and then you can see here where we are so the corner property is the duplex and then you can
see on the west thompson street these are the single families and they want to see a night
these are the single families and they want to see a night perspective as well
perspective as well.
and then this is west thompson street again these are the single families and then this
is the basically the rear yard of 1917 ridge so i just wanted to take a look about the let's see
okay so for the rear yard issue or um just want to take a look for lot a which is the duplex
it says that we have an where we have a rear yard uh setback requirement of 90 feet we're
three and a half feet but you can see that um it's because of our irregular shaped lot here
that if you look at it, really, we have a substantial side yard here.
But because there's a regular shape lot, they're counting this three and a half feet here as our rear yard depth,
where you can see on either angle, we far exceed the nine foot rear yard.
And then the other part is, again, for 1919 and 1921.
they also counting this little sliver here as part of for 1919 and for 1921 they count this
sliver as well over here technically under the code but as you can see because of this irregular
shape if you look at this part of the rear yard or this part of the rear yard we fall well within
the seven foot rear yard setback requirement so that's basically our case in nutshell on mr azran
hello how could you state your name please jack azran proceed counsel mr azran you heard everything
i had to state about this zoning matter today yes and it's true and correct yes and do you adopt
if you're going to pass money.
All right.
So this grouping here
is two single homes
and a duplex.
Am I right?
That's correct.
Questions from the board?
No, Mr. Chairman.
No, Chair.
Questions or comments
from the virtual audience?
I see no hands, Chair.
Planning Commission.
The Ron Bednar City Planning
and Comprehensive Plan
recommends no change
to the residential zoning
at this location.
the applicant's proposal to replat three existing lots to make two more code compliant
that they are now. The shape of these lots presents a clear hardship and that the applicant
replatting would bring two of the three lots closer to conformity with the zoning code. Therefore,
we recommend that the board grant a dimensional variance. Thank you. MI 2022-004-679-1917

19th Street.
Let me just make sure
I have a most recent version.
This is for
single household living?
For single families
on the R&M box.
Again, we can have more units
if we combined it into an apartment building.
But again, what was asked of us
is to provide affordable housing
of a single family nature.
And that's what we did at 1306-10 North 19th Street.
So quickly the notice of refusal,
they're all technical in nature.
What we did was create almost like a little community
in itself where there'll be two homes in the front
and two homes in the rear.
There's all these like easements
where there are walkways,
where there's ample space.
And it's just going to create a sense of community instead of having like a five unit apartment building, which, you know, you know, the city didn't want, they wanted single family homes, we found a unique way of creating that.
So all these refusals about like, we don't provide minimum, you know, the minimum street frontage, and things like that are all technical in nature.
I'm just going to go through the plans really quickly, but this is, you know, again, 19th Street.
It's going to go through the plans really quickly, but this is
This is 1306-10, so we'll go through that.
And again, what we're offering is single-family homes.
So again, you can see these are the two front single-family homes.
There are two single homes in the rear.
we have this beautiful gate with a little like short brick planters and there'll be a little
garden area in the middle and a pathway that will benefit all four homeowners who will be able to
purchase property under affordable rates. Again, all great facades, nice stone bases, and they're
all single family in nature so and then the lot sizes are characteristic of what you would expect
on 19th street similar to what the board just granted in terms of reverence so with that being
said i would ask that mr uh azran virtually raise his hand one last time jack azran
hi jack you heard everything i had to say about this project
is that correct yes it's true is it true and correct what i said yes and do you adopt it as
your own testimony yes all right thank you questions from the board no mr chairman no chair chair
questions or comments from the virtual audience
i see no hands chair planning commission from bednar city planning the prop the comprehensive
to plan recommends no change the existing residential multifamily zoning dislocation.
The applicant proposes building a quad, two buildings with frontage on 19th Street and
two buildings behind. First, two whose only access would be a pedestrian easement out of the street.
This raises a public safety concern. A lot of pedestrian walkways out of the 19th Street would
be new flag lots, which are prohibited by the code. It's exactly the condition that we would
highlight when requesting a blight certification from our commissioners. Therefore, we recommend
the request for variance not be granted. Mr. Natham, does he want to respond to that?
Yeah. I mean, so again, it was asked of us to provide single family homes for this property.
So in order to do that, we actually lessened the amount of units that were allowed as a bright
by RM1 so this is something that was requested of us that was blessed by the city by you know by the
land bank or RDA as well as city council so all we're proposing is a variance that has already
been blessed previously okay thank you MI 2023 000 359 1306 north 19 street I vote yes

