Council President Clarke

Thank you very much, Mr. Decker. That concludes our Calendar for today. Are there any speeches on behalf of the minority? The Chair recognizes Councilman Oh. Stated Meeting February 27, 2020

Councilman Oh

Thank you very much, Council President. I do understand that as a result of my resolution and bill today, I will be entertaining conversation. I think that's a great thing. People have different opinions. I've spoken to a lot of folks. I would say I'm pretty familiar with the subject matter. The only thing I'm going to say is when people -- when you approach me to talk about me, I'm going to start with these numbers: 120,000 murdered in Mexico between 2006 and 2012, all related to providing heroin to the United States. 120,000 estimated murdered in Mexico. 27,000 still missing. Start with those numbers, then move to the number of people murdered in Philadelphia, incarcerated in Philadelphia, all involved in the drug trade, human trafficking from minors, women, go through the list. If you want to show me studies, include all of those Stated Meeting February 27, 2020 about the harms done because of illegal drug trade, and that's a conversation we can have about prolonging and extending the use of drugs by people who are addicted and unable to take action themselves. There are proven ways to help addicted persons, and I will disagree that this is a good way to do it, and we can have that conversation. Thank you.

Council President Clarke

Thank you, Councilman. (Applause.)

Council President Clarke

Speeches on behalf of the majority? The Chair recognizes Councilman Johnson.

Councilman Johnson

Thank you, Council President. This evening in the Southwest part of my district at Myers Recreation Center from 6:00 p.m. to 8:00 p.m., we'll be hosting a Peace Not Guns town hall meeting to focus on what I Stated Meeting February 27, 2020 issue that we're addressing here in the City of Philadelphia, and that's the issue of gun violence. The number one murder of African American men between the ages of 18 and 34 is homicide by guns. And so we're not only going to talk, but we're going to establish a task force for the Southwest part of my district so they can work as a community. And we empower them to come up with their own strategies and solutions to reduce gun violence in Southwest Philadelphia. And, again, that's this evening, 6:00 p.m. to 8:00 p.m. I'll be joined by my colleague Councilman Curtis Jones, and this is an initiative under Special Committee on Gun Violence, and I will encourage any of my other colleagues that want to join not only the discussion, but be a part of the strategy and plan to reduce gun violence, so you're more than welcome to attend. Thank you very much, Council Stated Meeting February 27, 2020

Council President Clarke

Thank you, Councilman. The Chair recognizes Councilman Domb.

Councilman Domb

Thank you, Council President. I'd like to speak briefly on the wage tax refund legislation that we unanimously voted today to adopt. I want to thank everyone. This bill will help 150,000 low-income Philadelphians and aid our city in combatting poverty that has plagued us for too long. I want to thank all my colleagues for their ongoing support. I especially want to thank you, Council President Clarke, and Councilmember Derek Green and Councilmember Maria Quinones-Sanchez who stood with me last month at the Finance Committee meeting, along with several community supporters, including CLS, Campaign for Working Families, Benefits Data Trust, and The Stated Meeting February 27, 2020 the reintroduction of this legislation. I also want to thank additional co-sponsors such as Councilmembers Johnson, Gauthier, Jones, Squilla, Oh, Thomas, Gilmore Richardson, Councilmember Bass and Parker. This bill will allow low-income residents to apply for a refund that would give them back the hard-earned wages they paid the City in taxes. It will allow a family of four earning an income of 34,000 to receive about $810 per year, and by 2024, it could be as much as 1,300. It will give immediate assistance to pay their bills, buy groceries, and help with the day-to-day financial burden they face. It's not a silver bullet to curing our city's poverty problem, but this is a necessary tool that we need to help fix a problem that's lasted far too long. It's time that we make our tax Stated Meeting February 27, 2020 a lot of work yet to do, and I look forward to working with all of you as we finally reduce poverty in Philadelphia. One other comment, I want to remind all my colleagues and staff to join me tomorrow from 10:00 a.m. to 11:30 in the Caucus Room to learn about the latest policy solutions for opioid use disorder. The discussion and presentation is being held by the experts at the Pew Charitable Trust, and I look forward to seeing everyone there tomorrow. Thank you very much.

Council President Clarke

Thank you, Councilman. The Chair recognizes Councilman Green.

