Thank you, Council President. Just a few brief remarks. During this past holiday, Council President and colleagues, I was 00:16:20 hanging out with one of my family members who is from Alabama. We had a brief conversation regarding what she witnessed growing up in Alabama, what she witnessed having family members in Mississippi 00:16:36 around our ability and our civil rights to vote. And so I introduced these two resolutions today symbolically advocating for the John Lewis Voting Rights 00:16:47 Jan 20, 2022 Stated Meeting January 20, 2022 Advancement Act and the Freedom to Vote Act primarily just to go on the record to state that we should not be putting forth obstacles and barriers as it relates to 00:17:00 us having the ability to go to the voting booth and, most importantly, cast our ballots. And so I just want to read just one brief portion of the resolution I'm 00:17:12 introducing to kind of highlight how critically important these two Acts are. The demographics of the voter turnout gap are not coincidental. They are, in large part, due to a 00:17:30 longstanding, sustained campaign to restrict access to the ballot. In a 2018 report on minority voting rights access, the United States Commission on Civil Rights found hundreds 00:17:40 of harsh and restrictive voting policies had been enacted in at least 23 states, including voter identification laws, voter roll purges, proof of citizenship measures, challenges to voter 00:17:57 Jan 20, 2022 Stated Meeting January 20, 2022 eligibility, reduced early voting opportunities. And the Commission also found that these policies have a disparate impact on voters of color and 00:18:07 poor citizens. Such laws have also had an impact on younger voters by creating additional hurdles, such as residency requirements and strict voter ID laws, 00:18:18 which impact their turnout at the polls. A 2014 Governor Accountability Office study found that strict photo ID laws reduced turnout by two to three percentage points, which can translate 00:18:31 into tens of thousands of votes lost in a single state. And I know we are in City Council, and I believe that all politics are local, but I thought it was 00:18:40 imperative that we send a strong message to those who are legislating in Congress and also in our Senate to make sure that they are doing everything possible to pass these two Acts. 00:18:54 Jan 20, 2022 Stated Meeting January 20, 2022 It's critically important that nobody should be hindered when it comes to going to the poll and casting their vote. 00:19:02 So I just want to ask all my colleagues for their support, and I just want to go on record stating these comments. Councilman Domb offers one bill and one resolution, entitled "An ordinance amending Chapter 00:19:48 Jan 20, 2022 Stated Meeting January 20, 2022 19-4000, entitled 'Income Inequality Initiative - Earned Income Tax Credit,' by requiring employers to provide notification to workers regarding the 00:20:00 availability of certain additional federal and City tax benefit programs and extending the Department of Revenue's notification and reporting requirements to such additional tax benefit programs;" 00:20:08 and A resolution honoring the life of Jeff Guaracino, Chief Executive Officer of Visit Philly, who brought the City into the national spotlight as a 00:20:20 destination for tourism and whose work championed the lives of LGBTQ+ individuals and welcomed all to Philadelphia. Thank you, Council President. I'd like to speak on 00:20:38 Jan 20, 2022 Stated Meeting January 20, 2022 the legislation first and the resolution second. The legislation I'm introducing today is a tax refund notice legislation 00:20:45 that will require employers to notify their employees about the Philadelphia wage tax refund, the federal child tax credit, and in addition, the EITC program, which is already required in our 00:21:00 Philadelphia Code. These programs were created really to help people who are doing their best every day to put food on their tables and pay their bills. We cannot continue leaving this 00:21:11 money on the table. It's unspent money that deserves to go into the hands of our Philadelphia residents. So this legislation requires employers to notify their employees of 00:21:22 these opportunities, and we've created in this body this opportunity and the federal government by ensuring that they're made aware of what's available to them. 00:21:33 Jan 20, 2022 Stated Meeting January 20, 2022 I want to thank my co-sponsors on this legislation, Councilmember Johnson, Green, Gilmore Richardson, Brooks, Gauthier, Thomas, and Gym. This is regarding the passing of Jeff 00:22:08 Guaracino, our Chief Executive Officer of Visit Philly. Jeff made a reputation for himself as being a passionate advocate for Philadelphia that went well beyond 00:22:19 the City of Philadelphia. His work as a tireless advocate for the LGBTQ+ tourism Philadelphia really defines his legacy. In fact, in 2003, Jeff spearheaded a campaign encouraging visitors to come to 00:22:34 Jan 20, 2022 Stated Meeting January 20, 2022 Philadelphia with a commercial about a fictional gay colonial couple meeting for a date at Carpenters Hall. The advertisement, many of you will remember, 00:22:46 it was one of the first of its kind in the country, and it said, visit Philadelphia and get your history straight and your nightlife gay. And it worked. Philadelphia became known as a 00:22:57 safe and welcoming space for the LGBTQ+ community at a time when the rest of the country was still deciding if it was for or against basic rights like gay marriage. 