The institute and the cultural aspect of the institution, the behavioral patterns, and we have seen that reporting and statistics the way they have shifted, not only in the rape issue, but in all of the other crimes situation, they have been underplayed over the decades in this city. Hopefully, what we're trying to do here is to bring forward the recommendations that would prevent an institutional situation from overcoming the reality of what the case should be or what the law is. The culture within that is not only to reform the bureaucratic procedures, but if you don't reform and you don't extirpate and take the cultural behavior patterns out, that bureaucracy will revert sooner or later -- probably very much sooner -- to its old ways of functioning. PROFESSOR ANDERSON: Yes. And I think that there's also a way in which, at each stage of 249 12/6/99 PUB. HEALTH/SAFETY - RES. 990775 the game, the police are trying to anticipate whether or not the prosecution team will move forward on a claim, the prosecution is trying to anticipate whether or not juries will convict and ascribing all of the cultural and societal biases that I talked about to the members working at the at the next stage of the game. And one of the problems with that is that there's no opportunity for systemic reform when at each stage of the game, there is an expectation that societal biases are going to deep this complainant not credible.

I want this committee to bring forward a very comprehensive set of recommendations and your testimony will be a great part of that. I want to be able to look at the testimony and formulate, and I would want to see -- would you be available to the committee to sort of discuss the report as we shape it and bring it before City Council? PROFESSOR ANDERSON: Yes, sir. Of course.

Councilman Ortiz

'Cause I want to do it before we are through this year. Because this cannot happen and be laid over. I think the 250 12/6/99 PUB. HEALTH/SAFETY - RES. 990775 incoming administration has to have this in their hands -- PROFESSOR ANDERSON: Yes.

-- as the feeling and the reporting and the recommendations of this Council, plus all of the individuals that are concerned across the board, all of the advocate groups and so on, so that we can begin to deal with this from the get-go in terms of budgetary reforms, in terms of how the Police Department organizes itself, reforms of the Special Victims Unit, and looking at it as to how that should be organized, and what type of training should take place in that unit, and who should be the individuals that will be the personnel. So I would appreciate it if you remain available the this Council, to this committee, as we go forward. This committee of City Council will remain in recess until the 13th of December, at 11 a.m. so that we can then look at the report as coming out in terms of what recommendations. And this committee will look forward to the full body of City Council. 251 12/6/99 PUB. HEALTH/SAFETY - RES. 990775 Thank you very much for your testimony. And thanks to everybody for sitting in and waiting with us through this day.
