Good morning, everyone. I note that the hour has come and that a quorum of this Council is present. The Council will come to order. Members will take their seats, and visitors will retire to the seats outside the rails. To give our invocation this morning. The Chair welcomes Archbishop Stefan Soroka, Archbishop of the Ukrainian Church in Philadelphia. He is here today as the guest of Councilman Rizzo. Members and guests will please rise. Your Grace, we certainly welcome you. ARCHBISHOP SOROKA: Most gracious Lord, I stand in these municipal chambers of the City of Philadelphia, the City of Brotherly Love, as a new member of this community, humbled by this honor to lead this prayer of all of us gathered today. I thank you, Lord Jesus, for the experience of brotherly love and goodness I have felt so warmly in my initial months of residence. Thank you, Lord, for the gifts you bestow upon this community with your abundance, gifts known and unknown to us, particularly for the gift of this expressed in your civic leaders called to serve this community, a unique vocation. Thank INVOCATION you for their willingness to serve in roles of civic leadership, for their tremendous sacrifices of personal energies and time in the pursuit of the larger community good. Bless all civic leadership with a keen ear to hear the diverse needs of the citizens of our community, enhancing our ability to discern the priorities, helping us to generally facilitate the appropriate responses to the presenting needs of the community. Bless our civic leaders with your wisdom, with your presence, your guidance in our shared journey to develop our community as a family of brotherly love. Help us to break down any self-imposed barriers and to set aside personal agendas that we may always give greatest priority to the community's larger good. Give us the strength not to succumb to the overwhelming demands and needs. Grant us the confidence and hope necessary to develop the appropriate vision for our community, your vision for us. Help us to zealously imitate the life-giving of the early Christian communities INVOCATION characterized by mutual caring and support, an act of concern for its weakest and most vulnerable citizens, and a heart for readiness to share from economic wealth for the good of all citizens. Unleash within each of us the life-giving sources of love, understanding, and forgiveness that we may worthily seek the greater good of all of our bothers and sisters of Philadelphia, set an example for all community leaders and citizens to emulate in their lives. This a resolution honoring the Northeast Catholic High Scholl Wrestling Team on winning the Catholic League Championship. Whereas, Northeast Catholic High School Falcons Wrestling Team entered the post-season in a three-way tie for first place in the Catholic League with St. Joe Prep, LaSalle, and
And whereas, after defeating Conwell Eagan, North started a rigorous training campaign to aid in the finals; and Whereas, the Falcons won three of the first four matches during the championship match in the 112, 119 and 125 pound categories. Whereas, co-captain Ted Murphy locked the Falcon's title with a victory in the 189-pound match earning his 100th victory; and Whereas, Co-captain Ed Alverez finished his career at North Catholic with 111 victories and PRESENTATIONS a rank of second in Southeastern Pennsylvania; and Whereas, the title is the third Catholic League for North Catholic in four years.
Now, therefore, be it resolved by the City of Philadelphia that we honor Northeast Catholic Falcons on their achievements as Catholic League Wrestling Champions. And be it further resolved that we recognize the hard work and efforts of all the wrestlers and Coach Jim Savage on this achievement. And be it further resolved that an engrossed copy of this resolution be presented to Northeast Catholic Wrestling Team as evidence of the sincere respect and admiration of this legislative body. First off, I would like to thank you all for honoring us like this today. Our program is built upon the traditions of Philadelphia in general. We really preach hard work, dedication, loyalty and respect for yourself and opponents. For PRESENTATIONS us to be honored like this is a moment that we all will cherish and to be recognized for our awards and accomplishment by this Council is a great honor to myself, my assisting coaches and our program in general. For that, I thank you. (Applause.)
Thank you, Madam President and Members of Council. It's been a long, long time since the Flyers, Phillies, Eagles or Sixers have shown any championship caliber. Perhaps the Sixers this year. But we do have a veritable dynasty in sports here in Philadelphia, and on April 27 this year, the Philadelphia Wings National Lacrosse League Team won its sixth championship and they are here today. I'm going to introduce a resolution today formally honoring them. We will bring the team in on another day. But a member of the team, Kevin Fenerine (ph) who is a resident of Old City, Councilman DiCicco's district in PRESENTATIONS Philadelphia, which is nice, and Shay Spurry (ph) who is the marketing manager were so exciting with their win thatthey wanted to come in and share the National Lacrosse League Trophy, the cup, with us today. And those who want to see it and get their picture taken with it, Kevin Fenerine and Shay Spurry, please stand up. (Applause.)
Thank you. At this time, the Chair recognizes Councilman Nutter who will make a presentation commending the 7th Grade Class at Shawmont School and their teacher, Ms. Trudy Johnson. Will Miss Johnson, her students, and those accompanying them please join the Councilman at the podium. The Chair recognizes Councilman Nutter.