00:23:09 Jeff's strategies were some of the first ever seen in the country and will have a lasting impact on our hospitality industry on a global scale. But above all, Jeff will be remembered as 00:23:18 one of Philadelphia's proudest residents who spent his professional life sharing our city's greatness with other people and encouraging them to visit and see it for themselves. 00:23:30 Jan 20, 2022 Stated Meeting January 20, 2022 Jeff was the kind of person you could count on in the City professionally and personally. I'm curious -- 00:34:09 I'm at the corner of 6800 Ridge Avenue, and first off, I would like to understand how the properties, how the six properties in the corridor from Livezey to Fountain Street were chosen. 00:34:20 I have a property here that had just gone through zoning, and I had been down into Council over a year, year and a half with proposals to extend my eat-in restaurant area, and it was approved 00:34:34 through the Council, and now what I'm being asked to do is to basically change the zoning of my property and basically change me back on something that I was not at all aware of. 00:34:46 Jan 20, 2022 Stated Meeting January 20, 2022 I had just closed all of my permits on the property a little over ten months ago on the expansion, which had taken me about three years. And we're 00:34:55 definitely in the middle of COVID, and I'm trying to understand why at the time of the struggles of the pandemic and COVID in Philadelphia we have to be going through something that potentially could 00:35:07 be upheld after this COVID pandemic is up. This building that I'm in now, the restaurant/cafe, has been a restaurant/cafe zoning for over 00:35:17 100 years, and I just need someone to explain to me what this would do to my zoning in the property at this time. I know Josh and I know Mr. Jones, and they have been local 00:35:31 people here in support of all the activity on the Ridge corridor here, and this Ridge corridor has been an expansion project for over ten years, and it goes all the way back to the Roxborough 00:35:42 Jan 20, 2022 Stated Meeting January 20, 2022 Development Corporation's plans over ten years ago to expand this -- to expand the corridor for commercial uses as well as public -- addressing some of the shopping 00:35:53 districts. And I'm trying to figure out in the community how this ordinance was being proposed without the knowledge of those entities and the civic groups. I'm sorry. I just don't think that this is 00:36:07 right at this time. My property next door at 6802 is already historic, which means that they -- and the ones next to me, the lots, are already down. So all of the 00:36:17 expansion on my block is pretty much taken over, and I can't understand why we deserve this all the way through the pandemic. I'm one of the owners of 00:36:59 Fountain Street Auto Repair, one of the affected properties in the six parcels that are zoned. We own two of them. As Chaz just said, I don't understand. I thought we were trying to 00:37:08 get more affordable housing in Philly. They just approved a hundred-unit building next to my building. I'm the corner lot at the traffic light. The other lot is in the middle of the 00:37:19 Jan 20, 2022 Stated Meeting January 20, 2022 corridor, but it is attached to my building, and that was approved, and now we are being told that we're going to be downgraded and now we won't be able to 00:37:26 legally do auto repair. We'll be grandfathered in, but in the future, it could be an issue. We want to expand the business, which is already two weeks to get an 00:37:35 appointment for your car for the neighbors. We're going from 75 to 60 percent, and I just don't understand why these properties were picked. If we had an issue with this, then why wasn't all 00:37:46 of Roxborough included, not just the few properties. There's other properties that are across the street from me that had lower grade zoning that weren't approved 00:37:55 for apartments that got -- City Council approved the zoning and upgraded them so they could put apartments. You know, I don't understand this. I wasn't told about it. None of 00:38:07 Jan 20, 2022 Stated Meeting January 20, 2022 the property owners were or the Roxborough Development Corporation. We actually found out