Good morning. I note that the hour has come and that a quorum of this Council is present. Council will please come to order. Members will take their seats, and visitors will retire to the seats outside the rails. To give our invocation this morning, the Chair is honored to recognize Reverend Dr. W. Wilson Goode, Sr., Minister of Administration of the First Baptist Church of Paschall. He is here today as the guest of Councilman Goode. At this time, I would ask all members and guests to please rise. (Members and guests rise.)
It is wonderful to be here and to see all of you, and I just want to report that it is a very, very joyous and happy life after the Mayor's Office. Let us pray. God, we come to you this morning on behalf of this city, our city. We weep for our city, just as you weeped for the city of Jerusalem. We come especially to pray for our children, those who live in dins of dope rather than homes of hope. We pray for our children who woke up this morning hungry but had no food. We pray for our children who woke up this morning in homeless shelters with very low hope for the future. We pray for our children who are in classrooms eager to learn but don't have teachers who care whether they learn or not. We pray for our 40,000 children in this city who woke up this morning with one or both parents in prison. We pray, oh, Lord, for our children who drop out of school, forty-six percent of them, with low hope for the future. We pray for the Mayor of this you, Lord, to give him the wisdom and discernment he needs to lead this city through these difficult financial times. And, yes, Lord we pray for this Council, each member, one by one. God, you know them. You know each of them. You know their names. You know everything about them. You know their hearts and you know their motives. We pray for their wisdom, for their faithfulness, for their integrity and discernment, and, God, if it be your will, let Council and the Mayor be on one accord. God, I know I am asking for a lot, but you remind us in your word that we should pray for our cities. So this morning as I weep for the City of Philadelphia, the city I love, I can only turn to you to give those who govern the wisdom to navigate us out of these difficult times. So, God, we put this in your hands, those who are dropping out of school, those who are living in homeless shelters, those who wake up hungry, those who live in neighborhoods of violence and not neighborhoods of peace, those who cannot read above the fourth grade level, more than half of our citizens. We know of your track record, Lord, of making the impossible possible. We ask that you do it again right here and right now in this City Hall. For this morning, we conclude amid our weeping, just by praising you because you're worthy of all the praise that we can give to you. Glory to your name. We pray in the matchless name of Jesus who is the Christ and for his sake. Amen. (Amen.)

At this time, the Chair recognizes Councilman DiCicco, who will present a resolution recognizing the United States Coast Guard. Will Captain Todd Gutlin and those accompanying him please join the Councilman at the podium. I see that Councilman DiCicco is being joined by Councilman Kenney. COUNCILMAN DiCICCO: Thank you. Good morning. This is a resolution recognizing and appreciating the United States Coast Guard Sector Delaware Bay for protecting the region's ports, providing maritime safety, policing our waterways and the numerous other functions the officers and crewmen of the Sector perform. Whereas, the United States Coast Guard Sector Delaware Bay works closely with other local, state and federal government agencies, as well as community to ensure the safety, security and stewardship of the port receiving annually over 3,000 vessels, one million barrels of crude oil and $51 billion in cargo; and Whereas, Sector Delaware Bay encompasses the mid-Atlantic coastal area from Shark River, New Jersey to the Delaware-Maryland border, including the ports of Philadelphia, Camden, Wilmington and other smaller ports on the Delaware River. The area of responsibilities also covers over 145 miles of coastline; and Whereas, in a typical year, Coast Guard Sector Delaware Bay performs 1,100 search and rescue cases; 319 maritime casualty (accident) investigations; 4,397 recreational vessel boardings; 197 commercial fishing examinations; 3,679 foreign vessel safety and security examinations; 766 domestic inspections; 1,068 federal Aids to Navigation maintenance operations; 4,772 boardings; 254 pollution responses, which includes overseeing approximately $1 million in federally funded clean-up initiatives; as well as other duties too numerous to mention; and