Thank you, Madam President. Many of you know I talk from time to time about my daughter Olivia and the many traits that she has helped to improve her dad with, one of which is flexibility and responding to change. Normally, we just have the reading of the PRESENTATIONS resolution, the young people have a little presentation and in my usual flexible way I'll just do what they tell me to do. This is a resolution, Madam President, commending the 7th grade class at Shawmont School and their teacher, Trudy Johnson for their positive actions to promote safe drinking water within their school and community. Whereas, the Shawmont School is one of two Philadelphia public schools awarded a Pennsylvania Learn and Serve Grant; and Whereas, Trudy Johnson, the 7th grade science and social studies teacher at Shawmont School is responsible for the securing this grant and establishing partnerships with Earth Force, a non-profit educational environmental organization and the Schuylkill Center for Environmental Education; and Whereas, the Shawmont students chose the topic of water pollution and began conducting surveys of area residents to assess their water usage habits and views about water quality; and Whereas, while gathering this information, signs began appearing in their own PRESENTATIONS school warning students and faculty not to drink the water because of unsafe levels of lead. The students then decided to focus their project directly on the problem of lead in the drinking water at the public schools; and Whereas, the class undertook an investigation to learn about lead as a toxin, conducted research on the serious health consequences of lead in the drinking water and reviewed the history of this problem; and Whereas, the students are now embarking on the civic action component of their project through the development of posters and informational brochures to educate their peers and the public and through advocacy efforts calling for remediation for, not only Shawmont School, but all public schools; and Whereas, Miss Johnson and her students were featured on Fast Forward with Lisa Thomas-Laury as students who were making a "positive impact on their local environment" and Whereas, all of these students should be commended, not only for their study and research efforts, but also for taking action to solve the PRESENTATIONS very real problem that affects them and their fellow students throughout the public school system; and Whereas, Miss Trudy Johnson is clearly a truly special teacher who is not only teaching our youth about textbook science, but is also providing these young people with problem-solving skills and instilling in them positive civic action principles. Now, therefore, resolved by the Council of the City of Philadelphia that we hereby commend the 7th grade class at Shawmont School and their teacher Trudy Johnson, for their positive actions to promote safe drinking water within their school and community. This is a certified copy of this resolution adopted on the 5th day of April 2001, signed by Council President Verna, introduced by Councilman Nutter, and co-sponsored by all Members of City Council. A resolution calling on Temple University to abandon its efforts to avoid the democratic Pennsylvania Labor Board certified election of the Temple University graduate students, Association American Federation of Teachers, as the collective bargaining representative for its teaching and research assistants and to immediately begin contract negotiations and to bargain in good faith with the union.

Thank you, Madam President. Temple University is a great school. And it's a great school, not only locally, but nationally and internationally. At one time, it was almost the only school that offered opportunities to poor people or people without affluence to get an education. It was a great leader and we had great democratic dreams about it, small "d" for democratic. It's with a heavy heart that I address this issue because it is not the role, in my opinion, of a great educational institution to move in a backward direction rather than a forward direction. What we are seeking in this country to establish are the rights of all people and to INTRODUCTION OF BILLS AND RESOLUTIONS recognize the dignity of work. There are hundreds of graduate students at Temple University who manage to stay in college only because they accept positions as teaching assistants. It is honest work. It is important work. It is work upon which the success of the university is dependent. Yet Temple University from the beginning has adopted the most backward approach. In the early days of the Roosevelt administration in the late 30s, people began to recognize the dignity of work and the right of those who work to have some economic strength at the bargaining table, and they were permitted by law and encouraged by law to organize into collective bargaining units. Yet we find in this situation where the dignity of the work should easily be recognized, that Temple leads in a backward direction by asserting that these graduate students have no rights, that they're merely students and do not engage in gainful employment. I think it's time that the situation be changed. There was an election held by the State Labor Board to determine the wishes of the graduate assistants. Temple said they didn't really want the INTRODUCTION OF BILLS AND RESOLUTIONS union, but by a vote of something like 290 to 16, the graduate students voted to organize. And now Temple makes clear that it intends to fight that issue every inch of the way even though municipalities throughout Pennsylvania and throughout the nation has recognized the right of graduate students to organize and present their views in an organized way to the administration and to be recognized as equals in collective bargaining institutions. I hope, Madam President, that when the board of trustees at Temple University meets next week, they will consider their role in the life of this City and the life the State and the Nation and understand they ought to be in the forefront of strengthening democratic institutions rather than fighting them. Thank you. SECOND READING AND FINAL PASSAGE CALENDAR
Proposed amendment to Bill No. 010061. Section 4. Purposes for the Bonds. No more than $250 million of the proceeds from the sale of the bonds may be used to refund and redeem certain outstanding Bonds of the System, as such Prior Bonds are more fully set forth in the Determination. In connection with such refunding and redemption, the Bond Committee, or a majority of them are authorized to approve the redemption of the Prior Bonds and to enter into an Escrow Agreement providing for the deposit and investment of Bond proceeds in amounts sufficient to defease the Prior Bonds and providing for payment of the Prior Bonds at maturity or redemption, as applicable, including all interest payable on such Prior Bonds to such maturity or redemption dates, as applicable. No more than $250 million of the proceeds from the sale of the Bonds may be used for (a) construction, acquiring, reconstructing and renovating water treatment plants and related facilities and equipment for the sewer system; (b) constructing, acquiring, reconstructing and renovating water treatment plants and related facilities and equipment for the water system; (c) constructing, SECOND READING AND FINAL PASSAGE CALENDAR acquiring, reconstructing and replacing water and wastewater pipes, pumping stations and related facilities; (d) purchasing equipment and apparatus of a capital nature for the water and wastewater systems, all as included in the capital budgets of the City; (e) purchasing vehicles; (f) if applicable, paying the costs of Enhancement Agreements and/or costs related to any Qualified Swap or derivative financial instruments; (g) paying any other "project costs" as such term is defined in the Act; and (h) making the deposits referred to in Section 5 hereof; and (i) paying the issuance costs of the Bonds.

I would just like to SECOND READING AND FINAL PASSAGE CALENDAR ask the finance chairman majority leader for a short explanation of the purpose of the amendment.
Initially, the bill read $500 million. However, the technical staff felt that we should certainly contain it better and have more clarification by separating it into $250 million each and also by changing the language to indicate that no more than that, the proceeds from this bond may be used in these ways. So it defines it better and clarifies it better so that there can be no questions later about how any of this $500 million can be used.
