To give our invocation this morning, of the Chair welcomes Father Paul Brant, President of Roman Catholic High School. He is here today as the guest of Councilman Kelly. I would ask all members and guests to please rise.
Let us pray. God of creation, you have made all things for good and called your children to live as brothers and sisters. We pray today that all people will respect your gift of life and support and strengthen each other in the daily challenges that they face. We ask that you be with the Members of the Philadelphia City Council that they may use the wisdom and insight which you have them to make prudent decisions which will lead the citizens of our City to live in a just and productive society. We pray for all people throughout the world who do not enjoy the freedoms that are guaranteed in our nation. May they be guided by your presence and be given the strength to strive to work towards the dignity of each human being. We remember all who serve in the armed forces. Keep them in your care and protect them from every evil. We make this prayer in your name. Amen.

On behalf of all members of City Council, I welcome you to our Council session. We appreciate your taking the time to join us as we attend to the legislative affairs of our City. We certainly invite you to come again. At this time, the Chair recognizes Councilwoman Brown who will present a resolution recognizing Ms. Katherine Dunham. Allow me first to say thank you to Kevin Vaughn and Lois Hernandez for reaching out to my office and inviting to participate in what, for me, is an extraordinarily unique, wonderful, once-in-a-lifetime opportunity. I trained under Joan Meyers Brown who actually taught me the Katherine Dunham technique. And now to have the wonderful experience to meet this dance legend is indeed extremely special. So let me again say thank you to Kevin Vaughn and Lois Hernandez. And we're joined here on stage by a small representation of Philadelphia who know the extraordinary contribution that this dance legend has made to the world of dance. Honoring Katherine Dunham on the occasion of her dance residency in Philadelphia. Whereas, Katherine Dunham was born on June 22, 1909, in Glen Ellyn, Illinois, Chicago; and
Whereas, in the late '20s Ms. Dunham took dance classes and performed in a number of productions at the Cube Theatre in Chicago; and Whereas, during the '30s, Dunham continued her study of dance with Madame Lumila Speranzeva, whose mentoring led Dunham to dance her first leading part in 1933; and Whereas, Ms. Dunham began to study the anthropological ancestry of dance, and after receiving the prestigious Rosenwald Foundation Fellowship, she took her first visit to the Caribbean in 1935 to study indigenous dance;
And, whereas, returning to the United States in 1936, Ms. Dunham brought with her a plethora of ideas for innovative choreography, which she used as dance director for the Negro Federal Theater Project in 1938, and in New York Labor Stage in 1938; Whereas, her production Le Jazz-From Haiti to Harlem, in 1940 established Dunham as celebrated dynamic choreographers for African American dancers, and led in the production of Cabin in the Sky, her first Broadway musical; and
Whereas, during the 1940s and '50s, Dunham's School of Dance became known as the finest training facility for African American dancers, and Philadelphia's recognized leader in dance Joan Myers Brown of Philadanco fame studied under the tutelage of Ms Dunham; and Whereas, she made her last Broadway appearance in Banboche in 1962, and that same year she choreographed Aida for New York City's Metropolitan Opera Company; and Whereas, in St. Louis, Dunham established the Performing Arts Training Center, a school designed to offer City youth constructive alternative to violence; and
Whereas, Ms. Dunham has been presented the Kennedy Center Honors Award in 1983 and has also been inducted into the Black Filmmakers Hall of Fame; and Whereas, this woman known as the "Matriarch of Black Dance" is gracing our City of Philadelphia through the generosity of the Free Library of Philadelphia Foundation in conjunction with the Hawthorne Cultural Arts Center, Temple University, Philadanco and Dance Advance; Now, therefore, be it resolved by the City Council of Philadelphia, that we hereby honor and commend this extraordinary women, Katherine Dunham, on the occasion of her dance residency in Philadelphia. Resolved further that an engrossed copy of this resolution be presented to you, Ms. Dunham, for your historic achievements in the world of dance. (Applause.)

