i told told miss cummings and obviously we have no issue for co because that's a requirement as
you saw from the last presentation i did on 13th street so what's the hit there's something about
that building you remember and i can't remember what it is what was the history of it i don't
know um i think it was a doctor's office that's the only thing i i saw of public record it's a
beautiful building very unique um and we're looking forward to like you know revitalizing it
not out of character and by the way we're an r1 property too so multi-family it's not out of
character and then you know just the two refusals the one for parking we're not going to knock down
a stone uh fence we even if we wanted to the historic commission wouldn't let us so that's
one refusal gone and we we wouldn't we don't want to knock down we it doesn't make sense because
the two parking spots would be a zero sum for the neighborhood. We take two parking spots off of the
street and put it just for our own benefit. It makes no sense. Then in terms of the unit count,
not out of character to have properties, have six units. 1828 Diamond Street, six units. 1827 Diamond
Street, six units. 1829 Diamond Street, six units. Aerial view, you can see here we are, 19th and
diamond zoning map you know again i don't think we question where we are in terms of density in
terms of r1 rm1 zoning here we are in the neighborhood as well uh photographs of the
property just very unique uh you know we're obviously going to have to put all new windows in
uh you know deal with the facade and cleaning it up uh you can see here that they've noticed uh
posters uh you know there's a discussion here about whether we're going to preserve this
lettering of course we are i mean obviously because you know but it just has a great look to
it uh diamond street to the right diamond street to the left north 19th street to the right north
19th street to the left interior photos so my client bought it hasn't touched it you know wants
to you know you know obviously hopefully get their approval and then start doing work but here's
existing interior photos and then our plans and drawing. So first things first,
you can see there's independent steps for the lower level and it will have a
trash room down here somewhere else. But none of the units can, the first four
units, there's no buy levels. So let me just make sure I get my notes here. So
So you basically look at this, you know, you make it go into the common area, a common entryway, you make a left, that's unit 1B, that's a two bedroom, one bath.
So here's a living room, kitchen, two bedrooms, you know, washer and dryer.
You make a right, you have a two bedroom, one bath as well.
You have a living room, kitchen, bedroom, bedroom, bathroom.
and you go to the second floor up here
and you go to the second floor, up here, let's see, you have, trying to see here, you have 2B,
which is a one-bedroom, one-bath, so here's the open floor plan, and then a bedroom,
and then you go to the right which is uh two a which is a two bedroom one bath so living room
two bedrooms and a bath and then you go to the third floor and you have to the left you have a
two bedroom one bath you have a you have a living room in the kitchen two bedrooms and then a bath
right there and then a very unique part of the house or the property is you go to the right
and that's actually a four bedroom two bath and existing right uh well we'll we'll ask you when
you get sworn in but you have a oops let me just do this trying to get to the uh worth one where is
So, you have a living room, two bedrooms on this level, and a bath, and then you go to the interior by-level, and you have two more bedrooms, and actually a family room, and another bath.
So, we met with Strawberry Mansion Community Concern September 11th, and then here's our proof of mailing for the community meeting.
our application for appeal notice of refusal project information form deed to the property
showing that we own the property 1835 w diamond llc and then finally which we added just this
afternoon we're part of a payment plan so we do owe some taxes but we're part of a payment plan
with that being said i would ask that mr payden uh be sworn in mr michael
yes hi sir could you please state your name is spelled for the stenographer nicholas payden
n-i-c-h-o-l-a-s-p-a-d-e-n right do you swear or affirm to tell the truth the whole truth nothing
but the truth yes i do please proceed counsel oh yeah nick you heard everything i had to state
today about your zoning matter yes is it true and correct yes and do you adopt this your own
testimony thank you questions from the board just oh no i just had a question about what's going on
with the back the rear yard it's open to i think the rear units on the first floor it's not a
common entry okay yeah and and no trash is be restored just for that unit this trash will be
stored in the low in in the basement it has everyone has access to it okay thank you that
was brought up by miss cummings and we stated i stated to her i would state to you that's where
restore the trash yeah but biggest concern i have is for the two bedrooms that are on the right the
second floor and third floor if you go back to the plans there's barely living space dining area for
those two bedroom units um so i'm concerned about i understand that you're reasoning for six bedrooms
six units but my concern is really livability of those those particular units because the
The two rooms that are sort of on the left
are decent, have decent-sized living rooms,
dining area, you know,
for folks that would be living there,
but the ones that are on the right
are just very tight.
