I note that the bills just reported from committee with suspension of rules have been deemed to have had a first reading. These bills will be placed on the Second Reading and Final Passage Calendar for the next session of Council. Mr. Decker, will you please read any other bills on the First Reading Calendar.

Thank you, Councilman. Before considering these resolutions and bills, we will consider public comment with the rules as follows: Your public comment must concern matters on the Second Reading and Final Passage Calendar for possible action at today's Council. All speakers must sign up in order to testify. If you have not already signed up for today's session, please do so by giving your name to the Sergeant-of-Arms at the table to my left. You will be called in the order in which your name appears on the sign-up sheet, and you will have three minutes to speak. In order to be fair to all wishing to speak, we will hold faithfully Stated Meeting November 15, 2018 to the three-minute limit. When you begin speaking, you will see a green light on the podium. When there are 30 seconds remaining to your time, the light will turn yellow, which is your reminder to conclude your remarks. Once those three minutes have passed, we ask that you yield the podium to the next speaker, if you have not already done so. I would ask Mr. Decker to please read the name of our first speaker.
Joe Danihel, commenting on 180351-A. (Witness approached podium.)
Good afternoon. This is an official degree of the people in writ of mandamus quo warranto and, as such, requires immediate action and remedy. Every week, this Council, Mayor, Governor, and others transfer private property to the government, Stated Meeting November 15, 2018 probably illegally. As we celebrate veterans, let us not forget in 1775 in this very cradle of liberty, the Army was formed. The people had enough of the abuse of government. The people realized that their God-given rights were being violated. The people's property was being stolen and unfair taxes were being levied, resulting in the Declaration of Independence. In honor of these first veterans, the people must rededicate ourselves to prosecute any in government that violate oath, Constitution, and law. Veterans give their last measure to keep the people free and protect the people against all threats, foreign and domestic. Would veterans volunteer to serve overseas knowing their government was stealing their neighbor's home? Justice Brandeis predicted crime is contagious. If the government Stated Meeting November 15, 2018 becomes the lawbreaker, it breeds contempt for the law. It invites every man to be a law unto himself. It invites anarchy. The constitutions require immediate remedy of this breach of law, breach of close, breach of fiduciary duty. Your oath of office requires you to act or face prison. 42 USC 1982, 1983, 1985, 1986, 1987, 18 USC 241, 242, 2381, 2384, PA Constitution, Article I, Sections 1 through 28, 26 PA CSA 703, 705, 708, 709, 711, 712, 713, 716, 902, and other laws listed in SCOTUS 15-8965, 14-1330, 14-4056 appear violated. I call on the federal and Commonwealth governments to perform their constitutional obligations to investigate and prosecute all involved in the theft and illegal deed transfer of my home, 1038 West Wyoming Avenue. The denial of God-given 42 USC 1982 property rights for 24 years is Stated Meeting November 15, 2018 egregious, extraordinary, oath-violating, and requires immediate remedy. A just government must obey the rule of law. This color of law government must have its Charter to govern revoked until a constitutionally compliant government is installed. Public servants cannot refuse their sworn duty to act any more than a fireman can refuse to fight a fire. The sovereign people require oath, law, and constitutions be enforced, and jail is required for all who violate oath, Constitution or law. I remind Council, it takes a lot of cooperation to create and allow monumental corruption. (Applause.)
Mr. Decker, before you read the next speaker, the Chair recognizes Councilwoman Quinones-Sanchez.
Thank you, Mr. Chair. I want to be recorded as Stated Meeting November 15, 2018 voting aye on all bills and resolutions, as I have outside Council business and must leave.
Okay. Thank you, Councilwoman. Leave is granted, and you will be recorded accordingly. Mr. Decker, any other speakers?
