be made for the record. Do we have anyone to testify on the bills that were just read? (No response.)

Seeing no one here, I would suggest then that we go into a public meeting, and the 5 3/22/07 - RULES - BILL 070009 Chair recognizes Councilman Kenney regarding Bill No. 070009.

Thank you, Madam President. I move that Bill No. 6 070009 be reported out of this Committee with a favorable recommendation and a request made for rules suspension to allow first reading at our next Council session. (Duly seconded.)

Apparently the ayes have it and the 6 3/22/07 - RULES - BILL 070009 motion passes. The Chair recognizes Councilman Kenney regarding Bill No. 070013.

Madam President, there's an amendment to this bill. I would move that the amendment to Bill No. 070013 as circulated by the sponsor be approved.

Thank you, Madam President. I move that Bill No. 7 3/22/07 - RULES - BILL 070009 070013 as amended be reported out of this Committee favorably and a request made for rules suspension to allow for first reading at our next session. (Duly seconded.)

It is moved and seconded that Bill No. 070013 be reported out of Committee with a favorable recommendation as amended and that the rules of Council be suspended so as to permit first reading at our next Council session. All in favor will say aye. (Aye.)