Please allow me to introduce a colleague in dance. Many years ago, we learned of each other, she training in Philadelphia and me with the Philadelphia Dance Company, Ms. Karen Warrington of (Applause.)
Good morning. I am here to present attribute to Ms. Katherine Dunham who's had an incredible influence on my life since I was 7 years old. This is a congressional entry entered by Congressman Robert Brady in the House of Representatives. It says, "Mr. speaker, I rise to honor Katherine Dunham, a national treasure who is regarded as one the world's most respected choreographers and teachers of dance." And I'll skip to the end because we've said so much and we know so much and we just want to thank you, so we'll make as a succinct as possible. "Katherine Dunham has stood up against racism and inequity wherever she found consistently she refused to perform before segregated audiences. And at the age of 82 and as a result lifelong association with Haiti and Haitian people, she began a 47-day Louis home to protest the US policy of the deportation of Haitian boat refugees. Katherine Dunham's impact on the world of dance continues unabated, and as a result, audiences throughout the world have been educated ed through the medium of dance about the culture, history, and religious practices of the African Diaspora." (Applause.)
Thank you. You know, this has gone far beyond dance and I'm so pleased, I'm so pleased that while I respect and know dance as being one of the great cultural tradition of every people of the world, I am also so thrilled and delighted to know that people are here not just because I happen to dance and have a dance company. But in listening to these various warm tributes to me, I am aware of the fact that this is an age of searching out legacies, and every place that I feel that people know and think of me as a person more than just as a dancer, I feel things that constitute my legacy and it pleases me so much. I want you to know something, and I'm not going to hold for a speech or a lecture or anything. But I have appeared in or been in approximately 57 countries of the world. And I've been in their great buildings and their historic monuments and things built before the time of Christ and so forth. When I walked in here today, I was struck not only the beauty of this whole area and the beauty of this building, but something that I wish I had the words to tell you so you could carry this away with you. Your people who made Philadelphia must have been remarkable people, not only as politicians and economists and this and that and the other, but as people. And I hope that you are knowing them and appreciating them as I do. I can feel what they have given you. This is such a bright and cleaning City. You can't imagine what it's like to walk into these wonderful columns and see them all sparkling clean. And it's reflected in the people of the City, a been given a kind of tradition, believe me, that cannot be found anywhere else in this country and in a few countries of the world today. I think that this comes from the fact that you have not been devoured by technology. And I am so happy about that. Somewhere and somehow your past, your people, your ancestors have given you a stability, a recognition of self without being arrogant and without being possessive or oppressive, that you have learned how to live with beauty and with solid dependable beauty and you have kept it and you've kept it so clean. You may not even notice it, but I can tell you from a lot of experience. I appreciate also your warmth. I came Philadelphia before most of you were born. And I'm so happy to have come back. I believe in something called synchronisity. Do you know what that is? It's sort of like coincidence. " But do you know I didn't even have to think about it. " I don't know why, but I'm so glad that we did because I have a feeling about this country that I didn't have yesterday or the day before, about the solidness of it. I said last night in talking with people that the City has become apathetic. It's a word that I'll have to study and see if I really mean that. But I mean because you have all of these wonderful qualities, you cannot stop there. These are yours so that you can continue to rise and continue to be active and continue to move. And all of the satisfaction that you feel in all that you have inherited must continue to be active. I think it is. I saw the little group of people back there today and I heard them too. It isn't just these little groups that count. It's that we all become aware of the fact that to us not so that we could bask in the sunshine of it, but so that we could use it. I have no right to be telling you how to live your lives, but I can't help it. I have to tell you that because I am so pleased with what I see. And I feel so well being in your presence that I have to tell you about it. Make use of it now. Act. I do feel what I think years ago was known as brotherly love. And I appreciate it. I thank you. And I thank these ladies who said things about me that I didn't even think about, you know. You're so wonderful, really you, all of you.
I feel so much love. And this lady, you have a real jewel in her, and this gentleman down there. I felt so well -usually when people come up, sign this, write that, shake, sometimes I get tired or little bit irritated and I want to go home. I didn't today and I don't today, and here I am making a speech when I didn't intend to. Forgive me if I kept you on one knee all this time and kept you sitting and so forth, but I do feel well. I feel so well in this City. And I )
Let me also thank my colleagues, Councilman Jim Kenney who loves dance as much as I do, Councilman Rick Mariano, Councilwoman Marian Tasco, and I would remiss not to acknowledge that we are indeed delighted to present a Liberty Bell on behalf of our Mayor John F. Street. (Council at ease.)
At this time, the Chair recognizes Councilman Rizzo who will present a resolution honoring Mr. Don Cannon. It is my understanding that Mr. Cannon is on a very tight schedule, and we certainly appreciate his patience. Is there anyone else to accompany you?