through a builder. And you're hurting a lot of 00:38:14 businesses that have been around for a long time. I just don't -- I can't understand what we're doing here, what we're trying to gain of doing this to the commercial corridor. I thought we were 00:38:24 trying to expand Ridge and not downgrade it. I respect Councilman Jones and Josh Cohen and they've been great. They've been responding to me, but I just 00:38:33 can't get clear answers, and I don't understand why this is being done and why we're being picked on here. You're going to approve a hundred-unit building next to us and then we can't even expand our 00:38:42 auto repair shop. Thank you, everybody, for your consideration. I own Pastore Auto Tags and Insurance on the Ridge Avenue corridor in Roxborough. Bill 210922 will rezone my 00:39:13 commercial property from a CMX-2.5 to a CA-1, which will greatly decrease my property value. This is just not fair. The past five years, ten years the City sat by and watched developer 00:39:27 after developer knock down all buildings and build up monstrosity apartment buildings in their place in our small community, and now finally after they've done all that, they want to put a stop to 00:39:37 Jan 20, 2022 Stated Meeting January 20, 2022 it, but at the expense of the loyal family-owned businesses like me and Fountain Street Auto who have been here for 50-plus years, who didn't sell out. 00:39:46 Instead of commending the businesses that stayed here and tried to keep our community the way it is, they want to punish us by rezoning us and decreasing our property value, and that's just not 00:39:56 fair. It's just not right. If their main goal was to benefit the community, I don't know why it was kept such a secret, like Chaz and Brian just said. I don't know why none 00:40:05 of the property owners were notified. We had to find out about it through a developer. I mean, it's just frustrating. Thank you, Council President. The pandemic has been a really challenging situation that all of us have dealt with in so many ways. In many ways 00:44:59 I would say no industry has been impacted more than the hospitality industry by the pandemic. If you just look at our hotels in 2019, we were about 76 percent 00:45:10 Jan 20, 2022 Stated Meeting January 20, 2022 1/20/22 - STATED - 2ND READING occupancy rate. That fell to about 31 percent in 2020, which is about a 60 percent decrease. That also resulted in a loss of hospitality jobs in our 00:45:22 city, going from 79,000 jobs to about 48,000 jobs, and hospitality jobs in the City of Philadelphia is a significant issue, and based on the pandemic, we lost a significant amount of jobs. About 00:45:38 40 percent of jobs in the City of Philadelphia are in the hospitality industry. So this Philadelphia Hospitality Improvement Levy came 00:45:45 together through a real collaborative relationship. Our former Commerce Director, Harold Epps, our former head of our Convention and Visitors Bureau, Julie Coker, working with Ed Grose from the 00:45:59 Greater Philadelphia Hotel Association, all coming together to support this legislation. And through this initiative, no City dollars have been used, and what we've basically been able 00:46:11 Jan 20, 2022 Stated Meeting January 20, 2022 1/20/22 - STATED - 2ND READING to do is increase through a small fee, roughly about $1.50 for a $200-a-night fee -- hotel stay, excuse me, been able to really provide resources to help grow 00:46:23 our hospitality industry, and that's so important right now as we are trying to move out of this pandemic. Through the PHiL, we've been able to support a number of COVID relief 00:46:35 efforts through the Convention and Visitors Bureau. Earlier Councilmember Domb talked about the resolution for our late, great ambassador, Jeff Guaracino, and the PHiL was able to help the Visit 00:46:47 Philadelphia's hotel care package as well as PHL Care's homeless initiative. There are about 160 national PHiL programs similar to ours in a lot of our cities that are peers, but many of 00:47:02 those have much larger programs than we have. So through this small increase, I believe we'll be able to help to really bring back our hospitality industry in a way that was needed, in a way to bring 00:47:14 Jan 20, 2022 Stated Meeting January 20, 2022 1/20/22 - STATED - 2ND READING back jobs to the residents of the City of Philadelphia who have really been hurting because of the pandemic, and I hope all of my colleagues will support this 00:47:23 legislation. Always the right time to do the 00:49:12 right thing. And so in Roxborough, which is a small town inside of a big city, people have discovered it and want to over-develop it. And so if you look up and down the Ridge, historic properties 00:49:30 have been torn down to become Wendy's. Historic properties have been torn down in order to put multi-unit condos on them. And I respect and appreciate those businesses along the Ridge that held out 00:49:49 and didn't do the wrong thing by selling out to put 50 condos on a property. Yet when they say that they would now like to take an assessment to consider some of those offers, well, some 00:50:07 Jan 20, 2022 Stated Meeting January 20, 2022 1/20/22 - STATED - 2ND READING of the neighbors in the neighborhood have to deal with traffic every day. They have to deal with parking issues every day. I remember a shift nurse telling me 00:50:17 that she had to park three blocks away from her house in order to find a parking space. I have to address those issues, and I don't want it to be at the detriment of existing businesses. 