This is Craig Melodosian, Chair.
Yeah, Craig, are you involved in this case on Felton Street?
Yes, sir.
I'm the coordinating RCO.
We never heard from the applicant or the expediter.
We wrote them and asked them what they were going to do.
Of course, we copied Trey at a councilwoman OTA's office.
We have no problem with the continuance, but we thought it was odd that we had heard from no one on this project.
We had work with Mr. Faschino some years ago when he tried to convert it to a commercial.
So, again, we have no problem with the continuance, but we thought their silence was unusual.
So here's what I'm going to do.
I'm going to continue it and mark it must be heard.
OK, thank you.
Great.

lancaster avenue sherman toppen mr toppen was on earlier today to talk about this project
mr toppen you still want sir thank you uh yes good uh good afternoon mr chair and members of
board i'm here to speak on on 4860 lancaster avenue we are we're seeking a continuance but
the circumstances are a bit interesting and that's why we had a one rco meeting in this particular
case in that rco meeting the rco chair conducted the meeting if those zoom he had all the folks
that he contacted in his house he didn't put a screen on we had no idea who was there
we asked changes of it it didn't go in the right direction he he criticized the look of the
building personally and we feel that there was some bias in the way he conducted the meeting
afterwards we could be circulated a petition with quite a bit of support in the same area so that
for that reason we requested a second rco meeting and we had time to do it he then refused to
schedule that second rco meeting and as a result we feel we feel it is important that we bring our
project to the community in a proper meeting even proctored by the by the council person would be
appropriate or a different rco so we'd like a continuance for that reason to work that out
and to present our project our project to the community we feel in an unbiased manner
So MI 2025-003-384-4860, Lancaster Avenue. Cases continued to 5626 at 330.
Mr. Chair, can I just add just a quick question for Mr. Toppin.
Mr. Toppin, when I was reviewing the exhibits for this case, it looked like there was a smoking lounge proposed on one of the floors.
I don't have the exact answer for this, but I was a little concerned that that was another primary use that should be on the refusal.
I don't know if that would necessarily be considered accessory to a restaurant.
And so maybe we can talk more about that offline, but I just wanted to raise that issue that if that's being proposed, it may be considered like a separate use.
There is, there was, I saw in the plans the same, there was some conversation of a possibility that it could enable that use as well.
so correct you will be correct um miss emerson i will discuss it with you offline and and if we
have to make any amendments to the refusal and we have now time to do so um and to preserve and to
proceed with that but that was not mentioned in the rco meetings but it clearly was on the plans
yes okay all right thank you thank you thank you number number six thank you uh council okay number
6-MI-2025-006-317, 3110 Araminga Avenue. Henry Clinton is the attorney. This is a reconsideration
hearing. Good evening, Mr. Chairman. Good evening, Mr. Clinton. You've already been sworn. Could
you just state your name for the record? Sure. Henry Clinton, C-L-I-N-T-O-N.
So, Mr. Clinton, this is a reconsideration hearing. The testimony and evidence presented
at the original hearing on this matter are incorporated into the record for this hearing.
The scope of the reconsideration hearing is limited to the revised plans proposed by the applicant.
So you'll make a presentation for the applicant.
We'll take questions from the board, public testimony, then planning will take a position.
If you want, why don't you start off with a short background of how we got to here?
Sure. Good evening, Mr. Chairman, members of the board.
So this is a request to convert a first-floor doctor's office, Dr. Herbert Frank, long-time family doctor in the area, to a one-bedroom apartment.
And at the outset, I'd like to thank the board for reconsidering this.
It's not always done, so I really do appreciate how it does my client.
So anyway, when we presented it the first time, my client had hand-drawn floor plans, which were inadequate.
I knew that going in and it was raised by the board.
So we came back for another hearing, resumption hearing, and the client, despite my prodding, still did not have full professional plans.
So now we have full professional plans that I can show the board.
We're basically asking to maintain the one-bedroom apartment on the second floor and have a one-bedroom apartment on the first floor.
and have a one-bedroom apartment on the first floor.
And the issue was the floor plans.
And the issue was the floor plans were not professional,
and they were not adequately outlined.
If I can share that, I can show it to the board.
Why don't you start your presentation?
Did I lose you?
So we see your full screen in every area. You're up now, sir.
Great. Actually, this is not the one I want to show you.
So this is the request for consideration. And what I'll do, I'll run through the plans to give you a little bit of back.
This was the first set of plans, obviously inadequate.
And they were calling for two bedrooms on the second floor apartment.
And we only want one bedroom. We then submitted these plans by an architect, but these were not deemed adequate.
So these are the final plans. Proposed basement, no living, will be storage.
First floor, kitchen in the front.
Before it was, I think, in the middle or the rear.
Bathroom, bedroom, exit to the rear yard.
Yes, through the bedroom, but there's not a lot of space, and the client wanted the bedroom in the rear.
Second floor, originally presented as two bedrooms in the front.
That's been eliminated.
There's going to be a bedroom in the front, a living, bath, and a kitchen.
There's also a trash closet here in the kitchen for storage of trash.
That's basically the presentation.
Two one-bedroom apartments.
This is existing on the right-hand side, the second floor.
This first floor is proposed.
And that is the presentation, Mr. Chairman.
You want to bring your client on to adopt your testimony?
Yeah, I don't know that he's still on or around, but I'll ask him.
if he doesn't answer you're an officer of the court all right claudia bilis b-y-l-i-s claudio
are you on the call do we see him the chair counsel i do not see anyone answering to the
name of the audience mr clinton uh you're an officer of the court you're obviously we take
your testimony i appreciate questions from the board thank you for the updated plans they're
very helpful um i think the uh layout um other than the going through the bedroom to go to the
backyard if you could do that doorway out of the that breezeway would probably be much better
layout um on the second floor i i don't know why the um the kitchen isn't where you know where the
living room is and it's all one big space and make that kitchen a bedroom i think i think um
My fellow member would probably like that better.
So you don't have to walk through the living room to go to bathroom.
But other than that, much.
He's got Cheryl left him, by the way.
See, I'm working with you.
Thank you, Mr. Johns, for the comments.
Yeah, that second floor is existing.
So I don't want to make a promise on that one.
All right.
Other questions?
Questions from our attorney?
Not at this time, Mr. Chair.
Planning Commission.
Amy Boyd with the Planning Commission.
The Planning Commission won't be changing our testimony from the previous hearing.
Would you like me to redate again?
the comprehensive plan recommends no change to the rsa 5 residential single family zoning at
this location the city rezoned this neighborhood in 2017 in accord with recommendation from the
comprehensive plan the city issued a rental license in 2013 for one dwelling unit the
planning commission recommends that the board deny their quest variance for two dwelling units
Thank you.