Good morning, everyone. Honoring and thanking radio personality Don Cannon on his retirement for his important contributions and accomplishments. Whereas, Don Cannon has been a leading voice in the Philadelphia radio market at WIBG, WIP, WFIL, WIFI 92, SUNNY 104, and WOGL OLDIES 98 for over 35 years; Whereas Don Cannon has lent his voice and celebrity voice to benefit numerous charitable organizations in the Delaware Valley; Whereas, Don Cannon has been a dedicated supporter of charities such as Easter Seals, the Arthritis Foundation, the Leukemia Society; and
I got to tell you, Councilwoman Krajewski is trying to put the moves on Don Cannon as we're standing up here. (Laughter.)
So if I look a little distracted, that's what it is. Whereas Don Cannon once spent 99 hours on the air to benefit a food drive for the needy on behalf of the Cardinal's Commission on Human Relations; and Whereas, Don Cannon started the Don Cannon Variety Club Tournament of Champions, and annual golf benefit raises an extraordinary amount of money each year benefiting handicapped children; and
Whereas, Don Cannon and the then current Mayor co-hosted the annual City Hall Gala to raise funds for the restoration of historic City Hall -- which looks great -- and; Whereas, Don Cannon was the voice of the radio while Rocky Balboa trained for his big fight in the first Rocky movie; now therefore
Let you tell you, suffer, people, suffer. (Laughter.)
Resolved by City of Philadelphia that City Council honors -- my knees are shaking -and thanks Radio Personality Don Cannon on his retirement for his important contributions and accomplishments; and

This is the first time when you mention Joan Krajewski, I figure she's going to yell at me or something, so it was kind of nice for here, especially after seeing Katherine Dunham and the great contributions this woman has given to society. Me, I'm a clown on the radio having fun for the last 35 years, but I did do a lot of clarity work. I've been through a lot of Administrations, but I can relate to you guys because I got up at 2:30 this morning too, so I feel like we are in the same place. I got so exited when I learned I was going to receive this proclamation that I read the entire 500-page Tax Reform Commission report. (Applause.)
Wait. On the air, on the air, and I think I'm the only one who's read it. I tell you what, what ratings we should have now. But going back over the years, and I know a lot of Councilmembers, I know a lot of your fathers. I mean, Frank Rizzo was a dear friend of mine. And Wilson Goode, your dad, we had who more fun with him back in the '80s doing impersonations and stuff. It was always a fun time. And he took it real well from us too. Over the years, if we offended anybody, that was the intention. But, hopefully, it was to make for a fun City, a more productive City, and to get everybody Council have been doing for years. I feel I can talk about that. First part of my career, I lived in the City in the Roxborough area. My last day on the radio is tomorrow. Yes. But don't feel badly, it's my choice. This is something I wanted to do. But I will always remain in the area. Councilman Rizzo knows that, Councilman DiCicco, Mr. Kenney, Mariano, Joan, and Anna Verna and everybody through the years, whatever you need, I'd love to do it. And I feel so honored that not only this, I think I got the Liberty Bell at one time, but this proclamation has really just made my career feel worthwhile. You know, the Rocky movie, you know, it was kind of nice that he chose us and chose Philadelphia in the first one. How many remember the first Rocky movie? You might be too young. Do you remember it, the first one, when he's getting ready to train for the big fight, he goes to the refrigerator and starts putting the eggs in the blender, I'm on the radio; that's me. went to see the movie, I hated it because he put the eggs in the blender and starts drinking it, everybody would go "Awh, ooh," they drown out my part. I couldn't hear what I was saying. (Laughter.)
So at least I had your attention. And again, to all of you. Thank you so much. You really made my day. Thank you. (Applause.)