Whereas, Captain Meredith Austin, U.S. Coast Guard, assumed responsibilities of command for Sector Delaware Bay in June 2009 as the first female commander of the Sector. As Captain of the port, Federal Maritime Security Coordinator Officer in charge of Marine Inspections, Mission Coordinator and Federal On-Scene Coordinator, she commands a staff of more than 750 military and civilian personnel in carrying out all of the Coast Guard's principal activities of marine safety, security and environmental protection, maritime law enforcement, search and rescue, and waterways management; and Whereas, the Sector office, located in Philadelphia, PA, serves four functions. First, it is the Operational Guard activities within the Sector's area of responsibility. Second, it serves as the support element for all activities and personnel assigned to the Sector. Next, it is the home base for personnel conducting marine safety, security and environmental protection operations. Finally, the Sector's command center operates as a 9-1-1 call center and serves as one-stop shopping to initiate a Coast Guard response to events in the maritime domain. Now, therefore, be it resolved, that the Council of the City of Philadelphia, recognize and appreciates the United States Coast Guard Sector Delaware Bay for protecting the region's ports, providing maritime safety, policing our waterways and the numerous other functions the officers and crewmen from the Sector perform. Further resolved, that an engrossed copy of this resolution be Austin as evidence of the sincere sentiments of this body. Thank you very much and welcome. (Applause.)
The Chair recognizes Captain Gutlin for remarks. CAPTAIN GUTLIN: Thank you, ma'am. Thank you, Councilman DiCicco. Thank you, Councilman Kenney, who I understand father served in the Coast Guard.
In the reserve, yes, at your location. CAPTAIN GUTLIN: At our location. Thank you. This resolution means a great deal to us. I am not Captain Meredith Austin. Captain Austin is deployed with a contingent of our personnel to the Gulf. Since 1791 when the Revenue patrolling the Delaware River, the United States Coast Guard has had a continuous presence in this area. Today, in our entire area of responsibility, we have over 1,000 Coast Guard members and over 2,700 Coast Guard auxiliary members, as a voluntary organization, that helps us serve in this area. In Philadelphia alone, we have over 400 active-duty reserve and civilian members, along with another 100 auxiliary members. We're very proud of what we do in safety, security and stewardship. However, we couldn't do this without our partners. In Philadelphia, we're blessed to have our partners such as Maritime Police and Maritime Fire Department, as well as the City planners whose planning efforts are helping to keep our base secure. The Coast Guard members in this area and our families are also supported by some amazing organizations such as the USO, the Fleet Reserve and the Navy League, and the Navy League is represented today by Ms. Fran O'Brien. For members who are not from this area, having that kind of support for us and our families is nothing short of extraordinary. So we thank you for this resolution. I would like to invite the Councilmembers to come down to your base in Philadelphia. I think you'll be impressed with the young men and women that are down there. Thank you very much. (Applause.)
The Chair now recognizes Councilwoman Reynolds Brown, who will present a resolution recognizing Zarwin Baum DeVito Kaplan Shaer and Toddy, PC on the occasion of their 50th Anniversary. and Mr. Norman Zarwin and those accompanying them please join the Councilwoman at the podium. And I see that Councilwoman Brown is being accompanied by Councilman O'Neill.
