First floor, one-bedroom apartment.
It's a 128-square-foot living room, 138-square-foot kitchen, a bathroom, and 107-square-foot bedroom.
Second floor, two-bedroom apartment, 141-square-foot primary bedroom, second bedroom, 84-square-feet, 96-square-foot kitchen, 73-square-foot living room, and a bathroom.
And per the requests of the RCO and just what my client was doing anyway, they're installing one-hour fire walls and ceilings as part of what they're doing, which will separate the units and hopefully ensure the safety of the residents and folks in the neighborhood.
We believe this is a reasonable project, not creating a new use and restoring and bringing into full compliance historical use on a blighted property.
We got the support of the RCO, and I'd like to call my client to adopt my testimony.
Nicole, if you're on the call, could you raise your hand?
Nicole has no problem.
Nicole, you're allowed to speak.
Good morning, Nicole.
Hello.
Good morning.
Good afternoon.
Could you please state your name and spell for the stenographer?
My name is Nicole Ramirez.
spelled N-I-C-O-L-E-R-A-M-I-R-E-V.
Do you swear or affirm to tell the truth,
the whole truth, and nothing but the truth?
Police proceed counsel.
Good afternoon, Nicole.
Did you hear my testimony just now
regarding your property on Bouvier Street?
Do you adopt it as your own?
I have nothing further.
Questions from the board.
Comment.
Just a quick comment.
Can you go through a second?
Yes, sir.
yes sir not not for not for nothing but the location of your um range is a fire hazard
right next to the window somebody puts curtains there they're going to go up in flames just so
you know but um okay so but so um so i'm not quite sure uh um board member gaskin will have some
comments
I think my only question is about the subdivision
so you bought it in this condition
have my pet peeve
my pet peeve is that
this idea
that you have to wander from
the bedroom
all the way through the kitchen
and all to get to a bathroom.
I just, I don't,
and bathroom, bedroom here,
living room, then bath,
and then the other way,
it's through the kitchen.
So, you know, three o'clock in the morning,
that's a little hard to deal with.
I just think that a better layout
would be um so that you don't have to do that um i'm sorry can you guys hear me yes we can yeah
okay yeah i'm sorry i'm a little confused um because you said you i don't you don't have to
go through anything all of the bedrooms or like the room have their own door so you don't have
to go through like the kitchen or the bathroom or like they all have their own doors if i'm
understanding what you were stating i believe i believe she's mentioning the first floor here
where it appears that you go through the kitchen to get through the to the bathroom from this
bedroom and the yes yeah in the back well okay i understand i thought you were referring to the
second um unit so for the the layout like um we purchased the property like with this layout we
didn't make like any changes. And then between I don't I think there's a picture that I took from
um and then between i don't i think there's a picture that i took from like standing in the
kitchen to the bedroom there's um that's this tell me tell me which way to go on these on
these pictures nicole if i'm going the right way or the wrong way maybe go um like yeah backwards
keep going because this is the second unit
all right now we're downstairs again okay so keep going
oh i'm sorry maybe go um your renovation photos okay other way yeah so because there's a picture
okay right it should be um the couple of next pictures so this is the kitchen i should be the
next one okay here yeah so I'm standing in the kitchen and right there's like a little like
hallway I don't know what you call that and then that's the the bedroom but I do understand what
you're saying but there is like a door so it like the bedroom isn't like directly in the kitchen but
I do understand um what what you mean by like having to walk through the kitchen to go to the
bathroom i'm not i'm not saying that the bathroom is in the kitchen what i'm saying is that when you
get up at three o'clock in the morning okay to go to the bathroom you got to wander through
the kitchen to get to oh okay i understand sorry i misunderstood what you were saying
layout okay okay understood thank you sorry about that miss ramirez i do have another question so
it looks like you purchased the property this year and i know you said you guys have done no
work did you purchase this uh cash or did you uh do a bank process to get this and did you run a
title search before you when you purchased so yeah we did like uh i'm sorry you said it was cash or
through a bank yes yeah so we did it through a bank um there was a title search um like to the
title company but no one like told us that it wasn't zoned correctly um yeah so if that didn't
come up and i mean if we knew it wasn't like zoned correctly we would probably have purchased it but
it didn't come up during the title did anything come up during your bank process when you did
the inspections no no okay so they like they said they thought everything was fine yeah
the only reason i'm bringing it up is because there were a lot of lni violations from the
previous owner that you purchased the building from and it does look like some of the work
that's depicted currently was corrected during the lni violation process without permits so
so the only thing that we were aware of like in terms of violation was the like the rear yard
of the um like it was a lot of grass and trees in which we cut down but that was the only thing
that we were aware of and then we fixed we corrected that yeah well they they had they
had way more than the real wall they had like some structural things that they had to adjust so i just
wanted to make sure if you had a if you went through a bank process though you should have
been covered yeah nicole do you do you do you attend to get um your certificate of occupancy to
properly operate if the board grants your variance today yes yeah that's the plan
and could you just let me know about the trash uh for both units yeah so um as i mentioned we
have a rear yard and we do have like a trash and recycling management plan because that was uh
the our for the rco so um the trash and recycling containers are going to be stored in the rear in
the rear yard and which is accessible for both units um both units will be assigned um two 32
gallon trash containers and another 32 gallon um recycling bin and if you know extra containers
are needed then we'll definitely provide them also we'll be providing with the like both units
like indoor containers so they'll have a place to store their indoor trash and um recycling um you
know for daily use and then it's up to you know they have to go down and um you know throw their
trash in the in the rear yard and then another um thing that uh we're gonna do is through uh we're
gonna hire a property management and their maintenance company they'll be responsible for
you know bringing the containers um on trash date um to return it back and bring them out and then
And also, so they'll be responsible for that just to make sure that, you know, I know, sorry, that the tenants, they don't leave like the trash bins out on the curb.
