Right. Do you swear or affirm to tell the truth? The whole truth is nothing but the truth.
Yes, I do.
Please proceed, sir.
I'd like to make a couple of points also followed up with a couple of questions. So I've owned the property in the front 1224 for 16 years. I've lived in it for 14. As far as I'm concerned from witnessing in person over the years, Terrence Dowd, the previous owner, was using that structure as an office.
He was running his painting business out of it with the adjacent garage.
It was not used as a triplex.
My question would be, are there more interior photos of three kitchens?
Are there three leases?
Are there three tenants?
That's a question I have because I don't believe that to be true over my 16 years of ownership.
It has been an issue with that alleyway and that easement on who owns that easement.
It's been a nightmare with the traffic coming in and out of that easement and that alleyway with the previous owners painting clients.
The trash situation was a nightmare, and this is with not having three tenants back there.
Emily Bremer is the tenant of 1224 Columbia, so she signed that form, but she's in no position to vote yes or no, in my opinion.
I'm the owner of the property.
Another question would be, that's an 18 by 29 footprint on that structure.
I don't see how it's even legal to have a triplex on an 18 by 29 foot structure.
And my recommendation moving forward with the group and to the prior or the current owner is, I don't know how far back this goes with zoning, but that garage next door that he purchased with 1224 rear would be a good way for them to access the street.
I think at some point back in the day, that structure, the existing triplex, so to be, would exit and get to the street through the garage because those buildings are attached, but they are separately deeded.
So there's a couple of points I have, and mainly just the trash and the throughfare, people coming and going out of my easement or our easement, I would say.
All right. Thank you for taking the time to call us. We appreciate it. Do you have any questions, Bill?
May I just respond really quickly? Mr. Epperson?
Why don't we do this? Why don't we wait that there's another person with their hand up and then you respond at one time.
Next hand, please.
Yes, the next hand is Robert Everett.
He's from Fishtown. Okay. Hi, Mr. Everett.
Coming in now.
good morning mr everett i'm here it took a while i know you are just state your name
please and speak for the court stenographer yes first name is robert last name everett
E-V-E-R-E-T-T.
Do you swear or affirm to tell the truth, the whole truth, nothing but the truth?
Yes, I do.
You are the Fishtown RCL, am I correct?
That's correct.
I am one of the co-chairs.
Please proceed.
You have our letter, so I won't go on that.
I can't explain why we had eight abstentions.
Sometimes they hit the wrong button since we do it on Zoom, but that is what it is.
A question earlier from one of the board members there. Did the tenants attend the community meeting? The way we verify, we pull the list of everyone who voted and verify them against our database of verified members where people have given us evidence that they live where they say they live, and none of them are on our list for that meeting as having had attended.
And in addition to the letters that went out from the attorney for the applicant, we follow up and do actual door-to-door flyers for the same meeting the weekend before, so they should have had an opportunity to attend, with the exception if there's someone in the rear, because the gate's locked and we couldn't get back there.
All right. Thank you, Mr. Everett. We appreciate taking the time. Mr. O'Brien, do you want to respond?
Yes, just briefly to Mr. Epperson. Mr. Epperson sent an email prior to the RCO meeting to the Fishtown neighbors saying that he was the owner of the property and disagreed with Mr. Dowd's affidavit that it was continuously used as apartments.
It was that email was discussed at the RCO meeting. As far as I know, Mr. Epperson did not appear or participate in the RCO meeting. So there wasn't any further context.
And regarding the leases, I have two of the three leases here with me. I did not put.
And regarding the leases, I have two of the three leases here with me.
I did not put them part of the package because I thought it contained personal information wasn't necessary.
These are dated in January of 24 between the current residents of the first floor and third floor.
I don't have the second floor lease with me.
The rent is $800 a month and it includes all utilities and it extends until February of 26.
And they were signed by Mr. Dower.
Thank you very much.
So we're going to hold this till next Wednesday morning.
We'll vote at 930.
We're going to take it at executive session and go over all the issues.
Chair, do you want my recommendation?
Oh, I'm sorry.
I'm sorry.
