Yes, Mr. Chairman. My name is Paul McCloskey. I'm representing the Water Department. In regard to Bill No. 980408, introduced by Councilman Nutter by request, the Water Department submits the following testimony. This bill authorizes the placement of a drainage right-of-way of a variable width, primarily in the bed of Copper Beach Court. Copper Beach Court is a private street at 5400 Wissahickon Avenue. The property is owned by the Copper Beach Town House Association Incorporated. The development of a single-family townhouses was built with the City's utility constructed at City standards at the developer's expense, with the intent that the City would assume ownership, in accordance with the requirements of the City code. In order to assume the ownership of the facilities, this ordinance authorized the City to accept the right-of-way for water and sewer from the homeowners association through their private 8 COMMITTEE ON STREETS AND SERVICES - BILL 980408 property. We recommend this bill be favorably reported out of committee and also request a suspense of rules in light of the impending recess of the Council.

Thank you, Councilman. In reference to Bill No. 980445, this is not an Administration ordinance, but an ordinance requested by Herman Hinton, owner and operator of the newsstand located on the southeast corner of Ridge and Girard Avenues. The purpose of this ordinance is to acquire from City Council the legal permission to install, use, or maintain certain electrical wires, conduits, and appurtenances in, under, and across the southeast corner of Ridge and Girard Avenue for the purpose of supplying electrical service to said newsstand. Electrification of a newsstand is a precursor for lottery activity, which causes 10 COMMITTEE ON STREETS AND SERVICES - BILL 980445 queues on the sidewalk areas. This, in turn, causes a safety hazard for pedestrians and vehicular traffic. For this reason, the Streets Department does not support this bill.

Mr. Longshore, have you ever determined whether or not an ordinance is required for telephone lines to be installed? There was a question, if you recall, when we were dealing with an issue similar to this as to whether or not a newsstand operator, if he wanted to get telephone service, that this requirement is -- that this process is required for telephone.
Councilman Rizzo, it is. It was a 1951 ordinance for electrical conduits, and they specifically separated electrical conduits from phone conduits.
So my question is: If I had a newsstand and I wanted to put a phone in it, not electric, could I do that without an 11 COMMITTEE ON STREETS AND SERVICES - BILL 980445 ordinance?
No, Councilman, no. 4 For electrical and fiber optics, which would be a phone line, a separate ordinance or a combined ordinance would be required.

Mr. Chairman and members of the committee, my name is Paul McCloskey, and I'm testifying on behalf of the Water Department. Bill No. 980463 authorizes the placement of a new City street, Gardenia Lane, from Red Lion Road to a cul-de-sac, to provide access to utilities for the proposed development of single-family dwellings. 20 The ordinance authorizes the placement 21 of a 50-foot-wide right-of-way for drainage of water purposes from the above-mentioned cul-de-sac to an existing 40-foot drainage right-of-away at the southeasterly end of the development. Finally, the ordinance expands the 13 COMMITTEE ON STREETS AND SERVICES - BILL 980463 rights of the existing 40-foot drainage right-of-way to also include water mains. The existing right-of-way is located on a line of Pine Hill Avenue. It runs from Moreland Terrace to the developer's property line, approximately a hundred feet north of Moreland -- Moorefield Road. This new drainage right-of-way is required to divert and divide the new flow that will be created by the development to sewers in both Red Lion Road on one end and Warfield Road at the other. This is due to the existing grade of the property and is closest to the neighboring wetlands. The water main requirement for the new and existing drainage right-of-way is needed to provide circulation for the system that will check water quality. We recommend that this bill be favorably reported out of committee, and also request a suspension of rules to allow for the first reading in light of the near completion of the impending recess of City Council. I'm a little curious about the maintenance arrangement. Why are we requiring the Streets Department to maintain those?
No, we are -- this authorizes the Streets Department to enter into a maintenance agreement with the University of Pennsylvania so that they will maintain them. A lot of times when a street lighting structure is in the public right-of-way, we have the responsibility to maintain those. But in this case, the University of Pennsylvania, since it's specialized lighting, has agreed to maintain 'em with their own money.

Yeah. There's a standard hold-harmless clause in anything we enter into with this type of maintenance agreement whereas as long as it's not something that's the fault of the City, then we would be held harmless for any accidents that occur there. It's a standard clause in our contracts.