Hello. My name is Joe Cox. 170854, unfair rental practices, to require good cause for certain residential evictions. I'm curious and concerned as to when this is going to be talked about. It's been on the docket for months. People are being evicted every day. We have made bills out of the blue a few weeks ago. Today there are people in Kensington who are being evicted from a bridge in the snow. I just am concerned and Stated Meeting November 15, 2018 confused. When are we going to talk about this very important issue? That's all. (Applause.)
Emmanuel Bussie, commenting on 170408. (Witness approached podium.)
No? Okay. Thank you. Good afternoon, Council and colleagues. I stand here -- my name is Emmanuel Bussie speaking for the record. I'm a Different Kind of Democrat. I speak for 61 community activists and community leaders throughout the City. I'm in support of the bill to Stated Meeting November 15, 2018 not suspend first through fifth graders. What I want to share with Council is, I come here every week to not bash Council, not criticize Council, not condemn Council, but to encourage Council. If you check the record, 99 percent of the time I'm encouraging of Council, except for Bobby Henon and Bill Green, but your budget is a reflection of your priority. I know you guys heard that a million times. We rely on you, our elected Councilpeople, to be our voice. We really don't expect Bobby Henon to be the voice of brown people. We really don't expect Al Taubenberger to be the voice of brown people and black people. We don't expect it, but we do expect in North Philadelphia for Curtis Jones to be a strong voice for black and brown people. In North Philadelphia, in West Philadelphia, we expect Kenyatta Johnson to be a strong voice for black and brown people. We are going to, as Councilman Stated Meeting November 15, 2018 Jones alluded to, we're going to look to you guys to be, no matter what bills or laws get passed through the state or fed, we're going to look to you guys to be your champions and our voice in Council for bills and resolutions and provide an opportunity for black and brown people. If you take, for example, the critical issues in our city, right? Housing, jobs, and public safety. Every day that I come here and you guys don't address one of those three, to me you're kind of not doing what we expect you to do. Who addresses the critical issues in our city, if not you? If not you, who? Right? You take the homicide rate in 2017, it topped 2013, '14, '15, '16. And at 292, the homicide rate right now in '18 will top that deadly year. Who addresses that? You have the ability, Council, to solve the critical issues in our city. All you got to do is make up your mind, Stated Meeting November 15, 2018 right? All you got to do is decide that I can as a body solve the critical systemic issues that face our city. You can do this, right? It just takes you changing your mind to do it. You can change this city by just changing your mind and changing your attitude about doing it. If you say yes, I'm doing that, then how? How? You take the $20 million that's allocated for housing. Just take that for example. 20 million a year, hundred million dollars over the next five years. That's less than a half of a penny of every dollar spent on our budget. So how can you say to me that that's addressing the critical issue when you only allocated a half of a penny to address it? If you got a problem in your house, you're not going to address a half a penny of every dollar you spend to address it. This is what we call -- this is what we would like for you to do, to Stated Meeting November 15, 2018 actually put your money where your mouth is. It's not a criticism. Put your money where your mouth is. The budget is being contemplated right now, the Mayor's budget. We ask you, our body, to protect us and make sure that that budget is reflective of the priorities of the people that you represent. We depend on you. We rely on you. We count on you. Thank you.
Hagins Ogbonna. (No response.) SERGEANT-OF-ARMS: He had to leave.

Thank you very much, Mr. Decker. Any speeches on behalf of the minority? The Chair recognizes Councilman Oh.
