A. 6 I appreciate this opportunity7 to testify today regarding my nomination8 to a position on the Board of the9 Philadelphia Energy Authority. 14 I'm a native Philadelphian,15 raised in West Philadelphia and16 Germantown, and I now reside in17 University City. 11 COM. Nominations1 professional engineer in Pennsylvania2 since 1983, and I am licensed in at least3 ten other states and a chartered engineer4 in the UK. 7 I have extensive experience in8 the engineering, design, and construction9 of high-tech and energy-conscious10 buildings and systems, from residential11 to industrial, and have worked for some12 of the most well-known firms in that13 arena, including the Kling Linquist14 Partnership and Day & Zimmerman in15 Philadelphia, and HLW International in16 New York. 11 COM. A. 5 The PEA should have the6 flexibility to enter into agreements for7 energy efficiency or renewable energy8 products that could exceed the four-year9 duration which currently binds the City,10 and this will help us to work in a11 long-range planning format so necessary12 for energy-related initiatives and help13 us better future-proof the City against14 price fluctuations and supply15 disruptions. 11 COM. Mr. Swann,8 in the past few months since the9 deregulation and people being able to go10 out and buy electricity, many11 Philadelphians have taken advantage of12 the discount that they've been able to13 get. I don't know what the true numbers14 are, but I think it's about a quarter15 million in the region of the Philadelphia16 area.17 Do you envision at any time the18 board you're about to join and the Energy19 Authority getting involved in the20 distribution of or generation of21 electricity?22
I wouldn't see it23 as a practical matter for the City to try24 to compete with, say, Exelon on the25 10 4.14.11 COM. OF WHOLE - P.E.A. Nominations1 generation or distribution.2 That said, there may be some3 opportunities for local generation, let's4 say, photovoltaics or something at a City5 installation, which helps reduce load on6 Exelon or PECO's requirements.7
But I wouldn't see9 the City selling power to neighborhoods.10

Will do.5 I am a partner at Blank Rome6 and a member of the firm's Energy7 Industry Group, and I appreciate this8 opportunity to testify today regarding my9 nomination to the Philadelphia Energy10 Authority.11 Like my colleague Mitchell12 Swann, I am a product of the Philadelphia13 public schools. I attended Masterman,14 and I graduated from Central High School15 four years before Mr. Swann.16 I was fortunate to attend17 Harvard, where I received a B.A. in18 government, and I'm also a graduate of19 the University of Michigan Law School.20 I have extensive experience21 with government. I served in Governor22 Casey's administration first as Executive23 Deputy in the Office of General Counsel,24 and then as Secretary of the Commonwealth25 12 4.14.11 COM. OF WHOLE - P.E.A. Nominations1 of Pennsylvania, where I oversaw the2 operations of the Department of State.3 Since then, I've been involved4 in other governmental agencies. In5 particular, in 2000, Governor Ridge6 nominated me to the State's Judicial7 Conduct Board, the board that oversees,8 prosecutes, and investigates misconduct9 of judges; and in 2004, I chaired that10 board.11 I am active in civic affairs in12 this region. I currently serve on the13 boards of Arthur Ashe Youth Tennis and14 Education, the Urban Affairs Coalition,15 Drexel University College of Medicine,16 and West Chester University.17 Let me say just a few words18 about choice and competition in19 electricity markets. In 1996, the20 Commonwealth dramatically changed the21 regulatory landscape for electric22 utilities by enacting the Electricity23 Generation Customer Choice and24 Competition Act.25 13 4.14.11 COM. OF WHOLE - P.E.A. Nominations1 Before that act, utilities were2 monopolies, and the price of electricity3 was regulated by the PUC on a rate-of-4 return basis. After the act, competitive5 markets were created where consumers can6 now shop for their electricity, as one of7 the Councilmen noted.8 In the PECO territory, where we9 are now, rate caps expired on December10 31, 2010. And now, all consumers have11 the right to choose their electric12 supplier, and this power to switch gives13 them greater control not only over the14 price they pay but also over other15 features of their service, such as the16 ability to select a green or renewable17 energy source of supply.18 The key benefit of the Energy19 Authority is that it gives the City of20 Philadelphia increased flexibility in21 taking advantages of the opportunities22 presented by this new landscape. Unlike23 the City itself, the Authority would have24 the legal authority to enter into25 14 4.14.11 COM. OF WHOLE - P.E.A. Nominations1 agreements for energy efficiency or2 renewable energy projects that could3 exceed four years in duration, and this4 would allow the conservation and other5 agency savings to be financed over a6 longer period, enhancing the financial7 feasibility of those projects.8 The Authority could also help9 the City's small commercial and10 industrial customers to combine their11 purchases to obtain better offers from12 competitive suppliers.13 And finally, the Authority14 could be a useful tool for the City's15 Energy Office, which is the central point16 for the City's energy planning and17 purchases.18 Thank you, Council President19 Verna, for the opportunity to present20 this testimony.21 COUNCIL PRESIDENT VERNA:22 You're welcome, Mr. Lewis.23 The Chair recognizes Councilman24 O'Neill.25 15 4.14.11 COM. Good morning, Madam23 President and members of City Council.24 My name is Ken Ogawa. I also have a25 16 4.14.11 COM. OF WHOLE - P.E.A. Nominations1 prepared statement I can read into the2 record or abbreviate if you desire.3 So I've been nominated to serve4 on this Energy Authority board. And my5 background, I am currently the Executive6 Director of Operations and Maintenance at7 the University of Pennsylvania. In that8 capacity, I am in charge of all of the9 facilities, including providing utilities10 to the buildings and managing many of the11 conservation programs on campus.12 Several of the key projects13 which are pertinent to the Authority.14 I've negotiated several long-term energy15 contracts with Trigen. And also, we have16 instituted a load-serving entity, which17 is a legal entity allowed to buy power18 effectively on the wholesale market.19 Penn has decided to aggregate all of its20 electrical load and procure power at the21 best price for all of the university.22 So while we are not generating23 or distributing power in the sense of24 competing with PECO, we have decided to25 17 4.14.11 COM. OF WHOLE - P.E.A. Nominations1 aggregate our load to get a better price2 for all of our entities.3 I've also -- I'm managing a4 revolving-loan account, which is very5 much like a energy-savings performance6 contract. This is an internally-funded7 project where we can effectively take our8 own capital, loan it to other entities9 inside the university, where we can10 initiate projects to conserve energy.11 Prior to joining the University12 of Pennsylvania, I served 22 years in the13 Navy. I've served in facilities all14 around the world. And I oversaw a number15 of energy conservation and renewable16 energy projects, many of which were17 financed using long-term public to18 private partnerships.19 I hold a bachelor's degree in20 mechanical engineering from the21 University of California, Davis; a22 master's degree in mechanical engineering23 from the University of Maryland. I'm24 also a licensed professional engineer and25 18 4.14.11 COM. OF WHOLE - P.E.A. Nominations1 a LEED-accredited professional.2 I hope that this brief3 description of my background has been4 valuable, and I would be happy to answer5 any questions at this time.6