Thank you. Honoring the individuals who facilitated the return of Delimar Vera to her biological mother, Luz Cuevas. Whereas, Delimar Vera, previously believed to be killed by fire in 1997, was discovered alive and healthy by her mother, Luz Cuevas, at a birthday party; and
Whereas, the attention and hard work of members of the Philadelphia Police Department and the Pennsylvania State Legislature helped Luz Cuevas take the necessary steps to prove she is the mother of Delimar Vera; and Whereas, DNA test results showed that Luz Cuevas is the biological mother of Delimar Vera; and
Whereas, the return of Delimar Vera to her biological mother Luz Cuevas met the end of a six-year separation; now therefore be it. Resolved by the City Council of Philadelphia that we honor the individuals who facilitated the reunion of Delimar Vera to her biological mother Luz Cuevas; and be it further resolved
That an engrossed copy of this resolution be presented to Captain John Darby, Lieutenant Michael Boyle, Detective Dave Thomas, Detective Manual Gonzalez and State Representative Angel Cruz as evidence of the sincere respect and admiration of this legislative body. Thank you. (Applause.)
The Chair recognizes Captain Darby for remarks. CAPTAIN DARBY: Good morning. And may I say, it's an honor to be here today. On behalf of Lieutenant Mike Boyle, Detective Manny Gonzalez, and Detective Dave Thomas, I wish to thank State Representative Angel Cruz, Councilman Rick Mariano for their efforts to initiate these awards of certainly, to the State Legislature, our City Council President, and each of the members of this body for their support. We are here today, a child reunited with her natural family and a subject appropriately charged awaiting trial as a result of a mother's compelling, convincing account, followed by the intervention of Representative Cruz, then Angel Flores of the District Attorney's Office put into motion, was a complicated, protracted and at times emotionally charged investigation conducted by the lieutenant and the detective standing here with me. The assistance, cooperate of other departmental resources, including the Forensic Science Division where the DNA evidence was analyzed, other City agencies such as the Fire Department's Fire Marshal's Office, Medical Examiner Office, the District Attorney's Office, as well as other law enforcement agencies outside this City and outside the State should also be noted. I want to emphasize that this case is, without question, unique. Collectively, no one here in their years with the Philadelphia Police Department nor anyone else involved in this case can recall one that is remotely similar. It speaks to the continued commitment and dedication with which the Special Victims Unit strives to seek justice for all child and adult victims, given even the most challenging circumstances. Again, I thank you all. (Applause.)
State Representative Cruz, would you like to say a few remarks? REPRESENTATIVE CRUZ: Thank you, Madam President. I also have a citation from the Legislature that I will provide for the gentlemen that helped me here. I want to take the opportunity to say that many people always ask me and I was always on the news, I was always in the papers "You did a wonderful job, you're hero." Ladies and gentlemen, let me introduce you to (Applause.) REPRESENTATIVE CRUZ: Without their help and dedication, I would still be looking myself and never get this story, found Delimar to her biological mother. These gentlemen worked on their own time, they worked as hard as they can to make sure that this mystery was resolved. There's a lot issues still hanging out there. But you know what, it put us on the map letting us know that we work hard, that this story, that there are many other stories out there that are unsolved the same way but that we can all work together and make it a success. Thank you, Madam President. Early this morning at 3 o'clock this room was filled about 16 protesters who rights as residents of the City to protect the two-way passageway of the 20 Street and Olney area, the one block that's involved in giving easy access to the residents of the local area as well as the residents of Mount Airy, Germantown, Chestnut Hill, Roxborough and suburban areas quick access to the expressway. These citizens were part of a group of almost 200 that were here from 4 o'clock on yesterday afternoon, and 65 of them, at least by my count, was in this room when the hearing began around midnight last night and lasted until 3 a.m. The reason the people feel so strongly is that for 40 years there's been an issue between them and an institution about the passageway of this one street. And that passageway covers from Olney Avenue south of Belfield or from Belfield north to Olney, whichever way you look at it. That area is directly in the heart of the 17th Ward, of which in addition of being a Councilman At-Large elected by very strong vote, much more than the 10 percent of a District a district is, one-tenth of the City -- that location is right in the center of the 17th Ward and against the wishes of the 17th Ward political organization and against the wishes of the 17th Ward community well known to the District Councilman in the area because of two meetings she ran last summer which she decided where the meeting should be held and everybody at the meeting spoke in the opposition except the Councilwoman and her staff members, but all the residents spoke in opposition to it. She nonetheless, following her election, immediately took action to request that the Streets Department that they turn 20th Street into a one-way street. Now, I object to this motion because I think people need time to think about this. And I think Council needs time to reflect on what it's about to do. I'm not going to talk about the merits of that change, but I am going to the talk the political invasion District Councilmember into the tearing of another colleague of City Council, myself who the Ward Leader and the people. Apparently there are differences of opinion as to the responsibility of District Councilmembers and their rights. I believe that people will think that when they elect the representative, that representative is going to support them, not become somebody to them seems to oppress them and take away their rights. In any event, I think it's totally improper and unseemly for this Council to remit itself to be used as a tool for the decision to be made in that political issue. And I think Council is entering on a very questionable course when it chooses the sides so that people are voting for one Councilmember against other Councilmember's rights in his own ward. Now, this is not the ward where the Councilwoman lives. She's coming from outside and believes that she has the right to make the decision overriding all the people in the ward and overriding the political leadership there. I think it's a very bad example. I set City Council on a very unpleasant and unfriendly course. Therefore, I move to separate these and urge the Council to go slow and, therefore, I support this motion to sever to give us an additional week to think about the matter. That's the reason for my activity on this motion today.