They probably work better as one-bedroom units.
Yeah, let me try to get to it.
I'm having some technical difficulties here.
So notwithstanding the fact that,
You know, it's commendable that the developer wants to keep the building and its historic character.
I think that's that's great. So those the units, if you look at the one that's on the right.
With the tarot, there's very little with all the with all of the doors going into that space.
it's kind of difficult for a family of two to to kind of live there as opposed to the the unit
that's on the right on the left rather um a fairly decent sized living area
same thing with the unit above yeah the only thing i would say is yes it's it's a more micro
type of unit um but you know what we would see is that probably it would be a person who would
live you know have it would be one person and and it's you know would have a secondary
room as an office um but you can guarantee that though no you can't guarantee it but
No, you can't guarantee it, but the consumer chooses, right, ultimately?
but you know the the consumer chooses right
Well, the developer chooses, Alan.
Well, the consumer chooses what to buy and what not to buy.
Yeah, but you're calling it a bedroom.
If the intent is for it to be a den, then call it a den, but it's a bedroom.
My concern is that the overall sort of living space is inadequate, in my opinion.
i i can tell you that some people want to take care of things like a lot of space and some people
don't so i think well one of the things and there's always been a criticism right is that
when you don't show furniture and you don't show furnishings right it's kind of difficult for you
to or us to to really determine well not me necessarily but a lot of folks to determine
how that space really works. If you look at the size of the living
dining room for this one bedroom that's on the left
is completely different than the size that you have for this two bed room
on the right.
I'm sorry. I didn't mean to interrupt.
Right. You see this unit and then you see this unit.
You see the living room. You see this living room.
comparable to one is a two-bedroom
and one is a one-bedroom, right?
That's my concern.
So my concern is that not necessarily the six units.
My concern is maybe the layout.
So that's sort of my biggest issue.
So, Mr. Payton, do you have any issue
of putting that as a one-bedroom instead of a two-bedroom?
Not at all.
one of the issues we had was because it's historical we had to work within the window
spaces and i think that's why it's a little crammed because the windows didn't exactly line up
and we aren't able to move them because of the historic factor but we have no issue making it
a den or one bedroom all the questions can we talk about this walden stairwell at the rear
what's what's going on which this one right here yes uh can you explain what's going on with that
staircase that i'm not sure the prior use i believe it was a doctor's office but it's a
staircase that goes from the first floor to the third floor but with no exterior access
yeah so what are you just gonna wall it off just gonna close it off yeah
so um that's that's odd it seems like a missed opportunity i don't know it is but unfortunately
even for like access to each other floor it's i mean even if you did it as a light well or i mean
trash you lay well there's there's but that and then obviously you know you're gonna have to go
through a co process uh at this point how much of this property has already been subdivided into
these units and how much is work that's still left to do there's nothing that's been done yet
nothing's been done yet cleaning out the yeah the pictures show that but i guess the subdivision
What's the condition of the property?
If I was walking through that property,
how many units would you say are in there?
Or is it just one big?
It's just one big space.
One big house.
And then generally,
what is your floor-to-ceiling heights on each floor?
They're very large ceilings, I believe, 14 feet.
On each?
All the way up?
All the way up.
You know you're going to have to do sprinklers.
Yes, I do.
All right.
Oh, that he knows.
He's already counted that in.
Any other questions?
Questions from our attorney?
Brian McShury.
No, Chair.
Questions or comments from the virtual audience?
I see no hands, Chair.
Planning Commission.
Amy Boyd with the Planning Commission.
The comprehensive plan recommends no change to the existing residential multifamily zoning at this location, RM1.
the appellant has demonstrated the historic designation and the existing physical configuration
of the property create unique circumstances that would require relief from zoning board
i'm sorry from the zoning code for lack of parking the requested number of units is not the least
minimum however a fifth unit would be a diminished deviation from the required lot area the planning
commission recommends that the board grant the requested variance for required parking
and grant the requested variance for multifamily unit count with proviso max six sorry max five
units and you erased them for six and yes and given you know the condition of the property
we do need it to be six that's you know and and it's not out of character as you saw i think it
was 1827 29 and there was one other property i think 26 or you know that all are six units on
that barge. So MI 2025 001 580 1835 Diamond Street, I vote yes.