Other than10 electricity, what other energy sources11 are you going to deal with? Are you12 going to deal with natural gas, gasoline,13 steam? What is the entire involvement of14 the group?15
My understanding16 is, we could look at any of the options17 to reduce energy costs and improve18 sustainability to the City. Obviously,19 we're primarily focused on long-term and20 renewable, which are the items21 specifically in the original charter.22

I do not expect9 that Philadelphia would benefit from10 generating or distributing power11 directly.12
Okay. And13 I just have a question for the panel. I14 think there's an opportunity to take the15 expertise here and help the City not just16 become more sustainable, but coupled with17 -- coupling that with driving our bills18 lower. I mean, we have such huge utility19 bills, whether it's gas or electricity or20 whatever.21 And could the panel just -- any22 or all of you comment on whether that's23 something that you could achieve, or help24 achieve, in that area. I know the small25 22 4.14.11 COM. OF WHOLE - P.E.A. Nominations1 business, the aggregation, but the City2 itself, do you see an opportunity for the3 City to reduce its energy bills?4
I believe that the5 City probably could aggregate their loads6 and potentially negotiate better7 contracts with their service providers.8 So yes, I think you are --9

Certainly. I'm18 Barbara Adams. Good morning,19 Councilwoman Tasco and the other members20 of City Council that are here.21 It's been a long time since I22 was last here. Some of you are the same,23 some of you are new.24 In the interest of time, I will25 24 4.14.11 COM. OF WHOLE - P.E.A. Nominations1 briefly paraphrase my testimony, relying2 on the full testimony to be part of the3 record. And in addition to my testimony,4 there is a attached my résumé as well as5 a supplement to that résumé that details6 the areas of my background and experience7 that are directly involved in energy.8 I am a resident of9 Philadelphia, and until last January10 18th, I was the general counsel for the11 Commonwealth appointed by Governor12 Rendell; I served in that capacity for13 five-and-a-half years.14 Prior to that, I was with Duane15 Morris, a large international law firm16 that's headquartered in Philadelphia, and17 I practiced there for 28 years. During18 that time, I did develop an interest,19 which has been sustained over the past 1520 years, in sustainability and in the21 opportunities that arise from large22 entities purchasing power with regard to23 the various deregulation of the various24 types of energy.25 25 4.14.11 COM. OF WHOLE - P.E.A. Nominations1 I just want to highlight three2 aspects of my background just to give you3 a little insight into some matters that I4 have handled.5 First and foremost, yes, I was6 a Commissioner for the Philadelphia Gas7 Commission --8
-- along with Chair10 Tasco. I served in that capacity for11 four years, in the mid-'90s.12 I also, as a lawyer,13 represented large energy-purchasing14 entities such as hospitals and15 universities in reviewing energy savings16 contracts proposals.17 Finally, as general counsel, I18 did supervise the legal representation of19 the energy savings contract proposals20 that were to be used by agencies of the21 State government to reduce their energy22 costs.23 In addition to energy, I did24 focus my practice, when I was practicing25 26 4.14.11 COM. OF WHOLE - P.E.A. Nominations1 privately, on public finance. I think2 that will be a good background for this3 authority, which I suspect will be4 reviewing energy savings contract5 proposals, various financing proposals,6 public/private partnership proposals.7 Also generally, my background8 in government gives me some familiarity9 with the special aspects of a10 governmental entity such as the11 Authority, including special procurement12 concerns, ethics, Sunshine Law, and13 right-to-know matters.14 Thank you for providing me this15 opportunity to testify, and I welcome any16 questions.17

