Aye. The ayes are 16; the nays are zero. A majority of members present voting in the affirmative, the bill passes. That concludes our Calendar for today. Are there any speeches on behalf of the minority? The Chair recognizes Councilman Oh.

Councilman Oh

Thank you very much, Council President. I just wanted to state that yesterday was the 75th Anniversary of the attack on Pearl Harbor, and we have a survivor right now overseas in Hawaii, and I would ask this Stated Meeting December 8, 2016 have a standing moment of silence.

Council President Clarke

Thank you. (All Councilmembers standing.) (Moment of silence.)

Council President Clarke

Thank you, Councilman.

Councilman Oh

Thank you very much. On kind of a lighter note, I would like to just say that today, this evening at the Trocadero at 10th and Arch is the award show for PHL LIVE 2016. I've put on each Councilmember's desk two tickets if anybody would like to attend as well as a lanyard all-access pass if any Councilmember would like to attend. And, finally, a CD, which is our compilation, which is one of the prizes we give to the winners. So a number of the artists -- this is original music from Philadelphia-based musicians. And I appreciate all the support that this body Stated Meeting December 8, 2016 for our creative economy. Thank you.

Council President Clarke

Thank you, Councilman, and thank you for your continued good work. Speeches on behalf of the majority? The Chair recognizes Councilman Henon.

Councilman Henon

Thank you, Council President. Before I begin, I want to thank you for your leadership, not just with the best value legislation, dealing with all its members, members in the majority and in its entire body, but dealing with the Administration but all throughout the year of 2016. So I want to thank you for that. And when it comes to today's procurement legislation, I just wanted to clarify a few things that has maybe caused a little confusion. First, best value is a Stated Meeting December 8, 2016 in many other cities across the country. It is a best practice, and while it's new to the City of Philadelphia, it's not a new idea. Of the 20 largest cities in America, there are only two that are not best value, one being Philadelphia and Indianapolis. Best value is a modernization procurement practice that will allow the City to include other criteria beyond the cost alone to determine how the bids are selected. That criteria, which has not been finalized by the Mayor's Office or by the Procurement team, will include things like past performance, some other financial disclosures, whether a bidder is MBE, WBE or DSBE certified, and financial strength, like I said, and scheduling and more. So they are weighted measures that help ensure that we are getting the actual best value, and that this body is working closely with the Administration to determine and have Stated Meeting December 8, 2016 criteria, because it's something that we've been speaking about all year long and over the last several years. And it gives the City much flexibility that it needed and it does need for complex contracts. I think it's important to note that the best value will be just another tool in its belt. Initially best value will only be used for about 5 percent of the procurement projects and that the lowest bidder, lowest responsible bidder, will be used when appropriate and when necessary. Best value will also open up procurement projects to smaller vendors, it's important to say, who haven't had a chance to bid or haven't felt comfortable to bid on City contracts. I'm talking about vendors who couldn't compete with bigger businesses, who can do the job for cheaper, though not necessarily better. There's a whole type and group of businesses and business owners who have opted out of working with the City just Stated Meeting December 8, 2016 the lowest bidder. Best value gives those vendors a chance. It gives them a chance to compete competitively, and it gives the City a better chance to benefit from their knowledge. As far as the loudest criticism of best value, it opens up the door for -- as it pertains to opening up the door for cronyism and pay-to-play politics, I can say the following: The process is open and transparent at every single turn. The criteria is weighted, and it will provide the same time opportunity as it's posted. Bids will be evaluated by a committee that includes department experts and stakeholders. And once the final decision as made by the winning bid is selected, the City will make publicly available the score of that bid. Additionally, when I introduced best value along with co-sponsors, we introduced a companion bill. " It outlines the requirements relating to contracts under best value, including eligibility based on political donations. This isn't the only safety net. In June, I introduced two bills with several other co-sponsors of members in this body, and it creates a vendor registry, and one of those registries requires that the winning RFPs stay live and remain online for five years after it has been awarded, which means it increases the transparency and it helps vendors strengthen its future bids.