You swear or affirm to tell the truth, the whole truth and nothing but the truth.
Yes, I do.
Yes, I do.
Our vice chair has a few questions.
Good afternoon, counsel.
Do you agree to waive the reading of the refusal and stipulate to its accuracy?
Yes, I do.
Have you emailed all the required documents and exhibits that are needed to proceed with this case five days in advance of this hearing?
I have to follow up with Ms. Emerson on some tax information.
I'll just please proceed and share the screen.
Good afternoon, commissioners.
Can you see my screen?
We can.
Great.
Okay. Commissioners, I filed an application for 513 East High Street on behalf of Crinell Properties to legalize an existing auto body fender repair and paint shop.
I'd like to give you a little background history on this property.
First, I'm just going to go over my little syllabus that I prepared for you today.
I do have documents which consist of approximately 43 pages.
I've submitted the permit application, the refusal, the appeal, the property information form, deed, tax information, property history, plans, pictures, community flyer, certificate of mailing, letter of support from Faith CDC, letter of non-support from Bellfield and Chew neighbors.
And I also have a letter of support from Councilwoman Cindy Bass.
Commissioners, this property is an RSA 5 property.
I'm going to show you the refusal here.
It's been an RSA 5 for some time, but it has been used in a commercial fashion since approximately 1941.
I'm going to show you the zoning history of this property,
which will reveal that it's been a commercial garage
at least since 1941.
And it's been used as an auto body paint and repair shop
at least since 1948.
I'm going to scan down to those documents right now.
Just give me a moment.
So here's the first document I'd like to show you.
You'll see here that this zoning document is dated 1941, and it'll show you that this
property was used as a garage in 1941.
The second document here I would like to show you is an additional L&I document, and you'll
see here 10-7-48 that it was a one-family dwelling.
it was an auto body and fender shop. You'll see here in 1960, again, it was auto body,
fender, and a paint shop at that time. Commissioner, this case actually came before you
in 2019. Faith CDC, the community organization, heard it and gave it a lot of support.
You actually did grant our use, but there was a proviso that we weren't able to keep up with at
the time. You'll see this is the zoning use permit, but the proviso indicated that we must
obtain our certificate of occupancy within nine months. Commissioners, this approval was late in
2019. And of course, we all know that in 2020, COVID hit and most things stopped. We really
weren't able to put the correct information in and get the certificate of occupancy. And frankly,
the applicant had several unfortunate experiences, deaths with his daughter and his father, which
waylaid his process. But here you can see we actually did get the zoning permit in 2019 as
for the same exact use that we are requesting today. I'm going to scroll down now and I just
want to show you an old plan that was also in the zoning file. This property has always been used
this way, residential in the front, and there's a big commercial building in the back of this
building, which I'll show you pictures of a little later. I'm going to scroll down now to the plans.
I'm going to go to the picture first. Here's a picture of the posting, and here's a picture of
the front of the property, and here you can see there's a driveway which leads back to the
commercial facility in the back. I'm going to scan it down a little bit more and give you a better
to look at the pictures of the property. Here's the other side of the property and you can see
Here's the other side of the property. And you can see the houses in the front, which is a residential property. And there's a large commercial facility in the back. Again, I'm just going to give you another view of this property. And you can see this is the driveway up into the property. We do park cars along the driveway and in the back here. And there's a big commercial space in the back of this property.
the houses in the front which is
Also, just while we have this picture up front, we do have our own dumpster that we roll down to the bottom of the street on trash day and it's rolled up back to behind the property when the time is right.
I'm going to scroll down now, Commissioner, to the plans for the property.
Here is the plan that we have for you here today.
And as you can see, it's a pretty big commercial property here.
Just move this a little bit here.
here we go so as you can see this is in the this is just the floor plan for the commercial space
of the property this was the driveway you would drive up here and you can go into the commercial

we have a state-of-the-art paint booth in the back of this property there's also another way
to get in the property here through a roll down door and up front here we just have two commercial
offices for administrative purposes as well as a restroom on the side over here now I'm going to
scroll down and show you a couple pictures of the inside of this property I'll just show you a

are and this is an outside view of the offices