Thank you, Madam President. To members of Council and our guests, I am always struck by members of our corporate, business and in this case legal community who do well and then choose -- and I repeat choose -- to do good, and we know that often happens because of the quality of the leadership. Secondly, what I've learned is that Martha Graham said first, The only sin is mediocrity, and what I've come to know about our guests today is that in all that they do, they do with a sense of excellence. Lastly, I'm thrilled to know or thrilled to report that this firm has chosen, after 50 years, to remain in the with their recent move to 1818 Market Street, and, of course, we're always happy when we learn of business leaders who choose to stay in our city. So it gives me great pleasure, along with my colleague Councilman Brian O'Neill, to recognize and congratulate Zarwin Baum DeVito Kaplan Shaer and Toddy, PC on their 50th Anniversary. Whereas, in 1960, sitting around a musty conference room at the Land Title Building at Broad and Sansom Streets in Philadelphia, Norman Zarwin, Harris Baum and Lionel Prince decided that it would be easier to practice law as partners than as solo practitioners. They soon formed the law firm that 50 years later would be known as Zarwin Baum DeVito Kaplan Shaer and Toddy; and Whereas, the firm's humble beginnings belie the sophisticated 50-attorney law firm that currently sits in its meticulously appointed 13th floor at 1818 Market Street, and riding the waves of economic times, good and bad, the firm stayed true to the founding partners' goals of hiring top talent and providing excellent legal services at fair and competitive rates;
Whereas, the firm has grown and prospered during the past five decades, expanding to three satellite offices in Bethlehem, Jersey City and Marlton. It has a diverse list of practice areas that include real estate, corporate, commercial litigation, environmental, banking, immigration, estates, custodial abuse and neglect, employment law, casualty defense and personal injury; and Whereas, the law firm has always been fully committed to Philadelphia. Many of the members of the firm are extremely active in charitable, political and civic organizations. The leaders of the firm strongly advocate its employees. Included in this is the firm's charity-of-the-month program, the Annual Turkey Give-Away to needy Philadelphia families and its March Madness Networking Event benefiting the local food bank, Philabundance; and Whereas, Norman P. Zarwin has been actively involved in a variety of charitable, philanthropic and civic organizations, serving as an officer and/or board member for Golden Slipper Club and Charities, Jewish National Fund Council of Philadelphia, Society for the Jewish Aged, B'nai B'rith and Jewish Federation of Greater Philadelphia. He has also served as Chairman of the Scholarship Foundation of the Union League; and
Whereas, Harris Baum is Honorary Consul General for the Republic of Korea by appointment of the United States State Department and the government of Seoul, Korea working to between Korean and Pennsylvania business in order to mutually expand their markets. He is a past President of Keneseth Israel and currently serves on the board of the synagogue. He is Honorary Chair of the Board of Governors of the Civil War Museum of Philadelphia and past member of the Fairmount Park Commission. He also serves as a board member of Pegasus Riding Academy and the Consular Corp of Philadelphia; and Whereas, both Mr. Baum and Mr. Zarwin were honored last year by the Magen David Adom, the Israeli Red Cross, for their substantial support of that organization; and Whereas, the firm has had great success over the past 50 years and looks forward to continued growth, success and remains deeply committed to help Philadelphia become an even greater city, as Philadelphia has benefited tremendously from the talent of Zarwin and Toddy. Now, therefore, be it resolved, by the Council of the City of Philadelphia, that we hereby recognize, salute and celebrate Zarwin Baum DeVito Kaplan Shaer and Toddy on their 50th anniversary. Further resolved, that an engrossed copy of this resolution be presented to the partners of this firm as evidence of the sincere sentiments of this legislative body. Thank you, President Verna, and Councilwoman Brown particularly, and all the members of City Council. Zarwin and Baum started out 50 years ago, and little did we know 50 years later to today we would be in this prestigious room receiving this wonderful recognition. Philadelphia is a great city, and we are dedicated to help continue to make it great now and in the future, and we will continue likewise to encourage the members of our firm to participate in not only in the business side of the legal business but in the community and participate in various and important of our city's philanthropic and charitable activities. I have to digress just for one moment, because I was particularly interested in something I saw here today, which is really a slice of life of what makes this country so great. It's not just this governing body that we saw here, but we had a bunch of young children coming to see how a place where the government works, and then we saw people who are in our armed services who helping to defend our country, and just as importantly, there are a group of protesters outside articulating their thinking. The freedom that our country is able to create is really what makes the United States of America so great. So we appreciate and thank City Council for this recognition, and we hope that we will continue to make all of you feel that our firm is something to be proud of. Thank you so much. (Applause.)

Thank you, Madam President. Time flies when you're helping people. Today's resolution is recognizing and honoring Lesia Kuzma, Esquire for her leadership and work as Chairman of the First Judicial District's Mortgage Foreclosure Steering Committee on the occasion of their second anniversary in the City's nationally renowned Residential Mortgage Foreclosure Diversion Program.