Thank you very much, Council President. I want to again thank our Council body for taking on critical issues. We passed a resolution urging the State Legislature to amend the Post-Conviction Relief Act so that when new evidence is discovered after 60 days or after a year, thanks to State Senator Stewart Greenleaf, that the evidence can be reviewed by a court of law. Stated Meeting November 15, 2018 Riddick, who has spent 26 and a half years in jail, the evidence that became known over the course of these 26 years will not be considered by a court of law, will not be looked at by a judge, and the court itself has criticized the PCRA. That left us with the only option of filing a petition for a pardon from the Board of Pardons and the Governor of Pennsylvania. I've included on everyone's desk a copy of that petition with the evidence. I am urging the Governor and the Board of Pardons to consider the evidence, let the evidence speak for itself. And I am happy to report that I had a very productive conversation with Lieutenant Governor Michael Stack, who will bring this before the Pardons Board, and we shall see what happens. The problem is, it takes between two and three years for a petition to even be looked at by the Board of Pardons. And when asked that Stated Meeting November 15, 2018 expedited, the response has been they are not able to expedite because they have to take it in the order filed. They don't have enough manpower to look at these petitions in a timely fashion. What I have tried to present is, pardons are for people who are guilty. They're guilty and they're asking for a pardon. They are not supposed to be innocent people in prison and, therefore, there is no avenue for evidence of innocence to be considered outside of this pardon process or a filing of a federal habeas corpus. So with that, the pardon process, we are urging that the Pardon Board look at the evidence. If they find that the evidence indicates that the person petitioning is not guilty, to expedite that so that person is released from prison. Thank you.
Thank you, Councilman. Stated Meeting November 15, 2018 the majority? The Chair recognizes Councilwoman Reynolds Brown.
Thank you, Mr. President. I want to simply say thank you to the members of this body for supporting the resolution honoring the election of Shirley Chisholm as our country's first African American female Congresswoman. With last week's historic midterm elections, it is imperative to look back at all of the sisters whose shoulders we stand upon, because clearly there was a seismic shift on November 6th. For the first time, women are going to be more than represented in our United States Congress. In fact, 101 women were elected to serve in Congress for the first time ever. More than a dozen states will add women to their House delegations, including the Commonwealth of Pennsylvania, which used Stated Meeting November 15, 2018 of a D plus when it comes to women being elected to Congress. Now we have four, having moved from the point of zero. Councilman Jones, you're well aware that Ilhan Omar and Rashida Tlaib are the first two Muslim women going to Congress, and Deb Haaland and Sharice Davids will be the first two Native American Congresswomen going to Congress. Councilwoman Sanchez, if she were here, would be delighted to know that Veronica Escobar and Sylvia Garcia will be the first two Hispanic Congresswomen going there from Texas. And then we have Alexandria Ocasio-Cortez, who will be the youngest woman elected to Congress at the tender age of 29. Ayanna Pressley will be the first black Congresswoman from Massachusetts. She's fabulous. Johana Hayes will be the first black woman from Connecticut. We now have 35 women headed to the freshmen class of Congress. Stated Meeting November 15, 2018 8:00 a.m., my daughter called me from a conference in New York City asking me a variety of questions about the election. She said, So what happened in Florida? And what really happened in Georgia? Does she get a recount? And what about Texas? My reply today is different than it was last Wednesday when I thought we'd lost all three states to conservative politicians with hateful agendas. Today my reply is that we lost Texas. We were optimistic. But the fight continues in Florida and Georgia. We went from blood red states possibly to purple states. Today we're not accepting any more underhanded attempts to suppress voters. Voters showed up and showed out. Today we have a reason for optimism, because the balance of power is back in play. And so in closing, we need to say a huge thank you to those across the Commonwealth who showed up, particularly Stated Meeting November 15, 2018 we had a 51 percent gubernatorial General Election turnout, the highest it has been since 1994, where we only beat -- where we beat that by one percentage point. A huge thank you to Philadelphia voters, Mr. President.
Thank you, Councilwoman. The Chair recognizes Councilwoman Blackwell.
Thank you, Mr. President. I certainly agree with all that Councilwoman Blondell Reynolds Brown has said. I'd also like to note that Councilman Oh has done an excellent job in fighting for this young man, Eric Riddick. I remember when he was born. And I commend him for that and as well as Maria for talking about Joanna McClinton. As you all know, she's also a preacher and a lawyer. So she comes well qualified. Her mother is a preacher too Stated Meeting November 15, 2018 the task that she has undertaken, and we congratulate her for moving up already as she is in the State House. I also want to note that we put envelopes on each desk for NACA, Neighborhood Assistance Corporation of America, NACA, and we gave you this information because it reminds me, Mr. President, of a trip we took with you to talk about help for homeowners, and this is information -- and we have more if you need it -- that will allow people to get mortgage pre-approvals. Those with low credit scores and low income can get information. And from November 29th to December 2nd, it's right in our area. And we are just honored that we have a chance to at the Convention Center give out information for our citizens to help them become homeowners. So please pass out the information. Let me know if you need more, and thank you. Stated Meeting November 15, 2018
Thank you, Councilwoman. The Chair recognizes Councilman Green.