Councilman Green

Thank you, Council President. I want to remind my colleagues that we'll be having a lunch briefing immediately after Council with Mental Health Partnerships talking about Stated Meeting February 27, 2020 they do and how they can partner with members of City Council. I also want to bring members of Council -- I want to inform them regarding an issue I learned about. Council President, you also were supportive of this issue. Last Friday afternoon in the Mayor's Reception Room, I, along with State Senator Sharif Street, Senator Tony Williams, State Senator Tina Tartaglione, as well as members of the House of Representatives, State Representative Mary Isaacson, Representative Malcolm Kenyatta, Representative Danilo Burgos. We were also joined by Ryan Boyer, Business Manager for Laborers District Council, and also Mel Wells from One Day At A Time. The purpose of the press conference and the reason why I'm bringing attention, because this afternoon and this morning we've had a lot of conversations regarding the opioid Stated Meeting February 27, 2020 to address that issue. Last Thursday, Senator Street was in a Senate Appropriations Committee hearing and learned that at the state level, the Department of Drug and Alcohol Programs under the leadership of Secretary Jennifer Smith is going to be adopting a regulatory change that going forward -- and we're still trying to get the exact date and time for when this will go into effect -- that if you are a program that deals with any type of addiction services, if you do not allow medically assisted treatment individuals into your program, you will be de-funded. Not only will you be de-funded, but de-listed, which when you think of organizations like One Day At A Time started by Mel Wells' father who have really received scraps in reference to dollars providing treatment during the crack cocaine epidemic, you think about Dr. Tommy Reid from Nu-Stop in Southwest Stated Meeting February 27, 2020 Philadelphia, a number of programs around this city who have been really providing a resource for people who have been dealing with all kinds of addictions, from alcohol to drugs to opioid addictions, heroin addictions, and the fact that at the state level they are talking about removing funding, the little bit of funding that these organizations receive, if they do not accept medically assisted treatment individuals in their programs. I've had a chance to attend and visit a number of programs around the City of Philadelphia. In the recovery community, one size does not fit all. You have some organizations that focus strictly on abstinence. Others focus on medically assisted treatment. And for each individual that's going through some type of recovery, they have to find the path that works best for them. And the fact that at the state level they're even contemplating talking about removing Stated Meeting February 27, 2020 already do not get enough funding as it is if they don't accept medically assisted treatment individuals into their programs, it's just simply wrong. I know Senators Street, Williams, Tartaglione, as well as Representatives Isaacson, Kenyatta, and Burgos are talking with the Governor's Office to get this resolved. This would have a very major impact in the City of Philadelphia. These programs have done phenomenal work for decades, and for them to be forced to a closure just because they focus on abstinence -- and there needs to be all kinds of programs here in the City of Philadelphia, those who do need medical assisted treatment, but also there are programs that are needed for those who need abstinence, and we need not to have a one-size-fit-all model in the City of Philadelphia. And this is not just an issue for Philadelphia.

Councilman Green

In my role as First Stated Meeting February 27, 2020 Pennsylvania Municipal League, I will also be letting my colleagues know in other cities, like Harrisburg and Norristown and Erie and Scranton who are already dealing with these same issues. I look forward to this ongoing conversation and how we deal with these issues in our city, and I'm hopeful that our leaders in Harrisburg will resolve this issue. Thank you, Council President.

Council President Clarke

Thank you, Councilman. Thank you for bringing that to everyone's attention. The Chair recognizes Councilman Thomas.

Councilman Thomas

Thank you, Council President. I just want to take a minute to thank my colleagues Councilmember Parker, Councilmember Gilmore Richardson, Councilmember Domb, Councilmember Brooks, Councilmember Squilla, Councilmember Johnson, Stated Meeting February 27, 2020 Quinones-Sanchez, as well as you, Council President, for joining me yesterday at the culmination of my Black History celebration. We have had a number of different initiatives, from the Black Business Crawl as well as recognizing those who create paths for heroes of tomorrow. The last thing that we've done is recognize those heroes of tomorrow. So joining us in Council -- and they've been here since 10 o'clock, so I commend them, and I have lunch for them -- are three young people who we actually have citations for that are heroes of tomorrow, and they're here with their family. So if they wouldn't mind standing, Ms. Aviannah Mitchell, Ms. Mikayla Newkirk, and Mr. Ramier Jones. Can you all just stand up, please. (Applause.)

Councilman Thomas

All three young people participated in a phenomenal Stated Meeting February 27, 2020 Luther King Day. They talked about how they can use their intellect and their oratorical skills to be the change that they want to see. So immediately after Council, I have their citations. Any of my colleagues who can take a couple minutes after Council to take a picture with us, we definitely appreciate it. Thank you, and thank you, young people, and thank you for your parents.