Councilman Henon

Over the last year, this Council has put forth several other bills aimed at streamlining and modernizing Philadelphia's procurement process and encouraging businesses to reconsider Stated Meeting December 8, 2016 of Philadelphia. We want you to come and bid with the City of Philadelphia, so we're opening up to do so. From Councilwoman Bass's prompt pay legislation, Councilman Jones's, Councilwoman Reynolds Brown and Sanchez's bill that more clearly defines the requirements to be certified as a local business entity, this body has been fighting to cut the bureaucracy and build a system that ensures taxpayers are getting what they deserve for its tax dollars. So despite some, I'm proud to say that best value is a good policy. So I want to thank you for your leadership. I want to thank the members in having faith in the process that we go through in open, public hearings and to make sure that our Procurement Department and all its related departments are working together with the commitment from the Mayor. And I know that the Mayor is committed to making sure that this is Stated Meeting December 8, 2016 all Philadelphians who never had a chance to compete before. So thank you.

Council President Clarke

Thank you, Councilman. The Chair recognizes Councilman Green.

Councilman Green

Thank you, Council President. I just wanted to thank this body for its leadership. Thank you, Council President, for leading us through this year. I want to thank Councilwoman Parker for her resolution and for the various speakers that came to testify during public comment regarding her resolution and what she is trying to achieve through this resolution. I also want to thank this body for voting and supporting on this best value initiative. There have been those who have said that this legislation does not make sense. However, the prime reason that I decided to support this Stated Meeting December 8, 2016 many of the statements that were made by the people that testified in support of Councilwoman Parker's resolution. We here in the City of Philadelphia -- and I've often said, and I'll say it again -- we need a Maynard moment. When I say "Maynard," I'm referring to late Mayor Maynard Jackson of Atlanta. And so when you look at best value, it gives us an opportunity to provide businesses of color an ability to better compete. If you look at the letter that was circulated by the African American Chamber of Commerce -- and I'll quote part of their letter, which supports best value -- "Frankly, some of the Chamber's members right now feel shut out of the process. Why? Because when cost is the only factor in awarding a bid, it's far too easy for larger firms to underbid, then jack up the final cost to taxpayers through change orders. Minority-owned Stated Meeting December 8, 2016 to jump in the fray. " As Councilman Henon said earlier -- I also congratulate him on his leadership in introducing this legislation -- of the top 20 largest cities in the United States, only Philadelphia and Indianapolis do not support best value. With best value, we will incorporate the cost of the bid. In fact, that's the largest weighted aspect of the criteria for best value, but we'll also look at M/WBE information and also past performance on Economic Opportunity Plans, which is something that this body has viewed very strongly and has fought for making sure EOP plans are included on legislation. Many of us have worked with businesses. I myself talk to minority businesses almost every day, and so often they talk about the issues and concerns Stated Meeting December 8, 2016 working in the City of Philadelphia when they may get included on a bid and then find out through happenstance later when the work has already started that the contractor they were listed as a sub for got the work, but they were never even contacted. But with the current legislation that we have with lowest responsible bidder, we cannot incorporate that information into future contracts, and that's why it's important that best value is something that we look at as a way to include and increase minority companies here in the City of Philadelphia. We've often talked about increasing people of color in the trades, but one of the things we need to do is increase the number of minority union contractors, and the way we can do that is by building capacity, and that's why I believe best value is a way in doing that, because we can get more firms of color, especially firms who are minority Stated Meeting December 8, 2016 firms, involved in the procurement system of the City of Philadelphia. And we too often have these one-off initiatives where we've had a Convention Center expansion and people are involved in that for a period of time, but then that project is ended and things go back to where it is. Or the stadiums, both the Phillies and Eagles situation, where people may be involved in the contracting and then once that project finishes, they don't have an opportunity going forward.

Councilman Green

Or when you look at NTI where we had a number of minority contractors involved in demolition, but once the NTI program ended, we didn't build capacity. We need to build capacity to grow minority contractors, especially minority union contractors, in the City of Philadelphia. The way we'll be able to do that is by doing things like best value so we can have that Maynard moment here in the City of Philadelphia. One other note, and I'll Stated Meeting December 8, 2016 close, and I am thankful for being here. It's hard to believe that we've had one year in this body. I'm thankful for Council President's leadership. I'm thankful for all of our colleagues working together. Sometimes we will agree, but sometimes we will disagree. And I rise because earlier today I introduced a resolution regarding my fraternity. And so I say that because I want to honor someone some of you may not know, Dr. Derek Brown. He joined my fraternity at University of Virginia the year before I did. He was short from New York. I was tall from Philadelphia. He became a doctor. I became a lawyer. But although we were different, we had the bond of Alpha Kappa Psi. I raise this issue because last weekend, Dr. Derek Brown during a 10K passed away through a heart attack. And I say this and I raise it because we're in the holiday season and we need to remember that life is short and that Stated Meeting December 8, 2016 disagreements, some of us supported the President-elect, some of us supported Secretary Clinton, some of us support initiatives in this body and sometimes we disagree, but we all should remember that life is short and that you never know when you may be taken from this life. So I introduced the resolution today in honor not only of the fraternity, but in honor of Dr. Derek Brown, his wife Dr. Chimene Brown, his three children, Maya, Derrick "DJ" Justin, and Trent as he moves on to the chapter invisible. So thank you.