Amy Boyd from the Planning Commission.
oh i don't think i'm on video am i just a second
okay amy board with the planning commission the comprehensive plan recommends no change in zoning
at this location from the existing single family residential rsa5 the limited access by a narrow
easement to the back multiple dwelling units would risk life and safety of those residents in the
space and create congestions for the front property therefore the planning commission
recommends that the board deny the requested variance for multi-family household living
thank you very much we'll vote next wednesday thank you okay thank you
number three mi 2024 004 299 7143 edmond street or hey follow is the tenant applicant
This application is for use as artist studios and artesian industrial in an existing structure. The proposed use to artist studios and artesian industrial is prohibited in the RSA 3 zoning district. There's support from the Taconi Civic Association.
Do we see his hand?
Sorry, Chair, I do not.
Oh, yeah, there he is.
Should be coming in shortly.

okay good morning sir have you emailed in all the required documents and exhibits as needed
and required to proceed with this case five days in advance of this hearing
Yes, sir.
Thank you, sir. Please proceed and share your screen.
I'm sorry. I didn't hear you at the end.
You can proceed and share your screen.
Oh, okay.
Your presentation.
Niney, where
I share at?
There should be a green button at the bottom
of your screen in the center.
It says share.
You have to open your documents up as well
before you share.
I'll open the document there.
Y'all see the documents?
X this out.
That's good.
You can start your presentation.
Oh, okay.
All right. So, so I'm asking for a variance for the corner property of 7143 Edmond. And this is the blueprint right here. I'm sorry. Blueprint right here where it's the front entrance right here.
and the windows on the side
we're here on the left hand side
I'm trying to move myself but I can't
see my screen
and the office as you said
front office is the front
and right behind is the bathroom
and the main part
of the shop is the back
part of it where it's the dryer
and my
auto print
so it has two three closets
with the
a little sink
in hot or cold water.
And then
I also have
On the right-hand side of 7143 Edmond, on Friendship Street, I also have a garage that I'm renting in front of the property as well.
on the same side of the
on the right hand side of 7143
Edmond.
Why don't you tell us what you're trying to do?
I'm doing this as a screen print. It's a t-shirt shop, a silkscreen t-shirt.
this is the entrance of the shop right here
front door I can show you a better picture than that that's the bathroom
this is the front of the shop
as well as the office I was saying
and they go to the back of the shop
right here this part right here
yeah it's a silk screen
t-shirt
is there a residence above this
yes there's a residence above it
it's two apartments
up top over me
and how many
years have you had this
I rent
I believe
this is uh the back of the shop as well left side is the windows like bow windows
this is the front that's the entrance to the shop where do you get correct
where do you get into the two units above the two units above is up top of the shop
i mean how do you how do you get in there i'm saying oh they have their own entrance
on the left side
they have their own stairway
their own door
and on the right side as well
they have their own entrance as well
So tell me what happened when you went to the RCO
When I went to the RCO
the meeting
I didn't have any objections
not too many people showed up
Right, okay
the people that actually
showed up agreed to it.
Let me ask you this.
Before you rented this
property, what was it being used
for then? It was
a non-profit
art school.
Okay. Thank you.
They was doing clay
stuff,
oil painting.
You can see it on the
right side of the building.
little pieces of mirror that's on the wall
that's some of the stuff that they were doing
inside of there too as well
questions for the board
yeah I have two questions one
are you using the garages that you
showed in the images
yeah as storage
all three or
no just one I'm sorry
the far right to the
the garage
yes the far right is it's three garages and i'm using the far right so to get into the garage you
have to leave the store walk down the sidewalk there's no through access through the building
correct no at all you have to come outside okay and then how long has your business been in
operation um i've been uh i'm working not there but uh in my grandma's basement since 2016
and then i have we had sold the house and i have rent this place since 2018 and then in the
silkscreen process um i know there's a number of chemicals that are used to treat the like the
of fabrics how are you handling the storage and the disposal of any chemicals related to the
dyeing process okay well um the the type of chemical i do use it's called it's plastic saw
ink and it's similar to like uh like paint but it's for clothes and um when it's time to waste
is that I have a solution product
where it's safe for
the sewage when
it's time to get it off the
screen.