First, if you'll excuse me. This is an inaugural report of the Committee on Technology and Information Services. I don't think but I'm certain it's the first time a report of a Committee has been given by a Chair who is a Republican. I've been here 25 years, and I know my Democratic colleagues you get a Committee even if it's not the one they want when they get elected. It's been 25 years waiting, so it's very special to me and I want to thank you and the Majority Leader and my colleagues for the privilege. I promise not to abuse it because I know there won't be many bills in this Committee and it was a very short meeting. But the Committee on Technology and Information Services reports one bill with a favorable recommendation.

Thank you. I'm voting no on this motion because here again I think this Democratic Council is doing the wrong thing by permitting a Republican a leadership responsibility. There are 14 Democrats on the Council and only 3 Republicans. And I think it's shameful that the Democrats are once again resorting to support of a Republican and thereby understanding of everyone in the City that this is a Democratic City. I think the Democratic members of this Committee, the 14 of them ought to support Democrats for leadership positions because we owe it to the voters to have a democratic vote on these issues and not to the permit the Republicans to control our policy and, therefore, I think it is wrong to have a Committee headed by a Republican. It's never happened before. And unlike Councilman O'Neill, I cannot say I think it's an advance. It may be for him. This is no way meant to criticize any action that he himself has taken, but I think it's very poor public action for a Democratic body, overwhelming Democratic in the City of Philadelphia where my ward voted 97.3 in favor of the Democratic candidate for Mayor to have represented in this important technology field or in any field in the position of the leadership to have a Republican instead a Democrat. I think again we're on the wrong road.