Council President Clarke

Thank you very much, Councilman. The Chair recognizes Councilwoman Parker.

Councilwoman Parker

Thank you, Mr. President. Let me take this opportunity to thank all of my colleagues for their support of Resolution No. Stated Meeting December 8, 2016 161076. And I do mean to put these people on the spot. I want to say a special thanks, Mr. President, to you, to Councilwoman Blackwell, members Gym, Green, Quinones-Sanchez, and Squilla for co-sponsoring the resolution. I want to state that what Councilman Green just described was an effort to institutionalize diversity and inclusion in all that we do here in the City of Philadelphia so that we can ensure that all are sharing and benefiting from the fruits of all of our labor. And when you hear him referencing legislation that has been offered in this body by several members, when you hear him reference the work, the hard work, that was done negotiating deals such as the Convention Center, such as the stadium deals, and wanting to institutionalize the process by which each of those jobs met the requirements that were set forth as it relates to diversity and inclusion, Stated Meeting December 8, 2016 And I will dare say to you, Mr. President, that there is no magic wand and no silver bullet and no one anything that any of us will do that will get that done magically, but based on the history of all of the work that -- the work -- and I want us to make sure that we reference this. Philadelphia has had 24 years of African American mayoral leadership in this city, that we've had a Council that has had a majority of African American members on this Council, and the work that has been started since this issue was moving, all of those people will be a part of whatever success in terms of compromise that is reached. It won't be one person. It won't be one bill. It won't be one resolution. It's all of the work that has been done on an incremental basis to address this very complex issue. I know there was a lot of people here to testify on this resolution Stated Meeting December 8, 2016 today, and I want to say a wholehearted thank you to members of the clergy, the community-based organizations, and all of those who were present. And although it is not a silver bullet, it does, Mr. President, do what all of the work from the people I just referenced, try to provide a framework for future negotiations regarding this matter and ensuring that our voice is heard, and no one can say that they didn't know as it relates to putting together whatever program is going to be offered. So I want to thank you and my colleagues and also say a special thanks to the staff who work here in this building, the maintenance staff, the staff, you know, who sort of keep us all going, and the security guys. I leave my keys and my phone every time I leave out of this building, and they never once say, When are you going to remember to get those keys or have that ID out? So I just wanted to say thank you, and those Stated Meeting December 8, 2016 forgotten.

Council President Clarke

Thank you, Councilwoman. The Chair recognizes Councilwoman Quinones-Sanchez.

Councilwoman Sanchez

Thank you, Mr. President. I won't belabor this point, but I did want to weigh in on the best value, because I do think that it could serve as a potential vehicle for us to get to these aspirational goals that many of us have been talking about. The public has a right to be skeptical. They have a right to be skeptical because for many of them, been here, heard that, seen that. Councilwoman Blondell Reynolds Brown, who is not here, often says the best predictor of future behavior is past behavior and, Council President, we have failed. And so we need to approach this understanding that people have the right to be skeptical, because we haven't delivered. And we are okay with that, Stated Meeting December 8, 2016 move the needle every single day as we have this discussion. I do want to caution the Administration that any matrix, any discussion about how this gets applied and where it gets applied, that's open for discussion. We're not there yet. Whether it's local preference, whether it's de-bundling, whether it's bonding and insurance, whether it's back-office stuff, all of it is on the table. And that's why I'm very grateful for Councilwoman Parker's leadership on taking a specific issue around workforce and workforce development, because as our studies have shown us, even when we have folks in the trades, they don't necessarily get on the jobs. And so we have to commit that we're going to be okay with the level of questioning and skepticism that is put upon us, and we just got to step up to the plate. And I fully believe that Mayor Kenney is Stated Meeting December 8, 2016 it is this open discussion, it is the dialogue and the questions by the public that is going to ensure that they get full transparency, that this is really open for business and that we're not creating another mechanism for the designated few. So I'm good with the criticism, and I'm up for the task of finally getting it done, because we have billions of taxpayer money that is going to rebuild our neighborhoods through many different mechanisms, whether it's the Water Department, the Airport expansion, as Councilman Kenyatta Johnson will talk about the naval and the Airport, and this can be a jobs program, but let's think about what's happened in the past with NTI. Why wasn't it that these demolition companies were not embraced and allowed to become a union? Let's make sure that we don't create another mechanism without ensuring that we are in fact creating sustainability and real access. Stated Meeting December 8, 2016 say to folks is, what didn't we do last time to make sure that we do it this time so that we finally commit to making sure that men of color, minorities, and women really share in the economic development that's going on in the City. So I'm good with the tension, I'm good with the discussion, and I'm ready to roll up my sleeves and get it done. Thank you, Mr. President.