Whereas, with the significant rise in mortgage foreclosures both on the local and national level, the Mortgage Foreclosure Steering Committee, with Chair, has served as the focal group in developing and implementing the Pilot Residential Mortgage Foreclosure Diversion Program for the First Judicial District; and Whereas, Ms. Kuzma has been the coordinator of the group's efforts at every level. Her commitment and diligence to the project has made it operate to date; and
Whereas, Ms. Kuzma oversees the Committee's efforts by conducting meetings for the purpose of drafting operational protocols for the program; and
Whereas, Ms. Kuzma is passionate about the project and acts as a great facilitator for the group where there are representative stakeholders from all sides of the issue. She skillfully keeps everyone under one tent to move the group forward; and Whereas, approximately 2,000 homes have been saved through the and the efforts of Ms. Kuzma and Committee members. As a result of this success, Ms. Kuzma has become a sought-after spokesperson for the program in other jurisdictions looking to stem the increased flow of foreclosures. Now therefore
Resolved, by the Council of the City of Philadelphia, that it hereby recognize and honor Lesia Kuzma, Esquire for her leadership and work as the Chair of the First Judicial District's Mortgage Foreclosure Steering Committee on the occasion of its second anniversary of the City's nationally renowned Residential Mortgage Foreclosure Diversion Program. Before recognizing Ms. Kuzma, I would be remiss if I did not recognize -- and I'm just recognizing people by the back of your heads, I want you to know that. I would like to recognize Judge Rizzo for brief remarks. Judge Rizzo, would you like to say a few brief remarks. JUDGE RIZZO: Thank you, Madam President, for recognizing me. This really is the shining day for Ms. Kuzma and all this energy and effort behind us, because without a steering committee to lead, we would have no effort. So I truly recognize Councilman Jones, Councilwoman Tasco and Councilwoman Blackwell for really all they have done to support the effort, and our courts. I see Judge Manfredi here. That's wonderful. But it does really take the village, the perennial phrase, some people at the top to keep us churning and moving and going forward. So two years running. We are not finished the task, and we really so appreciate Ms. Kuzma's efforts to help all of us do what we want to do to make this a better place. Thank you. (Applause.)

Good morning, everyone. Today, we commemorate the two-year anniversary -
-- of the Philadelphia Residential Mortgage Foreclosure Diversion Program. This is a great honor that City Council has bestowed, and I sincerely thank the President, Anna Verna, Councilman Curtis Jones and all members of City Council. I am only comfortable accepting knowing that Council has equally recognized the Philadelphia Mortgage Foreclosure Steering Committee, for which I served as Chair since 2004. The successes we have had have resulted from the contributions of many, going back to 2004. It was in March of 2004 that the Sheriff stopped sales from going forward and the City joined with the petition of Community Legal Services and Philadelphia Legal Assistance in a request for an injunction seeking foreclosure relief for homeowners facing sale. This was a micro version of the current program. The case was assigned to the Honorable Annette Marie Rizzo, and the Mortgage Foreclosure Steering Committee was formed. Since then, the Committee has been meeting regularly and evolving, tackling critical foreclosure initiatives, including providing valuable improving the current program. The best and the brightest were at the table in our steering committee since 2004, stakeholders, representing the various competing interests; the Mortgage Foreclosure Bar, invaluable in providing their specialized skill, experience, their input in implementing solutions; the Legal Services Bar demonstrated their expertise, critically rose to the occasion in battling the economic crisis. Our goal was to maintain -- my goal as Chair -- to maintain equanimity and neutral position in focusing on our goals. We found a way. We were led to create a way to preserve human dignity in the foreclosure process while respecting the legal structure. Every one of us was chosen. We were handpicked to craft the solutions. We lived and received the changes. These are the warriors on the front line as we mastered the storm, A very special personal thank you to Her Honor, Judge Annette Rizzo, in particular for having allowed me this opportunity to grow and leading the group as we continue to explore innovative approaches, tools to facilitate foreclosure resolution, government with access as the