Council President Clarke

Thank you, Councilman. Thank you. (Applause.)

Council President Clarke

Congratulations. The Chair recognizes Councilman Squilla.

Councilman Squilla

Thank you, Mr. President. I usually don't give speeches, but this week we found out about Safehouse going into a site, without any input from the community, and Stated Meeting February 27, 2020 my cool a little bit at a press conference. It's usually not my style, but understanding -(Applause.)

Councilman Squilla

Thank you. Understanding that we represent both the people who are in addiction and the surrounding communities who are impacted by addiction, and it's a sad situation, it's a hard situation, but we have to stand up to protect both issues. And what happened this week is just outright wrong to be able to put something in the community without any input, whether you call it a medical emergency, whether you call it something that is necessary to save lives. We all want to save lives, and our goal is to save lives. To pit people against each other to say that people are against saving lives is just wrong, and what the Administration is doing here by selecting a site that is not only in an area that Stated Meeting February 27, 2020 center, a preschool in it -

Councilman Johnson

Two.

Councilman Squilla

-- two preschools, this is something that we need to address, because to have this -we can't have a billiards hall 500 feet from a daycare or school. We have a high school one block away. We can't have a tattoo parlor 500 feet from a school or a daycare, and yet we think it's okay to put a safe injection site in the same facility with the same building. And whether you support these safe injection sites or you don't, you have to be upset at the process, and we as a Council I think have to stand united. I want to thank my colleagues for reaching out and supporting that we believe a process has to be done, and we never have to get 50 percent support, 100 percent support to move these things forward. We have to make tough decisions, and that's why we're elected, Stated Meeting February 27, 2020 have that decision and that conversation with these communities that these sites are going in. I'm very disappointed on how this played out. We, Councilmember Sanchez and myself, actually went on a trip with some of these folks and we thought we had a great rapport with them, working with them, talking with them, not that we agree with everything that they say or do, but we are willing to work with them and look for best practices, look for ways to help more people, give us more tools in the tool shed to help people who are addicted to opioids, and to do this was just wrong. And I want to say that we'll do whatever we can as a Council to help protect our citizens and help to protect the people who are in addiction, and we want to continue to work with all of the people to make sure we right this wrong. Thank you.

Council President Clarke

Stated Meeting February 27, 2020 you, Councilman. The Chair recognizes Councilwoman Quinones-Sanchez.

Councilwoman Sanchez

Thank you, Mr. President. I want to join in on Councilman Squilla and I know Councilman Kenyatta Johnson. We've done a lot of work over the last decade and definitely over the last three years as this opioid addiction has gotten out of control, and it's very concerning when we send competing messages or contradictory messages. On the one hand, we want to meet people where they are. We want to destigmatize this issue. We want to talk about -- well, some of us want to talk about the injustices about how this problem is dealt with when the majority of the folks affected were white versus when it was black and brown people, all of those nuances to this discussion. And the one thing I've always appreciated about Councilman Squilla is that he's always been open-minded, and we've Stated Meeting February 27, 2020 open-minded in this process. I was practicing crime reduction before it became the term. I took a needle exchange program that was in a van, put it in a building, worked with the community. We educated the community, we informed them, and we created a full-fledged clinic. We asked the community, we have a homeless addiction problem. We worked with the community. We had many meetings, and I can tell you some of those meetings were very difficult. Councilman Squilla and I sat there, we took it, we worked with folks, and the Administration promised the community that they were going to take care of all of the issues around the respite centers. All of the community has in one way or another in their families have experienced the issues around opioid addiction, having lost someone in their lives. And they told us, okay, okay, and we promised them we Stated Meeting February 27, 2020 care of them. All you have to do is go to Kensington and Allegheny to know that what was historically a poor community that has always had drug problems, but nothing, nothing like we've allowed to fester there. I'm really concerned when we start talking about best practices. Councilman Green talks about this move to medical assisted treatment and it being evidence-based best practices. I'm usually not a conspiracist, but the pharmaceutical industry created this problem. Now they spent millions of dollars on studies to tell us they can fix the problem, that we will now give them billions of dollars to, for the rest of their lives, have people on their medications to counter what they did when they addicted them in the first place. Folks, I'm usually -- and I said this 18 months ago in this Council. I knew this conversation around the safe Stated Meeting February 27, 2020 coming, and I said from day one, if this is a medical intervention, it has to be in a hospital. If this is a practice that this Administration wants to support, what made the needle exchange program successful -- and I've had this debate on radio with Governor Rendell -- you lead it, you own it, you accept liability. You don't do an arm's length and put a non-profit of very well-intentioned people that I have the highest respect for. Jose Benitez is my personal friend, and we have not always agreed on everything, but I've always listened. In the last six months, we've spent time in Kensington trying to get folks motivated around what we agree as we restore Kensington. We've had advocates on both sides of this talk to each other, listen to each other, and I feel like all of the ground we gained around understanding was blown up because one or two people decided I'd rather beg Stated Meeting February 27, 2020 for permission. This is disrespectful. It is disrespectful for an Administration that continuously talks about Trump and how the federal government is disrespectful and it has lost its humanity, and we do the same thing.