Thank you, Council President. I just have a few comments. Last year myself as the Chair of the Council Committee on Disabilities and my colleague Councilman Al Taubenberger participated in the Special Olympics polar plunge. That is coming up again this year on November 30th at Drexel University at 1 o'clock. I will be plunging once again. I hope other colleagues will join me in the polar plunge for the great cause. Last year we had the Philly's GM, Gabe Kapler. This year the new Sixers GM, Elton Brand, will be there, so hopefully you'll be able to participate in the polar plunge. Two, I want to thank my colleague Councilwoman Blondell Reynolds Brown for her resolution today acknowledging that today, Thursday, Stated Meeting November 15, 2018 15th is America Recycles Day. We've had briefings in this body talking about some of the challenges in reference to plastic and the issue with China and recycling. We have a major issue in the City of Philadelphia currently with our current recycling contract, and that could have a major impact in our budget process going to next year. I just want to remind those who are listening that as you recycle, make sure your products are empty, clean, and dry. Also I want to say to my colleague Councilman Curtis Jones, I will not be able to participate in two weeks in the annual MenzFit activity. Although the one last year, someone shut off the recount process, so we'll leave that at that. And then, finally, in reference to Councilwoman Maria Quinones-Sanchez and her acknowledgment of Joanna McClinton's elevation to a new position Stated Meeting November 15, 2018 of the PA House of Representatives, we had a number of local elected officials who have done well, State Representative Jordan Harris, State Representative Jason Dawkins. State Representative Stephen Kinsey is now the head of the Legislative Black Caucus. And so we've seen the next generation of leadership really elevate within our State House into leadership positions. Then, finally, and I was glad that Councilwoman Brown brought up the number of achievements that happened at the federal level. So with that, I will close and quote Marcel Theo Hall, who is a noted urban lyricist and American philosopher. Reagan is the President, but I voted for Shirley Chisholm.
Okay. Thank you, Councilman. The Chair recognizes -Councilman, real quick. I'm sorry. On the polar plunge, do you have to put like Stated Meeting November 15, 2018 there or can you like just do your leg?
You can't do a pinky toe. Some of our uniform officers, both police and fire, have jumped all in, with uniforms. So I won't be jumping in a suit like Mark Squilla, but I'll be jumping in.
Thank you, Councilman. The Chair recognizes Councilwoman Bass.
Thank you, Mr. President. I just wanted to remind everyone, Councilmembers and staff, that up in Room 576 after session today we are going to have a briefing from Philabundance and the Share Food Program. A few moments earlier Councilwoman Blondell Reynolds Brown talked about the importance of voting, the importance of elections, and elections have consequences, and as a result of our current President's decisions on trade Stated Meeting November 15, 2018 tariffs, we have an abundance of food, a surplus of food here in the United States, and we are particularly concerned about how it's going to be distributed to those who are in need here in the City of Philadelphia. So I think that this is a briefing that we all need to attend, if possible, and we want to make sure that we'll be able to get the information on what is going to be happening with the U.S. Department of Agriculture in the next month. This is going to be a very big job for our food banks, and they've never seen such an influx of food like this before. There's going to be issues around storing, transporting, and distributing all of these provisions, and it's going to come with some challenges. So we're going to hear about their plans for taking this on and so that so many people can take advantage of this surplus. Stated Meeting November 15, 2018 So, again, we really want to have Councilmembers and staff attend this briefing. It's in Room 576. Originally we were scheduled to be in the Caucus Room, but we've had a minor change, and we certainly hope folks can come and get this very, very, very important information.