I'm the Associate Director for20 Sustainability and Leadership at the21 Wharton School at the University of22 Pennsylvania. I'm proud to present my23 credentials today and express my passion24 for helping create a sustainable,25 28 4.14.11 COM. OF WHOLE - P.E.A. Nominations1 affordable energy for future for2 Philadelphia.3 Philadelphia's been my home for4 thirteen years, and I've been a homeowner5 in Kensington for the last four. I hold6 a bachelor's of arts from the University7 of Pennsylvania and an MBA from the8 Wharton School in environmental and risk9 management, with a focus on enterprise10 sustainability.11 I came to Wharton to help shift12 the way we do business towards models13 that benefit a triple bottom line,14 incorporates benefits to communities, the15 planet, and financial stakeholders at the16 same time. I am a lead accredited17 professional, with a specialization in18 operations and maintenance.19 Prior to earning my MBA at20 Wharton, I spent five years running a21 consumer heating oil cooperative called22 Perk Fuel Buyers, here in Philly. We23 used group buying power to negotiate24 affordable prices and terms for 150025 29 4.14.11 COM. OF WHOLE - P.E.A. Nominations1 households in the region, many of whom2 were senior citizens and low-income3 families.4 In that capacity, I served as5 an advocate for the Low-Income Home6 Energy Assistance Program, LIHEAP,7 lobbying our Congressional delegation8 annually for increased federal funding,9 in partnership with PECO, PPL, the10 Utility Emergency Services Fund, and the11 National Fuel Funds Network and12 supporting the State-level administration13 of LIHEAP by serving on the LIHEAP14 Advisory Council in Harrisburg. I15 partnered with PECO's low-income usage16 reduction program to support energy17 conservation for those needed it most in18 our city.19 I learned from our members the20 real-life ramification of going without21 utilities, and I remain their advocate22 and champion today.23 In my current role at Wharton,24 I assess and work to reduce our25 30 4.14.11 COM. Nominations1 environmental footprint from an2 operational perspective, focusing on3 energy conservation, water-use reduction,4 waste and recycle issues, and much more.5 We've made exciting strides in6 the last two years at Wharton, earning7 Penn's first LEED certification on a8 renovation project and putting into place9 significant energy reduction projects and10 greening our operations across the board.11 We've played a leadership role at Penn in12 sustainability and continue to work with13 the University to meet our climate action14 plan goals.15 If confirmed, I'm eager to work16 with my fellow Authority members and17 Council to make the Energy Authority a18 body that can develop programs that19 position Philadelphia as a leader in the20 clean-energy economy, while providing the21 City, our residents, and all members of22 our community the opportunity to lower23 their bills and green our city through24 energy efficiency and green-energy25 31 4.14.11 COM. Yes. I would like to5 adopt the position of Mr. Swann. I would6 say no, with the exception of isolated7 where practical self-generation for the8 City's own use possibilities.9
Okay.14 When you talk about sustainability,15 that's a very big definition, and it's a16 wider definition, depending on who you17 ask.18 While it's not pure energy, the19 City is -- I mean, we're bragging, and20 rightfully so, that we've gone from 6 to21 17 percent recycling, but it's22 disastrously low still, and there are23 some potential energy issues when you get24 involved with that in addition to25 33 4.14.11 COM. OF WHOLE - P.E.A. Nominations1 savings, which can be substantial as2 well.3 Do you see any limit to what4 the -- when you look at that energy5 definition in an expanded way, any area6 that the Energy Authority could not weigh7 in on, try to be an advocate in, or try8 to be of some assistance, bringing --9 whether it's private or nonprofit10 expertise to the table? To assist the11 City.12
I would hope13 that we can take a creative approach to14 start at least and look at all options,15 see what's available to us.16
And what will18 make this both more affordable for energy19 in Philadelphia as well as greener.20 So I hope that we can take a21 creative approach and not rule things out22 before we look at them.23

-- would8 only grow as we move forward on this9 very, very, very important issue.10 The Mayor's Office of11 Sustainability currently works on some of12 these alternative-energy strategies, and13 the thought was that that office would14 probably provide staff support to the15 Authority where appropriate.16 COUNCILMAN DiCICCO: Thank you.17 Again, I just wasn't sure, 'cause someone18 asked me that question, and I haven't19 really followed this in its entirety.20 But thank you for the21 explanation.22