Councilwoman Sanchez

Whether it's the Northeast, whether it's South Philadelphia, whether it's Kensington, people deserve a process. They deserve to have every question answered. Will a pregnant woman be allowed to go in there? Will a minor be allowed to go in there? Will people be allowed to leave fully drugged and get in a car and drive away? People have the right to listen to those answers. They may not agree with us at the end. Councilman Squilla and I know most of the time, 80 percent of the time they don't agree, but we've respected them. We've respected their role in the community, and we have allowed them to ask those questions, and ultimately, again, focus Stated Meeting February 27, 2020 that we agree. I have been told I have blood on my hands. I've been told all of those things, and we've moved away from that discussion. We've moved to a discussion about in all of these services, methadone clinics -- I get tweeted that I'm the methadone queen because we have methadone clinics in our community that I have supported because 60 percent of the folks who visit it live in that community. So that is not someone coming from outside. That is your neighbor who is going for services. We need to be able to talk to our community about the reality of this is lifetime recovery for folks, right? But now we tell them you can't smoke in recovery. Now we tell them you have to take MAT. It's contradictory messages. And so over the next few weeks, everything that we've gained over the last few months has gotten blown up, and you're going to see divisions with a Stated Meeting February 27, 2020 extremely dangerous, when you have a President that we continually talk about who has divided this country. Be a leader. If Dr. Farley and Mayor Kenney want this, own it, lead it, fund it, accept responsibility. Do not use Safehouse and a board of private citizens, all who are very well-intentioned, take all of the responsibility for this. Do not say that it's an arm length relationship. That is not leadership, and that's not going to bring people together. It's going to create the kind of division that we've seen over the last 48 hours. People of Philadelphia deserve better. This work is going to take us years. We have a decade of restoration that we have to do in Kensington. This is not going to be successful. The run to be the first is also the run to be the worst. It is not going to help people in addiction and it is not Stated Meeting February 27, 2020 communities destigmatize a lifetime journey for folks who have a mental health disease. You have blown up all of the goodwill, all of the credibility of the stakeholders and the advocates on both sides of this aisle. I call on Safehouse, don't put yourself in the middle. Do not lose all of your credibility around AIDS work, needle exchange work, all that we've been part of, that I have been part of for 20 years, even before getting into Council, for the race for the first. The residents all over the City deserve better. If eventually this becomes a model that we want to adopt all over the City to take care of our residents, let it be one where there is a process and there is respect and humanity in the discussion. Thank you, Council President.

Council President Clarke

Stated Meeting February 27, 2020 you, Councilwoman. The Chair recognizes Councilman Jones.

Councilman Jones

Thank you, Mr. President. I stand and join the concern that my colleagues have. This is not a Kensington or Frankford issue. It's not a North Philly or South Philly issue. It's a citywide issue. And they want 20 more sites. So we are cautious, concerned that without a process, we can wake up and it's decided for us and our constituents as to where these facilities will be housed. Do not make the mistake of thinking -- and I can speak for my colleagues -- that some of my best friends have been addicted. Some of my very best friends have succumbed to this drug. We in my district have a methadone clinic, which when the community at the time wanted to raise up and close it, I stood in the middle of Stated Meeting February 27, 2020 no, because these are our family members, loved ones, and friends that need this treatment. We went through a process, and I underline the word "process," to develop a good neighbor policy where you weren't going to loiter, you weren't going to just blow smoke in kids' faces that are walking down the street that we came up with, and it works. What we experienced the other day was not a process. It was put upon people. And when I say to you it's not just a Kensington, Frankford issue, we have in West Philly, Katherine Gilmore and I dealt with the issue of pill mills that were supposed to be drug stores. We have dealt with medical marijuana that is the one shoe to fall before legalization because the state and others preempt local decision-makers to be able to vet these things, and when you do that, you alienate not only the elected officials of the area but the community itself. Stated Meeting February 27, 2020 as important as the program. The process is as important as the program. And I know I can't speak for independent elected officials. We vary on this issue, but if you're a District Councilperson, you have to stand up for your district and you have to have a process that includes them. You'd be surprised how liberal some people can be, but you give them the choice to do that. You don't impose upon them. Thank you, Mr. President.

