Do you swear or affirm to tell the truth, the whole truth, and nothing but the truth?
So, counsel, I believe he's going to request a continuous, so I'm going to let him go first.
So why don't you tell us where you stand with this case?
Thank you, Chair. We are lucky enough to be working with Meredith Berleger and her client, Nidal Hassan, for 6100 WSIC and Avenue, and we're very, very happy that we've made an enormous amount of progress.
We had a community meeting on April 20th, where we met with the developers team and our community was a zoom community meeting.
And then after the community meeting on a separate time, we had an online vote for a few days with our community.
and uh the community voted including the near neighbors and the uh rco zoning board and the
issues of importance that we identified were the storm water issues a very very important issue
the building height no higher than three stories above grade sight lines and aesthetics and we
We put this in a note to the developers group, and the applicant did address the majority
of our concerns.
We're very happy that there was a beneficial relationship with us and the developers team,
and we're able to move forward on these issues, particularly the stormwater issue, which was
particularly of concern to the friends of the Wissahickon.
However, the applicant would not reduce the height to three stories above grade.
The Bluebell Hill Civic Association requested the applicant
get a continuance so the community could be notified of the height change above three stories
above grade and then the community would be able to vote on that so that we could hopefully
come to a mutual agreement. The applicant denied our continuance, so as a result of that, the Blue
Bell Hill Civic Association, the RCO, requests continuance as a result of that opposition.
And we hope understanding can be achieved, particularly we think we can achieve understanding
with the applicant if there's time for us to discuss this matter. All right, so why don't we
let the attorney head. Meredith, could you please comment? Sure. Mr. Chairman, we wholeheartedly
I swore you in, right, Meredith? Yeah, you swore me in. We wholeheartedly agree with the
representations made in terms of the developer seeking to work with the community to the best
of his ability. But just in terms of the timing here, this matter was already continued once.
It was originally scheduled for a hearing in February.
Prior to even that date, already two meetings had been held with this particular RCO group.
The developer had agreed in February to a continuance to facilitate a third meeting,
which was held and which did result in many of the changes that Mr. Ozer represented to the board today.
But unfortunately, at this point in time, as the board will see this afternoon,
No further changes can be made, and we believe that the board will understand why that is the case
when you hopefully hear the case later this afternoon.
So at this point, we do not believe that a further continuance would be fruitful
other than to facilitate another vote in the matter.
It would not be any form of substance, at least in terms of any modifications being made.
So we believe that the community's position can be made clear on the record.
It was made clear in the email that was sent to the board outlining the changes that were made.
And we would ask for the matter to continue.
So we're going to hear the case today, and we'll take your consideration.
If you want to stay, please stay.
And we'll give you another opportunity to give us what you said and anything different.
Okay, but try not to make it long because we've got a lot of cases here.
we have uh support for the request for continuance also is from the 21st war
21st Ward Democrats, neighboring RCO, as well.
democrats sure bring rco as well a very interesting
A very interesting one is from Zhang Zha, which is a neighboring child care center, literally adjacent to the property.
And they have asked, including in one of our public meetings, that the developer reach out to them.
Why don't we do this?
You can raise that at the hearing.
Perfect.
The hearing should be, I guess, about 45 minutes, maybe?
I think the hearing will be about 45 minutes.
Thank you.
You looked forward to the opportunity to discuss this morning.
I'll see you in 45 minutes.
Thank you very much.

the whole truth, nothing but the truth? Yes. Eric, could you please turn on your video? Yes.
yes all right could you please turn on your video yes
there you go our vice chair has a few questions for you sir good afternoon um have you submitted
your documents and exhibits five days in advance of this hearing yes okay and um do you waive the
reading of the refusals and stipulate to their accuracy yes okay all right thank you you can
your screen and proceed with the case the application of this is for the direction of a
rear detached accessory garage which is not allowed okay um but there would there was a
there was one there was a there was a detached accessory garage when i bought the property right
just making
yeah I got it
yeah I'm just making one more
usable for me
and to utilize my driveway
okay so why don't you
start your presentation tell us what you want
to do and then we have
all your documents so what I would recommend
you do is just show us photos
and if you have drawings of what you're doing
okay so it's just
a variance for the
maximum setback
yeah we kind of yep yeah that's that's it and um let me see so what what can i share with you
to begin well i think if you have if you have drawings of it or photos we have all your photos
i mean all your documents okay so do you have pictures of what you're doing yes um let me get
into it. Sure, take your time.
um so that's you posted your property yeah that's the posting and um just just to show
you the like the entrance of the driveway with the vehicle in there um next i can get
that's the driveway yeah that's the driveway yes
um that's the picture there of the structure so you were you were building this and they stopped
you yes yes right okay so what just just very quick why don't you tell us what you were doing
there um just building um a garage for my cars i have two older like classic cars they're small
volkswagons um and just you know a place where i could put them away from the street so i don't
take up any parking and just utilize my garage um so i don't interrupt any second floor to that
no no no second floor just one once uh it's you know just one one story garage ground level
um there's no water there's no plumbing show it shows a photo of that again
yeah okay it's just um it's just like a like a like an a-frame
Okay. Do you have any other photos?
Do you have an architect do drawing for you for this?
Oh, yes. Yes.
I see. Why don't you show us the drawings?
Top file says plenty there it goes yeah to the behind to the side the driveways there
okay questions from the board let me ask you this does anyone else on the block have this
Questions from the board. Let me ask you this. Does anyone else on the block have this?
No, I'm the only one with a driveway that pertains to the property.
Across the street, there is a driveway that is like a common driveway, common used driveway for all the residents on that side of the block.
You have this driveway, and at the end of it, you put up a garage to try to put the cars in.
yes okay questions from the board so the the garage goes uh up against the back the rear
property line was it a space after the garage they're all they're um so they're all the rear
um yards of everyone else's uh properties um they don't have any structures um there is a
there's a Ford dealership that is right behind my property as well and they you
know they have like a full building back there takes up half of that other side
of the block which is on Frankfurt Avenue is a dumpy Ford dealership and I
think that's it though there's so there's nothing else behind you like
there's no other residents or whatever on the other side or behind that you know
because of my side of the street is kind of like an awkward because um there's
only three houses on my side and they are in a church so mines faces the the
yacht the the yards that run parallel from the opposite blocks I don't know if
could like generate an idea of what that looks like um but yeah only the yards
have you talked to your adjacent property owners as well as
whoever owns the property that backs up to your um your property line yeah i did i spoke to some
of them um to be honest with you most of them are uh rentals so they don't they don't have
any problem with it because they don't own the property or anything like that and then the people
