Bill No. 100677, an18 ordinance amending Section 2 of an19 ordinance (Bill No. 060317) approved20 September 28, 2006, entitled "An21 ordinance authorizing and directing the22 revision of lines and grades on a portion23 of City Plan No. 275 by extending Parker24 Avenue from its current terminus on the25 3 2/22/11 - STREETS - BILLS 100677/1100711 northeasterly side of a 66 foot wide2 right-of-way for railroad purposes,3 approximately 66 feet southwestward to4 the southwest side of said right-of-way,5 including the dedication to the City,6 free and clear of all encumbrances except7 for a right-of-way for railroad purposes,8 of the bed of the extension of Parker9 Avenue," by extending the period for10 compliance with the terms and conditions11 stated therein.12 COUNCILMAN DiCICCO: Thank you.13 (Witnesses approached witness14 table.)15 COUNCILMAN DiCICCO: Good16 afternoon.17

Good afternoon,18 Mr. Chairman and members of the19 Committee. My name is Frank Morelli,20 Survey Bureau Manager of the Department21 of Streets, and the Department of Streets22 would like to offer the following23 testimony on Bill No. 100677.24 This is not an administrative25 4 2/22/11 - STREETS - BILLS 100677/1100711 ordinance, but an ordinance requested by2 Mr. David Stubbs, President of Stubbs3 Enterprises Incorporated, 371 Pelham4 Road, Philadelphia, PA.5 The purpose of this ordinance6 is to further amend a previous ordinance7 (Bill No. 060317), approved September 28,8 2006, which authorized the extension of9 Parker Avenue from its current terminus,10 approximately 262 feet southwest of11 Umbria Street, southwestwardly across the12 right-of-way of the Philadelphia,13 Germantown and Norristown Railroad. The14 proposed amendment will extend the time15 period for compliance with the terms and16 conditions of the authorizing ordinance17 for an additional two years. This action18 will facilitate construction of the19 Umbria Village residential development,20 which is proposed to consist of 25021 market-rate rental and condominium units22 in four low and mid-rise buildings, and23 will also include retail space, indoor24 and outdoor parking, and public areas.25 5 2/22/11 - STREETS - BILLS 100677/1100711 The proposed extension of Parker Avenue2 will require the establishment of an3 at-grade crossing of the tracks of the4 Norristown Line. This action will not be5 confirmed until the crossing has been6 approved by the Pennsylvania Public7 Utility Commission.8 This ordinance is supported by9 the Department of Streets and is10 recommended to your Committee for11 favorable action.12

Good afternoon,13 Chairman DiCicco and members of the14 Streets and Services Committee. I am15 William Erickson, a City Planner with the16 Development Planning Division of the17 Philadelphia City Planning Commission. I18 am here to testify on Bill No. 100677,19 which Councilman Jones introduced on20 October 21st, 2010.21 This streets bill will extend22 the time limits on Bill No. 060317 to23 allow the developer to meet all of the24 conditions in the bill. The previous25 6 2/22/11 - STREETS - BILLS 100677/1100711 bill extended Parker Avenue across an2 existing railroad easement to allow3 access to a landlocked parcel to create a4 residential development called Umbria5 Village.6 The Philadelphia City Planning7 Commission reviewed this action at its8 meeting on November 18th, 2008 and9 recommended that the second time10 extension, Bill No. 080757, be approved.11 Therefore, the City Planning Commission12 recommends that Bill No. 100677 be13 approved.14 This concludes my testimony.15 COUNCILMAN DiCICCO: Thank you.16 Any questions for these17 witnesses from the Committee?18 (No response.)19 COUNCILMAN DiCICCO: Anyone20 else here who wishes to testify?21 (No response.)22 COUNCILMAN DiCICCO: Seeing23 none, please read the title of the next24 bill.25 7 2/22/11 - STREETS - BILLS 100677/1100711

Bill No. 110071, an2 ordinance amending Section 2 of an3 ordinance approved November 13, 2002,4 entitled "An ordinance authorizing the5 revision of lines and grades on a portion6 of City Plan No. 258 by striking from the7 City Plan and vacating Brill Street from8 Torresdale Avenue to Harbison Avenue, by9 striking from the City Plan and vacating10 a certain triangular section of Harbison11 Avenue, and by reserving and placing on12 the City Plan a right-of-way for drainage13 purposes, water main purposes, and gas14 main purposes, under certain terms and15 conditions," by extending the period of16 compliance with the terms and conditions17 stated therein.18

My name is Frank Morelli,21 Survey Bureau Manager of the Department22 of Streets, and the Department of Streets23 would like to offer the following24 testimony on Bill No. 110071.25 8 2/22/11 - STREETS - BILLS 100677/1100711 This is not an administrative2 ordinance, but an ordinance requested by3 Mr. Milton Velez of Rosen, Schafer and4 Dimeo LLP, 121 South Broad Street.5 The purpose of this ordinance6 is to further amend a previous ordinance7 (Bill No. 020429), approved November 13,8 2002, which authorized the striking from9 the City Plan and vacating of Brill10 Street from Torresdale Avenue to Harbison11 Avenue and the reserving and placing on12 the City Plan a right-of-way for13 drainage, water main and gas main14 purposes within the lines of Brill Street15 being stricken. The proposed amendment16 will extend the time period for17 compliance with the terms and conditions18 of the authorizing ordinance. The19 purpose of this action is to enable the20 abutting owner to consolidate parcels on21 either side of Brill Street and expand22 the parking area serving the adjacent23 business.24 This ordinance is supported by25 9 2/22/11 - STREETS - BILLS 100677/1100711 the Department of Streets and is2 recommended to your Committee for3 favorable action.4

Good afternoon,5 Chairman DiCicco and members of the6 Streets and Services Committee. I10 am here to testify on Bill No. 110071,11 which Councilwoman Krajewski introduced12 on February 10th, 2011.13 This streets bill will extend14 the time limits for compliance on Bill15 No. 020429, which authorizes the striking16 and vacating of Brill Street from17 Torresdale Avenue to Harbison Avenue.18 This action will allow the adjacent19 property owners to take control of an20 unneeded street, Brill Street, by21 removing the legal encumbrance. This22 area is currently fenced and not needed23 for traffic purposes.24 The Philadelphia City Planning25 10 2/22/11 - STREETS - BILLS 100677/1100711 Commission reviewed this action at its2 meeting on July 17th, 2002 and3 recommended that Bill No. 020429 be4 approved.