Council President Clarke

Thank you, Councilwoman. The Chair recognizes Councilman Oh.

Councilman Oh

Thank you very much, Council President. Just for the record, I want to state that I'm not clear where I am on best value, just to be very frank. There's a devil you know and there's a devil you don't. At the end of the day, I think the important thing is that it's going to the people, Stated Meeting December 8, 2016 decide that, and arguments and advocacy and perspectives will be shared. I think best value is a best practice. At the same time, I don't see where it has been articulated and clarified yet. As Councilwoman Quinones says and as Councilwoman Parker says, this is a thing that is going to move forward. It depends on how diligent and astute we are, but I have confidence in this body. I thank Councilman Henon for introducing this best practice, and I believe that the Mayor, whether I agree with him or not on all things, I believe that the Mayor is someone that we should support as he tries to address these troubling problems. I will say that under the old system, with all its ordinances, with all the ordinances that we had introduced, it has been a problem. The old system has plenty of problems. And so even though we have worked with the devil we know, I Stated Meeting December 8, 2016 -- we should allow the opportunity for this new process and for the people to have the final say. Thank you.

Council President Clarke

Thank you, Councilman. The Chair recognizes Councilman Jones.

Councilman Jones

I just wanted to say Happy New Year and that I really enjoy every one of my colleagues. I had an opportunity to work with each and every one of you. And I want you to hug your family, have a good time, and y'all come back now, ya hear.

Council President Clarke

Thank you, Councilman. The Chair recognizes Councilman Taubenberger.

Councilman Taubenberger

I would agree with Councilman Jones 100 percent, but I do want to add a couple other things. I wish everyone a Happy Hanukkah. I wish everyone a Merry Stated Meeting December 8, 2016 and healthy and prosperous new year. And, quite frankly, I enjoy working with all of you, and I appreciate being here in this Chamber. So thank you.

Council President Clarke

Thank you. Thank you, Councilman. That concludes our speeches. I'd like to say real quickly, because I know I'm not supposed to talk up here, other than preside over the proceedings, but four years ago when I became the Council President -- again, thank you all so much for this great job -- I boldly predicted that this would be the best Council in the history of the City of Philadelphia.

Councilman Oh

I was there.

Council President Clarke

You know what I mean? In all due respect to some of the people who are no longer here, because they were the best when they were here, but they're gone now. And we were able to sustain that bold Stated Meeting December 8, 2016 statement, and I want to thank you all so much. Now, four years later, we're into the new term, and I boldly predicted that this is going to be an even better Council, and I got to say after year one -- I know it's early, but after year one, you guys have delivered, and I just want to say that it is genuinely a pleasure to work with you all. As you see, all kind of great ideas come up, and every now and then we don't agree and we have these long speeches back and forth, and it's all good. You know, it's all about the dialogue. But I just want to say that it's a pleasure to have had the opportunity over the last year, and look forward to many more with you all. You guys are great not only as elected officials but as part of the political family that we call City Council. With that, I would like to make an announcement that we got a lot of good food across the hall. So to the Stated Meeting December 8, 2016 Councilmembers, you probably should go over there early, because once we open the doors to the general public, it will be gone quickly. But thank you all. Who is making the motion to adjourn? Councilman Greenlee, I would ask you to make a motion to adjourn.

Councilman Greenlee

Thank you, Mr. President. I move that Council stand adjourned until Thursday, January 26th, 2017 at 10:00 a.m. (Duly seconded.)

Council President Clarke

Thank you. It has been moved and properly seconded that Council stand adjourned until Thursday, January 26th, 2017, 10:00 a.m. All those in favor say aye. (Aye.)

Council President Clarke

Those opposed? (No response.)