00:50:34 So this bill allows them to continue being auto repair places. It allows them in perpetuity to continue to be those types of business. What it does shut down is the door of over-development 00:50:47 on those properties on the Ridge. And as the only third-party Councilmember on Council, I'm eager to continue challenging the status quo and expanding our ideas of what is 00:55:23 politically possible. I take seriously the powers entrusted to each of us and recognize the great responsibility that comes with that. But the reality is that our local governments cannot adequately 00:55:38 deliver on our promises for a better Philadelphia unless the fabric of our democracy is intact. It has been just over a year since right-wing extremists, emboldened 00:55:49 Jan 20, 2022 Stated Meeting January 20, 2022 Trump, stormed the Capitol in an attempt to overturn the results of a presidential election. And since then, attacks on the rights of 00:56:00 voters, and particularly working-class, poor, Black and Brown immigrants and elderly voters, have sharply increased across this country. And we know that these attacks are coming from the right. 00:56:12 Across the country, the republican party has demonstrated that it is an anti-democratic party, and as we see some of the most important voting right legislation of our time being 00:56:25 rejected by the GOP legislators, we can say it doesn't come by surprise, but it does not mean it hurts any less. Last year I passed a resolution recognizing the 65th anniversary of the 00:56:39 Voting Rights Act and urging U.S. Senators to pass the John Lewis Voting Rights Advancement Act, and today my colleague Councilmember Johnson introduced a resolution renewing this 00:56:53 Jan 20, 2022 Stated Meeting January 20, 2022 to pass these commonsense pieces of voter right legislation is a disservice, not just to 00:57:02 the memory of John Lewis but to other leaders of the Civil Rights Movement, but it's a disservice to the future of this country. So it is with this 00:57:15 determination that I commit to the work ahead of us as a public servant of the City of Philadelphia, and it is with grave concern that I monitor developments at the federal level and hope for a 00:57:28 national grassroot movement to emerge in response to right-wing attempts to tear down our democracy. We have overcome more in the past, and I know firsthand that power and 00:57:40 voices of the people are far greater than the hateful actions of a select few. Thank you, Council President. I just want to remind colleagues and other staffers in City Council that today at 12:30 we'll be 00:58:16 having a briefing on the City's transition plan under the Americans with Disability Act. That will be today at 12:30 on Microsoft Teams. I hope everyone can participate and learn about 00:58:28 the great work that we are doing in the City to be in compliance with the Americans with Disability Act. Also, as I reflect on the end of last year and I think in the last 00:58:42 Jan 20, 2022 Stated Meeting January 20, 2022 in Council, talked about the issue of gun violence in our city. We all know that we had a horrific number, 562 homicides in the City of 00:58:52 Philadelphia, and I talked about the need for both reform and accountability and safety and justice, and I just wanted to bring up the recent op-ed that our Controller issued and really kind of 00:59:10 endorsed and echoed those type of sentiments. The fact that our Police Department has increased the number of gun arrests; however, in 2020, only 00:59:22 37 percent of all fatal shootings were cleared. Only 27 percent of non-fatal shootings were cleared. So although we've made increases in arrests, we're still woefully inadequate in reference to 00:59:37 the clearances that we need in the City of Philadelphia. In reference to the District Attorney, once again, I've supported the work that our District Attorney has done 00:59:47 Jan 20, 2022 Stated Meeting January 20, 2022 Conviction Integrity Unit and bail reform, but when you look at the information that the Controller put in her op-ed, we've had a significant 00:59:56 reduction in the conviction rates for violation of the Uniform Fire Act, from 65 percent to 42 percent, and that's based on information from the District Attorney's Office. 