Thank you, Madam President. Madam President, on this particular bill I just wish to point out while it was not one of the items of legislation within the Tax Reform Commission's recommendations, this bill simply seeks to protect the property owners in Philadelphia. The Board of Revision of Taxes has announced that they'd like to change the system to assessing at 100 percent of value, which I'm certainly in agreement with. The concern is that taxpayers do not know at this time what the new millage rates will be and City Council obviously has to pass those new rates. This bill would seek to protect property owners from the system going to a hundred percent value without Council being involved in the process to then lower the rates to an appropriate level. And I would like to encourage my colleagues to support of the override on this particular bill in the interest of taxpayers and property owners. Thank you, Madam President.
Madam President, again, in support of an override vote, I know the veto doesn't involve any money and it is premised on a technicality that the Solicitor advised that the Council does not have authority here. We have not seen an opinion. We have never been told this through the whole budget process. And I believe we, Council, should be on record that when and if the City goes to a hundred percent that it be revenue neutral that we not be making money on what is supposed to be and will be, hopefully, a fairer way of telling people how their house is being assessed and giving them enough information whether to decide whether to make an informed appeal. So I think that it will send a message not just to the public but specifically to the Board of Revision of Taxes that Council feels this strongly about this issue, whether it's done next year, the year after or whenever.

It is my understanding that at the public hearing and my belief because I think I heard Mr. Glancy indicated that he supported such a move on behalf of the property owners and would essentially delay implementation of the 100 percent assessment until Council was in a position to adjust its rates.

An ordinance amending Chapter 19-1500 of The Philadelphia Code entitled "Wage and Net Profits Tax" by decreasing in six stages the rates of the tax imposed upon certain low income persons providing for refunds of excess taxes paid and directing the Revenue Department to prepare forms for use by eligible tax payers seeking such refunds, all under certain terms and
I urge all the members to vote override the Mayor on this bill. This is the one wage tax cut bill that can truly be described as reform. It brings in the elements of fairness and equity because its targeted to help working people and poor people, not the business people. All the tax reform bills, whether those in existence or those that the Tax Reform Commission has considered don't consider working people and poor people as being appropriate people to be the beneficiary of tax cuts. This bill which passed Council at one point 16 to and on May 31st passed 14 to 3 is a Democratic bill. It's targeted wage tax cuts to the people who need it. It would be the best thing in the world for the NTI program because it would enable the people in the neighborhoods to have enough money to support retail businesses. It's good for working people, it's good for retail business, it would be great for the economy, it's real economic development as well as fair and equitable to working people. It brings in at the local level the same procedures that now exists at the national and state levels whereby if your income is below a certain level at the end of the tax year, you can begin to get refunds. It does not kick in in any way to affect the current Five-Year Plan. The first year in which payments would be made based on refunds would be year 2010, and it would certainly seem that even if the Lord didn't help, and the Lord will help, but even if the Lord didn't help, six years is a long time to plan to give working people and low income people fair play in the field of taxation. I urge full support of all my colleagues as I've had in the past on this matter. Thank you.

And Bill No. 040602, an ordinance to adopt the Fiscal 2005 Capital Budget.
And Bill No. 040603, an ordinance to adopt a Capital Program for six Fiscal Years 2005-2010 inclusive.
And Bill No. 040607, an ordinance amending Chapter 1900 of the Philadelphia Code entitled "Wage and Net Profits Tax" by decreasing the rates of the tax, all under certain terms and conditions.
And Bill No. 040608, an ordinance amending Section 19-2604 06/10/04 - STATED of The Philadelphia Code relating to tax rates, credits, alternate tax computation for the business privilege tax, all under certain terms and conditions.

Madam President, on behalf of the joint Committee of Law and Government and the Streets Committee, the hearing scheduled for 4 p.m. yesterday which would have had to occur at after 3:00 a.m. this morning will be continued to immediately following the June 17th meeting. It's an investigatory resolution and is perfectly in order if you want a motion to suspend Rules merely set the full time meeting. It's merely to set a date for the meeting.