Thank you, Council President. I just want to take this opportunity to thank my colleagues and you, Council President, in your support of the amendment to the fiscal impact statement, including job growth and job loss. The fiscal future of the City is one of our most important challenges, and as a Council body, we're often tasked Stated Meeting November 15, 2018 certainly important financial decisions on behalf of the City, and I think this information will help us make those decisions. I also wanted to mention that this week we all heard about the news that Amazon selected Arlington, Virginia and Queens, New York. I want to take this moment, though, to thank everyone who worked on this proposal. It was tremendous cooperation from the Administration, Commerce Department, business community, PIDC, the chambers, Select Philadelphia, many other organizations, including many universities, and I think we saw a tremendous collaborative effort, which was great for the City. So thank you to all of them. The information that was collected, though, must be used to help our city grow its taxpaying base, because keep in mind, of the 20 largest companies in Philadelphia, only four pay all taxes. Stated Meeting November 15, 2018 last ten years actually, Philadelphia has had the third slowest job growth rate of the top 20 major U.S. cities, and there are two major taxes that hinder this growth - the income portion of the BIRT tax, called the net income, and the City wage tax. Companies do not move into the City because of these two taxes. They don't want to pay the net income portion of the BIRT and they don't want to have to give their employees a 3.7 or 3.8 percent increase on the wage tax. That's the main reason why they don't move in. It's also a burden on those that are here to expand. So if we're serious about not being the third slowest job growth city out of the top 20, we need to take steps going forward to address both of these taxes. Thank you. Thank you, Mr. President.
Stated Meeting November 15, 2018 you, Councilman. The Chair recognizes Councilman Johnson.
Thank you, Council President. On Tuesday, November the 20th, we will be hosting the Lincoln Square Pop-Up and Job Fair. This is a development project that I worked on at Broad and Washington in my district, and the companies that will be hiring are PetSmart, Chipotle, Target, and Sprouts Market. We will be doing on-the-spot hiring, and positions will be extended to qualified candidates. That's going to take place, again, on Tuesday, November the 20th at the Dixon House located at 1920 South 20th Street, from 11:00 a.m. to 2:00 p.m. We encourage all attendees to come with a can-do attitude and dress for success. And I also want to just wish all of my colleagues a Happy Thanksgiving.
All right. Thank you. Thank you, Stated Meeting November 15, 2018 Councilman Jones.
Thank you, Mr. President. I just wanted to express for the record my deep sadness about the fact that Councilman Green will not be able to go to Who Wore It Best this year. I so look forward to seeing his innovative and creative ways for a very good cause of redressing people that are returning citizens, homeless people that are going to job interviews. So I will gladly hold the title for you for another year in anticipation of you coming back. I also am going to join you in the polar plunge. I'm not going to just dunk my pinky toe. I'm going all in. Also, I just wanted to let my colleagues know the United Block Captains Association is having their senior event in Councilwoman Blackwell's district over at Spectrum Health Center, and it is a worthwhile cause to attend. They even Stated Meeting November 15, 2018 song, which I will not attempt to sing today, but we thank them for every year doing something worthwhile. Ms. Alice Wright is the President of it and really, really is the glue of a lot of neighborhoods because of those blocks, and I wanted to thank her for the record for continuing that effort. And why don't we join in recognizing her here today. (Applause.)
Thank you, Councilman. And with that, the Chair recognizes Councilwoman Reynolds Brown for a motion to adjourn.
Thank you, Mr. President. I move that Council stand adjourned until Thursday, November 29, 2018 at 10:00 a.m. Stated Meeting November 15, 2018 (Duly seconded.)
Thank you. It's been moved and properly seconded that Council stand adjourned until Thursday, November 29, 2018, 10:00 a.m. All those in favor say aye. (Aye.)