All right. Questions from our attorney?
All right. Questions from our attorney?
Not at this time, Mr. Chair.
Questions or comments from the virtual audience?
I do not see any of your hands, Mr. Chair.
Planning Commission.
Good afternoon, Chair, members of the board.
Michael Gall with the Philadelphia City Planning Commission.
The comprehensive plan recommends no change to the RSA-5 residential single-family attached zoning at this location.
the city rezoned this neighborhood in uh this section of tioga in 2006 in a community requested
map change this property does have a documented history of two-family residential use therefore
the city planning commission recommends that the board grant the proposed variance for two-family
residential use so mi2024-006-814-3630 north buvier street i vote yes with proviso certificate
of occupancy to would be obtained. Michael Johnson, my vote is yes with proviso.
Cheryl Gaston, my vote is yes with proviso.
Tanetta Graham, my vote is yes with proviso. Ryan McAdams, my vote
is yes with proviso. Io Nguyen, my vote is yes with proviso.
Thank you, counsel. Thank you, everyone.
Move that range from that window.
Write that down, Nicole. He's serious. Hillary,
We just mentioned there's three cases remaining.
We will add them to them.
And Mr.
I can just put those on the record.
Give me one second.
Sorry.
So those cases will be 2954 North Fairhill Street, 3301 North 22nd Street and 1019 Wallace
Street.
Those cases will be heard at 2 p.m. after a recess.
OK, thank you.
Thank you very much, everyone.
See every one of two.
He knows we have to.
We're going to we have three cases from this morning's list.
We're going to hear those first.
But before I start, I should mention that this morning we announced that.
Tinetto Graham is the new vice chairman.
And Cheryl Gaston is the secretary of the board.
So I just want everybody to know.
Okay, so number seven from the earlier list, number eight from the earlier list, MI 2024-006-880-2954 North Fairhill Street.
Richard Rivera, Roman is the appellant.
What's the name?
Do we see him?
Here, this is Jason Handel.
I'll be stepping in briefly.
Sure. Jason, do we see him?
He's in the virtual audience,
but he's not raising his hand.
Mr. Rivera, if you are still
in the virtual audience, please raise your hand.
Okay. He just raised his hand and he'll be coming back in as a panelist for him, Mr. Chair.
Sure, thank you.
Hello, everybody.
Hi, sir. I believe I swore you in earlier today. Am I correct?
Yes, that is correct.
All right. So why don't you bring up your video and start your presentation?
All right.
Well, as far as I know, everyone can see.
Yeah, so we have all your paperwork.
So why don't you start with your plans for the building, right?
We have that.
Why don't you start with your plans for the building and your photos?
All righty.
So my proposed plans are demonstrated in this blueprint here.
So this would be the first floor plans indicating.
Can you blow that up a little bit?
It's a little hard to see, just a little bit.
it doesn't seem to be quite working at the moment okay all right so
so that's your first floor where's your second floor my second floor
so that's your first floor where's your second floor my second floor
is right here so i have two bedrooms on top each room has their own closet as well as
a washer and dryer there's w and d there next to the bathroom then after you go up the stairs
There's a little bit more of a staircase, maybe two stairs.
There's a kitchen area, and then you have space for your dining room
and your living room as well here.
And show us the first floor again.
The second computer is a bit slow.
That's the second floor, right?
There we go.
It just loaded in.
So each floor will have its own separate entrance.
As you see, this is the main entrance, but the entry point for the first housing unit will be here, and this will be the second unit's entry.