focus. For this, I am very grateful and honored. Thank you to the City partners, the City Administration, Mayor Nutter, staff, City Solicitor Shelley Smith, Chair Liz Mattioni, the Law Department, Ann Pasquariello and Code. Thank you to the prior City Solicitors for their support with the City's joining the petition. Thank you individually to the Mortgage Foreclosure Bar, be recognized. To all lenders counsel, Legal Services and CLS attorneys, be recognized for your work. Philadelphia Legal Assistance, home of the Save Your Home Philly Hotline, PLA counsel, please be VIP, Philadelphia Bar Association, City partners at the Office of Housing and Community Development, directed by Deborah McColloch; Sheriff's Office representatives, court representatives, representatives of the City-funded housing counseling agencies, and Judge Rizzo's Law Clerk, Rachel Gallegos. Please stand, everyone. Every single member of the Foreclosure Steering Committee worked relentless for six years, and many behind the scenes, towards improving our city's foreclosure program. Please stand to be properly acknowledged and honored for your wonderful work. Finally, City Council's resolution honoring me as Chair as the Committee points to you, to each member of the group, honoring you as well. We can continue to make a difference. We can make a change. That's the least we again and God bless all of you. (Applause.)

I'd just like to say this has taken a very long time to move this property to OARC, which will change it from a nuisance bar which was in the community for many, many years known as the Jaguar and/or Jarett. So I know my constituents will be very happy. They worked very hard to close the bar down a few years back under the Nuisance Act and through the District Attorney's Office, and so now we're finally moving it so that we can continue with our economic development projects along Ogontz Avenue and Cheltenham Avenue. So I'm just kind of happy about that. Thank you.

Thank you, Madam President. Madam President, last spring after the release of the preliminary recommendations of the Mayor's Task Force on Ethics and Campaign Finance Reform, Council formed a legislative drafting committee that met throughout the summer, fall and winter to write this package of ethics reform bills that were introduced on March 4th. weeks, Council and staff -- and I must say all members of Council's staff pretty much participated -- had numerous meetings with the Ethics Board, the Mayor's Office, the City Law Department, Common Cause and the Committee of Seventy to develop agreed-upon amendments to these bills that were voted out of committee. And there were many, many meetings, just about every day of the week, to work on this, and I thank all of those groups for participating. What will these bills do? They outlaw excessive contributions and creates limits for contributions for inauguration and transition committees in retiring campaign debt, as recommended by the Mayor's Task Force. They adopt the Task Force's recommendation to adopt a litigation fund for candidates. The bills adopt the Task Force's recommendation to create a sliding scale, which includes aggravating and mitigating ethics violations. The bills adopt the Ethics Board's proposal to regulate the printing and distribution of sample political ballots. And we also adopted the Task Force's recommendation to require lobbyists to register with the Ethics Board. With regard to the First Amendment issue and the City's Home Rule Charter concerning restrictions on the political expression and activities of City employees, we will continue to work with the Ethics Board and its staff to develop reforms for Philadelphia which, compared to the top 40 cities, has by far the most restrictive laws in this area. So we do not want to move forward and, as I always say, act in haste and repent in leisure. We want to make sure that there are no unintended consequences. And since this Charter provision has been in since 1950, we want to be deliberative about looking at any changes we make and groups that we work with on board. So I want to thank the staff who worked on this, particularly Sophie Bryan of Councilman Green's office, Joe Fernandez of Councilwoman Sanchez's office and, of course, Derek Green of my staff and all members of City Council. I thank you for your cooperation, your staff's cooperation as we move forward to deal with the whole issue of ethics in the City of Philadelphia and do it in a way that people feel that they can abide by the rules and that they are not criminalized for any mistake they may make. So, again, I want to thank all the organizations that we worked with, and we formed a very cooperative relationship. It doesn't mean that we won't fight, but we've done pretty good.