01:00:10 So we need to do a much better job. We need to work collectively together to address these issues. I know as we go into our budget debates and discussion, all of us as members of this 01:00:21 body will be focusing on how we provide more resources regarding gun violence in our city, but it's incumbent upon all of us to work collaboratively together so that we can do both safety and justice 01:00:35 and also do reform and accountability. And that's something that I think we need to move forward. That's also something that started happening in a number of cities around this nation to address the 01:00:49 Jan 20, 2022 Stated Meeting January 20, 2022 violence that's impacting cities in our nation. On a slightly more positive perspective, I've got some great news 01:00:59 this year as we come into 2022, and when we have all of these challenging issues that we've been dealing with, from the tragic Fairmount fire to the number of gun violence incidents we've had in our 01:01:11 city, we need a little more love and healing. And so Love and Healing is the fifth album from Hill-Freedman Records. And Hill-Freedman Records is a record label from Hill-Freedman World Academy in 01:01:27 the Ninth Council District. It's their fifth studio album of 32 original songs from students at Hill-Freedman. This record label is run by a great music and technology teacher, 01:01:42 Ezechial Thurman. He's done great work at Hill-Freedman. He also did great work at Houston Elementary School. One was Ernest and one was Taylor. Both of them came in the schoolyard. And Taylor really learned very quickly that 01:03:28 the big boys were going to take his lunch money. He did not resist. He gave it up. He went in every day, but he was on the Jenny Craig diet through the years that he went to that school. 01:03:43 Jan 20, 2022 Stated Meeting January 20, 2022 every other morning wound up in a fight, and he could not fight, Mr. President. He got beat up every time, but he kept fighting. 01:03:53 And eventually the guys said, you know what, we're going to leave Ernest alone. We can just victimize Taylor. He's easy. He doesn't resist. Let's just take his lunch money. Ernest took a lot of 01:04:07 lickings, but eventually he was relieved of being victimized by them. I say all that to say that sometimes when we're dealing with the courts, sometimes when we're dealing with 01:04:19 the state powers that be when it comes to governing our own city with anti-violence measures, whether it's gun laws and things like that, we get beat up, but we keep fighting, Mr. President, and we let 01:04:36 them know that we're not going to stop fighting for the safety of our city. Today this body took a step in fighting back, and it's related to gun violence, by governing the stores that 01:04:53 Jan 20, 2022 Stated Meeting January 20, 2022 Member Bass and other members have stood up about how the disrespect that happens sometimes in our corner stores, whether they're selling 01:05:08 drug paraphernalia, whether they're selling liquor by the drink, whether they're selling with a code word actual weed. And so when we look at the 01:05:21 rogue gambling machines that are in our community that don't have to tell us where they are, don't check for ID when kids come in to play it using their lunch money, when seniors who get their Social 01:05:40 Security checks come in and waste money in a payoff that is already rigged, we don't have tax revenues for it, we don't have rules governing it, today we put a stop to that. And Member Gilmore will 01:05:55 appreciate how our former colleague, Blondell Reynolds Brown, used to always go to the industry to try to seek compromise. We did that, Mr. President. We talked to them and talked to them, and 01:06:12 Jan 20, 2022 Stated Meeting January 20, 2022 is a stalling tactic. There is a court case that is in the state court where they are being told that as long as there is no ruling, there 01:06:24 is no law governing their industry. We just took a step in the right direction, but we aren't done. We have to enforce this law. That means L&I, that means places like the Health 01:06:40 Department, that means like the Liquor Control Board need to form a task force, go into some of these stores and say they're not doing this right. There are laws on the books that govern how you are 01:06:54 to conduct your business to keep our citizens safe. So it's not just checking grease traps. It's not just checking for the BOCA code on electrical systems. It 01:07:06 is making sure that you do not create hunting grounds in these corner stores where our children, our citizens are being victimized because we don't take the laws that are on the books to 01:07:23 Jan 20, 2022 Stated Meeting January 20, 2022 stay tuned. Until we do, when we go up 01:07:34 and ask about lost and stolen guns to the courts up there, they look at us and say, you got a lot of laws on the books right now.