Council President Clarke

Thank you, Councilman. The Chair recognizes Councilwoman Parker.

Councilwoman Parker

Thank you, Mr. President. Let me as well take this opportunity to say to Councilmembers Squilla, Johnson, and Quinones-Sanchez, you are, in essence, on the front line here as your districts have been immediately impacted and Councilman Stated Meeting February 27, 2020 proposed location going into your district. My message is for those residents in the City of Philadelphia who are looking at that 20 number that said 20 more. So I want to just state for the record that when you hear Councilman Jones and myself and other members who do not represent those specific areas but you hear us communicate as passionately as we would for the districts that we represent, we know that it is those neighborhoods today, but it could be our neighborhoods tomorrow, the respective districts represented by each District Councilmember. In addition to that -- and I've got to say this because many of my colleagues who were with us during the last term remember that I had just a tad bit of experience in knowing what it's like when you have to fight an issue like this, and I want to say to the residents who live in your district, Councilman Stated Meeting February 27, 2020 Johnson, don't you let anybody shame you or guilt you or say that you don't have any empathy for anyone suffering from the crisis relative to opioids that is impacting our city because you say not at this location and not in this neighborhood. Don't you do that. People are going to try to guilt your people. They're going to try to say that they don't have any compassion, they don't have any empathy, but when you are a homeowner and what is going there will have an impact not just on your quality of life but on the value of what could be your only asset, you have a right to speak and you have a right to have a role. So until we've developed -- and I know from a legal perspective, you, Councilman Squilla, Maria Quinones-Sanchez and Johnson, are working through that process, but I need to know because all of the District Councilpeople, with all due respect, who don't have the ability to walk away after Stated Meeting February 27, 2020 everything -all of the unintended consequences that come from a facility like this, we will be the individuals who people say we specifically pushed that button for you to make sure that you address these issues. And so you can't walk away when the cameras are off and other people get a chance to flex their progressive muscles, as I like to call them. I don't know if they're the little P's or the big P's. They may be the little P's when the cameras and social media got active. But nevertheless, you stay strong. We're going to stand with you. And to the about 15 residents in my district who called and said how many are being proposed for our area, we don't know. We're waiting on process, but we're going to use every vehicle that we have to stand up to make sure that the people of this city have a right to have their voices heard. Thank you very much, Stated Meeting February 27, 2020

Council President Clarke

Thank you, Councilwoman. Stay tuned. So real quick, I had an opportunity to serve here a long, long time in various capacities and watch members come and go, and the simple reality is is that there's always been some consistency in terms of the people who actually don't have their names on the doors like we do and don't necessarily have city cars and all that good stuff, but at the end of the day, without these people, we don't get to do what we do. We don't get to talk about the issues as we have done. Today I'd like to recognize all of us a person who is that person, a person that actually worked here longer than me, if you can believe that. And it's a bittersweet moment. We had the pleasure of having an opportunity to serve with her for not a lot of years, Stated Meeting February 27, 2020 been a class act ever since I've known her, from the 5th floor to the 4th floor. And, Denise, we just want to say on the occasion of -- I guess your last day is tomorrow and your ability to experience retirement, which every time I talk to somebody who has retired, it's like, yes, I love this. So hopefully you will be in a position to say the same thing. We'd just like to recognize you and ask you to stand up so we can give you a round of applause. (Standing ovation.)

Council President Clarke

Thank you so much. Denise has worked and made sure that that Chief Clerk's Office ran like the trains were on time every day, the clocks ticked. And, Denise, we just want to thank you. You've been awesome. We are still trying to figure out how in the world we're going to replace you, but I Stated Meeting February 27, 2020 to do what you got to do. But just thank you so much, and God bless you. We really appreciate you so much, Denise. Thank you. Thank you. (Applause.)

Council President Clarke

And with that, that concludes our speeches on behalf of the majority and the minority, and the Chair recognizes Councilman Jones for a motion to adjourn.

Councilman Jones
